College of Ozarks request to sidestep anti-discrimination rule denied

Springfield News-Leader
A federal judge rejected the College of the Ozarks request to sidestep a 2021 directive backed by President Joe Biden that bans discrimination based on sexual orientation and gender identity.
Judge Roseann Ketchmark issued the ruling denying a temporary restraining order and a preliminary injunction shortly before 6 p.m. Wednesday, following a 2-1/2-hour hearing conducted virtually.
She said an effort by the conservative Christian college to stop the U.S. Department of Housing and Urban Development from applying the new directive would not protect the college from any liability related to unfair housing allegations.
The college and ADF argued the directive forced religious schools to violate their views by opening male or female residence halls  including dorm rooms and restrooms  to members of the opposite sex. ....

A federal judge has denied College of the Ozarks’ request to be exempted from a 2021 Biden administration directive that forces the college to violate its religious convictions by mandating that all living spaces, locker rooms, and bathrooms be open to both sexes.
The executive order stipulates that “all persons should receive equal treatment under the law, no matter their gender identity or sexual orientation.”

College of the Ozarks must follow Biden rule opening dorms, showers to opposite sex, judge rules

Judge Roseann Ketchmark, an Obama appointee, heard oral arguments from both sides for more than two hours Wednesday. After the hearing, she announced she would deny the college’s request to issue an injunction against the rule, which requires that segregated facilities such as dorms and restrooms be based on a person’s gender identity.
“After careful consideration of the law … the court denies the plaintiff’s motion for temporary restraining order and injunction,” she said from the bench. “The court does find that the dispute is not justiciable.”
The judge plans to issue a written order as soon as possible, she said.  ....
