let us reflect on the meaning of this moment. the single largest elimination of protections of lands and waters in u.s. history was met by the single largest mobilization for conservation in u.s. history. millions and millions of americans rallied to help tribes defend bears ears, to restore grand staircase escalante, and to safeguard the atlantic ocean's first marine national monument. this fight has galvanized a new and powerful vision for conservation in america, a vision in which we act with urgency and ambition to conserve and restore the land, waters, and wildlife we love, and that are disappearing so quickly. a vision in which the stewardship traditions and conservation priorities of tribal nations are celebrated and supported in both law and policy. a vision in which every child in america, no matter where they live, has a chance to experience nature's wonders. and a vision in which we harness the power of our forest and farms and ocean and coast to keep our climate liveable and communities thriving. this is the vision that president biden, with your help, is pursuing. and let me tell you, there is no one better to stand beside as we drive this work forward than our extraordinary secretary of the interior. ladies and gentlemen, my friend and partner in so many things, the secretary. >> good afternoon, everyone. before i start, i just have to say that i have the best team at doi, and i'm so grateful for all of you, so thank you. thank you. and thank you, brenda. thank you for your introduction. we are here today on the ancestral homelands of the piscataway people. bending the arc of the moral universe toward justice. thank you, mr. president, for the profound action you are taking today to permanently protect the homelands of our ancestors. our songs, our languages, and our cultures are strong and many people from many indian tribes have sung and spoken in unison to protect this sacred place. bears ears is a living landscape. when i've been there, i felt the warmth and joy of ancestors who have cared for this special place since time immemorial. it's a place where you can stand in the doorway of a home, where a family who lived thousands of years ago left behind a legacy of love and conservation for a place that sustained them for countless generations. stories of existence, celebration, survival, and reverence are etched into the sandstone canyon walls. sacred sites are dotted across the mesas. pots, arrowheads, clothing, seeds, evidence of lives well-lived, are as inseparable from bears ears as the air we breathe at this moment. today, children learn and sustain from their parents and elders the songs, traditions, and ceremonies that have been passed down from generation to generation at bears ears. this is a place that must be protected in perpetuity for every american and every child of the world. [ cheers and applause ] today's announcement, it's not just about national monuments. it's about this administration centering the voices of indigenous people and affirming the shared stewardship of this landscape with tribal nations. the president's actions today writes a new chapter that embraces indigenous knowledge, ensures tribal leadership has a seat at the table, and demonstrates that by working together, we can build a breyer brighter future for all of us. we have much more good work ahead. together, we will tell a more complete story of america. together, we will conserve and protect our lands and ocean for people, for wildlife, for the climate. together we will strengthen our economy with healthy, resilient natural systems. thank you, mr. president. thank you for strengthening the nation to nation relationship. thank you on behalf of all americans who love and value our cultural heritage. thank you on behalf of the local communities whose economies are continually benefiting from healthy ecosystems on our public lands, national monuments, and parks. i am so grateful and very proud to serve on your team. and now, it's my distinct honor to introduce you, ladies and gentlemen, the president of the united states of america. [ cheers and applause ] >> good afternoon. please, all be seated, please. madam secretary, deb, you've done an incredible job in a short amount of time. and i told you, when i asked you to be secretary of interior, that i understood i was politically raised by daniel inouye. indian nations. indian nations. and i want to thank all the leaders who are here today for your support and your help getting this done. and it's really, really important. and i want to thank brenda, council of economic quality, environmental quality, and gina mccarthy. if you need any translation, talk to me after. gina, you're the best. you're the best. and i want you to know, although he didn't speak today, i want to thank my buddy tom vilsack, secretaryof agriculture, because he's about preservation. [ applause ] and maria, senator cantwell, thank you for your really hard, consistent, unrelenting work on these issues. and i also want to thank michael bennett the same way. he's been in this and from the moment he got elected, he's been pushing hard. and rubin, i want to thank congressman gallego, for the work you've done and continue to do. i really mean it. this may be the easiest thing i've ever done so far as president. i mean it. i mean it. i've got to tell you a quick story. when i was running for office, and i'm embarrassed, i can't remember exactly which state i was in, but a gentleman, and i think it was his wife, and a little girl, said could i talk to you. she had this -- i couldn't understand what she had in her hand, it looked like a teddy bear. and she said, can i talk to you, mr. -- she wasn't sure what to call me, i wasn't elected yet, mr. president or mr. vice president. she said, i want to give you some bears ears. i looked at her. she gave me this set of bears ears. she said, you've got to promise me, you've got to promise me you'll protect the bears ears. i'm thinking, what the heck is -- i mean, at that time. i knew bears ears, but i didn't quite get it. her dad said, a national park. i said, oh, yeah. she said, you promise? you promise? and i promised. and it's the easiest promise that i've made in a long time. i'm grateful to the tribal nation leaders, both those who are here with us today and those unable to join us. today i'm proud to announce the protection and expansion of three of the most treasured national monuments. based on powers granted to the president under thetquiies act. first, bears ears national monument in utah. this is the first national monument in the country to be established for federally recognized tribes, a place of healing, as spoken by the secretary, a place of reverence. a sacred homeland to generations of native peoples. the last administration reduced the size by 85%, leaving vulnerable more than 1 million acres of cherished landscape. today, i will shortly be signing a proclamation to fully restore the boundaries of bears ears. second, imrestoring utah's grand staircase escalante national monument. we established the national monument 25 years ago this month. over the last quarter industry, this land has produced significant scientific discoveries per acre more than any other national monument, everything from fossils to ancient, indigenous artifacts. once again, the last administration cut the size of the monument nearly in half, stripping away more than 800,000 protected acres. today, i'm signing a proclamation to restore it to its full glory. third, protection of the northeast canyons and sea mounts marine national monument. waters teeming with life with underwater canyons as deep as the grand canyon and underwater mountains as tall as the appalachians. there's nothing like it in the world. because of its unique biodiversity, marine scientists believe this is the key to understanding life under the sea. president obama established it as a national monument five years ago, recognizing it's of irreplaceable value. again, my predecessor chipped away at its protection. we are restoring the protections from when this monument was first created. protection of public lands must not become a pendulum that swings back and forth depending on who is in public office. it's not a partisan