sexual assault. marianne rafferty is live with a fight that is escalating across the country. marianne good evening. >> reporter: good evening trace. in his opinion temporarily blocking rules j david f bowman says he hopes the state and school boards can negotiate in good faith and strike a balance between protecting transgender students and the rights of parents to bring up their kids. three school districts in monmouth county were sued by the state back in june after adopting policies that require teachers and staff to inform a parent if their child wanted to use pronouns or school facilities that did not conform to their sex at birth. that injunction is temporary while the larger case plays out in the state's civil rights division. temperature attorney representing the marlboro board of education saying that process could take years. in the meantime he writes the school district is now severely constrained in its ability to notify parents about important issues involving their minor children which is tragic on many levels. we're exploring avenues for appeal. meanwhile, down in virginia, counties are at odds over whether to adopt governor glenn youngkin's guidelines on trans students. the roanoke board unanimously approved rules that require teachers and staff to notify parents without anything related to their child's gender. the policy mandates that for activities separated by sex, schools must go by a student's birth section not gender identity. speakers on both sides of the issue made passionate comments before last night's vote. >> besides it being a legal right, parents have a god given right to be involved in every aspect of their child's life, including their education. >> for those children who don't have an a firming home to go to, the teachers and affirming staff members are the life line. they are the reason that they are alive and you're taking that away. how many people will die now? >> reporter: a different story up in northern virginia, the prince william county school board announced yesterday they will not be adopting youngkin's policy saying the rules in place already meet non-discrimination laws and earlier this week the largest school district fairfax county said it would not follow the guidelines either so trace a lot of parents will be upset about this. >> trace: battle across the country thank you. let's bring in bridget ziegler director of school board programs at the leadership institute and carry ingraham director at the discovery institute. ladies thank you for coming on we appreciate it. carrie to you first a temporary hannity the parents in new jersey, no doubt about it. >> trace, this is happening all over the country, not just virginia, not just new jersey but there's over 1,000 school districts, it's 1040 now and that affects 11 million students. under these policies that say a school district can or even should keep a child's gender ideology through this social contagion in secret from moms and dads goes against the very foundation of our country where parents have a god-given right to raise their child, and it's an attack not just on the individual's identity but it's an attack to 0 the breakdown of the family in our country and we need more people like governor glenn youngkin who's going to fight this and they're not backing down. >> trace: and the judge, david bowman in his preliminary injunction, bridget, said the follow, quoting here, the state has demonstrated a reasonable probability of success on its claim that the amended policies if implemented will have a dis pray impact on transgender gender non-confirming and non-binary youth. i mean how can you show any evidence that it's best to keep secrets from parents. >> actually i would argue that we have seen more evidence that would illustrate the opposite. i think it's very alarming again we have government institutions getting in the way between parents and their children intentionally and, again, more and moreest that's illustrating that this is -- that they're pushing and promoting an affirming transgender or gender questioning and putting towards policies and actually procedures that are irreversible and we're seeing more children come forward and trying to detransition so we need to -- it's very alarming. >> trace: i have one more flat platform on top of that because we talked about this being a bat until the country, in orange county california last night some parents very heated, here's a sample of that and i'll get your response. >> it should never be okay to tell children not to speak to their parents. >> i think it really behooves us to ask ourselves the most fundamental question which will help us understand why this board policy is needed and the question is as follows. whose children are they? >> trace: and no matter what side of the debate you're on carrie, that is the question. whose children are we talking about? i mean, these are not the state's children. these are parents' children. >> absolutely. you know, from birth, these resist the parents that know everything about these children, their personalities. and because of the social contagion that's happening in school that's funneling kids down this ideology and is attacking them on all fronts, it's now a curriculum under the guise of social emotional learning they're trying to change bathroom regulations whereby logical males come into a female's bathroom, locker room, sports teams. they're trying to make it a normal thing for these children, but it's moms and dads that know their kids. they're going to be there for these kids far past the school years when the teachers come in and out of their lives and be there when the kids detransition but like bridget said it has irreversible damage on these children once they funnel them through this social contagion. >> trace: yet you have groups going after people like you and it's kind of amazing. this is orlando weekly writing following. parents launch parenting with pride frame combat right wing culture war. it goes on to say its launch comes in response to a right wing educational noovment in florida has sought to roll back acceptance of gay, queer and transgender people and whitewash history in public schools under the guise of empowering parents. under the guise, bridget of empowering parents. it's one of those things where they're literally saying that they're hiding behind parents' rights bus other than that they're racist homophobic transphobic you name it. >> absolutely. we've heard those words done before but i can tell you i'm around the country talking to moms and dads who have never been politically active before and these kind of issues are mobilizing them and we're training them to be effective in taking back their school boards or the parental rights of every level of government. i'll tell you, there was a poll across party lines, 70% of parents and citizens believe that parents should be the ones making these decisions and school districts should not be withholding any information from their parents about their minor children. >> trace: every poll we see in all these states, including blue states, the polls always come out about that same way, that everybody thinks parents should have the right to parent their children. carrie, bridget, thank you both. we appreciate it. >> thanks trace. >> trace: meantime, just days away, as the banner goes forward, just days away from the first gop debate here on fox news. the candidates are working overtime to get attention and to get a spot on the debate stage. ashley strohmier live in the new york city news room with a mad final rush for candidates to qualify. ashley, it really is coming down to the wire. >> yeah, it really is trace and several republican white house hopefuls are appearing at a conservative conference with