Traffic may be slow in the area. Looking to see that there is not anything more major. Because im looking at these commutes and it looks kind of slow. Also looking at the san mateo bridge, traffic is improving a little by. Its going to be crowded out to the highrise. I want to mention if we have the Richmond Bridge approach here approaching 580, why does it seem so light . Im always suspicious. Thats because just before this, there is a crash on westbound 580 coming out of the richmond area. You will see a bunch of slow traffic. And then it gets the crash is basically Holding Traffic up. So as you go back to the Richmond Bridge, you will see that almost no one is getting through. Thats why if youre driving to the Richmond Bridge, dont let this picture fool you. Just around the corner there, is a crash blocking lanes. 7 03. Lets go back to the desk. It is back to work for the same jurors who last week convicted garciatorres of kidnapping and killing sierra lamar. Now the penalty phase begins in just about two hours. Allie. Reporter and the punishment options for garciatorres are either life in prison without the possibility of parole or the Death Penalty. The penalty phase of this trial set to begin a couple hours from now here at Santa Clara County courthouse. Similar to the way that the trial worked, jurors will hear witnesses called by prosecutors and the defense team. Some of the testimony expected. Prosecutors will call sierra lamars friends and family. As many as 12 individuals. To talk about how their lives have been devastated by what happened to her. According to court filings, prosecutors would also like to conduct a psychological evaluation of garciatorres and be able to use that as evidence in this penalty phase. Prosecutors also have asked to show the jury a montage, a Video Montage of sierra lamar set to music. Certainly something expected to be very emotional for people to watch. In his defense, garciatorres attorneys have also said they would like to show a video compiled by his family, showing his childhood and home life also set to music. Assed with as submit their own psychological evaluation of garciatorres. His attorneys will say that he suffered a troubled childhood with Sexual Assault and incest in his home. The defense is trying to get sympathy for him even though he has been convicted of horrible crimes. They are trying to say he is a man whose life is worth saving. Reporter now, another witness the defense has asked for permission to call, a doctor who says garciatorres suffered the negative psychological effects of long term pesticide use. Now, the judge in the case has not yet ruled on whether that doctor will be allowed to testify or whether the dualing psychological evaluation of garciatorres will be admitted. Investigators say hackers are using leaked software from the nsa to lock up computers and then demand a ransom. Now one Security Company says some parts of the juan acry ransom ware that the hackers are using has the same code used three years ago in the group behind the sony hack that was blamed on north korea. But it is possible that the code was simply copied. Unprecedented. Beyond anything that we have seen before. The level of infection and the amount of damage potentially it is inflicting. Now, the juan acry virus has paralyzed computers and banks, Government Agencies and factories in 150 countries since it was unleashed on friday. Now to developing news. Marin county sheriffs deputies are searching for a girl who is mentally disabled and hasnt been seen since yesterday. Treasure anderson was reported missing 6 00 last night. She was last seen by classmates in a private school bus heading from White Hill Middle School in fairfax to san anselmo. Crews have been searching for her throughout the night but have not found her. Authorities are working with the bus company now to see where treasure was dropped off. Marin county investigators say treasure has a mental capacity of a 7yearold. She was seen wearing a blue shirt, white tennis shoes and carrying a backpack. The developer of the building under construction along the Oakland Emery border that has now burned twice believes that both fires were deliberately set. There is an arsonist who doesnt want this building built. We need to find out who it is and stop them. Rick holiday owns the Development Company in charge of building 105 apartments and retail space. On saturday, a huge fire spread through that construction site. Back in july of last year, there was another big fire. The Alameda County Fire Department has not officially said that either fire was arson. Fire investigators are starting at step one to speak with neighbors, speak with First Arriving firefighters. Tonight the Novato School district will vote on a controversial lighting project at san marin high school. They want to install eight light tower thats are 80 feet tall on the football field and 36 other field lights. School Officials Say that would give athletes more practice time without reducing and cutting into school schedules. They say the School District is looking for ways to cut its operating budget but the lights would be costing about a million dollars. The Walt Disney Company says someone claims to have access to a disney movie and it threatening to release it unless