sirens on this i island. and why that wasn't activated, because it clearly would have given people more time to escape the flames and get out of town. and, of course, the number of fatalities would probably not be the number that it currently is. another big challenge here, mike, is housing. why? there's not much of it. it's expensive to rent or own. and unlike, say, the mainland there are not any towns that can simply absorb 4,500 people right now that need shelter. >> lahaina was really small, nice historical place, and it's gone. all the kind of, like, precious memories of my kids and kind of generational stuff. >> reporter: so eva adams, she lost her home. it was in this new 89-unit, affordable housing complex that is now, of course, as you see, just ashes. there are about 2,700 buildings here that were destroyed in lahaina, 86% of those were homes. and the community of lahaina is a very working class, a lot of native hawaiians who serve the resorts, and right now those people who are now homeless are asking the residents or the resorts, rather, to step up and help them. >> i would really like to see the hotels mahalo us for, like, giving, you know? if making it possible for all these tourists to come here and enjoy their vacations. it's our turn to be taken care of. >> reporter: so the other issue, mike, right now that people are talking about, of course, is the number who are unaccounted for which is in the hundreds. and listening to the police chief yesterday, they brought in 12 additional cadaver dogs to try to speed the process. but frankly, as hot as these fires were, they've only looked at so far 3% of all thed buildings, and now we're approaching 100 fatalities. he believes many who are unaccounted for remain missing and never be identified. >> we've got a lot of work we've gotted to do. we've got one way in on one side of the island, another way in on the other side of the island that's a one-way road, and we've got with an area that we have to contain. that is at least 5 square miles. and it is the full of our loved ones. >> reporter: that's why they don't want people -- that's why we have a check epoint if here, mike, right? the police and search and rescue don't want everyone around these areas where, hopefully, they'll find some remains and be able to get the dna done to identify who they are. the other challenge, mike, you know, i talked to fema yesterday, the housing here, it's a million dollars, right many in and the maximum sba loan is about $500,000, so the challenge is going to be for these 40% of the people here didn't have insurance trying to put their lives back together. back to you. mike: william la jeunesse live in maui, thanks very much. for new on the damage this hawaii, i'm joined by democratic congresswoman from hawaii, jill that cue da, congresswoman, welcome. >> thank you. mike: first, my condolences to the people in maui and just stunning loss of life. you've toured some of the worst hit areas. what is your assessment of what you've seen? >> you know, i took my first walk through lahaina yesterday with fema and the governor, and it was the absolutely heartbreaking. it hurts to watch the videos and to see the, you know, the pictures, but to actually walk through the streets, a place where it's so familiar to the a lot of us. i walked to the public library that i always visit when i'm in town, and it's completely gone, you know? it breaks your heart to also realize that while so many thousands fled and are now in shelters trying to figure out what to do next with their life, so many still remain. right there. and we have a responsibility, an obligation and a duty to collect those remains, to find all of our loved ones, to bring everyone home this one way or another. and it was a very surreal, painful moment to walk through those streets yesterday. mike: hawaii has warning sirens in the maui area. did the system not work properly, or was it more a matter of how quickly the fire spread? >> you know are, when you go in there and then when you see these videos, you realize just how past that fire spread. and i talked to survivors who said it was just whipping and coming so quickly, and it was burning hot. we do have those warning sirens up, everyone knows them the, we test them once a month. we really know them as tsunami warnings that you turn on the radio, the television, your phone and figure out what do i do next. some people think we run away from the ocean. in this case, it would have been right to the fire. but it happened so quick quickly in this case, a 60 to 80 mile-an-hour wind with, i spoke with people who were clinging to rocks because that's the only place they had to go when the cars and roads were blocked off. they sat there and they held on, but they could the feel the fire burning them from the roadside. and they said when the waves came this in, they said people were with lost areful people couldn't hold on. it was just a very, very quick turn of events that happened catastrophically in our lahaina community. mike: fema's estimated reconstruction could be in the neighborhood of $6 billion. how do you make the case to your