condition after she was struck by two cars in north philly. the driver of the first car stopped but the second one took off. this happened around 4:00 this morning at broad and venango streets. police are still searching for that hit and run driver. we will continue to follow this breaking news and continue to bring you updates. strike, good news. septa and the transport workers union reached a tentative two-year agreement. nbc10's matt delucia is live in philadelphia at the septa stays in frankfurt. matt, yesterday was really the deadline for the septa union. >> that's right. both septa and the transport workers union stayed until after 11:00 last night harmering down that deal. what that means is that riders who take septa bus, trolley, and subway lines, they will not have to worry about getting a ride. we're talking more than 900,000 of those riders. a strike had been threatened by wtu president willie brown, since contract negotiations had been moving slowly for the past seven months. earlier this week you will recall both sides said they were very far apart on the negotiations, especially on pensions and now there is a deal just within the past few hours. it's not a five-year contract that was expected but two years. willie brown said there were too many issues to deal right now so this gives them time to, in his words, work all of that out. here's septa chairman pat talking about the bargaining late last night. >> thanks to the riders. thanks to the union, how it got worked through and it was worked through in a business like manner. i think we have a good agreement tonight. we'll have to wait for the ratification. i think it's the right thing to do. >> now, as we look live once again this morning here at the frankfurt transportation center. you see the buses out there that continue to roll this morning and riders have been expressing relief. many who i've been talking with over the past week said a strike would definitely have left them in a stranded situation or at least in a very decision. up next, now, the union, as you just heard, has to ratify this contract. that could happen this coming friday. but just in talking with some of these riders they say, you know what, this is great news. especially on a dreary day like this. and we'll hear from some more of those riders coming up in the next 30 minutes. now we're live in frankfurt, matt delucia, nbc10 news. new from overnight. philadelphia police are investigating a shooting in the city's frankfurt section. one person was shot just before 1:00 this morning at oxford avenue. authorities tell us that the victim was not seriously hurt. police had not made any arrests yet in this case. u.s. marshals say they were following a hunch when they captured accused cop killer eric frein. they arrested frein on thursday night at this abandoned airplane hangar in tannersville, monroe county. a task force command we're tus marshalls says his team figured if they were on the run they would hide in a place like that. the nbc10 investigators did some digging into his arrest and obtained a copy of the radio transmissions of state police when frein was taken in. take a listen. >> cherry lane road. subject is in custody. handcuffs. they're going to go to the hangar and make contact with the marshalls there. confirm, the subject will be held blooming grove, car two is en route with corporal dickson's handcuffs. he will be there in approximately 20 minutes. we'll stand by until that takes place. >> the final radio transmission was made from fallen trooper dickson's patrol car. it said the cruiser was headed to the police barracks with, quote, one package in the back. state police estimate that the frein case has cost them roughly $10 million. we did the math and that's about $208,000 a day. that amount could continue to climb as the investigation is still on going. some more trouble at a high school in bucks county this morning as police investigating sexually explicit pictures and texts that they say were sent by students. according to officials this happened at neshaminy high school where the commune i can celebrated homecoming last night. police say they were tipped off friday afternoon by students who saw the inappropriate photos on classmates' cellphones at school. we are told that some of the alleged texts including nude images of other students. >> i think kids today just walk around with their cellphones. they're oblivious to everything that happens around them. they think they're above the law, above morals. >> parents of this students involved are being notified as the investigation continues. meanwhile, school officials say that this latest incident is separate from neshaminy's problems earlier this week when inappropriate messages were posted on an anonymous message board at called yikyak. today in montgomery county, one small community is expected to lose half of its police force when six officers will be laid off. a judge rejected an injunction by police officers in franconia township. the union tried to get a tech rare injunction to stop the layoffs. the union alleges that the township violated labor laws by refusing to bargain with police before the cuts were made. now to news to medical mission to help the fight to fight ebola. it comes from our area where folks will ship supplies, books, and toys today to some of the areas hit hardest by the ebola virus in liberia. they say a variety of local groups came together to help collect the much needed materials. now to news on that nurse who has been refuse that quarantine. a legal victory for her today. a judge in maine has ordered that kaci hickox does not have to stay home for the rest of her 21-day quarantine period but the judge says she