a $200,000 bond. we zls the harsh terms included in trump's agreement, the warning from the judge and the former trump attorney set to surrender in the next 24 hours. and then there were eight. the rnc announcing the gop 2024 candidates qualify to make their case to voters on the debate stage tomorrow. we know who's scooping, but see who made the cut and who's out. plus, president biden vowing to help survivors in hawaii rebuild after deadly wildfires devastated maui. what we're learning about the 800 people still missing as recovery efforts continue. good morning and welcome to "way too early" on this tuesday, august 22nd. i'm in for jonathan lemire. former president donald trump will travel to atlanta on thursday to turn himself in after he and 18 others were indicted in a wide ranging election interference case. frump announced the news himself on social media writing, quote, can you believe it, i'll be going to atlanta, georgia, on thursday to be arrested by radical left district attorney fani willis. the former president will report to the fulton county jail in atlanta for booking. the county sheriff has said there'll be, quote, a hard lock down of the street when he arrives. district attorney fani willis had given all defendants until noon on friday to voluntarily surrender. this is the first time he's been made to pay a cash bond. that is $100,000 higher than other known agreements. trump said on his social media page the amount meant willis, quote, thought i was a flight risk. i'd fly far away to maybe, russia, russia, russia, share a gold domed suite with vladimir never to be seen again. trump's bond agreement includes language not seen in others. the order direct lay states the form president cannot directly intimidate or obstruct the case in other way. john eastman will surebounder today. the constitutional law professor and attorney is charged with assisting the former president and his allies in creating a plan to use fake electors that pledged to make trump the president. eastman's lawyers agreed to a bond of about $100,000. he's been ordered to not speak about the case to any of his codefendants as well. of course eastman and trump are just two of the 19 defendants named in the fulton county indictment. and while the former president will surely be able to make that bond, some of the others accused of trying to obvert democracy in his name may find themselves stuck behind bars. according to "the new york times" trump's former personal attorney, rudy giuliani, is nearing a financial breaking point. the man once known as america's mayor has reportedly racked up more than $3 million in legal bills. "the times" reports giuliani husband repeatedly reached out to trump for help but the former president has so far refused to pay him for the legal work that he did on his behalf. there's also a former georgia republican party official cathy lathem who acted as a fake elector following the 2020 election. she's setup a online fund-raiser with the goal of raising half a million dollars to help pay her legal bills. so far the goal she has raised just under $4,000. then there's jenna ellis who was a senior advisor to trump's 2020 campaign. like giuliani she also reportedly reached out to the president for financial help in the past but was also denied. while trump refuses to help his long time loyalists filing es showed the self-proclaimed billionaire himself has had $21 million in this own legal fees paid for by his supporters. the special counsel is objecting to donald trump's call to push his 2020 election interference trial to 2026. trump's defense lawyers argued they would need years to comb through but trump's defense team say they're exaggerating the burden. smith's team wrote trump's proposal is premised on the notion that lawyers will, quote, individually and manually review discovery material, which is not consistent with modern practices. the special counsel's office had proposed starting jury selection in december. judge tanya chutkan is expected to set a trial date next monday. eight republican presidential candidates, meanwhile, have officially qualified for the party's first primary debate. they are nikki haley, doug burgham, chris christie, ron desantis, mike pence, vivek ramaswamy, and tim scott. the republican national committee said these candidates met the requirements to participate in the debate in milwaukee. donald trump also met the criteria but he's decided to skip the debate. businessman perry jaunsance and miami mayor francis suarez are not on that list though they do claim to have met the party's requirements. johnson criticized the rnc last night writing, quote, the debate process has been corrupted. while trump himself won't be on the debate stage tomorrow, he does have a plan to make his voice heard. sources tell nbc news the former president has already recorded an interview with tucker carlson which will air tomorrow night as counter programming. carlson was fired from fox news earlier this year and has since been posting interviews on it. it's only clear how his sit down with trump will be published. carlson has not responded to nbc's request for comment, and the trump campaign also declined to comment on any possible counter programming. okay, i think you've been having enough of my reading. let's go to our first guest joining us now. national politics reporter for "the washington post," hannah noles. trump is not going to be on the debate stage on wednesday night, but his presence will be there because the candidates going have to navigate around him. how are they going to do it? >> that is a big question. i'm sure they're all preparing for questions about trump, about his indictments. we'll see how much they dodge or use this moment to take a risk. >> what do the candidates need to do to stand out from each other? at the moment none of them has major name recognition. they're all kind of bubbling around. and only desantis is in double digits even. >> it depends on who you are, but if you're one of those candidates mired in the single digits you want to have a that buzzy break out moment. one way to do that is attack. we saw a memo leaked last week from desantis' super pac pointing out the way to get attention is go on the attack. >> desantis has had the argument i'm kind of like trump but i'm electable. but the polling that came out yesterday from nbc news and the des moines register suggests that voters