>> the point of no return. we are about 15 miles north of the small town of course can na, texas for about a 30-mile stretch. you can see the trouble this is causing in this area here. it's back towards the north, where traffic is backed up for miles and miles. so a large part of the interstate here, victor, is covered by water. in the last 24 hours, there has been 16 inches of rain that has fallen. the rain is expected to continues most of the morning. it's not exactly here when the interstate here connects dallas with houston is going to reopen. that is, of course, of great concern. we have been speaking with emergency officials throughout the night. they say some homes have taken on some water. but that doesn't appear to be the biggest concern at this point is really the roadways. there have been several dozen high water rescues over the course of the last 15 hours here in this area. it is a long night. people here, bracing for more rain as it continues to fall here into the end of the hours. victor. >> all right. thank you so much. again, this storm may have weakened. but make no mistake, it is still incredibly dangerous for anyone caught in its path. >> it moves across mexico. here's my question, as you look at the tra jejectortrajectory. what is the possibility that this. could get into the gulf and reenergize? >> well, that's not going to happen. it's not going to restrengthen, if you will. it will pump a lot of water into texas, but we're not going to see any restrengthening of this storm. right now, you are right, barely a category 1, 75-mile-per-hour winds, gusts up to 90. it has become basically shred apart by the mountain, the wind shear. that's exactly what we expected. but it is still bringing a lot of moisture, a lot of rain still to central portions of mexico and even along the coast, we are still getting a lot of rain there. you can see a tropical storm this morning before it hits monterey. so it is going to continue to weaken. but all of this moistures being fed up to the south. so you can see texas already has received flooding rainfall over the last day or so. they're only going to get more rain. some areas could see an additional 10 to 15 inches of rain, isolated apples even higher. so we are going to be in for a serious flooding situation, if it exist, not to mention the rain continuing if members colorado we could still see landslides there, because of the mountainous terrain and along the coast, we can see an additional tents to 20 inches of rain, because these storms are what you call training. they're going one after another. it's hard to clear out that way him so in texas, here's the story. you see right around houston, that bulls eye right there, six to ten inches with isolated amounts even higher. flash flooding is very hard to chase, so it's hard to predict exactly where it's going to hamtramck but we know there is going to be a lot of rain in texas. you have to keep in mind, the whole country could see major flooding as well. we seen it south of dallas, where id ed is. >> that will continue. because of that, we have the flash flood warnings in place across much of texas. those flood warnings as well. so this is going to be a continuing story, you can see the rain coming down as we speak across much of texas. >> an important reminder, jennifer, we thank you for that. that the category is only an indication of the wind speeds. so when people wake up this morning and they see this is a category 1, they think people are out of the woods, they are not. the rain can cause some serious dangers and threats, we'll remind people of that throughout the morning and teach them how to stay safe and remind them which areas are going to be hit next. jennifer grey, thanks so much. >> thanks, jennifer. cnn's sara sidner is joining us now from guadalajara, sarah, i know that daylight has not even come yet. so it might be hard to assess what damage you are dealing with. >> reporter: that's exactly right. we are inland. what which heard overnight are gusts of wind, plenty of rain. the rains have stopped, the winds are calm. we know the hurricane hit, the unprecedented hurricane hit south of puerte viarta to give you an idea where it land. we can tell you there were folks gathered from the government, rescue crews and aid groups that were gathered in peluma, gathered to know when there is daylight they will be able help those hurt the most. we are told in that area, they started getting people to leave, evacuating people not just because of the hurricane but more because of the voke that had been spewing ash in the past month. and that ash they were so concerned about, once water hits it. they were worried, boy, we are going to have mudslides, we need to get people in the davenger zones out of the way. that's where aid agencies were to gather to try to get to people who will need it most when there is daylight one of the things that we have heard from the president here is that though this is a historic and dangerous storm that hit mexico, they do not believe the damage will be as extensive as they first thought. >> was the information available tol until now and taking into account that the hurricane follows its path, the first reports the damage has been smaller did you to the hurricane. none the hess, it is very important that people stay in the shelters. security forces will be patrolling to protect their homes. >> reporter: so in the states here, the schools were closed, airports closed, sea ports closed. and again, people have to realize and the president wanted to make clear, don't just go out and think you will be able get to where you need to go. mudslides, landslides, there is a concern of flab flooding. they want people to still trump went on the attack. >> trump falls to 2nd place in iowa. i said, no way! the press was going crazy, they loved it. they were so happy. i won't mention the names, but you know some of them. you know some of them. we have a breaking story, donald trump has fallen to 2nd place behind ben carson. we informed ben, but he was sleeping. >> i'm gratified by the fact that so many people are really paying attention to what i'm saying. because none of this means what i'm saying are wild, crazy things. they're very logical thing and if people really sat down and thought about them rather than align to whip me to a greenzy. >> joining me now cnn commentator, errol lewis, good to have you this morning. >> good morning, victor. >> we're 150 days give or take from the iowa caucus. four out of five caucus-goers are persuadable, they could go to another candidate. put into context the change at the top. >> well the change at the top has some trends. the reality is that ben carson is much more in line with where evangelical conservative voters are as far as not just a point of view but just sort of life sometime, public presentation. he's got a certain modesty about it. the way he talks, there is a certain piety when he talks about religious ideas and what they mean to him. it's the opposite of trump, trump is bombastic. owns casinos, has been married three times, worships -- if you put it in political terms. you have a challenge that trump face, he knows, maybe it's not entirely clear to those who haven't seen these races before, but everything changes after iowa. you know, i mean, there is a sort of a media frenzy. there is a national spotlight that is shown on the race and so while trump doesn't necessarily have to win iowa, he also can't get blown out. i think that's kind of more where his organization is going