this morning, where people living there say this bold crime reflects a growing problem in the temescal district. in two minutes, tara moriarty will tell us what neighbors and witnesses say they want door. >> there will be a lot more today. not as windy. a little system coming down. it's on the western edge of it. it will keep us on the cool side even though we'll rebound a little bit today. some patchy low clouds don't stand much of a chance. the air aloft is really cool. 40s and 50s. we had a lot of 40s. 43 at napa. 43 mill valley. some 50s here a couple of 40s. san ramon, 49. 57 pittsburg. 50 la fayette. also on the peninsula, still 40s. menlo park, los altos and hillsborough. a little cool all associated with this big upper low which is showing signs of moving ever so slowly. and light rain up to the northeast of california and to the north of reno. looks like it's about done. mostly sunny, a chilly morning. patchy low clouds. a little bit warmer. still below average on the inland temperatures. today we'll get upper 70s, low 80s. 60s, 70s coast and bay. here's sal. we're still looking at traffic that's busy. in fact, it's getting busier as we get closer to the peak of the commute. this is northbound 280 in downtown san jose. it's slowing down getting up into the cupertino area. 101 and 85 will slowing down. there are no major problems in the area. this is a look at the bay bridge toll plaza. we have a 30-minute plus delay. unfortunately, the delay stretches from beyond the macarthur maze and that's why it's taking 30-minute drive time, maybe a little more than that, getting into san francisco. we also have a look at 580 westbound, almost an hour to drive from the altamont pass to 580. 880 in hayward is slowing down after 238. back to the desk. >> thank you, sal. oakland police are searching for two men responsible for a brutal mugging in the city's temescal district. neighbors say the attack reflects a greeing crime problem -- growing crime prob glem problem in the area. tara moriarty is live just around the corner from a string of restaurants. >> reporter: neighbors say these thieves are growing more bold. we're located close to telegraph. there's not a lot of foot traffic and they say that makes it a hot spot. it's also close to a freeway. very quick getaway. witnesses say that the young woman with the bandage on her head was mugged yesterday as she was walking to meet a friend around dinnertime. two men were huddling over her, throwing fists and made off with her cell phone and purse. it happened on shattuck as maya and her dad what were walking back from -- were walking back from dinner. they yemed to stop and -- yelled to stop and scared them off. >> you never expect that to happen at 6:00 in the evening. yeah. i'm still freaking out. >> reporter: one neighbor who didn't want to be identified said he would like police to step up patrol but he knows they are swamped with calls. >> it makes you feel prethy helpless -- pretty helpless and that they know they can get away with it. >> reporter: now, the two robbers ran down that tut and jumped into a -- shattuck and jumped into a waiting car. police have not been able to catch them yet. tara moriarty, ktvu channel 2 news. >> more details on crime in the temescal neighborhood. ktvu checked the recent crime reports in the area surrounding the location of the mugging yesterday. take a look at this. the red dots mark the location of crimes reported there in just the past week. they include thefts, burglaries, vandalism, and a robbery. even our own reporters are not immune to crime in oakland. take a look at the tweet heather holmes sent out last night from a different part of oakland. are you kidding me? could doing a live report and my purse stolen from the live truck. we were parked outside opd. police in santa cruz investigating a shooting death last night of a 15-year-old boy. police were called to an apartment on center street around 6:45 about a report of a shooting. the boy's body was found in a bedroom. several people in the apartment at the time are being questioned. but so far no arrests have been made. outside the apartment police say they located the gun believed to have been used in that shooting. it had been reported stolen last month. this morning, firefighters in piedmont investigating a small fire that started near some homes. here's new video. this is the aftermath of the fire first reported about 10:00 last night at jarome avenue and kiefer court. the fire burned some bushes and an outbuilding. firefighters had to clear some big trees and brush just to get to the flames. no injuries or major damage have been reported. 7:06. a brave 14-year-old boy from fairfield is being credited for saving and elderly man and a dog from a burning apartment. latrell says he was hanging out with a friend at their apartment complex on grande circle saturday night when he smelled smoke. he said he went to investigate and saw a disabled man struggling to get out of the smoke-filled apartment. so he went inside and helped the older man escape. the man told latrell his dog was inside so latrell returned to the building building. >> i went back down here where the dog is and back in the room where the flames are coming from, i opened the door, the dog came out. >> the young teen went back for a third time to make absolutely sure everyone had escaped. he did end up suffering minor injuries. his mom took him to the hospital. while firefighters praise his actions, they do not recommend entering a burning building without the proper equipment because it can be deadly. four women from martinez are suing papa murphy's pizza after being videoed while using an employee restroom. they are suing the owner and a former manager, 31-year-old jason la sore. the women say he put a camera in the bathroom and filmed them using the toilet and getting undressed. la sore admitted to the crime and served 120 days of home arrest. the company has not responded to the lawsuit. smart home systems have become a growing trend. it lets owners remotely control lights, lock doors and view security cameras. there's growing concern that local law enforcement agencies may be able to access your data. tech companies get requests to access e-mail. once information is stored, please could seek to view that as well. security experts recommend you read over your terms of service carefully, if you are buying this technology and that way you know what data the company will share with or without a legal order. 7:08. happening now -- pg&e crews busy repairing a damage power pole in atherton. it's knocked out the power for some of the customers in the area. you are looking at live pictures. we are aright there on ringwood road. there's that power pole. workers tell us a car crashed into the power pole earlier this morning. we don't have any word on how many people lost electricity in atherton or when they are gonna get their power back but again we're live on the scene in atherton. they are fixing that power pole after a car smashed into it knocking out some power for some of the customers in the area. we'll keep you posted. 