to 1.7 million. some health experts are concerned that the decline is due to complacency toward testing. >> on the covid beat force this hour. sam brock is at the super bowl in tampa. and scott cohen is in san francisco for us. guys, welcome to you both. first to sam in tampa and the prekaukss being taken to prevent a superspreader at the big game. what are the safety protocols for the attendees that you told me yesterday it was like 25,000 people get to go, right? >> reporter: that is exactly right. about 25,000 people in the stadium. that is well less than half of the capacity, alex. in addition, just getting out, they've expanded the space and everybody has to be wearing a mask if not eating or drinking and according to the nbc numbers, the numbers have dipped 22% in the last few weeks but now we have a super bowl and it is about to be game on. there will only be 25,000 fans at raymond jamts stadium for football's biggest game where strict safety protocols are in place. but for a contest that drew 100 million people to tv sets last year, it is what is going on outside of the stadium that has officials on high alert. >> we should be cracking down on events that are happening. >> reporter: at a downtown tampa hotel on friday night, video from tmz shows a dj popping champagne bottle news mouths and dancing bodies shoulder to shoulder with few masks in sight. many officers have been sickened by covid and their concerned. >> we want to not spread this disease to our families as well. >> reporter: the tampa mayor jane castor has been proactive. and we asked her about these images. >> i'm as dismayed at these videos as you are. it is not an appropriate portrayal of the majority of responsible bis owners are doing. >> why could you not go in and break up the parties. >> we see the video the same way you do, after the fact. but that doesn't mean that we have not spoken to every single one of these business owners and they all clearly know the rules. >> reporter: nationwide, the trends are finally moving in the right direction. cases are down 19% in the last two weeks. with a death toll quickly approaching half a million in the u.s., officials across country are asking people to stay home this weekend to stop another surge. >> if you're going to do a super bowl gathering, it should really be just the people immediately in your life. >> please, do not attend in-person super bowl parties this weekend. that can be a superspreader event. >> reporter: now we spoke with mayor castor again. there is another factor at play here when it concerns it the businesses. from tallahassee, orders from governor desantis have tied their hands when it comes to closing down businesses. they could issue fines for rule breaking to the businesses but that does not seem to produce the same effect. back to you. >> yeah, i agree with you. okay. sam brock, thank you so much from tampa. the big game there behind you getting underway in about four and a half hours by my counts. thank you. joining me now is medical contributor kavita patel and dr. nahid bhadelia. dr. bhadelia, you first, are you worried that the super bowl will become a superspreader event? >> i am, alex. and for the reasons that you just discussed. it is not just the eechbts itself, but a lot of the household gatherings, smaller gatherings where people let their guard down and take mir masks off because the virus doesn't take a magical break when you are eating and drinking and then start spreading again when you have the mask on. it is continuously doing that, like every other gathering so far that we've had to sacrifice this year. a huge part of the virus transmits indoors where people who are not in the same household gather and you're sharing that air and now is a more precarious time because of the b-117, the u.k. variant has been found in 33 states. it is a ironic state that just as the variants are hitting our shores is when we are at the height of our pandemic fatigue and if i could only tell people if you hang in there, vaccines are on the way. and we could make a difference. but this weekend is not the time to let your guard down. >> as we take another look at some of the videos, dr. patel, i'm curious how long it is going to take, i'm sure you share same concern, but how long will it take for people to get covid when you see people fraternizing the way we just saw in the video and the one we'll show you again. people are packed into clubs in tampa ahead of the game today. >> yeah, alex, we know that it could incubate and take days to even a couple of weeks which is why we tell people, by the way, every single person in that video shot should basically quarantine themselves for the safety of tampa and the society. they should quarentine for at least ten days if they could get access to a test on day five, six or seven. but if i were there or i knew one of them, i would say 14 days, your quarentine, you do need to do it. not because you're not worried about it, clearly they're not. but for the safety of people around them, and that is the approach we have to take, alex. people clearly do not want to listen about their own safety. but maybe if we could appeal to the safety of their neighbors and people around them that are at work or at home we could try to make some headway. >> dr. bhadelia, back to the new variants. on some of the more easily transmitted, and so i mean it very easily could become a superspreader event. >> i think when people hear this term i want them to understand what it means when we say that this is more transmissible. it means that viruses that have these mutations when they find the cells in your airways, they find it much easier to infect you. so if you walk into a room with someone who