to be focused in this last 100 days before the caucuses. >> how about this attack, though, donald trump calming ben carson low energy as he did jeb bush. it seemed to really get under the skin of governor bush. is this something that is going to work against ben carson, as you said, people like the way in which he relates with the caucus-goers? >> yeah, i don't think it's going to rattle him the way it may have bothsed jeb bush. the reality is it's a sort of a personal insult. aside from the fact that i think people may be getting tired of the personal insults. it's also like a manliness. . you are low energy, i'm a big guy with a lot of vim and vigor, are you not. he is what he is. he is a professional. he know what is he knows, frankly, that calm is really mot just his personality it's a part of his professional demeanor, you can't go around separating conjoined twins and sofrlt and keeping a steady hand over the course of hours and making literally life and death decisions few are a nervous, high energy guy. so i don't know if voters will hold that against him one bit. >> gotcha, let's talk about jeb bush the announcement from his campaign, they are slashing salaries, downsizing staff, moving staff from miami into the early states. is this a problem for the candidate or the cane? because the campaign i guess is bare bones, they can keep moving. but the right to rise the super pack is flushed. maybe this isn't as big a story. put this into context. >> that's right. look. sparce the ability to have some money spent somewhere on his team, whether it's super pack, which is outside spending or the campaign, itself, you have to hold your resources, there is no question about it. i think the campaign, though, is being accurate and it probably won't look very good to the average voter. i think they're realistic. they did not expect the surge of carson and trump. they did not expect to have to build out the kind of organization that can win a national race. you have to be look ahead, building in other states. it's a very expensive proposition. the reality, though, they can't get about the task of doing that national building if they will get blown out in iowa or rick getting blown out in new hampshire. so they have to sort husband their resources, buy some advertising, buy some people on the ground, make sure they don't get blown out in these first early states because there is nothing worth talking about it, if that should happen. it's a logical and politically professional. to do to sort of trim their expenses now while they still can. >> we'll see if these changes actually help into these polls, languished in the single digits for months now. er errol shooter. . a $6,000 reward is being offered for tips on a deadly school shooting police say started over a dice game. it happened thursday at tennessee state university in nashville. investigators have also released new surveys video this morning. you are watching it. it shows when the suspected gunman started shooting, killed one person in this case. authorities say they are looking for two men, two students suffered non-life-threatening injuries during this incident as well. the fbi has been asked now to join the investigation into the shooting death of a florida church drummer. the palm beach county sheriff asked for the help. cory jones was shot and killed by a plain clothes officer on an interstate exit ramp last week. family members say at the time jones was wait og an tow truck. the officer, apparently, pulled up in an unmarked car. expipman jared fogle paid out a $100 million payment to ten of his victims. he pled guilty in august to federal porn charges. part of that plea includes restitution. fogle will be sentenced income month. he faces up to 12.5 years in prison. students in chicago are trying to reconcile the loss of a high school football player who died on the field. family members tell cnn affiliate 17-year-old andre smith was hit in the last play of thursday night's game. he walked off the field and then collapsed and was rushed to the hospital. they say he had brain swelling. he died yesterday morning. coming up, a drive home from school ends with a 4-year-old girl dead in her father's arms. we got new details about this long criminal history of the man who is being called the road rage killer. plus, we are following breaking news this morning, parts of the united states now already feeling patricia's punch. this hurricane is still, though, is what's striking to me. it hit almost 12 hours ago and it is still a hurricane status, gage 1, winds gusting up to 125 miles an hour and threatening to drop at least a foot of rain it is so particularly dangerous right now. it's going to bring deadly flash floods, mountain slides, as it crosses through mexico center. it has been downgraded, but we do not want to, you know, we don't want to sensationalize it, but we don't want to say all is well. it is a dangerous storm, we are being told, for the millions of people still caught in its path. this, okay, as its bracing towards texas now. >> that state along is covering flash floods and warnings already. patricia hasn't hit it yet. >> for more on the situation in texas him we are joined by storm chaser in courcorsica na. >> reporter: i was here all day yesterday, there are several road closures, water several feet deep, interstate 45 has been closed. pretty much every route here out of town here in corsica na is closed. i'm looking at the interstate. can you see track lined up, semi trucks sleeping on the highway here. we've had well over a foot of rain, probably closing in on 16 to 18 inches in corsicana, the moisture will clam south texas through the week. >> you know what was so remarkable about this, one of many. this strengthened steamingly so quickly from just a tropical storm to the strongest hurricane ever recorded and torts in mexico didn't have much time to prepare. authorities in texas, though, have more time. what kind of emergency response and preparation are you seeing throughout that area? >> reporter: well, there's lots of road closures the emergency managers are getting there before the water is too high to sweep vehicles away, that's very good. they're monitoring the flood conditions very closely. i heard reports there is a dam on the north side of town they're closely monitoring. that dam is designed to slowly release water, to prevent catastrophic flooding. these dams aren't designed to hold rainfall of 18-plus inches and rainfall rates of one to three inches per hour. they said if mandatory evacuations become necessary associated with that weakening, so far, we haven't heard reports of that, which is a good. but all the creeks and rivers upstream here in central texas are filling up. there is a lot more rain on the way, especially for central and southern texas. i know austin and san antonio are under flash flood warnings. it looks like it may be shifting a little south. >> do you this, you chased more than a dozen hurricanes, including hurricane katrina, when people hear the strongest hurricane ever and these numbers when it was coming to shore, 200 miles per hour sustained, 245, much less than that now him put that into context for us, what we should expect, hope isn't true, but maybe expect when the sun comes up as we look across mexico? >> reporter: it's going to be really ugly there. especially ween between manzanilla to puerto vallarta. there is no way you will make it. i really feel for the people that live between there in those small towns the structures aren't big enough