statement tonight: congressman hardy was recently hospitalized for a minor heart attack and has undergone a routine medical procedure. out of an abundance of caution, doctors are continuing to observe him while he makes a full and speedy recovery. we expect the congressman to return to a full schedule later this week and is expected to be in washington next week for votes when congress returns from the august district work period. noise complaints about construction are nothing new in the valley. but no s homeowners are taking legal action against the builders next door, saying the new construction is damaging their properties. fox5's miguel martinez valle was at one of their neighborhood meetings today, and miguel .. did you see the damage they are talking about? i did ...cracked foundations, broken tiles, and split cielings... neighbors tell me these problems only began over the last few months... right around the same time these explosives started going off at a nearby construction site. " i just hit the and hit the floor, because i thought it was a 145 shot" " the whole house shook, and at first we thought it was an earth quake, what else would we think it would be" " she fell out of her chair, and my husband had a friend over that practically ran out of the house " a new construction project is causing quite the shake up in this southern highlands neighborhood near cactus and rainbow. and its not just noise these neghbors are worried about, they say their property is taking a hit... " they set these blasts off the whole house shakes, i have crack on my garage flo patio is cracked in two spots" " we noticed that was cracked shortly after the last one which was for us, the biggest one" " it starts here and it goes all the way to the back" " theres the crack begining here, well actually begining up here..." these neighbors have tried reaching out to richmond american homes of nevada and western explosives systems, the companies they say are responsible for these damages... they were told settling, and they weren't going to stop the explosions any time soon. " think theyre trying to dodge a bullet and say they have nothing to do with something they know damn well they have a lot to do with" so the neighborhoods getting together, theyre meeting weekly, and taking legal action to save their homes... " we filed a lawsuit about a week and a half ago, we have not yet decided wether it would constitute a class or not" " we're not asking for a million dollars, we just want them to fix what theyre ruining" the neighbors are planning to keep track on any new damage caused by future explosions, theyre also trying to get enough people on board to file a class action lawsuit. to the companies involved but no one was available to comment. if we hear from them we'll be sure to update you on their response. chief meteorologist ted pretty has a first look at the forecast. toss to weather more heat expected through the workweek with cooler temperatures ahead for labor day weekend. we'll see 103 on tuesday with 102 expected both wednesday and thursday. friday we'll see 99. southwest breezes start wednesday afternoon and continue thursday and friday to the afternoon. for labor day weekend expect 97 saturday, then 96 both sunday and monday. stronger afternoon gusts will be with us saturday and suspicious item this morning. police say it happened around 11 a-m near lake mead and martin luther king boulevard. they say a few units were sent to check it out. police say they t but didn't have a lot of information about the scare. a bullhead city man has been arrested for the attempted murder of his two week old daughter... this is jeremy cowan-- police say his baby was transported to a hospital here in las vegas--- with a fractured skull and brain hemorrhage.... cowan and the baby's mother say she fell off the couch.... then they changed the story saying cowan accidentally fell and dropped the baby. police later discovered that he had thrown the infant head first floor because she was crying. a man died while scuba diving at lake mead. the man's name is fred arnold--- a police officer from tampa florida. "fox-13" in tampa reported arnold was on vacation when he suffered a sudden medical issue. officials at the lake say he was unconcious when he surfaced. a woman also died while snorkeling at the lake with friends this weekend. it was the first day of school for thousands of students in the valley.. but some students don't actually go to class in the school building.... that's because schools are using portable classrooms because there are just too many students to fit inside the building. fox 5's eric hilt explains how some schools are playing catch up-- because of the overcrowding issue. the first day of school isn't just nervewracking for kids... nats it is for teachers, too. "last night i had a really hard time sleeping because i was nervous bu excited" this is nicole gladish's third william v wright elementary school... nats -- classroom and all three of those years she's taught outside of the school building .. in a portable classroom like this one. the school's short-term solution to a long-term problem with overcrowding. "one of the hardest parts of being in the portable is not having access to all the technoloogy inside, you have to walk in there but if you're in one of the pods you can easily send out kids to do vmath whereas here we dont have that opportunity" nicole's classroom is one of 28 portable classrooms at wright elementary... it even has a portable cafeteria and portable