[screams] >> the u.s. open is underway with the game's biggest stars showing off swings in the last grand slam of the year. >> you kind of got to go w. djokovic. he is the guy to beat. ♪ ♪ >> ainsley: straight to a fox weather alert. we are tracking hurricane idalia all morning long. the storm strengthening to a cat 1 about an hour ago as it is swirling off cuba and barreling toward the coast of florida. idalia is expected to grow even stronger before making landfall tomorrow morning. >> brian: here we go a state of emergency has been declared in dozens of counties. and with mandatory evacuations underway tampa international airport grounding all flights today. people across florida preparing for the possibility of life-threatening storm. it's life-threatening storm surge and catastrophic damage. >> it's better to be prepared vs. not prepared and have regrets. >> since i have been up this morning, people have been back and forth hauling trash, hauling boats. getting everything put away the best they can. hoping and praying for the best. >> hoping for the best. you know, we do this each time we leave every single time. but this one looks like a biggy. >> steve: it does look like a biggy. much of cuba and yucatan peninsula already seeing severe damage and flooding because the storm ride out there. governor ron desantis warning florida could face even worse than the yucatan. >> close to the cone, you should assume that there's going to be noticeable impact. and some of these impacts could end up becoming catastrophic. so. buckle up for this one. it's going to be a major hurricane. >> steve: indeed. let's bring in senior meteorologist janice dean who is stacking this storm. janice, you are over at the big wall. this could be the biggest, most powerful storm to hit the big bend of florida in 100 years. >> yeah. absolutely. we are talking about a 12-foot storm surge. the last time the big bend felt a 12-foot storm surge was back in the 1990s. take a look at 75 mile-per-hour sustained winds it. became a hurricane just last hour. hurricane hunters are going to be going inside the storm to see where the winds are the strongest winds. and we're going to be starting to feel the impacts right now nw along the west coast of florida around the keys. we also have franklin by the way out in the atlantic. that was a major hurricane, still is. but this one is going to make impact across the big bend. this is what i'm concerned with, the storm surge. this is all about the storm surge because this area is so vulnerable. the continental shelf is right there along that big bend, along the west coast of florida. so it's water on top of a shelf that's going to be pounding the coast and in some cases 9 to 12-foot storm surge will be overtop homes. you have to be completing your preparations now and getting out in you're in the area that is urged to evacuate. so we will be talking about a landfall tomorrow morning this hour. and then areas across georgia and the carolinas need to prepare for a category 1 hurricane not only the storm surge for the west coast but storm surge watches for the east coast of florida. so let's take a look at this. we're going to see those winds start to gu gust, 50, 50, 60 mis per hour as it comes on shore. here's the time to be ready your preparations need to be completed by this afternoon for the areas across the west coast of florida and then we have to keep an eye on georgia and the carolinas. again, this is forecast to be a hurricane as it makes its way across the southeast coast. we are talking about a major hurricane, category 3. possibility of this being category 4 as it rapidly intensifies over the next 24 hours. the waters by the way in the gulf of mexico way above average. that's the fuel that this storm needs to really power up, right? so hurricane warnings in effect for all the pink areas that you see here, including cedar key, gainesville, up towards apalachicola. tampa you are also into a hurricane warning. we talked about this last year with ian. tampa is so vulnerable for storm surge and flooding. so the storm surge warning for all of these big cities down towards sarasota, storm surge watch all the way down towards naples. the storm is huge. it's going to impact not only the west coast but the east coast of florida. over 9 # foot storm surge along that big bend this is one of the most vulnerable spots for storm surge. it's all about the storm surge. you can protect yourself from the wind but you have to run away. when it documents these land falling hurricanes, steve, ainsley, brian. >> steve: you are going to be in the weather center all morning long and tomorrow is when it really hits, right? super tuesday. the president is used to barn storming around march 5th -- 4th. instead, got to be in court. and then you see how the rest of this plays out. the rest, we know for sure, the rnc on july 15th, everything should be wrapped up by then. and then you got election day. can you imagine if the president is convicted along the way or