shot and killed daunte wright. >> i remember yelling taser, taser, taser, and nothing happened. and then he told me i shot him. >> plus as the january 6th committee prepares for more key depositions, one of the rioters gets one of the toughest sentences yet for flowing a fire extinguisher at police officers. and dark side of social media, unverified threats on tiktok, shutting down the country. good morning, everybody. it's saturday, december 18th, i'm lindsey reiser. and we have a team of reporters and analystists following the latest from washington, d.c. tole kentucky. we begin, though, this weekend with americans across the country grappling with a really tough decision. keep their holiday plans to see loved ones or cancel as a massive twin variant surge of covid cases begins to hit. it's been 21 months and one week since the world health organization declared coronavirus a pandemic. this is a case rate over that time. over there on the far right there, you see how sharply things are rising right now. new york state just recorded the highest one-day total of new cases. the highest one-day total, since the pandemic began there here's governor kathy hochul on the spike. >> it's going to get worse, especially after christmas day. people gathering in person. there will be absolute more spread. we saw a 70% increase in cases from thanksgiving to two weeks later. and the same thing is going to happen. >> all right. we want to show you a state-by-state look on how cases have changed in just over the last 72 hours. each state you see in red is showing a jump in cases over that time. here's nbc news national correspondence miguel almaguer. >> reporter: well before our nation has even reached what is predicted to be the depths of this year's deadly surge, businesses and schools are shuttering in pockets of the country. new york state reporting its single day record for new infections during the pandemic, though hospitalizations are down by more than half. still, a week before christmas, the rockettes are cancels the rest of its seasons shows. the nfl and nhl postponing some days after a cluster of outbreaks. parts of broadway are dark. and as restaurants and classrooms clear out, long lines for covid testing are back. with our fast resembling our future. the 91 million americans who are not inoculated are accelerating the pandemic. >> for the unvaccinated, you're looking at a winter of severe illness and dental for yourselves, your families, and the hospitals you may soon overwhelm. >> reporter: vaccinations will protect most from serious illness, but the covid task force emphasized the clinical need for boosters as omicron evades some larls of protections, scientists are worried about what will evolve next. >> we are concerned we're one or two medications away from not having effective vaccines or monoclonal antibody therapies. >> reporter: many hospitals on a break, and taking a toll on nurses with a new study showing 1 in 5 plan to quit the profession. >> we're tired. the hospitals are stretched. resilience is low. please, get vaccinated. >> i think we're looking at a potential wave of cases that's so large that we still, you know, overwhelm our hospitals. >> there's some danger ahead. >> i think there is. >> reporter: bracing for a winter wave expected to rival last year's, every day 1300 americans lose their lives. >> all of these rooms are full. >> all of these rooms are full of intubated covid patients. >> reporter: to see the grim reality, look no further than farmington, new mexico. two weeks ago, we saw their icus are full. local funeral homes tell us they're now running out of room to hold the dead. >> our thanks to miguel on that. let's bring in the doctor on the report. it's good to see you bright and early. it seems like things were getting real again and we're seeing restaurants and productions shutting down, and we just heard miguel say the rockettes are cancelling their season. when are we headed here? >> you know, lindsay, with the omicron variant, with the muslim countries and eu and south africa, with this move, the growth rate, the doubling rate of just two days in some areas means that we're quickly getting overwhelmed with cases. we're already seeing that. some of those lines with our people who potentially have turned positive very recently. what we're hoping, though, because we have a higher percentage of vaccinated folks, you're seeing those with two doses still have not the same type of protection but pretty good protection. one of the studies in south africa that needs to be validated shows about 70% protection against severe disease which not bad, you know. then as you get a booster that can sort of take that production back to what we expected from the vaccines. that's why you're seeing a push to get everybody boosted. however, what people should expect, that protects against severe disease, but we may see more breakthrough infections. which means this winter as you're visiting family, you've got to use the masks. and you see people are more vulnerable, potentially vaccinated but unvaccinated as well. >> we're showing a line i was at 57th street yesterday. the people in line that i talked to they said that some of them instead they were traveling internationally, so they needed a test. some of them