punishment for one year, the state will no longer use wells fargo for buying investments or underwriting bonds and will not invest in the bank's securities. >> how can my office continue to entrust the public's money to an organization which has shown such little regard for legions of californians to have placed their financial well-being in its care? >> reporter: state officials say the impact could be $500 million or more. chung thinks it will also be a blow to the san francisco-based bank's reputation. >> if they have to get down to their knees maybe a little again next, a little prayer would help them. >> reporter: wells released a statement saying in part we certainly understand the concerns that have been raised. we are very sorry and take full responsibility for the incidents in our retail bank. customers praised the state's action. >> corporations need to be held accountable. >> it's horrible that they would even do that to any of their customers. >> reporter: if wells fargo been a gut-wrenching three days for families affected by the loma fire which is burning in the santa cruz mountains that. fire has now burned more than 2,200 acres. it's only 10% contained. abc 7 news reporter chris nguyen joins us live with more from morgan hill with the very latest on this fire. chris? >> reporter: we just spoke to they estimate more than 1,500 personnel are currently on the ground fighting the loma fire. if you take a look behind me, you can see some of the smoke out there and although containment is up over the last 24 hours, the fire itself did spread, and neighbors are doing what they can to support each other. at the first rate coffee house in gilroy owner connie thomas can't think firefighters enough for their service. >> everybody wants to get together and, you know, do their part. >> reporter: thomas is part of a volunteer group that's trying to help some of the families who is have been evacuated even offering something as simple as a complementary cup of coffee in their time of need. >> i just wanted to do what i thought i would want so just donating some coffee and some breakfast, you know, and just letting them know, you know, we're going to pray for snow up in the santa cruz mountains temperatures on fire lines are eight degrees cooler today as compared to yesterday. crews with cal fire will take whatever relief they can get. >> the drought has affect all this vegetation. it is so dry that it's just like a tinder box up in there. >> reporter: firefighters are currently work around the clock shifts with personnel from throughout the state this. view from sky 7 shows some of the tricky terrain on loma prieta that crews are dealing with. >> they are having access issues to get equipment in. would you think that you could dry a dozer in and make a road. it's not that simple. there are certain areas a dozer cannot work so that's where we bring in the hand crews. >> and as firefighters continue pressing on, evacuees are counting their blessings. >> reporter: just a restless night worrying about whether or not you still have a house to go back, to you know. i mean, my heart was hurting. i know my husband's heart was hurting. >> many so grateful they made it out alive. >> reporter: and we expect to get another update from cal fire later tonight. so far the fire has burned at least 2,200 acres. containment is currently at 10% with smoke from the fire. san jose unified school district is recommending principals keep its students indoors during pe class, recess and lunchtime. >> we've got some changing weather which is good news and bad news for firefighters. >> really is. spencer christian is here with a look at what's going on. >> starting with the good news. live doppler 7 shows the cooling fog is back at the coast and the dropping temperatures hurting the fire fighting effort. let me take you down to the area of the loma fire. good news. temperatures are dropping and it's much cooler than it was when the fire strikes. humidity rising up to 31% right now. the challenging news is winds are occasionally gusty up to 10 miles per hour right now and the gusts do make the fire fighting effort a bit more difficult. as we take a look at the temperature trend for the week ahead in the area of the loma fire, it's going to continue cooling down over the weekend. sunday will be quite cool with a high of only 61 degrees. that, of course, is very helpful to the fire fighting effort and it's cooling down. notice the 24-hour temperature change. 