issue. and i want to thank the members of congress who have come together to support this important conservation work. and by the way, i might add, is a matter of courtesy, i spoke with both the senators from utah. they didn't agree with what i was doing but they were gracious and polite about it, and i appreciate that as well. the truth is, national monuments and parks are part of the identity, our identity as a people. there are more than natural wonders. they're the birthright we pass from generation to generation, a birthright of every american. preserving them is the fulfillment of a promise to our children and all those who will come to leave this world a little better than we found it. but today, our children are three times more likely to see climate disasters uproot and unsettle their lives than their grandparents' generation. we have to come together and understand why this work is so critical. when we're protecting care for a forest, we're not just preserving the majesty of nature. we're safeguarding water sources and lessening the impact of fires. excuse me. we're protecting wetlands. we're not only saving birds and fish and the livelihoods of people who depend on it. we're also shoring up the natural defenses to absorb the fury of hurricanes and super storms. nearly one in three americans live in a community that has been struck by weather disasters just in the last few months. hurricanes, wildfires, droughts, heat waves. both the build back better plan and my bipartisan information agreement will make critical investments, significantly increasing the resilience of these devastating effects on the climate crisis. it includes creation of a civilian climate corps similar to president franklin roosevelt's conservation corps. it's going to be put diverse groups of americans to work doing everything from restoring wetlands to protecting clean water to making forests more resilient against wildfires. my plan also puts americans on a course to achieve 50 to 52% reduction in greenhouse gas emissions by 2030 and to reach net zero emissions no later than 2050. you know, achieving these ambitious goals will require that nature itself play a role. scientists estimate that the protection and restoration of national lands and waters can provide nearly 40% of the solutions to climate change. that's why i'm signing these proclamations today as an additional reason. it's also why i'm restoring protections for the national forest in alaska which i've had the great honor to visit. as a matter of fact, when i was meeting with -- back in the days when the senator from alaska, i was with him after the oil spill, and we stopped in the tongas forest and we sat at a table in a restaurant in the middle of the forest, which is tree trunks as big as that whole building, it was magnificent. i sat with four big guys, big, big guys, they had a lumber company that they were foresting in the area, and they wanted me to support paying for roads into the national forest. and we started the conversation. to make a long story short, when i made it clear i wasn't going to do that, the father turned to his son and looked like that program, hoss, big fella, i won't use the exact language, i'm across the table, he's got he and his three sons, he said, i'll bet this so and so, referring to me, expletive deleted, doesn't realize, he's closer to lexington, kentucky today than he was when i just flew off the north slope. it made the point to me, alaska's pretty big. there's an awful lot we need to protect. that's why i'm working to protect crystal bay from mining operations that would threaten one of the world's largest salmon runs. that's why i'm refusing to sell off the arctic national wildlife reserve to oil and gas companies. [ cheers and applause ] these protections provide a bridge to our past but they also build a bridge to a safer, more sustainable future. one where we strengthen our economy and pass on a healthy planet to our children and our grandchildren. let me close with this. everett abbey, a writer who once worked is a ranger in utah, wrote, quote, this is the most beautiful place on earth. there are many such places. every man, every woman, carries in heart and mind the image of the ideal place, the right place, the one true home, known or unknown, actual or visionary, end of quote. folks, that's the united states of america. that's america. a country we all share together. a country that we must protect together. and this is just one more step in doing what other presidents have done, starting with teddy roosevelt. and i'm going to sign these proclamations. thank you, thank you all for your support. thank you. [ applause ] thank you all very much. >> it's good to be with you on this friday. i'm joe fryer. you've been listening to president biden speaking about protections for national monuments. and at this hour there's more breaking news just coming in out of washington from the committee investigating january 6. the deadline has come and gone for those four trump confidants to comply with those subpoenas from the committee. the former president has instructed them not to cooperate citing executive privilege. "the new york times" and "the washington post" report that one of those confidants, steve bannon, has officially said he's not cooperating because of trump's legal argument. this statement just in from the committee chairman confirms that reporting. quote, while mr. meadows and mr. patel are so far engaging with the select committee, mr. bannon has indicated he will try to hide behind vague references to privileges of the former president. we will not allow witnesses to defy a lawful subpoena or attempt to run out the clock. we will consider quickly advancing a referral. nbc news has learned the current president is officially denying the former president's attempt to withhold documents, setting up a legal showdown over executive privilege. joining me now, nbc's mike memoli. nbc news's pete williams. "washington post" national reporter carol leonnig. mike, what more can you tell us? >> joe, this is a significant development. as it relates to the january 6 committee, a clash between the biden and trump white houses in terms of what executive privilege means. here is what we just learned. we obtained a letter from the white house counsel to the national archives instructing the release of documents requested by the select committee in a broad request for a wide range of documents relate to the president, president trump's, actions on january 6. according to white house officials, what has happened here is that the request that was made by the committee sought a range of documents relating to president trump's activities on january 6. everything from his phone logs, from photos, from videos produced during the day, everything involving mike pence, former vice president, his activities, his protection. this was the first request made by the select committee after it formed. what happened after that point is the national archives which contains altar kinds of from the trump administration began producing documents to trump legal representatives and the biden white house. the trump team had sought to block the release of an additional batch of documents that the national archives produced but the white house is now saying no, executive privilege is not relevant to this situation. in fact i can read from a letter we object tainted from dana remus to the national archives that says, these are unique and extraordinary circumstances. congress is examining an assault on our constitution. the constitutional protections of executive privilege should not be used to shield from congress or the public information that reflects a clear and apparent effort to subvert the constitution. so now what happens at this point? the trump legal team is likely to challenge the biden white house's efforts to allow these documents to be released. so no documents have yet actually been turned over to the committee. the white house seems to be expecting that the trump team will seek to challenge that claim, that waiver of executive privilege. it's the beginning of what could be a long and protracted battle between the two administrations, as the national archive has only begun to