must continue daily self monitoring and she must coordinate any travel plans with state officials. hickox went on a bike ride and talking to reporters. meanwhile, nearly a month after thomas eric duncan died of ebola in dallas there is a dispute over what's left of the con at the present times of the apartment where duncan was staying. nearly all of the items were incinerated but the ashes sit in limbo at a texas facility. yesterday officials in louisiana successfully fought to keep them out of a landfill there. the cdc insists that the ashes pose no danger. whooping cough is the concern these days at a high school in montgomery county as there is another case of the respiratory infection among students. school officials are not giving many details about the student but warned that ore this kids at the high school may have been exposed. now, this, by the way, is the second case of whooping cough at w wissahickon high school in less than two months. now to decision 2014. the countdown is on. it is the final weekend of campaigning before tuesday's election. nbc10 is following key races in pennsylvania, new jersey, and delaware if l delaware. tom corbett will be spending his saturday campaigning in central and northeastern pennsylvania. while his democratic challenger tom wolf will be making several stops in our area today. he will spend the first part of his day talking to voters still under way to prepare for such attacks. this amp an airport review of the november 1st incident last year found that emergency response reaffected by communication and coordination problems. now to developments of the abduction of university of virginia student hannah graham. a lawyer for the man accused of the crime says that he wants his client to be evaluated to determine his sanity. that request came yesterday during jesse matthews' arraignment in an unrelated sexual assault case. matthew is charged with abducting a 26-year-old woman in 2005 and assaulting her. the judge took no action on the request for a psychiatric evaluation yesterday. matthew has also been charged with abducting graham with the intent to defile. the 18-year-old uva sophomore went missing in charlottesville in september. her remains were found more than a month later. let's head now to washington state where another teenager who was wounded in that high school shooting last week has died. officials say 14-year-old shaylee churckulnaskit died. the shooter died of a self influi inflicted gunshot wound opened fire in the cafeteria. the trial for a 17-year-old boy accused in a stabbing at a western pennsylvania high school has been post poened. alex hribal was supposed to be in september but his attorney asked for more time. the trial won't take place until at least march. hribal is charge with stabbing 20 students and a security guard at franklin regional high school in april. it is being called a huge setback for a company reaching into the upper atmosphere. officials are trying to figure out what caused virgin gal lactic space ship 2 to explode during a test flight over the mojave desert. a photographer who witnessed the crash says that space ship two exploded after a plane designed to take it to high at released it and the craft ignited the rocket motor. >> it a. white puff immediately at that point. i knew that something had went really horribly wrong. >> space police are also investigating a deadly crash in the logan neighborhood. nbc10 was on the scene at sten on the avenue and logan street with the driver of the car crashed into the pole. the driver died in the accident. investigators are now trying to figure out exactly what led up to the crash. this morning septa riders do not have to worry about how they'll get to work next week. a deal was announced late last night between septa and the transport workers union which means no strike. nbc10's matt delucia is live at the septa station in philadelphia's frankfurt neighborhood. matt, you've been talking with riders this morning. they must be relieved. >> reporter: yeah, and most are happy, rosemary, that they don't have to find another way to get to work or school or wherever they need to go in the coming days. and septa and the twu, they were at the bargaining table until late last night, after 11:00 p.m. this is what it looked like just before 11:15 when the negotiators finally walked out of the old city hotel where they had been hold up for several hours yesterday. a strike had been threatened by wtu president willie brown saying contract negotiations had been moving slowly for the past seven months. earlier this week you'll recall both septa and wtu local 234 skad they were very far apart, especially on pensions, and now finally there is tentative deal. this means that septa riders will be able to continue riding without interruption. first up we're going to hear from the union about this deal. it includes wage increases for two years, not five, and he discusses why that is and then you will hear from a rider i just spoke with moments ago. >> we have too many issues to deal right now. with a strike we don't have time. it gives us an opportunity to work over the next two years to solidify our concerns. >> that was crazy. it was pretty close. >> were you up late last night wondering what was going on? >> kind of. i got up about 3:00 this morning and checked my app on my phone. and i seen that they came to an agreement so i was happy about that. >> reporter: they stayed up late last night or woke up early this morning to find out what happened. and this, of course, means that people can get to work and now to the poles. one of the big concerns was election day. now, up next for the septa workers, the union still has to ratify the