to hand him those types of winds. there are few structures that are. there is no parking dprajs in the big resorts between those two towns. it will be absolute devastation. if you can imagine 20 mile wide f-5 tornado, 200-mile-per-hour winds, that will kooip wipe out anything in its path. you have landslides t. mountains go up to the coast there. it's going to be bad. in the morning and all that moisture is headed towards texas. >> i gotcha. we mentioned texas, let's talk about that with meteorologist jennifer grey. i don't know if you have been watching this overnight. i'm wondering, even though it is still 12 hours later a category 1, it'scake breaking apart, can you see how organized these remnants of the storm might be do you think once it does hit texas. >> well, it's not going to be a storm anymore once it hits texas. at 11:00 this morning, it will be downgraded to a tropical storm and it will be going this time tomorrow we won't be talking ab patricia anymore. knack, by later this evening, we won't be. but the much from this stoorm is going to feed into texas and combine with a system that's already there. what will happen is it will cause additional rainfall across texas. that's when we will see that major flooding. we seen a lot of flooding as reed was mentioning. we will have more moisture on top of that. it will last through the begining part of the workweek. guys. >> all right, jennifer grey, we appreciate (vo) go national. go like a pro. >> we, obviously, mourn the loss of this brave, brave man. but i think we can't be too rick adverse when it comes to defeating isis. >> i think iraq like afghanistan, we need to have some true presence there. we don't want all the hard fought gains to really go out the window. >> lawmakers there raising some concerns and conditions as it relates to the nature of the u.s. commitment in iraq. now, this is coming after the death, first death in four years of an american service member killed by enemy fire, paster sergeant joshua wheeler lost his life during a rescue mission him still, defense secretary ash carter says the death of carting wheeler does not mean the u.s. has returned to combat in iraq. some are wondering if the administration is correct in making that claim. cnn's jim scuitto has details for us. >> reporter: faced with the first u.s. combat death in iraq in four years, pentagon secretary ash carter made clear that u.s. troops will continue to face danger there. >> administration has taken great pains. the president in vs. permutations to say it's not a major combat rule. >> they will be in harm's way, no question about it. i don't want anybody to be under any ill lugs about that. >> reporter: master sergeant joshua l. wheeler 39 of oklahoma, a 20-year military veteran, was a member of the elite delta force. the deadly battle was the first time they engaged isis fighters in iraq. in a joint operation with kurdish commandos raided an isis compound. to rescue hostages thought to be in imminent danger of execution. u.s. warplanes bombed make-shift isis training camps, staging sites and bridges in the area and five helicopters brought in nearly 30 u.s. special force and kurdish troops t. u.s. force were not meant to enter the compoundsch when british forces were overwhelm the u.s. commander made the decision to enter the firefight, master sergeant wheeler was shot inside the compounds and died in irbil. when the mission was over, u.s. aircraft overhead destroyed the compound. u.s. troops are deployed to iraq on a train, advise and assist mission. however, under current rules of engagement. they are allowed to return fire when they or their partner forces come under attack. >> when a firefight ensued, this american ran to the found of the guns and all indications are it was his actions and that of one of his teammates that protected those who were involved in breaching the compound. >> this mission was launched after u.s. under surveillance spotted freshly dug pass graves inside the compound. u.s. officials say that 70 prisoners were rescued, 20 iraqi security force as well as civilians and interestingly, isis fighters accused by their own group of spying, missing, however, were the kurdish captains they were sent in to rescue. the master's remains will come home saturday. they will be met by his family and those coffins so familiar until u.s. forces withdrew from iraq in 2011. this is the first death since then and the first time we have seen those images in so long. christy, victor, really sad tos are. thank you so much. a little girl shot while riding home from school with her dad. what we're learning now about the confessed road rage killer as the man is being called. he had a long criminal history here. >>ing a at this perfect littlifies. a candlelight vigil is expected today for this four-year-old girl. she was killed during what police are calling a road rage dispute. this comes days after tony torres was arrested in the case and he has since, we are told, i believe, confessed to pulling a gun and firing it on an interstate. one of those bullets shot and killed little lily garcia. torres is facing among other charges, an open kound of murder, aggravated battery, is held on $650,000 bonds, legal analysts, joey jackson, out with us. i just want to ask you, if you are defending torres, where do you start? >> reporter: well, you know, good morning, christy, what happens is, is that you have to ask yourself as a defense attorney what is your objective? this does not appear to be a who dunnit cases, they have plenty of witnesses who observed who this person was, the defendant. how he was acting, what he was doing and essentially the conduct he engaged in, on that day, so then you have to go, if it's not a who dunnit, it's a why you dunnit? that's significant. it's an open count of murder. open count of murder allows the prosecution, that is, to argue multiple theories in front of the jury, that is, ladies and gentlemen, this is an intentionaling a by the defendant meant to cause death. if you don't believe that, ladies and gentlemen, tore evidence doesn't support that, clearly this was a depraved and inhumane death that caused death. he killed this little child 4-years-old committing another felony. now as a defense attorney, you have to mitigate that. are you not attempting to win the case outright because, clearly, they're going to identify your client. it's him. you are trying to spare his life. if he is convicted, you are never getting out of jail. >> how do you mitigate it? >> reporter: here's what you can do, if you establish as a defense attorney it was based upon provocation, sudden passion the kwashlgs they were in a dispute, road rage, he couldn't control himself, he was angry. the law does not excuse that conduct, christy, but it goes to the mental state and it reduces a murder count to a manslaughter count because you are acting out of a heat of passion and a sudden quarrel. what's the difference in the difference between three-to-ten years if jail, the rest of your life in jail. i think that's where the defense is going. >> so let's listen to what the judge had to say in torres' first appearance here. >> certainly, this is a crime of violence, i think it goes without saying. this is possibly one of the most wanton and atrocious acts in this city. >> so you couple that with the fact that this guy had a long criminal history. he faced nine different misdemeanors, felonies in 2008. accused of pointing a handgun at his girlfriend and asked if she quote wanted to die. how does something