colleagues here in the the washington that the hawaii should be the priority? >> this was a national disaster. you've heard our people say it, and it's absolutely right. i have no doubt that at the end of the day when we really, you know, determine the true extent of the loss, devastation here not just hawaii will be impacted, there will be so many other states across our country that will feel the impact and the loss of people, of life, of memories, everything, and is we're going to have to come together as a country nationally to provide a response. this is what happens in real america when we have disaster strike. this is real america you're looking a. our ability to support each other as america is critical as a country, and that is the case we have to make over and over again because we will need help. not just this year, not even just next year. what you're looking at will take generations for us to come back from and rebuild, but we will. we absolutely will. mike: congresswoman, thank you so much for taking time to speak with us today. >> thank you. mike: for more information on how you can help, the visit the american red cross web site. you can scan the code on your screen to get to the site and make your donation or text hawaii to 90999 to make a $10 donation. ♪ ♪ mike: attorney general merrick garland are tapping david weiss as special counsel in the hunter biden probe as the plea deal for the president's son has now collapsed. it is likely to go to trial. lucas tomlinson is live from the white house with the latest. hello, lucas. >> reporter: good afternoon, mike. hunter biden's attorney says it's not inevitable that this case goes to the trial. as you can imagine, both sides of the aisle very divided about the naming of david weiss as special counsel. here's what they said. >> hunter was the salesman, but the product was joe biden's personal favors. and that is, if true, corruption at the very highest level of government. >> it's what my republican colleagues have been demanding and asking for for months. now they seem to disapprove it for some reason. this is why we have a justice system. let's just let them do their job. >> reporter: president biden is spending the weekend at his vacation home in rehoboth beach, hunter biden's attorney saying the president had nothing to do with his son's oversea business dealings. >> if the most people that are criticizing the biden family is that when the president calls his son every day and it goes on the speakerphone, he says hello to the people in the room, that is not an offense if. that is nothing other than a loving fair. -- father. >> reporter: clay travis says it's not normal for anyone's father to be on the phone when it comes to running business. >> do you know how many times my dad has been on a business call? >> how many? >> in my entire career? zero. >> reporter: veteran tax attorneys say it's also not normal for getting misdemeanor charges for owing this much in taxes, mike. mike: lucas tomlinson, thanks very much. another indictment against former president trump appears imminent as two witnesses are now confirmed they are set to appear before a grand jury early this week, a sign that georgia district attorneyny willis may be close to bringing criminal charges -- the fannie willis. matt finn is live outs the courthouse in atlanta. >> reporter: this in as little as 24 hours, a grand jury might be beginning to hear evidence this in a possible indictment against former president donald trump here in fulton county. these potential charges stemming from alleged criminal behavior related to the 2020 election here in georgia. yesterday at the iowa state fair, president trump talked to a reporter about the potential indictment. >> reporter: is there any chance you'd take a plea deal in georgia? >> we did nothing wrong. it's called election interference. you know what that is? [applause] these indictments are brought on by biden who can't even put two sentences together. >> reporter: the former lieutenant governor, jeff duncan, confirmed yesterday that he will testify before a fulton grand jury on tuesday. fulton county d.a. fannie willis has been investigating whether trump and his associates broke state laws when they allegedly tried to overturn trump's loss here in georgia in 2020. and trump faces potential rico laws here in georgia which are classified as racketeering or organized crime. trump has been increasing his attacks against the d.a., posting on his truth social media, quote, i made a perfect phone call of protest. what does phony fannie have to do the with me? and and this indictment could come as early as monday or tuesday, but we're just not sure: we'll be out here and will keep you updated. mike: matt finn live e in atlanta, thanks a a lot. let's beige in republican congresswoman from the great state of wyoming and member of the house judiciary committee, harriet hairingman. welcome, congresswoman. >> thank you for having me today to. let's start with your colleague, jamie raskin, and i will get you to respond to what he had to say. >> they haven't been able to show any criminal corruption on his part. what