produce the documents the committee has requested. >> can the former president trump and his aides claim scuff privilege, pete williams? >> sure, they can claim it, but the question is how valid is it. the courts have never definitively said what authority a former president has to assert executive privilege. they've never said he can't. they've suggested, though, that it's a limited ability. first of all, the supreme court said in a 1977 case in a lawsuit involving president nixon against the archives that the sitting president is in the best position to decide what's in the national interest, that the privilege belongs basically to the office, not to the individual. now, they said president nixon could try to assert the privilege but that it was limited and if the president said no, that that undercut his claim, and that's clearly what president biden is apparently now doing according to mike's reporting, mr. biden is going against trump's wishes. so that's strike one against him. secondly, an executive privilege claim is a limited and balanced privilege. it has to be balanced against the need. this is the same position the biden administration took on whether former justice department officials could testify before congress. they said that congress has the greater need here. and that any privilege has to yield to that. thirdly, the supreme court has said before in another case involving president nixon that the privilege only applies to discussions with the president by a senior aide about his official responsibilities, in other words, policy. question, does a discussion of what to do about trying to undercut confidence in the election qualify? that's a question for the courts. and finally, of course, no privilege can be used to cover up any wrongdoing. so, you know, as it stands now, with this decision by the biden white house, there's nothing to stop the archives from giving this material to congress. president trump would have to go to court and try to block it. i have no doubt his lawyers will try to do that. but i think the weight of the legal scholarship, he faces very long odds here. >> let's talk about legal scholarship. renato, will these claims of privilege fly in court, and what do you make of this letter that the current white house has put out there challenging the former white house? have we seen anything like this before when it comes to executive privilege? >> it's going to have a very limited road in the courts. but the purpose here is to delay. i think really the goal here is just to create some sort of legal dispute that's going to allow the courts to take a look at this, put this on hold, potentially create some delay. as to blocking the witnesses, which that let that went out, that seems to me that it's just essentially a way to give cover to, for example, mark meadows, mr. patel, to try to give them an excuse, a reason to try to shy away from certain topics, to give them some negotiating leverage as they're negotiating with the committee. as to steve bannon, he has no leg to stand on because he wasn't even in the executive at the time so there's really no executive privilege between even a former president and people who weren't part of the executive branch. so it's ironic that he's taking the strongest stance because he certainly doesn't really have a leg to stand on here. >> renato, when we talk about the delay, how much of a delay could there be in this situation? and again, this letter we're seeing from the current white house now, does that make any difference in what's happening here, if there is this legal argument, this legal back and forth? >> i think there could be months of delay. we saw that during the trump presidency, right, where congress is trying to obtain records. the courts take time to examine these issues. and really what this does is it gives meadows and patel a way to say, look, we're trying to -- we're caught in the middle. we want to comply with this request from congress or the subpoena from congress, and on the other hand the former president is telling us that there's privilege, we don't know what to do. it's allowing them to avoid contempt of congress. and this way their attorneys can engage in their committee, as the chair and vice chair said, they're engaging, but what their lawyers are likely saying is, we want to weigh through these issues, and the committee could cut a deal with them not to testify about certain topics. that of course limits what information the committee gets. >> carole, steve bannon left the white house years before the insurrection. how would a claim of executive privilege cover him at all? it's interesting, the statement seems to indicate that meadows and patel are cooperating at least in some form. >> they're cooperating in some form, but my understanding from sources is that they haven't really turned over a lot of goods yet. so they may still follow bannon's lead here in basically saying, the former president told me he's got executive privilege claim and i'm not getting in the way of that. i couldn't agree more with pete that the odds of this winning legally are slim to none. the delay is what's important, apparently, to them. but i would also say, this is of a piece of former president donald trump's use of executive privilege. you may remember that he tried to claim that executive privilege would bar any public servant from testifying before congress. remember, about the ukraine call and his impeachment testimony. he thought that no state department employee, no justice department employee could be allowed to talk if he claimed executive privilege. well, that wasn't the case. it did slow things down but ultimately it failed legally because it was a specious claim. >> pete, what is it that january 6 investigators hope to uncover in these documents, what exactly is it they're asking for right now? >> well, i think you could look at it at the not benign level and say they just want to know what happened, they want to know what discussions were going on in the white house about the rally that was planned on the 6th about any efforts to get the justice department to try to look further into these claims, these unsubstantiated claims. they want to know if once the rioting broke out, what the president was doing to try to stop it, did he have any role in deciding whether or not the military would deploy the national guard. they have a whole range of questions. the nonpolitical way to look at it is they just want to know what happened. you can conclude for yourself whether they may have some political motives in trying to further examine what the president's role is in all this, but it does seem there are legitimate questions about what was going on there. >> and carol, pete raised all those questions. for us, probably the simplest question to ask but the hardest to answer, you have to wonder what is it donald trump does not want to committee to find out. you know trump world better than anyone, what are your thoughts on that? >> i'm so glad you raised this point because this is a former president who has insisted that the election was stolen from him and that if people would look more closely, they would see that it was rigged. he has made the claim to me personally that the events of january 6 were really a peaceful, loving crowd being warmly invited into the chamber of congress by happy capitol police officers. now, we all know from tape recordings and video evidence that that's not true. but if the former president believes both of those things then what is the problem with having mark meadows, his chief of staff, steve bannon, a close ally, and kash patel, who was at the department of defense and rallying against the transfer of power, what is the problem with having them testify about what they saw, heard, and witnessed in the days leading up to january 6? i think what's interesting is, all of those people are front row witnesses to what donald trump said and did. and that's what a good committee wants to find. what did the president say, what did he know, what did he do? >> so renato, let's look forward. what options does the committee have now? the statement they've just put out says "we will swiftly consider advancing a criminal contempt of congress