government shutdown. it's every monday night like this? just asking for a friend. the house on fire -- something tells me congresswomen and see pelosi has a few things to get off her chest. the speaker emeritus here on set, and she is coming up first. plus, the head of the july joins -- knowledge -- more dangerous votes on social, media and he might have committed a felony today in south carolina. andrew weissmann is standing by with his reaction. also tonight, we are counting down to the first live interview with the star witness at the january six committee. rachel maddow joins me -- with cassidy hutchinson. later, as the president and his predecessor jewel -- for back-to-back visits to michigan, did one of them has a long history of broken promises to the same people he's trying to pitch. >> remember when the government shutdown in 2013? i sure, to my first guest definitely does. in case you don't, let me refresh your memory. basically, republicans like mike lee and ted cruz, and a bunch of other ones were angry about providing health care to more people. they were so intense on defunding obamacare that they shut the government down. at that, time i was working in the obama administration and i, thought we were dealing with the most unreasonable obstructionist bad faith actors that i would ever encounter in my career in washington. i've got to, say this fight right now about whether or not tough on the government has made 2013 seem kind of like the good old days. at least that 2013 shutdown was about something. it was a ridiculous policy -- and they were definitely, wrong but at least it was not policy disagreement, the hidden obamacare, and they wanted to and. it today, the most powerful members of this house republican congress, who are determining the agenda of that conference don't have any agenda at all. they literally cannot articulate what this is all about. their agenda is to seize the role of government altogether. their agenda is to burn it all down. that is the entire guiding principle of the most powerful wing of this caucus. that doesn't seem to be the registering for -- who had the sense -- well, you have to keep the government open, if people want to close the, government it only makes it. weaker why would they want to stop paying the, troops or stop paying the border agents in the coast guard? i don't understand how that makes you stronger, i don't understand what point they're trying to make. >> doesn't it kind of sound like he's an observer, a spectator, not the speaker of the house? the person third and lie to the presidency? my first guest tonight refers to him as the shrinking speaker. it's pretty apt, because he has no control and does not seem to know how to assert. it's the most powerful members in the caucus or taking their case, not from, him but from mar-a-lago. they are not even hiding it. if donald trump posted last night, quote, unless you get everything, shut it. down that's to be exactly what they plan to. do let's be, honest this was all kind of predictable. despite their brief flirtation when they were on the campaign trail with pretending to want to govern on issues like addressing inflation, and lowering gas, prices they're blowing it all up agenda has been there guiding principle in the majority. just consider a few of their crowning achievements over the last few months. they spent countless, i'm talking countless hours, on meaningless resolutions intended to punish their political enemies. like, say censuring democratic congressman adam schiff, what a good use of time. they have been trying to retaliate against federal law enforcement for daring to hold donald trump accountable. they were threatening to defund the justice department, and the fbi. earlier this, month when congress came back from their longer recess with time running out to fund the government, the very first thing kevin riccardi did, under pressure of his right flank was launched a bogus impeachment inquiry into joe biden without a purpose. because this congressman or -- because donald trump told them to. so the connections here? what exactly do they want to impeach him for is really anyone's guess at this point. here we, are just five days from the government shutting down, which will happen huge -- and what's on their agenda this week? well, they are making time in their schedule to hold their first impeachment hearing. just two days before government funds run out. oversight committee -- made it official, in just a few hours ago with the witness list and everything. his committee says republicans are going to finally do what they have tried, and failed to accomplish over the last eight months that they've been looking into. this quote, presenting evidence -- knowledge of and role in his family's international business practices. it sounds a lot like what we've been hearing for months. look, whether mccarthy wants to go along with all of this or not, this impeachment inquiry and government shutdown, it does not really have a choice. without the nile of his party, he won't be speaker. because of, that he seems to be unwilling to tell them. now all of this begs the question, is being speaker so great? especially when members of your own party seem to humiliate you on a daily basis? i'm just wondering. from my vantage, point the man third in line for the presidency has found himself hostage basically to a group of people who have no desire for him to succeed, and no desire for the institution of congress to work. none of this is about different approaches to governing, or policy views. they've literally want to shut down the government. it's about ceasing the role of government altogether. that is the undergo. mister speaker, when you ask the point -- the answer is pretty clear. their agenda is dysfunction. that's the whole point. joining me now is the house speaker congressman nancy pelosi of california. thank you so much for joining me this evening. it's great to see you. >> it's great to see you, congratulations on your new time slot. it's a wonderful show. >> my pleasure to do so, thank you. >> i want to speak to you, you've been in congress for more than three decades, two of those decades in leadership. have you ever seen the house this dysfunctional? >> it's pretty dysfunctional, but all three of the shutdowns we have had had been under republican speakers. last one, the longest one, and the biggest, one in history was on her republican