to take the ferry from tiburon instead. there is one issue to tell you about that we just got word of. this was a collision. it looks like a single car hit the center divide. 101 northbound just past the central scan ralph exit -- san rafael exit. we don't see it reflected on the traffic sensors on 101. but be aware of that on northbound 101. you can see a lot of sunshine along the macarthur maze. a different picture than what we saw yesterday when the rain was covering the camera lenses. it is a 19-minute drive to get from the macarthur maze. the bay bridge toll plaza, the delay isn't that bad. 15 to 20 minutes to get on to the span. the time now is 7:02. and i'll send it back to gasia and dave. >> thank you, allie. new details on the massive bomb that the u.s. dropped on a tunnel complex in afghanistan. it killed 36 afghans. >> the commander of the u.s. forces in afghanistan says the bomb was effective. this shows the blast that the bomb created yesterday in easter afghanistan. it is known as a moab and nicknamed the mother of all bombs. the bomb was used to destroy extensive bunkers, tunnels and mind fields built by isis near the pakistan border. >> the u.s. coordinated with afghanistan to conduct yesterday's operation just as we have since we started these operations in early march. therefore this was the appropriate weapon to use at this time to reduce that obstacle to enable us to continue with our offensive operation in the southern part. >> this is video of the bomb dropping out of the back of a cargo plane. this video was taken only during a test. yesterday's attack though was the first time that the bomb was used during combat. it is the largest nonnuclear weapon ever used in the air force arsenal and it has the clear backing of president trump. >> we have the greatest military in the world and they have done the job as usual. we have given them total authorization. that's what they're doing. that's why they have been so successful lately. >> the bombing brings up questions as to whether this could be a message to north korea following last week's missile attack on a syrian air base. but the pentagon is pushing back there they could launch a preemptive strike. nancy pelosi called the bombing an escalation, one that congress should review. >> for things to be happening without congress being part of the debate raises very serious questions as to the justification and the results as to what this is about. >> pelosi said while she was in san francisco at a forum on health care for veterans she called on paul united states and how the world is reacting. >> i think everybody is looking at the united states as being a little more aggressive than they have been under the previous administration. although president obama did direct and oversee the assassination of osama bin laden. we haven't been the same in terms of expanding the field of battle. there was reluctance on president obama's part to go into syria when congress wanted less fronts, not more. this president i think is showing a willingness to be more assertive or aggressive and also to sort of create a public relations possibility out of each one of these things to project a stronger military presence that most countries believe that we possess in this way. the question is he willing to use them without authorization from congress and act independently on his own or le be more deliberative as the previous presidents have been. you talked about the consequences. one of the things to remember about isis, lots of people who muslim recent the notion of calling it the islamic state because they don't speak for all muslims. they have flourished and grown in countries that are essentially failed states. why are they in afghanistan in the first place? the central government controls kubal. the reality is that the central government doesn't control anything. the regional war lords are terror groups. there are at least eight in afghanistan today, not just the taliban and isis but others as well. in those kinds of places that's where isis flourishes. syria is in a civil war. the government couldn't provide central services there. outside of that it didn't work. we're seeing the same thing in libya and parts of eastern africa where isis being beaten in syria and iraq right now is looking for other places to go. to your point about consequences, i don't know that we use this kind of bomb somewhere else. we're aware of the fact that we're eradicating in syria and iraq isis presence doesn't mean that they won't pop up in other places like weeds in an unattended garden. that's what we need to be concerned about. >> nancy pelosi is calling for a congressional review. does this merit a congressional review or is she not seeing eye to eye with the president. >> some people in his own party don't see eye to eye with him. there was a wars powers act passed that was to stop an overreach by the executive branch. and what that calls for is congressional authorization. if you're going to be in a conflict for more than 60 days, 60 days or more. and we aren't really at that situation right now. you could argue in both of these instances, last week in syria and yesterday with the use of the bomb, this was a one off situation. for example, yesterday's tactical situation where he had already authorization for. going forward, if you see these actions, congress will be within its rights to come back and have consultation on this. they're the one that's are supposed to declare war. >> thank you, joe. >> we morning, new this morning, vacaville, police there investigating a late- night shooting where three people were critically hurt. just before