plan. >> it is doable in a bipartisan way. take that victory. and then, let's go do we know they are not going to go to the human infrastructure because of the adjustments of the tax code. i have known that from day one. but we can still go there you the process knowing we will probably have to go to reconciliation. and then, do what we can afford to do. >> so, that is where manchin's red lines began and didn't stop there. as manchin accused house democrats of holding the bipartisan infrastructure bill hostage, he held countless meetings with the president, progressive caucus, and democratic leadership in an effort to ham ourt an agreement on build back better. on november 19th, the house finally passed the build back better bill with assurances that it would get quick consideration in a path to get through the senate. including, from manchin. >> i feel very good about this. um, you know, there was a framework that was agreed to. the vast majority of this bill is preconferenced with senators manchin and sinema. we are going to get this done and we are going to get it done before christmas, hopefully in the first weeks of december. >> as we know now, that did not happen. as manchin pulled out issue, after issue he opotioned in the bill from paid family leave to inflation concerns. still, majority leader chuck schumer was holding out for a vote by christmas. president biden made a last-ditch effort this week, talking with manchin, and even speaker pelosi said friday that she was confident that there would be a final agreement between the president and manchin. >> and i have confidence that joe manchin will understand. we will find the agreement that is there to be made. but make no mistake, joe biden is in charge. >> so, despite all this, manchin ultimately chose to not talk to anyone at the white house before his announcement today. staffer 30 minutes before the hit with fox news did communicate the plans tos administration but manchin, himself, reportedly refused a call with officials to talk it over. >> it's real. it's harming every west virginian. it's making difficult for them to continue to go to their jobs, the cost of gasoline, the cost of groceries, the cost of utility bills. all these things are hitting in every aspect of their life. and you -- and you start looking at then -- then you have the debt that we are carrying at $29 trillion. you have, also, the geopolitical unprotest that we have. you have the covid the covid variant. i can't vote for it and i cannot vote to continue with this piece of legislation. i just can't. i have tried everything humanly possible. i can't get there. and you're done? >> this is -- this is a no? >> this is a no on this legislation. i have tried everything i know to do. >> that is how a bill filled with democratic priorities on childcare, climate change, on healthcare, finally died not with a bang but with a simple no from one senator. one democratic senator. joining me now with her reaction to all of this, democratic gone congress woman debbie wasserman schultz of florida. congresswoman, thank you zbroirning us on this. it is good to see you. >> you too, yasmin. >> obviously, it's incredibly -- incredibly disappointing that joe manchin has -- i don't know -- i guess, the only impression i can leave you with is that he hasn't been negotiating in good faith or at least what appears that he hasn't been negotiating in good faith. um, on the other hand, though, you know, with the legislative experience that i have going back to even before the affordable care act, i look at this development more like a pothole than a brick wall. i mean, if we go back to the debate all the way through the ten months or so that we were considering and negotiating over the affordable care act, there were countless times that it was left for dead. countless times that colleagues on one major issue or another said no more, i'm done. and what i heard joe manchin say today is that he is a no on this legislation. but i know the commitment i made years ago was i was going to vote to put as much healthcare reform on barack obama's desk. and that is the same commitment i have today. i am going to put as much of the build back better act on joe biden's desk. and so, to me, we should continue negotiating. um, i don't know that we that want to make sure we can lower prescription drug costs for seniors which i know we need in florida and i am sure they need it in west virginia. if we can make sure we can have childcare be affordable and don't have to have parents choose between going to work and childcare which i know is important in florida and west virginia. then, let's try to make sure we can continue to negotiate. let's find what can get a majority? and send that to joe biden's desk. it's the 50 yard line, dwrasz i can't see yasmin. >> i found it interesting, right, that the senator said he can't go back to his constituents and say he voted yes for build back better knowing how it is going to affect things in his eyes. but when you look at the state of west virginia we have right now and the child poverty they are dealing with, that is startingling to me. the number four state where food stamps are used most. percentage of households receiving food stamps are 21.8%. one in five we have children estimated to live in poverty. 