good from the carquinez bridge to the macarthur maze. at the bay bridge, not much of a commute at all. a lot of people are going but a lot of people have the day off. this is 880 in oakland. we're seeing good commutes. even when there have been crashes, they have been moved to the shoulder and haven't caused any slow traffic really. this will be the pattern from now to after the new year. unless something bad happens on your commute. we won't have a typical commute next week either. 7:02. back to the desk. >> a lot of people are trying to get home or away for the holidays. according to aaa, san francisco could be the most grid locked city in america this holiday season. >> can you believe that? we want to get you to where you're going safely. leigh martinez is in pleasant hill with this busy travel period. good morning, leigh. >> reporter: that's right. aaa is saying that your commute today could take twice as long as a typical bay area rush hour commute. you're looking at 680 south right now. traffic is moving. it is moving pretty well. but you are seeing quite a few lights out there. and today will likely match yesterday as the busiest travel days for the christmas holiday season. check out the video that we have of the evening rush hour on the bay bridge on thursday. brace yourself for a repeat of that again tonight. it looks like a lot of heavy holiday travel as soon as people leave for work today. chp is having their maximum enforcement patrols beginning at 6:00 p.m. gas prices are higher than last year. but that is just not stopping people from traveling. in fact travel has increased year after year. you are advised to get on the road early or wait just after the morning rush hour to start your holiday commute. now, if you can wait to drive on christmas day, now, that will be your best bet for avoiding other drivers on the road. so, again, you're taking a look at 680 south. we are seeing the morning commute. again, you're advised by aaa, if you can wait until after this traffic, this morning's rush hour, that will be a good time to hit the road. again, wait until christmas day. that will be the time that you won't see anybody else out on the road. they are warning you -- we're also getting warnings from the fire department down in southern california, if you are traveling to southern california for the holiday, they do still have wildfires going. they advise you to just plan an alternate route. always check to see what exactly the activity is in the area. plan ahead for that just to be on the safe side. back to you guys. >> $3.11. in san jose, it is about $3.08. today is expected to be one of the busiest air travel days. we will look at airports across the country. oakland international is expected to see a 7% increase in passengers over last year. oakland is certainly not alone. airports across the bay area are expecting huge crowds today. aaa says 6.4 million americans are expected to pass through airports this holiday season. that is expected to be the busiest on record. sfo had their busiest day yesterday but more crowds are expected today. they estimate 168,000 passengers went through the airport. that's about the population of berkeley, emryville and albany combined. the big crowds led to serious lines. >> it went all the way to the back. how many people would you say? a thousand people waiting in line. i don't know. >> usually it is like a breeze at san francisco airport. they've got us moving now. we will see how it goes. >> for those traveling by car, the highway patrol is reminding drivers to be careful this holiday season. the chp of course is doing the holiday crackdown. maximum enforcement starts tonight at 6:00. they want to get drivers to where they need to go in a safe manner. 76 people were killed in car crashes across the state last holiday. tsa expects 40 million people to go through security check points this holiday season. tsa is using overtime and extra hours for part-time agents to fill the positions and they are using k-9 teams to speed up security lines. the time is 7:06. we're keeping an eye on washington. we're waiting for president trump to sign that landmark republican tax overhaul bill. officials are indicating that he may sign it before he leaves washington to go to florida to his estate. he is due to fly to palm beach, florida in a couple minutes. the white house announced moments ago he is delaying his trip until the next hour. the tax overhaul is considered the first major legislative achievement for trump and the republicans since he took office. in the meantime, congress passed another stop gap spending bill that will keep the deposit from shutting down today. some democrats from republican- leaning states joined republican lawmakers in approving that spending bill if they had not, most federal agencies would have run out of money and would have shut down at midnight tonight. this temporary spending bill gives short-term funding for the chip program that provides medical care to almost 9 million low-income children and adds money for the pentagon and for veterans. the debate about this was brief but passionate for the spending bill, also known for cr, continuing resolution. >> let's call it cr for what it is. a chaotic retreat from rational regular order and fiscal responsibility. >> play politics on tax cuts. call it whatever you want to call it. play politics on all of the other legislation that comes to this floor. but if i can request one thing, please don't do it here. >> now, the bill did not address a lot of issues that the democrats wanted to settle before the new year; including