it. >> it's just really hard and i still haven't, um, kind of, like, worked over, like, how to be okay with that. >> reporter: horowitz did not get the endorsements of the students of color coalition. but she said the whole incident has not sidelined her campaign. in fact, she said it's going full speed ahead and voting starts tonight here at stanford university. live at stanford, len ramirez, kpix 5. last month there was a similar claim of anti-semitism by a student the ucla. more than 100 local leaders are calling on pope francis to replace san francisco archbishop salvatore cordileone. new at 6:00 elizabeth cook is in the newsroom with more on the calls for his ouster. >> reporter: this comes in the wake of the continued debate over the so-called morality clauses. cordileone has included in contracts for teachers and staff at four san francisco catholic schools. the group appealed directly to the pope. the letter will appear in tomorrow's edition of the "san francisco chronicle," including staff, volunteers and board members of catholic charities. the group says the clauses have caused division in the community. the clauses call for teachers to abide by church teaching, against sex outside of marriage and homosexuality. the archdiocese has responded to the ads saying, quote, the advertisement is a misrepresentation of catholic teaching. a misrepresentation of the nature of the teacher contract. and a misrepresentation of the spirit of the archbishop. the greatest misrepresentation of all is that the signers presume to speak for the catholic community of san francisco. they do not." among the high-profile signatures on the letter, charles [ indiscernible ] cofounder and current cochair of adobe. in the newsroom, elizabeth cook, kpix 5. you have about five hours and 58 minutes to get your tax return postmarked but julie watts explains why this year many are told to file them using false information. who would give you that advice? >> well, the feds are actually giving folks that advice. thousands of americans may be filing inaccurate tax rushes tonight because they have been told to ignore mistakes made by "covered california" and other federal and state healthcare exchanges. >> i need my tax refund. >> i want to file on time. >> reporter: but like thousands, stacy and jeff have been forced to wait months. diligently checking the mail for tax forms "covered california" was required by law to get them back on february 2. >> they have had plenty of time. they knew this was coming. >> sure, it is our responsibility to get the forms out on time. um, and accurately. >> reporter: "covered california's" dana howard was not available for an interview today but last month chalked up the delayed forms to growing pains of a new healthcare exchange. last month, the agency acknowledged at least 4500 enrollees had not received their tax forms in addition to more than 100,000 who received inaccurate forms. at least 13% of the forms sent out. today tax day the numbers are growing. "covered california" now says nearly a quarter of a million enrollees were impacted by missing or inaccurate forms that they know of. the agency claims the corrected forms have all now been sent out. but nearly every comment on "covered california's" facebook page is in reference to related tax troubles. while some like stacy did finally receive their missing tax formulas week, they arrived riddled with mistakes and no time left to send in another dispute. an issue so prevalent nationwide, the feds announced they won't be penalizing people who file inaccurate tax returns due to mistakes made by healthcare exchanges like "covered california" and the federal healthcare.gov. and while exchanges are chalking this all up to a learning curve, enrollees are learning a lesson. >> my experience with "covered california" is one of general frustration and finding them to be inept and incompetent. >> reporter: now, while jeff is still not receiving his 1095 by mail it showed up online last night so many are complaining today they can't log into their online profiles to check to see if theirs is now ther. "covered california" has a team dedicated to disputes and calling people to tell them they don't face penalties for filing returning with the incorrect forms. >> should you file an amended tax form now in the event you might get the 1095 later? >> reporter: well, now, you could. you can actually file an amended form if you do get accurate information down the road. but the feds say you don't need to. but, many people are going to want to -- but some people will if the mistake is not in their favor and they are supposed to be getting money back. they are going to want to file the amended return. >> there you go. all right. julie, thank you very much. waiting until the last minute to file, are you? hm! well, here are the few options to drop your taxes in the mail. post office at sfo will be open until midnight. got to drive to the airport for that. the one on evans avenue closes at 8:30 so you still have time. if you are in oakland, main