windy and skies will cloud up. before a cold rain in our forecast for tonight. we'll talk more about that in just a few minutes. because, i think it will make a messy commute for tomorrow morning. >> we are looking good right now on yours thursday morning. we'll look at what things look like around 5:40 as you make your way around the north side of raleigh. i-540 and six fork road, that heavier traffic move ago way is westbound traffic. things much lighter at i-540 and ray road. a look at glenwood avenue and the overpass there at i-540. things look good in both directions there. this is the typical time without any major congestion from capital boulevard over to i-40 in the westbound lanes. that is some good news. we do have a minor accident just south of 540 and strickland road on forum drive and old lead mine road. doesn't seem to be causing any major delays in that area. we do have some delays as people make their way along the clayton bypass. no accidents reported so that is the good news. things are all clear in fayetteville. back to you. a the north carolina naacp along with southeast recall icommunity leaders plan to meet today. >> they plan to discuss their next steps in the akiel denkins case. he was shot and killed by appear officer trying to serve a warrant on monday. police say a gun was found near the body. many have expressed outrage over the shooting. way temple on home street at 3:00 p.m. this is a police search warrant. raleigh police officers were threatened the day of the shooting according to this warrant which indicates the threat was sent in an e-mail. also, the family spokesman says denkins' mother wants answers as she prepares to bury her son. >> it's been sad, heart breaking. he was only 24 years old, just turned 24. >> what we are asking is simply for the truth. >> bishop darnell dixon of buyback way temple plans to lead the funeral service for denkins tomorrow. the da at this point has not released the results of the preliminary autopsy report citing an ongoing investigation. today is the first day of north carolina's early voting for the march 15th primary. that is why we had the big music up top. cycle. but that is not the only difference and certainly not the biggest difference. mikaya thurman joins us outside one of the early voting locations. >> reporter: bill, the music certainly helped to enhance the energy of this. this is one of 360 early voting locations. you will be able to come here or to any of the others over the next 10 days. that will wrap up just around march 12th. can you vote for democratic or republican presidential candidates for governor as well as local races. a separate primary will be held on june 7th for the u.s. house of representatives a panel of federal judges last month ordered lawmakers to redraw congressional districts. they did but there wasn't ballots. encouraging voters to vote the entire ballot. acceptable forms. identification include a north carolina driver's license, a veterans or u.s. military identification or a u.s. passport or a tribal id from a state or federally recognized tribe. this is one of 360 polling locations. but say you forget your photo id. the state board of elections says can you come here and you will be given a provisional ballot but you will be expected to produce a photo id before your vote will count. >> thank you very much. filing a complaint with the department of education because immigration officials have refused to accept school work mailed to the riverside high school student and are not allowing him to use the computer according to his supporters. i spoke with immigration officials yesterday. they said they have not received any mail for the student. north korea fired six short- range projectiles off its coast overnight t came shortly after approved new tougher sanctions on north korea. this comes after a recent nuclear test and long-range rocket launch. defense officials say it could be missiles, arrest till railroad or rockets. there may be a new lead in the search for flight 370 in malaysia. they say debris that washed ashore in mozambique may belong to the flight. photos appear to show the fixed leading edge of the right hand tail section of the boeing 777. it also matches investigators' theories about where wreckage from the plane would have ended up. an american adventurer, blaine in our viewing area, it is a possibility for late tonight and tomorrow morning. probably not going to e more than an inch. we've had just the right mix of clear skies and clouds this morning for a pretty sunrise. this camera looking west and you can see some clouds. as the day wears on, we'll see more and more of this cloud tonight will be a cold, rainy night with a little snow up near the virginia line. 29 is our current temperature right now. our dew point is at 19. so it is cold. it is dry. it is actually not too bad out there. a pretty, pretty sky. 26 in henderson. 25 in roxboro. 26 in south hill. if we're going to see any snow, this is where it is going to be from roanoke rapids along this band up into virginia and maybe down over towards roxboro. the weather service is hinting they may have to issue a winter weather advisory for some of our northern counties. should not be a problem for us around the triangle, durham, chapel hill and raleigh and as you head south. our temperatures won't be quite cold enough. we are talking about three to four degrees and then it would be a problem. so be sure to tune in to greg and mike and i'll have an update during our noon newscast as well. 25 in sanford. 