referral." what are the chances that is the next move? >> oh, i think as to bannon, that's certainly going to be the next move. bannon is going to have to try to potentially assert some argument in court. but he doesn't really have a leg to stand on. i think the committee is in good standing versus bannon. but that will take some time to play out. as to the other two gentlemen, mark meadows, kash patel, there is going to be some negotiation. and the committee has a choice. do they cut a deal with them in which they cut out pieces of the testimony, in other words cut out questions that are going to be disputed, that are going to raise issues that trump is going to claim are covered by executive privilege? >> it could make things much more challenging, joe. senator schumer has wanted to do victory laps and republicans and democrats both said it perhaps was not the right time last night. and the reason it's so precarious right now is because senator schumer and president biden, they need senator manchin, and of course kyrsten sinema as well, to pass the president's agenda, something that's stuck in congress right now with his multitrillion dollar bill. it's especially important to keep manchin close because there was a meeting between sinema, a minority leader mitch mcconnell before this agreement on lifting the debt limit happened. we know mcconnell told his members behind closed doors that he's bringing this deal to schumer, this offer, i should say, to schumer, to give cover to senators manchin and sinema. they're the two most vocal who do not want to break the filibuster. breaking the filibuster was, you know, at a fever pitch leading into wednesday when this deal on the debt limit happened. and so it's really, really important for democrats to keep manchin and sinema in the fold, especially as they're receiving a lot of pressure not only from their colleagues but from activists back home too, joe. >> tara, on the debt ceiling, it's pretty easy to see what chuck schumer wants. it's kind of coming into focus what mitch mcconnell wants, at least politically. my big question has been, what in the world to ted cruz and lindsey graham want? what was victory for them? was it an actual default and try to blame it on biden? what were they looking for here? >> they were looking for more attack ads for the midterms. they wanted all of the democrats to be forced into a corner in which they had to use reconciliation to lift the debt limit. they did not want, you know, the perception of weakness. in my opinion, mitch mcconnell lost the news cycle. okay, so we have a narrative that mitch mcconnell blinked, right, and that schumer won. but in early december, it's going to be an even bigger showdown. it's not just going to be the debt limit that they have to fight to increase, the democrats will have to fight to increase. but also there would be government spending. an actual shutdown could be on the line. it's going to mean an even bigger fight which mitch mcconnell just pushed off. it will give him another opportunity to have another staredown match with schumer. everything that mitch mcconnell is doing right now is about politics, hands down. this is about lining up votes, going after moderates, making attack ads, and showing that democrats are spending too much. he didn't get that last night. but he might get that in december. >> tara, quickly, on this last point, i can't let you go without talking about something related to the story we talked about, january 6. you write in this morning's playbook, spotted, caddie turned senior trump official dan scavino surrounded by law enforcement officers at the funeral of butch anderson. the january 6 committee struggled to locate him. are they really having that much trouble finding him? >> i was told from a source on the hill, so yes, they are still trying to reach him. they've been getting tips about where he was at and that's how they found out he was at the funeral. so they are actively trying to reach him. he's hiding in plain sight. i thought it was amusing that he was surrounded by hundreds of law enforcement individuals, because it was the funeral of a sheriff, an ally of president trump. this was a serious issue, he was spotted, not served. he's out there. we know he lives in new york state. i'm not going to say what town he lives in. but yeah, they have to serve him and have not been successful in doing so. >> tara and leigh ann, thank you for your reporting, we appreciate it. today's jobs report for the month of september was disappointing, only 194,000 jobs were added to the economy last month. far from the 500,000 economists predicted. president biden reacted to the report earlier this afternoon. >> today's report is based on a survey that was taken during the week of september the 13th, not today, september the 13th. when covid cases were averaging more than 150,000 per day. but when you take a step back and look at what's happening, we're actually making real progress. >> employment ticked down, but that's due in part to a large number of americans who left the labor force altogether. they're no longer employed and no longer looking for a job. taking a look at the bigger picture, we're still missing 5 million jobs since the start of the pandemic. what do these low job numbers mean when we put them in context? we've got just the right folks to help us do just that. political chief economic correspondent and msnbc contributor ben white and robin karzid. we know there are 11 million open jobs now waiting to be filled. wages are increasing. people are still dropping out of the labor force. what gives? >> yeah, joe, these were really disappointing numbers, but not terribly shocking given, as biden pointed out, this survey was taken kind of at the height of delta which we were really getting slammed by people not wanting to go back to the labor force. you had a lot of people in the public sector, teachers not going back yet. so i wouldn't freak out about this one kind of bad number, because it repeated in october and november, if we don't see an uptick in the overall jobs number, then you've got a real problem. this one i would say, crummy, wish it was better, but there are better days ahead. we've got a real problem with labor force participation and getting people back into the labor force, particularly women. as you noted earlier, we're still dealing with kids at home. they still don't have all the childcare in place that they need, some structural problems that the economy, that the biden administration is trying to deal with. but we have not hit that point in this recovery where, you know, jobs start flooding back in, and we get, you know, full recovery from covid-19. we may get there, but we're not there now. >> robin, there is a correction in this report on last month's jobs numbers. we initially saw 235,000 jobs added, now we know it's closer to 366,000. it looks okay in the context of the other month to month job numbers. is it possible september could see a revision like this too? >> yeah, and as biden said, you're kind of looking, you're trying to drive by looking in the rearview mirror anyway. all eyes right now are talking about black friday, right, and thanksgiving, grocery sales then and catering sales then and travel and the christmas season, will you see delta abate enough for us to get out there and kind of spend some of the belated hot vax summer money that wasn't spent in the hot vax autumn, right? we were supposed to feel some of these pumpkin spice oats that they're pushing people on. i know i just threw a million metaphors at you. we haven't narrowed the gap back to pre-pandemic unemployment. there's this mystery, how are people subsisting if they're not getting benefits that expired on september 6, where is the money they're using to balance their personal balance sheets at home? i think everybody is at wit's end trying to figure it out. >> robin, another pandemic-related woe, the shortages of pretty much everything right now. people are feeling it at the grocery store, the paper towels, the rice cakes, that was big talk in our meeting this morning. do we know how long it will be before we see a return to normal? >> this is not a great place. >> do you know anybody that is left or