in her management that could stop me from making a living. >> the explosive bombshells, an attorney with the free britney movement joins us as those two new documentaries reveal stunning new detars about her conservatorship. it's sunday, september 26th. we're setting up for a very busy week across the country especially on capitol hill. a team of reporters and analysts following the latest for you right now. we'll begin, though, with breaking news overnight, that deadly amtrak derailment in montana. three people are dead. as several train cars went off the tracks. the national transportation safety board is now investigating with crews working overnight to clear the wreck. all the survivors have been extra kated. >> this was a ten-car train heading from chicago to seattle and portland it derailed right there in the town of joplin, montana, one passenger describing the feeling like extreme turbulence on a train. the ntsb is launching a go-team to invest gate what happened. i want to ask you the first thing ntsb crew will be looking at when they get on the scene in. >> they're looking at a various number of things, i'd say track is probably the first thing, they'll look at the equipment the operators, thing engineers and the conductors and focus in on what happened in this accident. >> as you take a look at some of the images as we have seen so far, mr. quimby, what are some things that stand out to you as you take a look, as we mentioned it appears it was a straight-line tracks, the temperatures in montana at the time were around 09 degree and the first thing that sprung to my mind was a very similar amtrak accident that happened on august 6th, 1988, in montana, not too far from where this occurred, that was the result of a track buckle due to heat buckling the train. >> so, wait to pick up on that, what sort of temperatures does it need to be for that sort of buckling to take place? >> the surface temperature of the rail is going to be about 30 degrees higher than the ambient temperature around 110, 120-degree rail temperature, those temperatures, all steel, will expand under heat and if there's not a proper neutral rail temperature when that track was laid the track has the tendency to buckle. it can't go left or right, it can raise out of the rail bed and literally flip-flop into an "s" shape. >> something that happened in 1988 this isn't something that we hear about every day, from your professional opinion, how unusual is something like this that we're reporting on this morning in. >> relatively unusual, although tracks generally makes up the majority of most railway derailments like this on a main line, they could be caused by other things, it could be an equipment failure, could be something else, maybe even just a crack or broken rail. >> when you take a look at these images and yes, i'll admit, this was bad, but the way you see some of these cars that were tossed, eight out of the ten cars were derailed, are you surprised it's not worse than it is? >> actually, somewhat. passenger cars have a very resilient, particularly amtrak cars are stainless steel the two-level cars are like rolling battleships, they're very, very resilient. >> mr. quimby, the ntsb is sending a local team from montana and also a team from the d.c. area heading to that scene as well. >> right. they'll mount a team and get special aircraft from the faa to fly directly out of reagan airport there in washington, d.c., to near the scene of the accident. >> how long do we think we have concrete answers here? >> probably about two, three day, they have the move some of the amtrak cars in order to get a better picture of the track condition and to get a better picture of what the condition of the cars. >> that line by the way from seattle to chicago is shut down for the day. russell quimby, thank you so much for your time. >> still early into the investigation. on the docket more than a trillion dollar in infrastructure improvements and trillion more for social programs. >> democrats in congress also have to prevent a government shutdown, make sure the u.s. pays its debts likely without any republican help. house democrats are set to meet tomorrow ahead of a possible vote. >> that vote seems destined to fail. many experts say, don't bet against speaker pelosi. julie, we'll start with you, speaker pelosi really turning up the heat on her caucus with this letter. >> she is. in her letter, she speaks about a time of intensity, it's starting tomorrow, on monday when the house will take up that trillion-dollar bipartisan infrastructure plan infuse the economy with funding, the biggest infusements for decades. they also want to insurances on that $3.5 trillion reconciliation package where house speaker pelosi said will be voted on this week. speaker pelosi said that's her agenda. remember, it doesn't have consensus among house democrats, senate democrats, they still have major disagreements as to whether this bill should happen this year and senator manchin who met with president biden this week he's one of the democrats who said, let's talk a pause, see what happens, but democratic leadership said it's essential to do both of those bills for president biden's build back better agenda. to make sure the government doesn't run out of money on thursday, september 30th, that's the deadline. with the debt ceiling attached to that republicans won't support it, democrats will have to figure something out, passing a clean cr without any strings attached in order to keep the government from shutting down. >> let's get to josh right now at the white house and get the white house side of all of this. president biden has a lot at stake with these bills, clearly, what do we know about he's doing to get it done? >> the president has been working the phones over this weekend while he's been at camp david following up on conversations that he had on friday both with nancy pelosi in the house and with chuck schumer in the senate as the president tries to figure out what he can do ahead of this make or break week for the president. the white house used to juggling multiple priorities at the same time. it's hard to overstate what's riding on the next few days for the president's agenda. the issues julie was just talking about in terms of the debt ceiling and the president also expected to head on wednesday to illinois to talk about covid-19 vaccines as he tries to keep a focus on that issue as well as the booster