the relief and joins us from san jose. kiet? >> reporter: yeah, good morning, we're live here at the chevron just outside of the stadium where the gas prices $2.89 for regular unleaded. if you're paying with cash. basically what you're looking at here is the new normal. at least for the next couple of years. that is because there's a worldwide glut of oil. and oil analysts say we will stay oversupplied through at least 2016. and that the price will drift upward over the next couple of years gradually but don't expect gas prices to go up at least until 2017. part of the reason is that the saudi wills take a financial hit if they reduce production. also iran also has a large supply of oil ready to be released and could be pumping as much as four million gallons of oil a day into the system once sanctions are lift there. that means the national average is now down to $2.29 a gallon. california's average is about $2.99 because of that big explosion at the refinery back in february. so analysts are predicting gas will fall another 50 cents by christmas. and that will push the national average below $2 a gallon. we're live if san jose, kiet do -- in san jose, kiet do, kpix 5. >> back on at san antonio. that will get you back past the mess there. so northbound 101 two right lanes completely shut down. elsewhere, we are seeing a few brake lights northbound 101 near story road and san jose. no accidents but looks like the morning commute starting to get into full swing. also at the bay bridge big delays coming off the southeast shore freeway -- east shore freeway now. new accident reported near cutting and also working your way into the maze looking at at least a 30, 40 minutes ride from the maze making your way into san francisco. a look at the forecast, here's interesting. this is our satellite and radar and you can't even see the marine layer this morning. due to those mid and high level clouds that will continue to fuel across the bay area. lifting up in a northerly direction and ejecting to the east. so overall, partly cloudy skies today. even once the low clouds and fog dissipate. temperature-wise, 60s beaches and 60s and 70s will be common across the rim of the bay today up to the low 80s in mountain view. low 80s in santa rosa to the south low 80s in san jose and seven day forecast, that's coming up in 18 minutes after the hour. all right roberta thank you. today in palo alto a hearing is scheduled for the former scanford swimmer charged with sexual assault. 19-year-old brock turner was arrested on the stanford campus in january. police say he assaulted a woman outside the kappa alpha house. turner withdrew from stanford a few days after his arrest. today a jury trial begins on whether a man accused of mass murder in oakland is mentally competent to face charges. juan go allegedly shot seven people to death at the oikos university in 2012 and last spring a judge granted a request from a prosecutor for a competency trial. earlier a judge ruled that he was incompetent to stand trial citing reports by two psychiatrists who examined him. san jose may be down to its final at-bat in hopes of bringing the a's to the south bay. by the end of the week the u.s. supreme court expected to announce whether it will weigh in on the city's antitrust challenge to major league baseball. san jose wants to build a downtown ballpark for the oakland a's but mlb has refused to give the go ahead because the giants claim territorial rights to all of santa clara county. baseball has had an antitrust exemption since 1922. and the prime [ laughter ] good morning everyone, the time check is 6:12 on this monday, back to work and school and yesterday's temperatures spanned from the 60s at the coast to 92 degrees in livermore. but now, cooler due to that. right there. we'll talk about how cool it will be as the news continues. thanks roberta. it is 6:12. another student has died as a result of that duck boat accident in seattle that brings the death toll to five now. there's also some new information that tourest boat should have been repaired. investigators stay boat needed an axle repair years ago and duck boat was on a busy bridge thursday when it crossed the center line and veered into the on coming bus and more than 50 people taken to the hospital with injuries. at least 16 are still being treated. >> ntsb learned that ride the ducks international which refurbished the accident vehicle in 2005 notified its customers of a potential safety related concern in 2013. they recommended repair or increased monitoring by operators. >> several victims involved in the crash were from fremont. as house peeker john boehner -- speaker john boehner heads into the final days in office, he's promising to leave his house in order and to avoid a government shutdown. >> more cooperation i expect from some around town to try to get as much finished as possible. i don't want