can you imagine if he is exonerated if he is the nominee. put jet fuel into his campaign but other people say joe biden does not have to campaign if donald trump is in court. joe biden will just say hey, i got my job to do. i got to be president of the united states. plus, my opponent, if it is -- does get the nomination, is he in court anyway. it will be the closest thing to a pandemic rematch. >> steve: mr. lauro yesterday in front of a judge in d.c. look let's kick the big trial into 2026 and ultimately she said we are going to start on march 4th. mr. lauro essentially revealed the defense motions that they are going to start filing very shortly. first of all, they are going to claim that donald trump was immune to these charges because the indictment covers a period when he was actually president of the united states. also, he is going to claim selective prosecution because the charges brought by the special counsel were who was appointed during the biden administration is retaliation for the investigation of hunter biden. he is also going to challenge apparently all three of the conspiracy counts, plotting to defraud the united states. disruptions of the certification of the election, and depriving people the right to have their vote counted. so, that's essentially donald trump tipping his hand what the defense is going to be in d.c. >> ainsley: yeah. and this trial date that we are learning this morning is only one out of the four that we're expecting. jack smith, he wanted it originally, and can you see like the bottom, look, trump's d.c. trial to start a day before super tuesday. that's what the judge decided. the judge is saying tough, mr. trump. i know you didn't want it then. you wanted it a year from then. she says mr. trump will have to make the trial date work, regardless of his schedule. trump did say he is going to appeal. jack smith wanted it in january. january 2nd, 2024. right after new years'. just weeks of before the iowa caucuses in new hampshire primary. so the timing of this is suspect. why do they want this right before people go to the polls to vote? so that they are hoping that your vote is changed because of it. >> brian: they don't care how it looks. they are doing it anyway. 12 million documents to go through. they say you don't have to go through all of them. you have a big staff. just tell you the ones just give me jesus smith is going to be focusing on. >> steve: 300 key documents that were the underlying cases for that 45-page indictment. so, it's like okay. people are saying 12 million. really, just look at these 300 and you have got plenty of time, according to the u.s. government. >> ainsley: it could backfire. trump is getting 50% of the emerson poll. he leads by a huge margin. desantis is getting 12%. and he's in second place. >> brian: the only problem is, ainsley, that jury in d.c. and the jury in fulton county. unlike the one in florida which might have some type of balance. >> ainsley: both side get to pick jurors. >> brian: he only got 7% of the vote in d.c. and in fulton county, too. that's the probe. >> ainsley: hopefully find someone who still wants to be fair, right? what do you feel? >> it's the calm before the storm. it's really a typical gulf course morning. you can feel the humidity and we are getting closer to sunrise. actually behind the camera. and this will give us light of day of really the most quiet weather that we will see for the next 24 hours. i mean, the outer rain bands are going to hit this afternoon. and anyone in the state of florida, when they go to bed tonight, that's where they are going to ride out this storm. this has the potential of being historic storm for the state of florida. in fact, there has never been a category 4 hurricane to hit the big bend of florida and although right now the official forecast is calling for cat 3, it's not out of the question that this could be a stronger storms, with the landfall across the big bend of florida closer to cedar key, unfortunately that is worst case scenario for tampa bay where i am. that means we will have the optimal approach for storm surge. and for tampa bay, it's really like a baseball mitt. all that water push into the baseball mat is going to be stacking up on the ground. we could see 7 feet of storm surge across tampa bay. so right now we have 21 counties that have evacuation orders in place. the timeline to leave is starting to shrink because, as you can see it's calm town now but once winds are above 40 miles per hour, there is only be three bridges that connect us to the coast. and those will quickly start to shut. so it is a very good idea to listen to those local officials and, of course, download the fox weather app. stay with us. we will be weathering the storm with you as we get through hurricane idalia. steve? >> so, my goals are to hold each and every one of them responsible whether it comes from the ground up on or about the top down to the bottom i don't care. i want to know where those mistakes were, why they