but people will talk about it. because that's crazy. and it's just the rare thing. at least, it ought to be a very rare thing. but for house republican leader kevin mccarthy, it must feel like it happens all the time to him. in his time as a republican leader in the house of representatives, it has happened three times in the past five years already. and now, it looks like it might happen to him a fourth time. it's just not that often that a sitting member of congress gets indicted on multiple, federal charges. you know, while they are serving in congress. for port kevin mccarthy, not the leader of the house republicans, he keeps having to deal with this over and over again. first, it was republican congressman kissed colin's, multiple felony charges for insider trading and corruption, all the stuff. then it was republican congressman, duncan hunter. multiple federal charges. and you know, it's funny, with cullen and hunter, before they were both hit with multiple felony charges while serving in congress, which is crazy, those two had only ever shared the spotlight before for this reason. they were the first two members of congress to endorse donald trump running for president. back in 2016, neither of them made it through trump's one term in office before they were both arrested, indicted for multiple federal felonies, convicted, and sentenced to prison. kevin mccarthy having to deal with that in his conference. two of those guys. that happened to two of them. i mean, that was a rare thing. that was like a blue moon on your birthday. and i should also mention, republican voters are amazing. both of those republican congressman went up for reelection while they were under indictment. while they were awaiting trial on federal felony counts for which they would both ultimately be convicted. in both of those cases, republican voters reelected them. while they were under indictment at a awaiting trial. imagine being in the house republican leadership, when you've got two of your incumbents refusing to resign, running for reelection while they are under federal indictment and then they win reelection. so they're back in congress while they're dealing with their criminal defense lawyers and getting ready to serve their federal prison time. it's like, not the way that you imagine your time in public service. having to deal with that. among two of your members at the same time. members of congress to get in trouble. there are ethics scandals and scandal scandals among them all the time. but it is really rare for real felony criminal charges to be filed against a currently serving member. right? it's really rare for a currently serving member of congress to be arrested. amazing that that happened twice to kevin mccarthy since he has been in leadership for the house republicans. but then it happened again. in october, nebraska congresswoman jeff form and very, was indicted on multiple felony corruption charges. just this past october, imagine being kevin mccarthy and getting, that seriously? again? how many times is this going to happen. however jeff 14 vary of nebraska just this week announced that he is going to run for reelection. even while he is under federal indictment and awaiting trial on multiple felony counts. i mean, hey worked for congressman colin and congressman duncan hunter. they reelected him while he was awaiting trial to. why not jeff fortenberry. that said, donald trump is no longer president. so, the endgame here is less certain. after duncan, hunter and chris colors were convicted and sentenced to long person terms, president donald trump pardoned each of them. if republican congressman jeff fortenberry is also convicted like collins and hunter work, jeff fortenberry will have no haze in the hole. there will be no donald trump to pardon him. so if he is convicted, republican leader will look forward to the awkward dance of this serving republican member prepping for his prison term. and they'll have him resign. it has become a regular part of kevin mccarthy's job by. now three times in just the last five years this has happened. we and now, again, it looks like it will be happening to him again. which is honestly like getting hitting by lightning while you're getting hit by lightning on a blue moon on your birthday. but this is kevin mccarthy's life. the great florida political reporter works for nbc news now, quite a coup for nbc news to have landed him. there is no one like him in florida, political journalism today. and today, mr. caputo is the sole line on nbc news. i should mention, the legendary nbc justice correspondent contributed reporting to this as well. and if you want just a little peek behind the curtain here as to how those of us sort of in the nbc news family sort of read scoops from our own shop like this, you should know, like i said, mark caputo is unparalleled reporter in terms of florida politics. but pete williams being a contributing reported on this as well, pete williams is the emperor of the kingdom of understatement. when everybody else has their hair on fire going on in the criminal justice in the court, it is pete william who's got the saucer who brings to not just and makes everybody take a breath. so you put mark caputo on the byline from florida. and you put pete williams, mr. come down everybody, as contributing reporting and frankly you do not expect a lead as red-hot as this one from nbc news today. dateline, orlando florida, quote, congressman matt graces its girlfriend testified today before a federal grand jury investigating him for sex crimes a major development that suggests the u.s. department of justice may be moving closer to indicting congressman gaetz. the ex girlfriend whose name is being withheld to respect her privacy, has been in talks for months with prosecutors about an immunity deal. under a possible deal, she would avoid prosecution for obstruction of justice in return for testifying in the investigation into whether gaetz, in 2017, had sex with the 