extending protection for undocumented immigrants under the daca program, the deferred action for childhood arrivals program which will expire in march. an investigation into several suspicious fires in antioch. at 7:30, we will tell you where they happened and the search underway for whoever started them. recovery efforts following the terrible north bay fire. what could be done in the neighborhoods hardest hit. good morning. we do have traffic that is obviously lighter on some commutes. although this commute here, highway 4, has been a little bit marred by an earlier stalled vehicle. a little slow coming over the hill. well, it is still cold enough. a few high clouding are coming in but not before the freeze warning was extended to 9:00. we will look at the temps that are quite cold. a pretty sunrise for those listening, not watching. >> the time is 7:11. in ventura county, officials have lifted most of the evacuation fires from the thomas fire. it drove 100,000 people from their homes at the height of the fire. only a remote wilderness valley is under evacuation fire. it is the second largest wildfire in california's history. officials say it is on the verge of becoming the largest fire ever in california. the wildfire is responsible for two deaths and the destruction of 750 homes. pg&e is making progress in fire ravaged communities in the north bay. all of the power lines in coffey park will be restored today. construction crews have installed the poles and transformers in the santa rosa neighborhood that lost an estimated 1,000 homes during the tubbs fire that started back on october 9th. pg&e crews are building temporary overhead power lines in the mark west springs estates where power should be back on after the new year. california is asking insurance companies to relax some of their rules when determining the amount of property losses they will cover. homeowners who have lost everything in the fires are complaining they have been force today put down all of items they lost in a detailed inventory list. that is difficult and time consuming. the state insurance commission wants that requirement to be waived while speeding up the payout to claims. while congress took action to prevent a government shutdown last night, it did not pass the disaster aid pill that among other things would have happened california wildfire victims. the measure cleared the house but stalled in the senate despite i am passioned speeches from delegates representing those states. >> it was the costliest disaster this year and may well prove the costliest natural disaster in u.s. history. >> we need washington to act on the pressing needs of houstonians. it needs to flow down to the local communities. >> republicans didn't like the spending with no plan to offset the cost. democrats say the measure was not enough. the time is now 7:13. last night, san francisco's chinese community held a vigil for late mayor ed lee in portsmouth square. >> that was a loud thank you to the mayor. this was a chance for the chinese immigrants and senior citizens that were helped by mayor lee to celebrate his life and legacy. >> ed was definitely a role model. you know, ed was a friend. ed was, you know, a mentor and just as a young attorney coming up and trying to do right by the community. >> in his quiet, humble way, he was able to bring the city together, to focus on the issues and not on the politics. >> the people at the vigil were sad but their spirits are lifted by ed lee's legacy of hope and community activism. the mayor will be buried here in the bay area, not seattle where he was born and where his mother still lives. they plan to bury his ashes at cypress lawn memorial park. the family released a statement, thanking everyone for their support. thank you so much to everyone who reached out to our family with condolences, memories and a shoulder of and the bay area freeze warnings have been extended until 9 a.m. steve has been telling you about. the temperatures are in the 20s, 30s and 40s so far this morning. the national weather service says the freeze warning in effect in the inland locations and right along the san francisco bayshore line. and relief shelters are opening up here in the bay area because it is so cold. that includes warming centers in san jose. san jose is turning a dance studio at the roosevelt community center into four warming centers. they will be opening overnight through next tuesday because temperatures will be dropping to 40 degrees or lower. at 7:16, not everyone going to work today, sal. some people may be getting a jump on the holiday travel. you are seeing some people on the roads. >> that's right. i think the afternoon commute is going to be a tough one for people getting out of town. the morning commute is not much. i don't think a lot of people are going to work. they're traveling. they're going to the airport, the train station this afternoon or in the evening. right now, highway 4, we had a stalled vehicle. that's why traffic is a little slow. but once they got that vehicle off the roadway, traffic is recovering rather quickly. so that is what happens when volume is lighter. it is not completely light as you can see. but it is much better than normal. 18 minutes. we haven't moved from that time from the carquinez bridge to the macarthur maze. and the bay bridge toll plaza doesn't have a lot of slow traffic. so, again, it continues to be a lighter morning commute. minus 15 at livermore airport. you can see the higher clouds coming over the top. the easterly breeze, instead of the north wind which held the peninsula temps up yesterday, not only the peninsula but the solano county temps were held up. now it is southeast. that brings the cold air back in. 32 in fresno. fresno dropped to 29 this morning. 