>> that's such a good question. i actually don't know that answer. i wouldn't be surprised at this point if it was a.i. generated. we kind of knew what the president's positioning would be we knew he would appear defiant in some ways. what you are seeing there on your screen represents a lot how the former president is feeling about the cases all four of them proceeding against him now. this was his one chance to demonstrate that with his facial expression knowing that this, the legitimate one we are seeing would be spread far and wide and used by political opponents as well as supporters, too. >> steve: absolutely. alexandria a thank you very much. senator tommy tuberville of alabama said to nbc news regarding that photograph, he said i've seen that look when playing golf with him. when he misses a putt, he gives that look according to the senator. >> ainsley: when he is upset or angry. >> steve: that's a scary look. >> ainsley: uncomfortable feeling especially when he feels like he has done nothing wrong. this happened during laura ingraham show last night. very quick, only 20 minutes. he touched down in atlanta. he drives over to the fulton county jail. he turns himself. in there is the m mugshot. he lists himself as blond hair and 215 pounds. back on his plane again. flying back to new jersey. >> brian: that is a great height and weight. people are commenting on that. >> ainsley: did he have to stand on a scale? we have seen that happen in new york with one of the trump cases. and the judge said no. that wasn't part of your -- >> brian: there's a sense they will say yes. there is a strong case that they will say yes. >> steve: that would be good for mark meadows. >> brian: good for 17 or 18 ever left. take meadows. the president the united states is this a local or federal case? >> ainsley: depends on who makes the decision. if they are big democrats they will probably say no, brian. we have seen that and this is so politically motivated. if this is someone down in georgia fulton county makes that decision they are going to say no. they are going to say this is not federal case because they know if it becomes federal case then he could. >> steve: it would be different. >> brian: he could pardon himself. something else. it will broaden out the jury instead of being this very blue jury because a very urban environment in fulton county that went heavily for joe biden and hillary clinton. then you have all of georgia so that's why a lot of people who want trump convicted are upset by this d.a. who has taken head shots before and is running that she is prosecuting him just like this clown alvin bragg in new york city. they are making it political because they got to run for election. whatever you think of trump, just look clinical, just think legal for a second. they want oil-if people want to see trump convicted they want jack smith's case, pure, easy to understand, right to the point. 19 people sitting being tried at one time in a very complicated case, how are you ever, as the governor kemp said, how are you ever going to bring this before the election? would you vote for donald trump if convicted? he loses 17 points. so, if any of these cases get convicted, that's why there's a lot of hope on that stage that the gap could rapidly close because donald trump has got a substantial lead over ron desantis. >> ainsley: you were there, brian and you were talking to everyone, did you get the cents they were still going to vote for donald trump but this could be the vice president or did you ever get the sense that they have an open mind? >> brian: both. i mean, i guess people there bleed trump and other people see i want to see how they are. i want to see if someone can win me over. >> ainsley: i want to see those polls now after the debate. >> steve: we have got one. >> ainsley: who did best. >> brian: i did this morning. >> steve: two different panels we're going to show you. the first one is who do you think won the debate, performed the best? ron desantis won as you can see right there. according to something like 700 republican primary voters. ramaswamy came in second with 26%. nikki haley 15% and mike pence rounds out the top tier. we have got another panel to show you and i think this is more interesting. who gained and lost support? an additional 25 defendants have alleged connections to trans national crime networks. you know what that means. all bad. and in total, the department halls now seized more than $1.4 billion the criminals snol criminals stolein federal relie. misspent money like this will never be found and this is heart breaking. here with more is imhat winegar, senior fellow in poverty studies at the american enterprise institute. matt, good morning to you. >> good morning. >> at the height of the federal pandemic when trying to get money out as quick as possible. money was good but they ultimately made it too easy to steal. >> that's right. and this is what is represented in the department of justice's case. what viewers really need to understand is that's a relative drop in the bucket compared to the total losses experienced across the (interpreter translated.) of these programs during the pandemic >> 3,000 defendants charged with pandemic related fraud crimes. i understand that of those people, is that how many people took part or is the number much bigger than that? >> the number has is undoubtedly much bigger than that just this week the government released a splat report on maybe the most abused unemployment benefit program. that found that 36% of payments under that program were lost or misspent. so you are talking in a program that supported 15 million people, for example, at one time, that's something like 5 million people either who were involved in the rip-off or more likely their identities were stolen in the course of the rip off. bigger than the population of chicago or houston. >> steve: that is crazy. i mentioned when we were going down those tower numbers behind me that apparently some of the money was used for a murder for hire. federal dollars. people's taxpayer money paid for the murder of somebody? >> unfortunately so. that's what the case suggests. and it's really not surprising since gangs were so intimately involved in. this both domestic gangs, one in milwaukee but also trans national gangs in russia, china, nigeria, romania, you name it. >> steve: unbelievable. matt, i know you say that this is just money back in a profound way. who do you blame for this? >> carley: believe he had some sort of heart condition but don't know if that's related. >> ainsley: oh gosh, his heart. thank you. >> carley: you are welcome. >> ainsley: a fox news alert. president trump speaking out on the travesty of justice after being biewkd and released from the fulton county jail on charges from the 2020 elections. >> this case here is a travesty of justice. i did nothing wrong we did nothing wrong. trying to interfere with an election. there has never been anything like it in our country before. this is their way of campaigning. and this is one instance but you have three other instances. it's election interference. >> steve: well now, house republicans on the house judiciary committee are