they've got is hunter bide, and we all seem clear that this guy was addicted to drugs and did a lot of really unlawful and wrong things, and we have said let justice system run its course. they're not saying that about donald trump. mike: so he is stay saying that hunter biden did some bad things, not the president. your thoughts. >> well, i find it interesting that they're now admitting that, and hunter biden has also admitted that he had a severe crack addiction from 2003-2019. so that begs the question, why would these countries be hiring hunter biden for millions of dollars to be on the board of burisma and to be providing services? what were the services? all we need to do is use common sense. the reality is that hunter biden had nothing to sell other than joe biden. he had no skill set. this is a gentleman who, by his own admission, had serious addiction problems. and when you look at his history while he is an attorney, he's never really practiced law. so you have to ask the question, what was he -- was he an experience pert -- expert on ukrainian employment law? was he writing contracts? of course not. he was selling one thing, and that was access to joe biden. he didn't have any other skill set to sell. mike: how do you assess the appointment of a special counsel in the hunter biden case? >> what i'm terribly disappointedded in is that they have the person that they have appointmentedded, mr. weiss. this is a man who has failed by every metric last five years to actually hold hunter biden accountable for his illegal acts, and then -- [audio difficulty] as special counsel to continue to cover up for the biden crime to family? this is absurd, this is ridiculous. i think it demonstrates a level of desperation on their part, to try to find a way to continue to cover up what we know is serious corruption coming from the very top of the biden family. can that's joe biden. and that's joe biden. but the very law, the potential counsel law specifically requires that a special counsel be appointed from the outside, not an insider in the department of justice. and i don't think you can find anybody more inside than mr. weiss with. mike: to be fair, president trump, former president trump, has some legal issues, two, three indictments so far, maybe a fourth on the way if you consider georgia. how do you assess his legal challenges? >> well, i think that this very clearly is election interference, and and i think one of the most troubling ones is the accusations related to january 6th. this is an effort to criminalize freedom of speech and freedom of assembly and all different kinds of things. so it's interesting to me that they continue piling up these charges, and yet when you go into the courtroom, they're asking the courts to make sure that any of the discovery and evidence that they allegedly have against him is shielded from the american public. as a hong-practicing trial attorney -- long-practicing trial attorney, one of the most important aspects of a haut is being able to conduct discovery, but discovery's to done in the open. so they're using the justice system as both a sword and a shield. they're going after a president trump while at the same time they're saying but the american people can't see the evidence that he, tata we have or that he has -- or that he has. we have the right to leak and to bring these charges and all of that and to keep him under indictment, but we're going to make sure that the american public doesn't actually know what the evidence is against him or what his defenses may be. mike: congresswoman, thank you so much for your time and your analysis today. >> thank you. mike: now from the other side of the aisle i'm joined by democratic congresswoman from the if great state of michigan, debbie dingell. welcome. >> good to be with you. mike: let's start with a comment your colleague pat fallon made. let's play are it. >> they just want to kick the can down the road to get through november of next year. if joe and hunter biden had nothing to hide, why not just release your bank records? why not cooperate with the investigation? mike: how do you respond, congresswoman? >> i'm going to agree with my colleague, jamie rag raskin this morning. i do believe this belongs in the justice system. i don't think they're kicking the can down the load. -- the road. i think we need an open and transparent process. i want to be very clear, this is not a democrat that has been appointed. he was appointed as a u.s. attorney under president trump. so i think we are a nation of laws, i believe in due process. i think that hunter biden's case belongs in the justice process and we need to let it play out. and i think it needs to be as transparent as possible, and i think there continues to be a lot of political politics on all sides, and there is no evidence despite republicans trying to the find it over the last three years that president biden has been involved in any legal business or doing business with his son. mike: i want to play a clip from your former colleague, will hurd, who's now a presidential candidate. i'll get you to respond. >> that doj should show