the studio pays a ransom in bit coin. Disney did not name the movie but according to self reports it is the latest pirates movie that is opening next week. Disney is working with investigators and refusing to pay. The hack by the way is not believed to be related to the recent ransom ware attack that spread across the globe. Ford plans to cut 10 of its global workforce. Right now the car company employs 200,000 people around the world. The cuts will likely affect salaried employees but the company will offer early retirement incentives. For a little more slowing and it will be backed up to interstate 80. The crash is right before the Richmond Bridge and that means that traffic is be very slow getting into san rafael. Give yourself extra time. Also another crash on the actual span. This is not a very good commute at all. So that picture that i showed you is misleading. This is a look at westbound 80 around the berkeley curve. You can see slow traffic. It will take 40 minutes to drive from the carquinez bridge to the macarthur maze. When you get to the toll plaza, it looks good. Traffic looks as it normally should be. Backed up for 25 to 30 minutes. No problems on the bridge. On the peninsula, we dont have a lot going on there. And, again, that crash was just reported. In fact they may have already driven off of the freeway. There was a fender bender type accident. Like i say, the damage is done as you drive from the carquinez bridge to the macarthur maze. The bay bridge, a big backup here as well. 20 to 25 minutes before you make it on to the span. Also a crash westbound im sorry, northbound. It is right here. Where the split for the car tool lane comes carpool lane comes. I would not advise you taking the Richmond Bridge. There have been a couple of crashes on the way here. This is an awful commute. If you have to go that way and you say, well, theres no other way to go, just know what youre dealing with. Plans you will want to call ahead and say can we put the meeting off for a few hours . I wouldnt use the Richmond Bridge at this point. Highway 4, extra slow this morning. Eastbound 780 is slow. Northbound 280, 101 and 85 is slow. So this tuesday is definitely a lot slower than monday. And theres a theory going around that tuesday, everybody has to be in the office. A new push by state lawmakers to help people with low incomes pay off their traffic tickets. Alex savidge is in walnut creek. So tell us more about an idea to give them a discount on the traffic tickets, alex. Reporter thats essentially what were talking about, dave. If this bill becomes law, judges would have a lot of discretion here. They would be able to reduce the amount of a fine of a traffic ticket up to 80 . But only if a driver can prove that theyre unable to pay the original amount of that fine because of how much money they make. Now, people would only be eligible if their income is up to two and a half times more than the federal poverty limit. Were talking about low income earners here. The author of the bill says this is an attempt to even the Playing Field. He says hefty traffic fines that runs hundreds of dollars are simply an annoyance in many cases to people who are wealthy but can be detrimental no low income earners who find themselves in deep debt. We talked this morning with drivers in walnut creek about this idea. Yeah. Some people dont make, you know, enough money to pay tickets. Like a speeding ticket or something, it costs like 500 and up. My thought is that that would make it preferential for people who are low income, they want to break the law and speed and break other vehicle laws because knowing they wouldnt get fined as much. Reporter now, if this bill were to become law, it would not apply to fines for driving under the influence or reckless driving. The legislation, by the way, is opposed by the California District Attorney Association which believe thats driving comes with a certain degree of responsibility. This will likely be up for a vote in the state senate next month. The author of this bill is trying to create a sliding scale for traffic tickets based on drivers income. Lets see how it works out. People would need to apply at the dmv in person and provide a birth certificate to show california residency and a Social Security card. The new cards will have special markings that can be checked before boarding a flight. We also have to make changes to the card design that. Will cost as well. A big chunk of that will be to add staff. We will be ramping up that over six years. About half of the u. S. States are already in compliance with federal standards. In 2020, every person who flies domestically will need one of these drivers licenses or ids. If not, a passport would be accepted. The time is 7 39. Several hundred people gathered in san rafael last night at a synagogue to support a man facing deportation. 