17 degrees cooler than at this hour yesterday. both san jose and oakland and spencer, thank you. crews fighting the sawmill fire are making progress. cal fire reports the fire is now 85% contained, up from 75% early this morning the fire has burned 1,500 acres since it broke out sunday morning ten miles east of cloverda cloverdale. the cause of the fire is under investigation. >> now to petaluma where a grass fire ripped through a neighborhood yesterday afternoon. we brought you extensive live coverage on the news at 4:00 and today people are picking through the ashes. abc 7 news reporter amy hollifield talked with some. residents. >> reporter: with heavy hearts fire victims on stuart drive and petaluma are processing what they suffered through and figuring out what to do next. >> i guess we're going to start cleaning eventually and check on my neighbors, pick it up from there. i've never been in a fire. >> reporter: as they look into how to clean up, neighbors are also still sharing stories of what they experienced yesterday afternoon. >> i stepped right out here, and when i looked, there was so much smoke and just embers like falling, you know, like as if you were in a volcanic eruption. >> reporter: rochelle knew she needed to get out of there, but first she thought of her elderly neighbor who lives alone. >> and i ran hover there and burnt my feet the whole time trying to get there and when i got inside she was so scared and worried. >> reporter: she got her out okay. two people did suffer minor injuries and a cat died in the fire. four homes were destroyed. ten others were damaged. it started at 3:15 in some trees located between high what 101 and a row of homes. the homes were evacuated. the northbound side of the highway was shut down for a couple of hours. today fire victims are mourning what they lost but also thinking about what could have been. >> you can't be too sad about it because you didn't lose -- people didn't die. i didn't lose the entire house. it's not as bad as it could have been. >> reporter: residents want to know what started the fire. they are wondering if something from the highway sparked it. firefighters telling us it's still under investigation. in petaluma, amy hollifield. abc 7 news. the suspected teenage shooter at a south carolina elementary school is now in custody. authorities say the teen injured two children and a teacher at the school in townville. 135 miles west of colombia. the victims are expected to survive. authorities say before the teenager first killed his father at their home before opening fire at the school. in washington, lawmakers voted to overturn the president's veto of legislation that would allow families of those killed in the september 11th attacks to sue saudi arabia. there are claims that the saudis backed the attackers. now the vote was the first successful override of mr. obama's president sicht he and his allies vowed to find a way to scale back the legislation fearing that this would open u.s. residents and companies to be sued by foreign interests. officials in fresno are investigating how two special needs children ingested bleach through their feeding tubes. the children were hospitalized after last week's incident at an elementary school. both are expected to be okay. the school isn't saying how the water solution with bleach came into contact with the feeding tubes, only that it was an accident. the suspect at the center of a bizarre vallejo kidnapping case is set to appear in federal court tomorrow, and prosecutors are saying that matthew muller will change his plea now to guilty. muller's attorney tells abc 7 news that federal prosecutors will no longer be seeking a life sentence and instead will seek a 40-year prison term for the suspect. muller is charged with kidnapping denise huskins last year. vallejo police originally dismissed her story as a hoax. huskins has since filed a civil lawsuit against the city. check out this surveillance video of a home burglary in san jose. it happened on windsor street on august 24th. a man was caught covering his face and then later wasn't so cautious. look at him there. police say he broke a window to get into the house hand left in a jewelry box. >> san francisco's board of supervisors have voted to delay nearly 7 million of funding for the next phase of the transbay center project. phase two includes building an underground rail extension from the current station south of market to the new transbay center. the extension would be used by caltrain and the future california high speed rail system and the board is concerned about cost overruns as well as the adjacent millennium tower which is sinking and mayor ed lee backs the delay. >> it doesn't hurt us right now. what we need to do is focus on the engineering techniques, focus on the things that we're doing now to make sure we're doing our best. >> the transbay joint powers authority tells the examiner postponement of funding could jeopardize the project. the board will discuss the with a special task force designed to curb the thieves. >> laura joins us now live from oakland. laura? >> hi, dan. chp is one of several agencies that participates in this special task force, a huge problem especially in alameda county. more than 8,500 cars stolen so far this year. many of them chopped up. combating car theft is the a full-time job for an alameda count county team helping to recover stolen vehicles. in this case a man wanted for violating his felony parole tried to escape police by running into his own home and starting a fire. >> we called the fire department and the oakland pd loaned us the canine and the smoke and parking drove him out the other end. >> sold this pontiac trans am to a 17-year-old out of san leandro and it had a stolen