discussion. the president as far as his own involvement his role according to the white house is try to figure out not only democrats and republicans together, now he's trying to unite his own party and figure out what would amenable to folks with senators manchin and sinema and also progressives. you have president biden in a difficult situation here where he's sort of force to negotiate against himself and the $3.5 trillion that the president wants but knowing likely to come out of this is far more moderate than that. >> all right, josh getting us started there at the white house and julie, thank you guys. another development, the house budget committee has advanced the democrats' budget reconciliation measure. >> one member of that committee is dan kilde. he's a native of flint, michigan. he's here with us on the show. welcome back, congressman. >> thanks for having me. >> how can your committee pass this bill and send it to the house floor while two sides of your party still can't degree on the particulars. >> well, the work that we did yesterday in budget committee that took almost eight hours was to go through the bill and essentially stam pl the 13 pieces that came from the committee of jurisdiction and send this on to the house rules committee knowing that the rules committee ultimately could end up changing the legislation to align with whatever agreement we come to, it was a necessary but a ministerial step we took. >> you worked an eight-hour day yesterday, are you working behind the scenes, talk to members of your caucus ahead of that meeting tomorrow evening? >> we are, we got work to do yet and most of that work though could be clear is with our friends in the senate and we want to get to the boldest common denominator that we can get to, look, i will support the $3.5 trillion package along the bipartisan infrastructure bill but i'll also support a big step in the direction that those two pieces of legislation would take knowing that if we do that perhaps we are rewarded with continued majorities and we can continue to do this work as future terms arise, i just want to put ourselves in a position where we can't take action because we can't come to an agreement with one another and then to explain why we didn't take the one big step we could have taken. >> i'm curious what you think, who's the biggest impedement in all of this, has it been the moderate democrats, the progressives or the team that's sinema and manchin? >> the gnat has been a significant inbeadment. the impediment is we have to come together. this process is not always that fun to watch, but this is the governing process, the process of give and take, it's what democracy looks like and i think it's, you know, a process that ultimately result in something that everyone can get behind even though it might not be the legislation we write if we wrote it by ourself and this is how governing gets done, do you worry that the american public will translate that when democrats have the majority can't get these big items done. >> well, i think most americans just want to see us get this done, most americans just think about what the work produces in terms of the way it affects their lives, for example reduce prescription drugs, americans will appreciate that, give a big tax cut to families with children, the things that american families looks at isn't so much the process in washington but what it means to them at their kitchen table and it's so important whatever the product it is something good for the american people and i'm convinced even it's a compromised piece of legislation the impact will be felt at kitchen tables across america. >> you have a lot to get done in not a lot of time, are you fairly confident, a week from now, everything will be taken care, government shutdown avoid, debt ceiling lifted, the $3.5 trillion package is passed and on and on? >> well, that's what we're focused on and i'm confident that democrats will come together it's unfortunate that we have republicans on the other side of the aisle willing to work with us even to keep the government open. it would be helpful if republicans would come along. >> all right, we'll leave it there. >> thank you, congressman. still ahead -- the trump train rides through georgia. he was spouting lies and inaccuracies. >> they think a big mouth, i don't have a big mouth, you know what i have? >> here's what i think, i think america needs to wake up to this, trump's not going away he's not going to stop lying and we need to wake up to the reality that he's probably going to be the gop nominee in 2024, i think he's going to be more dangerous in four years and i think this republican party, kendis, is going to be a more dangerous cult in 2024, i don't see how any american watching what donald trump did the last few years, the horror he can achieve in the next four, he's not going away enter interesting take. you were changed in the democrats' response to this and the big lie by trump, how would you tackle that going forward or would have tackled several months ago? >> well, you know, i agree with everything that was said and part of the challenge for democrats going forward is to put in and invest in the infrastructure on the ground. one of the best ways to tackle this is to get as many people as you can get out there talking not what donald trump is saying but also what good government looks like, what reasonable leaders on both sides of the aisle look like and sound like and actually care about the business of government and helping and supporting people. i think the problem is is that you have a very loud voice on the other side and as a former president of the united states he still has a significant following whether he's on social media or not. so don't expect this to change any time soon. there's another important piece here, he's not -- he's just not doing rallies and speeches to call attention to himself, he's also out there campaigning for people running for office including secretaries of state in states where they do have elections and these are the individuals that have authority over election processes. that's really important. that's really important. >> it really is. last night we should point out the former president introduced three hand picked republican candidates to take on other republicans in primaries, they all talked about the rigged election, do you think, joe, that's what republican voters want to hear? does