to the first gop primary debate right here on fox news. eight candidates trying to convince america that they are the key to beating joe biden. bill melugin is live in milwaukee where the debate is less than 24 hours away. bill, good evening. >> reporter: trace, good evening to you. this time tomorrow night, that debate is going to be wrapping up and we are likely going to be talking about who did or did not perform on that debate stage as this debate is likely going to shift this race into an entirely different gear. so let's talk about who's going to be on that stage. take a look, the rnc announcing eight confirmed candidates will be there, and you can see the positions they're going to take on the stage. florida governor ron desantis and vivek ramaswamy taking center stage. ramaswamy and nikki haley will be standing next to each other which is interesting because haley was attacking ramaswamy yesterday over his foreign policy saying it's going to make america unsave if elected. you'll notice donald trump is not going to be at the debate and it's the talk of the candidates here's what it has to say. >> if you think the truth matters the truth needs a truth teller on the stage. >> also been u.s. president for four years so if he wants to skip the first couple i have no issue but i do think he should be on the debate stage at some point throughout the course of this year. >> reporter: now, last night in florida, florida governor ron desantis was at a pre-debate party i guess if you want to call it this, this is in fort walton beach. his campaign tells fox news they do expect some knives to be out for governor desantis because most of the polls show him in second place behind donald trump. they think that's going to put a little bit of a target on his back. as for governor desantis himself he says his primary focus is going to be on president biden's leadership. take a listen. >> when we get in in january of 2025, we are going to reverse bidenomics on day one. [cheers and applause]. >> we're going to take all of his executive orders, all of his regulations, we're going to grab them and we're going to throw them in the trash can. >> reporter: and, trace, earlier today, chris christie took a little bit of a shot at governor ron desantis on twitter. he tweeted, quote, that he's a politician who memorizes -- he's a florida politician who memorizes lines from his consultants. so potentially a little bit of drama developing there between chris christie and ron desantis and then we saw what happened yesterday with nikki haley goefr after vivek ramaswamy. what's great about tomorrow night, all the candidates are face to face no more hiding behind social media they can hash it out in person. >> trace: yep, some punches thrown, bill melugin live in milwaukee, let's bring in lee carter president and partner. lee great to have you on. i want to play this sound bite, rnc chair ron a mcdaniels on what she hopes will handle tomorrow night. >> in my dream world it would be joe biden, i don't love seeing republicans attack each other, it's fine to contrast issues but i want to keep focus on what our pledge was which was beat biden. >> trace: according to others they're not running against joe biden right now they're running against each other so that's kind of where the knives come out, lee. >> yeah, there's no doubt about it. i wouldn't recommend anyone run against joe biden. his popularity numbers speak for themselves. he's at the lowest approval rating of recent history of presidents, approval on the economy is down at the floor. and so no one really needs to be reminded how bad things are. what they need to know is if they vote for one of these candidates, what does it mean for them? and that's really what the job of each of these candidates is tomorrow, is to lay out the path, to lay out the plan, to tell us something memorable so when we say i'm going to vote for x, it means something. it doesn't mean a vote against, it means a vote for something that's going to be better for me. that's what their job is. they don't have a lot of time. they have a few minutes to make their point. so the point isn't so much what we're going to hear tomorrow, it's what we're going to remember the day after. >> trace: that's a very good point. the new york times talking about a rowdy debate, democrats pop dmorn hand root for a rowdy gop debate saying nobody is routing for the debate to go off the rails more than democrats praying for mr. biden's reelection. on the other side you think, look, a little robust debate, maybe throwing a few hands might not be all bad. >> i don't think it would be all bad. i think we really want to hear from all of these different candidates. in fact, you know, there's really not been a lot of movement among these candidates outside of vivek who's had a big surge but he's still only at 11%. let's not mistake anything. into is are all candidates we want to hear from. we don't know what it's going to be like if they're going to be president. we want to hear their plans for us. how are they going to improve the economy. importantly i think what are they going to do for women? a really big issue on a lot of folk's minds as they're thinking about this. so at the end of the day this is going to be -- it might get messy or ugly but at the point they need to land, each candidate needs to remember what it means if they're in office and hopefully it will be a shorthand to them to say we're going to vote for one of them. >> trace: you mentioned vivek ramaswamy and i'm wondering who you think takes more punches, is it vivek, it ron desantis? what's usual breakdown here? final question. >> you know, i think ron desantis is probably going to take a lot but i think the one person who's going to take a lot is going to be the one that's not on the stage and i think that's donald trump and i