midnight, police received several 911 calls about shots fired at an apartment building complex. when the police arrived, they found three people shot. now, the investigation is still going on. if you have any information, call vacaville police. and we have an update for you on a story we told you about yesterday morning about a woman whose husband's ashes were stoleenfrom her car in san francisco. we're hearing from mary wilkinson, a widow from north carolina. she came to northern california to scatter the ashes of her late husband. but someone broke into her rental car wednesday afternoon in fisherman's wharf and stole her suitcase, wallet and remains of her husband in a silver cylinder in a black pouch. >> they took my husband. i feel absolutely horrible. i feel like i have done him such a disservice. he was such a great man. and i just feel like -- >> she said her husband joe died last august of a heart attack. he loved san francisco. so she planned to scatter his ashes in the redwoods on what would have been his 57th birthday. she is hoping whoever stole his ashes will give them back. she is due to fly back home with her daughter next tuesday and says she doesn't know if she will come back to san francisco ever again. a landslide shut down a heavily used road in oakland hills overnight. police first discovered the slide at 11:00 p.m. on redwood road. the slide included mud and also brought down a tree. the road is two lanes, one in each direction. one lane was cleared at 2:00 this morning. the road is often used as a shortcut to the oakland hills and back. the time is 7:11. st. clair accounty is trying to block the trump administration from withholding money to sanctuary cities. ferry riders from sausalito may have to adapt their commute this morning. we will tell you about it coming up. in the middle of a say city planners could use that information to relief traffic jams. but the state won't release that information. the examiner reports it could be up to 45,000 uber and lyft drivers in san francisco. ride shares are one alternative for marin county residents heading to san francisco this morning. >> there is no ferry service because of emergency repairs at the sausalito ferry landing. ktvu's christien kafton is out there now telling about the options for commuters in the north bay. good morning. >> reporter: yeah. good morning, dave. good morning, gasia. the ferry service shut down here from sausalito for emergency repair. what that means for passengers is ferry service suspended until 1:55 p.m. this afternoon. that also means that commuters may be relying on buses to get into the city this morning. golden gate transit will be adding bus service between sausalito and san francisco's ferry terminal. they will depart at 7:10 this morning and at 7:20 from the bay street and bridge way bus stop nearby. passengers this morning tell us that they are taking it in stride. >> it's inevitable. i think that you have a piece of machinery that is going to eventually break down at some point. it is very rare that it happens. so, you know, we all have to kind of work around it, i guess. >> reporter: now, ferry customers can also opt to head to tiburon or larkspur to ride from though locations. the repair work will be completed in time for the evening commute. ferry service expected to resume at 1:55 this afternoon. the buses are departing right now. that's what passengers will be relying on to get into san francisco this morning if they still want to start from here in sauce sausalito. >> thank you. this is a nice friday commute, isn't it. >> it is. except there is one other thing along with the ferry service being canceled. another crash to tell you about this marin county. this one is happening at, let's see, northbound 101 at san pedro road. now, it looks like they're in the process of getting this cleared. it was a single vehicle spin- out that hit the center divide. now things have been moved off from the shoulder. you can see a lot of green. it is not impacting traffic in the northbound direction. heading out to the south bay, southbound 880 at brokaw there is a collision there. also a single vehicle car crash. ambulance is on the way. i don't know why that crash icon is in that location. because the only information that we have about a crash in the south bay is southbound 880 at brokaw. this is a look at 280 heading north in san jose towards cupertino, highway 17. cal train moving along right through the picture. a nice sight to see. 880 in oakland north and southbound directions look good. same with the bay bridge toll plaza. it is light for this time of the morning. the friday light commute. and sunrise over the east bay hills. nice to see the sun there for the first time on this traffic camera for several days. the time is 7:18. steve, i am arrested a 17-year-old boy for felony possession of stolen property. officials at the u.s. department of education went to richmond high school yesterday to investigate. some students agree there is racial tension. they say the growing latino population in the community is making some african-american students feel excluded. they're pointing to an upcoming prom as an example. >> they're having a mexican band there. and the black kids don't feel comfortable with that. they want something for them too. >> i'm for all children. don't get me wrong. i feel like maybe the small percentage of the african- american kids here are getting left behind. >> the school district confirmed there is an active investigation but officials will not tell us what exactly is being investigated. the time is 7:25. the popular downtown farmers market in berkeley won't be open tomorrow. it has been canceled for fear that a scheduled rally in the area may turn violent. berkeley police are increasing patrols just in case. look at this video from march 4th. a rally supporting president trump was crashed by anti-trump protesters. ten people were arrested. tomorrow a patriots day event is planned and protesters are expected as well. the city of antioch approved a plan to install surveillance cameras to help fight crime. city will buy three cameras for east 18th and cavala road, a hot spot for crime. they will buy six more license plate readers for antioch. the technology could be installed within a couple of months. christians around the world are observing good friday. according to the incidents in the south bay. near the oakland coliseum, traffic looks good over there. 