all students and faculty who have a license. an 18-year-old who was approximate being watched inside of a home daycare is now at home with his family recovering after being shot. the drive-by shooting happened yesterday afternoon on great bend drive in durham. the daycare is now closed. that's where we find wncn.com's mario boone. what did they tell you? >> reporter: i talked to the daycare owners about what happened here at this home behind me. indefinitely. they say they want to take some time and let things cool off. they also tell me the little boy is home from the hospital and is doing much better. they're withholding the child's name at the request of the meanwhile, we walked up and down the streets of this neighborhood and it's obvious, people here. a lot of the residents told me they did not want to get involved, and did not want to talk to us. a few folks who did talk to us, said they would only do it if we didn't show their faces. >> it's a dangerous situation. should be more protection in the neighborhood. >> we checked with durham police earlier and we are told that there have not been any issues here at the home in the past year, since january of last year, so of course we will continue to monitor the story. right now, we are also told that no one has been arrested. reporting live in east durham. i'm mario boone. we checked with the division of child development and early education. that's the agency that keeps track of life centers. taylor's christian center was indeed licensed and considered a five star facility. no charges will be filed against a bus driver who police say hit and killed a golds bro elementary school teacher. it happened when ray bates was driving a bus to drop off kids. today, the wayne county district attorney's office made the final decision not to charge bates. kincaid was a second grade teacher at the school. breaking news, lawmakers are headed back to raleigh to redraw congressional districts in the state. one of the runs from durham to the northeastern corner of the state. the other is a long, thin ribbon from charlotte to greensboro. all three judge panel says these districts were created using race as the main factor but with the primary just around the corner, time is running out. wncn's political reporter joins us live to explain the next steps and how this will impact next month's primary election. >> reporter: governor mccrory called for a special selection which will start tomorrow on redistricting. the republican led general assembly has waited as long as it possibly could to try and get a delay from the u.s. supreme court, in enforcing this order, but at this point, without that delay granted, they need to move forward with their plans. >> this is an abomination. >> senator blue appeared to want to try to create something that does not exist. >> reporter: you're hearing there from lawmakers who just wrapped a committee meeting. the proposed map has numerous statewide changes, and really every county will have at least some parts that are going to see some changes to the congressional districts. so again, this was approved in committee today, it now has to be voted on by the full general assembly, which lick lie will take place over the next two days. this change would impact the congressional primary, which happens in less than a month. >> the reality is we're having an election on march 15. we're making sure that we tell people, request your absentee. we're moving forward until we receive any other direction. >> reporter: statewide more than 1900 absentee ballots have already been returned. what you're looking at is more than 200 ballots that have already been returned in wake county. now republican lawmakers have repeatedly told me that this is not going to impact the presidential primary, which is allegation on march 15. take a look at why this would likely mean two separate elections. two primaries, including a later one that would take place for the congressional primary. live in raleigh, wncn news now. life or death, those are the options for a jury in a north hills murder case. the sentencing case started this morning for travion smith in the death of melissa huggins- jones. the mother of two was murdered in her home in 2013. she recently moved to raleigh with her daughter from tennessee. huggins-jones was killed in her bed while her daughter was asleep next door. today, the jury heard from the daughter. >> reporter: sean, prosecutors say that travion smith should get the death penalty because of the brutal nature of the murder. but the defense is saying there are mitigating stances that the jury must take into account. >> we ask that you remember the brutal killing in the autopsy photos which were difficult for determining whether this crime was especially heinous, atrocious, or cruel. >> reporter: with that, the prosecution brought melissa huggins-jones 10-year-old daughter to the stand. the judge did not allow cameras to photograph hannah jones, who recalled her mom as funny, giving, and loving, as she described finding her dead mother in bed, audible crying could be heard from family members in the courtroom. >> reporter: the defense claims travion fared no better with his bad. >> he got no stability, no structure, and rather got abuse from his dad. >> she would slip alcohol in their bottles, or whatever she could to get them to go to sleep, so that they would get tired, or she would slip some have a sleep aid to it, so she could do what she wanted to do. >> reporter: the defense will continue calling witnesses tomorrow, they expect they may be able to wrap up by tomorrow also. in the meantime, we have to tell you about the testimony of little hannah. it was very compelling, and coming up at 7:00, between these arch rivals. duke has had the better of this rivalry for the past few years. of course duke won a national championship last year and that kind of sticks in the claw of felt like they could win a title. >> three straight losses to duke does not sit well with north carolina senior marcus paige, but seeing the blue devils win a title last year hurts more. a sweet 16 loss to wisconsin the timing couldn't be better for us. it's a great way to get national exposure. >> reporter: they should have no trouble finding guests. according to expedia, 45% of rooms in raleigh are already booked for the first weekend of the tournament. >> obviously, the excitement is there. >> no matter who we have, it's a big event. >> reporter: he crunched the numbers from the last time raleigh hosted the tournament in 2014. more than 17,000 visitors to the area spent more than $7 million. those visitors accounted for 10,000 hotel room nights. >> we wanted tower visitors to raleigh feel like this is a big deal in our market. >> we're really excited its back. it's a big event. the ncaa has got a manual this thick, and between us and the university, we have to do. >> reporter: he says only about 20% of tickets are left. the arena can hold just shy of 20 though people during a game. >> we have on two occasions led merchandise sales to the entire tournament on our first and second rounds. >> reporter: sales are on the minds of the crossmans too, working like mad to get them out there by march. >> you don't have to have a chain anymore, if you offer a great experience, the word will from there is right at the bottom of our screen, so maybe we'll zoom on her a little later. the temperatures are going to be cooling off in the next couple of days, including tonight. the few clouds will go away. we've shut the radar off, it's going to be dry through the weekend, but it's going to be chilly tonight as we go hour by hour, we'll drop down to about 44 at 8:00, 39 at midnight, and you're out the door tomorrow morning with temperatures around 32 degrees. so it's going to be cold tomorrow morning, but it's also going to be dry. so a little bit of rain early, early this morning as well as this cluster of low pressure and cold front, that has now pushed away, but we're still getting the reverse flow from that low pressure system. along with high pressure to our northwest. they're kind of working together to bring some cold air down to us. so that's why it's going to be chilly over the next couple of days, but it's not going to last forever as we look into thursday and friday, we'll continue that northerly flow. sunny skies, dry weather, but staying chilly with temperatures in the mid- to low 50s. that high shifts around on us this weekend, brings our winds more out of the south. sure, there will be a couple of extra clouds, but it will be much warmer outside, as we get close to 70 degrees. then that area of high pressure continues to scoot away. as we get into next weekend, i'm talking monday, tuesday, and wednesday, a couple areas of low pressure with a cold front move through, and that means wet weather for most while it will be cooler, it all of that precipitation wet and nothing else. that's of course, as you know, not written in stoning about 5 to 7 r -- stoning stone being5 to 7 days out. 53 in fayetteville. your seven-day forecast will take us from the 50 degrees tomorrow, up to 52 friday. 66degrees on saturday. watch out, those morning temperatures still kind of chilly tomorrow morning, friday, and saturday morning. we'll duplicate that 66
