proves his hands were not in his pocket. >> reporter: in federal court, civil cases require unanimous jury verdicts. police say they had reason to arrest an amputee who died in custody. officers arrested melvin stubs on saturday for suspicion of murdering his wife. when police arrived at his apartment, it was in disarray and signs of a struggle. stubs was treated while in custody for low sugar, and was found dead sunday morning. friends say the accusations were hard to believe. >> i didn't believe that when i seen the report or whatever. i was like, wow, murder? he can barely get himself up. >> on monday, the coroner determined his wife died of acute bacterial meningitis. four people were injured when a san francisco cable car hit a garbage truck. it happened this morning as the cable car went up jackson street. the crash interrupted service along the hide, mason and california lines for several hoarse while muni investigated. none of the injuries are serious. today's wet weather is taking its toll on a few tree limbs around the bay area. "abc7 news" was at city college in san francisco this morning as workers cleaned up a large limb that came crashing down from a tree. it damaged four parked cars. the city will pay for the car repairs. crews worked to remove a sixth pine tree in oakland near highway 13. one lane of the highway was closed today as workers took down that tree. >> more trees may come as we face more days of stormy weather. >> sandhya patel is tracking the storms on live doppler 7 hd. sandhya? >> that's right, kristen and dan. as we look at live doppler 7 hd, you'll notice there's little left now of today's system, which is just spotty drizzle right now. this is all going to change. live doppler 7 hd will be tracking two storms. one is light, five is severe on our storm impact scale. we've been using this storm all winter to track these storms. the two storms coming up, two. flood risks will increase, especially as we head towards friday. already a flash flood watch beginning tomorrow morning running through 5:00 p.m. flash flooding is possible on small streams and creeks. let's look at the timeline tomorrow morning, 4:00 a.m. the rain moves in across the north bay at 7:00 a.m. it continues to shift southward by 9:00 a.m. i'll be back with the rest of the timeline and what else we may encounter coming up. in the north bay, many eyes on the russian river. with more rain coming, it is expected to be near flood stage. wayne freedman is live in guerneville to explain the plan to prevent the problem. >> reporter: good afternoon. flood stage in guerneville is much higher than what we're looking at. this is 14 feet. flood stage is 32 feet. and we may see it by as soon as friday night. it is not a first, but it is the first in four years at lake sonoma, yet another flood controlled release. it's an impressive sight, unless you're carlos hernandez, a long-time chief engineer. >> floods like this were very common years ago. >> reporter: a flood control measure based on levels at the now full reservoir above. a water release like this is all about planning and timing. >> from here down to guerneville, i think it's a good day, day and a half perhaps. >> reporter: that's important to know, because experts predict big rains beginning tomorrow. they could push guerneville to flood level by friday night or saturday morning. but the fire chief had more pressing concerns. a big rig that slid off the route blocking the way into town. >> we've had floods as late as april 15th. >> reporter: he remembers the flood of 1986, when 24 inches of rain fell in just more than a week, swelling the russian live tore a record 48.9 feet. the flood consumed this community, it caused $40 million damage. compared with that, the simple threat of a flood this weekend -- >> barely raises an eyebrow. >> reporter: it has to be like a week of rain? >> yeah. we're still delivering. >> reporter: in these parts, that attitude comes with the turf. wayne freedman, "abc7 news." a police chief finds himself on the wrong side of the law. the female dispatcher claims the chief and other officers encouraged lewd jokes and simulated sex acts. he was promoted to chief in 2014. he has no comment today. the city manager wrote an open letter saying a recent investigation "learned of past behavior by some police department employees that was inconsistent with the standards we expect." an exclusive i-team investigation uncovered a couple facing charges for sexually abusing their adoptive son. tonight, the victim is speaking out and melanie woodrow is live in downtown san jose with the story of the young man suing his parts. >> reporter: that's right. this is the civil lawsuit he's filed, basically saying he adopted him and brought him from russia to the united states for the purpose of sexually abusing him. tonight, he's sharing his story so that he can be a voice for other sexual abuse survivors. in 2000, a little boy from russia named dennis was given what he thought was a second chance. >> i lost everything. especially being an