17-year-old female for money. and weather months later he and others violated a federal law prohibiting people from transporting others across state lines to engage in prostitution. gaetz has not been charged with the crime. he has denied all accusations. the attorney for gaetz ex girlfriend, declined comment about the case once the today when he was spotted by an nbc news reporter entering the federal courthouse in orlando with his client. the department of justice spokesman declined comment. gaetz did not respond to requests to the common. but legal sources were familiar with the case say that congressman gaetz is being investigated for three distinct crimes, sex trafficking a minor, violating the men act, which prohibits taking women across state lines for prostitution, and obstructing justice. so, again, that was reported today just after noon eastern time today by reporter mark caputo at nbc news. and i don't know how house republican leader kevin mccarthy state was going up to that point. but having to deal, already, with three different republican members of the house being charged with multiple felony charges while they were serving in congress, now to get that news breaking at lunchtime today, can you imagine if he has to deal with the fourth one? i imagine that was a despotic moment for republican leader, kevin mccarthy, today. right? you can just imagine. i would be a flannel wall at the next republican meeting. could you guys please, stop with the crime? just for a little while? just for a hot minute? trump is not here to keep you all out of prison anymore. enough with the felony you guys. it pause. save me. so the day was already not going great for the house republican leader, kevin mccarthy today, but then 4:00 this afternoon, it got worse. when the january six investigation posted this letter to kevin mccarthy himself. it was a letter inviting him to please provide information to the investigation. quote, dear leader mccarthy, we right to request your voluntary cooperation with our investigation on a range of critical topics, including your conversations with president trump before, during, and after the violent january 6th attack. you have acknowledged, speaking directly with the former president while the violence was underway on january six. this information bears directly on president trump's state of mind during the january 6th attack as the violence was underway. the select committee is aware that, notwithstanding the understandable violence that day, you nevertheless agreed to support and continued objections from electoral vote. late in the evening of january six and into the morning of january 7th, the select committee wishes to question you regarding communications teammate had with president trump. president trump's legal team as well and representative jim jordan and others at the time on that topic. congressman jim jordan, really? quote, it appears that you may also have discussed with president trump the potential that he would face a censure revolution, impeachment, or removal from office under the 25th amendment. it also appears that you may have identified other possible options for president trump, including his immediate resignation from office. related, lead the select committee is concerned about potential for continued violence after january six provoked by president trump's false claims that the election was stolen. the committee is aware of communications among white house staff and president trump's supporters regarding the potential for further violence. for example, and this is new today, fox news host laura ingraham texted white house chief of staff mark meadows on january 12th 2021. quote, remarks on cameras discouraging protests at state capitals especially with weapons will be well advised given how hot the situation is. again, that takes reportedly from a fox news host to the white house chief of staff. with the committee continues, quote, during the same time period, you shared this concern about the presidents stolen election claims with your local news organization. saying, quote, it's raising the ability for greater violence. the letter that goes on to ask congressman kevin mccarthy to meet with the investigators, the first week of february. they also quote back to him a statement he made to a local news station in california just a couple of weeks ago. indicating the response that he would speak to the investigation, he told that local news source, quote, i have been very public i wouldn't hide from anything. that said, just tonight, literally just in the past few minutes, it has been handed to me since i started the segment, it has just come out. kevin mccarthy has just put out this statement saying that he will not cooperate with the january six investigation. he says, in part, quote as a representative and the leader of the minority party, it is with neither regret nor satisfaction that i have concluded to not participate with this select committee's abuse of power that stains this institution today. so, we saw shall see. the lead of the january 6th investigation, chairman bennie thompson, said today that he actually expects that kevin mccarthy will agreed to provide information. he said that they don't anticipate even having to subpoena him. now kevin mccarthy has come out and said that he is not going to cooperate. we shall see how this resolves. the question of whether or not members of congress, let alone leaders in congress can be subpoenaed by this committee appears to be settled as a constitutional matter. it appears to be uncontroversial as a black letter matter in terms of constitutional law. the problem is that it's never been done before. and anytime a new president like that is set, a lot of people are reluctant to go there. and nobody quite knows how the fight will happen. but this is the third republican member of congress that has been asked, voluntarily, to provide information who has said no. or who has indicated that they won't. for scott