like that we understand it get dismissed as it did? >> now, here's what's going to happen, these cases as we understand and you mention have gotten dismissed. so the issue is whether or not if he's convicted should they be factored in at sentencing or more closer to the point now, should they come in during this trial? andre ma dpee was a graduate assistant. >> i still can't get over your own daughter, there are so many things wrong with this, i can't wrap my head around it. >> andy scholes, thank you so much. >> whew! 12340e9s ♪. we got to get through this monster storm that moved on the shoer in mexico, bringing heavy rain, high winds, evacuations, hurricane patricia moves through mexico and heads towards texas. and in texas, flash flood warnings already with waters rising, six inches of rain expected to fall just this morning. and it's a big night for the democrats, a major rally tonight. clinton and sanders at the jefferson jackson dinner, could this be a game changer night? possibly for martin o'malley. >> good morning to you, i'm victor blackwell. >> i'm kristi paul. always so great for your company. look at those winds, that is some of the video we are getting in of the most powerful hurricane ever recorded as it paid landfall on mexico's coast. hurricane patricia is whopping 235 miles an hour t. winds have now slowed down to a category 1 as patricia is continuing to move into the mountains of mexico here. it's still a hurricane, though, some 12 hours later, extremely dangerous. torrential rain capable of triggering mass floods and it's contributing to flooding far to the north in texas. numerous drivers had to be rescued overnight when they got stranded in high rushing water. ed lavandara is south where much of the rain is contentcentrated. ed, has it stopped raining will? >> reporter: no, it is a steady rain. it continued to fall through most of the morning hours, leading to problems. we are on interstate 45 that connects dallas to houston near about 15 miles north of the town of corsicana, the interstate, a 30-mile stretch has been shut down. much has been covered in water, we are told and emergency officials just a short while ago saying they are starting to reopen the interstate here, so as you can imagine, it is a backed-up situation, as you look around, this was the point of no return here, basically, all the cars that have stacked up here throughout the overnight hours and we are looking down towards the south here. when you come back out this way, you can see for miles and miles, the cars that have been stacked up here throughout the overnight hours, trying to make their way between dallas and houston. it sounds like the water versus receded enough that emergency officials think it's enough to reopen portions of the interstate and allows track to start moving through, but it has been a treacherous situation throughout the night, kristi, several down high water rescues in the corsicana area,age emergency official tells me in a little more than 24 hours since the rain started they received 17.5 inches, more than 20 inches in some parts of the county, around corsicana. they say the rains will continue to fall. although this is falling. this is as light as we have seen here. >> that is good news, perhaps give the water a chance to recede here in this area as the storms continue to move through. it has been a treacherous and unrelenting downpour we have seen here in this part of texas. >> ed, you take good care there, you and the crew. thank you so much. >> so we see there are major problems for texas, but hurricane katrina -- patricia, rather, not done with mexico. for the latest. let's go to sarah side iner in guadalajara, where this hurricane made landfall. what do we know? still pre dawn hours. >> reporter: at this point what we're hearing is from the officials, from the president, himself, president nieto saying this is a didn't russ six. it has dropped, though, to a category 1. can reason why he is saying that, he is extremely worried as are many of the people who live along the coast about flash floods, about mudslides and landslides. those are real and present dangers. they want to make sure that the residents understand this event is not over yet. however, the good news coming from the officials are that so far, the reports they've gotten, mind you, it is not light out. they can't yet see the damage. but the reports they've gotten from the areas hardest hit are that this damage was not catastrophic, not what they were expecting, not as terrible as what they thought it would be, considering this is a his toreing storms the strongest ever recorded in the western hemisphere. and so there is a lot of talk this morning about exactly what actually got hit and we're hearing that this small fishing villages that may have the worst damage and as you might imagine, those villages are places where people are impoverished. so we will have to wait and see until the light comes, just how bad the damage is. we did manage to talk to some of those folks worn getting out as they were getting out of puerto vallarta. the hurricane did not hit that directly, but, certainly, it felt the effects of this massive hurricane, as it came in as a category 5 and they told us within they left, they took the last bus out and it took them seven hours. it's normally a four-hour drive to where we are in guard la harrah. we are expecting that a lot of roads will be closed and a lot of folks will be stuck where they are. >> all right, sara sidner there for us, sarah, thank you so much. now the winds have now dipped below the at that time strofk levels that they were about 12 hours ago. but, again the rain is continuing to cause problems, not just for central mexico, but now in texas. houston could be especially hard hit. >> let's go to cnn meteorologist with the details at the hurricane kernt center here in atlanta. jennifer, help us understand the trajectory and the strength. >> right. so this storm is weakening considerably. like sarah says, still a huge threat. we are still going to get a lot of rain across portions of mexico and because of the mountainous terrain, we are going to see the possibly of flash flooding as well as mudslides. you have to remember, this storm made landfall with 165-mile-per-hour sustained winds. it did not hit puerto vallarta, actually, most likely had hurricane force winds there. but not the category 5 hurricane force winds. so when you go to those towns today, when the sun comes up, we see those pictures, there is not much that can withstand winds of that magnitude. as this moisture continues to rise to the north, it is going to fill over mexico. we are going to continue with that flash flooding across the mountainous yaempls we could see additional four-to-six inches as we go over the next 24 hours or so. but all of this moisture from the remnants of this storm is going to combine with a system that's already in place across texas. that's going to pump incredible amounts of moisture, additional moisture into texas. we've already had record rainfall across places in texas. we've had water rescues overnight. so the flooding is happening now and when you add additional moisture to this situation, it is only going to get worse. we're looking at all of east texas, even the hill country of texas and that's when we could see major flashed intoing. so that's this huge concern, guys, as we go into today, tomorrow, even in monday. can you see the moisture that's feeding in over the top of that storm all of that moisture is going to head