speaker -- president trump who said i take ownership of the shutdown, and now he's encouraging this republican congress to shut down governments. it cost the economy tens of billions of dollars, it says to our men and women in uniform who are the military, or in federal law enforcement, you are not going to get paid. it's as 2 million women and children and our country, who depend on food assistance, you are not going to be eating. the guest goes on and on in terms of what government does. so, again, this is nothing new to them, however right now, with all of that is going on, all of the challenges that our country faces, it is particularly irresponsible. >> it's like a, game you have been through many of these before, as he said under republican leadership. >> all under republican speakers. >> there's five days left. do you think there's a scenario where speaker mccarthy can avoid shutdown? >> i hope so. of all the bad things that are out there, and what they say in, do a shutdown is a very bad thing for the country. they made an agreement when we had the discussion with the president, they had an agreement about lifting the debt ceiling, they came to terms on a budget number. that was an agreement. now they are walking away from the agreement, so not only is it a bad idea, in terms of our country, it's a bad idea about not keeping it -- there is a chance that the senate could get -- a continuing resolution that would keep the government funded in the short term. everybody is looking for solutions. here is that something that could potentially avoid a shutdown in the house? what do you think of that option? >> i have not seen, it it's just. new it is indicative of the old slogan that we always use in the house. not a nine senators are not enough. they have had bipartisan agreement it appeared, and the senate about doing their own continuing resolution and sending it over. it has its parliamentary challenges, but nonetheless, and now they said because -- object, they can't do. that one 99 senators are not. enough one senator holding up over 500 appointments, commission come oceans and the rest, in the military. it's just not. right anyway, to take it back to this, it depends on what it is. we are not just there to vote for anything and the democratic side. we will see where we can find our common ground. we have a responsibility to try to do that. >>, our leader, and we take our lead from him. >> another option is a district politician, or a handful of republicans, not that many could join with democrats, it's not something that is under discussion to avoid? this >> a discharge petition as an option, however an order for it to even be considered, you have to have to have a 30-day period or address, there and a 30 days -- it would be shut down. it's a longer term saying, it won't work unless we have something to keep government open. it's past the end of the fiscal, year which is september 30th. >> lee of or ovens happening this week is the house oversight committee holding its first hearing on the biden impeachment, which they have not outlined our purpose for. it's clear what they're trying to do, here at least to me. they're trying to muddy the, waters make president biden seem corrupt. how do democrats avoid that? or pushback on that, or prevent it from being an. issue >> the factors they had no goods. they have been for months and months and months trying to make some kind of a charge. i don't think they will ever bring it to the floor. they won't have the votes. the remembers and districts that president biden won, not that there are so far president biden, but these voters will say that's just not the right way to go. everybody was on my case in 2007 when we got to the majority, and they wanted us to impeach president bush for the war in a, rock the misrepresentations going, in departing from afghanistan too soon, all of that. if you have a difference of opinion, you just can't be impeaching impeaching, on the other hand, this is a fake distraction as you said. they don't even have the courage to bring it to the floor, i don't think the speaker has to worry about that. >> i mean you've been the speaker, before looking at all of the events of this, week what do you think the history books will say about kevin mccarthy's role as speaker? >> it remains to be. seen he has not had even a full year, much less a full term. i do think it's important for people to know what to the position. is it is the only legislative position mentioned in the constitution of the united states, and by the way it's second in line to president. so it's number two, so it's a highly responsible position, and it also has power. if you decide to use it for the public good, building consensus within the congress, to take to go for, for sustainability. that's why i keep saying, one thing he could do is to take back the republican party. the great party, it's done great things for our country. great leadership overtime. don't let it be turned into a cult, into a thug in my view. this is what is happening. this man is telling them, unless you get everything, nobody gets everything, unless you get everything, shut government down. that should be a testimony itself to the speakership of anybody to be taking guidance like that from the outside. >> several house democrats along with new jersey's governor -- of all called on senator menendez to resign. do you think he should resign? >> i respect their position they are taking. the charges are formidable. if in fact we are going to say that if you're indicted, you should resign, we have a situation in the house. as you know from the state of new york, that that would hold to. right, now sadly because of the challenges that we face, because the skepticism that exists in our country about governance, about this republican party that does not believe in governance, doesn't believe in science, so they want to take down everything in order to give tax breaks to the wealthiest, we've got to stay focused on that, and for that reason it probably would be a good idea if he did not resign. >> do you, this weekend on his failed social media site, donald trump used about the execution of -- this was flush quite shocking to. me what was your reaction to that? >> my reaction is not so much to him, but to the speaker who support him. i respect the differences of opinion that exist in our society, from the beginning of our country. that's what a democracy