might have the variant, you're much more likely to catch the variant infection than with the old variants and much more likely to pass it on to other people and not only that but they're much better at evading your immune system and potentially reducing the efficacy of the some of the medications that we have. and so for all of those reasons, this is the period of time where we have to hunker down for a little bit closer. even if the cases are going down, we can't let the variants take a foothold because they're going to keep multiplying than we've seen so far in this pandemic. >> and there is a great deal of pandemic fatigue. so it is seeming like a real conundrum. doctors stay with us because i'm going to come back to you. first i want to go to the breaking news out of california. san francisco students could be going back to the classroom after the education department and the teachers union have now struck a deal. let's go right to scott cohen who is live in san francisco. this story, this deal, is it a sure thing, scott? >> reporter: no, it is not anywhere close to a sure thing, alex. because there is another party in all of this and that is the city and as well the state of california. there are a lot of moving parts in this whole area of trying to get students back into the classrooms across the country. including a genuine apparent breakthrough in chicago, the nation's third largest school district, we'll get to that one in a moment. but first the situation here in san francisco, where as you said, the teachers union and the school district have reached a tentative agreement that said they will get the students back into the classroom as soon as all of the staff members have been vaccinated and as soon as the city and county of san francisco, the school district move into the state's red tier. it is currently in the purple tier which is more restrictive. but nonetheless, the teachers union president said this sets the stage so safely reopen schools in san francisco and now we need them to step up and make vaccines available to the school staff now. the city is not willing to wait for any of that. they filed a lawsuit led by the mayor london breed last week basically saying that students have been turned into zoom-byes and wanting them to get the students back into the classroom now. the school district said that the lawsuit is frivolous and not helpful. >> it is important to understand that the fear our staff is feeling for the health and safety of our students, our families and communities and themselves is very real. and that pushed the efforts again as empowering us to have even safer standards for the people who do put their lives at risk when they go out every day. >> reporter: so, the school district and the union now apparently aligned. we have yet to hear back from the city. now to the situation in chicago where they do seem to have reached a genuine breakthrough, pending the teachers union ratification. the mayor lori lightfoot announce they have reached a tentative agreement in which some students will get back into the classrooms in chicago this week with more coming in as the month goes on. that agreement includes vaccination of school teachers, 1500 at the outset and accelerating that down the road. so the unions generally across the country are standing firm on wanting vaccinations for their members, even though the centers for disease control said that is not necessary to open schools safely as long as there is other mitigation in place. >> okay. >> so that is where we are now. >> i appreciate that from san francisco. relative to san francisco and chicago right now. i'm back with dr. kavita patel and nahid bhadelia. dr. patel, so this discussion around schools, we've been having these discussions for almost a year together now. is now the time to get students back into classrooms? and what do you think needs to be done to do it safely? and it could be done it right now? >> alex, in short, i've never seen a situation where we have a lose-lose-loose. we're seeing short-term repercussions. so it is the right time to talk about what we need to do to get students in-person learning in a safe way. vaccinating teachers is a must and we need to raik vaccinate the bus drivers and others and that has to be a priority and we have to have testing in place. we do not have any vaccine for those underage 16. so we still have children that get infected. much lower rate but that is a false comparison if your child is infected. so we do need to have the structures in place to keep it safe. there is no question that getting our students learning back to the way they were before covid is a universal goal and we have to work on all sides to get there. >> dr. bhadelia, a lot of teachers are very concerned after the cdc director suggested it was safe to reopen schools without all teachers being vaccinated. i'm curious your take on that? are you teachers vaccination in your mind a requirement for safe schools and everything else as well that dr. patel is suggesting. the bus drivers, the cafeteria workers, it is one giant community. >> yeah, alex, i think coming down i'm pretty much of the same mind on this. i believe with the tenant, they need to be the last to close and first to open and the equations changed for the reason that we talked about, the strains are more transmissible across all age group. it is not like they are more transmissible among kids, but unless you're putting into the testing and the vent lation and even though the cases in the community are going down, this could be another opportunity for these variants to take hold. so vaccination, ventilation and honestly all adults not just teachers because that is a lot of where the transmission