wanted to get tested before holiday gatherings. other people know someone who was exposed or tested positive. what should they do with holiday plans? are you changing any of your plans? because realistically when you go see family and friends, you're probably not going to be wearing a mask the whole time you're at mom and dad's? right? >> no, and i'll tell you, everybody in our family is boosted -- vaccinated and boosted. and we plan to take a rapid test right before. and one thing that people don't talk about often that i do is actually risk modulate the week before. i try to reduce if i can any high-risk activities such as being indoors in a public space, potentially crowded for a long period of time. by doing that, you risk your risk of being exposed. >> eating out? >> absolutely. i don't usually do that if i'm going to go see family. that eases my peace of mind that i'm not subjected during that period of time. i think in small family groups we have the resilience to do this, we have to do it thoughtfully and consideration for our families. what i worry about, that we stop the larger gatherings hundreds of potential people whose vaccination status you may not know. new york with the testing, but that's not true around the country. in large gatherings where people are not vaccinated or tested may surge this. >> this brings home the importance of wearing a mask. and as you know the ceos of american and united airlines tested before congress without masks on. and they actually downplayed the need for masks on the planes. but two days later, the ceo of southwest airlines gary kelly tested positive for covid. so what's your take here on the need for masks on flights. and should we be listening more to doctors than airline ceos? >> well, i hope so. and yes, we do need it. because travel isn't just about the planes, right? even though there are good filters on the planes when the planes are on. when the planes are off, at the gates, all of the gatherings at the airports, getting to the airports, using public transportation, all of that travel carries risk. what i would recommend is a good quality mask. particularly with omicron. what you're seeing what the w.h.o. says is a force of infection. which means you're most likely to get inflected around a person who has omicron. you can get infected and pass it on to others. or you might get symptomatic mild disease. maybe you don't want that for the holidays. so n 95 when you travel is the safest way just to make sure you're adding that extra layer of protection. >> let's talk about vaccines and kids, we know that the vaccine for children 5 to 17 haven't been where it needs to be. the two shots don't appear strong enough, now, they're testing three doses. what does that mean for the time line of that age group? and what do parents need to know about keeping their kids safe during this time? >> i think pfizer is seeing for that group, particularly in the older side of that 0 to 5 rate, they did not see the kind of immune response that they're hoping for. and the younger population, that is you may not see as many severe infections. you want to base it on what you know is a healthy amount of antibody response. they didn't see that. they're adding this third dose. i think it means that the child may go on for long. i know parents don't want to hear that. they want to add that third dose to reach that antibody level and immune level to a point that might offer protection in the real world. i think the best way to protect right now, exactly what we've done so far. to have everybody else around them vaccinated. and those rapid tests. the more of them available using them during gatherings, particularly others gathering around the kids, just to ensure they have tested negative. >> just weigh the risks. we're hearing from family that they're changing their plans. dr. bhadelia, thank you so much. still to come inside the manslaughter trial that has gripped the nation? yeah, hang on, i'm about to break my own record. only pay for what you need. ♪ liberty. liberty. liberty. liberty. ♪ closing argument, in the kim potter trial are set to start monday. the defense resting its case after testimony from the former minnesota police officer. potter who's white took the stand yesterday defending herself defense manslaughter charges in the fatal shooting of daunte wright. wright, a black man was shot by potter after being bullepulled for a minor traffic violation in april. potter said when it came chaotic, she mistook her gun for taser. stephanie, let's talk about that moment. the court had to take a break. potter became very emotional describing the moments that led up to that fatal shooting. >> reporter: yeah, good morning to you, lindsey. she did get very emotional during several points throughout her testimony yesterday. as she described those fateful moments back in april when she thought and killed daunte wright during that traffic stop. now, during her testimony, she described how she was training a new officer, it was that officer, she said that wanted to pull over wright's vehicle for those minor violations being a tag violation and air freshener violation. potter also testified had she been alone, she probably would not have pulled over daunte wright's vehicle. she also then went on to talk about