31 in santa barbara. speaking of southern california, they have the easterly component. they can't get away from that. another red flag warning has been issued. there is also a freeze warning embedded in that round. a red flag warning continues all the way down to l.a. for high fire danger. that's not the whole month. 7 in flagstaff. las vegas, 34. 43 in san diego. that's cold. the higher clouds will continue to be on the move in the next couple of days. over time, that will bring our lows up. i'm not thinking there is any rain with it. the high clouds are it. mostly cloudy over the weekend. the rain looks like it stays well to the north. that will be very light. after monday, christmas, then we look for nothing. we may have to wait until january before we think about rain. 50s on the temps here. it looks like temperatures will warm up, if goodwill store helps us put people to work in the community through the job training and job placement programs. >> police say the robber was a white man between 40 and 50 years old. he had a thin build. he was last seen wearing a dark gray hooded sweatshirt, a black jacket and gray hat. if you have any information, call concord police. an oakland man is accused of sending two mail bombs. we will share a mug shot of ross gordon from a previous arrest in 2015. he was arraigned in federal court yesterday on one count of mailing an explosive device with intent to injure or kill. that injured a man in east palo alto in october. an identical mail bomb was sent to an officer on bay farm island. the officer was at work so his wife opened the package and suffered hearing loss and minor burns when it exploded. investigators say the alameda officer interviewed him in 2013 as part of a drug and burglary case. the time is 7:26. do you remember how we told you that apple fessed up to slowing will sign the tax bill in a matter of minutes. he tweeted that he is going to sign the landmark legislation at 7:40 our time this morning. s he is delaying his trip to florida by an hour for the signing. democrats say it slashes corporate taxes while not doing enough for middle and low- income families. many bay area roads will be congested today as people begin their christmas weekend. the mac mum enforcement period for chp begins at 6:00 tonight. aaa predicts that 107 million americans will travel during the holiday. holiday travel has been up for nine straight years. to the east bay where several suspicious fires in antioch are being investigated as arson. they started last night within minutes of each other. christien kafton is in antioch. this is the third time that the building behind you has burned. >> reporter: yeah. that's right. certainly looking very suspicious. we're here at acacia cremation and burial site. they have moved the business. there have already been two suspicious fires here, one in june and one in october. it prompted the business to close its doors here and move to another location. this is just the latest of a series of fire going back months at an accelerated pace. crews responded to the first fire in the neighborhood last night. while they were on their way to a series of fires on mcdill a few blocks away, they received calls about six separate fires. at the time it appears that all of the buildings were abandoned. that may be why no one was injured. all of the fires started within minutes of one another. >> we have no reports of injuries and the investigators are looking into the cause of the fires at this point. we believe that all of the fires are likely set fires. so we are investigating them as arsons. >> reporter: yeah. we have talked with neighbors here in the area. they tell us that they believe that this is the work of either a serial arsonist or a series of arsonists. there have been a series of fires here. one in a dumpster at a florist and a fire at a church. to give you a sense, those buildings are just up a street from where we are standing right now. as one of those people was taking eyewitness video here at the scene, i could hear in the background them saying, quote, another fire here on a street. so certainly a lot of neighbors here concerned about what seems to be a series and an escalating series and accelerating series of arson. back to you. >> thank you, christien. the time is now 7:35. we have new information about yesterday morning's deadly freeway crash. we told you about it as breaking news. the man died when his car collided with a fedex big rig. it happened on interstate 880 near the coliseum yesterday. paramedics and firefighters tried to save his life. but he died there at the scene. the fedex truck overturned in the crash, causing major traffic jams. the chp closed all southbound lanes for about five hours so officers could investigate and the crews could clear the road again. the chp confirms there was also a third vehicle in the crash. so far they have given us no details about that other accident. the time is 7:35. well, police in santa rosa are searching for a man who stabbed another man last night at a restaurant. just before 6:30 last night, police responded to lol a's market. the market has a restaurant in it. now, police say this man captured on surveillance video got up from where he was sitting in the restaurant, walked over to the table where another man was sitting and stabbed him in the neck. police say the two men had not spoken to each other. and police don't