could occur, among adults there these spaces as well. >> i feel better after talking with you. so thank you. they are just three letters but they bring up lots of feelings on capitol hill. what is the way forward, congressman steve cohen will tell me, next. next. i made a business out of my passion. i mean, who doesn't love obsessing over network security? >> well, alex, over the course of the next few weeks we'll get into the season of specifics. committees in the house drafting the specific legislation that will go along with the priorities that the white house and president joe biden have laid out, specifically the $1,400 relief checks to americans and hundreds of billion dollars toward ramping up vaccine distribution. but we are starting to see as these negotiations play out the balancing act that is going to have to be done even just to keep all democrats on board here. we know that they're going it alone through this more partisan reconciliation tactic. but look no further than bernie sanders and joe manchin who are sparring over the income eligibility cap for those americans that could get the $1,400 relief check. joe manchin saying he wants to see it exclude upper income americans an that is a point that most democrats agree on. but the actual number, the actual cap, that is still pretty nebulous. bernie sanders tweeted about this last night saying that if the income eligibilities for lower some americans who got checks from trump would not get them from biden. sanders capping off that point sarcastically saying that is brilliant. and this is an area where sanders is going to keep pushing forward. he said, it is not the only priority that he has right now. the increase of the federal minimum wage to $15 was initially in biden's plan. and biden now said ease not sure that could make it through the reconciliation process. bernie sanders said he will keep trying. listen. >> we've got to raise that minimum wage to $15 a hour. and as chairman of the budget committee we have a room full of lawyers working as hard as we could to make to the case to the parliamentarian, that in fact raising the minimum wage will have significant budget implications and, in fact, should be consistent with reconciliation rules. i have to get through the parliamentarian and then get 50 votes in support of raising that minimum wage to $15 an hour. >> reporter: this gets pretty complicated because in order to pass something through reconciliation it does have to prove that it impacts the basic bottom line of the federal budget. bernie sanders saying there that he has a team of lawyers who are ready to prove that and that is something sanders and others of the minimum age hike have said through reconciliation but joe biden said over the weekend in then interview with cbs that he didn't think that it would make it through this round of reconciliation but a $15 minimum wage is something that he wanted to push forward on nevertheless, maybe in a separate bill. but that is one of the unresolved pieces an we'll watch it gets fleshed out here on capitol hill. >> well i spoke with joe biden senior adviser who said they are not giving up on it yet. so to your point, thank you very much. let's go now to monica alba in west palm beach and the pending impeachment trial. so i know we don't know everything, but what do we know that we could expect to see in this trial this week? >> reporter: wellk alex, one of the most remarkable thing unfolding in the comes days is the fact that this trial will take place in the very senate chamber that rioters breached and were able to enter on january 6th. so as the lawmakers are making the case against donald trump, those impeachment managers and those house democrats, they're going to be able to point to the fact that those pro-trump supporters who got into that very room, they will argue did so because at the time the president encouraged them to, quote, fight like hell. so that is going to be quite a remarkable scene. and it is really going to show you why democrats want to use lawmakers' own testimony and accounts of what happened on that day. in addition, to the video and so many of the images that we've seen. it is quite remarkable by so many people did that did breach the ground the u.s. capitol were documenting it in realtime. so you have a wealth of evidence that not only law enforcement is using to atry to arrest some of the people but lawmakers are using it to build their case that they are arguing that donald trump is singularly responsible for this, quote, betrayal of historic proportions. so we're going to be seeing the house impeachment managers present their case and then donald trump's own defense lawyers will rebut that with a couple of points, they're going to argue this is an unconstitutional proceeding and you can't convict a former president because he's a private citizen living here in south florida. but we don't know the length of the trial. the first impeachment trial was roughly three weeks, this one right now could be in the estimation of some people participating shorter than that. only about one week. but there are so many questions about testimony and witnesses that haven't been fully answered. but we do know from senate republicans that they do not expect donald trump to be convicted. they really are bracing for an acquittal here. and we heard a little bit more about that from republican lindsey graham, a pretty close ally for most of the trump years to the former president on one of the shows this morning. take a listen. >> it is not a question of how the trial ends, it is a question of when it ends. republicans are going to view this as an unconstitutional exercise and the only question is will they call witnesses, how