right side of your screen. still about 10 minutes from willow pass to 24. this accident blocking at least one lane. be prepared for slowdowns out of concord and pleasant hill. your ride along westbound 24 looking fantastic. making your way over towards 580, 580 approach towards the maze. metering lights are on at the bay bridge toll plaza and the backup at the maze, 15 minutes to san francisco. three things to remember today as we start the month of december. our conditions are very typical for this time of the year. foggy in the morning, across the north bay and central california very foggy. sunny skies and temperatures in the 60s this afternoon. clouds are building up this weekend. no rain. here's the golden gate bridge. no fog there. and our san jose live camera showing a clear condition there. 43 degrees in san jose. santa rosa at 34 degrees. that's where we are seeing that dense fog. so the south bay, east bay looking nice and clear. santa rosa improved to three- mile visibility and petaluma went from one to seven. so that's good news. the dense fog advisory is right there from places like manteca, fresno, bakersfield all dealing with dense fog advisory throughout southern california, fog won't let up until after 11 a.m. >> the undocumented immigrant accused of murdering kate steinle is found not guilty. jackie ward reports. >> reporter: this is where she was shot and killed. a couple of summers ago back in july of 2015. you can see a memorial in her honor has been set up with a lot of candles and flowers and american flags. the verdict came in yesterday and it's shocking. it was unexpected after a four- week trial and six days of deliberations. the jury found jose ines garcia zarate not guilty of murder, not guilty of involuntary manslaughter but guilty of being a felon in possession of a firearm. as an illegal immigrant from mexico, homeless, his status was and is part of a national discussion regarding immigration and sanctuary city status. public defender matt gonzalez argued that the gun garcia zarate was holding went off accidentally before a bullet ricocheted off the concrete pier striking steinle in the back. this is a huge win for the public defender's office. >> this case was a terrible tragedy. our greatest fear is that mr. garcia zarate would not be able to get a fair trial. >> the verdict that came in today was not one we were hoping for. >> reporter: steinle's family was not in the courtroom when the verdict was announced. kate steinle's father jim told the "chronicle" after the verdict that he was, quote, saddened and shocked. he said justice was rendered but not served. keep in mind the jury was told to keep all information, all thoughts about immigration, out of this case. he has remained in custody since the arrest. he is back in court on the 14th. he could get three years. that court date is a status hearing. we'll then learn when he will be sentenced. and this morning on twitter, the leading thing trending now is boycott san francisco to explain what that trend means, the columbia bugle a commit commentary on twitter says san francisco failed kate steinle twice. they protected the illegal immigrant who went on to kill her. they allowed the illegal immigrant who killed her to get away with murder without any punishment. americans are not safe in san francisco. hashtag #, boycottsanfrancisco. in san francisco, jackie ward, kpix 5. thank you. i.c.e. says: prevented if san francisco had simply turned the alien over to ice, uested, instead of releasing him ba the streets." d at 6:30 our coverage ntinues with reaction fr president trump. it was a year ago tomorrow, that dozens of people were killed >> and ahead at 6:30 our coverage continues with reaction from president trump. [ no microphone ] [ no audio ] >> reporter: good morning, anne. that's right. tomorrow marks the one-year anniversary of the tragedy and we're here at the chapel of chimes in oakland, this cremation service offering its chapel as a place for people to reflect this weekend and remember the 36 victims of the oakland warehouse fire. it happened a year ago this weekend. now, this isn't the only place that's doing that this weekend. in front of libby schaaf's office there is a memorial outside her office where two artists who lost friends in the fire installed an art installation. visitors are invited to leave notes there to the 36 people who were killed when that warehouse went up in flames during an illegal dance party in the fruitvale district. now, at least 20 people mostly artists illegally lived in the warehouse. it was converted into this may -- into a maze of living spaces. it offered more affordable living compared to bay area rental prices. but prosecutors called it a death trap and the master tenant and a second in command there are facing manslaughter charges. those two pled not guilty. now, records show city police, firefighters and building inspectors visited the site before the fire. it was never shut down. the tragedy put a spotlight on shortcomings with the city's fire inspections and the housing crisis. the city did announce changes and promised to hire more building inspectors and according to an east bay times report, the city ultimately investigated more than 70 complaints of illegal housing at buildings like warehouses and storefronts. in addition, another 140 complaints for garages and basements and other structures illegally converted to housing. here at chapel of the chimes, they are opening their doors to folks who want to come in from 8:30 to 5 p.m. to just reflect, leave notes, candles, cards, to the 36 victims of the oakland warehouse fire. reporting live in oakland, i'm jessica flores, kpix 5. this morning neither the president nor white house is offering an answer on whether reports are true that secretary of state rex tillerson is going to lose his job in the coming weeks. the president and tillerson are set to meet today. president trump and secretary of state rex tillerson are scheduled to meet for lunch today. yesterday, mr. trump