7:09. san francisco voters will probably have two options in a battle over soccer fields in golden gate park. the city's ready to renovate the current soccer fields near the beach chalet by installing lights and artificial turf. the chronicle reports opponentings are gathering -- opponents are gathering signatures for a fake ban in the western part of the park. ed lee and several supervisors are planning to put their own measure in favor of the artificial turf on the ballot. happening today -- ride sharing companies like u berand lyf -- uber and lyft say that business is being threatened by new legislation. christien kafton has more. good morning. >> reporter: good morning. state lawmakers are considering some new rules for ride sharing companies and ride sharing companies like ubler and lyft are saying legislation has the risk of putting them out of business. one bill would require them to monitor driving records of their employees, require more extensive background checks and provide the same insurance coverage that taxi caps provide. the other bill, dairying commercial -- carrying commercial liability. both bills are under consideration by commit es today. supporters say the ride sharing companies need to be regulated the same as taxis. the people we talked with would like to see the same rules for the ride sharing companying but would not like to see them regulated out of business. >> i think it's good. half of the time you can't get a cab. >> reporter: now, uber has ononline with their campaign encouraging california to get on board saying what's needed is sensible regulations and is encouraging riders to contact senators to reject legislation that attacks renovation, listen to what californians want and stop what they are calling an effort to hurt small business owners. uber says one of the bills is a play by the taxicab companies to kill competition and the other is an attempt to serve their own interest. the ride sharing companies say the new rules have the potential for putting them out of business and they say that could hurt the general population of california because it would then reticket their options -- restrict their captured by a storm chaser in pilder yesterday. at least two people including a 5-year-old girl were killed. a stanton county commissioner says more than half of the town was wiped out. our reporter is live now with a look at some of the damage. good morning. >> reporter: good morning, tori. well, this town is about a square mile and now the people here are faced with having to rebuild, including rebuilding their post office, fire station and even city hall. the images are menacing. two tornadoes left a path of destruction in their wake. >> this is the first time i've seen two tornadoes like that that violent on the same storm. a lot of times you will see multiple storms and a dominant one and then weaker ones. >> reporter: the worst hit was the small town of pilger. they estimate three quarters of the town is gone. >> three houses on the opposite side of the block are gone. >> reporter: what about your sister's house? >> it's gone. it was on the corper. it's gone. >> sick. lost everything. >> reporter: pilger is not alone. damage is spread across four towns. nebraska's governor has declared a state of emergency putting the national guard on standby. now residents are left to pick up what's left of their town. >> rebuild. gonna take a long time. >> reporter: the national weather service says this same weather system spawned 32 tornadoes across four states. and now back here live, you can see that the wind whipping up again just making the miserable task of cleaning up that more difficult hear in pilger, nebraska. back to you. >> all right. thank you, paul. 7:17. the pentagon now moving more fire power in iraq as a terrorist group there continues a push to take over iraq. want to show you a map. these are the cities in iraq now controlled by the group known as isis. it's a branch of al qaeda. it is being called the most dangerous militant group in the world. they want to create an iraq that's ruled by islamic law. yesterday, president obama said 275 u.s. soldiers and marines will be deployed to iraq. they will provide support and security for u.s. personnel and also the u.s. embassy in baghdad. the president says the troops are equipped for combat and will stay in the country until that situation is resolved. now, some local war veterans who already served in iraq say it's upsetting that american soldiers are being called back to iraq. >> when i left iraq in 2004, we just captured saddam and i was think, awesome. we'll be out of iraq soon and the country will be able to stabilize itself. >> well, as that organization, isis, keeps pushing towards bapgd, the u.s. has ordered a thousand of the 5,000 staff to evacuate that city. john kerry says the obama administration is closely watching the situation and they will respond as necessary. >> all right. a story we'll continue to follow. right now, sal, keeping a close eye on the south bay. getting busy down there. >> it is. right now we do have a lot of slow traffic on 280, 85, 101. i want to start with 280 just so you can see it here. it's very slow out of downtown san jose, driving umg to the -- up to the cupertino area. this is taking 20 minutes. kind of a long one this morning. i want to show you on the map. we can trace it out. a lot of the slow traffic is just right here on 280 downtown section. it gets better but 85 is slow into the valley and 101 is going to be slow as well. as we push down to the south bay, southbound 880 traffic is busy, especially before 238 and 580 traffic is slow. we want to look at the eastshore freeway, that traffic continues to look steady at about a 23-minute drive. live look now at the bay bridge toll plaza, that's backed up for a 30-minute plus delay. i don't see any improvement. you can see on the left-hand side, a lot of slow traffic coming in from the 880 interchange. 7:19. let's go to steve. mostly clear out there. a patch or two of fog. san mateo coast, santa cruz coast. it won't last long. it's clear. the wind has tailed off considerably. yesterday was rip roaring along. turbo charge, all associated with a strong, cold low up in the pacific most. you can see the ridge of high pressure. everything came ditching down. water temperatures still cold, 49 to 54 degrees. golden gate, 52. the fog no problem forming. it's today it will be warmer. still below average. but warmer after the cooldown yesterday. napa was 75 yesterday. livermore, 71. should be 86. that's way below, as you might imagine. san jose, 71. san carlos was only 68. today, 75, 76. might be warmer for tomorrow. san francisco struggled yesterday with the temperature. 60. today we'll go 65. that's a little bit below average for this time of year. 67 is the normal high. 53, the low. we'll be pretty close today. the record high, 95, 1993. the record low all week long they've been in the 1800s. 47 back in 1899. i shouldn't say all week long. it's only tuesday, steve. we have a little bit of patchy low clouds around. other than that, it's clear and it was chilly. larkspur, 44. napa airport, 43. a lot of 40s. now we're starting to see a little bit warmer conditions. but half moon bay is 48 degrees. so clear sky. that's why. a couple of 40s holding on. calistoga. it looks like the breeze here is collapsing. saratoga, 46. i think these are a half-hour old. so probably warmer than that. this system is big. billings, calgary. it's on its way to the east. it sent in rain up towards northeast california, susanville and right to the north of reno, partly cloudy skies up in tahoe and truckee but i think they will go mostly sunny quick. 43 in tahoe. 50 in ukiah. 