long does the trial take. but the outcome is really not in doubt. >> reporter: one other detail we're still waiting to hear about, alex, who the third attorney is going to be that will be added to the roster of david schoen and bruce castor, the two people currently representing and defending donald trump. there will be a third person added to that list. we're not sure who that person will be but they will be in the senate chamber trying to argue the defense of the former president. we hope to have that later today or tomorrow. >> no time like the present given that it starts on tuesday. pretrial brief is due tomorrow. thank you very much. joining me now, democratic tennessee congressman steve cohen. he's a senior member of the house judicial committee and chairman of the subcommittee on the civil rights and civil liberties. tell me how you see the next week playing out? >> i think it is going to be very difficult for the democrats to win with the jury they have. they're going to make a compelling case, there is not a more compelling case that could be made than for trying to overthrow the government, disrupt the constitution and congress performing its duties on the electoral college and what trump did. but the facts are clear. you have a jury of senators that are -- 50 of whom are republicans and to get them is nearly impossible. they have their minds closed and their blinded to the truth. >> but when you describe it that way, congressman, when you say that is very apparent, we've all seen the videos and have heard the words of donald trump, seen the subsequent actions for months and alone what happened before the capitol riot on the 6th of january, what we're looking at right there, how is it that you think these senators will not look at the tooth, the reality as you describe it, and vote to convict? why don't they do it? >> they still have a base and of the party that is filled with qanon, 3% and bug a lieus and others that could you perceive to go under red rock and bathe. they are a nasty crowd. and there were nazis, neato nazis, a nasty crowd. they are the base of the republican party today. and they don't want to lose their base and they don't want to be subject to an attack from the right at a primary. now i'm shocked there is enough of them that don't come up until four or six years from now. you think they would have some courage but they don't seem to have it. they're still the party of trump. and they still have -- are the party of invertebrae party of trump. >> so the second trial is going to look different than the first one. trump's legal team said it may be using video from protests from last summer, the black lives matter protests in the wake of george floyd and beyond. democrats are planning to use images from the insurrection. how concerned are you that this trial is going to get ugly? >> well, it is going to get ugly. anything to do with donald trump gets ugly. everything that -- i don't know what they're doing with black lives matter and george floyd, in that case there was a policeman who killed an american citizen illegally. and in this case, there were trump supporters who killed police man illegally. there -- the comparison is not there. there is no what about-ism. and they're going to depend on procedural grounds because the facts are against them. this is an invasion of the capitol, this was an insurrection and it was set off by trump. trump early in december said come to the capitol. it will be wild. what is wild about a protest. people don't come to a protest with camo gear and helmets and baseball bats, hockey sticks and bear spray. they come for the purpose of invading the capitol and they did it and that is -- and they knew it on chatter, trump had at least a dozen and probably more so people who monitored that -- those emails and those social media sites and they knew from that that they planned to come here and to take over the government. to disrupt the electoral college. and as michael cohen said, trump speaks in code, he never says directly. he speaks in code. >> i don't know about that because he did say flat that everyone needs to fight like hell basically on his behalf. but this impeachment trial, i mean, look, congressman, how divided this country is now, do you worry it will create a further divide. >> i think the republicans are so far to coming to grips with reality and the needs of american public and to get free of trump that it is impossible for us to unify with them. we've seen it simply in the month we've had since this congress has been in session. they've attacked nancy pelosi, the taylor woman has called all of the democrats an the 11 republicans who voted or the ten or 11 how many it was, morans. they stood up and applauded in their conference. kevin mccarthy has shown this is the party of qanon and you can't work with people who are not going to stand up and say they are not fine people on both sides. the fine people on both sides in charlottesville, the people there with the nazi slogans and the jews will not take our place or supplant us and take over the capitol, they are the people at the base of the republican party. >> you mention congressman marjorie taylor greene. do you think removing here from her committees is enough? i mean there are some who believe that she should be expelled from congress. where do you stand on that? >> i support jimmy gomez's resolution to expel her from congress. now she said those things aren't true, that she believes 9/11 happened. wonderful. that is like saying you believe that the earth is round. the fact that she believed it at one point questions her ability to discern reality and you should at least have the ability to discern reality and speak the truth to