On Nodeep Kaur's plea, HC closes case | India News


CHANDIGARH: The Punjab and Haryana high court has closed the matter related to “illegal detention” of labour activist Nodeep Kaur after her counsel told the court that she would avail “other remedy” with regard to “maltreatment and custodial torture.” A medical report submitted before the HC had confirmed injuries on the internal parts of her body.
“The allegations with regard to illegal detention are no longer required to be gone into in view of the fact that there is an FIR dated January 12 registered against the detenue (Nodeep Kaur) and she has been released on bail. The said issue, if need arises, can be raised before the appropriate forum,” the HC observed while closing the matter. ....

Justice Ajay Bhanot observed that the rule of delay and laches, as a policy of litigative repose, creates certainty in legal relations and curtails fruitless litigation thereby ensuring that the administration of justice is not clogged by pointless litigation.
The observation was made while dismissing a writ petition filed after a delay of more than 4 years, by observing it to be barred by the rule of delay and laches, without there being any satisfactory explanation as to the delay.

Shiv Kumar case: Punjab and Haryana HC orders inquiry into alleged torture

The Punjab and Haryana High Court on Tuesday directed a district and sessions court judge to inquire into the allegations that Dalit activist Shiv Kumar was illegally detained and tortured in custody, reported
Bar and Bench.
Justice Avneesh Jhingan passed the order after examining four medical reports submitted by the state in accordance with the High Court’s earlier orders in the matter. A medical report submitted by the Government Medical College and Hospital to the High Court had shown that Kumar was subjected to torture when he was in police remand.
On Tuesday, Jhingan refused to comment on the medical reports, saying that any observation could affect the inquiry into the matter. However, the judge said that “it would suffice for this court to say that a probe is required”. ....

New Delhi: The Punjab and Haryana high court on Tuesday directed a district and sessions judge posted in Faridabad to conduct an enquiry into the allegations that labour rights activist Shiv Kumar was detained illegally and tortured in the custody of Haryana police.
Bar & Bench, Justice Avneesh Jhingan passed the orders after examining four medico-legal reports (MLRs) that were produced in court along with the status report dated February 27. ....