perry, the second was the before mentioned congressman jim jordan from ohio, and at the house republican leader himself. so many people involved in the investigation, even those who have just said no, even others who have been subpoenaed have invoked their fifth amendment right against self incrimination. they have otherwise just refused subpoenas, refused to provide information. so it's interesting to see how it will develop with these republican members of congress to. we did learn today that one of the 4000 people, roughly, who served as white house press secretary under trump, she was press secretary at the week trump administration when everything went pear shaped. she spoke both for the campaign and for the white house after the 2020 election. she personally made multiple false claims about the election to the american people. we learned today that miss mcenany testified. it was behind closed doors, so we don't know what was said. but we do know that she showed up to testify. but here is something that i am watching more and more closely each day. by the end of this week, it will be a month exactly since congress sent to the u.s. justice department a criminal referral recommending federal prosecution of trump's white house chief of staff mark meadows,. we owe they recommending that he be prosecuted for criminal content. he will not comply with compulsory records that were for the january six investigation. the january six investigation recommended prosecution for the same reason. for stephen bannon. trump advisor steve bannon to trust defy. in this case it took the u.s. defense three weeks -- to obtain the indictment that they obtained against him. it's been longer than that already for meadows. it's been longer than that already that the u.s. prosecutors in d.c. have made this referral to trump house of staff -- so far we've heard nothing about what the justice department is going to do. saying that, it is increasingly on my mind. it's because, for the last few days here, we've been reporting on emerging evidence. that in not one, but two, but three, but four, but five. in at least five states, republicans had forged documents. according to the electors states from these five states, they put these documents forward as if they were the duly elected electors to their college states, when in fact they were not. these five states had biden win, so they sent these people there like they were the electors. it was wisconsin, georgia, arizona at least filing fake dad -- who are gonna cast the states electoral college votes for trump. in the last few days here, thanks to our reporting for nicholas that politico dot com, and it's a watchdog group from america, we have been able to obtain and show you all five documents from the republicans in those five states. crucially, what we've notice is that there have been an instance of these five different groups in the five states coincidentally at the same time. they just happen to do the same thing. after looking at these local documents from these five states, that republican sent into these five states, the documents match each other exactly. same font, same spacing, same exact wording. because of that, maybe it all proved to be a coincidence, it does seem to be a coordinated effort. in this way it's like someone gave a template to these republicans in these five states. this is how they should create these forged documents. the whole reason we're on to any of this is because it appears that this is something the january 6th investigation is looking into. where making their lines of inquiry the best that we can. but as such, look at the mark meadows connection. i mean, what i'm about to show you, this doesn't say that the effort to coordinate these's efforts in five states came from the trump white house, but if you look at the contempt report that the january six investigation created about mark meadows it does seem to indicate that he was involved in this. this is from the contempt referral on mark meadows, the select committee seeks information from mr. meadows in the following. mr. meadows received text messages and emails regretting -- to send alternate slates of electors to congress. a plan, which one member of congress acknowledged was highly controversial. to which mr. meadows responded, i love it. mr. meadows responded to a similar message by saying, we are, and another message saying, we have a team on it. this is also from the latter that the january six investigation sent to mark meadows's lawyer about a month ago. when they were fighting about his cooperation. just before he was -- by the justice department. quote, mr. meadows has also produced documents that you apparently agree are relevant and are not protected by any privilege at all. those documents include, a november 7th 2020 email discussing the appointment of alternate slates of electors as part of a direct and collateral attack after the election. so, again, we have learned recently that one of the things these guys did to try to falsify the election results and keep trump in power, one of the things they did, is they got republicans in multiple states to create and file forged paperwork. pretending to be the real electors from states that biden actually run. we see from the documents from the united states that they actually match. we see that this must have been some coordinated effort. but somehow, some of these republicans in the states incidentally -- they sign their names to these forged documents, they may have opened themselves individually to forgery charges. or other forgery charges as a state crime -- we know from the january six investigation that trump house chief of staff, mark meadows, with somehow involved in multiple communications of such effort. he said we have a team on it, that we're doing it, that we loved it. and we know that the justice department is currently waving the part of a prosecution against him. in part, his refusal to morning yesterday. this woman gives it a couple