anybody who is leaving haiti? >> translator: yes, there are a lot of people leaving. >> hunger is not the only threat. >> it's a war zone. >> really a war zone. >> now we flew back to port-au-prince in a chopper. on the city streets, you understand why. >> we are making our way through port-au-prince and much of the city right now is controlled by violent gangs. we are going to a clinic run by doctors without borders. >> half of the patients that arrive here have life threatening gunshot wounds often from high-powered firearms. >> the patient in the bed right there is a victim of gun violence. >> how many of the people that you meet as patients do you think would consider leaving haiti for another country, including the united states? >> maybe 90%. >> 90%? why so high? >> violence, poverty. >> those are the patients you treat every day? >> yeah. >> victims of gun violence. stabbings? >> uh-huh. >> and even you as a doctor, is it fair to say that you might think about one day leaving haiti because of the situation here? let us reflect on the meaning of this moment. the single largest elimination of protections of lands and waters in u.s. history was met by the single largest mobilization for conservation in u.s. history. millions and millions of americans rallied to help tribes defend bears ears, to restore grand staircase escalante, and to safeguard the atlantic ocean's first marine national monument. this fight has galvanized a new and powerful vision for conservation in america, a vision in which we act with urgency and ambition to conserve and restore the land, waters, and wildlife we love, and that are disappearing so quickly. a vision in which the stewardship traditions and conservation priorities of tribal nations are celebrated and supported in both law and policy. a vision in which every child in america, no matter where they live, has a chance to experience nature's wonders. and a vision in which we harness the power of our forest and farms and ocean and coast to keep our climate liveable and communities thriving. this is the vision that president biden, with your help, is pursuing. and let me tell you, there is no one better to stand beside as we drive this work forward than our extraordinary secretary of the interior. ladies and gentlemen, my friend and partner in so many things, the secretary. >> good afternoon, everyone. before i start, i just have to say that i have the best team at doi, and i'm so grateful for all of you, so thank you. thank you. and thank you, brenda. thank you for your introduction. we are here today on the ancestral homelands of the piscataway people. bending the arc of the moral universe toward justice. thank you, mr. president, for the profound action you are taking today to permanently protect the homelands of our ancestors. our songs, our languages, and our cultures are strong and many people from many indian tribes have sung and spoken in unison to protect this sacred place. bears ears is a living landscape. when i've been there, i felt the warmth and joy of ancestors who have cared for this special place since time immemorial. it's a place where you can stand in the doorway of a home, where a family who lived thousands of years ago left behind a legacy of love and conservation for a place that sustained them for countless generations. stories of existence, celebration, survival, and reverence are etched into the sandstone canyon walls. sacred sites are dotted across the mesas. pots, arrowheads, clothing, seeds, evidence of lives well-lived, are as inseparable from bears ears as the air we breathe at this moment. today, children learn and sustain from their parents and elders the songs, traditions, and ceremonies that have been passed down from generation to generation at bears ears. this is a place that must be protected in perpetuity for every american and every child of the world. [ cheers and applause ] >> good afternoon. please, all be seated, please. madam secretary, deb, you've done an incredible job in a short amount of time. and i told you, when i asked you to be secretary of interior, that i understood i was politically raised by daniel inouye. indian nations. indian nations. and i want to thank all the leaders who are here today for your support and your help getting this done. and it's really, really important. and i want to thank brenda, council of economic quality, environmental quality, and gina mccarthy. if you need any translation, talk to me after. gina, you're the best. you're the best. and i want you to know, although he didn't speak today, i want to thank my buddy tom vilsack, secretaryof agriculture, because he's about preservation. [ applause ] and maria, senator cantwell, thank you for your really hard, consistent, unrelenting work on these issues. and i also want to thank michael bennett the same way. he's been in this and from the moment he got elected, he's been pushing hard. and rubin, i want to thank congressman gallego, for the work you've done and continue to do. i really mean it. this may be the easiest thing i've ever done so far as president. i mean it. i mean it. i've got to tell you a quick story. when i was running for office, and i'm embarrassed, i can't remember exactly which state i was in, but a gentleman, and i think it was his wife, and a little girl, said could i talk to you. she had this -- i couldn't understand what she had in her hand, it looked like a teddy bear. and she said, can i talk to you, mr. -- she wasn't sure what to call me, i wasn't elected yet, mr. president or mr. vice president. she said, i want to give you some bears ears. i looked at her. she gave me this set of bears ears. she said, you've got to promise me, you've got to promise me you'll protect the bears ears. i'm thinking, what the heck is -- i mean, at that time. i knew bears ears, but i didn't quite get it. her dad said, a national park. i said, oh, yeah. she said, you promise? you promise? and i promised. and it's the easiest promise that i've made in a long time. i'm grateful to the tribal nation leaders, both those who are here with us today and those unable to join us. today i'm proud to announce the protection and expansion of three of the most treasured national monuments. based on powers granted to the president under thetquiies act. first, bears ears national monument in utah. this is the first national monument in the country to be established for federally recognized tribes, a place of healing, as spoken by the secretary, a place of reverence. a sacred homeland to generations of native peoples. the last administration reduced the size by 85%, leaving vulnerable more than 1 million acres of cherished landscape. today, i will shortly be signing a proclamation to fully restore the boundaries of bears ears. second, imrestoring utah's grand staircase escalante national monument. we established the national monument 25 years ago this month. over the last quarter industry, this land has produced significant scientific discoveries per acre more than any other national monument, everything from fossils to ancient, indigenous artifacts. once again, the last administration cut the size of the monument nearly in half, stripping away more than 800,000 protected acres. today, i'm signing a proclamation to restore it to its full glory. third, protection of the northeast canyons and sea mounts marine national monument. waters teeming with life with underwater canyons as deep as the grand canyon and underwater mountains as tall as the appalachians. there's nothing like it in the world. because of its unique biodiversity, marine scientists believe this is the key to understanding life under the sea. president obama established it as a national monument five years ago, recognizing it's of irreplaceable value. again, my predecessor chipped away at its protection. we are restoring the protections from when this monument was first created. protection of public lands must not become a pendulum that swings back and forth depending on who is in public office. it's not a partisan issue. and i want to thank the members of congress who have come together to support this important conservation work. and by the way, i might add, is a matter of courtesy, i spoke with both the senators from utah. they