is about. people have different, views they debates, them you put it before the, public they make a decision, you go forward. but if you engage in language like, that it should be something that would discredit, would eliminates somebody as a prospect for any public office. -- was very courageous, in the military on the battlefield, and in the public arena in the white house. i'm saddened to hear that former president would say that just another argument, why he should have never been in the white house, and should never be there again. twice impeached, once defeated, how many times indicted? it's true. plus, when you buy your first line of mobile, you get a second line free. there are no term contracts or line activation fees. and you can bring your own device. oh, and all on the most reliable 5g mobile network nationwide. wireless that works for you. it's not just possible. today, fulton county judge it's happening. scott mcafee order that the identity of jurors and potential jurors and the georgia election interference case be kept secret until the end of the trial. that means that any video photographs or even drawings of the jurors would be barred. the jurors would only be identified by number. in any filings, and in open. courts that order comes as we await a decision from the judge presiding over the federal election interference case, judge tanya chutkan, on whether or not she will grant special counsel jack smith's request for a limiting gag order against donald trump. that could come tonight anytime. let's be clear about why we are seeing these orders and requests. donald trump has been furiously attacking everyone involved in the case against, him and even some shacks with filed that order, he's been attacking. them he and his allies have -- as election interference, he has repeatedly called jack smith drenched and a thug. his basically -- highly partisan, as well as very biased and unfair. and a few days, ago he suggested that his former top military adviser, general mark milley, who have spoken with prosecutors, should be executed for treasonous acts. let's just pause there for. moments his former military advisor, the chairman of the joint troops, he was suggesting that he should be executed for treason, -- many of these make them public, stripped threats of violence have spiked, there's a connection, the top prosecutors in the four criminal cases against donald trump now require round the clock protection. a texas woman was arrested just last month for threatening to kill judge chutkan if trump is not reelected, and the purported identities -- of the grand jury members have circulated on pro trump message boards. it's not hard to see the cause and effect here. stoking anger has often been a key part of donald trump strategy. we now know, very well what the consequences are. joining me now is my friend legal, eagle on official, counsel andrew weissmann. he's also general counsel at the fbi, and former senior members -- robert mueller's investigation. the judge in fulton county order today that no identifying information of jurors and prospective jurors should be disclosed. that seems fairly obvious considering the threats. here how uncommon, or common is that? >> in our file, case it is fairly. common it does not really need to be triggered by the defendant himself, or herself,, you're gonna be concerned about, interference about press interference, but anybody contacting jurors, here is others an additional reason for exactly, what you said. your concerns about remarkably, the former leader of the free world, is this a step that was taken by judge kaplan in the e. jean carroll assaults, sexual salt and rape case? i'm so it's fairly common, one thing that i'm still concerned about is that although he ordered the, judge that this be sort of an ominous, and we would not find out the, identities it does not mean that the defendant donald trump, and his counsel, no until you still steaming that donald trump will obey the law. that, as we know from fort indictments, it's not a questionable assumption. >> what happens if he releases their? names that's a crazy question to ask, but are the even consequences be to look into the system? for anyone else yes. but i think there's probably just a natural reluctance here, to jail somebody pending trial. or paul manafort for instance, when he coached to witnesses to lie, he was put in jail by a d.c. judge. it is the norm, sam bakeman frayed, in the southern district of new york for financial crimes. much less serious crimes in terms of the importance of democracy, it's in jail pending his trial. >> so, we're also waiting for trump, to respond to the special counsel's gag order request. it's supposed to come, tonight we'll see. talk about the stakes of this back and forth, given trump's behavior, because as a non, lawyer i'm sitting here watch -- make these threats about chairman, and thinking about how this is not a big factor, is it a big? factor >> let's just remember that, the context, wherein there is a motion before one of four judges, who have the criminal cases of donald trump. there is a motion pending by the government say, to something judge, you've got to restrict him some ways. what he is saying about witnesses, and drawers, and george's, and their families. you have to do something. while that motion is pending, as you said we're waiting for the defense brief tonight. he has done a number of, things he has made the statements about the former chair of the joint chiefs of staff, again it's unfathomable that we are sitting here having that conversation. he has been on air today, about possessing a firearm. you and i were on air together when in the d.c., case he said the most important thing is, when you are out on, bail do not commit another crime. it is a crime for somebody who is charged with the felony, charged with a felony to receive a gun. there are pictures on twitter of him holding the gun. >> the city need a receipt? we don't even know, his campaign has come out and said he did not purchase, it >> lets not the law, it's not that you can't buy, gotten the law is that you cannot, -- 9:22 and. it's that you cannot receive a gun, that has traveled in interstate commerce. that means it's traveled across state lines, and a glock has trifled against a, lines but they're not made in south carolina. >> even not, purchasing it he could've violated, >> that happens a lot, there are other