(ken) 87-year-old woman says her mother was abused at a north bay medical facility.(pam) today, a lawsuit was filed against the napa valley care center in napa... for elder abe, and negligent hiring and supervision. kron4's j-r stone .. in napa with details. this is 87 year old vivian yocum. her daughter, lori reed says that in this picture she has diaper rash creme on her lips. one of a number of reasons why reed says she is suing the napa valley care center in napa. recalling another moment last month when her bedridden mother was left naked and shivering in bed.sot it's just continuel....when i walked in she was shivering shaking crying....i just think they don't care.this picture of lori and her mother was taken back in may of last year. she says her mom has been hospitalized since getting pnemonia and then sepsis. she has lost quite a bit of weight since this photo was taken. reed claims that her mother has been left to lie in a soaked and soiled diaper for hours on many occasions, left lying in pools of her own vomit, and prescribed an anti-biotic to which she is severly allergic to multiple times. the lawsuit filed claims elder abuse and negligent hiring and supervision.sot they can see her hear her from sitting at her desk they can see her so there are lots of opportunites for them to change her diaper...a lawyer representing the napa valley care center says they have not yet been served with the lawsuit but maintain a high standard of care and are in compliance with all regulations. reed disagrees saying that she has picture after picture to prove it. reed says this picture shows dried milk along the table where her mom was served food. she also believes that table was moldy and that's what can be seen here.soti feel like if i'm not there every day they just don't care and like i said it's hard to even talk about because it's been very very heartbreaking not only to experience but to watch your mother go through that. it's been difficult.in napa, j.r. stone kron 4 news. (ken) the south bay family of a woman killed by police ... says, officers murdered their daughter... and they want charges brought against them. jennifer vasquez was shot and killed on christmas morning. but san jose police say the shooting was justified kron-4's charles clifford tells us what the family is demanding now... natswednesday afternoon, the parents of jennifer vasquez spoke to the media on the spot where their daughter died christmas morning. they are pleading for the district attorney to take a closer look at the case because they believe the police department is not being forthcoming about what happened. lydia jimenez read a statement prepared by the family.sotsan jose in the early morning hours of christmas day committed cold blooded murder against jennifer vasquez.this all started early on christmas morning, when san jose police officers responded to reports of a shooting near san jose city college. when officers arrived on scene they spotted and pursued a white vehicle leaving the area, believing it may have been the suspect in the shooting.. following a high speed chase through city streets, the car crashed into a fence here near the interection of fruitdale and leigh avenues. according to the san jose pd, the driver of the vehicle, jennifer vasquez, then attempted to ram police with her car, prompting four officer to open fire.nats vasquez was killed and a passenger in the vehilce suffered non life threatening injuries. upon further investigation, police determined that vasquez was not the suspect in the earlier shooting but they believe her actions prompted the officers to use deadly force.sotbut jennifer vasquez's family believes the officers murdered their daughter and they want charges brought against them. sotthe community and the family ask you, district attorney, to follow the facts and file accordingly.finally, the family is also asking that san jose police release any body cam or dash camera video that may have recorded the incident. the police department has said that because their are multiple investigations still ongoing they will not be releaing any video. in san jose charles clifford, kron 4 news. kron 4 news. charles clifford, kron 4 news. (ken) (ken) in the east bay... a new judge has been assigned to the criminal trial on the deadly ghost ship warehouse fire in oakland. 36 people died in the fire two years ago. ghost ship master tenant derick almena and creative director max harris are charged with involuntary manslaughter for those deaths. the case is now turned over to superior court judge trina thompson. the criminal trial is scheduled to begin on april 2nd-- and thompson says she expects it to last anywhere between two and six months. (ken) new year's eve celebratory gunfire injured another victim in the east bay. a 28-year-old mexican tourist was struck in the hand... just 12- minutes into the new year ... at a party at a san leandro home, on east 14th street, near the border with oakland. police say , the man told them, he was in the backyard of the home when he feft something hit his hand... and when he looked down a bullet was on the ground. police say, the bullet grazed the man but did not enter his hand... also, they don't know where the gunfire came from and are still investigating. (pam) a 14-year-old teen is in the hospital tonight ..in critical condition.. after he was hit by a car in oakland. police say.. it happened in the 11-hundred block of 35th avenue ... near the fruitvale bart station. according to police, the driver failed to stop .... and dragged the boy four- blocks. the car was recovered.. but police are not releasing any details about it. police are working with bart police, as well as a-c transit, to see if there is any video of the incident. oakland police are asking the driver of the vehicle and the passenger to turn themselves in. (pam) on the peninsula... palo alto police have arrested this man.. 28-year- old daniel alveraz, who they say is responsible for sexually assaulting a woman. the assault happened early saturday morning, on el camino real in palo alto. a woman was unloading items out of her car.. when she was attacked. the victim was able to yell and tried to fight off the attacker... her boyfriend heard the struggle and came out as the suspect ran off. alveraz was booked into the santa clara county jail. a live look outside tonight mabrisa has the forecast dry weather with seasonable daytime temperatures and cold overnight lows will continue through the remainder of the week. overnight lows will be in the 30s-40s tonight. daytime highs thursday