demanding fulton county d.a. fani willis answer questions over her, quote politically motivated prosecution. >> brian: here to react former house judiciary committee senior counsel gillian epstein. great to see you. >> good morning. >> brian: legally, when you saw the different mugshot you had different emotion. legally when find out when he will get into court with 18 others. is this a strong case? is this a case you would have brought if you were ms. willis? >> i don't think it's a particularly strong case and good morning, brian. >> brian: good morning. >> i don't think it's a particularly strong case. i did not vote for donald trump. and i was very critical of the january 6th activities and the riot. and the raid on the capitol. i still think if you are going to bring a case against the former president, it has got to be a compelling case, not just to 12 jurors but to the country as a whole. >> steve: um-huh. >> i'm not sure this does this. there are a number of questions. the first question i had i had no had a good answer. to say how did it take the local prosecutors and i'm saying this as a democrat. how did it take three and a half nearly four years to bring this case? why have they not answered the case about fani willis' conflict of interest? she held a fundraiser for the opponent of one of the targets of this investigation. we haven't heard any answer to that question. third, you know, generally, when a state and a federal government take on a very similar, almost identical case and this is very similar to the case that is being brought by the justice department on the january 6th matter, the state would have to have a rather distinct and separate interest. what is the strong from the state has here that is not being served by the federal prosecution? so i have real questions about democrats say they are playing it by the books. look for accountability. that's fine. i think the democratic elites and left elites in both the legal and the political world have have got to answer some of these questions. i think beyond that. problems with this case as a ricco case. 1 defendants. # 1 counts. hundreds of owe investigators act. some of the overt acts tweets and press releases and public statements by trump declaring -- president trump declaring his victory things all protected by the first amendment. you and i talked about this last week, bribe. i think the case, the central arguments of this case are going to be questionable. i mean, the case really rests on two essential arguments. first, that when president trump said to ross tenberger find me 11780 votes. when he said that, was he asking ross ten berger to falsify the votes. that is the presumption. >> brian: and he will say no. will. >> he would say no. i think him simply saying find me 11780 votes i think that's a matter of will. i don't think that's is he looking to falsify the votes. the other question is, this issue about false elector. this it issue of false slaft electors. this essentially relied on a legal theory of some of the president's attorneys on the reading of the 12th amendment that the vice president has turn down electors from states. i think that's bizarre theory. a couple of well-known attorneys hold it. i don't know that holding that theory or acting on it is necessarily criminal. i think there is all kinds of problems in this case. >> steve: no kidding. obviously. and we have talked about that. julian, we booked you because you were senior counsel on house judiciary. >> chief counsel for the democrats. >> steve: thank you very much. that makes much better business cashed. now it sounds like the house republicans under the direction of jim jordan they are going after fani willis and trying to figure out whether or not she clashed with the biden administration. we saw this with alvin bragg. he opens the case against trump in new york city and republicans went after him and local d.a.? >> i don't know at the end of the day it will make that much difference. i don't think it had an impact in new york. new york prosecution is a travesty as well. i wrote about that. i did a piece in the "wall street journal" about that. i think that was an awful case. the committee has a jurisdiction to do it. the course of the prosecution. one of the things that bothered me is democrats out there saying they don't want this to be political, they have not answered the question as to why it took nearly four years to i don't think there is a good answer to this and dropping this case in the middle of election season asking former president trump to be, you know, in three or four potential trials during the height of election. >> brian: crazy. >> i just see smacks too much of politics to me. i don't think democrats can claim that there's no politics here. >> brian: especially when you take head shots and run on it going for re-election. >> ainsley: timing of it and all these crazy counts. they just need one conviction. they are slapping all these counts. really quickly, yes or no, will this become a federal case. >> i think it's likely at least for some of the defendants to meet the removal, ainsley, the removal requirement. so i think some of the defendants could get a removal. i think. will that make a difference. let's ask global real estate jenna. why are we standing the structure of our houses and what we need and don't need? >> first of all, thank you for having me on this show today. yeah, this is the new reality that we're facing. to really put this all into context. home ownership is really the quintessential american dream. and, unfortunately, it is just becoming harder and harder for it to be achieved. so what people are having to do is they are having to make sacrifices right now. so, buyers are really faced with a lethal combination. so there is limited inventory. there's elevated home prices. and there are relentless interest rates. rates just went up to their highest level in over 20 years. and, of course, the market is very bifurcated in terms of who it impacts the most. and the young families, first time home buyers, young adults that are trying to get into the housing market, they are the ones that are being hit the hardest. the cost of owning a home, it has gone up over 70% in the past three years. americans are having to pay over 40% of their income to own a home. so this all tells you how challenging this housing market is and what buyers are having to do is they are having to make sacrifices. they are having to down size. they are having to get creative in order to achieve this dream of home ownership. >> brian: i could not believe the medium price of a home these days is now $415,000. take a look at what you say on the whole we are converting some of these rooms. to say not only are some of the rooms being changed, they are now getting a little bit more practical in my view no. more dining room. bigger kitchen within a island. separate kitchen room. instead of tv room and sitting room. bathtub with two sinks. a bigger walk-in closet converted to a second small bathroom increases the value of a home theoretically. extra room more outdoor space. maybe you don't build it. maybe just keep a bigger lawn. are some of these things effective?