transmission into it. >> reporter: later in east oakland we got a look at recovered property, this time from a suspected auto thief who specializes in gm vehicles and their coveted engines. >> just the last few years we -- law enforcement has recovered almost 300 strip camaros alone in the oakland area missing their engine and transmission stolen and found their missing transmissions. >> the suspect in this case is 35-year-old albert murray. once he steals the engines or other parts of the car he abandons the shell of the vehicle, often on the streets right around his own home. in oakland, laura anthony, abc 7 news. >> commuters in the north bay could soon be traveling on a very quiet smart train. one without cell phones. a new proposal would ban talking on cell phones on the new train service between santa rosa and san rafael. abc 7 news was at the transit center in san rafael getting commuter reactions i understand people don't want to listen to other people's conversations, et cetera, et cetera. however public transportation, probably a good idea. i found out way too many pieces of personal information from other people's lives list nick to their conversations. >> emergency calls would be allowed. >> another owner of a smaung 7 galaxy phone purchased in china burst into flames. the phone began smoking and then caught fire while being charged. you can see it's charged there. the claim day for self-driving technology and people with limited mobility. >> a quadriplegic former rats car driver has become the first in the nation to receive a special kind of driver's license. >> this is really remarkable. >> abc 7 news anchor krinzy is here with the story. >> reporter: remarkable, incredible and indescribable. what a feeling for sam schmidt. today he received nevada's first ever autonomous vehicle driver's license and immediately took his specially built car for a thrilling ride on a las vegas track. >> 15 years ago i figured i was done driving on the street forever and now anything is possible. >> reporter: schmidt was an indy car raers until a violent crash left him paralyzed from the neck down. he's now a team owner, and this car has put him back in the driver's seat. he breathes into a tube to accelerate and blows out to brake. cameras track his head movement and relay that to the tires for turning. his license comes with a few restrictions. only vad i had in nevada. there has to be a pilot car ahead and needs a licensed driver ready to take control if needed. sam is good with all of that and he's also just good period. listen to to this. when nevada's lieutenant governor handed him the license today, and i just want to show you, he says what is happens when i get pulled over and the officer says can i see your hands, what do you think, larry and see that the fog is back at the coast and it has brought along with it its usual cooling effect with the marine layer generating that cool air that's pushing well beyond the coastline. here's the view from mt. tam looking at the nothing kick out over the bay. tonight we can expect to hang out overnight and continues into the weekend and there's a chachs showers on sunday and we do have big changes in our weather pattern. right now temperature readings at 55. half moon bay 58. 69 at heyward and 75 in san jose. inland east bay danville 48 and concord 80. 87 up in santa rosa and overnight with the widespread areas of fog near the coast and pay and pushing locally inland, low temperatures will be mainly in the mid-50s. we'll see a few low 50s in some. cooler spots up along the coastline. the forecast animation. overnight you can see the fog drilling in there. 7:00, middle. morning commute, widespread fog still which will probably reduce visibility to the point that the commute will be a slow one and the fog will pull back to the coastline by late morning to midday giving us mainly sunny skies over inland and bayside areas tomorrow afternoon. highs will range up frommer 50s at the coast tomorrow to mainly mid and upper 60s to low 70s around the bay and upper 70s to near 80 in the warmest inland locations and looking ahead to friday it's going to be even cooler. windy evening developing on friday, saturday, and a cool afternoon and sunday will be the coolest day in the forecast period with inland highs reaching only in the mid to upper 60s and there's a slight chance of showers on sunday, so let me take you into sunday morning. 