didn't agree with what i was doing but they were gracious and polite about it, and i appreciate that as well. the truth is, national monuments and parks are part of the identity, our identity as a people. there are more than natural wonders. they're the birthright we pass from generation to generation, a birthright of every american. preserving them is the fulfillment of a promise to our children and all those who will come to leave this world a little better than we found it. but today, our children are three times more likely to see climate disasters uproot and unsettle their lives than their grandparents' generation. we have to come together and understand why this work is so critical. when we're protecting care for a forest, we're not just preserving the majesty of nature. we're safeguarding water sources and lessening the impact of fires. excuse me. we're protecting wetlands. we're not only saving birds and fish and the livelihoods of people who depend on it. we're also shoring up the natural defenses to absorb the fury of hurricanes and super storms. nearly one in three americans live in a community that has been struck by weather disasters just in the last few months. hurricanes, wildfires, droughts, heat waves. both the build back better plan and my bipartisan information agreement will make critical investments, significantly increasing the resilience of these devastating effects on the climate crisis. it includes creation of a civilian climate corps similar to president franklin roosevelt's conservation corps. it's going to be put diverse groups of americans to work doing everything from restoring wetlands to protecting clean water to making forests more resilient against wildfires. my plan also puts americans on a course to achieve 50 to 52% reduction in greenhouse gas emissions by 2030 and to reach net zero emissions no later than 2050. you know, achieving these ambitious goals will require that nature itself play a role. scientists estimate that the protection and restoration of national lands and waters can provide nearly 40% of the solutions to climate change. that's why i'm signing these proclamations today as an additional reason. it's also why i'm restoring protections for the national forest in alaska which i've had the great honor to visit. as a matter of fact, when i was meeting with -- back in the days when the senator from alaska, i was with him after the oil spill, and we stopped in the tongas forest and we sat at a table in a restaurant in the middle of the forest, which is tree trunks as big as that whole building, it was magnificent. i sat with four big guys, big, big guys, they had a lumber company that they were foresting in the area, and they wanted me to support paying for roads into the national forest. and we started the conversation. to make a long story short, when i made it clear i wasn't going to do that, the father turned to his son and looked like that program, hoss, big fella, i won't use the exact language, i'm across the table, he's got he and his three sons, he said, i'll bet this so and so, referring to me, expletive deleted, doesn't realize, he's closer to lexington, kentucky today than he was when i just flew off the north slope. it made the point to me, alaska's pretty big. there's an awful lot we need to protect. that's why i'm working to protect crystal bay from mining operations that would threaten one of the world's largest salmon runs. that's why i'm refusing to sell off the arctic national wildlife reserve to oil and gas companies. [ cheers and applause ] these protections provide a bridge to our past but they also build a bridge to a safer, more sustainable future. one where we strengthen our economy and pass on a healthy planet to our children and our grandchildren. let me close with this. everett abbey, a writer who once worked is a ranger in utah, wrote, quote, this is the most beautiful place on earth. there are many such places. every man, every woman, carries in heart and mind the image of the ideal place, the right place, the one true home, known or unknown, actual or visionary, end of quote. folks, that's the united states of america. that's america. a country we all share together. a country that we must protect together. and this is just one more step in doing what other presidents have done, starting with teddy roosevelt. and i'm going to sign these proclamations. thank you, thank you all for your support. thank you. [ applause ] thank you all very much. >> it's good to be with you on this friday. i'm joe fryer. you've been listening to president biden speaking about protections for national monuments. and at this hour there's more breaking news just coming in out of washington from the committee investigating january 6. the deadline has come and gone for those four trump confidants to comply with those subpoenas from the committee. the former president has instructed them not to cooperate citing executive privilege. "the new york times" and "the washington post" report that one of those confidants, steve bannon, has officially said he's not cooperating because of trump's legal argument. this statement just in from the committee chairman confirms that reporting. quote, while mr. meadows and mr. patel are so far engaging with the select committee, mr. bannon has indicated he will try to hide behind vague references to privileges of the former president. we will not allow witnesses to defy a lawful subpoena or attempt to run out the clock. we will consider quickly advancing a referral. nbc news has learned the current president is officially denying the former president's attempt to withhold documents, setting up a legal showdown over executive privilege. joining me now, nbc's mike memoli. nbc news's pete williams. "washington post" national reporter carol leonnig. mike, what more can you tell us? >> joe, this is a significant development. as it relates to the january 6 committee, a clash between the biden and trump white houses in terms of what executive privilege means. here is what we just learned. we obtained a letter from the white house counsel to the national archives instructing the release of documents requested by the select committee in a broad request for a wide range of documents relate to the president, president trump's, actions on january 6. according to white house officials, what has happened here is that the request that was made by the committee sought a range of documents relating to president trump's activities on january 6. everything from his phone logs, from photos, from videos produced during the day, everything involving mike pence, former vice president, his activities, his protection. this was the first request made by the select committee after it formed. what happened after that point is the national archives which contains altar kinds of from the trump administration began producing documents to trump legal representatives and the biden white house. the trump team had sought to block the release of an additional batch of documents that the national archives produced but the white house is now saying no, executive privilege is not relevant to this situation. in fact i can read from a letter we object tainted from dana remus to the national archives that says, these are unique and extraordinary circumstances. congress is examining an assault on our constitution. the constitutional protections of executive privilege should not be used to shield from congress or the public information that reflects a clear and apparent effort to subvert the constitution. so now what happens at this point? the trump legal team is likely to challenge the biden white house's efforts to allow these documents to be released. so no documents have yet actually been turned over to the committee. the white house seems to be expecting that the trump team will seek to challenge that claim, that waiver of executive privilege. it's the beginning of what could be a long and protracted battle between the two administrations, as the national archive has only begun to produce the documents the committee has requested. >> can the former president trump and his aides claim scuff privilege, pete williams? >> sure, they can claim it, but the question is how valid is it. the courts have never