okay so it shows the 3 men huddled together and a residence. i wonder what you think the reaction is by hamas to the fact they were hiding these people in these residences surrounded by palestinian civilians. some of them made into human shields in the situation. how do you think hamas would react now that these people were taken out from under their noses? dew you think it changes their behaviour? >> first of all, it is impossible for us to try to compare conditions across hostages. it's bad for everyone held in captivity no question about that. but we thank the situation these hostages were and is completely different from those who are believed to be held and tunnels underground. contact terrible for everybody. in terms of how this might impact hamas, it is so impossible to try to figure out how they think, how they rent and what they do. we are seeing headlines that they've given instructions now to immediately shoot any captives if there is any suspicion of soldiers coming. i can only imagine it is heightened alert and a stressful situation for everybody. even though we are celebrating these 4 releases, the tension is off the charts for all of us. we need to bring all the hostages home immediately. >> martha: every time i speak with you i'm just overcome with your compassion and composure. and your ability to hold it together. i know you basically said you are living in hell for 248 days. any parent i think can have some sense of understanding if we put ourselves in your shoes. but there is this discussion now of a deal directly between the united states and hamas. hamas has not accepted any deal. they've been offered a lot but have not accepted any. are you more optimistic they might reach something directly with american negotiators and leaving the israeli team out of it? >> someone sent us that headline today and immediately we said this must just be a rumour that is trying to make news because we have never heard anything about that. we are at a point, everybody is at a point where we are all desperate to get our loved ones home. anyone who is willing to try anything is more than welcome from all of the hostage families to do so. but i have no idea where that headline came from. we have not heard anything indicating that from the administration. if that was a possibility and if other nations were also trying, we know very well there are 24 nationalities being held. i don't know if the germans and argentinians and the polish and everybody else is trying to get their people out in one-on-one unilateral negotiations. but it's not my impression. >> martha: rachel and john, thank you. we all hope to see a similar video of you with hersh goldberg-polin and we want all of these americans and all the people from all of the countries you mention to be reunited with their families. it's well beyond time for that to happen. bear grateful for your time with us and keep being strong. thank you very much for joining us. >> thank you. >> thank you for keeping the story alive it so important. >> martha: we will continue to do so. thank you very much. back to wilmington now, hunter biden choosing not to take the stand and his gun -related trial today and now closing organs are underway. judge jeanine pirro next is mark cosentyx helps real people find clear skin. and in psoriatic arthritis, can mean less joint pain, and help stop further joint damage. serious allergic reactions, severe skin reactions that look like eczema, and increased risk of infections some fatal have occurred. tell your doctor if you have an infection or symptoms, had a vaccine or plan to or if ibd symptoms develop or worsen. ♪see me♪ oh, my leaffilter? >> no although i thank the trump team was not as in-your-face as the people -- these people are. it was mostly the trump team and eric the son. but luck this is a message to the jury. you're and delaware, we are the biden's, we are a united frontier and forget about what you're hearing. the fact the first lady actually did a solo transatlantic trip so she could be at the trial there is a strong message right there. i give credit to the prosecutor for saying does not evidence right there. so what's essentially a dysfunctional family is putting on this display that we are a joint family and we support each other. joe biden's brother and the nieces and nephews and all that. but they are a dysfunctional family. the biden women had all of this drama invited into their lives because of hunter biden and yet they come in like, you know, we are all great. of course i don't have to mention the fact hunter's own daughter navy london i think her name is was not included until the mother of the child agreed to the reduction in child support from 20,000 a month to 5000 a month and yet none of the families ever and that this grandchild i don't thank the public should be locked into what a great family they are, they are everything but. given the history and given the reality of what's going on. >> martha: this is an exchange this morning on msnbc about how the president has handled all of this. let's watch. >> the president of the united states has removed himself from this explicitly car consistently, honourably. and what's the rule of law in full. this is what we call practising what you preach. that's what president biden has done. >> martha: john beauchamp works for the biden team and writes speeches and worked on the normandy speech which was okay but this is the thing. there is the feeling that people are picking on them or being unfair to them. that addiction is something that happens in every family. so i think you are mention saying so many of the jurors said they had a family expanse with addiction and that made it an unfair jury what do you say to that? >> addiction has nothing to do with this. in the biden ministration in particular was pushing a law that would increase the penalty for lying on a federal form to buying a gun for 15 to 20 years. so let's not make out like this guy is being picked on. and congress, the president signed it, they don't want people like hunter biden who is a crack addict, the self-admitted crack addict, his own face belt -- voice bellowing in the courtroom to be able to say oh it's about me being an addict, know it's about you trying to get that done illegally. i'm tired of them saying he only had it for 11 days. the only reason he only had every 11 days is because his brother's widow with whom he was having a love affair through the gun out. he would have had the gun longer. it was interrupted by someone who is trying to do the right thing or keep them from killing himself. and i'm tired of this saying the bind of the ministration has been great -- and know the judge has been great. this is a judge who said we won't let you pull the wool over the country's eyes with this fake deal that will give your son immunity the rest of his life. what we are going to do is move the trial along. we won't extend it like the judge did in new york to keep donald trump off the campaign trail for 6 weeks, we are going to get this thing done. the tribute goes to the judge and not to the biden family who did everything they could to prevent this from going forward. >> martha: we'll be interesting to see what this jury does, they are being told essentially that you can carve out that day and he felt like he was straight that day and thanks are going well then it's okay but i'd come back and say why it did his brothers former wife throw the gun in a trash bin. she was obviously afraid he was acting radically and might do something based on that behaviour. >> and there were text messages. >> martha: you know, who knows maybe -- >> the evidence is solid. it's called nullification and has nothing to do with the reality of the case prevent yet a reasonable doubt. >> martha: thank you for joining us will see what happens with deliberations. we will see you on the 5. so president biden's executive action on the border might have realty is. a leaked memo from the san diego sector shows vary little has changed there. senator john kennedy's next. >> if biden loses this election it's going to be because of 2 thanks he is old and he can't get past the issue and people hate that about him. and immigration. on a political level i don't think they could've handled it worse. they could have fixed it themselves, they didn't. but now it looks like this is his last minute before the election hail mary pass and it's not going to succeed. ♪ ♪ ♪♪ ♪ you were made to find inner peace. we were made to track flight prices to paradise. >> after president biden's executive action of the border expected to turn around the asylum rules it turns out the feds are telling agents in 1 sector to go ahead and release migrants to the u.s. from nearly every country. fox news gets a look at this memo spelling out who gets to stay and who has to go, republican senator john kennedy is standing by a first to matt at the border. hello matt. >> reporter: hello martha. behind me scattered throughout the area is a large group of about 400 migrants who just crossed illegally. we've been talking to them and they're coming from places like iran, yemen, mauritania, india, china and nepal haul in this group. customs and border protection told me these migrants we'll not be eligible for asylum under president biden's new executive order but any number of these migrants are likely to be released into the united states and given notices to appear on their own free will. u.s. customs and border protection says south americans are less likely to be released because of strong relations with those countries. just last week president biden declared illegal immigration would be suspended but we are landing on the ground and through the border patrol memo that migrants are still being released. it instructs his san diego agents to continue releasing them from all eastern countries -- eastern hemisphere countries except for 6 including russia and mould above. i spoke with migrants from all over the world and many cities simply googled how to get into the united states. when you said you searched on my, what to do search?
