>> bret: former president donald trump will not have to appear in person for the next hearing he's facing following this week's indictment regarding alleged efforts to overturn the 2020 election. the trial judge making that ruling today. this comes amid growing questions about the justice system in the midst of dozens of criminal charges against the former president and multiple investigations involving the family of president biden. congressional republicans are vowing a strong response to what they feel is a two-tiered application of the law. senior congressional correspondent chad pergram starts us off tonight live from capitol hill. good evening, chad. >> bret, good evening. the g.o.p. says there are two sets of rules. one for the bidens, another for former president trump. the right intends to level the playing field. >> you can't beat them, you persecute them. >> republicans believe there is something nefarious going on. >> it seems as though every time trump goals higher in the poll he gets a new indictment. >> mccarthy suggests the timing is fishy. former hunter biden business partner devon archer sat for an interview with the house oversight committee on monday. the former president was indicted on tuesday. >> it seems to me, after you learn of the real dealings behind the bidens, the next day he gets indicted. >> house republicans are threatening retribution. >> devon archer transcript, i think, tells a lot about the corruption in the biden crime family. >> most democrats try to ignore g.o.p. accusations. it's unclear if the president faces a blind spot. >> the only thing that the biden administration can try to do is be cooperative and get the facts out as best they can. >> some republicans demand impeachment. >> when we get back in september, if there's not a clear path and a clear timeline for impeachment, i'm going to pull the trigger on that. >> democrats accuse republicans of a diversion. >> they have to change the subject and they have nothing to offer the american people in terms of jobs. >> republicans want information from delaware u.s. attorney david weiss about hunter biden's plea agreement. weiss says he's in control of the investigation but the g.o.p. suspects there was pressure from above. >> which is it, mr. weiss? you have full authority to bring them when, where and whether or just in your u.s. attorney's district? so he has changed his story but the whistleblowers haven't. >> the g.o.p. wants to cut money for the doj and trump prosecutor jack smith. that could be a major issue as congress tries to avoid a government shutdown in september. bret? >> bret: chad pergram live on capitol hill. chad, thanks. tonight we are hearing from a former big city law enforcement official who was given prison time for tax crimes similar to those hunter biden is facing. lucas tomlinson is following president biden in wilmington, delaware tonight with that part of the story. >> >> president biden is wrapping up his vacation, taking a short flight aboard marine one from his delaware beach house to his home in wilmington. he will spend the weekend in the same city where his son hunter's misdemeanor plea deal fell apart last week. critics argue there are two standards of justice comparing how the president's son has been treated to a former baltimore police commission his or her also failed to pay federal taxes. unlike hunter, darryl d'souza didn't face the extra gun charge. >> if even the money value, you know, some of the things that you described with the gun and, you know, and narcotics, they should be held at the same standard as me. >> the same justice department prosecutor handled both cases. hunter biden has been charged with a misdemeanor for not paying over $2 million in taxes. some tax attorneys say this much money could land you in jail for 3 to 5 years. hunter was offered a plea deal. yet, the explicit commissioner received 10 months in prison for owing much less. republicans are questioning president biden's involvement with his son. >> we know this was unethical. we know it was shady. we know he has lied repeatedly to the american people. >> hunter biden's legal team and doj prosecutors have to negotiate a new plea deal that will satisfy the judge here in wilmington after the last one fell apart. bret? >> bret: lucas tomlinson traveling with the president in wilmington, thanks. former president trump is facing three separate criminal trials in coming months those coincide with big events in his presidential campaign. this evening, correspondent david spunt looks at what comes next for the former president. good evening, david. >> bret, good evening. in a couple of hours, donald trump will deliver remarks at a dinner hosted by the alabama republican party in the capital of montgomery. is he back on the campaign trail and expects plenty of talk about yesterday's arraignment. now, this latest indictment, his third in four months. former attorney general bill barr, a one-time close al 4r50eu of his old boss, said just hours ago this recent case against trump is legitimate and trial should happen as soon as possible. >> i don't like, you know, all these overkill attacks that this was somehow reprehensible to bring it. what was reprehensible was