parts of the statute that apply to people who are convicted, and they cannot presents a gun. the issue here is not that he would be charged with that separate, offense it's that while this motion is pending, what judge chutkan will have in front of her is not just the statements, but somebody who has flagrantly boasted about doing something. to me, he is really daring the court to do something. it's like a, child except it's much more serious, because it's somebody who's out on bail on 91 felony counts. >> so while we wait for, that's because the next step we get trump's team, their response to the protective, order and jack smith's team can respond, and then we're waiting for the judge. >> so we're waiting for, the judge that's the most important part here, is that a yes or nos to the protective order? >> first, of all let me say thank you for saying that you are looking forward to, it and that you are so looking forward to. i am not looking forward to, it i need the next 23 minutes to continue to prepare, you know may well enough that i'm always pointing at the very last second so, like i have an event on the harris birthday. i am not ready. i need more moments. listen, cassidy hutchinson decided across the rubicon when she decided that she needed to live with herself. when she decided that she could continue to protect the presidents, she had a lawyer who was -- and who was being paid for -- she didn't know how, but it wasn't her, and she did not have money to pay for a lawyer for own choosing who did not have the same perceived conflicts. she realized that she could do that, but she wanted to pass what she calls the mirror, test being able to lock herself in the eye for the rest of her life. as a very young woman confronting that dilemma, she knew that she's likely looking at a very long life ahead, in what she's going to have to live with decisions that she's making by the age of 25. she crossed that rubicon, and now i think she wants people to understand how she did, it and why she didn't. alaska route, this but i can't help but think that she is also telling the story to let other people know that they can be brave to. >> you don't need to be in a safe, states in utah, with mitt romney. you don't need to be protected by a billion dollars in personal assets like mitt romney. his in, fact she was completely broke at the time that she was giving that testimony. she had not paid her rented months on the day that she sat there and that. room she had no family assets, working class kid, she did not have any -- question at all that she did the writing. i think she wants america to about two so other people maybe consider -- i hope people listen and kind of walk across that bridge. one part of her, i wonder what rachel thinks of this. now i have, you before i let you go to do your last preparing, she writes about how alexander battlefield is an inspiration to. her >> 41 who does not, know butterfield is a former nixon aide who testified at the watergate hearings -- in the white house. pretty -- you are a student, a podcaster, a broadcaster of historical parallels. what did you make of that comparison? back in 20, 16 remember he convinced a whole lot of those workers that he alone, trump alone was the person that could bring manufacturing jobs back to forgotten pockets of the country. >> i am going to pay the greatest jobs president that god ever created. remember that. >> i will bring back jobs. you cannot bring back jobs. >> i'm going to bring back our jobs, to ohio. and pennsylvania, and new york, and michigan, and all of america. it will be a victory for jobs, jobs, jobs. we are going to bring our companies back. if i am, elected you won't lose one plant, you have plans coming into this, country you'll have jobs again, >> it was that message you just heard that helped trump -- and cross the midwest, entering the 2016 election. remember, he won michigan by just over 10,000 votes, was caught by roughly 20,000, and pennsylvania by about 30, thousand in each of those crucible, he outperformed her was white voters without, by a margin of 2 to 1. it is empty promises to this group of voters helped propel him to the white house. in this, moments ahead of what we'll see this week, i thought that the story of one jim plant in lordstown ohio might be kind of useful. this plant was one sprawling, both in size, spending more than 100 football, fields and its impact on the community. for over half a century, the gm plant produced millions of vehicles, employees thousands of people in the, community and served as the beating heart of the town. in 2017, still wearing the -- trump spoke just 15 miles down the road from that sprawling gm plans. a group -- in youngstown. in a part of -- that barack obama won by 20 points, and trump phipps flipped in 2016. but he spoke to them, he promised that manufacturing jobs were coming back. >> i'll tell you what, i rode through your beautiful roads coming up from the airport, and i was looking at some of those big wants an incredible job producing factories, and my wife ali maloney a, what happened? -- >> we have to call it out as a straight-up ally. donald trump is coming to michigan to go to a non-union supplier. what is going to do is blame the ev transition. this is absolutely ridiculous, he's putting workers against workers. i've got to tell, you chinese automakers are sour bloviating at the opportunity that america is going to flinch on evs, so they can come in and dominate the market, and if he's successful, he destroys the american auto industry. >> you're there on the ground in michigan, he stopped by the picket line, tell us about what you've been seeing and hearing on the ground. >> number, one workers are frustrated. they see that ceo pay has skyrocketed. they see some of the ceo is making 20, eight close to $30 million a year. these are workers who might be starting at $15 an hour. they made a ton of concessions during the recession, they want their fair share. they want a 40% raise. there is some concern about evs, -- but more than anything, we want assurances that this will be our jobs, and donald trump has already said blatantly that if he is president,'s jobs are going to china. >>, yes and he's been pretty clear about. that president biden is of course joining the picket line tomorrow, not a common thing for the president to do. michigan congresswoman debbie dingell said president biden should not intervene in