of good wax and then walks off. here is the damage that she did, we got this from the coma county democrats. as you can see, she does not smash through the glass door but it becomes pretty queloz. lord knows with this is about. she's carrying a shovel, maybe it was a terrible gardening dispute. maybe she was mad about a parking spice, or maybe she thought it looked at her funny. or maybe it was not political really motivated. the sheriff said i would like to hope that it was a random act that was not directed towards us specifically. but if it was directed at us specifically, then the people responsible need to see the methods are sitting about living in a society. democrats in that part of texas specifically, have been having some attacks, and vandalism. if you remember, right before the 2021 election, some -- they tried to run a bus off the road. it was the bus carrying biden staff. one of the trump vehicles actually steered into and drove into the vehicle. that whole scary episode happen on a stretch of i-35 in austin, which is right near coma county. some of them who tried to run them off the road was from a -- they were from what they call a new broncos train. the headquarters of the travis county democratic party headquarters was vandalized a few hours later. it was because of that, they discovered a new security factor at there -- if you remember, this incident at the time last fall. this was the early hours of september 29th where a man was caught breaking the headquarters for the democratic party in austin. he put a motel of cocktail through the glass it tried to smoke. then the man threw a firework inside that threw off an explosion. in addition to that explosion, he left them a threatening note that said basically the democrats could have all the blue states. one thing they can't have is texas. consider this a warning. a few days after we figured that footage there, a suspect was arrested on federal arson charges. the man has been out on 20 $500 bond with an ankle monitor. his fate has been in the hands of federal prosecutors in texas. will this week, the federal prosecutors have reached a plea deal with the guy, he pleaded guilty to the arson charge. they say well there pleas to see a guy comes to it, there are disappointed that is part of this plea deal, prosecutors are only asking for the minimum sentence on the arson charge which is 5 to 60 years. this is literally the legal minimum to asked for. they could ask the coat to pose a greater sentence by law. the main question we're left with is why the government didn't pursue a terrorism classification for the charge, which the government said could've increased the government that -- this was a case involving a bomber caught on video tape, repeatedly coming to our offices at least three times throwing a molotov cocktail that caused at least 25,000 dollar damage to our office and manifesto containing threats. if that is not terrorism, wet? is from the u.s. attorney's office from the district electors, generally the court decides the applicable guideline range in the applicability for any enhancements or just minutes for sentencing. we cannot comments at this time. -- firebombing the democratic headquarters. he's not bound by the prosecutor's recommendation. whether or not the prosecutor thinks that this is a terror ridge charge, the judge can hand down whatever they think is appropriate at the sentencing in a couple of months. in the u.s. attorney's office at the -- of course a part of the u.s. justice department just this week decided that they were announcing the a prosecution -- doj, they say that they needed. because the number of fbi agents into sophisticated meant stick violence, has more than doubled since the spring of 2020. well clearly, in texas, that is one of the places they are grappling with the frontline implications of what that means. and what that means in very very practical terms. joining us now is katie nolin, she is chair of the democratic party. mr. -- thank you for joining us i appreciate you coming back. >> thank you for bringing light to this issue. >> let me just ask you if i've gotten on any of that the wrong way around, or if i've missed anything important of what has unfolded in this case affecting your office on your party and what's happened with this. >> at this point, we've experienced up to six different attacks. whether it be my stuff, whether be our office, neighboring parties both houston and often were attack within a short period of time back in 2020. and just yesterday, they was a series where some of those previous attacks, like the bus incident, i was actually there. i was there to receive the bus. and i can tell you the reaction from authorities in regards to the severity of the situation was very concerning to us. and so, the formulation or the announcements of domestic terrorism tax force is going to be very important. because it's long overdue from our experience. >> when you say that you were concerned about the law enforcement reaction to the bus attack, i will say, just as an observer from outside of the state looking into the public reporting on that, what's felt worrying about that incident that happened around the biden harris campaign bus was the 9-1-1 call transcripts and recordings that we were later able to access in which the police seem to not care. in which the police seem to be denying the importance of the incident and refusing to engage even as the bus was slowed nearly to stopping on the interstate even but one of the cars was actually hit by one of the trump supporters vehicle. it did seem like law enforcement wanted nothing to do with this. do you feel like law enforcement, as a general matter, not just with that one incident, has been under reacting to these kinds of, apparently, politically motivated violence targeting democrats? >> what we saw on january six, what we saw in texas, the repeated trends, unfortunately there are those law enforcement to think, it's just a woman with a