are actually more interested in somebody whose principles they agree with than just the electability argument. does that undermine desantis? if voters are saying you know what, biden he's not that strong after all, he's old, he looks a bit weak. we don't buy the argument it's going to take somebody like desantis to beat him. would you rather go with trump who you actually like and maybe he can beat biden? is that what republican voters are starting to think? >> it's a huge blow to desantis' theory of the skas and kind of like everyone els. all these other candidates have been pitching themselves that i can beat joe biden and we're not sure trump can anymore. >> without trump there is anyone going to tune into this? what kind of ratings are we expecting? >> i don't know about the ratings, but i think republican voters they still want to see a debate. polling shows most republicans think it's important to debate, so i think we'll still see a lot of attention to this. >> it's the clips on social media afterwards. what's the break out moment you think could come out of the this debate that might be surprising? "a," they're not going to support a clean continuing resolution, which means they need a number of policy provisions to get their support. what are those provisions? first off, they want to tackle the doj. house republicans have been claiming that the department of justice is weaponized especially in the wake of these indictments against former president trump. they also want to address border security and as you mentioned those quote-unquote woke policies at the pentagon. it is getting more serious as we get to that september 30th deadline, but washington is a town that runs on the lines. oftentimes you don't see too much movement before that deadline. there's still some time but it's running out. >> you have some reporting on the house freedom caucus who are going to be the linchpins whether this will pass or not pass. >> when you talk about border security you have somebody like chip roy leading the effort on trying to get policies to address security, so trip roy and 14 other texas republicans penned a letter, a dear colleague letter saying we need to have some sort of border provisions in these appropriations bills to get our support. there's also a conversation again about the department of justice. congressman -- a republican congressman has said that he will not support appropriations bills unless funding for the department of justice is slashed. and then you have this conversation about aid for ukraine, support for ukraine. the white house earlier this month unveiled a supplemental request, $40 billion. # 24 billion of that is funding for ukraine. now, it remains to be seen how lawmakers will handle this supplemental. omb director shalanda young said the white house was introducing it to be included in a resolution. but the house freedom caucus said yesterday they're going to support quote-unquote any blank check for ukraine. despite last year there being ukraine supplemental funding in the cr. >> great welcome back for kevin mccarthy when he comes back to congress. he's going to love all of this. briefly, debate tomorrow night, members watching, not watching. what's your sense on how much interest there is in the debate? >> i think there's going to be a lot of interest and especially because we're going to see some members of congress at the debate. some surrogates of former president trump are hoping to be at the debate to vouch for their candidate. of course former president trump is not going to be at the debate. there's also reporting overnight surrogates of candidates not present at the debate will not be allowed to be there. right now former president trump is easily leading with congressional endorsements but there are also some for nikki haley, there's some for tim scott particularly on the senate side. >> and a few for ron desantis too. >> and so i think when you talk about tomorrow night's debate there's going to be some all around the country including a few lawmakers. >> tomorrow it kicks off the election by the way, it's for real with that debate. things really start heating up. still ahead we'll go live to cnbc for an early look what's driving the day on wall street. and u.s. mortgage rates hit their highest point in more than two decades. what it means for prospective home buyers. "way too early" will be right back age is just a number, and mine's unlisted. try boost® high protein with 20 grams of protein for muscle health versus 16 grams in ensure® high protein. boost® high protein. now available in cinnabon® bakery-inspired flavor. learn more at boost.com/tv [stomach growling] it's nothing... sounds like something. ♪when you have nausea, heartburn, indigestion♪ ♪upset stomach, diarrhea♪ pepto bismol coats and soothes for fast relief when you need it most. new hampshire governor chris sununu is out with a new piece in "the new york times" titled" if republicans narrow the field we will beat trump." he writes in this part this. this week republican primary candidates for president will have their chance to make their case before a national audience with or without a donald trump on the debate stage. to win they must break free of mr. trump's drama, step out of his shadow, go on offense, attack and present their case. and then they need to see if they can catch fire this fall. and if they can't, they need to step aside because winnowing down the field of candidates is the single best chance to stop mr. trump. too much is at stake for us to have wishful candidacies. if mr. trump is the republican nominee for president in 2024 republicans will lose up and down the ballot. as governor of the first imine the nation primary state, i will do everything i can to help narrow the field. i plan to the dorse and campaign for the best alternative to mr. trump. as of now it's anyone's for the taking. joining us now republican strategist and msnbc political analyst. nice to have someone on the show with me this morning. this has been the theory of the case, that a big field in 2016 helps donald trump. when dee we start to see that field winnow? when we do get down to a two person race? >> in the op-ed chris sununu suggested christmastime. i think that's too late. he said something great a few months ago. he said it's not when you goat into the race, it's when you get out of the race. and candidates who are not above 5%, 6%, they