93% of children are eligible for the ctc payments tied for the highest in the country, congresswoman. >> well, it's really inexplicable if you can find -- i can't find a state that would be more in need of the benefits of the build back better act than west virginia. i mean, we need to make sure that -- that we have healthcare that healthcare costs lower. we have to make sure we have investments that are going to, like the child tax credit, that will continue so that we can continue to cut child poverty in half. but -- but look. this is -- this is a situation where, you know, the way the legislative process works, it ain't over until the gavel bangs and the congress is done. and so, we need to continue to have discussions and negotiate. i'm for making sure we put a package together that can get a majority of -- of both houses because that's what's going to improve people's lives. and by the way, yasmin, you know, if joe manchin is referring to inflation and -- and he often cites the thinktank pen wharton that issued a report like 48 hours ago that said this plan, the build back better act, would have very imlittle impact on inflation. >> democratic congresswoman of florida, thank you congresswoman. it's good to see you. want to bring my panel. democratic strategist and msnbc political analyst. nicholas wu. and tara set fire mire. resident scholar at the uva center for politics. welcome all guys, appreciate you joining me on this incredible news day to say the least. juanita, let me start with you on this one and i want to kind of start with this idea of conflict of interest when it comes to joe manchin. we know, right, there was climate change legislation in build back better. and if we take a look at reporting, um, from a few months ago talking about his interest in the coal industry, let me read it for you. manchin has holdings valued at between 1,000,005 million in intersystems inc., according to his most recent financial disclosure form, that covers 2020 activity and last year he made more than $491,000 from his holdings in this company. that is more than twice his annual salary of $174,000 from the senate. could this be driving, juanita, you think his decision to vote a big no on the current legislation? >> go figure. millionaire manchin doesn't want to undermine his own earnings by putting in more restrictions related to coal and that was a big part of the clean energy program included in the build back better act that he opposed, right? this is what people need to keep in mind when -- when he says he can't explain it to west virginianss, i'm pretty sure he can't explain it to his family and share holders who also benefit from those coal earnings. he is not talking about as you mentioned, 20% of children living in poverty. he is not talk about those families who live on food stamps to be able to provide food for their families. he is talking to other special interests and that's what -- what really irks me about him in saying no today is that this is not something that fully aligns with him saying he's been negotiating good faith this entire time, right? like, this is what those representatives in in the progressive caucus warned us against and i am sure none of them take pleasure in being right about their concerns for not trusting him. but he has shown his allegiance lies with special interests, not with the people of this country, no less the people of west virginia who are struggling right now. >> nicholas, talk to me about your reporting when it comes to back and forth or lack thereof between the senate and white house. we know they met on tuesday. we know the white house felt optimistic about what came out of that meeting, especially according to that lengthy statement from the white house, after we heard from senator manchin. and we know 30 minutes before his appearance on fox news, they were given a heads up. what else do you know? >> well, what we are seeing today is almost a blindsiding in some ways of aides and lawmakers about manchin's position here. for months and months, yesser has talked about some objectives here about inflation. but he can't put his foot down specifically on opposing legislation and then to come out and specifically say that today, no, that was the final nail in the coffin at least for this iteration of build back better. and that's -- that is really what caught the white house off guard here and then that leads to such a fiery statement there white house press secretary jen psaki. um, jen psaki for reneging on what they saw as this promise to members of congress he would support build back better. >> tara, let me play a little bit of senator sanders on cnn earlier today. his reaction. >> i hope that we will bring a strong bill to the floor of the senate as soon as we can, and let mr. manchin explain to the people of west virginia why he doesn't have the guts to stand up to powerful special interests. >> so you want to vote on it no matter what even -- >> absolutely, absolutely. the american people have got to understand what is at stake. we are dealing with mr. manchin for month after month after month. but if he doesn't have the courage to do the right thing for the working families of west virginia and america, let him vote no in front of the whole world. >> listen. so that -- that's one strategy. we have heard of other strategies, obviously, even on this program in the last hour or so. what do you make of that? >> well, i think that is a losing strategy. i mean, it sounds great rhetorically. however, the american people are not paying attention to who votes no on what and when. most people have no idea what is even in the build back better bill, which is part of the problem to begin with. so it sounds great as a political challenge, does not work politically. all people will see is that a vote was brought to the floor and defeated and it will be a big defeat for the biden administration. so, with all due respect to senator sanders, i think that is a terrible political decision to do if they were to do it but i don't think they will. the other thing about joe manchin you have to understand is, yes, that may be true that he has, um, financial interests in the coal industry. but west virginia has the largest coal jobs in the country. the largest amount of coal jobs in the country. the coal industry is incredibly powerful because it is one of the driving economic factors in creating jobs in that state. so, of course, as the senator from west virginia, he is going to be partial to the needs of the coal industry. so, you have to take that