everybody. bo minnick, wncn news now. in the last half hour, we learned from senate leader phil burger's office that a judge has given the plaintiffs in the redistricting case until noon tomorrow to respond to the state's request for a stay. we'll keep you updated. well also tomorrow, much colder temperatures return to the area. tonight it's rain. chief meteorologist wes hohenstein is tracking the rain and joins us with the latest. >> good evening to you and you at home. it was dry most of the day. now showers have moved in. and they're also on their way out depending on where you are. they cleared a good portion of the area. but rain with heavy down pours, nothing severe and nothing flooding is what we're in for for the next few hours. along the i-95 corridor from the virginia border through wilson and rocky mount into wayne county, the heaviest rain sampson county. and in another few hours, these showers will be clear. but so will any thought of warm temperatures. today we made it into the 50s. we won't see those numbers for 30s and 40s now. and we could see 20s by tomorrow morning because of this cold front that will move through over night that will really drop our temperatures. so we're down to 40 at 8:00. still with some rain. dry and 37 at mid night. out the door tomorrow morning, 32, that's going to feel like 26. we'll talk about how long these cold temperatures will stick around in a few minutes. a raleigh taxi driver was morning. tonight the killers are still on the loose. police say it happened at 1:30:00 a.m. at the hodges apartments in northeast raleigh. the victim, 55-year-old jose went to pick someone up there. david hurst is live at the scene tonight with the latest on the investigation. david? >> magie, the man who called 911 told dispatchers he found the body in this parking lot behind me. he says the boy body was unresponsive and not moving. the deadly shooting has many neighbors in this apartment of a devoted taxicab driver. i'm sad. because he was a good friend. those who new him say the 55- year-old had been a taxi driver for decades and they're struggling to wrap their minds around how something like this could happen. >> my brother said hey joaquin, got killed. i said i don't know nothing. and then i called a close friend and he told me, yeah. >> reporter: police found his body in a parking lot at the hodges creek apartments early monday morning. >> i woke up. i saw a male laying there. he was not moving. >> reporter: investigators are looking into a possible motive. it's not clear if the shooting stemmed from a robbery attempt. >> i heard someone got killed here. it's very scary. >> those who live at the apartment complex say the shooting made them uneasy. >> i had that taped off. that taped off. i've never seen anything like this before. and this is a very nice quiet area. police believe multiple individuals are involved. but the only description they have now is that the suspects fled in a white car. >> i'm alone in the house, it's scary, but i have to be more careful. >> reporter: this half of the apartment complex has been blocked off for the majority of the day. police just recently opened it back up. earlier this afternoon, i spoke with coworkers who wanted to come down here to lay candles and flowers for a memorial for dominguez. but they were unable to. they tell me he was passionate about his job and was loved by many here in the community. reporting live tonight in raleigh david hurst, wncn news now. graphic testimony today in the melissa huggins jones murder trial. jurors also heard about the lengthy interrogation of the man charged with her murder, travion smith. steve has the story from downtown raleigh. >> reporter: at the travion redden were arrested, the trio were questioned separately by police. >> when you were speak with the defendant, travion smith, do you know about how long that it was you spoke with him? >> approximately seven hours. >> you can be a witness and cooperate or you can be a potential suspect. >> defense lawyers had objections to playing the tape. the judge ruled that edited portions could be shown to the jury to in his words explain the investigative process but not to determine the truth of what smith was saying. >> we wait for ccbi to arrive. >> the lead investigator testified about graphic injuries he found on melissa huggins jones when he entered her apartment which he said was bloody and appeared ransacked. >> her face was appeared to be smashed in. teeth were missing. the teeth that were there were not -- appeared to not be in the proper place. there were puncture wounds >> it's anticipated that more of that interrogation tape will be played for the jury tomorrow. in the mean time, the prosecution has told the judge thursday. i'm steve, wncn news now. a fort bragg soldier accused of killing his wife appeared in court today. the incident happened saturday in fayetteville. authorities say jesus called 911 asking for help. when deputies arrived on scene they found him in a neighbor's driveway. he took authorities to his home when they found his wife mary unresponsive on the floor. >> there's no telling what went on. it's heartbreaking for the community here to be sitting on the outside wondering what we could have done to reach out to them more. but many people tried. >> he's charged with second- degree murder. a judge set his bond at $500,000. right now roxboro police are searching for a killer after a woman was found stabbed to death this morning. stewart stabbed nola bentley. officers found her body this morning at her home. nearby