37yearold hugo is detained by federal authorities. He is married and has three children. He has been in the u. S. Almost 20 years. He is a drywall foreman in the construction business. At the beginning of the admonition he and a coworker showed their id toss get into Travis Air Force base for a drywall job. Their names came up in the system as undocumented. Police are hoping that Surveillance Video will help them track down two drivers involved in a rolling shootout that happened on mothers day. In the closeup shot, you see the outline of a gun being held outside of the drivers side window of that red car. One person who lives nearby thought a car was back firing after hearing the sounds. But after reviewing the surveillance camera footage, he realized he was wrong. Ive been here 36 years and ive seen car accidents, kits get hit on bicycles. Once in a while a car gets broken into. But that is the first time that i ever heard gunfire. No one was hurt in the shooting. The time is now 7 45. Drinking too much caffeine is blamed for the death of a teenager in South Carolina. The 16yearold collapsed and died last month in a high school classroom. Authorities say he drank a large mountain dew, a latte and an energy drink within two hours. The coroner says that is way too much caffeine for a teenager. His father hopes the death of his son will save others by showing the dangers of too much caffeine. Like all parents we worry about our kids as they grow up. We worry about their safety, their health. Especially once they start driving. It wasnt a car crash that took their leave. Instead it was an energy drink. The purpose of today is not to slam mountain dew or cafe lattes or Energy Drinks. When we want to do is make people understand that these drinks, this amount of caffeine, how it is ingested can have dire consequences. Now, the coroner also says the teenager did not have problems but heart problems but even the Healthy Heart could not take the stress of too much caffeine. One out of five children say they have been bullied in class. 21 of students between the ages of 12 and 18 say they have been victims of bullying in 2015. 34 of lgbt students say they were bully the compared to 19 of heterosexual students. The number of Sexual Assaults reported on College Campuses has more than tripled over the past decade. Local School Districts have launched campaigns to teach students to be more tolerant. And on 680 as you drive down to the interchange out of dublin. 580 this commute has been completely slow because of many earlier crashes on the span. I put the crashes on there just to show you. Look at highway 4 and 680. That has been very slow. There was an earlier crash here on 780. Theres a lot to get to. 680 is slow out of pleasanton. You get the feeling this is a very, very buzz tuesday. So give yourself extra time if you can. At 8 02, lets go back to the desk. In about an hour, the next phase of the garciatorres trial will begin. He has already been convicted of kidnapping and killing sierra lamar. Allie rasmus is outside of the courtroom. The jurors will hear emotional testimony before they decide his punishment. Reporter yes. When it comes to the fate of garciatorres, there are two options, life without the possibility of parole or the Death Penalty. And the same men and woman who convicted him last week have the job of trying to figure out which of the two punishments he will receive. The penalty phase of his trial begins today with Opening Statements scheduled for 9 00, about an hour from now. Prosecutors are expected to call to the stand during the penalty phase some of sierra lamars close friends. The jury will also hear statements from sierra lamars family, her parents, talking about how their lives have been devastated by what he did to her. Prosecutors want to conduct a psychological evaluation of garciatorres and use that as evidence in the penalty phase. Prosecutors also plan to show the jury a Video Montage of sierra lamar set to music. It is expected to be an emotional testimony to make the case that garciatorres should suffer the ultimate punishment for his conviction, kidnapping and killing her. Garciatorres was convicted of murdering the 15yearold lamar but her body has never been found. Legal analysts say this could influence the jurys decision about his sentence. This jury has a lingering doubt about sierra lamar and what happened. And even though they didnt have a reasonable doubt, if theres a lingering doubt, are they going to impose the Death Penalty in a case where there is no body . Reporter now, in his defense, garciatorres attorneys have also said they would like to show a video compiled by his family showing his childhood and family life as well as admit their own psychological evaluation of their client. Garciatorres attorneys are expected to argue that he should receive life in prison in his defense that he suffered a troubled childhood with Sexual Assault and incest in his home. Now, another witness the defense has asked permission to call, a doctor who says that garciatorres suffered the negative psychological effects of longterm pesticide exposure. Now, theres no word yet on whether the judge will allow that doctor to testify or whether she is going to allow any of the dualing psychological evaluations in this penalty phase. The prosecution has rested its case in the trial of a mother and her boyfriend accused of killing 3yearold kayleigh in napa. Authorities say kayleighs mother kruger and her boyfriend warner killed kayleigh in 2014 and put her body in a suitcase and placed it in a refrigerate owe. Yesterday a video was played showing kayleigh in 2013. Last week an expert testified that kayleigh had suffered from extremely painful injuries in the days leading up to her death but her mother never took her to see a doctor. There has been another car fire in contra costa county. This happened just before 1 30 this morning on railroad avenue and the waterfront in rodeo. Firefighters quickly put out the flames and the car was then towed away. There is no indication at this point that this incident is connected to the recent series of suspicious car fires in contra costa county. 