New business models
Although it is early days, the new rules on whiplash claims and the launch of the new digital portal are prompting firms to reassess their business approach in this area, says John Cuss, vice-chair of the Law Society’s Civil Litigation Section Committee. The reforms, first announced by chancellor George Osborne (pictured) in 2015 and originally meant to come into force in April 2019, have been repeatedly delayed so many firms are still working on a wait-and-see basis. Others have exited the market (either altogether, or to focus only on the higher end), while some have evolved to adopt new funding models to serve lower-value claims, for example under either conditional fee agreements or damages-based agreements, according to Cuss. A small number of firms are also considering ‘unbundled legal services’ where they would provide a limited legal advice service on aspects of claims such as a complicated self-employed loss of earnings claim or a complex lia ....

Attorney General Brnovich Settles Race Discrimination Allegations with Uber, Postmates, DoorDash

Phoenix, Arizona - Attorney General Mark Brnovich announced today that his office (AGO) settled civil rights cases involving Uber Eats, Postmates, and DoorDash (Companies) regarding allegations of discrimination based on race. The Companies can no longer offer price distinctions based on a person’s race.
In Fall 2020, the AGO’s Civil Rights Division filed Divisional Charges against the Companies alleging public accommodations discrimination based on race. The Charges alleged that the Companies’ promotions to waive delivery fees for restaurants owned by Black individuals unlawfully discriminated against non-Black owned restaurants and their patrons, in violation of the Arizona Civil Rights Act (ACRA). ....

Arizona Attorney General Mark Brnovich announced that food delivery service companies in his state will no longer be able to waive delivery fees specifically for black-owned businesses, which he deemed discriminatory.

“Even with the best of intentions, corporations can do the wrong thing. Altering the price of goods or services based on race is illegal,” Brnovich said in a press release Wednesday, detailing a civil rights case settlement with Uber Eats, Postmates, and DoorDash.
“My office opened these investigations and pursued these settlements to protect civil rights and ensure businesses offer their services and products based on equal and neutral criteria,” Brnovich said. ....

BOISE Governor Brad Little announced Monday he appointed Boise lawyer Colleen Zahn to the Idaho Supreme Court, replacing Justice Roger Burdick, who is retiring June 30.
“Colleen Zahn is an experienced and talented lawyer with a broad range of knowledge on complex legal issues. She will bring beneficial insight to Idaho’s highest court with her extensive civil litigation background and longtime role representing numerous government agencies. I am confident she has the experience and aptitude to handle complex matters before the Idaho Supreme Court,” Governor Little said. ....