45 eureka. it was cold in northern california. mostly sunny. a few high clouds. a little bit of patchy fog. it looks good and it will be warmer. temperatures starting to bump up. 60s, 70s. lower 80s. mainly you throw that in there. and again most of these should be 82, 86 inland temperatures. saratoga, 78. 77 woodside, also palo alto in there. san bruno, brisbane, 67. 62 in half moon bay. they made it to 46. that's pretty cool. thursday looks mostly sunny. with the water temperatures so cool and we lose the wind, it looks like a quiet pattern friday into the weekend. 7:22. a san jose state student seriously hurt in an apartment fire two months ago, talking pub publicly about it -- push lickly about -- publicly about it for the first time. who alerted him uncovers what agents calls one of the largest cases of its kind. jorge guevara is accused of rolling back dozens of odometers at vehicles sold at his dealership in antioch. police uncovered an operation where a customer, actually an undercover, was ready to pay cash for a car with 115,000 miles. it turns out the car had 260,000 miles. >> to say the odometer was broken, in a case here or there, we can understand that but to have multiple vehicles or half of the inventory is unfathomable. >> state investigators say jorge guevara also owns a smog shop on the property where they believe the odometers were rolled back before the cars were put back on the lot for sale. the dmv is investigating to see how many cars were involved. >> the dmv says there are cars to detect odometer fraud. let your own mechanic inspect the car and check the maintenance records and retail the history using car fax or auto check. baseball fans all over the country mourning the death of one of the true greats of baseball. tony gwynn, only 54 years old, his death is raising questions about the use of smokeless tobacco. now, tony gwynn had been fighting salivary gland cancer which he says was the result of a long-time habit of chewing tobacco. friends say he spent the final years of his life warning others about the dangers. >> he started to share that have individuals, don't make the same mistake i made. hopefully people can hear that, those words and they sink in. >> the cancer that ended the life of one of the most successful hitters of all time. tony gwynn was a 15-time all- star. he won eight batting titles. he had more than 3100 hits during his 20-year career with the san diego padres. the irs scandal is back. it's bigger than ever. the new controversy involving a former irs chief and some lost e-mails. >> reporter: should juveniles who sexual assault someone face harsher penalties? that's what one south bay mother wants and she's headed to sacramento to talk about that. sexually assaulted at a high school party and having pictures of the assault shared among her peers. today, a bill named after audrie will face a battle in the state assembly. coming up in two weather and traffic and steve, you say it won't be as chilly today as yesterday. >> no or as windy. it will still be on the cool side. we'll dump the temperatures up a little bit. we get a more northerly direction. it won't be as windy and warmer. yesterday was way below average. a little bit warmer. kind of a quiet pattern. we'll get a warmup. after that, we settle in. i don't see one extreme or another for a while. a little bit of patchy fog. i expect that to get chewed up fast. the wind has tailed off. 50s on the temperatures. we had a lot of 40, including on the coast. san ramon, 49 now 51. the peninsula had a lot of 40s. these might be on the old side. menlo park, skyline, palo alto had 40s. the low responsible is right there. it's finally pushing. it will be a huge severe weathermaker. another one moving across as that gets out of the rockies. for us a little bit of cloud cover up in the northeast part of the state, maybe a few high clouds. but it looks like everything is moving off into nevada into california. a chilly morning gives way to california. a lot of sunshine today. and a little bit warmer. 60s, 70s. low 80s. here's sal. steve, just in the last few minutes we've seen a little bit of improvement at the bay bridge. not much but a little bit. i want to show you the toll plaza area, traffic is still superheavy. when you see this area, you can see how heavy it is. i will get the cursor out of the way. we're seeing traffic better. it's beginning to move and the traffic might be better in an hour, barring any crash. last time we saw it, it was absolutely standing still. let's go to the san mateo bridge and the traffic is moderate. at the bay bridge, it was a 30- minute plus delay. san mateo bridge about a 15- hint drive from the hayward toll plaza to foster city. san jose, a lot of slow traffic. 101 and 280. it's better than usual. 101 is not a solid line of slow all the way up to mountain view but most of it is. 7:33. back to the desk. happening today -- a bill named after a south bay teenager sexually assaulted is being heard in sacramento. it imposes harsher penalties on juvenile offenders. ktvu's janine de la vega joins us live from san jose to tell us why the bill might have an uphill battle as it heads to the state assembly. good morning, janine. >> reporter: good morning, tori. the mother of audrie pott is on her way to sacramento right now. her daughter was sexually assaulted and she supports automatic two-year sentences for juveniles who offend and she wants this bill to sail through the assembly. it is called audrie's law. it's named after 15-year-old audrie pott who was a saratoga high school student. she hung herself in 2012. her parents say she was upset after drinking at a party, passing out and being sexually assaulted. according to a wrongful death lawsuit, the three boys involved took pictures of the assault and showed them to the people involved. the boys received sentences ranging from 30 to 45 days. under audrie's law, anybody accused of abusing an unconscious person would get an automatic two years. critics call it too harsh. opponents say the focus needs to be on rehabilitating youth offenders and judges should be flexible in treatment, probation and jail time as option. the bill also calls for those hearings to be open to the public and news media. this bill is being discussed at 9:00 a.m. at the public state committee. it will be possible there will be amendments to pass there and in the assembly. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you. 7:35. reef leaf may be coming for people who commute along the busy corridor in the east bay. commercial property owners in pittsburg just agreed to a new tax measure to help cover the cost of building a new e- b.a.r.t. station in the area of railroad avenue and highway 4. the taxes would only apply to people who file for a new building permit around the station. the project, which would use small diesel powered rail cars is part of a ten-mile extension. it's expected to be completed by the end of 2017. san francisco police investigating a homicide in the mission district. just before tong last night, police -- 10:00 last night, police rushed to a call near cap street in the victoria theater. the man was pronounced dead at the scene. john sasaki took this photo. several police cars at the scene. investigators have not told us his name yet or how the man was killed. if you have any information call san francisco police. we're getting new information about a san francisco man who prompted a nationwide manhunt after fbi officials say they found a homemade bomb in his apartment. ryan chamberlain was in court yesterday. he pled not guilty