also think they're probably going to take a lot of swings and joe biden. the more important thing than the swings though is what we're going to take away on what the pro side is. it's what they're for not what they're against. that's what's most important to come out of tomorrow night. >> trace: there is a lot on the table. lee, great to have you, lee carter from maslankky and partners thank you very much. >> thank you. >> trace: a college athlete was reprimanded by a librarian at a moms for liberty for what she calls misgendering. jonathan hunt is live with more on the battle over biological males in female sports. good evening. >> reporter: good evening trace. moms for liberty describes its purpose as uniting and empowering parents and organized this event under the title, quote, forum on fair and safe sports for girls. it was held at a public library in davis california with a lineup of speakers opposed to transgender girls and women being allowed to take part in female sports in schools. among the speakers was sophia lori of the california family cancel, a christian organization, who compared her own experience growing up as a soccer player to what she claimed is the experience of young girls today. >> 10-year-old girls cannot live out the same dream as as long as member are allowed to compete in women's sports. >> that's when a librarian stepped in having previously warned lori that she couldn't quote misgender people while speaking in the library. >> our policy talks about treating people with respect and you are misgendering somebody that is unrespectful. >> reporter:. >> reporter: as you can hear from the applause there there were members of the audience on both sides of what is always, of course, a highly charged debate. sophia lori kept speaking referring to transgender women as biological men. the librarian stepped in again and asked her to leave. >> my name is erin, i am a licensed -- >> reporter: library oh first trace have not responded to our request for comment. trace. >> trace: jonathan, thank you. ♪ >> trace: while we're on the subject of education, the fox news at night common sense department understands the portland oregon public school system is implementing a new policy called equitable grading. apparently the old grading system was confusing, so the new system will streamline and simplify the process. and here's how the district defines their simple system. quoting now. we need to organize and consolidate our efforts towards common policies to more consistently and better support students and families with equitable grading. common sense doesn't think kamala harris wrote that, but still really has no idea what it means. the bottom line is this, portland teachers will never give a student a grade of zero, even if the work is incorrect, incomplete or missing. homework will not be graded. and a failed test gets a do-over. now the best part, teachers also cannot consider factors like attendance, performance, effort, attitude and behavior. get caught cheating? no penalty. fox news polls show 80% of voters want students to be taught good citizenship, 80%. and portland is telling kids that cheating, failing and not showing up is acceptable. common sense doesn't know the ramifications of the portland grading policy, but is pretty sure at some point, somewhere, some employer is going to want these kids to show up and do the work. let's bring in jill simonian, director of outreach for prager u kids and sonja shaw for unified school district in california. welcome to you both. the whole thing jill is, you cannot have a system where cheating is okay. where it's okay to cheat and then these kids are going to get something out of school. it just doesn't work that way. >> right and this is something at we at prager u kids have been talking about for years now, the danger and travesty of the lowering of standards, the standards keep getting lower and lower and lower and it's a fail on our education system. i know this happened in oregon but i want to take a quick look at new jersey. the new jersey board of education recently decided to lower the standards for high school graduating seniors because, under the previous standards, less than half have kids would graduate high school. so, you know, lower the standards and, hey, look, there's no problem. but it is a problem in the long run. >> trace: it is a problem and parents defending education said the following, quoting here, these equitable grading policies however well intended are a disaster for students who struggle the most and for the students who need accelerated course work. they're right. they're holding back the gifted kids, and they are pushing down the kids who struggle. >> absolutely. and we're showing our kids that there is no challenge anymore. we're raising future criminals just telling them to go with the floechlt you're not going to be chrgd anymore, and we're raising lazy citizens. i mean, these kids have no future if we keep pushing things like this. >> trace: yeah, so this college athlete goes into the library and he mentions biological males competing against biological females and the librarian shuts the whole thing down. there was an attorney at the event because there were some people who wanted -- and she said this. watch. >> not higher than our first amendment rights. we all have them and like i said, i'm excited that you guys are here. i'm excited that you have your signs and your flags. that's the american way, right? to voice your opinion. i would like to voice mine. >> trace: she's right sonia right? that's the concept everybody gets a chance to get involved in robust debate like we see tomorrow night for the candidates. >> absolutely if you agree with them but if you don't they're going to shut you down and pretty much violate your first amendment right because you don't agree. and