When I last wrote my blog post, “New Jersey Marijuana Social Lounges,” in November 2018, the NJ adult-use recreational bill was in its infancy. Now that the state has finally legalized marijuana under the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (“CREAMMA”), I am duty-bound to update the blog on “cannabis consumption areas” or “CCAs” as defined in CREAMMA.
Many clients have recently asked me, “How do I open a marijuana social lounge?” The short answer is you will need to apply for a cannabis retail license when the applications are published by the newly created New Jersey Cannabis Regulatory Commission (“CRC”). ....

Mexico's Bill Amending Various Provisions to the Hydrocarbons Law

Article 51.- The permits referred to in this Chapter shall be granted to Petróleos Mexicanos, to other productive enterprises of the State and to Private Parties, based on the Regulations of this Law. The granting of the permits shall be subject to the interested party demonstrating that it has, if applicable:
I. A design of facilities or equipment in accordance with applicable regulations and best practices, and
II. Appropriate conditions to guarantee the adequate continuity of the activity purpose of the permit.

OK Privacy Bill Stalls; WA Privacy Act PRoA May Cause its Demise

After advancing steadily in their respective legislatures the first few months of 2021, the Oklahoma Computer Data Privacy Act has seemingly died, and the Washington Privacy Act may run into similar roadblocks it faced in prior years.
After passing the Oklahoma House in early March, the Oklahoma bill grinded to a halt the first week of April after Oklahoma Senate Majority Leader refused to allow the bill to have a hearing, as confirmed in tweets and in a press conference by one of the bill’s sponsors, Rep. Collin Walke. The bill, which would have required businesses to obtain consumers’ consent for any collection of data and included an opt-in requirement for sale of personal information, garnered bi-partisan support in the House but faced significant industry opposition and was opposed by Republicans in the Oklahoma State Senate. In response to public demands for greater equity and inclusion in the workplace, on March 23, 2021, Governor J.B. Pritzker approved extensive changes to the Illinois Humans Rights Act, the Illinois Equal Pay Act and the Business Corporation Act. The measures place new limits on employers’ use of conviction records when making employment decisions. They also require larger employers to obtain an “equal pay registration certificate” and submit diversity data to the State for publication. Illinois employers must act quickly to comply with the new conviction record requirements, and larger employers should begin preparing now for the new reporting requirements. FDA Notice Announcing Increased OTC Monograph Facility Fees

On March 26, 2021, the FDA updated and reissued the fee rates for the newly created over-the-counter (OTC) monograph Drug User Fee program (OMFUA) for FY2021 in a Federal Register Notice (FRN) titled “
Fee Rates under the Over-The-Counter Monograph Drug User Fee Program for Fiscal Year 2021.” The CARES Act, passed by Congress on March 27, 2020, established OMUFA, FDA’s newest user fee program, which granted FDA the ability to assess and collect two types of fees: OTC monograph drug facility (MDF) fees and OTC Monograph Order Request (OMOR) fees. 
The initial notice issued by FDA on December 29, 2020, was quickly withdrawn by the HSS amid controversy surrounding FDA’s plan to collect user fees from manufacturers, including liquor distilleries, that stepped up to meet the US (and world) demand for increased production of hand sanitizers under the Agency’s temporary enforcement policy during the COVID-19 pandemic.  ....
