gunned ukrainian soldiers are strapped here, and one commander says his troops have days or hours left to live, adding his unit is outnumbered 10 to 1. he pleaded for an evacuation of 500 wounded soldiers and hundreds of civilians, which includes children who have been sheltering at the plant. officials have agreed to a humanitarian corridor, and witnesses say a small convoy of buses left the city earlier today but officials have no official numbers on the civilians who were able to evacuate, and they are cautious because previous agreements and cease-fires in this region, as you know, have fallen apart. according to ukrainian officials, 11 other cities have been under constant attack in the last 24 hours. all of them in the donbas region, where russian forces are now hammering that area, an area that has already been at war for the last eight years. the biden administration is prepared to announce another round of aid, and an aid package in addition to the 800 support they announced last year, and this new package will include more artillery and tens of thousands of more ammunition, and president biden will meet at the white house with the secretary of defense, the joint chiefs of staff and the combatant commanders. joining me now is nbc news foreign correspondent, ali arouzi, and an msnbc political contributor, helene cooper. what is the latest on the ground, ali? >> reporter: katy, it's a truly appalling situation in mariupol. as you mentioned, there was a convoy of buses trying to get in there, but we just heard from the deputy prime ministers that once again the russians have stopped that convoy of buses go into mariupol to get people out. she says they have not honored their word and made it very difficult for the buses to travel in there and because they are doing whatever they want on the ground there. earlier about several dozen people managed to get out, and those convoy of buses were meant to get 6,000 people out of mariupol, and the buses didn't get in there and they are hoping to get in again tomorrow but the ukrainian authorities said do not trust the russians to honor that once again, and inside mariupol the situation is absolutely horrifying. as you mentioned, they are down to the last handful of fighters in that city. we just heard from somebody in that azov brigade, and now they are making an appeal and saying if a third party can negotiate a safe exit for the troops and the besieged civilians of that city, because it's hopeless after the assault by the russians there. but to be clear, they are still fighting. that third party has not made the negotiate investigation to get out, and they said they will fight until they get out, and if that city falls, that land corridor that you mentioned will be built and putin will be able to sell this as a major victory through state media in russia, and there will be a huge morale blow for the ukrainians that have been trying so hard to defend that city since the beginning of this war. >> courtney, i know the pentagon is watching this closely. what is their assessment? >> that's right. they are watching the new ground offensive in the east. it's not a large-scale offensive, and i think we are all kind of waiting to see what they refer to as shaping operations. what that means is they are basically preparing the battlefield in advance of a larger scale ground movement of russian troops in the east. we know, according to a senior defense official, the russians continue to move more of their battalion tactical groups into ukraine, and just the size and scope here, that's about 82 of these battalion tactical groups inside ukraine. they are roughly 800 to 1,000 individuals, and you can do the math, we are talking upwards in the way of 80,000 russian troops that are there. the belief is that they will most -- if not all of them will focus on the donbas area and the southeastern part of ukraine. one of the things that is sort of a roadblock to this larger scale offensive is mariupol, which ali was just talking about. defense officials are watching closely to see if the ukrainians are able to hold out but there's less optimism as the situation grows more dire and russian troops are in the city. there are about a dozen russian battalion tactical groups down around mariupol, and will those troops be moved north and focus more on the donbas and provide more reinforcement and military power to the russians in that area in the coming offensive. you mentioned the military aid going to ukraine. some of those are how wet surz. they are preparing to send more artillery forward. artillery is going to be one of the major things that we see in this coming offensive. the russians have a tremendous amount of artillery that is expected to be used in the opening, and the u.s. is trying to get ukraine in the fight by giving them counter artillery and some radars so they will be able to detect where russian artillery is coming from and defend against it. >> i want to let everybody know there have been new sanctions announced by the treasury department targeting what the government is calling sanction evaders, so targeting banks and individuals in russia so yet more pressure being put on the russian economy to try and get them to back off. it seems like they are trying to exploit every avenue they can. helene, when courtney is talking about all the aid going in there and all the artillery, $800 million this week, and $800 million last week on top of what has been sent there, and is there an endless supply of supplies to send to ukraine? >> it's not endless, but it's certainly pivotal right now because you are looking at a new kind of fight about to start in the donbas. this is a region where, as courtney said, ukrainians have been fighting for years and they have dug in trenches, they have been -- they have been digging in and preparing for this sort of trench warfare which we are now expecting. the russians coming in over more open fields with their artillery, they will pound that area to the best they can, and then try and send in their tanks and troops, and the ukrainians have an opportunity as far as the pentagon sees it to really get at the russians with the anti-artillery radar. they can hit back because they are dug in, and some of their weaponry is dug in, and they have sort of an advantage because they are in a more defensive position, they are not going to be