bathrooms. the school was built to hold 750 students...this year there's nearly 13- hundred. "it's over twice as many as what should be in this school" but ccsd says a solution is in sight for teachers at one of the districts most overcrowded school. a new elementary school is planned to be built just three miles away -- reducing the wright. "a school will open up just to the southwest of here that wil help us in 20-19, so we are trying to catch up now" a game of catch up that the district says will take several years. the school district spokesperson told fox5 their goal is to get rid of portables at every elementary school... there are portables at middle and high schools as well -- bu says it does not think it will be able to get rid of those any time soon. police say a lot of tickets were written out to parents during the back to school morning rush. some new school zone rules include no u-turns and no passing other cars in any lane. also... if you're going to park to walk your kid inside-- you have to be in a legal parking spot and not in the middle of the road. parents should also tell their kids about their role in being safe by making eye contact with drivers and not darting out into the street. parent that you have a conversation with your child and really the age doesn't matter. sit down and have a conversation with your child about crossing the mid- block, about crossing between parked cars on the side of the roadway." another new rule is to stop completely at a crosswalk and not go until the child is fully on the sidewalk. the red carpet was rolled out at matt kelly elementary school-- and students got the celebrity treatment. "so, i do think it's very important that we come back here every year. not just to call and to pledge allegiance to these individuals who were left behind. but, just to say that we're all part of the human family and that, whether it be on the battlefield or on the peace field, we really never behind. statement tonight: congressman hardy was recently hospitalized for a minor heart attack and has undergone a routine medical procedure. out of an abundance of caution, doctors are continuing to observe him while he makes a full and speedy recovery. we expect the congressman to return to a full schedule later this week and is expected to be in washington next week for votes when congress returns from the august district work period. noise complaints about construction are nothing new in the valley. but no s homeowners are taking legal action against the builders next door, saying the new construction is damaging their properties. fox5's miguel martinez valle was at one of their neighborhood meetings today, and miguel .. did you see the damage they are talking about? i did ...cracked foundations, broken tiles, and split cielings... neighbors tell me these problems only began over the last few months... right around the same time these explosives started going off at a nearby construction site. " i just hit the and hit the floor, because i thought it was a 145 shot" " the whole house shook, and at first we thought it was an earth quake, what else would we think it would be" " she fell out of her chair, and my husband had a friend over that practically ran out of the house " a new construction project is causing quite the shake up in this southern highlands neighborhood near cactus and rainbow. and its not just noise these neghbors are worried about, they say their property is taking a hit... " they set these blasts off the whole house shakes, i have crack on my garage flo patio is cracked in two spots" " we noticed that was cracked shortly after the last one which was for us, the biggest one" " it starts here and it goes all the way to the back" " theres the crack begining here, well actually begining up here..." these neighbors have tried reaching out to richmond american homes of nevada and western explosives systems, the companies they say are responsible for these damages... they were told settling, and they weren't going to stop the explosions any time soon. " think theyre trying to dodge a bullet and say they have nothing to do with something they know damn well they have a lot to do with" so the neighborhoods getting together, theyre meeting weekly, and taking legal action to save their homes... " we filed a lawsuit about a week and a half ago, we have not yet decided wether it would constitute a class or not" " we're not asking for a million dollars, we just want them to fix what theyre ruining" the neighbors are planning to keep track on any new damage caused by future explosions, theyre also trying to get enough people on board to file a class action lawsuit. to the companies involved but no one was available to comment. if we hear from them we'll be sure to update you on their response. chief meteorologist ted pretty has a first look at the forecast. toss to weather more heat expected through the workweek with cooler temperatures ahead for labor day weekend. we'll see 103 on tuesday with 102 expected both wednesday and thursday. friday we'll see 99. southwest breezes start wednesday afternoon and continue thursday and friday to the afternoon. for labor day weekend expect 97 saturday, then 96 both sunday and monday. stronger afternoon gusts will be with us saturday and suspicious item this morning. police say it happened around 11 a-m near lake mead and martin luther king boulevard. they say a few units were sent to check it out. police say they t but didn't have a lot of information about the scare. a bullhead city man has been