32 in fayetteville. we do have cold air in place. it is already beginning to snow back here in the mountains and right here moving towards parts of the sand hills, not necessarily our viewing area. most likely none of that is hitting the ground. that little piece that is sneaking out across ahead of the rest of this is not going to cause anybody any trouble. can you see some thunderstorms down here into parts of the deep south and this is our system that will arrive tonight to bring us the precipitation. that will mostly be rain but we do have the chilly air in place out ahead of it. we'll see increasing clouds through the afternoon. that takes us up through lunchtime. by this evening by about 7:00 being we'll have gray skies, snow falling in the mountains. as soon as you get out of the mountains and come down the hill, it is likely to be rain. that rain sticks with us well into tomorrow morning. at one point, one of the runs yesterday did show a nice little patch of blue up here. we haven't seen any of that this morning. but still, it is possible especially if the rain starts coming down a little more some snow from time to time. the only chance of snow will really be up closer to virginia. i don't think it will be much of anything that will create any impact. we'll see skies gradually clearing during the day friday but it does stay chilly. 51 this afternoon. increasing clouds and our chance of rain jumps up at about 9:00 or 10:00 to about 85%. it rains all night. we are still at 80% by 7:00 tomorrow morning. maybe a little mixing with some snow and then the chance of rain tapers right on off. it will be dry over the weekend except saturday night. there could be just a few sprinkles. our morning lows in the mid- 30s. afternoon highs in the mid-50s which is a little bit below normal but if you liked that spring weather that we started the week with, we'll start next week with that. we have a look at what is happening out on the roads this morning. working and in last minute decided not to. we'll go to the live commute map. we have been following an accident at i-40 westbound and lake wheeler where the aleast one lane was blocked. it will take you 13 minutes from nc up to the split. once you get to wade avenue and the 540, it will take you five minutes. as we take a look now, this is where the accident is on the south side of raleigh. you can see that backup. you will start to encounter that right at the 440 split. also tracking those delays which are typical this time of morning here along i-40 west and the clayton bypass. that is not adding a lot of significant a time to your drive this morning. we do have one other accident to let you know about. this is just north of the beltline on west millbrook road and creedmore road. because of that. over in carey, a look at u.s. 1 and walnut street. traffic able to move smoothly in both directions. starting to see heavier traffic on the beltline as people are making their way along the north side of raleigh. we'll check in with your durham drive times in about 15 minutes. new this morning, a lot of business executives are pessimistic about the economy this year. those are the finings from a survey by the american institute of certified public accountants. hundreds of business leaders have turned sour on the future of the economy especially in the south. the survey score has fallen five straight times since reaching a high point in the last quarter of 2014. the u.s. d labor will release its latest jobless claim numbers this morning. last week, 272,000 americans that was an increase of 10,000 people from the previous week's numbers. astronaut scott kelly back in the u.s. after nearly a year in space. kelly arrived in houston overnight. he was greeted by his brother and fellow astronaut mark along with scott's two daughters, his girl friend and sister-in-law arizona congresswoman gabrielle gifford. vice president joe biden's wife came bearing gifts, beer and apple pie. she says there is nothing more american than that. research from kelly's mission will help nasa's plans to travel to mars. the man convicted of killing two college students in virginia will not get the death penalty. instead, jetty matthew will die in prison. matthew pleaded guilty to first degree murder and abduction. in court, he apologized for the 2014 murder of uva student hannah graham and the 2009 murder of virginia tech student a judge sentenced matthew to four consecutive life terms. matthew agreed not to appeal and will not be eligible for parole or early release. an alabama police officer is charged with murder in the death of an unarmed black man. authorities say montgomery police officer aaron smith shot and killed a 58-year-old man outside a neighbor's home one week ago today. authorities initially said the victim hay stick or a cane and the two men had struggled. the neighbor says the stick was an extension handle for a paint roller. montgomery county's district attorney would not say what evidence led to the charge. the 23-year-old officer is being held on $150,000 bond. a federal appeals court judge may be under consideration for the u.s. supreme court. a source says the white house is considering jane kelly to replace the late antonin scalia. she graduated with president obama from harvard law school she currently serves on the u.s. court of appeals in cedar rapids, iowa. he spent two decades in prison for a horrible crime. >> but it was a crime he never committed. coming up, what howard dudley had to say about show identification. early voting ends march 12th. let's take a look at the weather for today. >> we're starting to see the clouds thickening up a little bit. it is a very cold start out there. there is a look at our raleigh skycam. you can see a little filtered sunshine. the temperatures are down into the 20s and 30s. we'll see a high this afternoon of 51. tomorrow morning, we'll see a temperature in the mid-30s. we'll see rain tonight that may mix with a little snow in places up near the virginia line. at this point, we don't expect any real accumulation but something we are watching closely. we'll see cloudy skies friday and 52. over the weekend, highs in the mid-50s and partly cloudy. commute map right now. we do have an accident on the south side of raleigh at lake wheeler road. you can see the backup there. a 39 minute ride from the 440 split out to u.s. 1 because of the delays. as you are headed towards downtown durham, things look all clear right now. >> thank you so