will warm up slightly in the mid to upper 50s. a pattern shift is then forecast by this weekend with the return of widespread rain and potential for gusty winds. rain totals look best in the coastal ranges and the north bay areas where upwards of 2.00" (locally higher amounts possible) are forecast through the weekend. elsewhere, 0.50" to 1.00" amounts are more likely. unsettled conditions are likely into next week. (pam) the california highway patrol is releasing numbers from the new year's maximum enforcement period. and at least 50 people were killed in crashes throughout the 102- hour holiday enforcement. nearly half of those people were not wearing a seatbelt. c-h-p officers also made more than 11-hundred arrests for d-u-i. (pam) a big story tonight-- the next legislative session begins in just five days and california lawmakers already have a lot to consider.. more than 200 proposed laws are on the agenda. kron 4's capitol bureau reporter ashley za-val-a points out some of the measures which are time sensitive. with just a few months away before californians turn their clocks ahead... lawmakers will need to decide if and how they will move forward with getting rid of that practice by staying on permanent daylight saving time.voters approved the measure in november, leaving it up to lawmakers to finish the task.((nats))other time sensitive business for lawmakers include approving disaster relief funding in butte county following the camp fire.the california disaster assistance act normally allows for the state to share 75% of post-disaster projects with local agencies. butte county area lawmakers are hoping for 100%.that would make the camp fire the 14th event in california history to receive such funding.((nats)) another expensive cost for lawmakers to consider: how to fund the $20 million dollars it will take to prosecute the accused golden state killer.a judge determined joseph deangelo will be represented by a public defender for the dozens of charges he faces stemming from murders and rapes across california.area assemblyman filed a bill hoping to establish legislation that will appropriate funds to pay for the pricey prosecution.these are just a few of the hundreds of issues lawmakers hope to sort out in 2019. (ken) authorities are investigating a small plane that crashed into the american river near discovery park in sacramento today. this is a photo from the sacramento fire department... showing the plane submerged in the river. this happened just east of interstate 5. two people... a man and a woman... were on board when the plane crashed. they are believed to be from the napa area. one was able to get out... the other had to be pulled out by first responders. both people were taken to a local trauma hospital. (ken) authorities say the plane áwasá designed to land on water ... and the cause of the crash has yet to be determined. (pam) the eureka women's march has been postponed ... and the reason, is getting mixed reactions. organizers of the march say, they had concerns the event would not be diverse enough. organizer beth wylie says, she was not surprised when people started calling the march "overwhelmingly white." she says, postponing the march was not because only white women would show up .... but because the leadership was not diverse enough, and the event was going to be based only on the perspective of white people. (pam) the organizers say, they are still going to have march -- but instead in the month of march -- for international women's day. in the meantime.. they ar working on building a more diverse leadership. (ken) police say a driving lession ended after a teen driver ran the car into a packed los angeles restaurant. around 40-people were inside when it happened. one person was injured... but officials say the injuries are non-life threatening. according to the aunt of teen... she was teaching her niece how to drive when she crashed. police say the crash is still under investigation. (ken) a teenage prank in houston turned deadly.. and tonight a 14-year-old boy is facing felony murder charges. police say it happened yesterday afternoon. the boy was driving around with two friends, throwing eggs at other cars. one of them hit a vintage lincoln continential... whose owner reportedly brandished a gun and began pursuing the egg-throwers. surveillance video shows the teen in a gold s-u-v speeding away. the s-u-v runs a red light and smashes into a pick-up truck coming from another direction. the crash killed the driver of the pick-up truck.. the teen driver suffered a broken ankle.. and was booked into a juvenile detention center on murder charges. police also located the driver of the man who was chasing the teens... he is cooperating with the investigation. (pam) a florida man is accused of attacking a mcdonald's employee ... reportedly over a straw. and there is video of the whole incident . heather leigh has the story. heather leigh/ reporting: "daniel taylor spent new year's day in jail charged with simple battery and witnesses tell me it all started because of this."nats it's video lighting up social media.showing a man pulling a mcdonald's employee by the shirt over the counter.brenda biandudi / witness:"even though she's at work you know is there a limit to how much these employees can, can take." brenda biandudi was the person holding the phone watching as this fight began escalating quickly.she says it started when 40 year old daniel taylor walked over to the condiment bar to grab a straw at this mcdonald's on 34th street in st. petersburg.brenda biandudi / witness:"he was yelling and walking toward the counter and the young lady behind the counter told him that is the law now, we're not allowed to have straws in the lobby."that law does exist.starting january 1st the city told restaurants they can no longer leave plastic straws out on the counter and by 2020 they'll no longer be allowed to hand them out.biandudi says taylor refused to accept that answer, reaching over the counter and grabbing the worker.brenda biandudi / witness:"she had to do it, she was doing, you know she was, she's a petite girl and you know i just felt she did the right thing."police say on his way out taylor also kicked another employee in the stomach.mcdonald's wouldn't allow the employees to talk but sent a statement saying quote, "our highest priority is always the safety and well-being of our employees and customers at our restaurants."biandudi is happy her video could help police catch taylor.brenda biandudi / "i don't know what was in his hope you get help that he needs."