into texas and that moisture that's already in place that we have been seeing, it's only going to add to it. so that's the concern, texas is going to be the big story, guy, as we head into the next 48 hours or so. >> all right. stay on top of it. we'll check back soon. jennifer grey, thanks so much. >> ploil the democrats take the race for 2016 to iowa. clinton, sanders, o'malley all on stage tonight. that's what they need to convey to take the presidential campaigns to the next level. . plus, jeb bush is downsizing, slashing staff, and we had a lot of people wondering, what is the campaign's future? >> it is a larger problem. and look, a lot of people don't realize that jeb bush actually was quite a conservative governor. it's ironic he is paint as a moderate within his record is conservative. there is that aspect. he wants to introduce voters to his staunch conservative record. there is a big problem. that seals to be help is not an outsider. we see carson and trump josling for the top ranks, jeb bush is falling far behind. he is desperately moving resources to new hampshire. it looks like the only state he has a long shot in, it's a long shot at this point. >> maria, we understand they are reduceing payroll, cutting travel costs, moving people from miami into the early states, can bush turn this around? >> well, certainly, there is a possibility of that, victor. you know, one of the things we all know in politics is that anything can happen. but the fact of the matter is, that these are definite warning signs and most of the time, again, there could be exception, most of the time these moves signify the beginning of the end of a campaign, so bush i think it is extraordinarily skwau droppingly serious, because this was a guy that when he announced that he was going to be running, everyone thought that he was going to be the prohibitive front runner. he has a pack that still has you know tens of millions of dollars in it. we all know from a campaign standpoint, if you are not bringing money na your campaign, it signifies lack of enthusiasm. it signifies lack of debate that you have what it takes. they want you as near nominee. you can't continue without the kind of resources in your own cane that you need to in order to make the introductions they now think they need to make. >> got you. >> which again is indicative of very a bad turn for this campaign. >> let me come to you on hillary clinton and i go es the after math of that 11-hour marathon hearing. i want you to listen to virginia governor terry mcauliffe during dnc women's leadership forum. this is a rally, actually and the introduction. >> i don't know if any of you, you want to talk about a fighter, houb those 11 hours of testimony yesterday? it for her and thinking they have a smooth ride into the presidency. i have to tell you, a lot of democrats are very enthusiastic about her momentum this week. i think with good reason. but she needs to wake up every single day thinking and believing and running like she's the underdog. because that's the hillary we have seen in the last several weeks. >> that is when she is at her best. >> that is when she is at her most authentic. when she is at her most passionate. that's the one we saw in the democratic debate. that's the one we saw in the hearing. i believe that will be the hillary we see tonight. so her campaign will fight for every single vote. i got to tell you, the benghazi committee hearing, you know, even though, yes, absolutely the issues are serious, but it was the ninth investigation, the ninth committee that has investigated this and nothing new came out of it. >> how does nothing new 'come ot of this, maria? is that something we will see from the candidates, we heard from carley fiorina who has been very critical say she did well. we heard praise at the debate. are we going to hear benghazi more considering the general reception of the formering is's performance this week? >> there is no doubt about it. look, you won't hear about it during the democratic primary. bernie sanders seems consilltory in with the clinton campaign, vowing,ed theing her over her e-mail scandal. during the general election, no doubt about it. you will hear more and more about the benghazi hearings, to say no new facts came out of it. that's absurd. you look, we find out hillary clinton was saying this was a terrorist attack. she had spoken with the egyptian prime minister, saying this was an al qaeda attack. days later, showed up at andrews air force base saying handles. officials throughout the region are warping, turn around and don't drown. don't drive through this mess. a grim reminder two feet of water is enough to wash away any car or truck. patricia, the hurricane, okay, drenching mexico, dropping at least a foot of rain across the center. >> forecasters say it will be having mexico's mountains helping to tear apart this storm's strength. our meteorologist jennifer grey is here to explain. what is happening now? >> you are right t. mountains shred the storms. that's why it is weakening as rapidly as it is, with that said, it still contains a lot of rainfall. still dropping a lot of rain in mexico and because of that, we are going to see the possibility of mudslides so the situation there is still incredibly dire. most likely 75-mile-per-hour winds now. i would say this storm is tropical storm. we are still going to see a lot of rainfall, four-to-six inches, possibly, still along the coast. they have received quite a bit over the last 24 hours. but all of this moisture is going to pump into the south u.s. and combine with another system already in place and add more moisture, more rain, across texas and into louisiana as we get into the later part of the weekend, louisiana more so on monday. but we could see an additional four-to-six inches across portions of the hill country. six-to-ten inches of rain if some places around houston, isolated amounts even higher and so the flooding is going to be a huge concern across texas. we've already seen a water rescues, we've already had flash flooding. we are going to get this rain on top of what we've already seen there and so this is going to be the huge story as we go forward over the next 48 hours or so, guys. so all of this moisture the remnants of patricia will continue to get pumped into the south and combine with that upper level low already in place. so we will go from bad to worse i'm afraid as we get into the latter part of the weekend, guys. >> just grew so fast and intensity, so luckily, everything went well for us here in puerto vallarta. >> other than a rain event and some wind, you haven't seen anything treacherous? >> not whatsoever. in fact, we did not get wind here in puerto vallarta since the storms did not arise here in puerto vallarta. we got rain and the rain was a light-to-steady rain. >> we talked about all these people that evacuated puerto vallarta, why did you decide not to? >> well, to be honest with you, we didn't have too much time to evacuate since the storm grew really fast. so i decided to stay in my apartment and do the best we could, fearing the worse. luckily, things went good for us here in puerto vallarta. >> scott. we are glad you are okay. we hope your business is good as well. thank you for sharing to the movie "good fellas." it's happening in a new york courtroom. we'll take you there. well, today the body of afternoon american service member killed in iraq will return to the u.s. master sergeant lost his life during a daring rescue mission, which ultimately led to the