schools were placed on lock down as a precaution. anyone with information is urged to call police. the medical examiner's office ruled the shooting death of a harnett county man by a deputy a homicide. deputy nicholas shot and killed john livingston during an incident at his spring lake home back in november. deputies say they went to the investigation. according to affidavits, the deputy shot livingston after he says livingston went for his stun gun. so far, no charges have been filed in this case. a driver faces dwi charges tonight after police say he crashed into a wake county school bus this morning. it happened about 7:00 a.m. parkway. the bus driver was taken to the threatening injury. authorities charged jeffrey in connection with the crash. durham police identified the man found dead in an over turned car this morning. a vehicle partially under water on nc 54 near garrett road. officers found 25-year-old nelson dead nearby. police say he was not wearing a seat belt and that the crash happened sometime during the early morning hours. meanwhile, governor pat mccrory suffered minor injuries during a crash last night near the super bowl. authorities say a mercedes hit the governor's car from behind. despite the car being totaled, pat mccrory was able to continue on to his destination in another vehicle. california state troopers say the crash is still under investigation, so far no charges have been filed. controversy brewing over the dress code at a durham school tonight. next at 7:00, why some parents say the principal disrespected a cultural tradition. and what they want to change because of it. plus the panthers crushing loss in super bowl 50, we'll break down quarterback cam newton's but monday will be the warmest i'll tell you what are, this is wncn news now at 7:00. a heated protest outside a durham school this afternoon with parents calling for a change to the student dress codes. this all comes after the principal of the school for creative studies told students to remove a cultural head dress, mario boone has the story. >> y'all are young, gifted and brave. >> school for creative studies principal renee price came under fire monday from about two dozen protesters. >> y'all are young, gifted and black. >> outraged after price recently demanded several female students remove a cultural head dress. >> they're having to alter who they are to assimilate in society. and i don't feel that's right. >> for one hour the parents rallied outside the cafeteria with dps permission in full view of the students inside. >> everyday is black history month. >> speak it. the entire head, it could be a situation where they may have had weapons. >> durham public schools does ban students from wearing head dress, except for religious and medical reasons. in this case, school leaders said the girls failed to get permission before wearing them black history month. the parents who showed up here at the protest told me it's bigger than the red wrap. they're demanding durham public schools change the dress code. >> the solution is for them to express themselves culturally. >> their message has all ready gone up the ladder to the superintendent who issued this statement to wncn saying the parents concerns will be shared with the committee currently considering revisions to the student code of conduct. in durham, mario boone, wncn news now. durham school board members plan to discuss revisions to the student dress code thursday at 4:00 p.m. more relief is coming to students victimized by for today president obama announced new steps to investigate potential abuse and fraud committed by these institutions. the government did not move quickly enough to take action against for profit schools that left thousands of students with hefty debt. chipotle closed all its locations nationwide to go over food safety procedures. the company also revealed that sick employees are to blame for norovirus out breaks. and that tomatoes are likely behind the salmonella out break. in response, chipotle is offering workers paid sick leave so they can stay home if they're feeling ill. snow fell in the western part of the state today. look, it looks pretty there. this is video from sparta. boone could see up to 4 inches of snow making travel dangerous. it's shaping up to be a rough commute tomorrow where freezing temperatures and wet spots could lead to slick road conditions and fortunately we're not looking at any snow sticking here, right wes? rest of the week is the cold temperatures. it doesn't look like there's enough moisture to come with the cold temperatures to give us a lot of talk of snow. we have a little talk of snow. but not a lot. >> that's good. let's start with the rain tonight. magie, as you can see, and probably hear and maybe even you have driven through, there are some showers, some heavy down pours moving through from west to east. nothing severe. nothing flooding. and null you can see, they're high tailing it out of here. you're in the clear. at least in the dry in the western half of the viewing area. but east of the triangle from up in the virginia border right down i-95 and take a turn down 40 south wayne county samson county getting heavy showers right now. by 11:00, this rain should be all the way out of here. and definitely gone by tomorrow morning's commute. but you know what else will be gone? the 50s we had today. that's the warmest day we'll have for the next week to ten days. today was in the 50s. we have 30s and 40s out there now. it's going to be breezy tomorrow along with the cold temperatures. it's not going to feel really good on tuesday. we have the rain in the forecast for the next few hours as we go hour by hour, dropping down to 40 at 8:00. 