24 in lafayette, traffic is lightening up on this stretch as you make your way to the tunnel. one thing to tell you about. westbound highway 24 there is a report of debris, a large metal strap reported according to the chp in one of the right lanes. be aware of that if that's where your drive takes you. the bay bridge toll plaza looks very light. great time to get across. no delays for you if that's your drive this morning. 7:33. back to the desk. >> thank you, allie. the controversy over sanctuary cities will be front and center in the bay area. a federal judge in san francisco will hear arguments were the trump administration can withhold federal funding from sanctuary cities. rob malcolm is in san francisco outside of the courtroom with more on this. good morning. >> reporter: good morning, guys. you can see protesters are already in front of the federal courthouse where the judge is expected to listen to arguments at 9:00 a.m. this morning. santa clara county was the first in the country to file an injunction of this kind. it could be a turning point in the immigration debate. as part of president trump's executive order, he had threatened to strip federal funding from sanctuary cities. the constitutionality is being challenged. if the preliminary injunction is granted this will prevent the executive order that applies to sanctuary cities going into effect. in the bay area, san francisco, santa cruz, alameda joined oakland and san jose as sanctuary cities where law enforcement has said they won't help immigration and customs enforcement agents over to federal authorities. about 35% of its total revenue is threatened. those against the federal policy argues it hurts communities. >> the federal government was unclear what it means for to be a sanctuary county or state. we in santa clara follow the law. it is the federal government, we collaborate and cooperate with them. what they're asking to us do is violate the constitution. if we don't do it, take our local funds. those funds help the poorest people in the community. >> reporter: and chavez and her supporters will be inside of the courtroom all morning long, hoping that the judge rules in their favor. we're live in san francisco, rob malcolm, ktvu fox 2 news. >> thank you, rob. the time is now 7:35. the trump administration has released what it calls fixes for the affordable care act. it includes a shorter enrollment window. and also a reduction on special enrollments. now, insurance companies say those special enrollments are when people only sign up when they get sick and then they drop the coverage when they're healthier. insurance companies also want to guarantee the government will keep paying billions of dollars in cost sharing subsidies that help consumers with high deductibles. president trump hasn't made up his mind on that yet. new this morning, the trump administration is dropping a lawsuit against north carolina after that state moved to undo its bathroom bill that affects transgender people. the justice department filed papers this morning to throw out the federal lawsuit. last month state leaders reached a compromise that got rid of a provision that said that transgender people had to use the bathroom on their birth certificate. two secret service agents are out of a job this morning after they were both fired for the white house fence jumping incident last month. the 26-year-old came within feet of the president's door and spent 16 minutes on white house property before being spotted. tran made it up to the house and rattled the windows and even the doors. both agents had been on the job for less than a year. police in santa clara arrested a suspect accused of a sexual assault in february on a student at santa clara university. brandon of san jose is charged with assault with intent to commit rape and kidnapping. on february 2nd, about 8:00 in the morning the victim was attacked on a sidewalk near santa clara university. the victim fought back against the suspect, who ran away. police say they were linked to this man and they were able to link him to the assault. police in san francisco are looking for a group of teens who robbed a woman on a muni bus. it happened just before 10:00 wednesday night near mcallister street. the woman got off of the bus and a group of ten teens punched her, took her purse and well set and ran away. anyone with information is asked to call san francisco police. it looks like bart may be able to avoid service cutbacks after a wind fall of $16 million from the state. the bart was originally expecting to make cuts to balance its budget, including some of the early morning bart services being cut. after a meeting yesterday, the board says they won't have to do it. bart will also keep the 62.5% discount for seniors and the disabled. some of the riders we talked to say they want to see bart