orphan and this was my way of living again. >> reporter: "abc7 news" profiled the story of russian orphans, and the couple who soon became dennis' parents. >> we became interested in the possibility of adoption. >> reporter: 16 years later, they're facing 44 criminal charges, including continuous sexual abuse of a child and incest. now they're facing civil litigation, as well. >> they're still living in denial. >> reporter: according to court records, dennis said ralph flynn began abusing him when he was 9. >> there was a lot of fear because i had just gained something that what i believed was a gift. >> reporter: he said carolyn joined in when he was 15. he said he attempted to report the abuse and called 911. he said because he was older than 18, his report was brushed aside. >> just bury it and go on with my life. >> reporter: a psychologist also called the sheriff's office. in january, the sheriff told the "abc7 news" i-team, we will examine how this official report was handled. ralph and carolyn flynn's attorneys declined to comment in the criminal matter. both said they may not be representing their clients in the civil litigation. >> now is the time to make it right. >> reporter: at 23 years old, dennis says he's finding his voice. >> as i told my truth, i realized i got more strength and integrity. >> reporter: he said he's sharing his story now so he can be a voice for other sexual abuse survivors. carolyn flynn bonded out, ralph flynn is still in jail. i reached out to the sheriff's office how the initial complaint was handled several years before the flynns were arrested. a spokesperson for that office said "we looked into how the 2012 case was handled and we have addressed that internally." live in san jose, melanie woodrow, "abc7 news." >> melanie, thank you. after a train goes off the tracks, then what? up next, trying to get back to normal as new pictures are released from inside the ace train that plunged into a cold creek. also, how big banks are taking on silicon valley over your money. frustration over sky high fees and the help that could be coming. and why you could be seeing a lot more this is "abc7 news." ace train service resumed this morning two days after one of its trains derailed because of a mudslide. nine people were hurt, all are expected to recover. ace and union pacific are looking at ways to prevent another accident like this. laura anthony is live at the ace station with the story. laura? >> reporter: hi, dan. we have seen the east bound trains roll through here pretty much on their regular schedule. ridership is down a bit, but for the most part, the riders we talked with told us they are happy to see these trains back on the tracks. it looked like business as usual on board the commuter train this morning, but there was certainly an awareness of what happened on the same line just two days ago. >> a little nervous. >> scary. just, you know, i can just try to imagine how those people felt, because it's dark out there. >> a little overwhelming. it must have been scary, because it's quite a drop. >> reporter: in the meantime, alameda county fire released this photo that shows what it looked like inside the car after it plugged into the creek. with the train back in service, ace is cooperating with federal and state investigators. and they're looking at ways to head off a similar incident in the future. for instance, installing front facing cameras and mudslide centers. >> i think it's a terrific idea, great technology. it's something our agency is not aware of. >> reporter: we could see the union pacific has put sheeting over the bank in the accident area and trains will continue to run at slower speeds through there, just 10 miles per hour. >> safety first. if there's conditions out there, they will be slower until it's safe. >> reporter: ace reports ridership on the morning commute lines was down this morning by about 20%. in pleasanton, laura anthony, "abc7 news." tonight, b.a.r.t. is hoping newly released surveillance video will help them find a man who shot someone to death on a train in west oakland. b.a.r.t. is offering a $10,000 reward for information leading to the arrest of this man. take a close look. officials hope this video will help somebody recognize how he walks. >> you can see the way he walks, his mannishisms, the way he c e carries himself. >> two months ago today, 19-year-old carlos romero died after being shot on a b.a.r.t. train in west oakland. police are looking for a missing senior citizen. he walked away from his home about 8:00 a.m. yesterday. he is familiar with bus routes. the 83-year-old was last seen wearing a red 49ers sweatshirt. renaldo has dementia and takes medication. big banks are taking on tech leaders with instant payments. bank of america announced it's joining two other banks in a system that allows customers to pay with smartphones. customers of those two banks make up 60% of people with mobile apps. speculation is intensifying about apple's iphone 7. plans for getting rid of the headphone jack look for a certainty