know of a motive yet. the stabbing suspect ran away. again, take a look. the victim was taken to a hospital with a life threatening injury. if you have any information, call santa rosa police. a richmond police sergeant accused of firing shots inside of a san francisco hotel last sunday is set to appear in court this afternoon. phillip sanchez is facing felony gun charges. he was arrested after being accused of firing several shots in the four seasons. the off duty sergeant was acting strange before the shooting and was taken to the hospital for evaluation. no one was hurt by the gunfire. a teacher in concord for a program for disabled adults was arrested and accused for having sex with one of his students. he taught through the adult education program of mount diablo. the alleged victim is an adult with the mental capacity of a young teenager. gonzales was placed on administrative leave and is being held on bail. the san francisco symphony cutting its ties with famed conductor charles. he was accused of sexual assault. three opera singers and a classical musician says that they were sexually assaulted between 1985 and 2010. he was the artistic director and principal conductor of the royal philharmonic orchestra. the orchestra says he was released from his duties while these reports are being investigated. before the allegations, he was also scheduled to be a guest conductor for the san francisco symphony for two weeks in april. so far, he has not responded to the allegations. and berkeley police want your help. they want to find this man who is accused of attacking a female jogger earlier this month. these images were released of the suspect. investigators say he tried to grab the jogger along 9th street along hines avenue and aquatic park. a surveillance camera caught pictures of him as he ran away. police say the victim did not have to go to the hospital. iphone owner are suing apple over software that slows down older phones. wednesday apple admitted that it deliberately slowed down iphones to prevent unexpected shutdowns when the batteries were worn out. yesterday two iphone owners filed a lawsuit in los angeles saying they never consented for apple to slow down the older iphones. apple insisted it is not slowing them down for them to buy newer phones. a new battery for an iphone will peace, dick enberg. eric schmidt the chairman of alphabet is stepping down. the 62-year-old billionaire will become a technical adviser and will continue to sit on the board after stepping down next month. according to the company's latest proxy filings, he holds shares worth about $5 billion. a number of new state laws will take effect in the new year. passengers and drivers on tour buses will now have to wear a seat belt. starting january 1st, ammunition sales in california will have to be made through a vendor licensed by the department of justice. gun owners will also be banned from importing ammunition from outside of the state unless it goes through a licensed vendor first. also several new cannabis laws go into effect on january 1st. california's population has grown to almost 40 million people. new reports say california's population grew by 301,000 people to now 39.6 million. that's a growth rate of almost 1% and almost double the population of california back in 1970. of the nine bay area counties, santa clara county is the most populated, growing to 1.9 million residents this year. california also takes the top spot in the country as the most populated with a quarter of residents living in los angeles county. today is the deadline for people to sign up for health insurance under covered california. last friday was the original deadline but was extended because of a surge of demand. covered california says 10% more have signed up compared to last year. people have until midnight to sign up for coverage that begins january 1st. a report from the nevada's governor office shows that tesla received more than $150 million in tax breaks this fiscal year from nevada. it is all part of a deal that brought tesla's giga factory to industrial park east of sparks, nevada. tesla doesn't have to pay anything back as long as it meets its goals over ten years. it employs 1300 people who earn about $45 an hour. get ready for another busy day on the road. landmark legislation at the white house minutes ago. he delayed his christmas trip to florida for the signing. this is his first length tiff achievement and republicans since the president took office in january. they say it helps the middle class and creates jobs. democrats however say it benefits the wealthy and corporations at the expense of lower and middle class families. air force one is preparing to take off as the president heads out of the white house. i believe he will be spending the holiday at his home in florida. so certainly we do expect to see the president on the move very soon this morning. in the meantime congress has passed another stop gap spending measure to avert a government shutdown. most federal agencies would have run out of funding and shut down tonight at midnight. it is a temporary spending bill that provides short-term funding for the chip program. it provides almost 9 million low income children with medical care. it adds money for the pentagon and veterans. the bill is known as cr, continuing resolution. >> let's call this cr for what it is. a chaotic retreat from rational regular order and fiscal responsibility. >> play politics on tax cuts. call it whatever you want to call it. play politics on all of the other legislation that comes to this floor. but if i can request