liberation of 70 hostages, but this marks the first enemy fire since 2011. meanwhile, defense secretary ash carter says it doesn't mean that the u.s. has returned to a combat role in iraq. he did say similar raids in the region are likely. cnn's ryan noble joining us now with the details. good morning, ryan. >> good morning, kristi, defense secretary ash carter will be in dover, delaware today when master sergeant joshua wheeler's returns to the united states. meanwhile, secretary carter is clarifying the role of the u.s. military in iraq. now, u.s. forces are not there in a combat role, instead, to advise and assist iraqi forces. now, carter said, though, they should and can engage if the situation warrants. now in this case, wheeler, who is a member of the elite deallt force was at an isis compound in northern iraq. many of these hostages are iraqi special force, they were facing imminent mass execution. now as the kurdish force were overwhelmed, u.s. special forces command on the ground made the decision for the u.s. forces to engage. it was during that gunfight that wheeler was shot and killed. now, secretary carter said that events like this are rare in iraq, but it's something that u.s. military forces need to be prepared for. >> when we find opportunities to do things that will effectively prosecute the campaign, we're going to do that and this is an example of a case we can do something we alone have a capability to do so it's one of those categories, i suspect that we'll have further opportunities in the future. >> meanwhile, carter said he was proud of master sergeant wheeler. this was a man who was a 20-year military veteran and a father of four. he had been awarded the bronze star 11 different times and was posthumously awarded a purple heart. now, carter did not go into specific detail about the operation, itself, but he did say that wheeler was attempting to is about murder, racketeering and his alleged role in the heist, itself. >> reporter: you know how it's always said, oh, it's only in the movies, but prosecutors are say anything a new york courtroom right now, no, this is real life. the blockbuster 1990 motion picture was "good fellas" day-to-day life inside a new york mafia crew a. crew that hit a criminal jackpot. >> in a daring pre dawn ride at the lufthansa terminal, port authority say $4 million. >> reporter: it was one of the largest heists in this country's history. the multi-million robbery at the terminal alt new york's and now for the first time, one of those fellas is being prosecuted in new york city. for murder, racketeering, and robbery. 89-year-old defendant vincent asaro, an alleged captain in the vinadado crime family isn't portrayed. but prosecutors are portraying him as the mastermind of the crime portrayed in the movie by robert de niro. star witness in the prosecution, 37 years later, the defendant's own cousin who wore a wire and recorded asaasaro, a member of crime family, too. who turned to prosecutors after believing he didn't get enough loot. he actually stormed into the warehouse and helped take millions out. as asaro could be seen in court sayinging "liar" he remembers packages of money that contained $125,000 in 100 dollar bills, burlap sacks of gold chains, crates of watches and stones, total cost, $6 million. and none of it was found. asaro's former defense attorney said he didn't do it. >> the fact that he didn't get murdered would suggest he didn't have anything to do with it. >> reporter: prosecutors say asaro conspired and murdered by strangling with a dog chain paul katz in 1959 after believing he was cooperating with law enforcement. they found remnants of his remains hidden. and four other defendants allegedly playing minor roles including asaro's son have already made deals with the government. but the good fella prosecutors believe is the real deal is asaro who they helped to put him behind bars and at the same time bring justice to victims of crimes never solved. wiretap recordings are going to play a large role. right now, the jury's hearing testimony by the defendant and his cousin still on the stand. and he started recording the defendant in 2008. in 2011, there's a recording that the jury has heard, where the defendant asaro says, you know, we didn't get our fair share of this stuff because jimmy "the jet" burke got it all. witnesses asked what are they referring to? they said he's referring to the lufthansa heist. the $6 million there. and there's a recording where asaro is saying to his cousin, you faux, you've done some good things and an awful lot of bad things. and the prosecutor said what are the good things? well, i buried a body. >> go to my facebook page is the easiest thing. tomforemancnn. you can see the various pictures and videos as i make my way across the country. i hope i make it. that's 108 miles. that leaves me 1 we. >> you're going to make it. >> we have faith in in you. >> we certainly do. >> all we've been doing is sitting in this chair. >> absolutely. >> good for him. there is so much more news that we want to talk to you about this morning. >> certainly, your "new day" continues right now. >> announcer: this is cnn breaking news. breaking news we're following this morning i'm christi paul. so grateful to have your company. >> i'm victor blackwell. good morning to you. hurricane pa tricheia, the most powerful storm ever record is causing major problems. south of dallas, navarro, you see flooding occurring here. >> we're going to show what you patricia looked like as it came ashore in mexico. what you're looking at here is a category 5 at its peak south winds. topped 235 miles per hour. listen to that. so frightening, when you think about being there. patricia has now, i should say, slowed to a category 1. but we cannot discount this. experts saying this is still a very threatening storm. we have live records from sara sidner in mexico. and ed lavandera in texas. and a flood threat that's happening there. what are you seeing today? >> reporter: hello, it's been a treacherous night here along intestate 45 that is the major that are row fair that connects the cities of houston and dallas. we're about 15 miles west of a town call corsicana which has been covered in water for much of the night. and the interstate had to be closed down. there's a great deal of backup starting to clear out. the rain has slowed down a little bit over the last couple hours. that has allowed the floodwaters to recede. and now emergency crews are trying to open up as many lanes as possible. christi, as you can imagine, these are people headed southbound along interstate 45. the traffic here is mind-boggling. cars and cars for miles and miles, as i mentioned, has been an unrelenting rainfall that has hit this part of texas for more than 36 hours now. in whi emergency officials told me a little while ago that more than 17 inches of rain has fallen in the dorcorsicana texas area. rain continues to fall, even though it's lighter than usual. they're trying to get a handle on the situation. they'll get a better idea once the sun comes up. the real focus is the roadways, there's been 30 or so high-water rescues here in the corsicana area, that emergency teams have had to launch to save people trapped in the floodwaters. so even though the rain has slowed down a little bit, it's still a very treacherous situation here. emergency teams waiting for the sun to come up to get a better handle on what they're dealing with. now interstate 45, portions of the interstate tarting to reopen. but the backup has been