manage its money better. >> bart needs to manage resources properly, no matter where they come from. i would like to see more of the funds spent on the infrastructure and the customer and lesson the management. >> a couple of changes were approved by the bart board. paper tickets will now cost riders an extra 50 cents. the discount for students will be cut down to 50%. more evidence as if we needed it of the competitive nature of buying a home in the bay. 70% of homes in san jose were sold at above the asking price. the highest percentage in the country. number two was san francisco at 66.7%. and oakland was third at just below 66%. real estate agents say the reason is quite simple. supply is just not meeting the demand for housing. the time is 7:39. also a reported battle for trees here in the bay area. the business insider website reports that apple wants to plant 9,000 trees at its new complex in cupertino. 80% of that 175-acre campus will be landscaping. however, apple is running into a problem. apple is battling the trans-bay system for top trees from nursery across the pacific northwest. apple employees will move into the complex later this month. with this week's storms the sierra nevada is officially setting its wettest year on record. the raining season received 90% of rain and snow. the previous record was back in 1983. the new freeway. the chp released this video showing blanco being take known custody yesterday. police say two guns and methamphetamine were found at his home. blanco is suspected in a shooting on highway 101 march 16th. the 17-year-old boy was hurt and the highway was shut down for several hours. at the time the chp said the shooting was gang related. two men were arrested yesterday on suspicion of a armed robbery in south san jose at a rail station. matthew sloan and 18-year-old lorenzo green robbed a woman at gun point at the blossom hills station. transit authority deputies chased after them and arrested sloan in a nearby neighborhood. they say green ran towards a children's center. that forced that center and an elementary school to go on lockdown. authorities later arrested green. he was hiding in a garbage can. new from overnight, there was a fire on the las vegas strip last night at one of the most popular hotels. it was at the bellagio. it started in the shopping area. it was also next to the lake where the bellagio fountain show takes place. it was going on during the fire. the hotel rooms and the casino was not affected. the fire was out in 20 minutes. no one was hurt. more protests planned in chicago this weekend after a man was dragged off of a united flight. yesterday reverend jesse jackson led a group outside of the o'hare airport. the videos which i know you have seen show dr. dao being dragged off a plane on sunday at o'hare airport. he suffered a severe concussion, a broken nose and lost two teeth. his daughter says her father and her family still have not recovered from what happened and he now plans to sue. >> we were horrified and shocked and sickened to learn what had happened to him and to see what had happened to him. >> we want respect and we want dignity. that's it. not a big deal. this seems so simple. >> yesterday executives from united airlines and chicago's aviation department were questioned at a city council meeting in chicago. three aviation security officials have been suspended as a result of what happened. and there are some more problems for united airlines. another passenger was stung by a scorpion on a plane last sunday. a couple coming back from mexico brought the scorpion on a flight from houston to calgary. it was stored in an overhead bin, but it escaped. it fell on the head of a man who was sitting under the bins. now, he shook off the scorpion but it fell on a tray table. that's we had was stung when he tried to pick it up. he is recovering. he said it was, as you can imagine, it stung. 7:46. a chick-fil-a in texas is helping make a 6-year-old boy with a rare food allergy feel special. chick-fil-a happens to be christopher's favorite restaurant. he has a rare condition, one that causes severe allergic reactions to foods. doctors only allow him to eat 7 foods, including the waffle fries at chick-fil-a. when one franchise owner heard about the condition, he made christopher the honoree owner of the restaurant for a day. >> he wants to own one day so he can go in and eat at a chick- fil-a. this is a dream literally for coming true. >> little christopher not only ate the fries but he cooked them himself and even worked the drive-through and his mom was tearing up. it means the world to him. good for that restaurant owner. >> bravo, bravo. it is 7:47. let's check on traffic blocking one of the lanes. according to the chp notes, it has been cleared out of the way. not having an impact on traffic in the southbound direction. we went over to the westbound 80, 580. it look like -- it will be a little slow if you're going through richmond, down through berkeley on the east shore freeway, close to the university avenue off-ramp. no specific problems to tell you about on seems to be doing just fine. carson was diagnosed with what is called vanishing twin syndrome. he lost his twin in his mother's womb. now he is happy to have fin back at home. 7:54 in the time. jc penney delaying plans to close 138 stores because of a last-minute surge in customers. jc penney says since the store closures were announced, the affected stores have been seeing better than expected sales and traffic. now the liquidation sales are pushed back to may 22nd. and store closures won't start until july 21st. the only bay area store to be closed is in