into consideration also. and recent polling shows that he is very popular in west virginia. he is over 60% approval righting in the state and over 60% of the people in west virginia support his position against build back better. so in this instance, joe manchin is doing a better job messaging why he is against build back better in its current form than the administration is doing in convincing people why he needs to vote for it. so, joe biden needs to demonstrate that he has a little bit more -- i think a little bit more humph behind his words here. everybody loves uncle joe but he needs to use the power of the presidency to demonstrate there are consequences if you go against what the white house's agenda is. i don't think joe manchin or sinema really fears what the -- what the retribution will be if they don't go along with some type of compromise here. >> what could the consequences -- what -- what does humph look like? what kind of consequences could there be? >> right. >> so we can see this in past history with other presidents. you can see what johnson did to get civil rights passed. you can see what obama did in order to get obama care passed. there are federal judge, there are jobs in those states. federal contracting. there is also campaign money. when it is time to support their campaigns, you need to know that you have the backing of the party behind you. and now, manchin's not up again until 2024, which is a little bit why he is set citing back not worried about it. but sinema is up for re-election sooner than that and so we need to find ways, the old-school ways of politics, the stick part of it, to get them back fwh line because obviously the party unity singing from the sim hymnal, that is not working hear. >> i got to say though, tara, i'm not sure politics works that way, anymore. i think we have just so changed dramatically that even, you know, the threat of not having your party behind you for a re-election, i don't know if that is really a threat anymore. especially inside -- >> republicans. >> yeah. >> go ahead, juanita. >> i i was going to say republicans are a different story because they all actually do fear trump. they all fear what him backing one of their primary challengers could yield for them and so that's why they fall in line and let's be real, they kiss the ring and sold their sole seouls long ago. but it also begs the question. >> the system is formatted in such a way someone who represents a state as one of the least populous states in the country can hold sway over legislation that would impact people across the country. that is something that i think people are starting to ask about these structural changes. and how we can get this done because manchin is showing he is not up for it and, yasmin, i tweeted earlier that is this his big stunt so that he can say he is leaving the democratic party? is this his big stunt to try to get all that heat and that pressure that we know is coming to him right now so that he can say i am not welcome here? i think we all need to keep our eyes out for what his next move is going to be even as negotiations continue. >> nicholas, talk to me about that. any reporting on -- i know there was one point where there was some reporting on the fact that senator manchin had some private conversations that he was going to declare himself an independent and obviously, he came out and said that's absolutely not true. i think he may have even used an expletive or something to -- to negate that statement. any report ongoing the fact that senator man dhin is wanting to jump ship here? >> everything that senator manchin said about that topic, he has said the reports he would leave the democratic party for all intents and purposes, hogwash. he talks about being a democrat. he talks about being an old-school democrat, for that matter. but for -- he -- you know, even mcconnell was asked about this fairly recently and said that he didn't think that manchin would be leaving the democratic party and coming over to his side. >> i love how mcconnell is asked about it. like mcconnell would know. sorry, tara. what did you say? >> it's possible. we are going to pursue doggedly everything to the ends of the earth and i that includes and we don't like necessarily having to go here but that includes members of congress. >> let's talk about this and specifically the legal implications. harry litman, once again. harry, thanks for stick shticking with us. we appreciate it. so, ali alexander saying in a since-deleted video that he worked with gosar, biggs, and brooks, to attempt to use congress -- congress's january 6th session certifying biden's victory as a chance to pressure lawmakers to overturn the electoral results. saying quote, we four schemed up to put maximum pressure on congress -- scheme being the important word here -- while they were voting. this is what he said in the video. the panel hasn't formally requested testimony from any of the gop lawmakers yet but has continued to ask witnesses about gosar, biggs, and brooks as well, and representative scott perry, who helped push a strategy to help department of justice promote the fraud claims. is it just, maror harry, a matter of time here before they call these folks? >> you know, i think so. so that channel has been very well developed again from the organizers to the members of congress. and this week, the channel from the members of congress to meadows and, therefore, trump was developed and it was kind of a thunderbolt when liz cheney announced all these things. now, there is, to date, everyone's assumed that merrick garland and department of justice wants no part of this. but there is a statute that is down the middle applicable here. there are some very high fa luting ones that are very serious, some minor ones. but it says if you impede an official proceeding, that is a felony subject to 20 years. people have tried to argue congress's certification