happened the way that they happened. i mean, my goodness, we have had now three chances to take out this bomber and didn't take those chances why? why was that not done were the intel going back up the chain ultimately to the white house ignored? or did they think something worse was going to happen? that's what i want to know. >> ainsley: so, kelly, mr. schmidt was talking about a cover-up. he thinks this is a cover-up. he says i just want to hear the truth. the pentagon is telling me one thing. but then the other soldiers that were there on the ground have a completely different story. are you experiencing the same thing and, if so, what's the pentagon telling you and what are the soldiers on the ground saying? >> i agree 100 percent with what mark said. it's a cover-up. that i have no it was orchestrated nightmare. the soldiers on the ground with telling us basically the taliban that were incident is to be their security and i have no idea why we entrusted our security of our men and women over to them but they are basically, in my opinion, the ones that orchestrated this. and for some reason they are being protected and i just don't understand and that's 100 percent accurate what mark said. i believe there is so much cover-up going on for protection taliban? the administration? i don't know. >> steve, you say you want to hear we made a mistake. do you think that will happen? i don't know. i'm optimistic, considering the directory of this administration i doubt it. but i'm still hopeful that that it will. >> what was ka careen like? [screams] >> the u.s. open is underway with the game's biggest stars showing off swings in the last grand slam of the year. >> you kind of got to go w. djokovic. he is the guy to beat. ♪ ♪ >> ainsley: straight to a fox weather alert. we are tracking hurricane idalia all morning long. the storm strengthening to a cat 1 about an hour ago as it is swirling off cuba and barreling toward the coast of florida. idalia is expected to grow even stronger before making landfall tomorrow morning. >> brian: here we go a state of emergency has been declared in dozens of counties. and with mandatory evacuations underway tampa international airport grounding all flights today. people across florida preparing for the possibility of life-threatening storm. it's life-threatening storm surge and catastrophic damage. >> it's better to be prepared vs. not prepared and have regrets. >> since i have been up this morning, people have been back and forth hauling trash, hauling boats. getting everything put away the best they can. hoping and praying for the best. >> hoping for the best. you know, we do this each time we leave every single time. but this one looks like a biggy. >> steve: it does look like a biggy. much of cuba and yucatan peninsula already seeing severe damage and flooding because the storm ride out there. governor ron desantis warning florida could face even worse than the yucatan. >> close to the cone, you should assume that there's going to be noticeable impact. and some of these impacts could end up becoming catastrophic. so. buckle up for this one. it's going to be a major hurricane. >> steve: indeed. let's bring in senior meteorologist janice dean who is stacking this storm. janice, you are over at the big wall. this could be the biggest, most powerful storm to hit the big bend of florida in 100 years. >> yeah. absolutely. we are talking about a 12-foot storm surge. the last time the big bend felt a 12-foot storm surge was back in the 1990s. take a look at 75 mile-per-hour sustained winds it. became a hurricane just last hour. hurricane hunters are going to be going inside the storm to see where the winds are the strongest winds. and we're going to be starting to feel the impacts right now nw along the west coast of florida around the keys. we also have franklin by the way out in the atlantic. that was a major hurricane, still is. but this one is going to make impact across the big bend. this is what i'm concerned with, the storm surge. this is all about the storm surge because this area is so vulnerable. the continental shelf is right there along that big bend, along the west coast of florida. so it's water on top of a shelf that's going to be pounding the coast and in some cases 9 to 12-foot storm surge will be overtop homes. you have to be completing your preparations now and getting out in you're in the area that is urged to evacuate. so we will be talking about a landfall tomorrow morning this hour. and then areas across georgia and the carolinas need to prepare for a category 1 hurricane not only the storm surge for the west coast but storm surge watches for the east coast of florida. so let's take a look at this. we're going to see those winds start to gu gust, 50, 50, 60 mis per hour as it comes on shore. here's the time to be ready your preparations need to be completed by this afternoon for the areas across the west coast of florida and then we have to keep an eye on georgia and the carolinas. again, this is