36yearold man was arrested for the fires over the weekend in benecia. Benecia city leaders are meeting to discuss the flaring at the refinery earlier this month after a power outage. The scare prompted a nearby evacuation. Officials tell ktvu that the city council will hear a presentation about what happened, including a timeline of events. Then there is a meeting expected on thursday with various agencies to delve further into the findings. President trump took to twitter this morning to declare he has the absolute right to share information with anyone that he wants, including the russians. In a series of tweets the president said he wanted to share the information that isis might be plotting an attack on board commercial airliners with laptops. He was more upset that the Washington Post what was said during the meeting saying, quote, ive been asking director comby and others since the beginning of my administration to find the leakers in the intelligence community. One of the first people on scene was a 14yearold Police Explorer, jose lorasco. I sat down with jose now a young man to tell about that tragic day. In doing so discovered how one man could inspire another to follow in his footsteps. 911. Saturday, january 7th, 2006, East Palo Alto. How many people are fighting. The call, a fight at the tacoria. Alberto alvarez is one of them. A nearby surveillance camera catches him walking away. Turned left out of the restaurant. East Palo Alto Police officer richard may responds in. In the patrol vehicle, Police Explorer. K9 officer dave carson heard the chatter on the radio and also responded and in the car with carson, another Police Explorer, jose. I remember were driving down do not going towards university. And i remember looking at jose and he was quiet. And i looked at him and i said man something is not right. Something wasnt right. Radio silence. 12 seconds of radio silence. And then are you there . When did you know something was wrong . When marco got on the radio. Jose was 14 years old. Now he is 26 and telling his story for the first time. When he got on the radio and said man down. Man down. Man down. Man down. Man down on weeks. Whats the cross . We arrived and then and then we saw officer mays car in the middle of the street. Did you see officer may . Yeah. I ran up to him. Officer has been shot. Officer has been shot. 104. Officer has been shot. I saw that he had a bullet wound to the head. Yeah. What were you feeling at that at that moment . I was scared. Sad. I had to get marco out of there. And i had to get jose out of there. I didnt want them to see what we were looking at. Dave carson is now a sergeant with the police department. I had to lean on them to help that day. In what way . I was task them with things that we would normally do. Drop some tape for me. You know, look for some evidence. Make sure that the scene is secure. Carson was telling me to do things. Do this and that. So i was just, okay, i did what he asked. Jose was eventually led away from the scene. The gunman tried to escape but was captured nearby and four years later convicted of the killing. Officer may was shot multiple times that day. He was 38 years old. Prior to his watch in East Palo Alto may served the country. He was a marine. I follow his footsteps and joined the marine corps. He was a marine. And then just two years ago, jose, just like richard may became a Police Officer in East Palo Alto. What is the hardest part of the job . What is the hardest . I would say, you know, trying to convince the people that dont want us around, you know, trying to convince them to that were not bad people. D people. During one stop, we found ourselves at the corner of university and weeks, just blocks away from where officer may was killed in 2006. There are times that i come through here and just drive by the house. It is a job i have to do. So i just have to keep moving forward. Forward. [bagpipes] two weeks ago on this warm spring day in redwood city, a service to honor those killed in the line of service. Richard a may. East Palo Alto Police department. It was jose who placed a flower and saluted a man in blue. The man who inspired him to live the life that he is living today. Officer mays widow and his daughters drove hours to be here. He is missing. He has missed so much. But even so she knows he has inspired and his hard work and dedication lives on in another. To have that much of an influence on him that he want today follow in his footsteps like that. I didnt realize the impact that he has on jose until the last few years, i think. He was always kind to people. You know, always talked to them with respect. So thats something that that i do. The moment that you walk over to officer may when he is there on the ground, you know, they talk about moments in lives where you can go this direction or that direction. Was