a level of transparency that they've never shown in their history because of the sensitivity of all these cases whether it's the documents case and the january 6th case against donald trump or it's what's happening against hunter biden. there's a lack of trust in our institutions. mike: do you agree that trust in our institutions has been harmed in. >> absolutely agree. and i absolutely agree with him that we need transparency on all of these cases. particularly i believe it in the trial of donald trump. i don't care what side you are on, and we should, by the way, let due process play out. there are a lot of people that have already made up their minds on all sides. i think we should be opening those courts to television so that people can hear the case presented, the credibility of the witnesses, the quality of the evidence that's produced because people don't have the ability to see that, they're never going to believe what an impartial jury, remember, both sides are going to have the a say in who that jury is. and i think we need to be as transparent as possible. this lack of trust in the institutions in this country is a danger to our democracy. mike: i was looking at an article from "the new york times" that said the prosecution of former president trump could have terrible consequences. what do you make of that? mike: alicia acuna, thank you so much. ♪ mike: the surge of my grant withs at our southern border increasing strain on both boarder efficients and cities across the nation. new york city is working on identifying additional locations within its five boroughs to house the overflow of migrants overwhelming the city. we have team coverage with bill melugin tracking the latest developments on the ground at the border, but let's are start with nate foy looking into the crisis in new york city. hello, nate. >> reporter: hey, mike, a four-star hotel in long island city is one of almost 200 taxpayer-funded shelters for pie grants, but as mayor eric adams looks to share the burden with the rest of the state, erie county is off the list of possibilities after two reported sexes yule assault allegations in the past week involving migrants. democratic erie county executive said, quote, i demanded that mayor adams halt all further transportation of asylum seekers to our community until such time we can resolve all security issues. he also went on to the accuse a contractor hired to help migrants of possibly interfering with the second sexual assault investigation. now, both incidents happened at buffalo hotels. your past experience can help you earn your degree faster and for less. get started at phoenix.edu. ladies... welcome to my digestive system. when your gut and vaginal bacteria are off balance. you may feel it. but just one align women's probiotic daily helps soothe digestive upsets. and support vaginal health. ♪ ♪ mike: concerns arising over merrick garland's special counsel appointment as some republicans now question whether weiss will be an unbiased investigator pointing to weiss' work on hunter biden's plea deal that that fell apart last month. for more on potential legal fallout for hunter biden, hans von spakovsky joins me, senior legal fellow at the heritage foundation. well -- welcome. >> thanks for having me. mike: how do you assess the appointment of the special counsel in the hunt e biden case? >> well, i think the concern it was feeded, but it isn't going to change the way he's compromised the investigation. he and his lawyers have, had either incompetence or intentional misconduct in the way they mishandled it. there's incident after incident after incident9 of things they did wrong including justs basically allowing the statute of limitations to run on really serious tax the evasion -- tax evasion issues. mike: does the plea deal that he offered the president's son hurt his credibility? what about that? >> very much so. you talk to any veteran justice department lawyer, and they are all astonished at what i would say is the sweetheart deal of the century. he was going to walk away with probation for not paying upwards of $1.6 million in taxes, probation, and he was also going to get away with a serious gun charge. plus, no prosecutor would agree to a plea deal if really they still are investigating other charges which, as you know, they said they were. no prosecutor would do that. mike: to former president trump's legal issues, we expect a prosecutor in georgia, fannie willis, to potentially bring an indictment this week. here's the former president on that prosecutor. let's play it. >> they say there's a young woman, a young racist in atlanta, she's a racist, and they say, i guess they say that she was after a certain is gang, and she ended up having an affair with the head of the fang or a gang member. and -- the of the gang or a gang member, and this is the person that wants to indict me. mike: how do you assess that potential georgia case? >> unfortunately, fannie willis is a soros-supported, rogue prosecutor who sees indicting donald trump as her way to the national political stage as a democrat. and, you know, in her grand jury investigation a