the negotiations. what do you think? >> well, first of all, this is historic. this will be the first sitting president in united states history to actually come to a picket line. i think anybody running for president should come to the ground and listen to workers. not go to a non-union supplier and try to pick people against people for their own gain. come on, listen listen to, people shake their, hand show up, bring some coffee and donuts. that is how you show solidarity. should he negotiate with, them or she should stay out of? it >> he should listen to them. the president should not come here to negotiate with workers on the picket. line i've got to tell, you visiting the picket, line and hearing people stories, i talked to one worker who is a third generation uaw worker whose grandfather participated in the sit-down strikes. he's now working across his son, that's -- sitting at the, white house sitting in our offices. showing up in listening, it's something that's incredibly powerful, and only one candidate -- does. well >> the uaw has not endorsed president biden. yet what do they think they need to hear to take that step? i sure, to my first guest definitely does. in case you don't, let me refresh your memory. basically, republicans like mike lee and ted cruz, and a bunch of other ones were angry about providing health care to more people. they were so intense on defunding obamacare that they shut the government down. at that, time i was working in the obama administration and i, thought we were dealing with the most unreasonable obstructionist bad faith actors that i would ever encounter in my career in washington. i've got to, say this fight right now about whether or not tough on the government has made 2013 seem kind of like the good old days. at least that 2013 shutdown was about something. it was a ridiculous policy -- and they were definitely, wrong but at least it was not policy disagreement, the hidden obamacare, and they wanted to and. it today, the most powerful members of this house republican congress, who are determining the agenda of that conference don't have any agenda at all. they literally cannot articulate what this is all about. their agenda is to seize the role of government altogether. their agenda is to burn it all down. that is the entire guiding principle of the most powerful wing of this caucus. that doesn't seem to be the registering for -- who had the sense -- well, you have to keep the government open, if people want to close the, government it only makes it. weaker why would they want to stop paying the, troops or stop paying the border agents in the coast guard? i don't understand how that makes you stronger, i don't understand what point they're trying to make. >> doesn't it kind of sound like he's an observer, a spectator, not the speaker of the house? the person third and lie to the presidency? my first guest tonight refers to him as the shrinking speaker. it's pretty apt, because he has no control and does not seem to know how to assert. it's the most powerful members in the caucus or taking their case, not from, him but from mar-a-lago. they are not even hiding it. if donald trump posted last night, quote, unless you get everything, shut it. down that's to be exactly what they plan to. do let's be, honest this was all kind of predictable. despite their brief flirtation when they were on the campaign trail with pretending to want to govern on issues like addressing inflation, and lowering gas, prices they're blowing it all up agenda has been there guiding principle in the majority. just consider a few of their crowning achievements over the last few months. they spent countless, i'm talking countless hours, on meaningless resolutions intended to punish their political enemies. like, say censuring democratic congressman adam schiff, what a good use of time. they have been trying to retaliate against federal law enforcement for daring to hold donald trump accountable. they were threatening to defund the justice department, and the fbi. earlier this, month when congress came back from their longer recess with time running out to fund the government, the very first thing kevin riccardi did, under pressure of his right flank was launched a bogus impeachment inquiry into joe biden without a purpose. because this congressman or -- because donald trump told them to. so the connections here? what exactly do they want to impeach him for is really anyone's guess at this point. here we, are just five days from the government shutting down, which will happen huge -- and what's on their agenda this week? well, they are making time in their schedule to hold their first impeachment hearing. just two days before government funds run out. oversight committee -- made it official, in just a few hours ago with the witness list and everything. his committee says republicans are going to finally do what they have tried, and failed to accomplish over the last eight months that they've been looking into. this quote, presenting evidence -- knowledge of and role in his family's international business practices. it sounds a lot like what we've been hearing for months. look, whether mccarthy wants to go along with all of this or not, this impeachment inquiry and government shutdown, it does not really have a choice. without the nile of his party, he won't be speaker. because of, that he seems to be unwilling to tell them. now all of this begs the question, is being speaker so great? especially when members of your own party seem to humiliate you on a daily basis? i'm just wondering. from my vantage, point the man third in line for the presidency has found himself hostage basically to a group of people who have no desire for him to succeed, and no desire for the institution of congress to work. none of this is about different approaches to governing, or policy views. they've literally want to shut down the government. it's about ceasing the role of government altogether. that is the undergo. mister speaker, when you ask the point -- the answer is pretty clear. their agenda is dysfunction. that's the whole point. joining me now is the house speaker congressman nancy pelosi of california. thank you so much for joining me this evening. it's great to see you. >> it's great to see you, congratulations on your new time slot. it's a wonderful show. >> my pleasure to do so, thank you. >> i want to speak to you, you've been in congress for more than