as exposed as the russians are coming over those open spaces, and i think the expectation is we are about to see a different kind of flight, but it's going to be muddy, messy and long. everybody i have talked to at the pentagon, nobody at this point is ready to remotely write off the ukrainians. one senior official i talked to yesterday mentioned on the mariupol issue, talked about the possibility that russia takes mariupol and then moves those fighters north to the donbas, but he said the second they do that, look to see the ukrainians trying to take back mariupol, so it's -- i think we're in a very, very dynamic situation and, you know, it's going to be the next few weeks will be critical. >> the last images we were looking at were from mariupol, and we saw individual soldiers going out and making their way through areas that frankly look apock tau lip particular. today he announced that russia had successfully launched a new missile that it said could deploy nuclear warheads at hypersonic seeds anywhere in the world and how wit defenses, and i am reading from the paper so i get it right. the intention is to get everybody to think twice before threatening his country. how does the pentagon read that? >> this is, again, the pentagon -- the pentagon official i spoke with today characterized it as sabre rattling. putin did this in february as well, right at the beginning of the invasion. this is the kind of talk that really alarms the biden administration and the united states has taken pains over the last few weeks to de-escalate and respond very carefully every time russian officials and vladimir putin start rattling their nuclear sabres. when you ask this question, katy, you are getting again, at the essence of what has kept the united states and nato countries out of this war, and that is at the end of the day russia has nuclear arms. his nuclear arsenal is in many ways all that vladimir putin has left, given how bismolly his military has behaved. now with his nuclear arsenal, he's taking pains to make sure to remind the world that, you know, there's a reason why nobody wants to go to war with russia. it becomes a question of is this just talk or is he, you know, has he crossed a different line? >> we just saw vladimir putin today and i believe he was talking with a bunch of young people, again, trying to paint this what they are calling special mission in russia as a mission to liberate ukraine. we have all seen the images there and know otherwise. thank you for bringing us that reporting. with me now from ukraine is alexander crabet with the ukrainian news website. what is happening in mariupol right now? it's hard to put it into words, it seems so awful. the soldiers are at a steel plant and say they have days, maybe hours left to live. people are sheltering there. what can you tell us about what is happening there? >> yeah, thanks for your question, katy. this is -- they are living in the shelter in the main corridors on the plant, under the steel plant. the numbers of the troops over there, like, increased in the last 24 hours because ukrainian military, the marines and the azov battalion, they have 500 men from the mariupol port, and they brought them to this steel plant so they can -- so they have more people to fight against russians, but the situation there is really people are losing their hope over there. we still don't -- do not know how many civilians are over there, but we are sure there are men, women, elderly and a lot of children under those steel plant. >> we have seen some images out of there and a number of -- from a number of news agencies, and we're looking at drone video overhead of that steel plant right now, and it is -- it doesn't even look real, frankly. there are also a lot of fighting going on in the east, and in the east it's interesting because there has been fighting going on there now for eight years between russian-backed separatists and ukrainians. now that the russians are focusing more on the east, what is your -- what is the word you are hearing about the ukrainian force's ability to defy the russians? >> so the ukrainian army is well trained and they have the experience to fight at donbas because they have been fighting there since 2014, and yesterday the ukrainian army gained control over a village, and even a small field there, you just cross the road and you are in this city that is occupied since 2014, and ukrainian army regained control over that village, and the destruction from the north from that donetsk provence, and the only one major city over there is left under ukrainian control, and the ukrainian army is repairing those -- ukrainian army is -- have the ability and have the armour to fight the russians over there, and they know the place and they know everything and they know every corner to fight the russians in. >> alexander, thank you very much for joining us today and thank you for all the reporting you are doing on the ground for your outlet, for your country of ukraine. we appreciate it. >> thank you for having me. i appreciate your reporting over there for the whole world. >> we have been watching. it's been awful. this friday, richard engel reports as they fight back in the face of war and complete destruction. watch "on assignment with richard engel." still ahead, you don't need it on a plane but you may need it on a bus? >> yeah, the answer for new yorkers is they are not entirely sure. they are pretty confused. i have spent the last couple of days, really, since the florida ruling came down when i was in an airport taking public transportation around the new york area and trying to get a sense of what exactly the rules are and what people think of them. the answer is pretty complicated. for ubers nationwide, they say masks are optional for drivers as well as riders, but when i got in an uber, they said they were not optional, and masks are still required today, and the driver didn't know about it, and masks are required in new york subways, but not on amtrak trains and not required for the new jersey transit system but you are required if you are in a new york-state governed station, and you can have a scenario where you are on a train in new jersey and you get to penn station and you put your mask back on and it's optional when you are in the train hall. if that's not confusing, in laguardia and jfk, it's mandatory to wear a mask