local judge already cited her for her misconduct in targeting a state senator with or her grand jury, someone who was running for lieutenant governor, who is now lieutenant governor, and then using that targeting as a fundraiser for the democrat that was running against him. that, i think, tells you a lot about her bias and partisanship. mike: hans, thank you so much for your time and analysis today. >> thanks for having me. mike: we will take you to the iowa state fair where many presidential candidates have spent the weekend trying to stand out from the if pack. that's after the break. ♪ ♪ uuuhhhh... here, i'll take that! [laughter] >> that's a good question. >> reporter: so to be continued on that. we if we will see the former president on that debate stage in wisconsin, although governor desantis tells me the think -- he thinks trump should be there because it's what's best for the american people so he can the hear what he thinks about policy and what he would do for the american people. mike: i'm wondering if you've had any iowa state fair food like pork chop on a stick, cheese curds or even a fried twinkie. >> well, the polls are showing otherwise, and that's why what what we've seen in the headlines is this new term that i love, momentum. we're so excited to see the direction in this race is shaping up, especially in iowa where senator scott's connection with iowa voters and their heart and faith and love of country is really what's guiding them to switch, really consider the whole field, look at him very closely and see that he has a conservative record and a record of not only fighting, but actually winning on these issues. mike: here is former congressman will hurd. let's play it. >> it's the an indication of how fragile our election system is and how donald trump's efforts were making us -- increases our lack of trust in our systems. and one more example of why donald trump is running for president is because he's trying to stay out of jail. mike: caroline, how do you respond? >> that's ridiculous, and nobody even knows who will hurd is. if you go to the voters in iowa or new hampshire, they don't know who he is, but they certainly know who donald trump is. there's a groundswell of excitement and support for the former president as demonstrate thed at the iowa state fair yesterday. ron desantis was there speaking, begging for the voters' votes, and the voters were chanting back at him we want trump. and why is there that overwhelming love for president trump? if it's because he delivered for these people before. he speaks for the forgotten men and women of this country. he unleashed our domestic energy production, made america the export of energy, he secured our border or, we had an economic bomb, and now these people are feeling the devastating con consequences of joe biden's agenda. they want donald trump because they know he will deliver, and he will be our republican nominee. the only question remains, who will come in second place. mike: we have a first republican presidential primary debate on august 23rd. denise, what will be senator scott's strategy? (soft music) ♪ ♪ mike: fox news confirms the pentagon's looking into reorganizing the d.c. can national guard. the potential changes would be aimed at addressing issues highlighted in the chaotic responses to the january 6th riots and the george floyd protests. alexandria hoff is live with more details. hi, alex. >> reporter: hi, mike. what makes d.c. different, there's no governor to mobilize the national guard. it's a chain of communication that the district blamed for response time delays on january 6th. the pentagon then blamed the district for turning down earlier or offers of manpower. army officials also have safety concerns over the d.c. guard's response following the george floyd protests in 2020. in addition, some feel political appointees should not decide when assistance is needed for local leaders who they may disagree with, so the pentagon is looking into possibly making some changes there. one could be handing over control of the d.c. guard to the u.s. northern command which is nonpartisan. d.c. mayor muir yell bowser has maintained that her office should have the authority. according to the associated press, pentagon feels that the district calls on the guard too frequently as a means to deal with law enforcement shortfalls. this year decides homicides are up 25%. >> we're tired of this and enough is enough. those who live here know we are clearly in a war zone. i'm going to say it again, we are clearly in a war zone e. >> reporter: regardless of how it's done, d.c. council member trey onwhite supports calling in the national guard now to deal with out of control violence. >> well, there are a lot of areas in d.c. that we're experiencing shootings every day back to back to back, and the issue is coverage and presence. desperate times calls for desperate measures. >> reporter: the ap reports if the d.c. guard is restructured, a deal could bring the district more military police, mike, which could help as well. mike: alexandria hoff, thanks so much. that is all for this hour of "fox news live."