from the website on lease, which has a very good record of accurate information on this stuff. the pictures show a rear facing plastic case for the iphone 7. the areas cut out for certain ports could indicate big changes to sound quality and battery size. facebook is heting up competition with snap chat. a popular feature on the app is face swap, which lets people trade faces with one another in photos. it also lets you take selfies in celebrity masks. this is facebook's push to get more young users. listen to this. this is stunning. airline baggage fees have gone up 67% since 2009. >> if you think that's a little too much or a lot too much, you might be interested in a new bill introduced in congress today. >> michael finney is here. >> airlines these days. people are getting fed up. this bill would set limits on certain airline fees. baggage and change or cancellation fees are specifically mentioned. the bill would direct the department of transportation to bar airlines from imposing unreasonable or disproportional fees to the actual cost of providing the service. the airline trade group says deregulation has made flying affordable and fees reduce the need to overbook. ever wish your credit card company would forgive you for paying just a little late? a survey by creditcards.com found all you have to do is ask. banks reverse late fees for 89% of credit card holders to ask for the waiver. and granted most requests for lower interest rates. household income was not a big factor in getting relief. so what is important to the banks? sandhya patel has the forecast. >> no rain expected on the parade, which is good. but you may see some rainbows over the next couple of days. right now, cloudy over the bay. and it feels a bit cool out here. let me show you live doppler 7 hd. still a little bit of showers, and drizzle around hayward. you can see the green specks on the radar. rainfall totals for today's system, which was a one, oakland, 0.08 of an inch. rainfall totals will look very different over the next couple of days. temperatures in the 50s and 60s. is this a picture or what? just stunning from our emeryville camera. stormy pattern next two days. a break comes friday night into saturday. on our storm impact scale thursday/friday, a pair of storms are moderate. they're a two. the flood risk will be increasing on friday. thursday morning at 5:00 a.m., the north bay is getting moderate to heavy rain. it sits over the north bay at 9:00 a.m. and then shifts. notice the intensity eases up at 2:00 in the afternoon. but that rain line doesn't move much. so at 7:00 p.m., it's coming in across the central portion of the bay area and the rain line shifts northward at midnight friday. the intensity of the rain will increase. the winds increase. gusts 35 miles per hour. could see up to 40 miles per hour. so a wet and windy commute for your friday morning. notice the pops of oranges and yellows, indicating the friday rain. your friday morning commute does not look like it's going to be an easy one. a difficult one as a matter of fact. 8:00 a.m., it's still coming down. 9:00 a.m., pouring rain there. and then we switch over to scattered showers for your friday afternoon. rainfall totals over the next couple of days will look like this. about 2 1/2 in the north bay. possibly higher. looks like thee to four north of santa rosa. in the south bay, about half an inch in san jose. so not everyone will get the rainfall distribution equally. the russian river at guerneville is a concern. it is expected to -- forecast to reach near flood stage saturday 9:00 a.m., 31.5 feet. flood stage is 32 feet. so it is going to get close. tomorrow morning, temperatures in the 50s for most of you. the rain first in the north bay and it shifts for the afternoon. temperatures range from the mid 50s to the upper 60s. make sure you have your rain gear with you. two on our storm impact scale, moderate strength storms for thursday and friday. saturday we get a break. saturday night, we have a one, so a weaker system that will bring us rain. sunday night into monday, another system, which is also a one on our storm impact scale, a light system. this sunday at 2:00 a.m., we go to daylight saving time, so spring forward one hour. and we are going to get a healthy dose of rain, but watch out, potential for mudslides. >> thanks, sandhya. up next, the view of a lifetime for some lucky alaska airlines passengers. and then at 5:30 -- >> the new interview with donald trump. what he says will happen if he wins ohio and florida, next. a deadly storm system from the gulf up north. families rescued from their homes. and the silent danger in your look at this. just an incredible view of last night's solar eclipse for 163 passengers on alaska airlines. the airlines changed the flight plan of a plane headed from anchorage to hawaii, after an astronomer contacted them how to see it. dozens watched as the moon covered the sun for two minutes and you saw it here live yesterday on "abc7 news." >> worth the detour. >> absolutely. how cool is that?