when in the terminal, and airlines say it's optional, and if i didn't make it confusing enough for you, listen to what new yorkers have to say about it. >> i think you should wear it on a train, being everybody is so close to each other, i mean, just for safety reasons. >> is it confusing to be a new yorker when it comes to mask rule? >> definitely. some businesses don't require mask, and airlines don't require a mask, and new newark they don't, and new york they do, and i believe in the mask and i think it's a helpful way to protect yourself, but it's very confusing. i bet next week it's going to change again. >> reporter: so among people we have spoken to, about 50% say they are glad to have the option of wearing a mask in most public transportation places are optional, and what we are seeing is a whole lot of confusion because when you have these patch-work rules, people don't entirely know what the rules are and it's very hard for them to follow them, so on the ferry today, masks are mandatory but only half were wearing them. >> and then is there a point in the tunnel when you get to take it off, or on the river from new york to new jersey, is there a point where you take it off? >> yeah. basically in the tunnel. >> the cdc is looking into making its recommendation -- the biden administration wants the cdc to decide whether or not this is necessary any longer before doj goes forward with an appeal of this if they are going to do that. what is your take on whether the masks -- i know there's a ba.2 variant are necessary right now given the cases may be rising about the the hospitalizations are not? >> i think that's the dilemma. we know the cases are going to go up especially with the more contagious variant, and hospitalizations are falling and that's the metric we have been aiming for, to make this a tamer virus, one that doesn't lead to hospitals getting overwhelmed. i think the hospital mandate was really justified. we do many more things high risks that don't require a mask, and it's paradoxical to me, and even when they extended a week or so ago i thought that was controversial and this is set to expire in early may anyway, so there's a lot of consternation over something that will change in two weeks. >> what about those immunocompromised, we have heard about them and kids that need to get a vaccine and can't wear a mask? >> for the immunocompromised, it's important to know that one-way masks work, and that's what i take care of people with tuberculosis, i wear a one-way mask and whether it's in transportation or a shopping mall or grocery store, one-way masking could work. for smaller children, i think you have to look at it on the base factors for severe disease in a child, and there are some that are too young to wear a mask and transportation is one small part of life and there are other situations where they have to navigate whether or not who is wearing a mask around them at the mall or daycare center, and clearly on airplanes, based on filtration, it's probably one of the lower risks for a person versus somebody being in a grocery store, so we have to navigate it based on individual risk tall runs and factors for severe disease remember, this is the only place masks are required anymore. >> i speak to you and i get one answer and you are level headed about it, and i talk to other doctors and they say it's extremely risky, and one-way masking, yes, it works but how effective is it, and it would be hard watching this at home to figure out who to listen to? >> it's highly unusual to see an out and out fight between one of the most powerful and important companies in the state. >> political insiders say the battle is really over florida's new parental rights and education law. which opponents, including some vocal disney employees, call the don't say gala. disney's ceo initially noncommittal saying after it was signed into law, our goal as a company -- >> this is not based on the demands of california corporate executives. >> disney's special self governance allows the company to provide many of its own services, like fire departments, road construction and building and zoning. >> today i want to share with you some of our ideas for disney world. >> without reedy creek, historians believe it's unlikely uncle walt would have realized his dream in florida. >> it's political, the governor and republicans in the legislature, at least many of them seem to be trying to punish disney. >> disney is about twice the size of manhattan, and for another reference, the size of san francisco. we reached out to the counties that currently disney sits on to see if they could take on the responsibilities if the florida legislature decides to eliminate the reedy creek district, and it's hypothetical so essentially we got no comment. >> that's pretty big for one little part of florida. and florida rejected math textbooks from next year's state curriculum, and some include -- yes, you heard that right. nobody has seen the allegedly problematic books because state officials are not showing anyone. why? what is the real motivation here? joining me, mark caputo, who always has the best and most enviable backdrops when he comes to us with these stories. i want to get the nitty gritty of what this math book is from you first, and then i want to talk about larger politics. what is going on with these textbooks? >> yeah, you got me. it was good friday. they sent out a press release that, hey, we ban books, and then i called the people we know at the department of education and said, why did you ban them? we can't tell you. what? we are in a situation when they say the publishers have a right to appeal, so we can't look at the specifics as to why they were banned? no. the background conversation, an official i spoke to, and i will not name the person, but most of the banned books here or rejected books that were not accepted to be part of the curriculum, because they had common core elements, and not the critical race theory, and i said, wait, you are the ones that sent out the press release that said critical race theory, not us. >> is this something that is going to back fire? 41% of our math books, floridians are going to say, show us the problem? >> i don't know. we're seeing -- the state -- the politicians who are running the state are led by ron desantis and are testing the boundaries of what we used to think