office on 7th street also closes at 8:30. and you have three choices in san jose tonight: stations at eases ridge mall, oakridge mall open until 9:00. eastridge mall open until 9:00. lundy open until 8:00. san jose is bringing the pitch to the supreme court to bring the a's to the south bay. today they asked the supreme court to step in. san jose wants to build a downtown ballpark for the a's. major league baseball has stood in the way of the effort. territorial rights belong to the giants. mlb is reluctant to step in. the sport has had an antitrust exemption since 1922. the city's lawyers say it is the only league that has, and times have changed so should the exemption status. >> with huge broadcasting and media contracts, licensing revenues, baseball is not just a sport on the field. baseball is a business and should be treated like every other professional sport. in fact every other business in america. >> in an interview last week phil matier asked a's owner lew wolff about the court battle. lew wolff was reluctant about pressing the san jose issue. >> there's a lot of complications to it with territorial rights and so forth and, um, but it's not worth a nasty battle in my opinion. >> as for san jose's case, lawyers say the earliest a hearing could happen is this fall. that's if the high court takes it. it a decision could then come sometime next year. it's one of the biggest days of protests in the fight for a higher minimum wage all across the country. thousands of people walked off the job today. this is the movement in berkeley. hundreds of people started at uc and they marched to a mcdonald's on shattuck avenue in just the past hour. this was the scene at a mcdonald's in san francisco's mission district. the protestors are calling for a 15-dollar an hour minimum wage. san jose, oakland and san rafael saw similar demonstrations today. down south in los angeles, hundreds of people flooded the streets outside another mcdonald's and other fast-food restaurants, as well. today's movement comes just two weeks after mcdonald's announced it would increase pay by $1 an hour. workers say that's just not enough. a construction worker trying to stop a rolling four ton pipe is crushed to death. da lin spoke to the man's family who gathered at the scene in petaluma. >> reporter: the accident happened back there. the worker killed is a young man from novato who graduated from san marin high school in 2004. 28-year-old jared overfield was working on the highway 101 widening project when this large pipe crushed him. a forklift operate her set the pipe on the ground and it somehow rolled down the hill. the chp says jared was trying to stop it. but he never had a chance. contractors say it's a concrete reinforced steel pipe and weighs 8,000 pounds. the family is devastated. >> jared overfield was a remarkable child. he loved what he did. he loved what he learned. and, um, he'll be missed. >> the best brother i have ever had. i'm going to miss him. >> reporter: the chp gave the family some privacy with the body. jared was one of five siblings. the family gathered around his body and some brothers and sisters by phone and they shared their favorite stories about jared. after that, the coroner removed the body from the job site. in petaluma, i'm da lin, kpix 5. >> the construction company gave jared's hard hat to his family. cal/osha says it could take a while to finish its investigation. five-year-old girl is recovering after she was attacked and choked by a total stranger. this happened this morning in san francisco's marina district. police describe what unfolded at the intersection of union and octavia. >> turns out the girl was walking with her mother when this man came up to the chilidog provoked grabbed her by the neck and choked her. >> the man was arrested within minutes. a high school student says a man tried to get her into his car this morning at a 7-eleven on contra loma boulevard. she then got into her own car and drove to school. she says the man started to follow her but then took off. only description is he was driving a black supported explorer a fiery face-off at the state capital over a parent's rise to choose on vaccination for children. there have been death threats against the state senator who wants to force children to get vaccinated. hundreds lined the hallway for and against the bill. those in favor say it increases public health. opponents call it unconstitutional. >> vaccinations have prevented more than 21 million hospitalizations, 732,000 deaths among children born in the last 20 years. >> it's a denial of due process and denial of right to exercise of religion. >> the vote with no open discussion will happen a week from today. still ahead, a morbid attraction on the beach. a whale washes beach. scientists finished the necropsy and have just released what they found. kpix 5's devin fehely is live in pacifica. devin, are they any closer to figuring out what killed this massive animal? >> that's acareer ender. say the wrong thing during a commercial break