to leave my successor a -- a dirty barn. >> in an exclusive interview with cbs "face the nation," the ohio republican emphatically said it would not happen. he's been under pressure to push through a bill that would take away funding from planned parenthood. boehner says that partly played a role in his decision. and says some private words from pope francis sealed it. >> i would repeat them except it would really cause me to cry. i don't want to put my colleagues through all this. >> boehner's last day is october 30th and he served in congress since 1991 and has been house speaker since 2011. space fans are red hot with excitement about the red planet. today nasa plans to announce that it solved a big mystery about mars. won't give us any hints either about what it is. we'll have to wait until 8:30 this morning to find out. >> can't wait. >> okay. and across the sky last night meanwhile the moon put on a show last night. >> it was the first supermoon eclipse in more than 30 years and kpix 5's joe vasquez saw it with sky watchers in oakland. >> reporter: at the chabot space and science center, an overflow crowd of more than 500 patiently waits with telescopes and cameras for the sun to disappear so they can get a glimpse of a magical moon. >> it's pretty exciting. you don't get the chance to see something like this very often. >> reporter: they call it the supermoon because it appears very large, 14% larger than normal. that's because in the oval shaped orbit of the moon around the earth, this is the closest it gets to earth. then there's the eclipse. the moon passed right behind earth essentially hiding in earth's shadow and changing colors. >> because of the refraction of light through the atmosphere of the earth, caused the red light to fill that shadow and it makes the moon look like a rusty red color. >> i've never seen it before. >> reporter: you've seen the moon. >> but i haven't seen it orange because it's -- been a long time, 33 years and i'm 8. almost 9. >> we saw it when we were kids. and then now he's seeing it and then i said to him and his brother, could take their kids when they grow up. >> last time they had this was 1982. the next time is 2033. >> hopefully i'll still be here but i don't know if i'm going to be looking at it. >> 2033. forget about it. >> the fear on his face, you really did. >> i started doing it during the piece and i went no. not going there. you got a busy day don't you? busy on the roadways and really picked up in the last 20, 30 minutes especially the traffic alert along 101 and 1 and 580 and 80. this trouble spot along the peninsula. northbound 101 at rinks door of. two right lanes still shut down for a traffic alert and big rig lost its trailer, trying to get everything over to the right shoulder, delays off 237 now and backed up at least to 85 at this point. use 2850 as the alternate. that's your best bet the kind of get around the mess. you can use surface streets at san antonio. westbound 80 right at cutting boulevard one lane is blocked. the left lane shut down. they should have it cleared though within the next few minutes. for an accident but you can see it's really causing quite a bit of a backup almost to highway 4 now. on the westbound side of 80. once you pass that though, traffic isn't doing too bad towards the bay bridge. most of the delays are before that on the east shore freeway but the bridge is where the problems are now. again you will see delays off of 580 and 24 now. 880 though. not doing too bad. 880 doesn't really pick up typically until after 7:00. right now still a nice time to ride 880. north and southbound. southbound you will see a few brake lights near hayward and westbound 580 altamont pass to 680 stop and go conditions continue. good news though they just cleared the accident westbound 580 right at 680. now completely off the freeway and some brake lights show northbound side of 680 approaching 580. especially southbound side as well heading into pleasanton there as well. reports of an accident here as well. westbound near the toll plaza. not a lot of details just yet. chp just report asking headed to the scene and more on that as it comes in and clear though once you get apass the span there. -- across span there. roberta? it is 6:17. a look at the live weather camera and you have to remember it stands a little over 1,000 feet tall. i like to use it as a barometer, when you didn't see the tiptop of it which stands 212 feet it gives me a good indication this ceiling has lowered to about 800 feet. and when that happens, generally we do have delays at sfo on some arriving flights. so we'll keep you posted on that. right now mostly cloudy. 