arrested for the attempted murder of his two week old daughter... this is jeremy cowan-- police say his baby was transported to a hospital here in las vegas--- with a fractured skull and brain hemorrhage.... cowan and the baby's mother say she fell off the couch.... then they changed the story saying cowan accidentally fell and dropped the baby. police later discovered that he had thrown the infant head first floor because she was crying. a man died while scuba diving at lake mead. the man's name is fred arnold--- a police officer from tampa florida. "fox-13" in tampa reported arnold was on vacation when he suffered a sudden medical issue. officials at the lake say he was unconcious when he surfaced. a woman also died while snorkeling at the lake with friends this weekend. it was the first day of school for thousands of students in the valley.. but some students don't actually go to class in the school building.... that's because schools are using portable classrooms because there are just too many students to fit inside the building. fox 5's eric hilt explains how some schools are playing catch up-- because of the overcrowding issue. the first day of school isn't just nervewracking for kids... nats it is for teachers, too. "last night i had a really hard time sleeping because i was nervous bu excited" this is nicole gladish's third william v wright elementary school... nats -- classroom and all three of those years she's taught outside of the school building .. in a portable classroom like this one. the school's short-term solution to a long-term problem with overcrowding. "one of the hardest parts of being in the portable is not having access to all the technoloogy inside, you have to walk in there but if you're in one of the pods you can easily send out kids to do vmath whereas here we dont have that opportunity" nicole's classroom is one of 28 portable classrooms at wright elementary... it even has a portable cafeteria and portable bathrooms. the school was built to hold 750 students...this year there's nearly 13- hundred. "it's over twice as many as what should be in this school" but ccsd says a solution is in sight for teachers at one of the districts most overcrowded school. a new elementary school is planned to be built just three miles away -- reducing the wright. "a school will open up just to the southwest of here that wil help us in 20-19, so we are trying to catch up now" a game of catch up that the district says will take several years. the school district spokesperson told fox5 their goal is to get rid of portables at every elementary school... there are portables at middle and high schools as well -- bu says it does not think it will be able to get rid of those any time soon. police say a lot of tickets were written out to parents during the back to school morning rush. some new school zone rules include no u-turns and no passing other cars in any lane. also... if you're going to park to walk your kid inside-- you have to be in a legal parking spot and not in the middle of the road. parents should also tell their kids about their role in being safe by making eye contact with drivers and not darting out into the street. parent that you have a conversation with your child and really the age doesn't matter. sit down and have a conversation with your child about crossing the mid- block, about crossing between parked cars on the side of the roadway." another new rule is to stop completely at a crosswalk and not go until the child is fully on the sidewalk. the red carpet was rolled out at matt kelly elementary school-- and students got the celebrity treatment. " amazing grace " eleven years later.... the city of new orleans remembers the devastation caused by hurricane katrina. may the victims' interred here and the city that refused to accept demise, take pride in remembering eleven years later and saying still (audience says "rise")oh you gotta rise. " the category three storm killed more than 18- hundred people... and displaced more than one million people in the gulf region more than 80 percent of new orleans was underwater, stranding tens of thousands of people. today--- new orleans officials and community leaders gathered for a wreath- laying ceremony at the katrina monument. it's where nearly 100 unidentified victims of the storm were buried. "so, i do think it's very important that we come back here every year. not just to call and to pledge allegiance to these individuals who were left behind. but, just to say that we're all part of the human family and that, whether it be on the battlefield or on the peace field, we really never behind. " katrina is considered one of the most devastating hurricanes and the most expensive natural disasters in u.s. history. the damage was estimated at 108- billion dollars. many of the people who evacuated the following the storm--- ended up calling las vegas home.. coming to the valley for a fresh start. one family found a new home here and opened "t-c's rib crib". the family patriarch invited his family to all join him here in the valley and together they op the west side on durango near spring mountain. "we invited our family to come because they were so displaced. they came. they stayed for awhile, but they still wanted to go back, but they stayed long enough for us to open and become a thriving bbq restaurant. "project neon" is counting on las vegas locals to help fill some construction job openings. they'll even teach you ever you need to know before you're hired! they've partnered with the laborers international