menendez tonight, we are barrelin towards one of the mos consequential weeks fo abortion access since the farr of roe v. wade the government has less than a week to intervene after trum appointed antiabortion federal judge in texas matthew has merrick suspended a proven o mifepristone, one of the mos widely used abortion medications in this country. the justice department immediately filed an appea today. health and human services -- said - for the millions who need it >> well, they certainly have access today and we intend to do everything to make sure it is because o viewable to them not just in a week but moving forward. we have already filed an appea of this court's ruling one judge and one quarter an one state turned upside down the fda's approval process for safe and effective medications we have to go to court and see an appeal. this is not america. what we saw by that one judg in that one court in that on state. that is not america. >> adding to the uncertainty and to the confusion, federa judge in washington stat issued a conflicting rulin friday ordering the fda to keep the drug available in 17 states an washington, d.c. the dueling decisions -- directly to the supreme court. setting up the most contentiou fight over reproductive care since last - that reversed row. here's how mark joseph sti pitch -- why this is a moment of trut to the supreme court quote, they do not put a sto to cause merrick's madness they will show the country tha their goal is not to leave abortion up to the democrati process, but to use every tool in their power to outlaw abortion in every state. kicking us off tonight, msnb contributor mick bliss murray. she is a - of law and faculty director -- at nyu melissa, what would it loo like for the supreme court t take up the abortion cases and how soon could that happen >> well, alicia, i think thi is on a staff rocker to th supreme court. i think there's no way thi couldn't go to the supreme court eventually right now, judge kacsmaryk's ruling it has been an appeal t the fifth circuit. it is a famously conservativ court. but that court doesn't actuall have to do anything. judge has merrick issued a seven-day stay, so it is seven days before his state actually goes into effect the circuit just sit on this for seven days, and that would really put this in the questio of whether it goes to th supreme court. i think the fda would have t seek approval at the supreme court. they could ask for - which this happened before basically get the supreme cour to take this up to resolve a conflict between the washingto injunction and this toxic' decision again issued by a single judge in texas. but nationwide decision that would basically imperil all of mississippi are ston accessibility across the country. >> composition of this court - for justice kavanaugh to mak good on what he said - that his decision was rooted i constitutional principle what would you be looking ou for if portion access is decided by this court? >> well, again, i think you se it up beautifully. this case really gives the court the opportunity to sho the american public whethe they were serious abou returning the abortion questio to the democratic process or whether this is what the antiabortion movement ha always said it was - merely a weigh station on th road to fetal -- abolition of abortion in the united states. this is the decision from on judge that would have th impact of eliminating abortion access even in states where it is currently legal this is not the state by state settlement that drops reported to the offer, and i will b looking, not only a justic kavanaugh, but justice toledo, who can't that decision, sayin that this was merely destroyin this to the -- democratic process this is the antithesis o democracy. >> i pointed out this ruling, read it in full and cast merrick was really insistent o using the term unborn huma instead of fetuses he embraces the idea of feta personhood i want to read a tweet that yo flag for me. this is from americans unite for life that tweet says, restoring the constitutional right to life for the pre-born has been th entire point of the pro-life movement since roe no human being can except be excluded from the circle o humanity or the equa protection of the law. i mean, melissa, they are no even trying to hide what the are doing. tell me about why that matters for the national fight for abortion access and for wome across this country. >> again, alicia, this shows immediately the lie that dobbs -- restoring this to the people i their states to determine fo themselves what their position on abortion would be on a stat by state basis that cannot be the outcome it is absolutely an incoherent outcome, if you are someone wh opposes abortion, if you oppos but portion and believe that i is tantamount burner, yo cannot be okay with blue state allowing it. the only coherent response t abortion is the complete and total abolition of it. so the dobbs opinion is merely an s the sizing us to th prospect of the slow and incremental removal of all abortion accessibility in that eight states we are seeing that movin quickly to its outcome we saw the is last week when there was that case filed in texas about the wrongful death for termination of pregnancy again, the idea that onl persons get to have long ful death suits. again, acquitting the fetu with a person. and now a black and white in the pages of the united states federal supplement reporter, that this judge is telling u where this is going. this is moving toward feta personhood it is the only place it can go unless there is a response fro the people >> melissa you, talk about wha is happening in texas and in washington state you talk about what is happening and idaho. you talk about what is happening in at tennessee in the effect of gerrymandering which you have often flagged for us in the theoretica context that you can see pla out in realtime. all that goes back to th supreme court. you've made that point over an over again last year pulling down the trust in the supreme court at historic low last year you had republic issuing an explosive report on justice thomas's trips paid fo by a conservative bill lio air. -- for thomas might look like and what that might mean in term of the sanctity of - >> wealth, the real person w should be asking that question to his john g. roberts, th chief justice of the unite states what does the court plan to do about this rogue member of the court who is repeatedly defyin the basic ethics principle that most lawyers would observ as a matter of course. he refused to accuse himself - his wife is likely to be implicated and now we have learned that he is accepting 500,000 dollar luxury trips to indonesia and other places i mean, this is well beyond th pale the supreme court only answers to itself. it does not get regulated by any other -- eye where do we put our trust? certainly not in this court, i doesn't seem to have any interest in policing itself or even maintaining the objects o being above board and no partisan >> lisa marie, if you are up t me, this entire show would be recitation of your tweet threats. thank you so much for bringing your expertise and analysis to us every weekend i appreciate you i want to bring in democrati congressman -- she's also a civil rights an criminal defense attorney, which i've been thinking about a lot, congresswoman, as i hav heard you breaking down over and over again what is happening legally with abortio in this country. i want to play some sound from vice president harris. this is on abortion access take a listen. >> there is no question that the president and i are goin to stand with the women of america and do everything we can to ensure that women hav the ability to make decision about their health care, their reproductive health care in manner that is what they nee and they decide that, not thei government >> of course, you sent a lette to president biden urging th administration to preserve fda approval for mifepristone an access to a nationwide you have 40 other housto signed on to it. talk to us about what the bide administration needs to do -
