President Joe Biden was sworn into office on January 20, 2021. In just the first 100 days, the Biden Administration has begun its return to more labor-friendly policies, rules, and decisions, similar to those issued under the Obama Administration.
For example, on Day 1, immediately upon taking office, President Biden demanded that Trump-appointed National Labor Relations Board General Counsel Peter Robb resign from his post, and then summarily terminated him when Robb refused. The next day, Biden removed Robb’s replacement, the Deputy General Counsel, who had been named by the NLRB as Acting General Counsel. Biden also replaced Republican Board Member John Ring with Democrat Member Lauren McFerren as Chairperson of the NLRB. ....

The Biden Administration: Expected Changes At The NLRB | Husch Blackwell LLP

Given President Joe Biden’s commitment to strengthening labor laws on behalf of workers, the Husch Blackwell Labor & Employment group anticipates dramatic shifts in labor law interpretation, which may cause disruptions to business operations as employers negotiate these changes. Indeed, President Biden, in an unprecedented move, fired the NLRB’s General Counsel the day after his inauguration, and appointed a more union-friendly Acting General Counsel, Peter Sung Ohr. ....

While that transition will, no doubt, impact a great many national and global issues, the focus of this article is the potential impact that this dynamic will have on U.S. labor law and policy.
Those who have been monitoring labor issues since 2008 largely know what to expect. After four years of more management-friendly labor policy, today the pendulum has started to swing in the direction of labor, just as it did in 2008. How far the pendulum swings and how fast is yet to be determined, but all signs indicate the swing could be significant. On the eve of the election, Pres ....