richmond in the hill top mall. the issues in the east bay. from the southern end of it up to the north. let's start with the map at 580 in the -- actually, this is the eastbound direction. castro valley boulevard on-ramp on to eastbound 580, a crash between a big rig and a car. be aware of that incident over there. it could be slowing things down. you can't see the crash icon because it is hidden behind that 580 -- 580 sign u that see there. but this is macarthur freeway southbound 580 in oakland. the left lane is blocked because of a collision. two-car collision there. things are looking good on highway 4 up until half an hour ago. westbound highway 4, three-car crash we are hearing about at bailey road. it is blocking one of the right hand lanes. be aware of that. your drive on the east shore freeway, the carquinez bridge to the macarthur maze, very good this morning. it was a trouble spot earlier this week with all of the rain we had. not the case today. you can see sun shining there. the bay bridge toll plaza also a very easy, very light drive in. let's go back to the desk at 8:03. we're following the latest on the bomb that was dropped yesterday. >> it killed 36 isis fighters and there is no evidence of civilian casualties. >> gasia and mike, the commander of u.s. forces in afghanistan says the bomb was effective and it achieved its intended purpose. take a look at video. it was released by the pentagon this morning showing the massive blast that the bomb created yesterday in eastern afghanistan. the official name is gbu43b but better known as moab, a massive ordinance air blast. also nicknamed the mother of all bombs. the u.s. and nato commander in afghanistan says it was used to destroy extensive bunkers, tunnels and mind fields built by isis near the border and killed 36 fighters. >> we had service tent surveillance over the area before, during and after the operation. and now we have afghan and u.s. forces on the site and see no evidence of civilian casualties nor any reports of such. >> this video is file footage taken during a test of the bomb. yesterday's attack though was the first time that the bomb was used during combat. it is the largest nonnuclear weapon ever used by the air force in their arsenal. and the aggressive move had the clear backing of president trump. trump. >> we have the greatest military in the world. and they have done a job as usual. so we have given them total authorization. that's what they're doing. frankly that's why they have been so successful lately. >> the bombing now brings up questions as to whether this could be a message to north korea following last week's missile attack on a syrian air base. the pentagon is strongly pushing back against a report that they could launch a preemptive strike. we will wait and see what happens. gasia and mike. >> thank you, christina. nancy pelosi called it an escalation, one that congress should review. >> for things to be happening without congress' -- being part of the debate raises serious questions as to the justification and results as to what this is about. >> pelosi said while she was in san francisco at a forum on the health care of veterans, she called on paul ryan to reconvene to debate action in syria. joining us now in the studio is joe tuman, political analyst. president trump would not say if he personally signed off on this operation. does that mean anything, whether he did or didn't. >> it does. one way of looking at this or parsing his reluctance to take full credit of it perhaps is that he has learned -- he is learning on the job how to be president. there are a lot of rumbling in congress about him acting independent of their authorization for declaration of war. i don't technically think that he is in violation of the war powers act yet. but every time that he independently takes an action or this administration takes that action, congress has to pull them back in and say you're suppose today share the decision making. you can't go off on your own. >> if he authorized it, he is giving the commanders more power. >> this was an ongoing action that we had already commit today with the previous administration. i'm not exceeding my authority. if he creates the impression that he is acting on his own, it requires oversight. we won't pay for this if you don't consult us. >> this bomb had not been used before because of the concern of civilian casualties. first of all, is that the full story? second of all, the strategy here, were they taking out people or tunnels? what is the location, the timing, the place. >> militarily using something that would collapse everything beneath it was necessary to level the playing field, forgive the expression. literally level the playing field. so we could see who we were fighting against along with our afghan allies in the conflict. the other reality is we think how people will interrupt what is going on there. as we know a week ago when we -- we had friendly fire that killed 18 people who were suppose today be our allies. that hurts us in a place like syria where we need to be on the same page and feel like we're supporting one another. they are careful to say that here. to your question, do we really know if they did that or not. one thing that tell you about isis having studied it for quite a long time, when they're engaged in field of combat is to surround themselves if they're fighting for us with civilians and make them human shields. the likelihood that they weren't doing this here is probably not very high. i think it's more likely that they would have had civilians. we had reconnaissance of this before and after the bomb was dropped and there was no