to federal charges that include possessing an illegal destructive device and possessing a firearm with a serial number filed off. prosecutors accuse chamberlain of assembling what's called a clothes pin switch. but the plans to use it remotely to set off a -- with the plans to use it remotely to set off a bomb. they say chamberlain had caster beans which contain the deadly poison ricin. >> we're seeing the forensic labs trying to analyze things as they are building the case and there may be added charges. >> they say a search of his ipad and iphone turned up search phrases, including homemade switch, ricin, poisoning, killing and untraceable. in the meantime, chamberlain's lawyer said he's not been charged with possession of toxins and said if you check the online activity of anyone, you could turn up similar search phrases. he's due back in court on thursday and the focus then will be on his mental health condition. the chp is looking for the driver of a hit-and-run crash that badly injured a woman in alameda county. it happened yesterday just before 11:30 a.m. on westbound interstate 580 near grant line road. wents say a dark colored vehicle suddenly swerved and hit a truck. the driver of the truck, a 25- year-old woman from modesto, was taken to hot with major -- to the hospital with major injuries. anyone with information is asked to call the chp. a 7-year-old boy is recovering in the hospital after being hit by an surf while riding his bike in berkeley. it happened in the area of bancroft and action street yesterday. you can see the bike pinned under the suv. the boy was wearing a helmet. he was taken to the hospital with serious injuries. his condition is said to be stable this morning. later today, community members are set to deliver a petition with 30,000 signatures to the archbishop of information. they want the archbishop to cancel plans to speak at this week's march for marriage rally in washington, d.c. critics of the march say it's organized by two groups that are openly hostile to gays and lesbians. however, the archbishop rejected these calls for him not to go to the march, denying that the march demonizing homosexuality or same-sex marriage. the archbishop sent out a letter saying it's important to get to know the people you disagree with. i'm quoting here, when we come together, seeking to understand the other with good will, miracles can happen. well, today, president obama flies to new york city. he will attend a democratic party fund-raising gala with gay right supporters. this comes after a white house announcement that the president will sign an expectative order banning federal contractors from hiring or firing employees based on their sexual orientation or gender identity. 21 states including california already have laws banning discrimination based on sexual orientation. 7:39. the house committee investigating the recent irs scandal has subpoenaed the current head of the tax agency. panel members want the irs commissioner to testify about the agency's claims. it cannot locate a number of e- mails belonging to former irs chief lois learner. the tax agency outraged congressional leaders saying they cannot find any of the emails prior to 2011 because her computer crashed. the country still buzzing after a thrilling u.s. victory in the world cup. the testimony of weight loss products. the goal what can be done to protect consumers. now, dr. oz is there. he's been under fire in the last few minutes about what he says and does on his show. he says after performing thousands of surgeries on people whose hearts had been severely damaged by obesity, he decided to get involved in teaching people how to take better care of themselves. he says consumer scams and fraud concerning weight loss products plagued him and his work long before his talk show started. >> it's a problem that i have spent immeasurable time, broadcast resources and money to combat. >> now, dr. oz, under attack in this hearing accused of endorsing products and making promises to consumers about so- called miracle pills. now, the hearing is still going on right 7:47. this morning, the defense begins presenting its case in the bryan stow civil trial in los angeles. the lawyers for the dodgers and former team owner frank mccourt will spend the next five days calling witnesses. the jury could then get the case sometime next week. stow is suing the dodgers and mccourt for negligence saying they failed to provide adequate security at dodger stadium on opening day 2011. stow was nearly beaten to death in the stadium parking lot. yesterday, an expert testified his injuries could cost stow $37 million over his lifetime. 7:47. the san jose state football player who was seriously hurt almost two months ago in an apartment fire. he's now talking publicly about his ordeal. >> the skin is discolored but it's all healthy skin. just needs to get the color back. >> with his mother by his side, that's jared leaf showing us the burns on his hand and upper body at the family home in martinez. he was injured when his off- campus apartment caught fire right there. he was asleep. he got a phone call from a friend telling him to get out. >> ran through basically a wall of fire. i think my whole living room and kitchen was on fire and just ran out the door. >> now, doctors and nurses, they've given him a nickname wolverine because they say he's healing an an amazing rate. he's hoping to attend san jose state's football training camp and at the end of the month and hopes to pursue acting. >> really? multi-talented. nice to hear he's healing fast. we want to check in with sal. is the traffic healing in the south bay? >> nice transition. >> i would say. >> a little bit. a little bit. there's still some slow traffic, to be sure. let's start with 280 northbound as you get up to the 880 interchange. you can see traffic is moving along okay. you can see a lot of slow traffic right through here obviously. it's not all that bad. if you are driving from southbound 280 over to northbound 880, that traffic will be slow. let's move along to the bay bridge toll plaza, you can see traffic here is going to be a little bit slow as well. it's about a 30-minute drive time getting into san francisco. itsim proching a little bit -- it's improving a little bit. also westbound 580 we have slow traffic on 580 westbound from the grant line exit to 680. it's about 50 minutes. this was sent by april ashley go. that's the twitter handle. look at all of the slow traffic in vallejo past highway 37. it's very, very slow. we appreciate when you send things like that. of course, send them safely. don't be taking pictures while you are san jose. it will be warmer today. water temperatures cooled off again from 49 to about 54 but it will be a warmer forecast. we had some really cool air come in aloft also at the service and inland temperatures, 10, 15 degrees below average. that doesn't support fog. but a warmer forecast will especially as we head towards thursday and friday. it's really losing out to some much drier air and also more of a northerly breeze. a lot of 40s. now we're in the 50s. yesterday, we couldn't even find a 60 until after the 9:00 hour. 50s to the north. calistoga made it to 44. lakeport, 48 now 53. i know sebastopol was 46. now 57. healdsburg, 56. north bay, i think is in better position for some northerly breezes and a warmer forecast. i don't think it's this cold. i think that's about an hour ago. overall, here's all you need to know -- the wind has collapsed at travis. it was 40 miles an hour. 35. it's gone from 26 down to calm. that's a sure sign it will warm up. there is a hint of an easterly breeze for oakland as well. this is a big, big system. there are winter storm warnings out for snow in western montana and severe weather warnings out in eastern montana. when this goes across the country, this will be a major weather player. this is unseasonably strong and cold for this time of year. once it clears the rockies and starts to interact with some of the gulf moisture coming up, it will be just unbelievable as far as severe weather goes. look at that line just made it into susanville. probably quincey, up there in quincey. the clouds made it to truckee, tahoe, reno. but the precip stayed to the north, near gerlack. bill up there. the system moving out into parts of the nevada. chilly lows. clear, starting to warm up a little bit today. and temperatures high pressure will build in. we'll get a decent warmup tomorrow. it will come back down. the extended outlook looks quiet. thursday into friday. mostly sunny. chilly morning. 