were normal in politics, referencing your prior segment, the idea that a republican-led legislate and republic governor would remove a taxing status that has been around for 54 years, we didn't think that would happen and it did happen and so this happen something not that far out of the realm of possibilities. >> maybe you don't know this off the top of your head, but if they strip disney of their status, what would that mean with taxes? >> good question. that's something they are talking about the floors of the senate and house right now, and it's legislation that has been introduced all of a sudden and now staff and media has to become experts in the special districts and how that works, and reedy creek is at least a billion in debt service, where if this goes away, and the taxpayers would have to eat that and look at a tax increase, and on the other hand there are properties there that could be taxed at perhaps higher rates and maybe make up for it. it's a thorny mess. if you open up a box of snakes, it would go everywhere. one legislature that wrote this law being passed right now, it gives them 15 months to decide if they really want to do this, or 13 months, i should say. reedy creek would disappear, and disney's special district would disappear in june of 2023, and that gives them a lot of time to decide do we really want to do this do we really want to break this and buy it under the pottery barn rules. they will find that out. and it puts disney on notice, a legislature that appears unafraid and a governor definitely unafraid of going after them, so they may have to make nice, and there could be a court fight as well, and these are something we have not seen in a long time. >> the pottery barn rule, i never heard anybody describe it as such. and coming up, julian assange, some want him extradited to the united states and it's one step closer to hospitaling. what will assange face here? and then marjorie taylor greene will have to answer questions about the insurrection under oath. we will have a member of the legal team suing to keep her out of office. ♪♪ why don't you do cool spins? (supervisor) ♪ i want to lock it all up in my pocket. ♪ (ceo) ♪ i want today. ♪ ♪ i want tomorrow. ♪ (warehouse worker) ♪ presents and prizes and sweets and surprises... ♪ (driver) ♪ of all shapes and sizes. ♪ (dispatch) ♪ i want it noooooow! ♪ (vo) t-mobile for business has 5g that's ready right now. a federal judge will hear arguments on friday in a lawsuit filed by a group of georgia voters that want congresswoman marjorie taylor greene barred from running for re-election. they believe she should be disqualified because she supported the january 6th rioters. a lawsuit is fundamentally anti-democratic. joining me is board chair and senior legal adviser for free speech for people, the group representing the georgia voters in this case. good to have you. the georgia voters you are representing, why did they file the lawsuit? voting against somebody is one thing, and wholesale disqualifying them from office is another? >> it certainly is, and it's a rare remedy, and it's one the constitution only provides in the case of an official that has taken an oath to defend the constitution who thereafter engaged in insurrection. this is not about the political choice whether to vote her in or out, this is about the constitution disqualifying her, and our clients, the ones that brought this challenge are seeking to enforce that provision of the constitution, section 3 of the 14th amendment and uphold our constitutional democracy. >> part of the lawsuit -- or the lawsuit does argue the congresswoman helped facilitate the rioters in part with her rhetoric around the results of the election, and how do you say her speech amounts to a call to action? >> well, she literally called on her supporters to go to washington, d.c. on january 6th at a point in time when it was very clear it was reported in the media that violence was likely to occur at the capitol. in fact, she had a long history of which supporters were well aware of advocating violence against her political opponents, and she specifically called that day, january 6th, as being their 1776 moment, which was well understood among followers of marjorie taylor greene to be a call of exactly what 1776 was, which was a revolution using violence, in this case not a revolution against a foreign government but an insurrection against our own government, exactly what the constitution says you are disqualified if you participate in. >> do you plan on deposing her? >> yes, the hearing on friday is scheduled before a state administrative law judge who under georgia procedure is tasked with making the first determination of whether the challenged candidate is constitutionally qualified. we have issued a subpoena for marjorie taylor greene's appearance and her lawyer has attempted to block the subpoena, and the administrative law judge rejected that attempt and she's required to appear on friday, and our expectation is we will be deposing her then. >> the georgia primary is on may 24th. >> our hope is it will be settled by then, at least the initial round of the admin straightive law judges determination, and there could be appeals pending, but once we hope that the administrative law judge makes the determination that she engaged in the insurrection, the secretary of state can then exclude her from the ballot. >> the ballots have have. so not all ballots have. and so there's other ways that that can be addressed. it can be addressed with a notice to the voters specifying she's been disqualified and that votes for her will be discounted. and if absolutely necessary a new election could be held. this is -- these are obviously fairly drastic steps, but we're dealing with a drastic issue here, which is a member of congress who engaged in insurrection based on the allegations in our complaint against the constitution, against the country, and against our government seeking re-election. and so if there are some procedural hurdles to implementing that constitutional provision, that is certainly something that the state should be prepared to bear. >> ben cummins, we will be watching. thank you so much for joining us. >> thank you, katy, for having me. pleasure. >> and coming up next an nbc news exclusive. what prince harry said about his secret meeting with his grandmother the