for a while. it's going to take a while to clear it up. >> ed lavandera, thank you. the mudslides, one of the biggest dangers right now, as patricia dumps use amounts of rain over the mountains of central mexico. that's where we find cnn's sara sidner. she's in guadalajara there. we're a few hours from sunrise as we get a comprehensive picture of patricia. what do we know thus far. >> reporter: you know what's interesting, here in guadalajara, there's no rain no wind, all calm here. so you understand, it's still a category 1 storm that's trending into the country. and when it did hit, it was a category 5. i'm going to show you some pictures of what that looked like. i mean, massive, massive amounts of wind. very strong sustained winds hitting 200 miles per hour. unprecedent this is the strongest hurricane ever to be recorded in the western hemisphere. so when you credit it a powerful storm, there is reason to warn people. they evacuated tens of thousands of people, the mexican authorities. and they did the right thing. a lot of folks saying that certainly made a difference because the eye wall was small. that's where the most dangerous winds are, around that eye. that was small, which means that likely the damage is not as extensive as they thought it would be. the president did say he thought it could be catastrophic damage judging from how large and powerful this storm was. but he's now saying, look, from the reports that we have so far, even though it's not yet daylight, and we cannot yet see ourselves. the reports that we have so far is that the damage was not as bad as once expected. >> translator: with the information available till now, and taking into account that the hurricane follows its path, the reports confirm that the damages has been smaller considering the magnitude of the hurricane. nonetheless, it is very important that the population stay in the shelters. the security forces will be patrolling to protect their homes. >> reporter: so you're hearing him say, you know, still very important. and the reason for that is landslides. mudslides. flash flooding. those are still real and present dangers that everyone, that is in that area, needs to be aware of. and there's also another issue here in colleeno, a couple of hour from where we are, this is where they were going to put the aid agencies and deploy to hard-hit areas. they've had to evacuate people from there because a volcano that has been active and spewing a lot of ash over over the past month. they're very worried box of the rain, that ash is going to turn into another danger and more mudslides. victor. >> sara sidner there live in quad guadalajara guadalajara, thank you very much. >> it's still bringing a lot of rain. cnn's jennifer gray is following it for us. it's not going to heightened because you don't expect the a trajectory to include the gulf of mexico? >> that's right. a laud of wind shear. even though it's a patrol storm and it will completely dissipate over the mountains of mexico, it is still going to bring a lot of rainfall for the southern u.s. texas, louisiana. so the moisture from the remnants of this store will feed into the upper level low that's into the south. that will bring incredible amounts rain over the next couple of days. winds 50 miles an hour. an 8:00 advisory just came without. 90-mile-per-hour gusts. will still cause damage, especially for villages that don't have that. we'll see trees down and the possibility of mudslides because a lot of moisture is still in the storm and it's still continuing to dump a lot of rain as it heads north and east. 2 to 4 inches of rainfall in the mountains, 4 to 6 in isolated mountains and 6 to 10 towards the coast. the shift to the u.s. over the next couple of days and it's already happening% we had high-water rescues overnight jut south of dallas. it has already been flooding. and we could see an additional 6 to 10 inches of rain across portions of texas, guys. it's unbelievable. 4 to 6 inches across louisiana. flooding that we're seeing, the flash flooding, we're going to see more rain on top of it. today, tomorrow, this is going to last into monday. so this is going to be a huge concern, as we go through the weekend. all of this moisture, remnants of patricia, pumping into the southern portion of the u.s. so, flash flooding is going to be expected, today, tomorrow even into monday into louisiana. christi. >> jennifer gray, thank you so much for the heads-up. congressman paul ryan, he may have an easier than some would have expected path to become maybe the next speaker of the house. but how much cooperation is in his future if he'd like to make some changes? >> well, some of the people, obviously, had made commitments elsewhere or had thoughts on different things but at the end of the days, our caucus and others, those organizations came out as well. those organizations i don't think had as formalized rules as ours did. ours was a little structurally different. >> one of the reported changes that congressman ryan be made to the ability to remove a speaker. the motion to vacant as it's known. >> that's been a procedure on the books since thomas jefferson wrote this manual for congress. over 200-plus years ago. it's a right of any member of congress to represent his constituents on the floor of the house of representatives. i guess our group is saying now is probably not the right time when you're trying to bring everybody to together to go in and try to divide things to change a rule that's been in place for two centuries now. >> you voted against voting against john boehner as speaker. would you be willing to use this motion to vacate to replace paul ryan, if he does not live up to the list of commands from the freedom cauaucus? >> i don't know that the freedom caucus has really a list of demands. they're meeting the person public, it's on the who and what, forgets to ask the questions, the why. the why are these things going on? you look at a presidential race and you see that washington is not happy in general with the way the house is moving. we make changes in leadership. what they forget to add is the why. and the why in the senate is the other half of the equation. that's part of the problem we don't control but when we pass bills in the house and they go over to the senate, and they die there, that's the why question that really should be at the bottom of all of these discussions we're having right now, with changes in washington. >> understaood. let me get back to the essence of the question. is there part of the reason that some members thought changing the motion to vacate, is because you foresee using that in the near future if paul ryan makes decisions which you disagree? >> no, i don't see us using that in the future. we had full vision with paul ryan. i've worked with him on the floor as well. he has a conservative view for the country. he was the party's vice presidential candidate the last time around. so, i think if we can enact those things, move those things in that direction. but again, it all goes for naught if we do these great things. and then it goes from the senate and it dies in the senate. >> there were three demands made. from paul ryan. that's what i'm going to go to. he said that he wanted to be able to change this rule. reportedly, he's going to delay that. he said he needed the endorsement of three key gop groups. he didn't get that either. i wonder if going into the job -- he's not even there yet, we don't know what the work/life balance will be. if he's weakened already by