the chain of events that led up to that moment that went terribly wrong. take a listen. >> we were struggling -- we were trying to keep him from driving away. it just -- it just went chaotic. and then, i mean, i remember yelling taser, taser, taser. and nothing happened. and then he told me i shot him. >> reporter: and potter who is 49 years old is a police veteran. she faces charges-first degree and second degree manslaughter, lindsay. >> potter was repeatedly pressed by the prosecutor has to whether wright even ever posed a threat to her. >> reporter: yeah, indeed, lindsey, you know, potter has maintained that this whole thing was a terrible accident. but the prosecution pulled no punches yesterday, they essentially -- the prosecutor saying that potter was reckless and negligent. and therefore, that she does deserve to go to prison. during cross-examination. she also asked potter whether she thought that daunte wright was indeed a real threat. take a listen. >> never saw a gun? >> no. >> he never threw a punch, right? >> no. >> never kicked anyone? >> no. >> never said i'm going to kill you? >> no. >> never said i'm going to shoot you? >> no. >> never said there is a gun in the car and i'm coming after you? >> no. >> reporter: now, closing arguments in this case begin on monday. lindsey. stephanie stanton, thank you. let's bring in trial debbie hines and trial attorney julie rendon. let's break this down here. julie, let's start with you as a former assistant a.g., you saw that testimony, what's going through your head? does it help or hurt prosecutors? >> it could go either way. one of the things that's really bad, one of the things we know, what the jury is left with a whole weekend to think about potter's testimony before they have deliberations and jury instructions on monday. and potter is basically, you know, taking a page out of the playbook of kyle rittenhouse and other people who have testified in situations such as michael slayer, the police officer who shot and killed walter scott. she got on the stand and cried. but the intent does not matter. and that is what the prosecution will argue, it doesn't matter that she was upset. and her testimony it being a chaotic situation. well, that is what we would expect, is that police officers should handle chaotic situations and know the difference between a taser and a real gun. i'm not so sure how much her testimony would help. but in most instances defendants do not take the stand. but i honestly think in this case for any shot she had tour a hung jury or not guilty, she had to take the stand in this case. >> julie, going on with what debbie said, when potter was cross-examined she was shown photos of the gun and the taser. they look nothing alike. and talking about whether daunte wright was ever a threat. she never saw a gun, et cetera. as a trial attorney yourself, how damaging are those events? >> look, i think the prosecutor did a very methodical job. i'm not sure she did the best job she could have, in terms of questioning her in regards to those specific things. i think one of the things that sticks out in my mind is that when this fire officer testified many people on the jury thought she looked like a soccer mom in her yellow outfit. she's certainly not the person you see when you think of derek chauvin. >> but that's also by design. >> you're absolutely right. there is an affect to this that seems to be that is what she was. you notice, she acts different than when she does on the stand. and remember, when she talks, she's talked about the fact she's never used the taser before. she's never fired the weapon. never had any complaints. when we think about what the jury is hearing, they're hearing about a human being now. and before she testified i don't think they really got a feel and sense, except to the end of this video as to who this person was. i think that's effective for the jury. i think it may have an impact on what the jury decides in the end. >> debbie, let's talk about the make-up of that jury, nine of the first 12 jurors seated are white. talk about that significance. >> well, unfortunately, in all of these cases, race matters. race matters in each and every case. so, what we have only one black woman, no black men on the jury, and that is going to be significant. even though people are saying well, they're sworn to basically look at the evidence and decide the evidence based on the law of the case. but race always matters in these cases. that can bode for kim potter. she's going to be more sympathetic, let's be honest. some of the white jurors in this case are going to see themselves in kim potter. she testified she's married. her husband is her high school sweetheart. two sons, one in the marines. all of those things are going to appeal to some of the white jurors in the case. that is why it is so unfortunate it's not going to go with the jury in this situation. >> debbie hines and julie rendon, thank you for sometime this morning. >> thank you. still to come -- >> i did invoke my fifth amendment rights to every question. >> another trump confidant refusing to answer questions at his january 6th deposition. will the panel vote to refer him for contempt of congress? you're not even in this one. i thought it was thursday. sorry. -it is. -i thought -- i thought it was last thursday. welcome back. let's turn to washington where the january 6th investigating committee is honing in on some of former president trump's most prominent allies with roger stone appearing for his deposition yesterday. but he says he remained tight-lipped in invoking his fifth amendment rights for every question he was asked. meanwhile, the committee rescheduled its deposition of conservative talk show host alex jones. that was originally set for today. as the committee faces road blocks with witnesses so does the major pillar of president biden's agenda. both biden and senate democrats acknowledging the build back better agenda will likely not pass before the end of the year. now, democrats are turning their attention to voting rights but they're expected to face familiar road blocks. here to walk us through the d.c. developments near the end of the year, julie tsirkin, and msnbc correspondent traveling with the president tris morning. >> julie, let's start with you. tell us what you know about the committee rescheduling jones' appearance and what we know moving forward in 2022? >> good morning. we know alex jones was supposed to be appearing before this morning before the january 6th select committee. chairman thompson said he won't be coming today, the aide said the deposition has been postponed. and we don't know much other than that, that indicates that jones and his attorney are talking with the committee and communicating and seeing what they can work out there. remember what jones said as he was subpoenaed at the end of november. he issued a video statement slamming the committee calling it a kangaroo court. calling it a witch hunt. and saying he'll probably invoke his fifth amendment right. and someone else who invoked his fifth amendment is roger stone. we played in an intro, he said after about 90 minutes before the committee that he didn't answer any of the questions. he invoked his fifth amendment right to every single question. moving forward, the house and senate are gone for the holidays. they're home. what what they have to look forward coming back is hearing from phil waldron, the ex-u.s. official who turned to election fraud claims after working, both in the as az audit testifying before the senate there. and reportedly sending that power point on january 6th to mark meadows. now bennie thompson, the chairman said the documents that he reportfully provided to members of congress is an alarming blueprint for overturning a nationwide election. something they have to look forward to returning from break. the committee is crossing off names on the list. perhaps getting closer to connecting the dots after what happened after january 6th a year after the insurrection. lindsey. >> josh, when we talk about build back better. vice president kamala harris was on cha charlemagne the god. >> who's the real president of this country, joe biden or joe manchin? >> come on, it's joe biden. no, no, no, it's joe biden. and don't start talking like a republican about asking whether or not he's president. >> do you think joe manchin is a problem? >> and it's joe biden. and i'm vice president and my name is kamala harris. >> tell us what this may mean between the vice president's office and the white house here. and also the white house and joe manchin? >> yeah. what an interesting moment here. especially as vice president harris has been really facing such a slew of bad headlines recently. a lot of questions about her status in the white house. about her own office and a series of departures of senior staffers. as well as real questions about her political standing. and her fate as the potential future presidential candidate or nominee if president biden were to choose not to run again for re-election. so, at this moment in time, we see harris really trying to stand as one with president biden. she gave -- shortly after that part of the answer, a staunch defense on what she and president biden have done on all of these various issues that are of such importance to the black community and charlemagne the god's audience. and how she shut down that line of questioning. and the other aspect there watching her kind of flip the argument on him, by saying play into these concerns about biden's stature, compare to joe manchin's, that those doing that are actually playing into the same republican hands that are still questioning president biden's electoral legitimacy, a year after the election. so, you see how certain harris is about wanting to stand up not only for herself, but for her role as a part early in of joe biden in the administration, it's a difficult time for her. >> josh, real quick on president biden's vaccine mandate for peverley workers. a federal appeals court reinstated his vaccine or testing mandate for large companies. that's a legal victory for the administration. what does this mean moving forward? >> yeah, some 80 million workers who can be affected by that. they'll either have to get the vaccine or weekly tests to be able to go into work. we know that the folks who had sued the administration over this mandate, they are still planning to appeal that to the supreme court. so it's likely we will see that at the supreme court, at some point in time, where, of course, conservatives now have