queen. gunned ukrainian soldiers are strapped here, and one commander says his troops have days or hours left to live, adding his unit is outnumbered 10 to 1. he pleaded for an evacuation of 500 wounded soldiers and hundreds of civilians, which includes children who have been sheltering at the plant. officials have agreed to a humanitarian corridor, and witnesses say a small convoy of buses left the city earlier today but officials have no official numbers on the civilians who were able to evacuate, and they are cautious because previous agreements and cease-fires in this region, as you know, have fallen apart. according to ukrainian officials, 11 other cities have been under constant attack in the last 24 hours. all of them in the donbas region, where russian forces are now hammering that area, an area that has already been at war for the last eight years. the biden administration is prepared to announce another round of aid, and an aid package in addition to the 800 support they announced last year, and this new package will include more artillery and tens of thousands of more ammunition, and president biden will meet at the white house with the secretary of defense, the joint chiefs of staff and the combatant commanders. joining me now is nbc news foreign correspondent, ali arouzi, and an msnbc political contributor, helene cooper. what is the latest on the ground, ali? >> reporter: katy, it's a truly appalling situation in mariupol. as you mentioned, there was a convoy of buses trying to get in there, but we just heard from the deputy prime ministers that once again the russians have stopped that convoy of buses go into mariupol to get people out. she says they have not honored their word and made it very difficult for the buses to travel in there and because they are doing whatever they want on the ground there. earlier about several dozen people managed to get out, and those convoy of buses were meant to get 6,000 people out of mariupol, and the buses didn't get in there and they are hoping to get in again tomorrow but the ukrainian authorities said do not trust the russians to honor that once again, and inside mariupol the situation is absolutely horrifying. as you mentioned, they are down to the last handful of fighters in that city. we just heard from somebody in that azov brigade, and now they are making an appeal and saying if a third party can negotiate a safe exit for the troops and the besieged civilians of that city, because it's hopeless after the assault by the russians there. but to be clear, they are still fighting. that third party has not made the negotiate investigation to get out, and they said they will fight until they get out, and if that city falls, that land corridor that you mentioned will be built and putin will be able to sell this as a major victory through state media in russia, and there will be a huge morale blow for the ukrainians that have been trying so hard to defend that city since the beginning of this war. >> courtney, i know the pentagon is watching this closely. what is their assessment? >> that's right. they are watching the new ground offensive in the east. it's not a large-scale offensive, and i think we are all kind of waiting to see what they refer to as shaping operations. what that means is they are basically preparing the battlefield in advance of a larger scale ground movement of russian troops in the east. we know, according to a senior defense official, the russians continue to move more of their battalion tactical groups into ukraine, and just the size and scope here, that's about 82 of these battalion tactical groups inside ukraine. they are roughly 800 to 1,000 individuals, and you can do the math, we are talking upwards in the way of 80,000 russian troops that are there. the belief is that they will most -- if not all of them will focus on the donbas area and the southeastern part of ukraine. one of the things that is sort of a roadblock to this larger scale offensive is mariupol, which ali was just talking about. defense officials are watching closely to see if the ukrainians are able to hold out but there's less optimism as the situation grows more dire and russian troops are in the city. there are about a dozen russian battalion tactical groups down around mariupol, and will those troops be moved north and focus more on the donbas and provide more reinforcement and military power to the russians in that area in the coming offensive. you mentioned the military aid going to ukraine. some of those are how wet surz. they are preparing to send more artillery forward. artillery is going to be one of the major things that we see in this coming offensive. the russians have a tremendous amount of artillery that is expected to be used in the opening, and the u.s. is trying to get ukraine in the fight by giving them counter artillery and some radars so they will be able to detect where russian artillery is coming from and defend against it. >> i want to let everybody know there have been new sanctions announced by the treasury department targeting what the government is calling sanction evaders, so targeting banks and individuals in russia so yet more pressure being put on the russian economy to try and get them to back off. it seems like they are trying to exploit every avenue they can. helene, when courtney is talking about all the aid going in there and all the artillery, $800 million this week, and $800 million last week on top of what has been sent there, and is there an endless supply of supplies to send to ukraine? >> it's not endless, but it's certainly pivotal right now because you are looking at a new kind of fight about to start in the donbas. this is a region where, as courtney said, ukrainians have been fighting for years and they have dug in trenches, they have been -- they have been digging in and preparing for this sort of trench warfare which we are now expecting. the russians coming in over more open fields with their artillery, they will pound that area to the best they can, and then try and send in their tanks and troops, and the ukrainians have an opportunity as far as the pentagon sees it to really get at the russians with the anti-artillery radar. they can hit back because they are dug in, and some of their weaponry is dug in, and they have sort of an advantage because they are in a more defensive position, they are not going to be