definitively said what authority a former president has to assert executive privilege. they've never said he can't. they've suggested, though, that it's a limited ability. first of all, the supreme court said in a 1977 case in a lawsuit involving president nixon against the archives that the sitting president is in the best position to decide what's in the national interest, that the privilege belongs basically to the office, not to the individual. now, they said president nixon could try to assert the privilege but that it was limited and if the president said no, that that undercut his claim, and that's clearly what president biden is apparently now doing according to mike's reporting, mr. biden is going against trump's wishes. so that's strike one against him. secondly, an executive privilege claim is a limited and balanced privilege. it has to be balanced against the need. this is the same position the biden administration took on whether former justice department officials could testify before congress. they said that congress has the greater need here. and that any privilege has to yield to that. thirdly, the supreme court has said before in another case involving president nixon that the privilege only applies to discussions with the president by a senior aide about his official responsibilities, in other words, policy. question, does a discussion of what to do about trying to undercut confidence in the election qualify? that's a question for the courts. and finally, of course, no privilege can be used to cover up any wrongdoing. so, you know, as it stands now, with this decision by the biden white house, there's nothing to stop the archives from giving this material to congress. president trump would have to go to court and try to block it. i have no doubt his lawyers will try to do that. but i think the weight of the legal scholarship, he faces very long odds here. >> let's talk about legal scholarship. renato, will these claims of privilege fly in court, and what do you make of this letter that the current white house has put out there challenging the former white house? have we seen anything like this before when it comes to executive privilege? >> it's going to have a very limited road in the courts. but the purpose here is to delay. i think really the goal here is just to create some sort of legal dispute that's going to allow the courts to take a look at this, put this on hold, potentially create some delay. as to blocking the witnesses, which that let that went out, that seems to me that it's just essentially a way to give cover to, for example, mark meadows, mr. patel, to try to give them an excuse, a reason to try to shy away from certain topics, to give them some negotiating leverage as they're negotiating with the committee. as to steve bannon, he has no leg to stand on because he wasn't even in the executive at the time so there's really no executive privilege between even a former president and people who weren't part of the executive branch. so it's ironic that he's taking the strongest stance because he certainly doesn't really have a leg to stand on here. >> renato, when we talk about the delay, how much of a delay could there be in this situation? and again, this letter we're seeing from the current white house now, does that make any difference in what's happening here, if there is this legal argument, this legal back and forth? >> i think there could be months of delay. we saw that during the trump presidency, right, where congress is trying to obtain records. the courts take time to examine these issues. and really what this does is it gives meadows and patel a way to say, look, we're trying to -- we're caught in the middle. we want to comply with this request from congress or the subpoena from congress, and on the other hand the former president is telling us that there's privilege, we don't know what to do. it's allowing them to avoid contempt of congress. and this way their attorneys can engage in their committee, as the chair and vice chair said, they're engaging, but what their lawyers are likely saying is, we want to weigh through these issues, and the committee could cut a deal with them not to testify about certain topics. that of course limits what information the committee gets. >> carole, steve bannon left the white house years before the insurrection. how would a claim of executive privilege cover him at all? it's interesting, the statement seems to indicate that meadows and patel are cooperating at least in some form. >> they're cooperating in some form, but my understanding from sources is that they haven't really turned over a lot of goods yet. so they may still follow bannon's lead here in basically saying, the former president told me he's got executive privilege claim and i'm not getting in the way of that. i couldn't agree more with pete that the odds of this winning legally are slim to none. the delay is what's important, apparently, to them. but i would also say, this is of a piece of former president donald trump's use of executive privilege. you may remember that he tried to claim that executive privilege would bar any public servant from testifying before congress. remember, about the ukraine call and his impeachment testimony. he thought that no state department employee, no justice department employee could be allowed to talk if he claimed executive privilege. well, that wasn't the case. it did slow things down but ultimately it failed legally because it was a specious claim. >> pete, what is it that january 6 investigators hope to uncover in these documents, what exactly is it they're asking for right now? >> well, i think you could look at it at the not benign level and say they just want to know what happened, they want to know what discussions were going on in the white house about the rally that was planned on the 6th about any efforts to get the justice department to try to look further into these claims, these unsubstantiated claims. they want to know if once the rioting broke out, what the president was doing to try to stop it, did he have any role in deciding whether or not the military would deploy the national guard. they have a whole range of questions. the nonpolitical way to look at it is they just want to know what happened. you can conclude for yourself whether they may have some political motives in trying to further examine what the president's role is in all this, but it does seem there are legitimate questions about what was going on there. >> and carol, pete raised all those questions. for us, probably the simplest question to ask but the hardest to answer, you have to wonder what is it donald trump does not want to committee to find out. you know trump world better than anyone, what are your thoughts on that? >> i'm so glad you raised this point because this is a former president who has insisted that the election was stolen from him and that if people would look more closely, they would see that it was rigged. he has made the claim to me personally that the events of january 6 were really a peaceful, loving crowd being warmly invited into the chamber of congress by happy capitol police officers. now, we all know from tape recordings and video evidence that that's not true. but if the former president believes both of those things then what is the problem with having mark meadows, his chief of staff, steve bannon, a close ally, and kash patel, who was at the department of defense and rallying against the transfer of power, what is the problem with having them testify about what they saw, heard, and witnessed in the days leading up to january 6? i think what's interesting is, all of those people are front row witnesses to what donald trump said and did. and that's what a good committee wants to find. what did the president say, what did he know, what did he do? >> so renato, let's look forward. what options does the committee have now? the statement they've just put out says "we will swiftly consider advancing a criminal contempt of congress referral." what are the chances that is the next move? >> oh, i think as to bannon, that's certainly going to be the next move. bannon is going to have to try to potentially assert some argument in court. but he doesn't really