and breaking tonight, a teen accused of deliberately running down and killing a retired police chief on a bicycle is now laughing about the incident and telling police he'll be back on the street in 30 days. sadly, he might be right. standing by to talk about the dramatic rise in teen crime, deputy district attorney john mckinney, prosecutor wendy patrick and dr. houman hemmati. but first to the chief correspondent jonathan hunt live with more on a suspected killer now mocking the legal system. jonathan good evening. >> reporter: good evening to you, trace. the video of this hit and run is shocking as two teens laugh before mowing down 64-year-old andreas probst a retired former police chief as he rode his bike. look at this. and the reported response of the alleged driver after his arrest is equally shocking. 18-year-old jesús aiala according to las vegas tv outlet klas told police, quote, you think this juvenile blank is going to do some blank? i'll be out in 30 days, i'll bet you. it's just a hit and run, slap on the rust. but he and his alleged passenger 16 year old jameer keys who both appeared in court for the first time yesterday will likely be tried as adults and face murder charges, according to the clark county district attorney. meantime the teen crime epidemic appears to be a nationwide issue. in new york city presence so far this year 816 teens have been arrested for robbery compared to 451 in the same period last year. and the number of teens arrested for felony assault has increased to 276 from 225, according to the nypd. while colorado's division of youth services reported that 41% of those sent to juvenile detention in 2022 were charged with violent crimes. a 35% increase over 2021. but even in a time when we see so much crime committed by so many young people, the vegas video is breath taking in the cruelty on display. >> following video which lacks morality, it is a complete lack of conscious, i don't want any part of it. and the worst part about it in the video you hear that everything was intentional. >> reporter: the two teens accused in that callous killing trace will be back in court on tuesday for a bail hearing. >> trace: it is very hard to watch. jonathan thank you >> the fox news at night common sense department is a bit stunned. the juvenile robbery in new york city is up 80%, in fact, juvenile crime across the country is up significantly. which is no laughing matter. yet the young criminals are laughing. when they beat and almost killed a seattle cashier for cigarettes and candy they laughed. when they deliberately ran down and killed a former police chief riding his bike in way gus, they laughed. and when the driver who allegedly killed the police chief got caught, he laughed again, mocking the justice system, saying he would be out in 30 days. common sense thinks he's probably right. there's no place to put juveniles so they're postally sent home, many times to a single parent and inevitably they commit more crimes. remember, these kids grew up at a time when their teachers were not allowed to discipline and the legal system opted not to discipline. they got one giant societal hall pass. we sewed now we reap and the reap will get worse. wa do we expect the happen when stealing is legal, homework is optional and wearing shorts and a hoodie on the senate floor is considered decorum. nobody said the fetterman effect is playing a role in crime but common sense is pretty sure that constantly lowering standards never leads to higher performance. let's bring in john mckinney la county deputy district reaction afterwards. >> i don't sleep good. when i get a call, of course i'm upset like oh, my god, who is it. you know? i'm terrified. if it's not handled here eventually it's going to fester there. this is the results of it. it's not an issue just in our inner city. this is now all over. >> trace: all over. and a lot of parents, john, are asking, why is juvenile crime so much on the rise? >> well, it's on the rise because there's no accountability for the crime. we see so-called progressive prosecutors all over the country and when we see these progressive so called criminal justice reforms we see accountability and rise in crime. it's happening here in los angeles just as it's happening on the east coast. so until we get serious about crime, these juveniles are going to keep mocking us and laughing at us. >> trace: yeah, seems like a fair assessment. we had cheryl on last night from moms for liberty and wendy, she said this. watch. >> when we close schools, we basically showed kids that they don't matter, and a lot of kids really took that to heart. also, you know, under the obama administration when they rolled out these restorative justice policies that really tied the hands of administrators and teachers and they're not punishing kids. >> reporter: and these young people wendy know exactly how the law works. they know the consequences. they know exactly. the kid in vegas laughing and mocking the system they know what's going to happen to them. >> trace remember the phrase you do the crime you do the time? you and i both grew up with this wisdom. nowadays, most kids if they're committing crimes like this are getting inspired off of social media, many are committing copycat crimes that's one of the reasons we know. but trace i worked in juvenile court. this is a unique population that is susceptible to positive influence. intervention prompts rehabilitation, catch and release prompts recidivism. when you think of all we can do investing in their future not leaving them with a felony record, this population we can do so much with and so much about. >> trace: to that point, john, i want to put this up on the screen because this is the suspect in that killing of the former police chief in las vegas, his name is jesús ayala and he said the following, quoting here, we're clearly bleeping some of this out, it just blank hit and run, slap on the wrist. and then