that's a career ender, dude. >> reporter: they probably will not be able to definitively determine the cause of death. all day long there's been a steady stream of people come down to mori point. they performed a necropsy on the animal. they say it appears to be an adult sperm whale. the animal weigh severely underweight and may have been sick or starving at the time it washed ashore. more >> bones are protruding, not eating. not a lot of stomach contents. >> reporter: the samples they checked today were not fresh enough to determine an official cause of death. so what happens now? the marine mammal center says they would prefer to leave the animal exactly where it is and allow nature to take its course. but they say that they are also in communication with the city of pacifica who may want to bury the body. in pacifica, devin fehely, kpix 5. pretty big changes coming to a bay area landmark. kpix 5's don ford on why the artist behind the iconic lafayette crosses says it's time to take 'em down. >> reporter: thousands of crosses have covered this hill for the last 8 years, what started out as protest to the iraq war overtime morphed into quasi war memorial. now it's in grave condition. >> they are falling over, not grounded, rotting, not standing up tall. >> reporter: jeffrey is the original artist who started it all. he says it hurts to see what has happened to the memorial. peeling paint, splitting apart. some have elaborate decorations while others a simple tribute to a loved ones but time has run out. can you maintain it? >> no, i'm taking them down. they are -- the crosses are coming down. >> reporter: when? >> um, effective immediately. you want to watch me take them down? >> reporter: and just like that, jeff climbs the hill to the original cross he placed eight years ago almost overcome with emotion he carefully removes the very first cross and carries it off the hillside. >> i was hoping that all the crosses would be hand made out of concrete. but thank god that didn't happen because it would be really hard to get them all down if they were. >> reporter: jeff takes only one down today. there are more than 4,000 crosses left. some are falling down themselves. jeff says no one seems to care anymore. >> nobody is helping me to fix the crosses up. >> reporter: what took eight years to build may be gone in a matter of weeks. it will still take quite some time before all these crosses are removed. the artist says he wants each person who placed the cross to now come and remove it himself. in lafayette, don ford, kpix 5. >> a brazen smash-and-grab caught on camera in san francisco. a team of burglars is still on the run tonight. the four suspects were calculated when they showed up outside of "stuff" on valencia street this morning. they pulled up in a black truck and used a slingshot to shatter the front doors. some of them stood outside on watch. they stole $5,000 worth of merchandise. the store owner is banking on the video to bring the thief to justice. >> it appears from the video that they are using the people that are on the street as lookouts while they do their crime. >> police say three burglars escaped in a truck the fourth got away on bicycle. thieves have hit a hayward little league hard. they broke into a clubhouse at a park over the weekend and took a safe. it had $7,000 in it from a fundraiser. the league does have insurance to cover the loss. it is offering a $1,000 reward for information leading to the arrest of the crooks. in 10 minutes an east bay water district will decide on mandatory water cuts. this time it's the contra costa water district. they are considering a 25% reduction. right now, the district is under a voluntary 15% cut back. the board will also take a look at a possible rate hike and consider a ban on watering your lawn more than twice a week. time for a look at the forecast. chief meteorologist >> reporter: if the neighbors object? >> this is consistent with the zoning and, in fact, it's well below the zoned capacity for the site. >> reporter: plus, by not using any federal or state money, lucas cuts through a lot of the red tape that usually slows down projects like this to a snail's pace. >> all these rules don't apply. >> reporter: so the neighbors really wouldn't have too much of a say in this? >> well, this is marin county. the neighbors will always have a say and they should. >> reporter: not all of lucas's gifts have gone over. he hit the wall when he tried to donate a museum to the presidio national park but this deal has a secret weapon right out of yoda's own playbook. and in the world of politics that is one heck of a force to be with you. in san anselmo, phil matier kpix 5. >> 70% of the development will stay as a park and you won't even be able to see the housing from the road. the feds are slapping a $30 million fine on san francisco- based heald college for allegedly misleading students. the department of education says the college has shown a pattern of falsifying alumni employment data. in one instance, their honolulu campus said