should be getting out after this first debate, maybe the second. i realize people feel like they have something to contribute, but you know what chris sununu is right. if we don't have serious alternative to donald trump, he is the de facto nominee. and chris sununu knows something else. he knows new hampshire very well, and he knows there's more registered independents than republicans or democrats, which means they can vote in this primary, so they are open to an alternative, and an early blow to trump could be very meaningful. >> but we're also in a position we could well have a split. this polling and i know it's early and voters staent started tuning in that much particularly in new hampshire. you could have somebody come out of iowa who does well, chris kristi gets split and all these second, third place candidates thinks i'm going to stay in a little bit longer. what's going to be the decisive factor that pushes them out? >> it's interesting. you heard an interesting column. what's interesting what's good for these candidates is that donald trump is not on the debate stage on tomorrow night. what that allows them to start talking about not just the issues but to present that there are viable alternatives to donald trump. now, what you asked is what's the crux that starts allowing a breakout? i believe it's not how the candidates are doing against donald trump that will make the difference. it's how donald trump is doing against biden in these polls. if biden starts gaining a 5, 6, 7-point lead over trump, you will then have, you know, potentially good alternatives to donald trump and the electability argument. it takes those two things for someone to really come out and break out against donald trump. the good thing is when you look at the field of candidates, i personally think desantis is gone. he lost this before he entered just by some of the decisions he made. tim scott's the one who watch. he can make the move. he can come into a strong first or second place in iowa and/or new hampshire, and then in september, which is, you know, his home state. so there is room for someone to break out. i think if republicans see it, they will want other candidates to drop out earlier and earlier. >> how much appetite is there amongst donors? and how much are donors going to be paying attention to the debate wednesday night? because we know they're shopping around. we know there's interest in finding somebody else. do you think that's going to be an important sector of the audience on wednesday night at the debate in milwaukee? >> to a certain extent. it's those donors who will fund the super pacs and big money. i don't think people want to start putting money behind a candidates until they see some real potential. >> okay, thank you, susan, for getting up on "way too early" with me. up next we'll go live to cnbc for the morning's top business headlines. >> we're seeing georgia from a legal standpoint and for the future of democracy is centrally important. you do have that future of democracy and the future of voting rights unfolding in my home state. the district court judge on friday temporarily prohibited some of the rules that were passed as part of this sweeping legislation in the wake of the 2020 election down in georgia, which, by the way, again, was declared safe, secure, free and fair, and yet that did not stop the republican-controlled legislature from passing legislation in direct response to the 2020 election under kind of the guise of election integrity, though, again, there was really no evidence that there needed to be a response to claims of voter fraud that were falsely made in that state and across the country that year. >> yeah, and the water thing was crazy. why not give water to people waiting in line? it can be hot in november, and it seemed cruel to not let people have bottles of water handed to them. interesting to see that's been reversed. black georgia voters gave biden a win in 2020, but there's been recent reporting showing some are lukewarm about the party in 2024 more than they felt in the last cycle. is georgia going to stay blue this round? >> that is an open question, and black voter turnout is going to be key to answering that question in 2024. i think that's why you're seeing, you know, groups and even the democratic party investing in georgia earlier than you would normally see, trying to shor constituencies, n particular, labor, trying to reenergize some of the coalitions that delivered victory in georgia in 2020. but, listen, i think, you know, this case unfolding in georgia, so much of this trial really centers on how the former president and his co-defendants really tried to disenfranchise voters, black voters, and discredit election officials, like shay moss and ruby freeman, in an attempt to overthrow the election results. with that on the minds of black voters in georgia and across the country, it'll be interesting to see what the political implications of that are for the voters who see the stakes of people excluding them from our democracy. >> we'll see if the trial starts before the november election, whether it galvanizes everyone or turns everyone off by the system. tell me, in your reporting and what you're hearing, errin, what is it behind the sense, to the extent there is some, of a slight disillusionment of the democratic party amongst black voters and black males at the moment. what are people saying? >> well, you know, i think what voters are telling me is that, you know, again, we're looking at a potential showdown between the same two candidates that we saw in 2020. i think, you know, the same kind of polling we've seen around voter enthusiasm headed into this election also does, to some extent, apply to black voters. black voters are still wanting to see action on issues like voting rights, like police reform, but also on issues like material mortality and voting rights. so, you know, with that kind of work left undone, i think democrats still have a case to make as to, you know, whether they can effectively be a firewall, you know, headed into the next four years and actually deliver on some of those promises that president biden made in addition to the promises he's already delivered on. >> there is still work to be done. editor at large for the non-profit newsroom the 19th and an msnbc contributor, errin hanes, thank you. thank you for getting up "way too early" on this tuesday morning.