80s on some of the temperatures after yesterday's 70. so 60s, 70s and 80s but these are still below average for some. concord should be close to 84. livermore should be closer to 86. warmer out towards pittsburg, say a dump truck was unloading bark. the truck became stuck and the piles of bark then caught fire. about 50 firefighters were out there battling those flames. no one was hurt. police have found the man who attacked two priests in phoenix last week. 54-year-old gary michael moran was arrested at an urgent psychiatric facility on sunday. he is facing murder charges in the shooting death of kenneth walker. he's also facing charges for the brutal beating of father joseph. tracy morgan is no longer in critical condition. ten days after a crash that badly injured him and killed one of his friends. morgan has been upgraded to fair condition. he suffered broken ribs and a broken leg when a walmart truck crashed into the limo bus he was in on the new jersey turnpike. a criminal complaint alleges the driver of the wall mark truck had not slept for more than 24 hours before the crash. he has pleaded not guilty to death by auto and assault by auto charges. a florida boater caught the ride of a lifetime with a very large fish. the whole thing was caught on video. james bosswick is in the water every day. last friday, he spotted a fish he had never seen before. a whale shark. it's the largest fish in the world. swimming with one has been on his bucket list. he jumped in and grabbled the wham shark's fin and hung -- whale shark's fin and hung on for the ride. >> it was just as curious about us as we were about it. >> three other people also joined him in the water. marine shark experts say the whale sharks are protected, cannot be caught. it's okay to swim with the sharks as long as you quick look at weather and traffic. so steve, a little warmer today? >> absolutely, tori, dave. pretty cool start. everything continues to drive down from the north from that really strong low. now it's up in idaho, pacific northwest. you can see the high pressure building in. that will help swing in a few high cloud. not nearly as windy. yesterday was howling. warmer today. it's a quiet pattern. it's not so much now, one extreme with the law. but if things start to level off, it looks like we'll stay there. a little bit of patchy fog. most of that is about done. the breeze has tailed off considerably. very, very cool. now we're getting some 8:00 temperatures. 61 in fairfield. 61 santa rosa. because -- i bet they have a northerly breeze. we're out of the gate much faster with the temperatures. yesterday we were in the 50s. also towards the peninsulas, had a lot of 40s. temperatures beginning to move out pretty fast here and for good reason. the low responsible is purring off toward the east. a lot of cool air in place. just gets modified this time of year. a lot of partly cloudies in the sierra nevada. almost got some precip. mostly sunny. it will be sunny for us after patchy low clouds. a little bit warmer especially nir you a yas -- in areas that get the north wind. 60s, 70s, coast and bay. here's sal. some commutes are getting better. that's the good part. the bad part we've had some incidents. we have an accidents cleared to the center divide but traffic is slow in downtown san jose. your drive time is way up here if you are driving into cupertino, 20, 25 minutes coming up to highway 17. let's take a look at 880 southbound. we have slow traffic coming down to fremont. we had an earlier crash there as well. that's backed up from 92 heading south. bay bridge toll plaza, right now, westbound, the 880 approach is your best approach. i would say. 580 is not bad either. things are definitely getting improved or improving here at the toll plaza. i also want to mention in vallejo, west 80 at redwood. that accident that was in the lanes is gone to the side but people are still very slow past the scene. 8:03. back to the desk. police are busy trying to catch the man who brutally attacked an woman in oakland in an areas where people say crime is escalating. tara moriarty is live from the temescal neighborhood. you have been out there all morning. you are in an area where there's popular restaurants, tara. >> reporter: that's right. neighbors say these thieves lately have been getting a lot more brazen. they say that not only are they attacking -- targets cars, they are now attacking people, especially along this stretch, that you see right here. it's actually an area that doesn't get a lot of foot traffic. it's become a hot spot. if we pan over to the left a little bit, you can see that there's a freeway. so people who live around here say that's a very quick getaway for the robbers. the young woman with the bandage on her head was mugged. two men were huddling over her, throwing fists and made off with her cell phone and purse. it happened on shattuck. mark sommer said he witnessed a similar attack years ago and said nothing for year of his own safety. but last night he found the courage to scare off the offenders. >> i hope i helped. the police said it was a good thing that that happened. i felt -- what if it had been my daughter? so i really feel glad that this time i didn't withhold zblget the two robbers ran down shattuck and jumped into a waiting car. police have not caught them yet. we're trying to see if there's any surveillance video in this area. so far we haven't been able to find any. but we will be getting in touch with police later to see if they have any further description of the suspects. >> more details. ktvu checked the recent crime reports for the area surrounding the location of that mugging last night. the red dots you see there, they mark the location of crimes reported there in just the past week. they include thefts, burglaries, vandalism, and a robbery. even our own reporters, we're not immune to crime in oakland. take a look at this, the tweet from ktvu's heather holmes. she sent is last night while covering this story from a different part of oakland. it says, are you kidding me? doing a live report at oakland police headquarters and my purse stolen from the live truck. we were parked outside of opd. 8:06. evacuation orders in central california have been lifted for hundreds of people forced out of their homes because of a big wildfire. it's burning in kern county in the mountains about 