there any second there where you thought, you know, this isnt for me . No. After that, i thats when im like im really going to be a cop now. And now he is. On his wrist as he patrols richard mays memorial bracelet. And these days joses sergeant is carson, the sergeant he rode with 11 years ago. To know richard was to love him. He had this funny sense of humor. And jose has got the same same thing about him. You know, its almost its uncanny almost. His biggest thing that he tells us is family is always first. Family first. And for this young officer, while he may patrol at times with a heavy heart, he is being guided by the light and the strength of a man who will always be his partner, by his side, in spirit. East Palo Alto Police chief says that the second Police Explorer on that scene that day marques is actually a Police Dispatcher in the bay area and doing well. One day he hopes to be a police chief in East Palo Alto. What an amazing story. How interesting how that one moment could have turned him away from police work but it pushed him closer. When i asked him that, without hesitation he said nope, i knew i was going to be a Police Officer from that moment on. Thank you to jose for sharing that story. Absolutely. 8 18. If you have to bite the bullet and get out there, know that you will be in a lot of slow traffic getting over to san rafael. A warning out for parents after a teenager in South Carolina died from drinking too much caffeine. The 16yearold collapsed and died last month in a high school classroom. He drank a large mountain dew, a latte and an energy drink within two hours. That is way too much caffeine for teens. His father hopes that his sons death will show the dangers of excessive caffeine. Like all parents we worry about our kids as they grow up. We worry about their safety and health. Especially once they start driving. It wasnt a car crash that took his life. But what we want to do here today is make people understand that these drinks, this amount of caffeine, how it is ingested can have dire consequences. The coroner also said the teenager did not have heart problems but evensa Healthy Heart couldnt take the stress of all of that caffeine. Now, for healthy adults the food and Drug Administration says 400milligrams is the safe amount of caffeine. That is four or five cups of coffee. Most Energy Drinks contain as much caffeine as four cups of coffee and 14teaspoons of sugar. Happening today, families of the people who died in the ghost ship warehouse fire plan to file a lawsuit against the buildings owner and manager. 36 people died in the fire. The building manager organized the event and charged an entry fee and lived in the warehouse and charged rent to artists. There were no permits inform Holding Events in the building. Unsafe conditions existed in the warehouse and were ignored by the building manager and owner over a long period of time. The developer of the building under construction that has burned two times believes that both fires were deliberately set. There is an arsonist who doesnt want this building built. Hackers are used leaked software from the nsa to lock up computers and ask for a ransom. The hackers are using code that is the same as the sony attack three years ago. It is possible that the code was simply copied. Hackers are reportedly holding the latest pirates of the caribbean movie for ransom. Disney says that someone is claiming to have access to a disney movie and threatening to to release it unless the studio pays a ransom in bit coins. It did not name the movie but said it is the latest disney movie set to open next week. The hack is not believed to be related to the ransom ware attack that spread across the globe. There is a new effort in fact underway at the State Capitol to make it easier for low income earners to pay off their traffic tickets. Alex savidge has more on the bill that would give drivers a discount on the fine snooze if this bill becomes law, it would give judges in many cases wide lat feud, a lot of discretion to be able to reduce the amount of a fine for a traffic ticket by up to 80 . That is if a driver can prove they are simply unable to pay the original amount of that fine because of their income. Now, people would only be eligible if their income is up to two and a half times more than the federal poverty limit. Now, the author of this bill, state senator bob hurtsberg says this is an attempt to even the Playing Field. Hefty fines that run hundreds of dollars are an annoyance to people who are wealthy but can be detrimental to low income earners who oftentimes find themselves in debt. We talked to drivers about this idea. I think it is a good idea. Some people dont make enough money to, you know, pay tickets. Like a speeding ticket or something, it costs 500 and up. My thought is that that would make it preferential for people who are low income, they want to break the law and speed and break other vehicle laws because knowing they wouldnt get fined as much. Reporter if this bill were to become law, it would not apply to fines levied for driving under the influence or reckless driving. The legislation by the way is opposed by the california district attorneys Attorney Association which believes that driving comes with a certain degree of responsibility.