one thing, please don't do it here. >> the bill does not address many issues that the democrats hoped to resolve before the new year, including an extension for 800,000 young undocumented immigrants under daca, the deferred action for childhood arrivals program that expires in march. a lot of people are trying to get home or away for the holidays. according to aaa, san francisco could be the most grid locked city during the holiday season. leigh martinez is live rush hour here in the bay area. we are looking at 680 south right now and it doesn't look that bad. some people in the starbucks parking lot said they were pleasantly surprised the traffic was moving as well as it is. you are advised to get on the road early or just after the morning rush hour to start your commute because traffic will be worse this afternoon. today will match yesterday as the busiest travel days for the christmas holiday. check out the evening rush hour at the bay bridge on thursday. brace yourself for a repeat of that again tonight. it looks like heavy holiday travel as soon as people are getting off of work. now, one mother left vallejo this morning to head to san diego. she worries about the commute along with the southern california wildfires. >> with my little kids, i am worried. hopefully we make it there. >> reporter: we can't stress enough how important it is to remain patient and vigilant on the roads. over the thanksgiving holiday, chp says that 76 people were killed in car crashes across the state. now, tonight chp's maximum enforcement patrols will begin at 6:00 p.m. so, again, you're taking a look at 680 south, just outside of pleasant hill here. traffic is not looking as bad as we have seen it before. and, again, people are pleasantly surprised how light traffic seems, considering that they figured there would be a lot of holiday travelers out there tonight. if you can wait until christmas day to do your holiday traveling, we're told that is the best time to go because there will be few drivers out on the roads. push it to the travelers from last year with 750,000 people passing through the airport from now until january 1st. oakland is not alone. airports across the bay area are expecting huge crowds today. aaa says 6.4 million americans are expected to pass through airports across the country this holiday season. it is expected to be the busiest on record. sfo had its busiest day yesterday. big crowds are expected again today because of the holiday rush. they estimate 169,000 passengers went through the airport yesterday. that's about the population of berkeley, emryville and albany combined. and those big crowds led to some serious lines. >> it snaked all the way to the back. i don't know. how many people would you say? a thousand people waiting in line. i don't know. >> usually it is like a breeze at remote wilderness valley is under evacuation orders. it burned 425 square miles. officials say it is on the verge of becoming the largest fire ever in california. it is responsible for two deaths and the destruction of 750 homes. here at home, pg&e is making some progress in fire ravaged communities in the north bay. officials say all of the temporary overhead power lines in coffey park will be replaced today. they have installed 226 poles and 155 transformers in the santa rosa neighborhood that lost an estimated 1,000 homes during the tubbs fire that started back on october 9th. pg&e crews are also building temporary overhead power lines in the mark west estates where power should be back on after the new year. california is asking insurance companies to relax some of the rules when determining the amount of property losses they will cover. homeowners that lost everything in the fires are complaining they have been force today put down all of the items they lost in a detailed inventory list. residents say that is difficult to do and time consuming. the state insurance commissioner wants that to be waived while speeding up the payout to claims. the government did not pass an $81 billion disaster bill that would have helped the wildfire victims. it was designed to help hurricane victims in texas, florida and puerto rico and those affected by the wildfires here in california. the measure cleared the house but stalled in the senate despite i am passioned speeches from delegates representing those states. >> hurricane harvey was the costliest disaster this year and may prove to be the most costly in united states history. >> we still need washington to october on the pressing needs of houstonians. we need it to flow down to the local communities. >> the $81 billion aid package was attacked from both sides. dranks said the -- democrats said the measure was not enough. last night the chinese community held a vigil for the late mayor ed lee. it was a loud thank you to the late mayor. organizers say this was an opportunity for the many chinese immigrants and senior citizens that the mayor helped in his years of service. >> ed was definitely a role model. ed was a friend. ed was a mentor. and just as a young attorney coming up and trying to do right by the community. >> in his quiet, humble way, he was able to bring the city together to focus on four months old, raymond and melissa learned their son was suffering from a rare and fatal liver disease and he would eventually need a liver transplant. they would move their lives from sacramento to stanford medical center where he would undergo a procedure to delay the transplant. >> his skin wasn't yellow anymore. he came out well. two weeks later, he started going downhill again. >> reporter: noah