50s and 60s and we will see the return of the marine layer push back out over the open waters. but overall, partly cloudy due to mid and high level clouds. we have no big changes in this week's forecast. not a rain drop in sight. except for right there. a little bit of light drizzle associated with the mid and high level clouds that are streaming in from the pacific ocean. that's why we will call it partly cloudy today. this is your futurecast and you see the low clouds and fog hanging tight to the coast through lunch hour. not really going anywhere playing tag with the sunset district and san mateo coast and it looks like inland areas we clear during the afternoon hours. the clouds are all associated with a very weak disturbance. meanwhile, upstream this is an area of low pressure that's pooling down some cooler air mass and we will have cooler conditions on wednesday and on thursday. meanwhile, 90 in sacramento and 90 in yucaipa and upper 60s monterey bay. our numbers stacking up from the 60s at the beaches mid 70s bay side to 70s and low 8 #s around the peninsula. 87 degrees in livermore. that's down from 9 # yesterday. it will be 81 downtown san jose and that's where we stood on sunday. west winds 5 do 10 miles per hour today. we'll call it partly to mostly cloudy on tuesday. there's a bit of that cooldown wednesday, thursday. before we bump up the temperature on friday. boy, big series dodgers in town. peavy on the mound for the good guys and we need to win all four games tonight. 62. bundle up. gang? >> reporter: well, portable units behind the middle school will be used for cobb elementary school students because there's so much smoke damage at that school. but all of the primary sites in middletown are okay for students to use today except for a portable building that was destroyed by the fire. now an inspector has gone through all of the buildings and determined there's no structural damage. but extensive cleaning was required. now all the buildings were cleaned with hepa vacuums and wiped with a special solution to remove soot and ash. the fire is one of the most destructive in california history. it destroyed almost 1300 homes. but the district superintendent says she is excited to welcome students back to school this morning at 9:00 a.m. now minnie cannon cobb and the middle school will get out at 2:402 afternoon. coyote valley at 3 drank 15 and the high school out at 3:45. the buss are all fine and all been checked out and they'll be running today. but you might want to check the schedule. check the district website for the exact times and also counselors already on hand to talk with the students. lisa chan, kpix 5. federal government urging victims of both the valley fire and the butte fire in the sierra foothills to register for help. workers from fema and the small business administration say temporary housing is available at the state level the department of finance is transferring $10 million from california's rainy day fund to help pay for some of the fire clean-up. all right, 6:32. a check on our weather. good morning. >> good morning everyone. we're going to have a little bit of a cooler day today. but additional cooling takes place on tuesday. but then still cooler by wednesday. >> wow. >> until we heat -- >> about time. >> but then we heat up on friday. >> of course. >> all right good morning everyone. we have the areas of low clouds and fog this morning and even some drizzle lining the coast into the bay. once that retreats we've got all that. that you're looking at. mid and high level clouds streaming across our horizon. temperature-wise, we are in the 50s and 60s. winds are nonexistent. therefore we have areas of fog. limiting visibility three quarters of a mile in napa. temperatures coming down in fact we will see 60s at the beaches with partial clearing. 80s around the peninsula. and we will have partly cloudy conditions. 87 degrees for one of the outside numbers to the south across the santa clara valley. west winds up to about 10 miles per hour. maybe even 12. east of the bay. 87-degrees in throughout the tri-valley. down from 92 yesterday. north bay numbers stacking up from the 60s and steinson and 70s in sausalito and 80s petaluma. the full forecast coming up at 48 minutes after the hour. gianna. the peninsula we've watched this major trouble spot a big rig lost its trailer and now stuck in lanes. but chp says they should have it cleared in the next couple of minutes and still backed up along 101 off of 237 as well. again the traffic alert should be cleared up within next couple of minutes. drive times though, pretty tough. north 101, 237 to woodside that's a 29 minute ride. headed over to the san mateo bridge westbound we have reports of a multi-vehicle accident blocking lanes. busy anyway as you come off of 880. slow now 880 to 101. that's going to take you 25 minutes. traffic alert on the flip side eastbound 80 a red top. now the good news it's the countercommute direction. this is due to a brush fire it's in the right lane. westbound is where you will see the delays on 80 but the traffic alert is on the eastbound