We just learned moments ago that the storm has weakened just a bit to a category 3 storm with 125 mile an hour winds. Its lashing mexico with strong winds and high waves right now. Forecasters warn it could dump more than a years worth of rain across parts of california, nevada and arizona. The storm is expected to weaken as it moves north, but the threat is so severe, a Tropical Storm watch has been issued for california, the first ever for that state. People there are trying to prepare as best they can. Cnn meteorologist Allison Chinchar is joining us. A new advisory has just been issued. While it may have been downgraded a little bit, thats still very threatening. Right. Keep in mind the weakening was forecast. We knew as it slid into cooler waters, this was going to happen. this is america s newsroom. this all happened yesterday in orlando, florida. authorities say the gunman shot and killed his first victim around 11:00 a.m. she was a woman in her 20s as an acquaint answer of the suspect. bill: the gunman fled the scene and returned five hours later and opened fire on the reporter and photographer. they were rushed to the hospital. the reporter died of injuries identified as dillon lyons a journalist for spectrum news 13. dana: the gunman sphered a home and shot and killed a 9-year-old girl and wounded her mother. his actions were totally senseless. it is unclear why the suspect entered that home. we don t know what was in the mind of this suspect. and hopefully at some point he will talk to us about what his motives were. dana: the suspect was 19-year-old keith moses. he has a mile long rap sheet. bill: phil keating is live in miami with more on this. hello. good morning, bill. tragic story. the orlando police are withholding the

safety concerns for witnesses or it could impact on going investigations. prosecutors have until thursday to propose redactions, then the judge will decide whether they are reasonable. there are a couple things worth thinking about between now and then, even if we see the affidavit, it is just one side of the argument, the government s side. the target of the search doesn t get to appear in front of the judge or argue. the information has not been cross examined. secondly. it takes probable cause to search, but it takes a lot more than that to convict. whatever is affidavit may wind out to be true or certain. only the government participates in seeking a search warrant, we don t know and we won t know until both sides present their facts and test the echedz on evidence on the other side, we should ask ourselves why? why do we want to read the affidavit? how will it help us arrive at the truth? do we arrive at the facts. credible evidence is to move us to persuade us, can we s