as exposed as the russians are coming over those open spaces, and i think the expectation is we are about to see a different kind of flight, but it's going to be muddy, messy and long. everybody i have talked to at the pentagon, nobody at this point is ready to remotely write off the ukrainians. one senior official i talked to yesterday mentioned on the mariupol issue, talked about the possibility that russia takes mariupol and then moves those fighters north to the donbas, but he said the second they do that, look to see the ukrainians trying to take back mariupol, so it's -- i think we're in a very, very dynamic situation and, you know, it's going to be the next few weeks will be critical. >> the last images we were looking at were from mariupol, and we saw individual soldiers going out and making their way through areas that frankly look apock tau lip particular. today he announced that russia had successfully launched a new missile that it said could deploy nuclear warheads at hypersonic seeds anywhere in the world and how wit defenses, and i am reading from the paper so i get it right. the intention is to get everybody to think twice before threatening his country. how does the pentagon read that? >> this is, again, the pentagon -- the pentagon official i spoke with today characterized it as sabre rattling. putin did this in february as well, right at the beginning of the invasion. this is the kind of talk that really alarms the biden administration and the united states has taken pains over the last few weeks to de-escalate and respond very carefully every time russian officials and vladimir putin start rattling their nuclear sabres. when you ask this question, katy, you are getting again, at the essence of what has kept the united states and nato countries out of this war, and that is at the end of the day russia has nuclear arms. his nuclear arsenal is in many ways all that vladimir putin has left, given how bismolly his military has behaved. now with his nuclear arsenal, he's taking pains to make sure to remind the world that, you know, there's a reason why nobody wants to go to war with russia. it becomes a question of is this just talk or is he, you know, has he crossed a different line? >> we just saw vladimir putin today and i believe he was talking with a bunch of young people, again, trying to paint this what they are calling special mission in russia as a mission to liberate ukraine. we have all seen the images there and know otherwise. thank you for bringing us that reporting. with me now from ukraine is alexander crabet with the ukrainian news website. what is happening in mariupol right now? it's hard to put it into words, it seems so awful. the soldiers are at a steel plant and say they have days, maybe hours left to live. people are sheltering there. what can you tell us about what is happening there? >> yeah, thanks for your question, katy. this is -- they are living in the shelter in the main corridors on the plant, under the steel plant. the numbers of the troops over there, like, increased in the last 24 hours because ukrainian military, the marines and the azov battalion, they have 500 men from the mariupol port, and they brought them to this steel plant so they can -- so they have more people to fight against russians, but the situation there is really people are losing their hope over there. we still don't -- do not know how many civilians are over there, but we are sure there are men, women, elderly and a lot of children under those steel plant. >> we have seen some images out of there and a number of -- from a number of news agencies, and we're looking at drone video overhead of that steel plant right now, and it is -- it doesn't even look real, frankly. there are also a lot of fighting going on in the east, and in the east it's interesting because there has been fighting going on there now for eight years between russian-backed separatists and ukrainians. now that the russians are focusing more on the east, what is your -- what is the word you are hearing about the ukrainian force's ability to defy the russians? >> so the ukrainian army is well trained and they have the experience to fight at donbas because they have been fighting there since 2014, and yesterday the ukrainian army gained control over a village, and even a small field there, you just cross the road and you are in this city that is occupied since 2014, and ukrainian army regained control over that village, and the destruction from the north from that donetsk provence, and the only one major city over there is left under ukrainian control, and the ukrainian army is repairing those -- ukrainian army is -- have the ability and have the armour to fight the russians over there, and they know the place and they know everything and they know every corner to fight the russians in. >> alexander, thank you very much for joining us today and thank you for all the reporting you are doing on the ground for your outlet, for your country of ukraine. we appreciate it. >> thank you for having me. i appreciate your reporting over there for the whole world. >> we have been watching. it's been awful. this friday, richard engel reports as they fight back in the face of war and complete destruction. watch "on assignment with richard engel." still ahead, you don't need it on a plane but you may need it on a bus? >> yeah, the answer for new yorkers is they are not entirely sure. they are pretty confused. i have spent the last couple of days, really, since the florida ruling came down when i was in an airport taking public transportation around the new york area and trying to get a sense of what exactly the rules are and what people think of them. the answer is pretty complicated. for ubers nationwide, they say masks are optional for drivers as well as riders, but when i got in an uber, they said they were not optional, and masks are still required today, and the driver didn't know about it, and masks are required in new york subways, but not on amtrak trains and not required for the new jersey transit system but you are required if you are in a new york-state governed station, and you can have a scenario where you are on a train in new jersey and you get to penn station and you put your mask back on and it's optional when you are in the train hall. if that's not confusing, in laguardia and jfk, it's mandatory to wear a mask