40 miles west of bakersfield. it started friday night and has destroyed three homes and damaged several others. the cause of this fire is still under investigation. in the meantime, people in two native-american communities near the new mexico/arizona border have been evacuated because of a big wildfire. strong winds intensified the fire in the mountains. it's burned more than 17 square miles. so far no homes or businesses have been destroyed. the fire started after someone was burning leaves near a lake and then lost control of the flames. boaters in the city of martinez say the marina is an in extremely bad shape and now the city plans to do something about it. people who go in and out of the marina say one third of it is unusable. there's damaged daublgs stacked with -- darks stacked with -- damaged docks stacked with debris. martinez officials are asking the state to turn over the property so it can be rehab imitated -- rehab imitated. >> it will give us -- rehabilitated. >> it will give us the chance to free up capital to free the marina. >> they say the marina could take money if it were in better shape. if the city gets the land it would give some of the revenue earned back to the state. pg&e crews are busy fixing a power pole in atherton damaged when a car crashed into it earlier this morning. these are live pictures. you can see what looks like a new power pole being lifted into place. in the past hour, one lane of ringwood road was reopened. we're told crews will have to replace the pole so traffic may be impacted in that area for a few more hours. several homes are without electricity. still no word on when power will be fully restored. 8:08. happening today -- could be trouble at the state capital for ride sharing companies. ktvu's christien kafton is in san francisco now at uber headquarters with more on the proposed legislation this can change the way ride share companies are regulated. >> reporter: state lawmakers considering making changes to how the ride sharing companies are regulated. uber and lyft are fighting back saying those changes could put them out of business and would endanger their business. lawmakers are considering the ride sharing companies to monitor driving records of their employees, require more extensive background checks and provide the same insurance coverage that taxicabs provide the second bill, that they carry commercial liability insurance. that insurance could kick in any time the app was turned on whether they had a fare with them or not. supporters of the bill say the ride sharing companies need to be regulated the same ax taxis. people -- as taxis. people we talked with would like to see more rules but wouldn't like to see the companies regulated out of business. >> i think there should be more rules anding arelations as far as -- rules and regulations as far as safety. >> reporter: uber is encouraging california to get on board. uber says one of the bills is a play by the tax cab industry to kill competition and the other bill an attempt by insurance companies and trial attorneys to share their interest. and this would limit consumer options which would be bad for consumers, they say. christien kafton, ktvu channel 2 news. >> thank you. san francisco voters are likely to have two options in a battle over artificial turf in golden gate park. san francisco is ready to build soccer fields with lights and artificial turf near the beach chalet. the cell phonicle reports -- chronicle reports opponents are gathering signatures to ban fake grass in the west end of golden gate park. they have until today to put their own measure on the ballot. cut back on water use to help the drought or keep your lawn green. officials from the department of water resources say there are ways you can do both. some of their recommendations include keeping your grass long, longer grass means longer roots which can reach deeper into the soil for moisture. it's also a good idea to water early in the day and use sprinklers that have multistream rotors. >> good advice. an oakland man who spent eight years in the army, he's pleading for thieves to return special flags that were stolen. roderick williams put up that new flagpole last september for his flags. he had a u.s. flag, a pow-mia flag. earlier someone jumped over the fence of his house and stole all three flags. >> i'm a disabled vet, you know, why? what's the reason why stealing somebody's flags? >> you don't see very many people showing pride in the service that they've given to our country. so i thought it was very admiral that he had the flags flying. >> mr. williams thinks whoever stole the flags. they don't under the importance to them. >> he's called oakland the u-verse revolves around you. more coverage now. the two deadly tornadoes that leveled a small town in nebraska, would you look at this. a storm chaser captured this yesterday in pilger, nebraska. at arrest two people, including a -- at least two people, including a 5-year-old girl, were killed. a stanton county commissioner says more than half of the town was wiped out. our reporter is out there now live to show us more of the damage. paul? >> reporter: you can see a town devastated. they are gonna have to rebuild their post office and fire station, even their city hall. as one resident put it, pilger is the town too tough to die. the images are men as ing. >> they are merging. >> reporter: two tornadoes ripped through northeast nebraska, leaving a path of destruction in their wake. >> this was the first time i've seen two tornadoes like that, that violent on the same storm. a lot of times you will see multiple tornadoes and one dominant one and then weaker ones. >> it seemed like forever, but i guess it was only a couple of minutes. it was coming down on top of us, but the coolers head together wonderfully. >> reporter: the worst part hit, pilger, 90 miles from omaha. officials are still assessing the damage, but they estimate three quarters of the town is gone. >> three houses on the opposite side of the block are gone. >> reporter: your sister's house? >> it's gone. it was on the corner. it's gone. >> sick. lost everything. >> reporter: pilger is not alone. damage is spread across four towns. nebraska's governor has declared a state of emergency putting the national guard on stand by. now residents are left to pick up what's left of their town. >> rebuild. gonna take a long time. >> it will be a setback. we'll get something done, i'm sure. >> reporter: and as you look live residents starting to walk through here and try to figure out just how to clean up the mess. so many houses just reduced to stacks or piles of wood. they estimate that more than commute. still pretty busy out there? >> it is busy. we have a lot of slow traffic. highway 4 for example, westbound is still only about 13 minutes. it's up a little bit but it could be a lot worse between pleasant hill road and the caldecott tunnel. the commute at the bay bridge toll plaza is showing imimprovement as well. it looks like improvement on the 880 approach. this is a 20, 25-minute drive time into san francisco. and we still have pretty robust drive time here if you are driving from livermore to the 680/580 interchange. its improved by -- it's img -- improved by five minutes. 