wasn't an official proceeding but i don't think that will fly. indeed, a trump judge, just this week, held that it doesn't fly. so, i think they are telegraphing pretty strongly they are going to involve them. and then, once they find a strong case and they've as much as developed it already for 1512, they can make a criminal referral pretty easily. and then what does merrick garland do? he probably wishes it never came to him but you can't just ignore congress's saying, did these guys impede an official proceeding? you've got to give it a hard look. >> so -- so, let's talk mark meadows here for a moment because feels as if he is a senator of all this. we now know all the tengts text messages exchanged between fox news hosts and mark meadows as well. we know text messages from don jr. during the january 6th insurrection. let me raeld for you the text message from jim jordan to mark meadows on january 6th. on january 6th, 2021, vice president mike pence is as president of the senate should call out electoral votes he believes as unconstitutional as no electoral votes at all in accordance with guidance from founding father alexander hamilton and judicial precedence. will mark meadows, harry, be held accountable? because he seems like he is at the center of all this. >> i mean, you will be hearing a lot about alexander hamilton because what corrupt means here is unlawfully but did they want to impede? no doubt about it. and did they know it was unlawful? that's where the action will be. but i expect the committee will certainly be calling out, you know, gosar and jordan and perry and if they give meadows a pass, it would only be because he's already sort of in the mau of the department of justice for the criminal contempt charges. so -- and he is the chief of staff, after all. that makes harder executive privilege issues. so i think he is in probability terms, yasmin, not top of the charts. but i think these six members of congress better be getting lawyers. >> so here is the thing. "new york times" reporting basically that these republicans -- they are very adept at running out the clock. of avoiding testimony as we have seen so far. there is a hope inside the republican party, especially amongst these individuals, like mark meadows, they can kind of fight this thing all the way until november 2022. hopefully, republicans take back con congress and then the whole thing will be done for. is that -- is that a reality that could actually happen? >> i don't think so. it is a little early to try to go into a stall game because once they do refer to the dement department of justice, if they do, that process remains even if things change in november of 2022. so, i don't think they can run out the clock so long that they can't -- that it -- it's in the committee's hands, whether to do a criminal referral. and their -- their planning, you know, big hearings early in the year. they can do it if they want. there are -- there are other strategies to try to delay parts of it. but if the committee wants to bring them up and send it over to doj, they'll be ample time. >> harry litman, thank you as always. happy holidays. thanks for sticking with us. let's bring back my panel. juanita tolliver and tara setmayer. thank you, ladies, for sticking with me as well. juanita, let me start with you on this one and let's talk mitch mcconnell once again. we end on mcconnell. let's start on mcconnell and what he has said the piskt he has made essentially when it comes to this investigation which had a lot of folks scratching their heads wondering where is this coming from? saying this. it was a horrendous event and think what they are seeking to find out is something the public needs to know. this is something he said to spectrum news. what do you make, juanita, of this pivot we are seeing from the senator? >> i am stuck on the fact that now he thinks it's something the public needs to know after whipping republican votes against a bicameral commission, right? like he impeded that process and stopped it. he also didn't find it horrendous enough to convict trump during his second impeachment hearing about this. so i'm really confused about where this is coming from mitch mcconnell, especially when he is someone who knows how to say no comment when he doesn't want to talk about something. so i feel like this could be mcconnell being petty, trying to take digs at trump knowing that trump is coming for his leadership role if republicans were to retake the senate in the midterms. and this could be him trying to get trump out of the way. or even validating the select committee to the point that, when they do have their wall-to-wall coverage of public hearings next year, when they do release their findings, when they do release any type of referrals for criminal charges or federal charges against trump and potentially other members of the republican party, he backs it up and he validates it. so, i think that mcconnell might be playing a long game here based on potential outcomes of the select committee. >> here is the thing, tara. mcconnell knows everything already. it is not like he didn't know any of this. he knows what happened in the lead-up to january 6th. he knows about these text-message exchanges. we know what he thought on the senate floor when he made his fiery, passionate speech following the insurrection and then made an about face days later during the impeachment trial of the former president. let me read for you from something that hayes brown wrote for msnbc. those six members of congress who tried to help trump remain in power violated their oath to support and defend the constitution of the united states. instead, they chose to support and defend one man's attempt to shatter the constitution, donald trump. the january 6th committee's investigation ends, there have to be consequences for their misplaced loyalty. not one of those members should be allowed to remain seated in