tonight, we begin with a major legal setback for donald trump. after seeking to delay his classified documents trial until after the 2024 election, the twice indicted ex president has been met with major pushback from special counsel jack smith. trump s legal team had argued that, under smith s proposed timeline for the trial, which the cult unreasonable, a fair trial would not be possible and considerations should be paid to the fact that much of the presidents schedule will be consumed with campaigning. in effect, trump wanted to postpone the trial indefinitely and was using his presidential run as an excuse. but in a court filing this, week assistant special counsel david harbuck did not mince words saying, quote, many indicted defendants are demanding jobs that require a considerable amount of their time and energy, or a significant amount of travel. the speedy trial act contemplates no such factor as a basis for a continuance and the court should not indulge it here. in

county police chief and we also spoke with a the teen s brother about the incident. this is a picture of what police say they saw friday night. 18 year old kionte deshaun spencer walking along the area of electric and brambleton road. that red circle shows what appears to be a gun in his right hand. but chief howard hall revealed it was actually a bb pistol. chief hall: so you can see in this picture the weapon that our officers saw in the subject s hand and how it compares to the 9mm pistol chief hall says officers told spencer to put down the gun, but he did not. so an officer tried and failed to tase him, twice. that s when spencer turned around, with the gun still in his hand. chief hall: this was a deadly force encounter, despite the fact that we know now that this handgun was an air gun then, two of the officers shot at spencer. chief hall: the preliminary that he was hit once in the hip area and once in the collarbone or shoulder. i can t, what, what can happen? my b
in fact, he was waiting right outside of the roanoke county public safety building at the same time as the news conference. spencer was hoping to find out more about his brother s death. while the brothers didn t live together, spencer says . they talked about 4 times a week. the last time he spoke with his brother was just hours before the shooting. carl spencer, subject s brother: that s what makes it so crazy. and, that s another reason why i came here, because this is not sitting right with me. i ll never be able to get over him until i find out what happened. spencer says his brother lived in an independent living program and prior to that was housed in a local department of social services. we are still learning more information about this roanoke county officer involved shooting. an internal investigation is underway to make sure protocol was followed. we also reached out to the school and living program that spencer attended. we ll have more information tonight at 6