afterwards, of course, he said i'll be out in 30 days. and it really is basically that these kids are told. i mean, a lot of adults enlist these kids to do crimes for them. they're told there's not going to be penalties and turns out most of the time it's right. >> we're raising criminals and incentivizing crime. and when i say we i don't mean all of us, those put in charge of our criminal justice system like in los angeles da george gascón. he has light as touch policy with juveniles which means even after serious violent crimes like murder they're getting two, three years. and the other thing trace it makes them attractive to older gang members, who will use them not just to carry the guns to and from crimes but to fire the guns during crimes. >> trace: crazy on the los angeles suspect the daily mail writes jesús has a long criminal history in the juvenile system according to a news. while key was played in the child welfare at eight years old they also tied the teens to three hit and run incidents on the very same day. they believe the slaying of probes. the chief former police chief, ended the spree. they were doing this all over town. >> being a row involving door allows an individual to be a 1-person crime spree and that's dangerous to the community. at true rehabilitation is one goal but deterrence is another. sanctions prompt personal responsibility and community safety. that's what we have to get back to, in combination with the kind of positive role modelment you have people that are in school, they're living at home some of them. there's so many opportunities for families, faith leaders and faculty even to put them on a different path. >> trace: it really is, it's one of the things the revolving door that you touched on is a shocking thing and it kind of is amazing. wendy, john, thank you both. we very much appreciate it. let's bring in jason rantz, seattle talk radio host and author of the upcoming book what's your take on what's happening up in san francisco. >> yeah, i spent a lot of time actually looking into this contingency management for my book and it just doesn't work. the data does not back what they're promising. because when we're talking about this kind of scheme to get someone off of whatever their drug of choice is, usually in this case it would be meth, it doesn't actually work for the folks who are the most chronically addicted, the folks who are already out on streets whose lives have not been turned around and then when you look at the data long term it's just not there. they're not actually staying on it. so you might have some short-term gain for the folks who are not as deep into the addiction as the problem actually is on the streets but unfortunately that's just not the problem we're dealing with, whether it's in san francisco or across california, which is where this policy is going to start to spread. >> trace: yeah, and i wanted to bring up the policy with you dr. houman hemmati because your friend and a guest on this show a couple of times, john ali from santa monica was severely beaten by a homeless person and the first report came out that he was trying to film this homeless person but john ally says that's not the kay. he says he was filming an open air drug market and he got very badly hurt. >> yeah, thank goodness john, i talked to him just before the show, he's starting to heal. he's able to talk and function. but he's got a long road ahead. they broke his jaw in two different places. he was unconsiders for 30 minutes getting kicked in the head the entire time. >> trace: but this is rampant. he was talking about the fact that you go through some of these areas in santa monica pacific palisades and it's just crazy how many drug addicted homeless people there are. >> and they're doing nothing about it. they're handing, in santa monica where this happened to john and where i live, the city and county goes around handing out needles to people, not even old needles handing out needles to addicts doing nothing in return not forcing them to go into rehab. not like these people you can bribe them with a few dollars to get off the drugs. when you're so badly addicted you go through withdrawals if you go cold turkey you have to go through a detox program or you could die. it's not so easy and they're making the problem worse. >> reporter: he wrote the following, there's no accountable or consequences for those who do not abide by the law, we are in a downward spiral, the city council, talking about santa monica mayor and city attorney are too concerned about offending those who commit crimes, the homeless addict who attacked me has opted for drugs in lieu of housing and that's the case all over the country jason. >> it is. that's the unfortunate reality where you have everything backward, folks on the radical left telling us that the criminals are the actual victim, that the victims themselves, well, they're just an inconvenience because at the end of the day this is all being driven by ideology. they believe on the radical left that these institutions are inherently corrupt and oppressive. so what they have to do is dismantle and rebuild it through this radical ideological lens. and they seem to be okay with what they think is short-term consequences. but it's not short term. the consequences what they're doing for the criminal justice system is going to be here for a very long time. you can't just walk this stuff back. >> reporter: lastly i want to get your take on this dr. houman hemmati, we started with jason rantz on this because i think it's interesting the way you're trying to clean this up is giving gift cards to people addicted to drugs. there has to be a better prescription out there for this. >> there is trace. i actually worked here at the west los angeles va hospital in what's called a dual diagnosis treatment program for veterans that have mental illness and drug abuse, where they have locked intensive care for weeks or months at a time where