deadly path, a walk to school turns tragedy as a teenager is hit and killed by the train. it hurts, i looked back and she had passed way. reporter: tonight emotional reaction from a friend who saw it happen. hello everyone i m vic carter. and i m denise koch. here is what people are talking about today. the community is saddened by the death of a teenager who was hit by a train. kelly mcpherson talked to a friend that saw it happen. reporter: that friend says she was just a bit faster and missed the train. that s why she s the only survivor in this tragedy. reporter: when the train passed by, two kenwood high school girls were on the tracks. but only sarah harden survived. we were on the track and at no didn t hear it. i heard it a split second before she did, and i turned around. reporter: she flagged someone to call 911 but it was too late for anna marie hurley. reporter: you can see there s no fence here, they were walking because they had missed ....

accident. derek? reporter: speeding trains what are caused the young girl to die. a short while ago, her weeping mother was out here. she placed this cross here by the accident scene where earlier this morning one of the speeding trains cut her daughter s life short. at speeds at more than 100 miles per hour, amtrak trains ripped through this area. tuesday morning, just before 9:00, one of those trains struck and killed 14-year-old ann marie stickle, who was walking along the tracks with a friend on their way to school. they were walking parallel on the tracks. the friend that she was walking with that ann marie was walking with, was able to get out of the way, but ann marie was not. reporter: sky eye chopper 13 was over head as they removed her body. an area was clearly marked no trespassing, signs neighbors say are routinely ignored by area teens. the fans put new chains on it and they go back through there again. reporter: along some stretches of the train ....

mayor s uncertain future. it s more than 40 pages long. and cites juror misconduct. the defense wants the judge to throw out that guilty verdict against the mayor. mayor dixon believes she deserves a new trial. among the reasons they believe the last one was unfair. jurors were communicating outside of the jury room, including online, on facebook. let me believe reporter: shiron davis, also never disclosed during deliberations that she was charged with theft in the past. and juror number 3, shawona tyler, won a city sweepstakes which she had contact with the mayor, and she did not disclose that. they also said ron lipscomb not talking prejudiced the jury. now, judge dennis sweeney holds her fate in his hands. he s ruling on the motions and deciding the mayor s sentence. here you have very competent lawyers on both sides. and you have a very competent, straightforward, no bullet, fair judge. as wjz first reported, january 21st is the sentencing date. the ....