the hopes of making up ground against donald trump who continues to hold a commanding lead in the latest fox news poll. the former president not speaking at the atlanta event but florida governor ron desantis was there today and told radio host eric erickson he wants the 2024 election and the fox news primary debate next wednesday to be a referendum on president biden and not on 2020. >> there's nobody that wants us to be looking backwards more than the democrats and the media. they would love to have us have to relit gate all this stuff from 2020, 2021. because what does that do? >> i do not. >> heavily criticized for not using the i land's siren warning system. this as they say the search for victims is slower than expected with about 60% of the burn area searched and only a small number identified. >> a lost us haven't even had time to grieve. we just slowly getting out of the survivor mode. >> reporter: so i'm told another reason fire fighters may have lost pressure is because excessive heat damaged the pipes but, trace, you know, almost we've been in lahaina almost every day the last week and it's changing. not only is the national guard around every corner, they've erected a fence around much of the city. back to you. >> trace: william, thank you >> well, meantime southern california is now bracing for a whole lot of rain, high winds and the potential of dangerous flooding as tropical storm watch has now been issued in southern california for the first time ever. back now to marianne rafferty, she's live with what we can expect in the wake of hurricane hillary. >> reporter: yeah, well, this is amazing the last time a tropical storm hit southern california, 1939. and it killed nearly a hundred people so residents are taking no chances. >> batten down the hatches. >> reporter: yeah, they're making sure they have plenty of supplies on hand like water and canned goods and piling up the sandbags in order to protect homes and businesses from the threat of potential dangerous flooding and landslides. >> i mean a lot of people here are excited because the waves are going to get pretty heavy but it's going to be some rain so, you know, usually there's some flooding and the landslides and things like that. >> reporter: and right now, powerful category 4 hurricane hillary continues to turn toward the southern california coast. there's a tropical storm watch in effect for the first time in history and severe weather alerts in effect from sunday into monday for many large metro areas that include san diego and los angeles and a warning stretched to inland areas as well like palm springs. >> personally, it's kind of unbelievable. i mean, this is unprecedented. so it's sort of unbelievable. >> reporter: residents across southern california will see the weather start to deteriorate over the weekend with the remnants of hurricane hillary expected to hit the region by sunday night. trace? >> trace: going to be a rain makerment maryanne thank you >> as crime continues to plague america one troubling trend is the rising number of young people committing the crimes. let's bring in psychiatrist dr. yelled a safai, great to have you on, this is from the wall street journal focusing on kids juvenile crime surges rising crime growing oval young victims kids killing kids, new york city police say 124 jove niles committed shootings up from 62 in 2020 and 48 in 2019. so more than both of those years combined. more kids are depressed, more kids are committing violence. more kids are killing other kids and killing themselves. what's going on here? (soft music) >> trace: streaming is now becoming more and more popular for american tv viewers but hold your wallet because the prices, if you want commercial free, are going way up. welcome to stream flailings, let's bring in vat america's director and pop culture and entertainment expert jacqui jordan. thank you both. seth, i want to put these on the board. this is the ad streaming cost. you see netflix 15.49 now, disney plus doubled their price, 13.99 hbo max 59.99 and hulu and all these other ones. hitting like 75 bucks for these things and sometimes you still have to watch the ads. >> yeah, what's happening now is i think the studios and the streamers have figured out there are different price points out there that consumers might not be so price sensitive on the subscription side of things, disney seeing it so is netflix so pushing that price up and the mid tier, the average revenue per user on the ad supported stuff so they're emphasizing the free plans too, all about profitability not just getting subscribers and building programming. probably a smart strategy. >> trace: jacqui i remember reading, they're all about eyeballs. just sign up everybody, get eyeballs and now they genuinely need revenue to actually survive. >> well, it's so interesting because they take up 62% of the marketplace for media assets, and the timing for this is really interesting, obviously we're in a recession but also in an actors and writer's strikes and they're fighting over residuals for streaming rights while the companies are raising the price right now for the consumers. so it's ironic timing. >> trace: it really is. i want to move on to the next subject because is anybody watching following this blind side lawsuit, you know, with michael orr going after the to you touey family. but why are they asking sandra bullock to return her oscar? what's the point? why are you attacking sandra bullock. >> i couldn't agree more with you on that. it's not the thing to attack her about but they're calling this a white savior story so they're going after -- there's a hint of racism in here but if you look at the best picture movies the past couple years there's been a lot of social minority stories being promoted so to go after sandra bullock is ironic and a distortion and from the same exact community that is also saying that, you know, a lot of these white actresses ended up adopting black children. so the logic for sandra bullock to have to give back her oscar because it's a white savior story is all a complete distortion. >> reporter:. >> trace: speaking of white savior story this is the author of the white savior film it's a common theme where the black person being saved has to be almost rescued from blackness itself the message the closer to whiteness you become the more your problems are solved. i think what jacqui's saying there, i don't quite get it. if you're an actor you can play whatever you want to play and it doesn't mean you're actually doing whatever the person -- it's like playing hitler in a movie not like you did something nefarious. >> there is a tradition going back to the kill a mocking bird and all the way through of this white savior factor and it's a difficult slippery slope here. i think in the creation and writing of hollywood pictures over time, and we're going back, there probably wasn't enough diversity representation so you see that in some of these stories. i think the good news is you're starting to see so many different pictures, whether it's barbie or get out or even squid games coming from lots of different angles and i think, i don't know if something like this picture, this was 12 years ago, right, when it was released? they're not marketed the same way right now anyway. and the oscar stuff is ridiculous because it wouldn't make any difference at all so it is absurd. >> in the last couple years in our oscar lineup we've had 12 years a slave, two years ago we had coda, child of disabled adults. so, you know, we've definitely had a lot of minority representation in flames in the last decade, unlike -- you know, so we've definitely hit the quota in our stories. so to come back and do a retro pull is kind of ironic. >> trace: ten seconds wrap us up seth?