visual evidence of that. we will take them at their word right now. it is possible that buried under the rubble there may have been somebody. >> there is a poll that says 51% of americans back trump's moves in syria. that is higher than his approval rating. this is more about his domestic policy than what he's talking about and going and getting isis. do you agree with that, this is more about trying to bump up his numbers because his domestic policy isn't working at this time. >> that's a good question, mike. more than just the approval ratings, the president has been concerned about the ongoing russian collusion investigations. you know, did the administration when it was just a campaign, trump campaign, work with russian hackers. he wanted to change that subject. last week's launch of the missiles could be evidence from his point in view that he is not putin's puppet in all of this. but the other thing that i think is definitely the case with all of this in terms of the president's approval ratings is that any president who acts in -- in a way that looks decisively at our history will usually have the support of public. people in congress usually line up behind the president because we don't want to have a lot of voices on our side. it looks like we're confused. that reassures voters that he is a strong leader. he will get a bump in terms of this action. some were empathetic about the chemical weapons attack and the victims being children. that doesn't translate back to domestic political issue. you have to share power and the president has a mixed record. >> thank you for joining us, joe tuman. >> during his campaign president trump repeatedly said he had a plan to defeat isis and we're going have to do something extremely tough over there. this follows the airstrike in syria. last friday we asked you if you supported that or head to larkspur or tiburon to take the ferries from those locations. christien kafton, ktvu fox 2 news. new this morning, police in vacaville are investigating a late-night shooting where three people were critically injured. just before midnight, police received several 911 calls about shots fired at an apartment complex on agean way. when police arrived, they found three people shot. if you have any information about this case, call vacaville police. officials with the u.s. department of education went to richmond high school to investigate complaints about racism on campus. we talked with both students and teachers about the allegations. some students agree there is racial tension. they say the growing latino population in the community and making some african-american students feel excluded. they're pointing to an upcoming prom as an example. >> they're having a mexican band there. and the black kids don't feel comfortable with that. they want something for them too. >> i'm for all children. don't get me wrong. i feel like maybe the small percentage of the african- american kids here are getting left behind. >> the school district confirmed there is an active be closed today and there is no trading on wall street. the u.s. government is warning americans currently in egypt to stay away from places of worship for two weeks due to concerns about terrorism. several cathedrals have come under attack in recent months. u.s. officials say they're worried that americans could be targeted. islamic militants have vowed to go after christians working and living throughout egypt. target is recalling easter toys heading into the weekend. they are recalling the hash and grow easter eggs. the toys grow when you put them in water. if they're accidentally swallowed by a child, they can expand and cause intestinal problems. you can get a full refund if wuff unof these. more parents are skipping the eggs and chocolate and instead filling the baskets with expensive items such as clothing and electronics. the trend started with parents who didn't want to give their children unhealthy treats in the baskets. some are against the idea, filling easter cal train moving along nicely in the northbound direction towards cupertino. and the bay bridge toll plaza this is the picture we were talking about. very light. no delays getting into san francisco. you, allie. happening today, the controversy over sanctuary cities is front and center in the bay area. a federal judge in san francisco is hearing arguments on whether the trump administration can withhold federal funds from sanctuary cities. rob malcolm is live in san francisco at the courthouse with more. rob. >> reporter: good morning. this has been an issue that has been front and center in the bay area. of course the courthouse here has been a beehive of activity this morning. we have another camera on the steps of the courthouse. and if we take it here, we had encountered about 50 people trying to get into the courthouse. right now it is basically people trying to get in still. and large contingent of media now. santa clara county was the first in the country to file an injunction of this nature. it could be the turning point in the immigration debate. the case brought before the federal judge was filed by san francisco and santa clara counties, requesting a suspects of president trump's executive order that threatens to withhold federal funds from so- called sanctuary cities. trump signed the order in january and it targeted cities and counties that limit cooperation with federal immigration authorities. in the bay area, san francisco, san jose, and santa cruz joined alameda and oakland as sanctuary cities. santa clara county joins san francisco, requesting the court for a nationwide preliminary injunction to halt the order