they get daily therapy immediate indications adjusted, psychiatrists, social workers all monitoring them and helping them on a daily basis. you can't have them on the streak hand them cash and say good luck to you. that doesn't work. we have medical evidence of what works and they're not a employing it more broadly. >> trace: seems preposterous it really doesment dr. houman hemmati jason rantz thank you both. >> thanks. >> trace: new jersey senator bob menendez and his wife have been indicted on federal bribery charges in a scheme to sell secrets to the government. kevin corke with breaking on this. >> reporter: evening trace. three counts and this is his second corruption indictment in ten years and tonight the new jersey democrat senator has stepped drown his role as chairman of the powerful senate foreign relations committee until at least this case is resolved. menendez facing three counts including conspiracy to commit extortion under color of official right. now basically that's a charge for public officials who take bribes in return for official acts. he's also being charged with allegations of bribery linked on his work on the frc, the foreign relations committee as well. >> special agents with the fbi executed search warrants on the residence and safe deposit box of senator menendez and nadine menendez in new jersey. when they got there they discovered approximately $500,000 of cash, stuffed into nfls in closets. some of the cash was stuffed in the senator's jacket pockets. agents also discovered a lot of gold. >> trace: a lot of gold. among the other allegations that menendez provided sensitive government information and took other steps that secretly aided the government of egypt, and tonight, several democrats are calling for him to resign from his job as senator, including new jersey's governor, phil murphy, as well as congressional lawmakers, congressman dean phillips of minnesota and congressman andy kim from menendez's home state of new jersey about which the senator said tonight in a statement, quote, those who believe in justice believe in innocence until proven guilty. i intend to continue to fight for the people of new jersey with the same success i've had for the past five decades. i am not going anywhere. prosecutors are seeking to have menendez forfeit assets including his new jersey home. a 2019 mercedes benz convertible and about $566,000 in cash, gold bars, and funds from another bank account. all told, menendez and high school wife and three businessmen expected to appear in a manhattan court on wednesday to face the music. trace. >> trace: can't wait to hear how this one comes out. kevin corke live for us in dc, kevin thank you. let's bring in princeton university political scientist lauren wright. i don't know lauren, bob menendez also said this, following, quoting here, those behind this campaign simply cannot accept that a first-generation latino american from humble beginnings could rise to be a u.s. senator and serve with honor and distinction even worse they see me as an obstacle in the way of their broader political goals. one he can't even say the word indictment two he's kind of hiding behind his nationality, this is political double speak 101. he's in trouble laura. >> of course he is and you know a lot of people are laughing about this and on social media about how egregious the cash and the jacket with his name and the gold bars and the cars, you know, it's sort of exactly what you would expect of as bad as it gets of an indictment charge, federal bribery. and the saddest part is, for new jerseyans, we had a chance to get rid of this person in 2018 and replace him with a normal upstanding person, bob hugin. bob menendez won by double digits. and, by the way, in 2015, he was also indicted on federal bribery charges. and so it's not like people did not have this information about him, phil murphy campaigned for him, you know, day in and day out. so did cory booker. i will say, though, trace the claims of democrats that the doj is politicized and out to get only republicans are not looking that great this week with hunter biden and bob menendez. it looks actually pretty fair to the average person. >> trace: well, some say the hunter biden thing was specifically targeting the gun charge only. let's move on to the dallas mayor eric johnson switching parties. >> well, okay. >> trace: he told the wall street journal the following, quoting, unfortunately many of our cities are in disarray, mayors and other local elected officials have failed to make public safety a priority or to exercise fiscal restraint. most of these local leaders are proud democrats who view cities as laboratories for liberalism rather than as havens for opportunity and free enterprise. on the way out the door he kind of took a couple slaps at his own party there. what do you make of this switch? >> i'm a little cynical, so i will say that it's smart politics for johnson, who is very popular, won reelection with 98%, and probably wants to run stayed wide and probably should be a republican in texas that trump carries five points in 2020, ten points in 2016. however, there is something to this in cities the local issues that affect people's lives resist the issues that republicans do well on. it's all about crime, it's taxes. and it's issues like education where they're really localized. once you get into the mail strom of national politics and you have to weigh in on trump and abortion and all of these really divisive issues, republicans don't do so well. but in the cities, they really have a good message right now. >> trace: yeah. i want to put this up because this is ted cruz as an election theory and i want to get your take before we run out of time. listen. >> i saw that, yeah. >> here's the scenario that i think is perhaps most likely and most dangerous. in august of 2024, the democrat king makers jet sin joe biden and parachute in michelle obama. >> trace: he's not the first one