forecast to be a hurricane as it makes its way across the southeast coast. we are talking about a major hurricane, category 3. possibility of this being category 4 as it rapidly intensifies over the next 24 hours. the waters by the way in the gulf of mexico way above average. that's the fuel that this storm needs to really power up, right? so hurricane warnings in effect for all the pink areas that you see here, including cedar key, gainesville, up towards apalachicola. tampa you are also into a hurricane warning. we talked about this last year with ian. tampa is so vulnerable for storm surge and flooding. so the storm surge warning for all of these big cities down towards sarasota, storm surge watch all the way down towards naples. the storm is huge. it's going to impact not only the west coast but the east coast of florida. over 9 # foot storm surge along that big bend this is one of the most vulnerable spots for storm surge. it's all about the storm surge. you can protect yourself from the wind but you have to run away. when it documents these land falling hurricanes, steve, ainsley, brian. >> steve: you are going to be in the weather center all morning long and tomorrow is when it really hits, right? >> brian: when are we going to find out what is in the 5400 emails? >> griff: we don't know what is in the content of any of those files and we reached out to nara to get our own records. right now it's with that southeastern legal foundation. they have yet to publicly put those records out there. so we don't know right now. and we have inquired. >> brian: we know if it's between hunter and his dad it's about the weather that's all they talk about. i can't wait to see what else is there. >> ainsley: in 5400 emails. >> steve: thank you very much, griff. according to the people who have seen him so far the interaction with joe biden with the various pseudonyms. >> all right. >> ainsley: thank you, griff. >> brian: leave his mic all morning, please. >> steve: so far the people have seen the email between joe biden and pseudonym and others it's just the schedule. here's the important thing to remember about this. even though he is using a pseudonym, he is using federal email accounts, which are all subject to nara and also foia. so, you know, they would be crazy to put anything incriminating in those. and that's probably why we only see schedules. however, if joe biden had a fake yahoo account or hotmail or gmail, that could be where they actually find something. maybe the house republicans on oversight will request something like that, but what we found about these 5400 emails so far, not from the house republicans. it's from that law group that griff told us essentially foiaed them a year ago. >> that was the southern legal foundation. they say the national archives is dragging its feet. they requested these emails and these records, the 5400 emails in june of 2022. through the foia requests. they say not a single email has been produced to them. the national archives have acknowledged their existence. they actually -- stephanie awry a brewer. sent the southern legal foundation this response we have performed a search of our collection for vice presidential records june #th s, 2022 request and have identified approximately 5438 email messages 25 electronic files and 200 pages of potentially responsive records that must be processed in order to respond to your request. so they have acknowledged their existence. then james comer now with house oversight is demanding the national archives hand over all of these emails and these records because they have yet to do that and it's been more than a year since they have been requested. >> brian: how do you know the contents? schedules on there? >> steve: according to the "new york post" today. they say that people who have seen things so far they only. >> ainsley: just schedules. >> steve: just talk about joe biden's daily schedule. >> ainsley: do you know how they found one of these emails it was on hunter biden's lant. robert l dot peters pci.gov. a government email address. >> steve: they are all government emails so far. what they need to do is figure out if they had any other accounts like a yahoo, a hotmail, a gmail. >> when you hear report about weiss and the doj and they are going back and forth. >> brian: there is no coordination between david weiss and the department of justice. is he is totally on his own except for when i need advice about media inquiries are. >> ainsley: sending each other articles any time republicans in congress were asking for information to weiss. then weiss would send the doj a message. sometimes he would include links or his office would include links to articles that were written about this and then they would eventually respond with there are no comments. all of this is being slow-walked. it looks like, what they're appears to us try to hold off as long as they can and not give any information. >> brian: just the fact that it took almost five years they are investigating