it even matter at this point? >> kendis, it's so sad but the answer is yes, look, again, i speak with hundreds of republican-base voters every day and they do believe, again, let's face reality, one of america's two major political parties is a dangerous, undemocratic cult wrap your arms around that, america, kendis, they believe, republicans believe the election was stolen. they do not believe joeden won fair and square and to be a viable republican today, you got to articulate that. >> the former president spoke for about 90 minutes, went through a litany of different things, tested out some new lines including questioning whether obama's elections were legitimate, what's going on here? >> it's a cult. as the former congressman has said. i will tell you that going forward, this is only going to get worse and, you know, there's not much we can do to recruit republicans to a different party but we as republicans have to fight against what the president is doing which is venue shopping in any form and at any level of government he's trying to solidify his support so you know going back to obama and i'm sure he's going to be calling hillary clinton's name a thousands times, this is only going to get worse. >> joe, quickly, before we go, he's there on stage for 90 minutes and putting out those numbers from arizona, those numbers showed he actually lost the audit in arizona. why, what's the point of that? >> good morning. well, first of all, this is going to be good for both cities, so the economies function together, they lost millions. they were losing $35 million a day. so a lot of things have changed when it comes to the migrant crisis here since this problem began with the thousands coming across the border, one, is a rot of these migrants decided to go back to mexico voluntarily because they knew the flights back to haiti were happening, so, now, many who wanted to come to the u.s. are thinking twice about possibly being deported back. also the mexican government is now working with the american government helping with more check points installed throughout the border, sort of stopping buses and other vehicles that could be carrying migrants to the border, because of these changes you don't have the large influx. they're helping them with special work permits, offering shelters in other parts of the country, so all of this will help stop the flow of migrants that may try to cross the border into the u.s. and when it comes to people being able to cross this changes everything for them, many of them are used to be able to cross for different reasons. one family told us why they needed to cross so badly. >> he was excited. he wanted to go to mexico, we need to buy groceries, medicine, we wanted to visit family. >> reporter: you know, this is something that we might have not known about is how a lot of the residents on the american side will cross into mexico to buy medicine because the cost of medicine being much cheaper and a lot of the workers for businesses on the american side live on the mexican side. this is something that happened in other parts of the border when we deal with one of these crises, for now things are calm, economies are beginning to function once again. boarder patrol agents do more help here, adaisal state troopers have been in the area helping to guard the border. some new covid numbers signal some reason for hope here, the longest decline we've seen in three months, so, how long will it last? >> so, yes, it's valid concern and we actually think the numbers are, the numbers of unvaccinated teachers are lower, the atf has done a very good job, my local and frankly my home local new york city in terms of trying to be incredibly supportive of the vaccine and making sure that people who have religious or medical exemptions to get to have that voice, so the local union believes that there's about 6,000, not 10,000, but that's not the issue, the issue is that the mayor has refused to work with principals or the other people who are in schools to actually manage not only this transition on vaccines which started kind of three weeks into the school year rather than at the beginning of the cool year but also changed a bunch of different protocols around covid leaving everyone in schools all throughout new york city really confused and really afraid. so none of the schools actually know who is or is not going to be there on tuesday, so frankly, you know, people have seen this new tro as, you know, kind of as an opportunity for the major to sit down with the principals and figure out this transition, because nobody thinks that those substitutes are available. >> your own polling shows 90% of members are vaccinated. what do you make of essentially a very vocal minority holding this up? >> look, there are two groups -- and this is only one in any number of lawsuits that, you know, you're going to see across the country because of the polarization and the disinformation, there are two groups of people here who are very resistant to the vaccine and frankly, let me just also say that if we had 90% and if we had 93% of every population group, every professional group vaccinated we'd be in a really different place than we are right now but the two groups, one are people who just, they have been anti-vax for as long as lived and they just don't believe in it and it's fueled by the disinformation and misinformation, you know, starting back to the measles vaccine and the second is, a group of people who are legitimately scared because of the disinformation or have medical exemptions so we have to meet their fear with facts for the first group, you know, i don't think we should be demonizing them, i think it's matter because of covid this is a new condition of employment, vaccines have been with us forever, ultimately we'll have vaccines for kids, for covid, there's a new cdc report that these vaccines work -- >> we have seen this go down in school board meetings. i want to play a quick clip. >> no more masks. [ chanting "no more masks" ] >> randi, we've been reported on the fact that many people including those who are against vaccines, ascribe to qanon beliefs are now running for school boards, what's the long-term impact of this. >> it's very dangerous, and that's why, i would put the people who are hesitant on vaccines because they're afraid of fertility or steristerility , i would put them in a different category than that clip with the masking. we