7:00, watch the movement here as showers push into the north bay first and then slide southward down to the golden gate. we don't expect a lot of rain out of this but there will be wet spots from this system before it winds down sunday night into monday. here is the accuweather seven-day forecast. so mild in the warmest inland spots tomorrow but still cooler than it has been for much of the week. cooling continues friday and saturday and sunday and the wettest one, the only one we expect to be wet and temperatures remain below of immigrant affairs. zulma is committed to makin an emotional good-bye to miami marlins pitcher jose fernandez killed in a boating accident on sunday. a hearse carrying fernandez's casket arrived at saint brendan's catholic church for tonight's public viewing. earlier fans lined up outside marlins park to drop off flowers and mementos and sign a memorial. the all-star pitcher is such a huge loss for the city of miami. senator marco rubio is asking for an investigation of the safety of the jetty off of south beach where fernandez and two others were killed. ronnie lott is optimistic that his investment group can get a deal done to build a new stadium for the raiders in oakland. lott made his first public comments about the on going negotiations to the san francisco "chronicle" and his group reached an agreement with oakland and alameda county giving them 90 days to work out a deal for the coliseum. the raiders meanwhile are moving ahead with a stadium plan in las vegas but a viable stadium option in oakland would likely keep the team in oakland. 93-year-old agnes nixon created, wrote, produced and acted in a number of soap operas including abc's "all my children" and "one life students and a teachers were injured at the school. their injuries are non-life-threatening. the suspect has been arrested. abc 7 news reporter david louie is talking with people on the front lines of the loma fire in the santa cruz mountains. david tweeted this video or video of a helicopter used to drop thousands of gallons of water on the blaze. he'll have a live report coming up on abc 7 news at the bank. a crowd of angry people went to -- went face-to-face with police today in the san diego community -- san diego county community of el cajon. the community is on edge after the unarmed killing of a black man. >> reporter: protests in san diego after an unarmed black man was shot and killed by a police officer there. >> did you shoot him? >> reporter: this comes on the heels of outrage over the police shootings of black men in charlotte, north carolina and in tulsa, oklahoma where an officer was charged with manslaughter after shooting 40-year-old terence crutcher. in california, authorities releasing this image of the moments before the shooting tuesday saying the man appeared to be in a shooting stance though police admit he had no weapon. >> the mail rapidly drew an object from his front pants pocket and the placed both hands together on it and extended it rapidly towards the officer. >> reporter: one officer tasering the victim and another opening fire with a handgun and this facebook live video purports to show the aftermath. >> did you kill my brother in front of me. >> reporter: woman claiming she's the victim's sister saying she had called police. >> why couldn't you tase him. >> reporter: police say they were responding to calls of a man who was not acting like himself and walking in traffic and claimed he refused multiple instructions witness handed over cell phone video of the incident to police which hasn't been released. authorities are urging for calm during their investigation and the officers involved are now on prosecutor says the targets included places of worship, rallies, stadiums as well as schools. the statement comes after two female teenagers from nice were detained this month on suspicion of possessed patient. critics say the visitors sit on chairs that look like wheelchairs and the whole experience stigmatizes mental illness. they are pulling the plug after debut. great america says it made the decision after a number of people complained the attraction was hurtful to those who suffer from mental illness. in a statement to abc 7 news, great america says it never intended to portray mental illness. the statement continues as it is impossible to address both concerns and misconceptions in the halloween time frame. at this time we've decided to close the attraction. selena gomez is a queen, at least the queen of instagram if that counts. already the most followed person on instagram and now the singer and actress is the first to reach 100 million followers on the social media network. no strange irto instagram records n.july a picture of gomez nearly sipping a coke took the title for most liked photo. doesn't take a lot to get likes, at least if you're selena. 5 million likes for that. here's some weather. i hope you'll like. cooling marine layer at the coast and it will be pushing during the overnight hours and producing a cooling effect. tomorrow's highs will reflect that cooling reaching from the upper 50s at the coast to only 60s and maybe low 70s around the bay. upper 70s in the warmest inland areas and maybe an 880 or 81-degree reading here or there. we expect a little bit of rain on sunday, and -- and the -- the projection for rainfall totals shows that we don't expect a lot of rain, mainly just a few hundreds of an inch for most of the bay area. however in the north bay we have our greatest chance of more significant rainfall totals, perhaps nearly a quarter of an inch and just over.1 inch in nevada and the important takeaways are these. it will be an early season storm, weak system and best chance of rain, as i said, will be in the north bay. here's a look at the accuweather seven-day forecast. the cooling pattern that is under way