hunter biden and they presented a deal that the judge just basically tore up in front of them that imploded. looks like they are heading to trial. >> steve: brian, that's going to be part of trump's lawyer's defense of the former president. we will get to that in a minute. in the meantime, yesterday, a judge said down in d.c. that the big trial for donald trump is going to start on march 4th. that's a win for the special prosecutor. they wanted it actually a little earlier. but it's a loss for the defense because they wanted it two years later. >> ainsley: that is the day before super tuesday. and, brian, i know you are going to walk us through this calendar. >> brian: unbelievable. >> ainsley: donald trump is going to be tied up in legal issues all next year. >> brian: check this out. in september show up arraignment just a for imagination it got to be there a day off the trail. not that intense, even though he lost six points not showing up for the debate. signs tightening up he will have to get more aggressive. is this calendar going to allow that to happen. is he going to be back in new york here, it turns out they want to look at the trump organization because they say they might have overvalued real estate assets in order to get loans which have all been paid back. letitia james trying to play politics but, still, trump has got to be there. up here the d.a. proposed start trial date. this is probably not going to hold up, but they are going to end up pushing it somewhere in between probably in the spring, fall, but if trump has his way, it will be pushed to another year if trump has his way, too, you have got to think side note, mark meadows yesterday in court for this georgia case trying to separate himself from the 19 and push his case to federal court which in theory would give him more of a broad based georgia jury that would be fairer than the one in fulton county. and if mark meadows moves his case, the theory is trump would follow. he had a three hours plus testimony there talking about the case and trying to let everybody know where he would go and how a judge would rule. then this e. jean carroll defamation suit. this thing was done. the president lost. supposed to write a $5 million check. made some comments about her. so she is like i'm going to sue you again. i don't care what you think of the case, it's still a timing. january 15th when the president has got to be here. the same day as the iowa caucuses. so preparations for this case, perhaps, even meetings with leaders in his plane is still going to talk away from the iowa caucus. >> the president didn't win it in 2016. in 2020 it wasn't contested. pyramid scheme class action suit has him back in new york again. they say something to do with his private business. nothing to do with anything criminal. but civil. and then here rego with the january 6th trial at a time. that's where -- that's where they hope to get on the first week in january. so, the president wanted in 2026. and here they said no, we're not going to make it january 6th. in 2023. we're going to push it to march 4th. i don't know, what's march 5th? super tuesday. the president is used to barn storming around march 5th -- 4th. instead, got to be in court. and then you see how the rest of this plays out. the rest, we know for sure, the rnc on july 15th, everything should be wrapped up by then. and then you got election day. can you imagine if the president is convicted along the way or can you imagine if he is exonerated if he is the nominee. put jet fuel into his campaign but other people say joe biden does not have to campaign if donald trump is in court. joe biden will just say hey, i got my job to do. i got to be president of the united states. plus, my opponent, if it is -- does get the nomination, is he in court anyway. it will be the closest thing to a pandemic rematch. >> steve: mr. lauro yesterday in front of a judge in d.c. look let's kick the big trial into 2026 and ultimately she said we are going to start on march 4th. mr. lauro essentially revealed the defense motions that they are going to start filing very shortly. first of all, they are going to claim that donald trump was immune to these charges because the indictment covers a period when he was actually president of the united states. also, he is going to claim selective prosecution because the charges brought by the special counsel were who was appointed during the biden administration is retaliation for the investigation of hunter biden. he is also going to challenge apparently all three of the conspiracy counts, plotting to defraud the united states. disruptions of the certification of the election, and depriving people the right to have their vote counted. so, that's essentially donald trump tipping his hand what the defense is going to be in d.c. >> ainsley: yeah. and this trial date that we are learning this morning is only one out of the four that we're expecting. jack smith, he wanted it originally, and can you see like the bottom, look, trump's d.c. trial to start a day before super tuesday. that's what the judge decided. the judge is saying tough, mr. trump. i know you didn't want it then. you wanted it a year from then. she says mr. trump will have to make the trial date work, regardless of his schedule. trump did say he is going to appeal. jack smith wanted it in january. january 2nd, 2024. right after new years'. just weeks of before the iowa caucuses in new hampshire primary. so the timing of this is suspect. why do they want this right before people go to the polls to vote? so that they are hoping that your vote is changed because of it. >> brian: they don't care how it looks. they are doing it anyway. 