be in congress. she doesn't have that. the fact that she said just recently that there were -- that the roth child created lasers from space that caused the fires in california, roth child and soreos is code for jew and people that use jewish people at scapegoats for problems in society do not belong in a civilized site and she has done that and how the republican members account that is beyond me. >> congressman steve cohen always coming on and speaking your mind. thank you so much. teeld to apologize. a request from one top republican to another and this one might blow your mind. blow yd if you smell gas, you're too close. leave the structure, call 911, keep people away, and call pg&e right after so we can both respond out and keep the public safe. if you see wires down, treat them all as if they're hot and energized. stay away from any downed wire, call 911, and call pg&e right after so we can both respond out and keep the public safe. new this hour, a stunning and remarkable report from capitol hill about what happened in the hours before that big republican meet, between two key figures just a short time ago, axios reporting that house minority leader kevin mccarthy asked congresswoman liz cheney to apologize for her vote in favor of impeaching former president trump. joining me now is elaina treen. from axios. and jeff mason the white house correspondent for reuters. very glad to have you both here. i got my folks to print this article out and it is stunning to say the least. give me the details that you report here and i understand you have two sources? >> i think i should be back on. >> better, great. go, start from the top again because this is important stuff. >> my apologies. >> no, it is okay, go. >> and i apologize. essentially in the hours before that meeting wednesday night, the closed door meeting between the conference, my sources tell me that leader mccarthy told congresswoman cheney that she needed to say she was sorry to the conference and explain why she did that vote, why she went about it and apologize for the way that she handled it. and she refused. we have quotes from -- >> again, the audio is going in and out. let me pick up on that with you, jeff, i want you to get your reaction to it. let me read a couple of things that i've highlighted from the article. that liz cheney said a quote, i cannot do that it was a vote of conscience, it was a vote of principle on which i stand and still believe. and let's remind our viewers that that gop conference vote to have her maintain her number three leadership position in the republican party there, she won by more than two to one. she won 145-61. so why would ken mccarthy, according to this report, feel the need to ask her to apologize to her republican colleagues? >> i mean, it is really -- it is really something. if he did that. because certainly congresswoman cheney made clear that her vote was a vote of conscience and you can't possibly imagine that she would all of a sudden decide to go back on that because leader mccarthy asked her to. she knew the political risks of that and stood by that vote. so it is kind of -- it is terrific reporting and a stunning story. >> and let me get further into it. let me know in the control room if we have alana back with her audio. apparently liz cheney didn't go into this blind. because they did a whip count on the opponents and her team, they knew that -- well at least a fair amount of confidence that she could secure at least 142 votes. so, by the way mccarthy comment was not forthcoming. they did ask for a comment for this axios article and he declined to do so. but going forward, does this in some ways almost empower liz cheney, maybe not with kevin mccarthy but with other republicans across the country who may self describe as republicans and not trumpians. >> well, for sure it does. it absolutely empowers her with people that agree with her. that is -- that goes to the core of the divide in the republican party right now. is there are what perhaps we could start calling the cheney wing, and then there is the other side, the trumpian wing. and what mccarthy has done in the last week or two is try to show that the republican party has a tent that is large enough for both but it is not clear how long that tent could stay -- as a structure, alex. it's just -- the divide in the republican party is so strong. and you have people like liz cheney who are willing to stand up against the trumpian piece of that and then you have somebody like mccarthy who is traveling down to florida to make good with the former president at the same time. >> you know, elaina, liz cheney made it quite clear when she was spoking on fox news with chris wallace, about how she felt about donald trump and his positioning. what did she have to say to him? >> well, she made it clear that she thinks that the congressman isn't handled this right. she thinks that he should have been able to handle what happened with marjorie taylor greene and other problems without the caucus -- sorry, i'm hearing feedback so i apologize. >> i know, it is confusing. >> essentially that he should have handled this between leadership and it should have never been forced to a vote on marjorie taylor greene. and she said she refused to apologize. she's doubling down on her remarks. we heard her on fox news this morning with chris wallace where she doesn't think that trump has a place in the republican party any more and she's leaning into this and she recognizes that kevin mccarthy is not going to be doing that. we did see him in florida with him last week and he's kind of playing both sides somewhat on this issue. and everyone is trying to move forward. but there is still this division in the caucus