have a leg to stand on. i think the committee is in good standing versus bannon. but that will take some time to play out. as to the other two gentlemen, mark meadows, kash patel, there is going to be some negotiation. and the committee has a choice. do they cut a deal with them in which they cut out pieces of the testimony, in other words cut out questions that are going to be disputed, that are going to raise issues that trump is going to claim are covered by executive privilege? >> it could make things much more challenging, joe. senator schumer has wanted to do victory laps and republicans and democrats both said it perhaps was not the right time last night. and the reason it's so precarious right now is because senator schumer and president biden, they need senator manchin, and of course kyrsten sinema as well, to pass the president's agenda, something that's stuck in congress right now with his multitrillion dollar bill. it's especially important to keep manchin close because there was a meeting between sinema, a minority leader mitch mcconnell before this agreement on lifting the debt limit happened. we know mcconnell told his members behind closed doors that he's bringing this deal to schumer, this offer, i should say, to schumer, to give cover to senators manchin and sinema. they're the two most vocal who do not want to break the filibuster. breaking the filibuster was, you know, at a fever pitch leading into wednesday when this deal on the debt limit happened. and so it's really, really important for democrats to keep manchin and sinema in the fold, especially as they're receiving a lot of pressure not only from their colleagues but from activists back home too, joe. >> tara, on the debt ceiling, it's pretty easy to see what chuck schumer wants. it's kind of coming into focus what mitch mcconnell wants, at least politically. my big question has been, what in the world to ted cruz and lindsey graham want? what was victory for them? was it an actual default and try to blame it on biden? what were they looking for here? >> they were looking for more attack ads for the midterms. they wanted all of the democrats to be forced into a corner in which they had to use reconciliation to lift the debt limit. they did not want, you know, the perception of weakness. in my opinion, mitch mcconnell lost the news cycle. okay, so we have a narrative that mitch mcconnell blinked, right, and that schumer won. but in early december, it's going to be an even bigger showdown. it's not just going to be the debt limit that they have to fight to increase, the democrats will have to fight to increase. but also there would be government spending. an actual shutdown could be on the line. it's going to mean an even bigger fight which mitch mcconnell just pushed off. it will give him another opportunity to have another staredown match with schumer. everything that mitch mcconnell is doing right now is about politics, hands down. this is about lining up votes, going after moderates, making attack ads, and showing that democrats are spending too much. he didn't get that last night. but he might get that in december. >> tara, quickly, on this last point, i can't let you go without talking about something related to the story we talked about, january 6. you write in this morning's playbook, spotted, caddie turned senior trump official dan scavino surrounded by law enforcement officers at the funeral of butch anderson. the january 6 committee struggled to locate him. are they really having that much trouble finding him? >> i was told from a source on the hill, so yes, they are still trying to reach him. they've been getting tips about where he was at and that's how they found out he was at the funeral. so they are actively trying to reach him. he's hiding in plain sight. i thought it was amusing that he was surrounded by hundreds of law enforcement individuals, because it was the funeral of a sheriff, an ally of president trump. this was a serious issue, he was spotted, not served. he's out there. we know he lives in new york state. i'm not going to say what town he lives in. but yeah, they have to serve him and have not been successful in doing so. >> tara and leigh ann, thank you for your reporting, we appreciate it. today's jobs report for the month of september was disappointing, only 194,000 jobs were added to the economy last month. far from the 500,000 economists predicted. president biden reacted to the report earlier this afternoon. >> today's report is based on a survey that was taken during the week of september the 13th, not today, september the 13th. when covid cases were averaging more than 150,000 per day. but when you take a step back and look at what's happening, we're actually making real progress. >> employment ticked down, but that's due in part to a large number of americans who left the labor force altogether. they're no longer employed and no longer looking for a job. taking a look at the bigger picture, we're still missing 5 million jobs since the start of the pandemic. what do these low job numbers mean when we put them in context? we've got just the right folks to help us do just that. political chief economic correspondent and msnbc contributor ben white and robin karzid. we know there are 11 million open jobs now waiting to be filled. wages are increasing. people are still dropping out of the labor force. what gives? >> yeah, joe, these were really disappointing numbers, but not terribly shocking given, as biden pointed out, this survey was taken kind of at the height of delta which we were really getting slammed by people not wanting to go back to the labor force. you had a lot of people in the public sector, teachers not going back yet. so i wouldn't freak out about this one kind of bad number, because it repeated in october and november, if we don't see an uptick in the overall jobs number, then you've got a real problem. this one i would say, crummy, wish it was better, but there are better days ahead. we've got a real problem with labor force participation and getting people back into the labor force, particularly women. as you noted earlier, we're still dealing with kids at home. they still don't have all the childcare in place that they need, some structural problems that the economy, that the biden administration is trying to deal with. but we have not hit that point in this recovery where, you know, jobs start flooding back in, and we get, you know, full recovery from covid-19. we may get there, but we're not there now. >> robin, there is a correction in this report on last month's jobs numbers. we initially saw 235,000 jobs added, now we know it's closer to 366,000. it looks okay in the context of the other month to month job numbers. is it possible september could see a revision like this too? >> yeah, and as biden said, you're kind of looking, you're trying to drive by looking in the rearview mirror anyway. all eyes right now are talking about black friday, right, and thanksgiving, grocery sales then and catering sales then and travel and the christmas season, will you see delta abate enough for us to get out there and kind of spend some of the belated hot vax summer money that wasn't spent in the hot vax autumn, right? we were supposed to feel some of these pumpkin spice oats that they're pushing people on. i know i just threw a million metaphors at you. we haven't narrowed the gap back to pre-pandemic unemployment. there's this mystery, how are people subsisting if they're not getting benefits that expired on september 6, where is the money they're using to balance their personal balance sheets at home? i think everybody is at wit's end trying to figure it out. >> robin, another pandemic-related woe, the shortages of pretty much everything right now. people are feeling it at the grocery store, the paper towels, the rice cakes, that was big talk in our meeting this morning. do we know how long it will be before we see a return to normal? >> maybe 90%. >> 90%? why so high? >> violence, poverty. >> those are the patients you treat every day? >> yeah. >> victims of gun violence. stabbings? >> uh-huh. >> and even you as a doctor, is it fair to say that you might think about one day leaving haiti because of the situation here?