much. north carolina's virtual charter school getting an next on fox other, how a north carolina man serving a life sentence is a free man this morning after a judge dropped his convictions. >> in court, the judge said the north carolina system failed howard dudley. dudley has been in prison serving a life sentence since 1992. you can see he was clearly relieved and full of joy. he was convicted for sexually assaulting his 9-year-old daughter but the state never presented any physical evidence. his now 33-year-old daughter admitted this week and actually several times in the past that she lied about those sexual assault allegations. dudley spoke after -- about the news after he left the hearing. >> it feels great. i'm excited and i look forward to moving on. >> moving on. dudley's family says they are looking forward to the family gatherings and a lot of quality time. judge parsons says dudley was trial because he was counsel. a south florida man is due in court in connection way $4 million heist on i-95. the fbi arrested aliberto perez but haven't said what role he played in the crime. armored truck. three armed men approached the guards, held them captive and stole 275 pounds of gold bars. a miami man needed guilty to extortion for trying to sell one of the gold bars. we are just one day away from hosting our annual attorneys on call. this is a chance for carolina connections academy will add tenth grade classes. this will be the school's first year of operation. it plans to add a grade each year as students age into them. the enrollment cap will also increase to accommodate the change. enrollment is currently under way. the state board of education is expected to tax i'll couple of pretty serious issues when they meet today. they will talk about the new report on crime and the dropout rate in north carolina's public schools. the crime rate report released last week says the overall crime rate in schools went up 1.5% in the 2014-2015 school year compared to the year before. the dropout rate increased 4.8% during the same time period. also during the meet, the state board is expected to recognize philip riggs, a music teacher at the north carolina school of he was named the 2016 grammy music educator of the year. an effort to preserve a historically significant landmark. the wood arrested school was the first high school for african-americans before integration. soon the property at south roxboro will be home to a new school. there is a groundbreaking this afternoon for the redevelopment t will include affordable housing and eight pre-k classrooms. mayor the state's largest cities are meeting today. annual metro mayors conference takes place in rocky mount. more than 30 mayors will discuss issues like economic development and public safety. it is held at the imperial center for the arts and sciences. a new garden is creating a positive message in wake county. employs at the camden street learning teamed up with members of the community to work on the project in southeast raleigh. the project teaches residents how to become more self- their own vegetables, herbs and fruits. katie murray says it provides more food security for the community as well as an important education on healthy eating. >> so we offer gardening classes. we offer gardening space. we offer cooking and nutrition classes for kids and adults as well and also teens. >> the principal financial group awarded a $20,000 grant to support the project. murray says they are hoping to start a new program next year to teach teens how to grow produce and then sell it as a business. the weather has certainly felt like gardening weather but today it changed a little bit. >> we'll have to wait about five days before it feels like gardening again. >> i do love gardening weather, elizabeth y i -- >> i do too. i love my snow but if it is not going to snow, it might as well be 70. sunrise here earlier. it is still pretty out there accident out there. or is that just a regular backup at i-40? >> we have the regular backup at i-40 but there is an accident here in this area. this is also a trouble spot yesterday morning about this time as well. so again, when we have already all of those drivers in this in an accident and we know higher chance of even more slowdowns when an accident happens. so it appears that at least one lane is blocked, probably the far right lane at this point. so as we take a look at what this means for your drive times, right now, it will take you 32 minutes from the 440 split on out to u.s. 1. that is slightly better. a couple minutes shaved off from when we checked in just a little while ago. we have people still making their way up through johnston county and they will continue to add to this backup. so we will let you know as soon as that clears. could you probably use tryon road as an alternate route around the south side of the city. but we know that that often gets backed up. so this is where that accident is here and again we can start to see the backups starting at jones sausage road at i-40 all in the westbound lanes. some people trying to avoid that by taking the beltline. you can see some slowdowns there but nothing major at this we do have one accident on capital boulevard at perry creek road. starting to see some of the typical delays as people are making their way south from wake forest at this point in the morning. as we take a look here, people are headed towards downtown durham, traffic flowing smoothly in both directions there. >> thank you. we'll be expecting to get an update on how the flu is impacting our state. a better vaccine and lighter flu season has led to far fewer deaths this year than last year. as of last week's report, four people had died of flu-related illness in north carolina since the start of the flu season. more than 200 people died of the flu last year. the season typically lasts through may. a protester attempts to steal the and board until march 18th. thousands of resident were forced to move out of the porter ranch area during