5 a.m. on this friday morning. thank you for joining us i m eric thomas. and i m kristen sze. hours from now ross mirkarimi will make a critical court appearance as he battles to get his job back. amy hollyfield is live at san francisco s superior court. reporter: good morning. not looking good for ross mirkarimi victory in court today. the judge issued a temporary opinion yesterday stating he doesn t look like he s going to be mirkarimi his job back. they will be in court to fight and argue this in court. mirkarimi is asking the judge to toss out his suspension. the city suspended him last month when he pleaded guilty to a domestic violence-related charge. today is his second attempt to get this worked out in court rather than a long battle before the ethics commission and the board of supervisors. city attorneys say they aren t surprised by all of this court activity. i think he is in danger in serious jeopardy of removal. of course it serves him to try and sh ....