side right at red top. one lane still blocked. slow and go anyway across the freeway. we had the earlier wreck cutting now cleared but by sieve going to the -- busy going to the bay bridge. some relief for drivers and gas prices have fallen about nine cents in the past two weeks. according to gasbuddy.com a gallon of regular costs $2.92 in san jose and $2.91 in oakland and $3.09 in san francisco. kpix 5 reporter kiet do is live in san jose and tells us these low prices may be sticking around for a while. kiet? of india wrapping up a big weekend visit to the silicon valley with an event wills week at the s.a.p. center in downtown san jose. tens of thousands of people all applying for tickets to see narendra modi but only about 19,000 got in. he was focused on technology during his visit and how india and the u.s. can invest in each other's economies. prime minister modi started the day yesterday with an vaccinations to collect more than 363,000 signatures to put a referendum on the ballot. senate bill 277 requires students in california to be vaccinated with exemptions for medical conditions. if million that topped last year's launch of the 6 and 6 plus by three million. this year there was an extra week of preorder time. and last year, chinese sales were not yet included in that total and chinese consumers wound up being the big drivers behind the 6 and 6 plus sales over the past year. leading to record quarterly profits for apple. a tough day ahead for whole foods employees. the chain says it's going to cut 1500 jobs over the next eight weeks. it's trying to cut costs as it deals with rising competition. now some of those jobs will come back as whole foods opens a more budget oriented chain next year called 365. plans about 100 of those locations starting in early 2016 with a first doors opening. consumer spending rose at a decent clip in the month of august. up .4%. that suburb. >> he nearly burned down a gas station trying to kill a spider. the critter was apparently hanging out near his gas tank when he tried to torch it with a lighter. instead, the entire pump went up in flames. the gas pump was charred and no one was hurt luckily. and believe it or not, the man's car was apparently damaged. but -- i mean. >> smart enough to get a fire extinguisher but my god. westbound 92 just as you head towards the san mateo bridge we have reports of a seven vehicle accident. no -- vehicle accident. it is causing a major delay there as you go westbound 92. also slow now coming off 880 as well. looks like a 27 minute ride to go from 880 to 101 across the span there on the san mateo bridge. good news is once you get past the accident, you're looking a lot better heading towards 101. starting to see a few brake lights northbound 101 near the coliseum into oakland and southbound again you're slow especially into hayward as you head towards the delays because of that accident. busy off the bay bridge. where metering lights are on. you're backed well into the maze and approaches as well slow coming off the east shore freeway. an accident stuck in lanes at powell and an accident at cutting and also the traffic alert in effect eastbound 80 at red top. that's the countercommute. no delays on the eastbound side but westbound we are seeing some significant delays as you work your way through there near vallejo. it looks like it's 1 miles per hour in some spots. give yourself a few extra minutes there. but again you're going to see delays along the freeway headed to the bay bridge this morning. new reports of an accident westbound 4 right at 680 look at this westbound 4 really stacked up this morning. backed up all the way into antioch. stop and go conditions there. the sig alert canceled but the damage is done. roberta. good morning everybody. it is time now to take a look at our weather watchers. these are people you can be a weather watcher. all you have to do is go online and check in with us and right now, let's see who's up and reporting some temperatures for us. this is so helpful because when i take a look at this one right here, this would be john miller and reporting mostly cloudy skies and even some areas of drizzle all due to the return of the low clouds and the fog and i would not know that unless john checked in with me. meanwhile we have napa dave is reporting some partly cloudy conditions. in antioch jerry says it's clear. this is the scene as we take a lookout this morning towards sfo. and we do have areas of low clouds and fog and even a little clearing there. wow. temperature-wise, 50s and 60s. it is now 60 degrees in san jose. the winds are calm. and it is mostly cloudy. so sure we have the return of the enhanced marine layer. and then on top of that we have several layers of mid and high level cloudiness so we will refer to it as partly cloudy today. and then no big changes in our forecast. so okay the marine layer is right there. these are the clouds streaming overhead and futurecast illustrates easily today only partial coast cal clearing at west all the way through the san mateo coast and we will have some sunshine in our inland areas. area of low pressure bringing us some cooler air mass so instead of 92 in livermore today, 87 degrees. then cooler conditions by wednesday and thursday. 