to say that but it's a long shot. your thoughts. >> it's a long shot and i've written a book about first ladies and i think ted cruz is saying that because michelle obama could win a national election in this country. >> trace: maybe. >> but it would be so insulting to vice-president harris if she was not next in line and if she was replaced by anyone really. so i do think it will be biden, maybe harris, not michelle obama. but it's scary because she's very popular dramatically widening their strike across the nation tonight walking out of 38 parts distribution centers operated by general motors and stellantis in 20 different states, bringing to around 19,000 the number of workers who have walked out. but sparring ford from further shutdowns because of some progress in talks. auto workers want substantial pay raises, profit sharing and greater job security. >> we're not going to wait around forever for a fair contract at the big 3. the companies know how to make this right. the public is on our side. and the members of the uaw are ready to stand up. >> reporter: general motors called today's strike escalation unnecessary and accused the uaw leadership of, quote, manipulating the bargaining process for their own personal agendas. while president biden is siding with the workers saying on x he will visit michigan on tuesday, quote, to join the picket line and stand in solidarity with the men and women of uaw. out here on the west coast, meantime, hollywood writers in the big studios appear to be making some progress toward ending the month's long strike that is costing the entertainment industry billions. >> radio silence for both sides, so that's good. that means they're talking. so far no bad news has come out. no good news but as long as they're talking that's good news. >> i feel really optimistic. i feel like sometimes you have to be pushed to the edge in order for you to recognize like what needs to happen. >> reporter: there is, though, nothing definitive yet. and even if the studios strike a deal with writers, they still have to deal with the actors who are, of course, trace also on strike. >> trace: indeed they are. the actors writers and auto workers not the only employees frustrated. teachers say across the country ever since the pandemic educating young people has become much harder. alex nester parents fellow and julie fairfax county public teacher and candidate for virginia state senate. welcome both. the washington post writes the following, quoting here, public education is facing a crisis of epic proportions, testes scores are down and violence is up. parents are screaming at school boards and children are crying on the couches of social workers. anger is rising patience is falling. public schools are failing julie and you are seeing this firsthand. what's your take. >> absolutely. what we're seeing is ever since the covid shutdowns, there has been a big learning loss problem. kids are behind in their reading, their writing, their arithmetic. sol scores are way down. before the pandemic, before the pre pandemic days, kids used to have higher passing scores on their sol. the other thing that i think really negatively impacted the learning across fairfax county is for a couple years, we were only allowed to give students a minimum grade of 50%. so if they didn't turn in their work, we still had to give them a 50%. so you lose motivation when that's the case. >> trace: yeah. that's a fair assessment, you lose motivation. i want to move on because i want to put this up. this is from the conversation, and this is to you alex. the conversation writes the following here, moms for liberty, joy full warriors or anti government con spear sifts, the 2-year-old group could have a serious impact on the presidential race. of course the headline is a slam on moms for liberty and these parents kind of fighting for their kids, right? what conspiracies are they talking about here? you can see that the moms for liberty and a lot of these parents groups have riled up the left. >> the issues that parents are concerned about are the ones that julie just mentioned. testes scores are down, parents are being excluded from everything that's going on in their kids' classrooms. fairfax county is a great example. the district pushing equity initiatives at every step at expense of getting students back on track. that's what parents are concerned about. >> trace: yeah, it's a fair concern because that's exactly what they're concerned about. the daily mail writes the following, want both your take, missouri high school faces criticism after crowning landon patterson a former student who is also trans and held the title eight years ago. julie, riley gaines wonders if a female will become home coming king. your thoughts on this? >> you know, transgender students, obviously all students need love more than anything in the world. and i, you know, i am a teacher that lovers every one of my students. however, we also, there needs to be fairness. you don't want to take away these opportunities that females have. you don't want to take away a girl's opportunity to be the top, the top swimmer, or the top soccer player. and naturally, men -- males are stronger than females. that's just the science. >> trace: right, and that's not the home coming thing here but kind of in the same vein here. your final thoughts on this alex? >> you can be happy for the student but also criticize the adults that let this happen. this is a trend we're seeing of biological men being given honors and awards that are typically awarded to women. we saw this in connecticut with high school track athletes. you saw it in collegiate swimming. now you're seeing it in a home coming court. and, look, someone needs to start standing up for these girls. the girls and women are the ones who are being picked as the losers here, not being prioritized and their awards being given to biological men something we're not dressing enough. >> trace: alex,