returned to the hospital, eventually going to intensive care. >> they intubated him. they put him on life support because because his liver was failing. >> reporter: on august 24th, as doctors searched for a suitable transplant, noah was baptized. >> i think it was around 5:30, 6:00. >> uh-huh. >> and it was 9:30 when we received the call. >> the next day. >> the following day. >> the following day. >> that they had -- they had found a donor. a suitable match. >> reporter: hours later, noah received that liver transplant. the donor, a teenage boy. that's all they have been told. city is turning a dance studio at the roosevelt community center into one of four warming centers that will be open overnight through next tuesday as temperatures fall to 40 degrees or lower. send it the top stories we're following this morning. here is advise of president trump announcing the signing of the landmark tax reform bill. >> this is something that republicans wanted for years and democrats wanted for years but yet it never got done. who would object to trillions of dollars being brought back into our country? nobody. >> the 1.5 trillion dollars tax bill was approved by the senate earlier this year. democrats said it benefited the rich and big corporations at the expense of middle class and lower income families. some bay area roads will be congested today as people begin their christmas weekend. some people hit the roads last night, in hopes of beating the traffic. adam housley says that aaa predicts this is the ninth straight year that holiday travel is up. >> reporter: plenty of cars already on the road as the busy holiday travel season kicks off. more than 107 million americans are expected to hit the roads, rails and airports between now and january 1st, a new record. the vast majority will be driving. and winter storms are threatening to slow these folks down with 22 states from the rockies down to texas and east to maine under snow and flood alerts. >> the weather can be unpredictable. we want drivers to be prepared to driver in whatever conditions they might wake up to. >> trying to get home and enjoy the holidays. probably slow things down and get out early and head back and get in the house. >> reporter: it is just as crowded at major airports across the country. long lines at security check points being reported from new york to los angeles. for some passengers, just getting to the airport was a challenge, while others were shocked by the wait times once they got inside. >> there was a ton of traffic just getting with the shuttle to get here was a bunch of traffic. we don't usually have that. >> it snaked all the way to the back. how many people would you say? a thousand people waiting in line. >> reporter: airport staff doing their best to keep things moving as smoothly as possible. >> travel can be really stressful. so we have increased staff to make sure that we can get people through the security check points. >> reporter: if you're one of the 97 million americans hitting the roadways this holiday season, the gas price is down. along the 405 freeway where people are probably heading to the bay area, i'm adam housley, ktvu fox 2 news. several suspicious fires in antioch are being investigated as arson. they started last night within minutes of each other, just blocks apart. >> ktvu's christien kafton report that's one building has not the target of arson before. >> reporter: take a look at the damage to the building behind me. in fact the business had to move because of a series of fires. they already had two suspicious fires here in june and october. that prompted the business to close its doors. then there was last night's fires. this is the latest in a series of fires going back at an accelerating rate. neighbors were on scene last night and shot cell phone video of the fire. crews were on their way to a call at mcdill just a few blocks from the current location and they received additional calls about additional fires. in all, six fires. at this time it appears that all of the buildings were abandoned. that may be why no one was reported injured. people living and working here in antioch say there appears to be a serial arsonist at work. >> sure. these businesses are, you know, people we know. you know, they're families supporting families, selling their flowers or whatever it is. somebody takes their livelihood away. >> it is frustrating. >> yeah. it is. >> reporter: as you heard, just this week, there were two other suspicious fires. one in a dumpster pushed kafton, ktvu fox 2 news. now to new information an a deadly friday crash we brought to you as breaking news yesterday on mornings on 2. the man died when his car collided with a fedex big rig. he was an off duty ups driver. this happened just before 3:00 a.m. on 880 near the coliseum in oakland. paramedics and firefighters tried to save the driver but he died at the scene. the fedex truck overturned during the crash that prompted a shutdown of the southbound lanes on 880 for five hours so crews could clear the scene and investigate. there was also a third vehicle involved in the crash. so far they have not released more information on what happened. a sergeant accused of firing shots inside of a san francisco hoe telephone last sunday is scheduled to appear in court this afternoon. he was arrested after being accused of firing several shots in the four seasons hotel. witnesses say the off duty sergeant was acting strangely before the shooting and was taken to the hospital for evaluation. no one was hurt by the gunfire. a teacher in concord at a program for developmentally