congress, tara. >> i agree 100%. and there is even a clause in the constitution that talks act what happens if you support an insurrection. in the 14th amendment section 3, you are disqualified from ever holding office again if you are deemed a part of an insurrection. it's happened after the civil war. so, um, there absolutely -- they absolutely should not be seated in congress if we find that gosar and brooks and marjorie taylor greene and others were directly involved in this. this is despicable. i mean, this is -- we've never seen anything like this in our country before. and if -- if there aren't swift consequences, then it's simply a practice run. so the idea that mitch mcconnell, um, now is starting to say, well, yeah, the public should know. that's because it doesn't impact him in the senate. we are looking at people in the house. you know? [ mittens squeaking ] - oh...oh. - what's going on? - oh, darn!va. - let me help. lift and push and push! there... it's up there. hey joshie... wrinkles send the wrong message. help prevent them with downy wrinkleguard. feel the difference with downy. today's bombshell announcement from senator joe manchin that he will vote no on the build back better act deals poe enten shlly fatal blow to the president's agenda l which will deepen a stark partisan divide in our nation. it is also signaling what will be a difficult fight ahead for voting rights if the filibuster remains much op-ed in the hill describes it this way. republicans are using trump's defeat in 2020 and the red herring of election fraud as their moment to propel a more insidious cause stacking the political game to ensure that trump or his successor, as republican nominee, cannot lose the 2024 election. i want to bring in joe han jones who writes the blog. it's good to see you. thanks for joining us. >> thanks for having me. >> give me, first, your reaction. your gut reaction, um, to manchin's appearance on fox news saying he is going to vote no to build back better. >> yes, yes. well thank you again for having me, yasmin. i think for the first thing, it is very telling that joe manchin went to the nation's leading right-wing propaganda network, fox news, to sell his opposition to key progressive proposals. um, namely, the build back better bill. um, in which -- during the interview, he was allowed to espouse a number of conservative talking points about his concerns about inflation. he threw a jumble of words out talking about geopolitical concerns about the build back better bill. he talked about, um, covid. he was also able to frame his -- his opposition to the bill as one -- as a matter of personal concern. he talked about how personally jarring and difficult it was to come to this position but didn't ask him any questions about what the implications for joe manchin's constituents and the rest of the country would be in his opposition to the bill. so i think he went to the perfect place this morning at least to sell his opposition to a progressive proposal. he wasn't going to get any pushback to that. and he did not from brett barry. >> much of what i heard today is talking about the fact that maybe this is not deed daddy in the water, we have to keep burning, we have could keep working, we have to keep talking to joe manchin. maybe this is just negotiating tactic from joe manchin. whatever it may be, they can't also forget the fact that is about voting rights, right? because they don't have a large enough margin in the senate. right? and -- and -- and it's voting rights and the filibuster that are top of mind for me in thinking about where the democrats are. you actually wrote about this, voting rights, and kirsten sinema specifically and something she told some students in arizona. according to the student, sinema said she supports the freedom to vote act but she said it hasn't passed because it hasn't been put up for a vote. truthfully, she is a major that reason that bill has -- has not passed. >> yes. yes. and so, i use that example just to show that kyrsten sinema will tell virtually anyone what they want if she feels it's going to suit her interests. she told hungry hunger strikers that the reason the progressive proposals for voting rights were not being passed is because it sbaz hazent been reintroduced since it was struck down but the reason it was able to be struck down is because republicans use the filibuster she is currently supporting. and so, i mentioned that example to show she is kiends of kicking up a storm of dust which we in arizona call a -- you know, vocabulary for aw you at home. but a storm of dust to kind of mystify constituents and people in the country as to her stance on the filibuster and voting rights. you can't have it both ways. you can't claim to support voting rights full throatedly. while you are supporting this measure that is being used in this current time as the most effective cudgel to stop voting rights from being passed and that's what she is trying to do with all of her rhetoric over the past couple weeks. she also told "politico" she continues to support the senate's 60 vote threshold because she thinks it is geeg going to protect country from radical reversals and we know those are happening at the local level by republicans attacking rather voting rights. >> thank you for joining me. happy holidays, my friend. that wraps up the hour for me, everybody. i'm yasmin vossoughian. join me tonight, everybody, for a special yasmin vossoughian reports attack on the capitol tonight. 9:00 p.m. eastern time right here on msnbc. i will see you then. for now, i am going to turn it over to my friend reverend al sharpton and "politicsnation." it's the 11th annual revvie awards from rockefeller center, here is your host al sharpton. >> good evening. and welcome to "politicsnation's" 11th revvie awards. it's where we celebrate the best and worst in 2021 and give awards to those who deserve it. i'm honored to have b