gave no indication the meeting would have anything to do with reports tillerson is about to be fired. >> rex is here. >> reporter: cbs news has confirmed the white house is drafted and is circulating a plan for his exit. replacing him with current cia director mike pompeo. white house spokesman sarah sanders when pressed on it also refused to give a yes or no answer on tillerson's future. >> when the president loses confidence in someone, they will no longer serve in the capacity that they are in. >> reporter: the news follows months of growing tensions between tillerson and the president. among the most high-profile disagreements, north korea. shortly after tillerson announced the u.s. was in diplomatic contact with pyongyang, mr. trump tweeted out, quote, he is wasting his time. there's also the report in july that tillerson called the president a moron in front of a group of officials. still, the state department insists tillerson is continuing with business as usual. >> he kind of, you know, brushed this off today. he has heard these kinds of stories before. >> reporter: the state department says white house chief of staff john kelly called tillerson's chief of staff on thursday and told her, quote, the rumors are not true. several sources tell cbs that kelly has signed off on tillerson's exit plan. if this shuffling does happen that would leave the opening for cia director mike pompeo. republican senator tom cotton of arkansas would likely be offered the position. pressure is growing on the longest serving member of the house of representatives to step down in the face of sexual misconduct allegations. congressman john conyers has represented detroit since 1965. he was just hospitalized for stress. >> i pray for congressman conyers and his family and wish them well. however, congressman conyers should resign. >> conyers' lawyer is rejecting the request that conyers leave the house. the lawmaker continues to profess his innocence. in the senate an ethics panel is opening a preliminary inquiry into claims made against senator al franken. five women have accused the democrats of misconduct and an image of franking groping a woman was displayed on that billboard in los angeles for a short time yesterday. it was quickly removed. the cutouts were taken from a photo of franken groping leeann tweeden in 2006. a street art group named unsavory agents claimed responsibility for the billboard. time has run out for congress to fund a critical healthcare bill. now money set aside for almost 9 million children and pregnant women across the country is expected to run out. kpix 5's katie nielsen is here to explain how this could impact many here in california. katie. reporter: in the golden state almost two million children and pregnant women get their health insurance through the children's health insurance program or chip. but if you look at this map from the kaiser family foundation, you can see california is projected to run out of those federal dollars to pay for chip by the end of the month. the issue isn't whether congress wants to continue the program. it has bipartisan support. but what they can't agree on is how to pay for it. california's been getting almost $3 billion a year from the federal government to fund the program. now, if congress can't decide on the funding soon, the state will have to pay. >> if chip goes away and that's going to blow a billion-dollar hole in our state budget. >> reporter: chip started almost 20 years ago as a way to provide health care for working class and low-income families many of whom aren't always able to get employer insurance. california has more people in the program than any other state, more than a million children and half million pregnant women. >> we are close to the end of the year. how likely is it that congress will pass this [ no audio ] >> the russians knew and it could potentially be used against -- as a way of compromising him. um, and so this is what is at the heart of this plea deal that we're expecting to hear more about in the coming minutes and hours. >> all right. we'll be standing by. thank you very much, jeff pegues. paula reed is outside the federal district court house in washington where flynn is scheduled to appear in an hour from now. paula, good morning. >> good morning. now, there were several clues this plea deal was coming. sources confirm to us that mike flynn's attorneys had stopped cooperating with the white house and stopped sharing information with them about the investigation. sources also told me that certain witnesses who were expected to testify about nike flynn before the grand jury had been told to hold off. they had been pushed bawe also attorn were two possible things he could be charged with. the first was violations of requirements that you have to register when you're lobbying on behalf of a foreign country. we know that at least half a does witnesses have gone before the grand jury here at federal court and testified about mike flynn's lobbying work on behalf of turkey and russia. we knew that was a possible charge and it at peers here in this plea deal, special counsel has pushed aside that charge for now, and allowed him to only plead guilty to making false statements to the fbi about his meetings with russian ambassador sergey kislyak. now this is an incredibly significant witness for robert mueller, because you have to remember, mike flynn would have been there for all the initial -- the discussions and conversations with the administration at the outset. so he's going to have a lot of very valuable information for the special counsel. >> paula, thank you. just to put this in perspective, the magnitude of it all. this is the second associated with the president, his campaign chairman paul manafort has been indicted, now his national security adviser michael flynn indicted as well. jeff b jeff can you give us more detail? [ pause ] reporter: kenny, we are in front of the chapel of chimes. this is a mortuary where today the chapel will open up its doors to folks who want to just reflect and maybe leave a note or flowers for the victims. 