a graduate had found a job as an accountant when she was really working at taco bell. the department says in other cases, the company actually hired its own graduates for temp jobs in order to inflate the job placement rate. a california judge declined to remove marijuana from the list of most dangerous drugs. the case stems from a marijuana grow operation. it is the first time in decades a federal court has seriously considered marijuana's classification as a schedule 1 drug. those are defined as having no accepted medical use and a high potential for abuse. marijuana's place in that category puts states that have legalized the drug at odds with federal law. a florida man is in jail tonight after landing a personal aircraft on the lawn of the u.s. capitol building. craig boswell reports the man says that he was just delivering a message. >> reporter: it's not a bird and it's not a plane. a florida man managed to land what's called a gyrocopter on the grounds of the u.s. capitol in washington wednesday afternoon. visitors never expected to see this on their tour. >> we are wondering what it is, amazed at it but still confused. >> reporter: u.s. capitol police arrested 61-year-old doug hughes, a mail carrier who said on a website he had a delivery for congress. letters to each member demanding campaign finance reform. he made his intentions public in a video from the tampa bay times. there's a no-fly zone over the capital and hughes says he knew the risks. >> i'm defenseless. they could knock me down -- a boy scout with a bb gun could shot me down. >> reporter: the surprise landing closed the visitors center and local streets. capitol police officers picked up the copter and loaded it on a trailer. they found nothing hazardous on board. craig boswell, cbs news, capitol hill. >> hughes could face civil and criminal penalties. still ahead finding light from a dark experience. the inspiration for this bay area couple now helping people all around the world. >> plus, 30 grand for an ipad? that story on bay area nightbeat at 10:00 on our sister station, kbcw 44/cable 12. people in need from oakland all the way to angola have the support of this week's jefferson award winners. but elizabeth cook is here to explain this isn't exactly how they hoped life would turn out. they are make the best of this. >> absolutely. it's a really incredible couple, ken. marilyn and jerry burke took the worst moments of their lives and channeled their pain into something very positive. reporter: >> now as we move on -- >> she was bright. she was fun. and sunny. >> just the word kindness. when people sort of regale us with stories about julia, they don't talk about her successes that much but they really talk about the kindness. >> reporter: marilyn and jerry burke are talking about their only child, julia. >> very concerned about people left behind by their political and economic systems. >> she just always reached out to those who were struggling. >> reporter: they dreamed of starting a foundation to help disadvantaged people with the hopes that one day, julia would take it over. but in october of 1998, julia was killed in a car accident. she was just 16 years old. in the midst of the worst tragedy a parent can face, marilyn and jerry found a way to keep julia's spirit alive. >> there's a lot to be done. >> reporter: one month after her death, they started the julia burke foundation and began supporting groups that were important to their daughter, everything from helping underprivileged students to helping to raise awareness about organ donation. >> she said, if somebody has something they don't need and it could save the life of their father, mother, sister, brother, friend, why would they not give that gift? ♪[ music ]♪ >> reporter: julia also loved music and, in fact, after a long day she would often play the flute just to relax. and it was in this very room where she fostered that passion. >> ready, clarinets -- >> reporter: bob athayde was julia's music teacher at stanley middle school in lafayette. >> they just say bob what do you want do, how do you want to do that? okay, we'll fund that. if it's funding for our complete recording studio, stereo systems, instruments. >> reporter: jerry and marilyn have donated money and time to over 30 organizations around the world, all while staying true to their daughter's values. >> they took that which most people would have just pushed them over the edge and made a foundation to help people. >> here's another one. >> reporter: for turning their grief into giving, this week's jefferson award in the bay area goes to jerry and marilyn burke. elizabeth cook, kpix 5. one of the programs close to the burks' hearts, one of the many programs students rising above a project founded by our very own wendy tokuda. wendy tells us the burkes funded a special online portal to give young people tips on getting into college. all the wisdom sra has gathered over the years. it's for any student whether he or she is a part of the sra program or not. >> wow. pretty amazing, huh?