contract and union president says that could happen this coming friday. live in frankfurt this morning, matt delucia, nbc10 news. this morning we are learning new details about how accused cop killer eric frein was captured. frein was arrested thursday night at this abandoned airplane hang gor in tannersville monday voe county. a task force commander with the u.s. marshals service says that he and his team had a hunch that if they were on the run they would hide in a place like that. according to the commander his team spied somebody moving from the woods toward the hangar and they were confident that it was frein. >> he turned towards me. saw that we were in full kit with rifles. identified myself. he put his hands up. i told him to get on the ground and he got on the ground. >> frein was arraigned yesterday in milford. he is being held without bail. a preliminary hearing is scheduled for november 12th. frein is charged with the shooting death of corporal bryon dickson. trooper alex douglass was critically injured but released from the hospital two weeks ago and continues to recover at a rehabilitation center. good news for hunters and trappers, they can resume the activities in the area where police were searching for frein. the pennsylvania game commission lifted temporary restrictions at midnight. hunting and trapping seasons were halted in several townships in monroe county during the manhunt. turkey season also opens today. this morning a philadelphia mother is behind bars charged with exploiting her two daughters. 32-year-old christine yoder is accused of sending an explicit photo of her 6-year-old and offering to fly the child to detroit for sex. she also allegedly produced pornographic pictures of her 16-month-old child. if convicted she faces a minimum of 15 years in prison. now to the mysterious deaths of the cooper health system ce organization and wife. their children have hired a pathologist to help investigate. john and joy sheridan were found in their home last month after a blaze started in their bedroom. officials have said that fire was set on purpose, but they have not said what exactly killed the couple. a spokesman for the family says that pathologist michael baden has been hired to help them. baden was most recently hired to perform a private autopsy on michael brown. he's the ferguson, missouri, teenager shot and killed by a police officer in august. meanwhile, the somerset county prosecutors office says that it's awaiting lab results before they release the causes of death. happening a little bit later today will be a celebration for a woman who nearly died when her suv plunged into cobbs creek this past summer. the family of sheryl allison is celebrating her miraculous recovery and formally thanking five people who helped save her. allison lost control of her suv back on august 19th. the suv flew down anal embankment right into cobbs creek. several drivers who saw what happened huld apulled allison t safety. they are all being honored at this party tonight. on the heels of a local high school football hazing scandal a pennsylvania lawmaker has come up with a bill that would protect students from these types of rituals. all vars si and jv players at central bucks west as well as coaches were suspended last week for the hazing incident that happened there at the school if the bill that's being proposed would make any hazing at any pennsylvania school a crime. it would also require schools to write and enforce policies to prevech vent hazing. it's a misdemeanor but it only applies right now to colleges and universities. it may be raining out there today but that is not going to stop this 6,000 people who will hit the streets to make a statement about diabetes. here's a live look at the philadelphia museum of art where the step out walk to stop diabetes begins at 9:15 this morning. the year's goal is to raise $1 million to fund research to find a cure. now, immediately following the walk a really special presentation happening at 11:00, participants and the public are invited to a concert featuring patly labelle. labelle is diabetic and is an advocate for awareness of the increase is blamed on three casinos closing in just two weeks this summer. more than 8,000 workers lost their jobs in 2014 and, so far, four casinos have closed this year and there could be one more. wrapped up a seesaw month of october by sending stocks around the globe h soaring on friday. this after japan announced a fresh round of stimulus measures to boost its struggling economy. the dow even touched an all-time intraday high. federal reserve said the u.s. economy is better and it does not need as much help as before so it is ending its latest bond buying stimulus program but lit keep report low interest rates right where they are because the housing market is still recovering. and proving the fed right, the government says the economy did grow at a strong pace of 3.5% during the summer. that's thanks to big gains in business spending. strong sales of u.s. exports and more military spending. there's a lot less pain at the pump these days if you haven't noticed the average price of a gallon of regular gasoline in the u.s. hit $3 on the nose this week. that's the lowest in four years. and down 33 cents for the month of october, thanks mostly to plunging oil prices. americans are earning a little more money these days but we're spending less of it. maybe because of those lower gas prices. consumer spending fell .2% since september nap is the first decline since january. and apple ceo tim cook became the highest profile chief executive ever to come out proclaiming in a published essay that he's proud to be gay. apple's board issued a statement fully