that majority, lindsey. >> to be continues. thank you both so much. let's welcome in congresswoman debbie dingell of michigan to talk about all of this. congresswoman, good morning. thank you for being here. >> good morning, lindsey. good to be here. >> let's get your reaction, a shift in priorities moving into the new year. build back better might be on the agenda next year. it sounds like voting rights is the focus, also what would you make between that exchange between charlamagne tha god and kamala harris? >> i'm going to try to answer those in this fashion. build back better is, at the end of this year, those discussions are continuing there's too many important things in there like lowering prescription drugs. child care, long-term care for seniors and we're going to get it done. move into next year and get it done. voting rights have been front and center in the house of representatives all year long. it is critical, as we watch republicans around the country, and it's not only republicans, but it's people who are trying to do two things. make it more difficult for people to vote. difficult for people to vote >> you know, i'm tired, senator manchin is one voice. we've got a lot of things done despite him. and some things with him. so president biden is going to keep working for the build back better over that time. i know know he's president of the united states. and i think it's time for all of us, for the holiday, but we've got a lot of things to keep working on. >> and congresswoman, what about some of those benefits that will sun set a lot of the families benefitting from the tax credit got their last check on wednesday. if build back better doesn't pass, they're not going to get another one. >> that's right. there's so many good families, last night i was with people, 30 or 40 years, and there were more boxes than we have seen for the families. already there with the drivers at 6:00 a.m. and people need those. those mothers and fathers have told me about the food who had been sleeping on the floor. that money is critical. we have to help people. >> a couple of angles here. robert palmer was sentenced to five years prison. this is the longest sentence handed out so far. we know mitch mcconnell is changing his tune. he looks forward to seeing what the committee finds in the probe and called what happened on that day a horrendous event. what are your feelings now on people being held accountable. does this under score the people on that day? you want to shutdown, but you are giving credence to something that wasn't true? >> i do. i worry that by shutting down schools and sending out emails, we're giving attention to bad behavior that maybe wasn't a threat. >> reporter: in michigan, some districts not taking chances after a student opened fire killing four and injuring 11 others. in florida, a teen arrested at miramar high school. earlier this year, some students shared an online challenge to destroy school property. experts worry about a larger trend. >> what worries me is about the situation is schools shutting down across the united states. unfortunately, what we see is there's power in spreading misinformation. >> reporter: viral posts on social media sparking into fear and world disruption. gadi schwartz, nbc news. >> let's welcome in kalen rosenblatt. we have seen disruptive trends on tiktok like, believe it or not, stealing things in schools or the milk crate challenge and people falling and getting hurt. help put this in perspective. >> i think this is, you know, it is unfortunate this has become a big deal. in perspective, this wasn't a threat. there was no origin point. whereas, the milk crate challenge or eating honey could have physical ramifications on people taking part of them. this was more hysteria. parents have more to worry about and there are genuine tiktok trends that are a problem like the crate challenge and honey challenge. this was not one of them. this became something parents had to worry about. we have to be careful about the information that we spread both online and information that schools and local media send home to parents. >> what's tiktok doing about trends like this? >> well, in the past, something like the milk crate challenge, you cannot search for it. if you look it up or look up a different spelling of the challenge, usually it is disabled. you cannot find it. even the trend where people were stealing items. you can't search those things on tiktok. no way to access that information. in this particular case, tiktok also released a guide so if you see a trend that is disturbing, you can report it to tiktok. you can let them know i'm nervous about this. they run the gamut on how they take care of a certain trend depending on what the execution of that trend is. in this case, they said, hey, here is a step by step guide. if you see a rumor thatis scary, report it to us. we will look at it. >> i want to put up the second page of the statement. tiktok is essentially saying we need to be careful here. for example, we are concerned that the proliferation of the local media reports on the alleged trend not found on the platform could inspire real world harm. law enforcement was doing press releases. this is not something media is just doing. how does law enforcement weigh the threats?