seeing he can't get the basic things which would be the only conditions by which he would run, he's running without two of the major three. >> it doesn't weaken him, it strengthens him in the sense, in order to move things along, you have to have consensus in the house. that is what he was trying to do. that's what the house freedom caucus was trying do. he realizes in order to try to move to get the responsiveness to the american people, you have to move all together. that's what the american public acting for out of washington. anyone in washington that wants to be successful realizes when you go to the negotiation table, you may know what you want, but you're not going to get 100% of it. and if you demand 100% of it, it's your way or the highway, then you will not be successful. and the american public will not be successful. that's what we're trying to change in the house. and i'll challenge you on this to ask that why question, why the senate, we can't, why they're always looking for 100%, it's there way or the highway. we're willing to be the party of not hell no, but the party of hell yes. we want to get things done if we can get them out of the senate and get them done. >> there are those who say that the freedom caucus is part of the reason why. it held the leadership to pass on something when there was no chance it will even get a vote? >> yeah, but that's the question you -- i challenge you to ask the senate, why will they not allow the vote on those things? ask that question, why does the senate democrat leadership say they will not allow a vote at all to allow an american voice be heard? >> reporter: well, this is some of the lightest rain we've seen which really isn't saying much because the rain has been coming down relentlessly here in many parts of it or over the northern part of texas for what seems like 26 hours now. an expert said they received here in the town of corsicana, nearly 17 inches of rain since the rain started yesterday and caused quite a bit of problems. this is interstate 45 which has been closed for most of the night. and just moments ago started reopening. they're now in the process of clearing out miles and miles of cars that have been backed under here on the interstate because the road has been covered in water for much of the roadway. for now, the rain has receded and slowed down. the floodwaters have dropped back. it's open, that's good news. but we're told as the rains pick up later in the day. and floodwaters come back up. there's a chance they might have to shut it down again. they're trying to get as many people through as possible. >> ed lavandera, take care of you and your crew there. >> let's bring in cnn meteorologist jennifer gray tracking the storm as it continues to break down. and those mountains helped earlier as you said to shed the storm. it's a major challenge here. >> absolutely. that's going to be pumped into the central portion of the u.s. combine that with an upper level low that's sitting over texas and you are going to have a major flooding event. we're already seeing flooding, as ed was saying, more than 17 inches of rain where he is. on top of that we could see an additional 6 to 10 inches, so, it is going to be a major flooding event. all of this moisture. here's tropical storm patricia, all of that moisture is going to continue to feed to south texas. central texas. south of dallas, that bull's-eye right there, we could see more than 10 inches of rain in isolated amount. texas all the way down to houston, the hill country included in this. flash flood warnings are in place. flood watches over much of the state. and that is to include southwest louisiana. let's not forget about that. louisiana's going to be in this, too, especially as we get to sunday and monday. dallas in the rain. off the innocent rain, we even have lightning associated with this. we've seen rainfall rates 1 to 3 inches per hour. some areas have seen even higher rainfall rates. that's what's going to continue. it's not going to let up. this is going to be relentless over the next few days. that flash flood warning in corsicana, 35,000 people within that warning box. so that is in effect until 10:00. i'm sure that's going to be extended, guys. because this is not going to let up at all. look at the heavy rainfall that's forecasted by tonight. just southwest of houston. along the coast. dallas still in the rain tonight. and on into louisiana. so this is going to be a major problem. we've already seen the high-water rescues overnight. and so as long as the rain continues to come down like it is. it's not going to get any better, guys. >> jennifer gray, thank you so much. we'll continue to check in. >> today, iowa is the center of the universe, so to speak, for those who want to become the next president. just minutes from now, iowa's new gop leader, ben carson is greeting owners. the democrats and we'll break that down for you. >> and russia is also supporting syrian rebels against isis which means now they're backing two different sides in this fight. a lot of people wondering how does that work? [ laughter ] >> the cat's not grumpy, just misunderstood. president obama giving his best grumpy cat face. the republican candidates yesterday, this morning, donald trump he's not exactly happy with his drive from the top of the polls in iowa. the polls show dr. ben carson with a commanding lead ahead of donald trump by nine points in this critical caucus state. it's remarkable because carson isn't technically on the campaign trail. he's on a book tour. but his book tour goes through a lot of early voting states. cnn reporter maeve reston joins me live. how is maeve, how is dr. carson characterizing his ascend to the top of the polls? >> well, what we're seeing is evangelicals flocking around ben carson and he's obviously rocketed to the top in iowa. he actually is here in iowa today, along with hillary clinton and bernie sanders. he was doing a breakfast in ames, this morning, as part of the book tour. but he's certainly out there connecting with voters, an we saw donald trump go after him last night at his rally in florida, saying while ben had shot up in the polls, they let him know that and he was sleeping. we'll see how the back and forth over carson and trump goes over the next few days. >> it's a big day for democrats in des moines. today is the jefferson jackson dinner so important, essentially elevated the campaign of then senator barack obama back in 2007. a question for you, what are we expecting tonight? and what does a candidate have to do to get that elevation? i'm looking at former governor mark o'malley. >> reporter: right, this could be a big moment for him tonight, all of the campaigns are getting their supporters to this dinner, starting with rallies this afternoon. we have dueling rallies between hillary clinton and bernie sanders here in des moines. katy perry who did a wake-up call for clinton staffers this morning will be joining hillary clinton and bill clinton later on today. thy this is really about getting the supporters excited. working the crowd and getting the commitment cards in. everyone stalks about this as being really the real start of the fall campaign. so, that's what's on the agenda for these candidates today. and they'll be speaking tonight in a theater in the round setting to their supporters which can have kind of a more intimate feel even though there are 6,000 tickets sold for the event. 6,000 but intimate environment. maeve reston, thank you so much. what say katy perry wake-up call?