the conduct after the election. and it's perfectly to be expected that the department of justice would approach it the way it would approach something like this. >> one of the chief allegations the government makes is that donald trump knew he lost the election, but still wanted to put a pause on the official electoral vote counting and send those votes back to the states. that's on page 34 of the 45-page indictment. here is how trump's attorney explained this situation. >> what president trump said is let's go with option d. let's just halt. let's pause the voting and allow state legislators to take one last look and make a determination as to whether or not the elections were handled fairly. that's constitutional law. that's not an issue of criminal activity. >> following yesterday's arraignment, trump's calendar really beginning to fill up, bret. no question with both political events and court dates. on the top of the screen you will see first political debates first hosted by fox news. summer caucuses and summer quengsz. bottom court appearances and court date. the trial in the classified documents case is set for may. special counsel jack smith wants the trial effort to overturn the 2020 presidential election to happen before the 2024 presidential election. we can't also rule out another possible indictment soon in atlanta, georgia. district attorney fanny willis you see her right there. moving toward an indictment to overturn election results with georgia officials. the former president's legal team abandoned a bid to oust a case after a judge earlier this week ruled against them. the next donald trump-related court hearing next week in for the piers, florida in a separate classified documents case. several house ago he pleaded not guilty to paper on three additional charges added last week, middle of last week. he is not expected to attend that court appearance. bret, he has a busy calendar campaigning and dealing with these cases. >> bret: david, thank you. >> you bet. >> lawmakers concerned over china's growing influence in the u.s. participated in a field hearing today in iowa. they are looking into china's expanding purchases of large amounts of american property, particularly farmland. correspondent bryan llenas is in iowa tonight. >> the bottom line gets thinner and thinner and tighter and tighter. >> sixth generation farmer says china's relentless efforts to steal billions of dollars worth of america's secretly patented engineered seeds is costing farmers and potentially threatening america's food supply. >> when china steals that i.p. from a seed company, that money has to be made up somewhere. and so, unfortunately the u.s. farmer is the one that's going to deal with it. >> over the last few years, chinese nationals have been convicted of stealing genetically engineered corn seeds in iowa. rice seeds in kansas. a company's software farm ago gori them in missouri. >> they don't innovate like we do. we have a frequent economy. so the only out for them is to steal our secrets. >> you are being robbed every day. >> congressional round table in dysart, iowa the select committee on china how china is pleepg for conflict with the u.s. over taiwan. china now owns 384,000 acres of land in the u.s. that's up 456% since 2011. particularly alarming are attempted agricultural land purchases near u.s. military bears land that lawmakers warned could be used for spying or for spreading bioweapons that could disseminate our crops. >> what keeps me up at night is that they are stealing our seeds and they are reverse engineering to know what makes them hardy and what makes them drought resistant and pet resistant. what says they couldn't turn that around to us. our food supply is a national security issue. >> here's the problem, one out of every three rows of soybeans out here is sold to china. u.s. farmers are asking congress to get tougher on china without alienating their number one customer. bret? >> bret: there are also concerns about potential chinese influence in america's energy policies at large. >> bret, tonight, fox news digital is exclusively reporting energy secretary jennifer granholm had multiple undisclosed closed door conversations with china's top energy official days before the white house decided to tap into the nation's strategic petroleum reserve in an effort to lower gas prices back in 2021. republicans argued that this was a threat to ou.s. national security while at the same time financially benefiting chinese companies that were allowed to buy and sell that oil the department of energy tells fox news those conversations were about climate change bret? >> nonhuman. >> there is money in a ghawjt is said to go to a program and is it doesn't and it goes to something else. >> yes. i have specific knowledge of that. >> bret: we covered that hearing and it's truly, truly amazing and we are going dissect it further tonight. time for tonight's "common ground" segment. tonight we deal with the ufo or uap issue which has gone from a fringe topic to warranting the significance of that congressional hearing and much more investigation. just a few days ago. joining us tonight wisconsin republican congressman glen grothman and california democratic