have to meet fear with facts. on the issue of what's happening? >> you don't get out. until you scream. >> that one right there was a clip from the new netflix documentary, but "the new york times" film includes claims that her father hired a firm to surveil her phone and bedroom. he denies all wrongdoing. but joining us is an attorney who closely monitors the free britney movement. bj corville, thanks for being here. let's start with this new claim that spears' father had her phone and bedroom bugged nepsecurity firm said they actually conducted themselves within ethical and legal bounds and that they were proud of their work in keeping britney spears safe. but what would be the actual reason for anyone to have done that within a conservatorship? >> thank you for having me on. good morning. hope you guys are having a great morning. the reason, it's becoming clear to anyone who, you know, just looks, is, frankly, to control britney through, you know, monitoring her communications. now the statement that black box's lawyer put out, it seems to actually not be false in a lot of ways. the court has authorized jamie to look into britney's phone and to have other security and i.t. people look into the information on her phone. and so they've actually been doing a lot of this activity just right out in the public for anyone to see for a very long time. no one has actually been looking. so if they were, in farkts recording her in her bedroom, which i believe because we have people there saying that that happened, then that's not something that the court authorized. the court did not authorize that and i think that it's probably a violation of the law. >> let's talk about that because one of the oomphies for the security firm hired by britney's father talked about the surveillance. let's listen. >> i had them tell me what was on it. they seemed very nervous and said that it was extremely sensitive that nobody can ever know about this and that's why i need to delete everything on it so there's no record of it. that raised so many red flags with me. >> in california, it is illegal to record audio without both parties consenting. does that mean that britney or britney's attorney were aware this surveillance was happening? >> so it's difficult for us as the public to know exactly what samuel ingam did or didn't know. i will say, based on what we saw in controlling britney, this documentary that just came out, it does seem as though sami ngham did have reason to know britney was being recorded in this way because we're shown an email that he basically says, you know, i, for legal reasons, i need to know if you're monitoring her. i'm paraphrasing, of course, and then you do have another email in response to him saying, oh, we're not monitoring her text messages or whatever. so, i mean, it's up for -- it's up for you to decide whether or not sam ingham knew. i think he probably knew and certainly had reason to know because they were communicating about that issue. >> he did resign and she was able to pick her own counsel now? >> correct. >> we haven't gotten a comment from britney. her last tweet was saying she was going to take a break from social media to celebrate her engagement. good for her there. jamie spears filed a petition to end her conservatorship earlier this month and her lawyers requesting to remove him as a conservator immediately. how do you expect all of this will play out and these new shocking revelations we're learning about, while creepy, give us a big picture of where this will play. >> so something that i think is important to understand about the conservatorship is it's parasittic. i kind of liken it to, there's this vine that grows on trees and sucks the life out of it called death vine or -- and that's what this conservatorship is. every single lawyer in this case on both sides are making money off britney. so jamie, what we've seen, is doing a few performative things here and there to make it seem as though he's going to cooperate and matthew rosengard, britney's new attorney, has accused jamie of basically just doing all of this stuff to rehabilitate his reputation. so when you take all those things in mind, it's likely that this is going to still play out in the probate courts for a while based on just their financial incentives here. but i also think we should keep our eyes open for any potential criminal investigations that may also be going on concurrent to this probate case because i think there's ample evidence now to at least launch an investigation here. and if blackbox security, for example, was helping jamie to do things that are illegal, they could be liable for some type of reco charge, organized criminal activity. >> it will continue to play out not only in the court of public opinion but in probably the criminal courts. bj courville, thank you. thank you for watching msnbc reports. before we go, want to take you to the canary islands. live pictures right now of that volcano that is continuing to erupt. it is nearly 1:00 there in la palme. the pictures going out right on cue. kind of feels like "the view." you need to leave the set now. >> gladly. >> "velshi" up next. good morning. today is sunday, september 26th. i'm ali velshi. the cornerstone of president biden's agenda could be decided this week. house democrats are caught in a struggle between moderates who want a smaller, physical infrastructure bill passed with bipartisan support and progressives who want a sweeping bill with greater social safety net priorities passed regardless of whether any republicans support it. both groups want their bills passed first as a precondition to supporting the other bill and some moderates are saying they simply won't pass the larger bill because it costs too much money. the smaller bill focuses on physical infrastructure like roads and bridges. it has bipartisan support. but whether it will actually pass remains unclear. since progressives are vowing to tank that package unless it's passed in tandem with the party's larger $3.5 trillion social spending plan that lawmakers have been working through the weekend to finalize. the house budget committee approved the reconciliation package. that's the larger bill yesterday. so a bill will likely be brought to the floor this week. nancy pelosi will likely discuss the strategy tomorrow evening when she huddles with house democrats. she's asked for the fullest participation among her members and hop