8:18. let's go to steve. thank you, sal. clear skies, a little breezy but not that bad compared to yesterday when it was really howling. had gusts 40, 50 miles an hour. that will not be the case today. we get the northerly or northwest direction. what we call a little deep trough over the west coast. we could have used it in the winter time. it will be a warmer forecast today after yesterday's big cooldown. patchy fog at best. it looks like a lot of that has disappeared or is losing out. it is too cool to get a northerly breeze. the lows, even though they were cool are starting to rebound pretty fast. this is a monster system as had comes out of a montana -- out of montana, wyoming and utah. look at the scope of that. it also spun in a few clouds and light rain. northeast california and a lot of cloud cover up towards the sierra nevada didn't make it there. had 30s tahoe and truckee. reno and tahoe. that's pretty cool air. 61 in sacramento. they are starting to bounce. times. tony gwynn was a 15-time all- star who won eight batting titles. he had more than 3100 hits during his 20-year career, all with the san diego padres. >> incredible man. 8:24. the 49ers say they are changing the way they do business after getting an angry letter from a civil rights group. the group accused the 49ers of excluding minority companies when it gave out contracts to build the stadium. in response, the 49ers ordered the main contractor to reopen bids for jobs that had not started. the 49ers now say more minority- owned companies are involved in building the stadium. and when it opens, august 2nd, those companies will be even more involved. however, one activist is estimating only 2% of the stadium's construction contracts went to minority or women-owned companies. safeway has settled a lawsuit by investors challenging a $9 billion buyout deal. now, safeway agreed to turn over money to investors when it sells the grocery chain in mexico clearing the way for servers to take over. er is everybodiers wants to -- servers wants to challenge kroger. suzi orman quietly getting out of the payments business. she teamed up with banc corp. now, approved cardholders they are getting letters say the cards will not work after july 1st. they are encouraging cardholders to spend all the money on the cards before then. and then they will send checks to the people for the money left over. 8:26. a young man praised and credited for saving more than one life during a fire at his apartment complex in fairfield. wait until you hear the story of his stunning courage. he half-hour from now, the focus will be on a hearing in sacramento surrounding a bill that cracks down on pushing juveniles convicted of sexual assault. it's named after a saratoga high school teenager who committed suicide after being sexually assaulted. janine de la vega is live from san jose and janine, you just got off the phone with the senator who authored that bill. what did he have to say? >> reporter: well, he says, it's going to be tough. at 9:00 a.m., he will head into the public safety committee meeting and he wants them to pass audrie's law but says the chair is opposed. it imposes a mandatory two-year sentence for juveniles who sexual assault someone who is unconscious. audrie's law passed unanimously in the senate but it still needs approval in the say semably. audrie -- assembly. audrie pott took her own life after she was sexually assaulted while unconscious by her classmates. photos of the incident were taken and shared. legislators supporting the bill say the three boys involved received sentences that ranged from 30 to 45 days because current law makes assaulting someone less serious if they assault someone. opponents call it disturbing because it would be the first time a mandatory minimum sentence would be set in the juvenile justice system. brain research shows juveniles are less come a bell for their -- cuppable for their actions. it's a possibility amendments may be made to appease politicians on the fence about it. if it passes, it still needs a two-thirds majority to approve it. janine de la vega, ktvu channel 2 news. >> thank you. 8:33. police in santa cruz are investigating the shooting death last night of a 15-year- old boy. police were called to an apartment on center street around 6:45 last night after a report of a shooting. the boy's body was found inside a bedroom. several people inside the apartment at the time are being questioned no arrests have been made so far. outside the apartment, police say they found the gun believed to have been used in the shooting. it had been reported stolen last month. firefighters in peadmont are investigating a small fire that started near homes. it was first reported around 10:00 last night at jarome avenue and kiefer court. the fire burned some bushes and an out buildings. firefighters cleared large trees and brush to access the areas. no injuries or major damage was reported. we're learning more about a brave 14-year-old boy from fairfield credited for saving an elderly man and dog from an apartment. he said he was hanging out with a friend at their apartment complex saturday night. he smelled smoke. latrell went to investigate. he saw a disabled man struggling to get out of a smoke-filled apartment. so he ran inside and helped him get out. the man told him his dog was still inside, so latrell went back to that burning building. >> i went back down here where the dog is, back here in the room, i went and owned up the door, the dog came out. >> brave young men. he then went back for a third time making sure absolutely everybody had escaped. latrell ended up with minor injuries. he was taken to the lapt by his mother -- hospital by his mother. firefighters praise him for his heroism but don't recommend going into a burning building without the proper equipment because that can be very dangerous. four women from martinez, they are seeing papa murphy's pizza after they say they were videotaped while using an employee restroom. now, the women are also suing the owner of the martinez store and their former manager, 31- year-old jason lasore. the women say lasore put a camera in the bathroom and filmed them using the bathroom and getting undressed. lasore admitted to the crime last year and served 120 days of home arrest. the company not responding to the lawsuit. smart home systems are becoming a growing trend. it lets a homeowner remotely control the lights in the house, lock the doors, look at security cameras. now there is a growing concern that local law enforcement agencies may be able to access your private information. tech companies already get requests to access e-mail and phone records. once home security footage is stored on a server outside of your home, the police could actually seek to take a look at that as well. security experts recommend make sure you read over the terms of service very carefully if you are buying this kind of technology. that way you know what kind of information the company will share with or without a legal order. a lot of people all over the country still buzzing after a thrilling u.s. victory in the world cup. other crimes are the reason one oakland city councilwoman is opposing electronic recycling machines in that city. the eco-atms are like coin star machines for electronics. you take your electronic device to the machine, insert your driver's license or state i.d. and you can get cash in a matter of minutes. the counsel woman says she's worried because the process is so easy it could lead to more people being robbed. officials with the company say security measures are in place to prevent thieves from et going away -- from getting away, including taking photos of