three decades, two of those decades in leadership. have you ever seen the house this dysfunctional? >> it's pretty dysfunctional, but all three of the shutdowns we have had had been under republican speakers. last one, the longest one, and the biggest, one in history was on her republican speaker -- president trump who said i take ownership of the shutdown, and now he's encouraging this republican congress to shut down governments. it cost the economy tens of billions of dollars, it says to our men and women in uniform who are the military, or in federal law enforcement, you are not going to get paid. it's as 2 million women and children and our country, who depend on food assistance, you are not going to be eating. the guest goes on and on in terms of what government does. so, again, this is nothing new to them, however right now, with all of that is going on, all of the challenges that our country faces, it is particularly irresponsible. >> it's like a, game you have been through many of these before, as he said under republican leadership. >> all under republican speakers. >> there's five days left. do you think there's a scenario where speaker mccarthy can avoid shutdown? >> i hope so. of all the bad things that are out there, and what they say in, do a shutdown is a very bad thing for the country. they made an agreement when we had the discussion with the president, they had an agreement about lifting the debt ceiling, they came to terms on a budget number. that was an agreement. now they are walking away from the agreement, so not only is it a bad idea, in terms of our country, it's a bad idea about not keeping it -- there is a chance that the senate could get -- a continuing resolution that would keep the government funded in the short term. everybody is looking for solutions. here is that something that could potentially avoid a shutdown in the house? what do you think of that option? >> i have not seen, it it's just. new it is indicative of the old slogan that we always use in the house. not a nine senators are not enough. they have had bipartisan agreement it appeared, and the senate about doing their own continuing resolution and sending it over. it has its parliamentary challenges, but nonetheless, and now they said because -- object, they can't do. that one 99 senators are not. enough one senator holding up over 500 appointments, commission come oceans and the rest, in the military. it's just not. right anyway, to take it back to this, it depends on what it is. we are not just there to vote for anything and the democratic side. we will see where we can find our common ground. we have a responsibility to try to do that. >>, our leader, and we take our lead from him. >> another option is a district politician, or a handful of republicans, not that many could join with democrats, it's not something that is under discussion to avoid? this >> a discharge petition as an option, however an order for it to even be considered, you have to have to have a 30-day period or address, there and a 30 days -- it would be shut down. it's a longer term saying, it won't work unless we have something to keep government open. it's past the end of the fiscal, year which is september 30th. >> lee of or ovens happening this week is the house oversight committee holding its first hearing on the biden impeachment, which they have not outlined our purpose for. it's clear what they're trying to do, here at least to me. they're trying to muddy the, waters make president biden seem corrupt. how do democrats avoid that? or pushback on that, or prevent it from being an. issue >> the factors they had no goods. they have been for months and months and months trying to make some kind of a charge. i don't think they will ever bring it to the floor. they won't have the votes. the remembers and districts that president biden won, not that there are so far president biden, but these voters will say that's just not the right way to go. everybody was on my case in 2007 when we got to the majority, and they wanted us to impeach president bush for the war in a, rock the misrepresentations going, in departing from afghanistan too soon, all of that. if you have a difference of opinion, you just can't be impeaching impeaching, on the other hand, this is a fake distraction as you said. they don't even have the courage to bring it to the floor, i don't think the speaker has to worry about that. >> i mean you've been the speaker, before looking at all of the events of this, week what do you think the history books will say about kevin mccarthy's role as speaker? >> it remains to be. seen he has not had even a full year, much less a full term. i do think it's important for people to know what to the position. is it is the only legislative position mentioned in the constitution of the united states, and by the way it's second in line to president. so it's number two, so it's a highly responsible position, and it also has power. if you decide to use it for the public good, building consensus within the congress, to take to go for, for sustainability. that's why i keep saying, one thing he could do is to take back the republican party. the great party, it's done great things for our country. great leadership overtime. don't let it be turned into a cult, into a thug in my view. this is what is happening. this man is telling them, unless you get everything, nobody gets everything, unless you get everything, shut government down. that should be a testimony itself to the speakership of anybody to be taking guidance like that from the outside. >> several house democrats along with new jersey's governor -- of all called on senator menendez to resign. do you think he should resign? >> i respect their position they are taking. the charges are formidable. if in fact we are going to say that if you're indicted, you should resign, we have a situation in the house. as you know from the state of new york, that that would hold to. right, now sadly because of the challenges that we face, because the skepticism that exists in our country about governance, about this republican party that does not believe in governance, doesn't believe in science, so they want to take down everything in order to give tax breaks to the wealthiest, we've got to stay focused on that, and for that reason it probably would be a good idea if he did not resign. >> do you, this weekend on his failed social media site, donald trump