36 people killed in the oakland warehouse fire one year ago this weekend december 2nd. this is one of many places across the city that will be paying tribute to the victims. over in downtown oakland in front of the mayor's office, two artists who lost friends in this fire, they put an installation there in front of the mayor's office. visitors are invited to leave notes there to the victims. here are other tributes this weekend. there's a dance club moment of silence on saturday at various clubs. deejay danny delorean is calling or deejays to stop the music from 11 p.m. to midnight for the victims. you can also leave items at the city hall. and at the oakland museum there's going to be an exhibit called the days of the dead exhibit that will feature a nod to the oakland shows the plan would add one trillion dollars to the deficit over the next decade. supporters say it will grow the country's economy by adding more jobs. opponents claim it only helps the rich at the expense of the middle class. at the center of the plan, slashing the corporate rate. right now it's at 35%. the bill would slash it to 20%. >> the reduction in rates on businesses means that they have more to invest in their businesses and one of the by- products of that is it goes into higher wages for their employees. >> you will not support any cut to medicare and social secure? >> i am not insurance program or chip provides coverage for almost 2 million children and pregnant women across the state. if congress doesn't act soon, there won't be any money to keep paying for that program. now, the issue isn't whether congress wants to continue chip. it does have bipartisan support. but what they can't agree on is how to pay for it. chip provides insurance for about 9 million people across the country. california has the largest enrollment of any state at 1.3 million people. that's why california gets most of the money from the federal government, about $3 billion a year to pay for the program. if congress can't decide on the funding soon, the state will be responsible for paying. >> it means that a kid who with insurance would go to the doctor's office with a sore throat and get a cheap antibiotic is going to end up in the emergency room making the taxpayers pay a whole hell of a lot more than they would otherwise. >> about a week ago, lieutenant governor gavin newsom holiday season. online and for "brick and mortar" retailers, macy's says to handling the increasing store traffic they added another 7,000 holiday workers. it already hired about 80,000 going into the season. stock market is pumping its brakes a little bit after the big gains yesterday. let's go to the big board and see how we're doing in the early going. a lot of wrangling going on over the senate newest train car was taken out of service yesterday after a passenger's fingernail got caught in a door. the new train debuted on november 17th and is the first of a new fleet. >> that sounds painful. are in the red for drivers on 580. anyone heading out of livermore over to the dublin-pleasanton interchange a crash blocking two lanes in the red 39-minute ride from 205 to 680. things are starting to show a little improvement on southbound 680 and 242. that's what you're taking a live look at. we had an earlier crash with residual slowdowns 10 minutes to highway 24. 580 approach towards the bay bridge toll plaza, definitely starting to see some slowdowns as you just get to the maze but we are still okay near highway 24. we're long the eastshore freeway seeing the usual slowdowns and the bay bridge toll plaza, in the red. 33 minutes into san francisco from the maze. let's check in with neda now on the forecast. good morning to san jose right now. nice and clear for most of san jose. but to the east we are seeing that fog building up there. and here's another live look across the area this morning. this one ocean beach our camera from the cliff house and temperatures are cool this morning. in the 30s and 40s. san francisco the only one in the 50s right now. santa rosa temperatures just dropped off to 34 degrees ahead of that official sunrise which is occurring this morning at 7:06. sunset tonight at 4:50. so just before sunrise, that's when we really do see that denser fog. we have this dense fog advisory through 11:00 this morning. so that fog is really sticking around through central california, fresno, bakersfield, all impacted. as far as our area goes, you can see a lot of that fog to the east. but it's not impacting much of the east bay in the form of lower visibility. we are still at 10 miles so that's nice. santa rosa, though, 1.3-mile visibility there. expecting that to drop off now as the temperatures have reached the dew point. they are a little below the dew point actually. here's a look at our afternoon highs today. it's cool now, but it will be nice later on. mid- to upper 60s for morgan hill. temperatures 67 in antioch and brentwood. 66 walnut creek this afternoon. so sunshine and 60s again in our forecast. so certainly get those sunnies out, your sunglasses, it will be sunny later on. if you are traveling around on this friday, 61 for sacramento. lake tahoe 51 degrees. and lake tahoe may get a chance of snow. here's what's going on. we have a lot of action going on across the pacific northwest. and on saturday, we'll get some clouds because of what's happening north of us. and there's a chance for just about an inch of snow, not much from the storm system that is bringing a lot of rain for washington and oregon. a wind advisory north of tahoe in effect, waves up to 3 feet. so that means kayaks, paddle boards could all capsize so they are warning folks about that. here we go for your rest of your workweek. next week, temperatures will be warming up so we'll cool off a little bit for the weekend as those clouds roll in. but other than that, we are going to see our temperatures stay in the 60s for monday, tuesday,