union to hold job training sessions for anyone interested. the sessions are part classroom and part field skills. "project neon" is designed to make the i-15 safer. it's creating more than four thousand direct and indirect jobs in the valley. "for something of project neon's size and magnitude, this is something we would definetely want to do." have a lot of skilled and ready construction traits here." project neon construction is expected to last until the summer 0f 2019. a neighborhood is taking on a building company.... how they say the company's new project--- is causing damage to their homes. causing controversy on-- the field. how the n-f-l is responding to quarterback colin kaepernick--- refusing to stand for the national i'm catherine cortez masto and i approve this message. as a doctor, i see how decisions in washington impact my patients here in nevada. so even though i'm a republican, i won't be voting for joe heck. joe heck's voted ten times to defund planned parenthood, which thousands of women depend on for cancer screenings. and heck opposes a woman's right to choose even when her health is at risk. for me and my patients, 10. local. las vegas. one valley neighborhood is working together and taking legal action against the builders next door... they say new construction near cactus and rainbow is damaging their properties... fox5's miguel martinez valle spoke to them earlier today, miguel how many neighbors are complaining? well, there were at least 20 to 30 neighbors at tonight's meeting, and many of them were saying their homes were damaged by these explosions. explosion and rumble thats one of them right there, neighbors tell me they started noticing them in june, at first they thought it was an earth quake because the explosion shook up their homes. turns out its just part of a construction project where explosives are being used to flatten the mountains behind them... they tell me they have noticed a few explosions since summer started and in that time have also noticed more cracks on walls, broken tiles, and doors that wont close.. ive got cracks on my garage floor, my patio is cracked in two spots, the so called retaining walls that are built, the special ones that would hold back an avalanch, cracked in two spots" the neighbors tried reaching out to richmond american homes of nevada and western explosives systems, the companies they say are responsible for these damages... they were told the cracks were a result of natural settling, and they weren't going to stop the explosions any time soon. so now they have filed a law suit against the companie theyre holding weekly meetings and keeping track of future damages caused by these ongoing explosions, theyre trying to file a class action lawsuit. to the companies involved, no one was available for comment. three people were stabbed by the same person on sunday night. police say a man went into a crown liquor near twain and swenson - around 9-30 last night. the suspect stabbed two people inside the store - just minutes apart. a third person was stabbed about twenty minutes later . all three victims were taken to the hospital - but are expected to be okay. police do not have a suspect in custody. police say the man who shot and killed three police officers in baton rouge -- does not have p- t-s-d. medical records for former marine- gavin long--- says he never saw combat... despite telling doctors he suffered from post traumatic stress disorder because a buddy showed him videos of maimed and decapitated bodies. in november 2011--- doctors diagnosed him as suffering from an "adjustment disorder with depressed mood," but not ptsd. long shot and killed three officers and injured three nearly four years after the shooting rampage at sandy hook elementary-- the new school is now open for classes... children have been attending a nearby school ever since a gunman opened fire at sandy hook in 20-12. 26 people including 20 first graders were killed. the f-b-i is offering up a reward for the arrest of a religious leader. " the fbi is announcing it is offering a reward of up to $50,000 to the person or persons who provides information that leads to the arrest and conviction of lyle steed jeffs." " lyle jeffs has been on the run for ten weeks after slipping out of his ankle monitor and esaping house arrest in salt lake city. he had been awaiting trial on fraud charges involving food stamps. jeffs' brother warren is the imprisoned leader of the fundamentalist church of jesus christ of latter- day saints. lyle jeffs ran the day-to-day a pair of brothers-- accused of killing an n-b-a star's cousin... make their first court appearance in chicago. chicago police say brothers darwin and derren sorells-- killed dwayne wade's cousin-- nykea aldridge friday. aldridge was walking with her baby in a stroller when she was shot in the head and arm by stray bullets. police say the brothers are gang members and convicted felons who were out on parole. dwyane wade, who plays with the chicago bulls, tweeted: "...another act violence. four kids lost their mom for no reason. unreal." n-f-l quarterback colin kaepernick is stirring up controversy.... after he decided not to stand during the national anthem before a pre- season game on friday night i'll continue to sit. i'm going to stand with the people that are being oppressed. to me this is something that has to change and when there's significant change and i feel like that flag represents what it's supposed to represent in this country-is representing the way that it's stand.