the 16 high pressure week leak. the gas company says it appealed because public health officials have determined it is safe for resident to return to their homes. hulk hogan will be back in court today for a second day of jury selection in his civil trial against the gossip web site gawker. hogan is suing gawker for a hundred million dollars for publishing a sex tape of him personality back in 2012. the jury will determine if gawker violated hogan's right to privacy when it published the video of the former professional wrestler having sex with his best friend's wife. at least eight u.s. airline carriers have submitted applications for routes to cuba. the government will spend the next few months reviewing the requests and is expected to award the contested havana routes this summer. flights to smaller cities in could you be could be approved much sooner. currently all plates operating between the two countries are charter flights. starting next month, you will not be able to use e- cigarettes on commercial flights. passengers on carriers going in or out of the u.s. already prohibited from smoking tobacco cigarettes on board. you hear the flight attendant say that at the beginning of the flight each time. final rule clears up any cigarettes fall under that crescent moon and already, it is really clouding up in the western part of our viewing area. you can see the gray skies there in durham this morning. it is 29 degrees. a northeast wind at 3 miles per hour so if you have a meteorological brain, you may say wait a minute, it is 29, clouding up. what is the chance that we'll get something frozen out of these clouds that are approaching. the answer is the chance is not great. the chance isn't zero but it is not great. we'll talk about that over the next couple of minutes. the dew point is 19, very dry at the moment and quite cold, 27 in south hill. 28 in roanoke rapids. 29 in chapel hill. it is 32 in smithfield. 30 in southern pines and 32 in fayetteville. almost everybody below freezing. we had the cold air come in yesterday behind the front that brought us the rain for yesterday morning. an here comes another one. this is a fairly active pattern that we are in right now. we'll see this system for tonight. another one for saturday night. but saturday night's system will look nothing like this. it may bring us just a quick little shower t won't bring us the amount of rain that we'll see with this which could be up to 1/2 inch of rain. the mountains could get 3 to 5 inches snow from boone northward up into virginia. we've had thunderstorms with this system now moving into northern alabama. as can you see, the rain with this, well up into illinois. so we do have some warm air that will be associated with this. just enough so that we have very little frozen precipitation in our forecast. if you liked the 70s from sunday, monday and tuesday, they will be back for tuesday and wednesday. a little pattern coming in, it our chance of rain is not great. it look dry from monday, tuesday and wednesday. we may see rain a little later in the week. the rainfall trend is only just a little above normal. rainfall for tonight is pretty much a sure thing with that front approachings us. 84% chance of rain by 10:00 p.m. it will be rain as it kicks off. and then during the day on friday, that chance really drops off. we'll wake up to some rain in the morning. our temperatures will be in the mid-30s. we are looking at three, four degrees and it would be something frozen. the heavier the rain falls, better chance it will be some snow. the best chance of that will be up near the virginia line and at this point t would be less than anen. probably not anything that will cause problems for the morning commute but don't be surprised if up around roxboro or henderson or south hill, we see some snow mixing with the rain. friday and saturday from 11:00 to 2:00 is the durham bulls fanfest. can you buy your season tickets for the year. pick out the seats you want. they let you do some batting practice, run around on the field. it will be a little cool and it will still be a fun time out there. the home opener is april 7th. that is just about a month from now. it will feel like spring tuesday and wednesday with those 70s. tara is here talking about traffic. i know yesterday there was trouble at that same spot at i- 40 at lake wheeler. what is going on there? >> of course, it only takes one accident and if it is in the fortify work zone, you can pretty much guarantee there will be a big backup. the good news is all three lane are back open on the westbound side of i-40 at lake wheeler road. that accident moved over to the shoulder of the road so there are still some flashing lights and people are staying slow as they are moving through that area so that the emergency crews can stay safe in that area. so in terms of your drive times, we are seeing things improve. it is now down to 20 minutes and just about five to 10 minutes ago, it was up to a 30 so now that all three lanes are back open, we should see the drive time slowly improve. taking a look at our live commute map, not too bad around the triangle. we are seeing some of the typical delays around the beltline on the westbound side, seeing some traffic pick up here on 540 but things have been all clear in durham this morning as people are making their way towards downtown durham and also using the durham freeway. you should not have any major issues in that area. as we do track another dent on the north side of raleigh, near capital boulevard and perry creek road, but not causing any major deliz in that area. that is some good news. we'll take a look at some of the other issues we are seeing around the triangle. all that become jean still due to the accident from i-40 stilling on over past the 440 split. >> thank you very much. good morning. bill leslie here with your top stories. governor mccrory's campaign and the connection nc committee are asking state elections officials to dismiss a formal complaint suggesting the