when in the terminal, and airlines say it's optional, and if i didn't make it confusing enough for you, listen to what new yorkers have to say about it. >> i think you should wear it on a train, being everybody is so close to each other, i mean, just for safety reasons. >> is it confusing to be a new yorker when it comes to mask rule? >> definitely. some businesses don't require mask, and airlines don't require a mask, and new newark they don't, and new york they do, and i believe in the mask and i think it's a helpful way to protect yourself, but it's very confusing. i bet next week it's going to change again. >> reporter: so among people we have spoken to, about 50% say they are glad to have the option of wearing a mask in most public transportation places are optional, and what we are seeing is a whole lot of confusion because when you have these patch-work rules, people don't entirely know what the rules are and it's very hard for them to follow them, so on the ferry today, masks are mandatory but only half were wearing them. >> and then is there a point in the tunnel when you get to take it off, or on the river from new york to new jersey, is there a point where you take it off? >> yeah. basically in the tunnel. >> the cdc is looking into making its recommendation -- the biden administration wants the cdc to decide whether or not this is necessary any longer before doj goes forward with an appeal of this if they are going to do that. what is your take on whether the masks -- i know there's a ba.2 variant are necessary right now given the cases may be rising about the the hospitalizations are not? >> i think that's the dilemma. we know the cases are going to go up especially with the more contagious variant, and hospitalizations are falling and that's the metric we have been aiming for, to make this a tamer virus, one that doesn't lead to hospitals getting overwhelmed. i think the hospital mandate was really justified. we do many more things high risks that don't require a mask, and it's paradoxical to me, and even when they extended a week or so ago i thought that was controversial and this is set to expire in early may anyway, so there's a lot of consternation over something that will change in two weeks. >> what about those immunocompromised, we have heard about them and kids that need to get a vaccine and can't wear a mask? >> for the immunocompromised, it's important to know that one-way masks work, and that's what i take care of people with tuberculosis, i wear a one-way mask and whether it's in transportation or a shopping mall or grocery store, one-way masking could work. for smaller children, i think you have to look at it on the base factors for severe disease in a child, and there are some that are too young to wear a mask and transportation is one small part of life and there are other situations where they have to navigate whether or not who is wearing a mask around them at the mall or daycare center, and clearly on airplanes, based on filtration, it's probably one of the lower risks for a person versus somebody being in a grocery store, so we have to navigate it based on individual risk tall runs and factors for severe disease remember, this is the only place masks are required anymore. >> i speak to you and i get one answer and you are level headed about it, and i talk to other doctors and they say it's extremely risky, and one-way masking, yes, it works but how effective is it, and it would be hard watching this at home to figure out who to listen to? >> it's highly unusual to see an out and out fight between one of the most powerful and important companies in the state. >> political insiders say the battle is really over florida's new parental rights and education law. which opponents, including some vocal disney employees, call the don't say gala. disney's ceo initially noncommittal saying after it was signed into law, our goal as a company -- >> this is not based on the demands of california corporate executives. >> disney's special self governance allows the company to provide many of its own services, like fire departments, road construction and building and zoning. >> today i want to share with you some of our ideas for disney world. >> without reedy creek, historians believe it's unlikely uncle walt would have realized his dream in florida. >> it's political, the governor and republicans in the legislature, at least many of them seem to be trying to punish disney. >> disney is about twice the size of manhattan, and for another reference, the size of san francisco. we reached out to the counties that currently disney sits on to see if they could take on the responsibilities if the florida legislature decides to eliminate the reedy creek district, and it's hypothetical so essentially we got no comment. >> that's pretty big for one little part of florida. and florida rejected math textbooks from next year's state curriculum, and some include -- yes, you heard that right. nobody has seen the allegedly problematic books because state officials are not showing anyone. why? what is the real motivation here? joining me, mark caputo, who always has the best and most enviable backdrops when he comes to us with these stories. i want to get the nitty gritty of what this math book is from you first, and then i want to talk about larger politics. what is going on with these textbooks? >> yeah, you got me. it was good friday. they sent out a press release that, hey, we ban books, and then i called the people we know at the department of education and said, why did you ban them? we can't tell you. what? we are in a situation when they say the publishers have a right to appeal, so we can't look at the specifics as to why they were banned? no. the background conversation, an official i spoke to, and i will not name the person, but most of the banned books here or rejected books that were not accepted to be part of the curriculum, because they had common core elements, and not the critical race theory, and i said, wait, you are the ones that sent out the press release that said critical race theory, not us. >> is this something that is going to back fire? 41% of our math books, floridians are going to say, show us the problem? >> i don't know. we're seeing -- the state -- the politicians who are running the state are led by ron desantis and are testing the boundaries of what we used to think