39 at 10:00. then the winds pick up. we'll put temperature over windchill. even though it's going to be dry past midnight, look where we wind up tomorrow morning, 32 on the thermometer. technically warmer than this morning. but it's going to feel like 26. it's essentially going to feel the same tomorrow morning than it did this morning a couple things we're watching on the big picture, the rain moving out tonight, there's the cold front that moves through over night. you see a lot of snow. you're like that's going to come here, right? that's not the case. we have a small chance of precipitation tomorrow. and an even smaller chance that a few flakes could mix in. like i said, the bigger story, the cold temperatures move in tuesday and don't move out for a week. let's pick up the weather map later tonight at midnight. the cold air seeps in as the front moves through. by tomorrow morning's commute, we're dry, a lot of us see sunshine, but it'll be cold. time tomorrow. a little disturbance in the upper atmosphere could throw a little moisture at us. we're thinking light rain and sprinkles, triangle on north. be dry. but because it's going to be cold and much colder in the upper atmosphere, i wouldn't be surprised if there were a few flakes. not going to accumulate. issues. excitement. that's tomorrow afternoon. by tomorrow night, we're dry, we clear out. and then we get reinformants of the cold air that you will feel wednesday and beyond. let's show you what the cold air looks like, temperatures on wednesday, probably not out of the 30s. we get another blast as we head into the end of the week. and watch what happens this weekend. we really get it. so far our coldest day this year, this winter has been 32. coldest morning has been 18. i think we're going to beat both of those numbers as we probably not rebounding until the middle of next week. all right. so it's going to get cold. and it's going to stay that way. tomorrow we're in the 40s. we do it with breezy conditions and just that small chance of precipitation i told you about. and maggie 44 is warm compared to 38 wednesday. 36 thursday. but wait, that reinforcing shot i talked about will be here just in time for valentine's day when the high will be 32 this sunday. morning temperatures of 17 degrees. that hopefully will be and is so far the coldest temperatures we've seen so far this season. >> find somebody to keep you warm on severe valentine's day. super bowl 50 is in the history books. coming up at 7:00, we'll look at cam's performance and bizarre press conference. bowl without well there's only one word you can use to describe super bowl 50 if you're a panthers fan and that's disappointing. let's take a live look outside bank of america stadium where the panthers just arrived home. now, you can see lots of fans there to greet them. still, they had a pretty good season so fans there, not too disappointed in their team. they lost to denver in santa offensive miscues and mistakes. they look to return a strong squad next year led by the return of wide receiver kelvin benjamin. the loss hit cam newton hard. cam newton stormed out of his press conference. >> cam newton's body and psyche took a beating at the hands of the nfl's top ranked defense. today newton's reputation is getting hit just as hard after his post game melt down. >> they just played better than us. i don't know what you want me to say. >> newton's body language showed the frustrations of a quarterback sacked, hit, hurried and harassed. a tough day on the job ending like this. >> the new york times wrote a piece today that ripped him up. >> mike makes his living as a marketer. he helps put companies and their athletes in their best light. cam could have used his help. >> as the nfl's mvp this year sometimes you just have to say, i've got to stick this through. tough questions. >> panthers fans while disappointed in the loss say they can understand cam's reaction. >> he wasn't expecting it to go that way. i can understand the frustration and i understand it's a tough loss. a tough pill to swallow. >> but it's a pillow many players before cam had to swallow and they didn't walk off the stage. as the face of the panthers franchise, newton's actions are sure to leave a mark but in the end -- >> this will quiet down. cam will come back to being cam. and the opportunities for marketing will be there. they might be less right now than they were if he had been a little bit more humble. >> super bowl ads. >> i don't think there was a winner this year. it was pretty safe in general. it was fairly vanilla. >> experts say that may have to do with the pressure that connellsvilles with the commercial's 5 million-dollar price tag but comedy seemed to strike a cord this year. hyundai's first date with kevin heart was number one in the ad meter rankings. >> you have to use the right celebrity i think. it has to coalesce with your brand or reach your demographic that you're trying to target. >> at the bottom of the rankings were a pair of ads from drug companies and mountain dew's puppy monkey that's a little creepy well some exciting changes are coming to wncn at the end of the month, today our anchor team got a chance to visit the cbs headquarters in new york. now starting february 29th, the price is right, and march madness. you can see they're meeting with scott pelley, meeting with the cbs this morning team. i know they had a great experience up there. and we're