90 sacramento and 90 in yucaipa and it's currently 46 going up to 77 on the south shore:. here's the sunup and your sundown. we have two minutes and 24 seconds less of daylight hours today thursday. make it a great day. thanks roberta. house speaker john boehner shocking when he announced last week he'll step down sometime next month. >> boehner said he was avoiding fight over whether he should remain speaker. with more on the fight is political analyst melissa caen. >> good morning guys, sometime this week, the freedom caucus was supposed to meet to discuss the vote to remove boehner from office. now remember, there are about 250 republicans in congress and 50 of them said they were ready to vote boehner out of office. that means there were 200 others that weren't necessarily looking to do that. it is likely that boehner would have won the new vote and kept his position. still it is true that the fight would have been ugly. and it is not crazy for him to want to avoid that and remember he's been speaker for over five years. he's like the 11th or 12th longest serving speaker. >> really five years? >> a little over is that. >> what's his problem? pause a lot of republicans are not big fans. >> some people were really excited when they herd he was going to be stepping down basically. this is a group of tea party republicans saying look, republicans are in the majority in the house and the senate. so why isn't more of our -- agenda getting done? we want to shrink the government and curb illegal immigration and none of this is happening and whose fault is that? now to some degree they think it's boehner and think he has not fought hard enough and they say congress is being ignored by the president and by the senate and that boehner is to blame. now on the other side, boehner says look, we have a very complicated political process, republicans don't have enough votes to override a veto so we have to work with the president. and in the senate, we don't have enough votes to stop a filibuster so we have to work with democrats. so just because we're the majority in both houses doesn't mean we're getting to do whatever we want. in fact, boehner went on "face the nation" yesterday and was pretty blunt about how he sees the situation. >> are they unrealistic about what can be done in government? that's the -- >> absolutely. they're unrealistic. you know, but the bible says beware of false prophets. and there are people out there you know, spreading -- noise about how much can get done. >> i get the feeling that noise was like not the first choice. for him. >> no. i would say that, that's only like the third choice. >> or it was the first choice of words and that was not appropriate for family television. >> there you go. we are hearing that congressman kevin mccarthy is in the lead to replace boehner, do you think he'll be any better? >> that's the hope right. i mean he's still going to have to face the same tension between far right conservatives and the more mainstream republicans. but there is a perception that mccarthy is a good choice because he is basically the prom king of congress. all right, everybody likes him. he listens to them. he knows all about their districts. he's the quarterback of the football team. but one of the criticisms of boehner is that he was vindictive and he didn't listen to people. and he shut out the more far right elements. so the idea is maybe mccarthy would bring a collaborative approach to the office. as far as the politics goes, he didn't really different from boehner depending on where you ask a little to the left or right. he wouldn't represent a big ideological departure from boehner, just be more like a leadership style change for what that's worth. >> california guy too. be good for our state. >> that would be the hope that he would especially when we have a lot of drought legislation pending and he and his district down in bakersfield really, portable units behind the middle school will be used for cobb elementary school students because that school had so much smoke damage. all the primary school sites survived except for this portable building which was destroyed. and inspector determined the schools had no structural damage but needed cleaning and hepa vacuums were used along with a special solution to remove soot and ash and now school starts at 9:00 a.m. today. minnie cannon and the middle school will get out at 2:40 this afternoon. coyote valley at 3:15 and the high school at 3:45. now bus schedules will be different so be
