Hershey Entertainment to pay $101K to settle federal minimum wage lawsuit filed by wait staff

Hershey Entertainment & Resorts Co. will pay more than $101,000 to settle a federal minimum wage lawsuit filed on behalf of 41 wait staff at its Houlihan’s restaurant in Hershey.
U.S. Middle District Chief Judge John E. Jones III approved that deal in an order issued Wednesday morning.
The settlement comes 15 months after a former worker, Randy Sicklesmith, filed the suit.
Sicklesmith claimed Hershey Entertainment was paying Houlihan’s wait staff $2.83 an hour plus tips and that their pay ended up below the minimum federal hourly rate of $7.25 because they spent about 30 percent of their time performing tasks that don’t generate tips, such as cleaning and sorting tableware. ....