that's exactly what they keep doing. they shut anybody who doesn't agree with them down and it's absolutely insane. >> trace: she started that whole rant off with jill about hour your rights do not supercede my rights and you have this back and forth debate and people were literally clapping when she shut down this guy talking about biological males should not compete against biological females, people applaud. instead of debating they applaud and that's not how you get something done. your thoughts. >> no, it's not. and one thing that is an indicator have what we saw on that video and i did watch that whole video. one thing we need to remember is our children need to learn what civil discourse means because we have an entire generation now who has forgotten what it means to have civil discourse, that you can listen to something you don't agree with and you can say your point and view and back and forth and vice versa and our kids need to understand that we do have first amendment rights and civil discourse is important for a functioning society. >> trace: we had dual rallies in los angeles, you had the parents rights groups and then you had lgbtq groups. cbs two said the following, organizers of tuesday's counter rally including ground game la and queer nation los angeles accused the parental rights group of trying to bring their hate to los angeles city hall and promoting a hate-filled fascist agenda of fear. and, again, it's not hate to just stand up for your kids, to stand up for what you think is right. >> absolutely. and how is hate wanting to be notified as a parent. that's what they were gathering for, and you had the opposite in opposition there and they were teachers, teacher union vice-presidents. so these are people that are dealing with our kids and they're fighting against the parents. where are we right now? that is absolutely vial to know our teachers are fighting against the parents just for wanting to be notified. >> final thoughts for you because it's all about parents being notified, if that's the thing that is involved here, if kids are afraid of their parents, they've got bigger problems, jill. >> yeah, and i applaud chino valley school district that you're a part of and you are one of the leaders on their board of education, for giving parents transparency, because parental rights equals transparency and that's what everyone wants. >> trace: yeah, jill simonian, sonja shaw, great to have you both on. thank you. >> thank you. >> trace: meantime alarming new video just obtained by fox news of a robbery in oakland showing a woman being violently dragged by the robberies. police say it's one example of what's happening across the city. marianne rafferty is live with the video and the late coast the investigation. marry ann good evening. >> reporter: truly shocking and frightening video of this woman being pistol-whipped and dragged across the ground and democrat-led oakland continues with a surgeoning of crime. the footage shows a woman confronted by two men who attempt to grab several items from her including her purse. she's then violently struck with a weapon and before she falls to the ground she's pulled across the gravel as the two men raid her pockets. the attackers both on the run. the woman's condition is unknown. oakland's mayor has called the rise in crime gut wrenching and now wants to remain no a regional task force to combat crime to send what she calls a hard message. >> you cannot come oakland and continue to do illegal things like side shows or continue to come and take advantage of innocent people who are walking on the streets minding their own business. >> now, not only does oakland face a major budget crunch but also seems to have a problem keeping police officers. according the city's latest staffing report, the oakland police department lost 50 employees the past year. it's unclear if a recently approved budget will allow the hiring of new officers, and you may recall the spike in crime has even prompted the local naacp to urge local leaders to call a state of emergency as burglaries and auto thefts have nearly doubled just over the past three years. trace. >> trace: crime overall is up. maryanne thank you. let's bring in prosecutor wendy patrick and retired nypd inspector paul mauro. thank you both for coming on we appreciate it. wendy the silicon valley bank chronicle said as of early july it was up 37% compared with 2019 and reported robberies were up by about 30%, property crime jumped, too, particularly car-related crimes, car break-ins were up over 40% while vehicle chefs more than doubled. we heard the mayor from oakland talking earlier but also told the naacp quit complaining and come up with a solution. it's really not the naacp's job to come up with a solution. >> it's up to our leaders to come up with a solution. you know, trace, defund the police, endanger the public. that is what the crime trends show. what you really see is you have citizens taking it upon themselves to try to enforce the laws within their communities. you know, that's also seen in retail. we all know that retail theft is theft enter the community. we have gated groceries. we have new self-service checkout message where you can check out anytime you want but you need a receipt to leave. that is the kind of measures we have to take to protect the property values and community safety because it's not just shop lifting it's armed robbery and burglary. >> trace: we're going to talk about retail theft in a moment but i want to get to paul mauro quickly because this is up your alley paul the whole concept if you look at the pictures from oakland and we can show it again it's disturbing to see people treated like this. it's the second type time in a week we have seen video. if we see video for the second time in a week of this kind of behavior you know it's