12 million documents to go through. they say you don't have to go through all of them. you have a big staff. just tell you the ones just give me jesus smith is going to be focusing on. >> steve: 300 key documents that were the underlying cases for that 45-page indictment. so, it's like okay. people are saying 12 million. really, just look at these 300 and you have got plenty of time, according to the u.s. government. >> ainsley: it could backfire. trump is getting 50% of the emerson poll. he leads by a huge margin. desantis is getting 12%. and he's in second place. >> brian: the only problem is, ainsley, that jury in d.c. and the jury in fulton county. unlike the one in florida which might have some type of balance. >> ainsley: both side get to pick jurors. >> brian: he only got 7% of the vote in d.c. and in fulton county, too. that's the probe. >> ainsley: hopefully find someone who still wants to be fair, right? what do you feel? >> it's the calm before the storm. it's really a typical gulf course morning. you can feel the humidity and we are getting closer to sunrise. actually behind the camera. and this will give us light of day of really the most quiet weather that we will see for the next 24 hours. i mean, the outer rain bands are going to hit this afternoon. and anyone in the state of florida, when they go to bed tonight, that's where they are going to ride out this storm. this has the potential of being historic storm for the state of florida. in fact, there has never been a category 4 hurricane to hit the big bend of florida and although right now the official forecast is calling for cat 3, it's not out of the question that this could be a stronger storms, with the landfall across the big bend of florida closer to cedar key, unfortunately that is worst case scenario for tampa bay where i am. that means we will have the optimal approach for storm surge. and for tampa bay, it's really like a baseball mitt. all that water push into the baseball mat is going to be stacking up on the ground. we could see 7 feet of storm surge across tampa bay. so right now we have 21 counties that have evacuation orders in place. the timeline to leave is starting to shrink because, as you can see it's calm town now but once winds are above 40 miles per hour, there is only be three bridges that connect us to the coast. and those will quickly start to shut. so it is a very good idea to listen to those local officials and, of course, download the fox weather app. stay with us. we will be weathering the storm with you as we get through hurricane idalia. steve? >> so, my goals are to hold each and every one of them responsible whether it comes from the ground up on or about the top down to the bottom i don't care. i want to know where those mistakes were, why they happened the way that they happened. i mean, my goodness, we have had now three chances to take out this bomber and didn't take those chances why? why was that not done were the intel going back up the chain ultimately to the white house ignored? or did they think something worse was going to happen? that's what i want to know. >> ainsley: so, kelly, mr. schmidt was talking about a cover-up. he thinks this is a cover-up. he says i just want to hear the truth. the pentagon is telling me one thing. but then the other soldiers that were there on the ground have a completely different story. are you experiencing the same thing and, if so, what's the pentagon telling you and what are the soldiers on the ground saying? >> i agree 100 percent with what mark said. it's a cover-up. that i have no it was orchestrated nightmare. the soldiers on the ground with telling us basically the taliban that were incident is to be their security and i have no idea why we entrusted our security of our men and women over to them but they are basically, in my opinion, the ones that orchestrated this. and for some reason they are being protected and i just don't understand and that's 100 percent accurate what mark said. i believe there is so much cover-up going on for protection taliban? the administration? i don't know. >> steve, you say you want to hear we made a mistake. do you think that will happen? i don't know. i'm optimistic, considering the directory of this administration i doubt it. but i'm still hopeful that that it will. >> what was ka careen like?