considered to be unconstitutional. saint clear depends on $1.7 billion annually of federal money, 37% of the total revenue. there is also concern for what this means for undocumented immigrants. >> we're already, you know, having problems with people being told, you know, even in our courtrooms, down in santa clara county by judges if you come in -- if you come in and ask for a restraining order, if you're involved in domestic violence and ask for a restraining order, you need to know that the justice department will have your name, id. they're going to know who you are. if you're undocumented, you could be walked right ow of the courtroom straight to deportation hearing. so there's a lot at stake. there's a lot at stake. we need to win. the fortunate thing is the law is on our side. the constitution is on our side. >> reporter: as you heard from cortese, there is a lot at stake. cortese and his it calls fixes for the affordable care act. the changes including a shorter enrollment window and curbs on special enrollment periods that insurers allows people to sign up only when they need costly treatment. they want to guarantee that the government will keep paying billions in cost saving subsidies that help with high deductibles. president trump is committed to repealing the affordable care act but he will try to keep the existing system going in the meantime. new this morning, the trump administration is dropping a lawsuit against north carolina after that state moved to undo its bathroom bill affecting transgender people. the justice department filed papers to dismiss the federal lawsuit. last month state leaders reached a compromise that got rid of a provision that said that transgender people had to use the bathroom on their birth certificate. santa clara police have arrested a suspect for the sexual assault of a student in february. brandon was arrested of san jose on charges of assault with intent to commit rape and kidnapping. police say on february 28th at 8:00 in the morning the victim was attacked on a sidewalk two blocks from santa clara university. the victim fought back against the suspect who then ran away. police were able to link him to the assault. police in san francisco are looking for a group of teen that's robbed a woman on a muni bus. police say when the woman got off of the bus, a group of about ten teenagers punched here, took her phone and wallet and ran away. san francisco city leaders are considering suing the state because they want to know how many ride share drivers are actually on city streets. the examiner reports the city has repeatedly asked the california public utility commission for location data of uber and lyft vehicles. officials say city planners could use the information to relief congestion but the state is refusing to release the data. according to the report, there could be 45,000 you knower and lyft drivers across the city. more protests are planned in chicago in response to the man being dragged off of the united express flight. a group led by reverend jesse jackson protested outside of o'hare airport. the video shows dr. dao being dragged off of the plane. he suffered a severe concussion, a broken nose and lost two teeth. his daughter says that they have not recovered from the three aviation security officials have been suspended as a result of the incident. a happy reunion between an 11-year-old boy and a therapy dog. he was missing for 12 days and the boy was heart broken. >> reporter: you can tell carson bates is grateful that his springer spaniel is back home. inseparable, fin is his therapy dog after the 11-year-old was diagnosed with vanishing twin syndrome after losing his twin in his mother's womb. >> i'm just happy. everything. i'm just happy that we found him. and that he is alive. >> reporter: the family considers it a miracle. on april 2nd, fin went missing avenue the family left for an unexpected trip. they came home to find he had pushed open the side gate and hadn't rushed. >> i was worried the entire time. i didn't give up on my hope. i always had that a little bit. >> reporter: there are several sightings of fin throughout the neighborhood, including here at the former naval weapons station, a restricted area. the family believes the dog crawled through a hole in the fence and even flew a drone to try to find him but no luck. >> we were getting spotty findings every day. you would get there and find turkeys but no dogs. today it was miraculous. >> reporter: after an exhaustive search, a neighbor spotted fin two miles away from the bates' home. this is video when father matt bates finally saw him. >> it was emotional because he was covered in a blanket and he was very wet and muddy. i was just very happy to see him. >> reporter: whimpering and unable to bark, they took fin to a vet where he was reunited with carson ultimately. ten pounds lighter with a fever and a swollen paw, carson happy for the first night in a while the two are able to sleep soundly together. >> he is basically like my  everything. he we have an undate to a story we first told but yesterday morning about a woman whose husband's ashes were stolen from her rental car in san francisco. we are hearing from mary wilkinson, the widow from north carolina who came to northern california to scatter the ashes of her late husband. somebody broke into her car wednesday afternoon in fisherman's wharf and stole her suitcase and her husband's remains inside of a black velvet pouch. >> they took my husband. and i feel absolutely horrible. i feel like i have donnazyme such a disservice. he was such a great man. and i just feel like -- >> wilkinson says her husband, joe, died