were normal in politics, referencing your prior segment, the idea that a republican-led legislate and republic governor would remove a taxing status that has been around for 54 years, we didn't think that would happen and it did happen and so this happen something not that far out of the realm of possibilities. >> maybe you don't know this off the top of your head, but if they strip disney of their status, what would that mean with taxes? >> good question. that's something they are talking about the floors of the senate and house right now, and it's legislation that has been introduced all of a sudden and now staff and media has to become experts in the special districts and how that works, and reedy creek is at least a billion in debt service, where if this goes away, and the taxpayers would have to eat that and look at a tax increase, and on the other hand there are properties there that could be taxed at perhaps higher rates and maybe make up for it. it's a thorny mess. if you open up a box of snakes, it would go everywhere. one legislature that wrote this law being passed right now, it gives them 15 months to decide if they really want to do this, or 13 months, i should say. reedy creek would disappear, and disney's special district would disappear in june of 2023, and that gives them a lot of time to decide do we really want to do this do we really want to break this and buy it under the pottery barn rules. they will find that out. and it puts disney on notice, a legislature that appears unafraid and a governor definitely unafraid of going after them, so they may have to make nice, and there could be a court fight as well, and these are something we have not seen in a long time. >> the pottery barn rule, i never heard anybody describe it as such. and coming up, julian assange, some want him extradited to the united states and it's one step closer to hospitaling. what will assange face here? and then marjorie taylor greene will have to answer questions about the insurrection under oath. we will have a member of the legal team suing to keep her out of office. ♪♪ why don't you do cool spins? (supervisor) ♪ i want to lock it all up in my pocket. ♪ (ceo) ♪ i want today. ♪ ♪ i want tomorrow. ♪ (warehouse worker) ♪ presents and prizes and sweets and surprises... ♪ (driver) ♪ of all shapes and sizes. ♪ (dispatch) ♪ i want it noooooow! ♪ (vo) t-mobile for business has 5g that's ready right now. a federal judge will hear arguments on friday in a lawsuit filed by a group of georgia voters that want congresswoman marjorie taylor greene barred from running for re-election. they believe she should be disqualified because she supported the january 6th rioters. a lawsuit is fundamentally anti-democratic. joining me is board chair and senior legal adviser for free speech for people, the group representing the georgia voters in this case. good to have you. the georgia voters you are representing, why did they file the lawsuit? voting against somebody is one thing, and wholesale disqualifying them from office is another? >> it certainly is, and it's a rare remedy, and it's one the constitution only provides in the case of an official that has taken an oath to defend the constitution who thereafter engaged in insurrection. this is not about the political choice whether to vote her in or out, this is about the constitution disqualifying her, and our clients, the ones that brought this challenge are seeking to enforce that provision of the constitution, section 3 of the 14th amendment and uphold our constitutional democracy. >> part of the lawsuit -- or the lawsuit does argue the congresswoman helped facilitate the rioters in part with her rhetoric around the results of the election, and how do you say her speech amounts to a call to action? >> well, she literally called on her supporters to go to washington, d.c. on january 6th at a point in time when it was very clear it was reported in the media that violence was likely to occur at the capitol. in fact, she had a long history of which supporters were well aware of advocating violence against her political opponents, and she specifically called that day, january 6th, as being their 1776 moment, which was well understood among followers of marjorie taylor greene to be a call of exactly what 1776 was, which was a revolution using violence, in this case not a revolution against a foreign government but an insurrection against our own government, exactly what the constitution says you are disqualified if you participate in. >> do you plan on deposing her? >> yes, the hearing on friday is scheduled before a state administrative law judge who under georgia procedure is tasked with making the first determination of whether the challenged candidate is constitutionally qualified. we have issued a subpoena for marjorie taylor greene's appearance and her lawyer has attempted to block the subpoena, and the administrative law judge rejected that attempt and she's required to appear on friday, and our expectation is we will be deposing her then. >> the georgia primary is on may 24th. >> our hope is it will be settled by then, at least the initial round of the admin straightive law judges determination, and there could be appeals pending, but once we hope that the administrative law judge makes the determination that she engaged in the insurrection, the secretary of state can then exclude her from the ballot. >> the ballots have have. so not all ballots have. and so there's other ways that that can be addressed. it can be addressed with a notice to the voters specifying she's been disqualified and that votes for her will be discounted. and if absolutely necessary a new election could be held. this is -- these are obviously fairly drastic steps, but we're dealing with a drastic issue here, which is a member of congress who engaged in insurrection based on the allegations in our complaint against the constitution, against the country, and against our government seeking re-election. and so if there are some procedural hurdles to implementing that constitutional provision, that is certainly something that the state should be prepared to bear. >> ben cummins, we will be watching. thank you so much for joining us. >> thank you, katy, for having me. pleasure. >> and coming up next an nbc news exclusive. what prince harry said about his secret meeting with his grandmother the queen.