despite them saying that there is unity and that they all could move on from this together. this is going to continue to be an issue in the weeks and months ahead, particularly as we look at fundraising and how the races play out. she's going to have a primary challenger that is more pro-trump than she is. so it is a problem despite tem saying that it is not. >> do you get the sense that cheney is not veiled but does not have a lot of confidence of kevin mccarthy's leadership in the republican party. >> i am not sure that she's gos that far. he is doing what he can as the leader of the conference to try to hold everyone together and that is why he asked her to apologize, because she is a leader within the conference. and it is not because i think that the other people who voted to impeach the president are not seeing the feedback because they aren't in leadership. she is number three within the house gop conference and so that is why she's getting this pressure and i think as for the leadership, she did make, i guess, some sort of swipe at him this morning about the way that, what happened with marjorie taylor greene went down but the end of the day she's not trying to criticize the gop leader but show that she's distinct from the views that he and others in the party hold. >> okay. jeff, given your experience covering not only the trump administration but now this current biden administration, how do you think that the headlines will play out this week ahead both with the impeachment and with all of the things that joe biden is hoping that his administration will be able to focus on, not just impeachment but the things that he wants to accomplish? >> sure, well i mean i think it is a challenge for this white house. and they've been trying to walk that line for the last couple of weeks. recognizing that the impeachment process is important and that the senate and the house that brought the impeachment charges have a right to hold former president trump accountable while at the same time really trying to move on and elaina used that phrase as well, move on. it is hard to move on. and after what happened on january 6th. and that is what the impeachment process is all about. but president biden has an agenda that he is trying to push forward from the covid relief bill to multiple other policy areas. and that is going to be hard this week. >> sadly i have to move on. i'm out of time. thank you both so much. what voters have to say about trump's second impeachment trial. you'll hear the divide in wisconsin, next. e divide in wisconsin, next. tlong. or on any new protein bowl! so many ways to go pro at subway®! it's not amateur-tein, it's pro-tein, baby! go pro and get double the protein for just $2 more. subway. eat fresh. introducing fidelity income planning. we look at what you've saved, what you'll need, and help you build a flexible plan for cash flow that lasts, even when you're not working, so you can go from saving... to living. ♪ let's go ♪ ing gain flings, from saving... to living. their laundry smells more amazing than ever. ah, honey! isn't that the dog's towel? >> reporter: well, alex, we've had some thoughtful discussions with folks on both sides of the political aisle and what they tell me kind of breaks down into two categories. republican voters that i've spoken with tell me that feel hooimt is unnecessary and calling it a political side show, whereas democratic voters feel that it is important that the secondary impeachment trial takes place to hold president trump accountable for the actions and the rhetoric at the capitol. that is going a step further than the republican voters told me. they didn't draw the through line at the same level. take a listen to the conversations with both republicans and democrats here in milwaukee county. >> if the language in the constitution allowed that, by all means continue doing it. but it is something where it is a political agenda or there is bias or a motion behind it, i think it is time to move on and start progressing as a group of people, us americans. >> what are we doing to hold the other elected officials accountable for their actions as well. i think that is going to have more of an impact to me than who currently have power than to have somebody that previously had power. >> reporter: so you're getting both perspectives there on either side of the political aisle. and this is an area that is politically diverse, in the suburbs of milwaukee where we are. it is going blue in the last few elections but this is a state which as you know joe biden won by just 20,000 votes and 15,000 additional votes came in this turnout for 2020 from this very country. the one other point, is that among the voters when speaking about impeachment, a number said instead of focusing on impeachment, they want to get back to work and investing in small businesses again. we spoke at length about president biden's stimulus plan and the $1,400 as part of the $1.9 trillion passage through congress and i asked the republicans would this make a difference in your life, do you see this as a step forward with that bipartisan agreement and they say, look, for some people that would make a difference but we rant to see this come back into the community affecting those small businesses and helping getting people back to work. so we're really seeing a lot of the different perspectives here and as the conversation continues it is interesting with the impeachment try starting on tuesday if that will reverberate in the communities itself. >> you will let us know. amanda golden, thank you so much. so there is cause for a big celebration today but not just because it is super bowl sunday. it turns out there with 28 other reasons. curious?