the person recycling the devices. >> there are some minimal security things that the company might tell you about a thumbprint but all of that is so after the fact. it's retroactive. it does not stop the crime. >> oakland's city council will discuss whether or not to ban the machines when it meets next week. raising the red flag about false advertising for weight loss products. >> there's not a pill will help you lose without diet and exercise. >> tough questions a tv doctor is facing from members of congress. >> reporter: oakland police searched for the muggers who were responsible for a brutal attack on a woman in the temescal neighborhood. we just got off the phone with police and we'll tell you what they had to say about the suspect's description and the getaway car. still very slow in some areas out we're following for you right now -- pg&e crews still busy fixing a power pole in atherton. a car smashed into it earlier this morning. the crews out there have replace the power pole. so traffic in the area will be affected for a few more hours. several homes still have no electricity. just a short time ago we found out that a rally will be hemed at the state capitol this morning opposing antiride sharing legislation. the bills would require the companies like u berto -- uber to monster the driving records and also conduct extensive background checks. it would also require ride sharing companies to have the same kind of insurance as taxicabs and be closely regulated. oakland police still searching for the man who brutally attacked an oakland woman last night in a neighborhood where people say the crime is escalating. tara moriarty has been on the story since 4:30 this morning. tara, you just got off the phone with police and they have a description of the suspects and a getaway car. good morning. >> reporter: that's. they do but they are not -- that's right. they do but they are not revealing that information. they are pursuing leads and they will be digging up surveillance video within several blocks' radius of where we're standing on 46 get and shattuck avenue -- 46th and shattuck avenue. we know this area has seen a spike in crime. police say they are beefing up patrols. witnesses say that yesterday the young woman with the bandage was brutally mugged as she was walking to meet a friend around dinnertime. witnesses saw two men huddling over her, punching her. they made off with her cell phone and a purse. one neighbor said she's been calling police reporting three to four robberies each day along shattuck between 46th and 49th. he says that he tried to stop one burglar just hours before this assault. >> he showed up in a cadillac with his baby and a partner in the back. i yelled at him not to break in the car. he looked right at me, broke into the car, put the bag in the car and took off. makes you feel pretty helpless. >> reporter: now the two robbers ran down shattuck, jumped into a waiting car. police are following leads. we expect them to pam cook has been listening into a hearing in washington, d.c. it just wrapped up in the last half-hour. pam, you say the focus of this hearing was on diet supplements and also dr. oz. >> yes, certainly. the hearing is concerning deceptive advertising of weight loss products. dr. oz is at the center of this discussion this morning. he testified at this morning's hearing and had to answer a lot of tough questions about what he does and says on his show. he's accused of endorsing products and making promises to consumers about so-called miracle pills. but senator mccatskill who led the hearing said that's what meem want to believe -- people want to believe there's a magic people. she read a quote. >> every time you cheat on your diet, i want you to grab one of these tiny, pills. this tiny tablet can push 0 a lot of fat on the -- push a lot of fat out of your belly. >> i have people i want people to try. >> now, dr. oz stated that he came to the hearing to be part of the solution, not part of the problem and told the committee that he believes you cannot lose weight without diet and exercise. he says consumer scams and fraud concerning weight loss products plagued him long before his talk show launched but the committee focused on finding better ways to protect consumers. pam cook, ktvu channel 2 news. >> thank you. foods sold in grocery stores and restaurants could be less salty in the near future. the fda is getting ready to ask the food industry to lower sodium levels. but the changes could be voluntary. the food industry has already made some reductions. the fda says bigger reductions in salt usage to prevent thousands of deaths of heart disease and strokes. the recommended daily amount is one teaspoon, dave. >> i know. >> most people have 50% more. >> most of the salt is not what you shake on the food it's already in there. you have to look at those labels. hey, sal, everybody behaving on highway 101? >> i think the behavior is getting thursday. a little cooldown looks like for the weekend. ford suvs are are the most popular in the u.s. with thieves acourting to the national insurance crime bureau. the ford escape was the most stolen suv between 2011 and last year. the edge and explorer were close behind. jeep's grand cherokee and kia round out the top five. they say compact suvs were taken twice as often as their full-sized counterparts. more suvs were stolen in california than any other state. just checking the stock market right now. it looks like tesla's stock is up almost 3% in early-morning trading. tesla's stock jumped almost 9% yesterday. that wiped out all of its losses so far this month. the price hike came after reports that nissan and bmw are interested in teaming up with the palo alto-based carmaker. it's believed the three companies want to expand the network of charges stations. nissan is the biggest electric carmaker in the world and bmw is starting to produce luxury this week's rally, the march for marriage rally in washington, d.c. the critics say it's organized by two groups that are openly hostile to gays and lesbians. however, the archbishop has rejected calls for him to stay away denying claims that the march demonizes homosexuality or same-sex marriage. now, the archbishop sent out a letter saying it's important to get to know the people you fund-raising gala with gay rights supporters. this comes after the president will sign an order banning federal contractors from hiring or firing employees based on their sexual orientation or gender identity. 21 states including california already have laws banning discrimination based on sexual orientation. the house committee investigating the recent irs scandal has subpoenaed the current head of the tax agency. panel members want the irs commissioner to testify about the agency's claims it cannot locate a number of e-mails belonging to former irs chief lois learner. the tax agency outraged congressional investigators by saying it cannot find her e- mails prior to 2011 because her computer crashed. new this morning, the pentagon says a libyan militant accused in the deadly attack on americans in benghazi is now in u.s. custody. this marks the first time the united states has arrested a suspect believed to have been directly involved in the deadly attack on september 11th, 2012. sources tell the washington post, the suspect is a senior leader of the benghazi branch of an international terrorist group. terrorists killed christopher stevens and three other americans. the obama