happening more often and people are wondering what is the remedy? is it more police? >> i mean we can say that it's more police the problem is we're not getting them. we've so defunded the police and demoralized the police that police departments across the country are significantly understaffed. and the real fact of the matter is, underlying it all as far as staffing police departments goes, is that nobody joins the police department for the money. you go into it because you want to be the good guy. you go into it because you want to do good work that you feel good about. and, you know, here in new york, the mayor raised the pay for the police, and it was a significant raise. the nypd is not a bad gig pay-wise but yet they're down thousands of officers and they can't fill the academy. and it's really more of a morale thing and it's because the of the laws. they know, the police understand the people they lock up will be out before they're done processing them and nobody wants to do work that gets undone an hour later. >> trace: exactly right. yo of gump store closing in san francisco he gave it to the city pretty good and i'll get your response on the other side. >> if you can't get around and when you're trying to walk the streets you step over needles and human waste and often bodies on the streets, it makes it an unworkable business environment. every small or medium-sized business in the city of san francisco cannot survive. these kinds of things are incompatible with successful business. >> trace: you can't survive, that's the whole thing, you can't have a thriving city if that's what your scene looks like. >> absolutely, it was the flourish before the fall, that's the cities we remember, the beloved cities that didn't have these crime rates. by the way nobody becomes a prosecutor for the money either. but one thing you notice when you look at this footage is we want to make sure communities are safe and when you think about the security that's involved, we're going to have to do it ourselves in addition to trying to attract brave men and women to do a job that is so important. you and i grew up and we said american express don't leave home without it. those community members say it's narcan they can't leave home without. >> reporter: which is stunning. >> really bad. >> trace: paul finally to you dick's sporting goodes down 23% and they exclusively talk about the fact that they are getting robbed day in and day out by these retail gangs. your final thoughts. >> i have a piece up on foxnews.com that caused a little bit of a stir because i listed five reasons why i think this organized theft is ongoeshgs principled among them is not just criminal justice but the reforms. why are we losing our cities and why are we standing for it. i actually think to tie this to a couple of your earlier session, this is a point that should be asked to gop candidates tomorrow. how are you going to save our cities because this is going on coast to coast. and it's not just, you know, new york city has 8.5 million people but there's 20 million people who live in the metropolitan ts town and that's how it is coast to coast. >> trace: you're exactly right. paul wendy thank you both. >> thank you. >> trace: up next, we'll tell you who might be the next to testify and why it now appears that without the irs whistleblowers, the hunter biden case would be a done deal. and later in the nightcap, is there a job you think you'd be pretty good at but you have zero credentials? pretty sad. and i posted it to show that kenny's not always happy. within 24 hours people had donated over $5,000. no, you're kidding. we set up the patriotic kenny foundation to give mobility scooters to veterans. it has changed my life tremendously. none of this would've happened without tiktok. ♪ >> trace: new subpoena's being issued by house republicans demanding to know more about the hunter biden probe before the sweetheart deal was made and then later unravelled. the senior national correspondent kevin corke is live in dc with the latest on this. kevin, good evening. >> reporter: evening, trace. it seems like no response is becoming the official response from the doj to house republicans, especially when it comes to answering questions about how the hunter biden probe has been conducted. only now, those requests are becoming demands for testimony and accountability. you'll recall that this summer, two irs agents testified before congress that they had concerns about how the investigation into hunter biden was being run by the u.s. attorney in delaware. they speculated that, you know, things were being limited. potential charges against the president's son maybe not so much. only now, the pressure is building on capitol hill, with the house judiciary and ways and means committee issuing four subpoenas for witness testimony pertaining to the allegations of preferential treatment writing in a letter to the doj's inspector general, quote, their testimony raised serious questions about the federal government's commitment to even handed justice. the doj oig acknowledged they later wrote, that they received information from the whistleblowers but have not indicated whether their office is meaningfully investing the disclosures. meanwhile special council david weiss is under more scrutiny tonight with even some democrats aligning with republicans and asking questions about the investigation's pace. >> i'm sure he wants the best for his son but if the justice system says look, these laws were violated and here's the penalty for it, that needs to happen. >> reporter: and while republicans have publicly floated the idea of subpoenaing members of the biden family, it remains unclear how soon or if that will ever happen, trace screw that's a little muddy. kevin corke live in dc thank you. let's bring in assistant attorney general john