disabled adults was arrested and accused of having sex with one of his students. gonzales taught through the mount diablo school district adult education department. the alleged victim is an adult with a mental capacity of a young teenager. gonzales is being held on $2 million bail and was placed on administrative leave. iphone users are now suing apple because of them slowing down the phones when the batteries were worn out. they say they never consented to apple to slow down the older iphones. apple insisted it is not slowing them down to get people to buy newer models. it is possible to buy a new battery for the older iphones at a cost of $70. kohl's stores will stay open 24 hours until 6:00 p.m. christmas eve. toys r us will stay open around the clock until 9:00 p.m. on christmas eve. tomorrow, saturday, is expected to be one of the biggest shopping days of the year. the give away earlier this month. organizers are still accepting donation because as of last night they were about 1500 toys short. sacred heart also needs volunteers both now and into next month. in addition to handing out toys, organizers are holding a rafael to give away bicycles. as a reminder, our one warm coat collection drive is going on right now. donate a new or gently used coat, sweater or other winter items at several drop-off locations in the bay area. as well as ups stores and big o tires. you can also donate anywhere at one of those locations. there is a new santa bringing santa. >> i had to stop and shed a tear. it hit me, the power of santa claus. >> all right. >> reporter: he sees things a little differently. for him playing santa is a way to bring different races and backgrounds together. >> give them a different perspective. that santa is not one way or one color. >> reporter: martin hopes those that see him don't focus on the color of his skin but for the message and the power that santa brings. >> santa is just santa claus. he is just santa. at the same time i have never seen a black santa or an asian santa or hispanic santa. it is a special role. >> reporter: a role that martin takes pride in. for nine days, he dons the red suit. as we found out, getting into it is not easy. martin, i mean santa, even needs a little h once he is dressed and and he said are you real? i said i'm real. i'm real. it was so cute. >> reporter: although he only gets to play this role once a year, the smiles and joy that he gets to see is well worth it. >> if look back at his career coming up after the break. >> welcome back. hall of fame sports broadcaster dick enberg has died. he passed away last night at his home in la jolla reportedly of a heart attack. he was best known for saying oh my during his play by play. he spent 25 years at nbc sports and worked at cbs and espn as well. he was the play by play tv voice of the padres but retired last year after seven seasons with the team. family members believe he had a heart attack. the 49ers general manager tweeted this morning, sad morning waking up to learn of the passing of dick enberg. hailing from san diego, he was a friend to my wife's and my family and such a kind man. prayers to his family. rest in peace, dick enberg. the san francisco symphony has cut ties with the famed conductor after being accused of sexual assault. three opera singers and a classical musician told the associated press that they were sexually assaulted between 1985 and 2010. he was the artistic director and principal conductor of london's philharmonic orchestra. this morning the orchestra said he was released from duties while the reports are being investigated. before the allegations, he was also schedule today be a guest conductor for the san francisco symphony for two weeks in april. he has not responded to the allegations so far. berkeley police want your help in finding a man accused of sexual battery against a woman jogger earlier this month. authorities have released these images of the suspect. investigators say he tried to grab the jogger along 9th street near hines avenue in berkeley aquatic park. police say the woman did not need to go to the hospital and had never seen the man before. santa rosa police are searching for a man who stabbed another man last night at a restaurant just before 6:30. officers responded to lol a's market. that market has a restaurant in it. police say this man captured on surveillance video got up from where he was in the restaurant and walked over to the table where another man was sitting and stabbed him in the neck. police say two men -- the two men had not spoken to each other and they don't know the motive for the attack. the stabbing suspect ran off. the victim was taken to the hospital with life threatening injuries. anyone with information on the case is asked to call santa rosa police. the corner of golden gate park is now named after robin williams. williams was a big supporter of the annual free comedy day in the park. it has been held at sharon meadow for 20 years. back in september when the city announced the plan, mayor ed lee said it was fitting to name the field after williams because he brought so much light into the world. well, a marine veteran deported to mexico 15 years ago is now back in the u.s. marco chavez crossed the border into san diego county yesterday. he first came to the u.s. in 1973 when he was just six months old. he received a green card in 1989 through the reagan administration's amnesty program. he sent four years with the marines and received an honorable discharge. earlier this year, governor jerry brown pardoned chavez for a 1998 conviction for animal