used about the execution of -- this was flush quite shocking to. me what was your reaction to that? >> my reaction is not so much to him, but to the speaker who support him. i respect the differences of opinion that exist in our society, from the beginning of our country. that's what a democracy is about. people have different, views they debates, them you put it before the, public they make a decision, you go forward. but if you engage in language like, that it should be something that would discredit, would eliminates somebody as a prospect for any public office. -- was very courageous, in the military on the battlefield, and in the public arena in the white house. i'm saddened to hear that former president would say that just another argument, why he should have never been in the white house, and should never be there again. twice impeached, once defeated, how many times indicted? it's true. plus, when you buy your first line of mobile, you get a second line free. there are no term contracts or line activation fees. and you can bring your own device. oh, and all on the most reliable 5g mobile network nationwide. wireless that works for you. it's not just possible. today, fulton county judge it's happening. scott mcafee order that the identity of jurors and potential jurors and the georgia election interference case be kept secret until the end of the trial. that means that any video photographs or even drawings of the jurors would be barred. the jurors would only be identified by number. in any filings, and in open. courts that order comes as we await a decision from the judge presiding over the federal election interference case, judge tanya chutkan, on whether or not she will grant special counsel jack smith's request for a limiting gag order against donald trump. that could come tonight anytime. let's be clear about why we are seeing these orders and requests. donald trump has been furiously attacking everyone involved in the case against, him and even some shacks with filed that order, he's been attacking. them he and his allies have -- as election interference, he has repeatedly called jack smith drenched and a thug. his basically -- highly partisan, as well as very biased and unfair. and a few days, ago he suggested that his former top military adviser, general mark milley, who have spoken with prosecutors, should be executed for treasonous acts. let's just pause there for. moments his former military advisor, the chairman of the joint troops, he was suggesting that he should be executed for treason, -- many of these make them public, stripped threats of violence have spiked, there's a connection, the top prosecutors in the four criminal cases against donald trump now require round the clock protection. a texas woman was arrested just last month for threatening to kill judge chutkan if trump is not reelected, and the purported identities -- of the grand jury members have circulated on pro trump message boards. it's not hard to see the cause and effect here. stoking anger has often been a key part of donald trump strategy. we now know, very well what the consequences are. joining me now is my friend legal, eagle on official, counsel andrew weissmann. he's also general counsel at the fbi, and former senior members -- robert mueller's investigation. the judge in fulton county order today that no identifying information of jurors and prospective jurors should be disclosed. that seems fairly obvious considering the threats. here how uncommon, or common is that? >> in our file, case it is fairly. common it does not really need to be triggered by the defendant himself, or herself,, you're gonna be concerned about, interference about press interference, but anybody contacting jurors, here is others an additional reason for exactly, what you said. your concerns about remarkably, the former leader of the free world, is this a step that was taken by judge kaplan in the e. jean carroll assaults, sexual salt and rape case? i'm so it's fairly common, one thing that i'm still concerned about is that although he ordered the, judge that this be sort of an ominous, and we would not find out the, identities it does not mean that the defendant donald trump, and his counsel, no until you still steaming that donald trump will obey the law. that, as we know from fort indictments, it's not a questionable assumption. >> what happens if he releases their? names that's a crazy question to ask, but are the even consequences be to look into the system? for anyone else yes. but i think there's probably just a natural reluctance here, to jail somebody pending trial. or paul manafort for instance, when he coached to witnesses to lie, he was put in jail by a d.c. judge. it is the norm, sam bakeman frayed, in the southern district of new york for financial crimes. much less serious crimes in terms of the importance of democracy, it's in jail pending his trial. >> so, we're also waiting for trump, to respond to the special counsel's gag order request. it's supposed to come, tonight we'll see. talk about the stakes of this back and forth, given trump's behavior, because as a non, lawyer i'm sitting here watch -- make these threats about chairman, and thinking about how this is not a big factor, is it a big? factor >> let's just remember that, the context, wherein there is a motion before one of four judges, who have the criminal cases of donald trump. there is a motion pending by the government say, to something judge, you've got to restrict him some ways. what he is saying about witnesses, and drawers, and george's, and their families. you have to do something. while that motion is pending, as you said we're waiting for the defense brief tonight. he has done a number of, things he has made the statements about the former chair of the joint chiefs of staff, again it's unfathomable that we are sitting here having that conversation. he has been on air today, about possessing a firearm. you and i were on air together when in the d.c., case he said the most important thing is, when you are out on, bail do not commit another crime. it is a crime for somebody who is charged with the felony, charged with a felony to receive a gun. there are pictures on twitter of him holding the gun. >> the city need a receipt? we don't even know, his campaign has come out and said he did not purchase, it >> lets not the law, it's not that you can't buy, gotten the law is that you cannot, -- 9:22 