yoo. i want to get your take on what kevin was talking about first there. you make the revelation that david weiss the u.s. attorney now special council was planning not to charng hunter biden with anything until those irs whistleblowers finally came out. what's the thought on that? >> people should remember that there's basically two tracks to this investigation. one is, what was hunter biden up to? what was his dad up to? where was the money coming from. where was it going out. that's one. then the second investigation is how was that potential crime investigated by the justice department. was it politically influenced, wore things slowed down or even stopped as the irs whistleblowers say. it's very important for the committee to move slowly and get testimony from the people on the ground first and to get subpoenas to find out where the money has gone. >> trace: i was interested in this because i was kind of reading your talking points, john, and you believe that the special counsel's appointment of david weiss, you have a lot of republicans saying they believe this is an attempt to stonewall the house investigation. explain your point there to us. >> first, it's a great victory for the house committee to have raised the political pressure to force the attorney general to appoint the special counsel. before the appointment. it looked like hunter biden was going to get away with a mere slap on the wherein and a crime for potentially influencing millions and millions of dollars. but now what i think they have to do is ratchet up the pressure during the investigation. ken star wasn't the first who investigated the clintons. there was another player who wasn't doing a good job and political pressure from the hill got a switch. and we can do that here if the house committee continues to make new discovery with their investigation. >> reporter: finally the new york post says doj officials say jurisdictional issue may prevent investigation into hunter biden whistleblower coverup claims. justice department inspector michael horowitz of a potential, from investing him of blowing whistleblower campaigns alleging the coverup in the criminal investigation of first son hunter biden. everybody seems to trust michael horowitz and yet he's saying, you know, i really don't have the authority to look at this. final thoughts on that, joe. >> i worked with mike horowitz back 20-some year ago. he is an impartial neutral civil servant. one of the great in the justice department that both rely upon. if he's saying there's a jurisdictional problem we need to learn more about that. but maybe the house committee should start hiring more investigators and demand more answers to try and carry on the ball forward, if the inspector general, doj, can't. >> i think they've promised to do exactly that. john yoo great to have you on as always sir thank you. >> thanks trace. >> reporter: coming up what's keeping voters up at nice. it has to do with the southern board. and still to come a terrifying at a con onin pakistan and a father meets the father of the daughter he saved. viral videos are next but first a live look tonight, hotlanta temperatures in the mid to upper 90s, the rest of the week in the south. we are coming right back. how can you sleep on such a firm setting? the most important issue facing the country? well, the economy. but in second, immigration and border security. marianne rafferty is back live with more on that. marianne, even the big cities are news poll which finds registered voters which find immigration and border security are the second most important issue facing the country. the issue could be a potential liability for president biden with more than 60% say they stae approve of how he is handling the issue and while the biden administration maintains border is not open take a look, according to the new york post u.s. officials have welded so much 114 massive gates on the border and those are reportedly letting in 1400 migrants a day. for months now the white house said there were reforms to immigration policy have led to a big cities, a lot of people wouldn't know about it. >> that's right. trace, for decades, members of concerned women for america in texas and southern california have been so concerned about the crime, about the over-burredening of their school system and healthcare, and now suddenly, shockingly states like new york where are getting a taste of what we've been dealing with for so lovenlth americans are very compassionate and care very much about our neighbors across the board but it's a horrible situation. and we have children that are being trafficked. you have women that are being raped. you have drugs that are coming across. we, as american citizens, must demand that the board is closed and that we're able to bring people over in a way that is helpful for them and for us. >> trace: pastor the whole concept, even evangelicals you talk to, aspeny was saying, they're concerned, always concerned about human beings coming across but the concept here is there has to be some kind of control. you have to have borders if you are a country. >> well, that's right, trace, and the bible says god created government for two reasons, to maintain order in society and to protect its citizens and when you have an open border policy it creates chaos and also insights violence against citizens. i know there are people out there who think it's unchristian to have borders and not to welcome everybody. look, god's the way who came up with the idea of nations, act 17 said the boundaries of those borders of those nations and i think most christians want an immigration policy that's compassionate but enforceable and most of all will protect its citizens. >> trace: because the trip these migrants are taking is no. compassionate. the hill writing abortion rights reshaping the 2024