shovel. it's a gardening issue. or it just somebody who's doing the car on i-35, what's the problem? they don't see that violent. they don't see those threatening or intimidating. and i think that's the heart of the issue. each of these acts, especially if the acts where our office was firebombed, and what we're seeing in the sentencing guidelines from the u.s. attorney's office, is that there is a lack of concern. or at least it seems, from our experience, a lack of concern. because of these peoples and confidence, we are not going to take it serious. we are going to laugh at all. when in reality, it is that 1 million dollars of damage and property destruction and the intent to intimidate -- how is that not terrorism? how can this not be taken seriously? and at one point are they going to start waking up? i mean, i am excited that the doj is finally going to start taking this seriously because, does someone have to die? does someone have to get hurt? does somebody actually have to get run off on the road in a car wreck for this to be terrorism or for this to be real? because, the intimidation is real. >> katie naranjo it showed the texas democratic party. i told you last time that you are, here i'd love for you to stay and talk to us more as this case press, citing the medical examiner. top doctor, hospitals are overflowing admit unprecedented virus surge. head over to portland maine, here's the portland press herald, government will activate 169 more guard troops to help hospitals. and then you see the second story at the bottom of the page, on the front lines, battle fatigue sets in. describing themselves as the busiest we've ever been during the pandemic. means our stress. just which people would get vaccinated. the omicron wave is spreading quickly to more and more places across the country. it is causing, very, very rapid increases both in cases and hospitalization. and that is all terrible news. there is a glimmer of good news admit these huge overwhelming surges for. we mentioned earlier, this, week first reports out of new york city. new york city of course is the first big american city to be hit by the omicron wave. we talked earlier this week above first reports that cases and hospitalizations have started to slow down in the rise. started potentially to plateau or even to climb. that trend is still holding in new york. and now, we have similar news from one of the other major cities to first get hit hard by omicron. this is the headline today from w b you are in boston. quote, unambiguously goodness. sharp decline in covid waste water levels in boston area. now, we talked before on how cities like boston have used wastewater data to track the spread of covid in realtime. look at this graph here today. this is the amount of covid, basically, that they are detecting in the city of boston using wastewater data. again, this is not reflecting test results. this is not reflecting individual people's positive or negative tests. this is just how much covid is in the wastewater in the cities catchment area. and the rise has been so steep, it's almost hard to tell. but if you look closely, look at the right side of the screen there. you can see booker start to sharply bend down. boston's npr station wbur, interviewed the person looking at the wastewater. he said, when i refresh the website inside, i literally punched the air and let out a who'd because there was something i had been hoping for. it's unambiguously good news. is that recent trend we are seeing in boston? those recent reports from new york. are they reasons to punch the air. and are they reason to feel hopeful about what is to come? and how soon? joining us now is doctor ashish jha. i really appreciate you being here. >> what is your reaction on this? >> i think it's really good. news >> this has been a leading indicator for the entire bag that. mick i look at it probably every few. days and what it does, it tends to proceed case counts by about a week. so if you see wastewater infection numbers rising. you will see that in the case reports coming out of the department of health in about five, seven days later. this is a very sharp decline. it is down about 30 40%. it really looks like the wave is crushing in massachusetts. and i expect cases are falling in the next few days. in epidemiological terms. and tell me if this is the thing that is too complicated to explain to someone without a degree, but i don't have a degree in this kind of stuff, in ideological terms is the sharpest of that drop explained by the same factors that created the sharpness of the rise. meaning, is a curve that rises that steeply always gonna come down that steeply? or could we be looking at something where it went up really fasten the kind is gonna be slow? >> it's a fabulous question, including in south africa we saw a sharp decline. it's not clear if that's gonna happen in this population. we need to determine, in wet populations is it -- we are expecting a relatively quick decline, actually hoping that we're gonna see a relatively quick decline. we're seeing that new york city, we're seeing that in washington d.c., i hope this is more evidence we're seeing it boston and obviously want to see it more across the country. >> and as we see it in new york, as we see it in, boston and d.c., those are three cities that if we see -- on a scale not large enough for it to be big enough or an individual state. but as we see this in an individual pattern, should communities or states that are further down the timeline in terms of when omicron decided to crash over them, should they use that data in terms of planning for the kinds of efforts they can make to take care of staff, to keep those hospitals from crashing, keep the health care system running, has the brunt of the wave hits them? what i mean is, they know that it's gonna be a terrible way but of fast one, if they can make distinctive efforts based on that knowledge, do you think that they should be confident and making those