and. it's that you cannot receive a gun, that has traveled in interstate commerce. that means it's traveled across state lines, and a glock has trifled against a, lines but they're not made in south carolina. >> even not, purchasing it he could've violated, >> that happens a lot, there are other parts of the statute that apply to people who are convicted, and they cannot presents a gun. the issue here is not that he would be charged with that separate, offense it's that while this motion is pending, what judge chutkan will have in front of her is not just the statements, but somebody who has flagrantly boasted about doing something. to me, he is really daring the court to do something. it's like a, child except it's much more serious, because it's somebody who's out on bail on 91 felony counts. >> so while we wait for, that's because the next step we get trump's team, their response to the protective, order and jack smith's team can respond, and then we're waiting for the judge. >> so we're waiting for, the judge that's the most important part here, is that a yes or nos to the protective order? >> first, of all let me say thank you for saying that you are looking forward to, it and that you are so looking forward to. i am not looking forward to, it i need the next 23 minutes to continue to prepare, you know may well enough that i'm always pointing at the very last second so, like i have an event on the harris birthday. i am not ready. i need more moments. listen, cassidy hutchinson decided across the rubicon when she decided that she needed to live with herself. when she decided that she could continue to protect the presidents, she had a lawyer who was -- and who was being paid for -- she didn't know how, but it wasn't her, and she did not have money to pay for a lawyer for own choosing who did not have the same perceived conflicts. she realized that she could do that, but she wanted to pass what she calls the mirror, test being able to lock herself in the eye for the rest of her life. as a very young woman confronting that dilemma, she knew that she's likely looking at a very long life ahead, in what she's going to have to live with decisions that she's making by the age of 25. she crossed that rubicon, and now i think she wants people to understand how she did, it and why she didn't. alaska route, this but i can't help but think that she is also telling the story to let other people know that they can be brave to. >> you don't need to be in a safe, states in utah, with mitt romney. you don't need to be protected by a billion dollars in personal assets like mitt romney. his in, fact she was completely broke at the time that she was giving that testimony. she had not paid her rented months on the day that she sat there and that. room she had no family assets, working class kid, she did not have any -- question at all that she did the writing. i think she wants america to about two so other people maybe consider -- i hope people listen and kind of walk across that bridge. one part of her, i wonder what rachel thinks of this. now i have, you before i let you go to do your last preparing, she writes about how alexander battlefield is an inspiration to. her >> 41 who does not, know butterfield is a former nixon aide who testified at the watergate hearings -- in the white house. pretty -- you are a student, a podcaster, a broadcaster of historical parallels. what did you make of that comparison? back in 20, 16 remember he convinced a whole lot of those workers that he alone, trump alone was the person that could bring manufacturing jobs back to forgotten pockets of the country. >> i am going to pay the greatest jobs president that god ever created. remember that. >> i will bring back jobs. you cannot bring back jobs. >> i'm going to bring back our jobs, to ohio. and pennsylvania, and new york, and michigan, and all of america. it will be a victory for jobs, jobs, jobs. we are going to bring our companies back. if i am, elected you won't lose one plant, you have plans coming into this, country you'll have jobs again, >> it was that message you just heard that helped trump -- and cross the midwest, entering the 2016 election. remember, he won michigan by just over 10,000 votes, was caught by roughly 20,000, and pennsylvania by about 30, thousand in each of those crucible, he outperformed her was white voters without, by a margin of 2 to 1. it is empty promises to this group of voters helped propel him to the white house. in this, moments ahead of what we'll see this week, i thought that the story of one jim plant in lordstown ohio might be kind of useful. this plant was one sprawling, both in size, spending more than 100 football, fields and its impact on the community. for over half a century, the gm plant produced millions of vehicles, employees thousands of people in the, community and served as the beating heart of the town. in 2017, still wearing the -- trump spoke just 15 miles down the road from that sprawling gm plans. a group -- in youngstown. in a part of -- that barack obama won by 20 points, and trump phipps flipped in 2016. but he spoke to them, he promised that manufacturing jobs were coming back. >> i'll tell you what, i rode through your beautiful roads coming up from the airport, and i was looking at some of those big wants an incredible job producing factories, and my wife ali maloney a, what happened? i said those jobs of left ohio. they're all coming back. they're all coming back. don't move, don't sell your house, don't sell your house. >> don't, move to inside your house, he told people to stay put. he told them he had their backs. those people listened to him, they trusted him, but by 2019, that -- shut down. thousands of jobs were lost, and an entire community was shattered. a local restaurant owner said he hosted more than 100 going away parties by his how about the, plant watching lifelong friends gather for l round of drinks, a final. photo of others whose husband was -- called the closure traumatizing. a husband and father who was transferred for away hours away from his -- said i miss sleeping in my bed. hold in my, wife holding my, kids hugging my family. what did donald trump do next? did he work on an economic package to rebuild the community? nope. most of his bodies would have her the community. he proposed funding for a number of communities that would've helped people and lordstown. did he show an ounce of empathy or remorse?