last august of a heart attack. he loved san francisco and she had plan today scatter his ashes up in the redwoods on what would have been his 57th birthday. mary wilkinson is hoping whoever stole the ashes will return them. she is scheduled to fly back home with her daughter tuesday. she does not know if she will come back to san francisco ever again. new information in connection with a theft of some musical instruments at a high school in fairfield. police have arrested a 17-year- old from pacifica. and some of the instruments have been returned to the school. the staff noticed that dozens of instruments had been stolen out of the school band room. after getting a lead in the case, police searched a home and found two of the stolen instruments inside. those two instruments alone worth about $10,000. they arrested a 17-year-old boy for felony possession of stolen property. off to allie rasmus we go and a check of the friday morning commute. peterson says her first job was here. for decades the store provided wonderment for kids and athletes of all ages. >> i don't know where i'm going to do my christmas shopping into but times have changed. in 2007, business start today slip. a few years ago, the company started selling toys online. and through google express. >> it was one of our best money makers actually. it helped the business thrive throughout these last few years. but unfortunately the decline of in-store sales is too much. >> reporter: the manager says the problem is people stopped coming here into the store. this is the original bag. they say the issue is they couldn't keep up with the steep de clean in foot traffic and in- store sales. they looked to relocate but say that peninsula area rent was too high. so the 75-year-old owner decided it is time to retire. >> we have been such a part of the community for so long that it's just -- it just feels sad to me that we're not going to be around. >> reporter: manager miguel has worked here for more than 20 years and there are simply fewer families in the area. >> we did our research, there is just -- you know, even local elementary schools, the amount of kids being enrolled in elementary schools is at an all- time low right now. >> reporter: the store looks a lot different these days. and palo alto for that matter. >> that's part of elon musk says the company will unveil an all electric semi-truck this fall. he offered no other details about the semi, whether it will be equipped with the partially self-driving auto pilot mode. tesla currently sells two electric vehicles. its lower cost electric car is due out by the end of the year. we're hearing about a battle for trees in the bay area. apple wants to plant some 9,000 trees at the new cupertino complex. 80% of that 175 acre campus will be landscaping. but the high tech giant is running into a problem. they are battling for the top trees from nursery across the pacific northwest. jc penney is delaying plans to close stores because of a last minute surge in customers. since it announced the closures, the affected stores have seen better than expected sales and traffic. now liquidation sales are being pushed back to may 22nd. and the closures will start july 31st. the only bay area store that will close is in richmond at hill top mall. another pro trump rally is planned in berkeley tomorrow. the popular event that has been canceled due to fears of more violence in berkeley. >> there's a fire on the las vegas ago strip last night at one of the more popular hotels. it was at the bellagio and it started in the shopping area. it was also next to the lake there where the bellagio fountain show takes place. in fact the show was still going on while the fire was going. the hotel rooms and the casino were not affected. the fire was put out in about 20 minutes. no one was hurt. a landslide shut down a heavily used roadway in the oakland hills overnight. east bay regional park police discovered the lied slide at 11:00 at pine hurst road. the road is two lanes there. one of the lanes was cleared at 2:00 this morning. the roadway is often used as a shortcut to morago to the oakland hills. a man is accused of shooting a teenager on the freeway. video was released showing blanco being taken into custody yesterday. police found two guns and methamphetamine at his home. he is suspected on the shooting back on march 16th on the 101. the 17-year-old was hurt and the freeway was shut down for several hours. a popular downtown farmers market in berkeley has been canceled because of a rally that will take place this weekend. remember this video taken on march 4th. when a rally in civil center park in support of president trump was crashed by anti-trump protesters. ten people were arrested. a patriots day event is scheduled tomorrow and opponents are expected to turn up as well. antioch agreed to buy three surveillance cameras for east 18th street. the area is a hot spot for crime. city council members approved buying six more license plate readers for the city. it could be installed in the next few months. happening tonight, in the nhl playoffs, the sharks look to take a 2-0 series lead against the oilers. edmonton jumped out to a lead in the 1st only to have the sharks tie it up in the 3rd and win it in overtime. whether the sharks win tonight or not, they will have home ice event on sunday night at 7:00. if you love the warriors, you might want to wear blue and gold today. mayor libby schaaf and mayor ed lee declared today warriors friday to honor the team's fifth straight appearance in the nba playoffs. on sunday the warriors will host the portland trail blazers. to show support for the