congressman robert geathersgarcia. congressman grothman, boy, it raised a lot of eyebrows. what did you get out of it and where does it go from here. >> said they saw unidentified anonymous phenomena. they said other pilots one in the pacific and one in the atlantic. one seeing tic-tacs shape objects and others seeing spheres with a box in it. other pilots have seen it as well. i have since had a conversation with someone who is involved in the department of defense who insists our military is withholding information on this. so while it seemed kind of an off beat things for congress to fro can you say on it's high time we did. there has been a lot of speculation on this going to be for dozens of years. think i it demands more questioning. not to mention the star witness who he jews saw a second ago kept saying he could not reveal things because he was in a more confidential setting forces more confidential setting. congressman garcia i'm going to play another soundbite from the whistleblower the u.s. is concealing this multi decade program. take a listen. >> i was informed in the course of my official duties of a multi decade uap crash retrieval program to which i was denied access to those additional read-ons when i requested it. >> are you aware of any individuals who are participating in reverse engineering programs for non-extraterrestrial crafts? >> personally, yes. >> bret: okay. the defense department spokesperson says to date all to date ano, ma'amly resolution office has not discovered any information to substantiate claims that any programs regarding the possession or reverse engineering of extraterrestrial materials have existed in the past or exist currently. i guess what people want to know is this whistleblower for real? he was under oath, right, at your committee? is this getting us to finally realize that this is all happening for real? >> i think that chairman grothman said it correct. we have a hearing that was very bipartisan. we had three witnesses that all have distinguished service to the country. and we have to explain and understand what this phenomena actually is the truth is that uaps exist. our government has said that numerous times. we had it said at the hearing. by hots have seen them northwesterly commercial and military side. as it relates to this witness. the witness is sharing a lot of truths as he sees them. and i think as having whistleblower status it's up to us to get to the bottom of it. there is a loft information that came out. while the government can certain liver agree that there are some uaps we can't explain, there are many that we cannot. i think that it's not just the uap issue but there is information within the department of defense, our other whistleblowers we need to uncover what's going on. i think that the american public deserve transparency and disclosure here. and there are unanswered questions. >> bret: all right. i just want to ask you both. do you believe what that whistleblower was saying? congressman grothman, first to you. >> well, to be honest, he answered so many questions that i cannot respond it in a more closed setting. you really don't know what to believe. i think far more impressive were the other two witnesses who literally saw unidentified phenomenon near their plane and had other pilots in their formation see it as well. in two different locations. one the pacific, one the atlantic, seeing different sorts of aircraft. so i think those were really the two key witnesses. and i do believe that what they saw demands further explanation. >> bret: congressman garcia just at the white house, national nal security council spokesman john kirby said that the uaps are having an impact on u.s. military training and that they are seeing these phenomena more and more. there's just a frustration out there, i think, that this is so groundbreaking, so, you know, crazy to think about that why can't we find out now? there were not -- i'm not going to. there wasn't like, it wasn't specific, you know, county big guy help it was always enor fuss can we get help in d.c. jim jordan help from the united states government to deal with the pressure they were under from their prosecutor then tailed the freezing of assets at the london bank and other things that were going on in ukraine. mr. archer: correct. meantime "the washington post" says joe biden gets four pinocchios because biden said his son earned no money from china. his son says otherwise. i mean, these are just, you know, tidbits of what this investigation is going forward. >> it was a bad week for joe biden because you also have to put what we learned from devon archer in the context of what we already knew. which is, again, that joe biden was sent on this delicate mission to ukraine. his job was to keep them close as russia invaded crimea. he was warned by the state department not-that hunter biden was a big problem. that this entire look was undermining their anticorruption message and, yet, now we find out this week that he aided hunter in presenting a basically a cone of protection around this controversial burisma company. which, i mean, devon archer said actually allowed the company to maybe not go bankrupt. so he knew what he was doing. and that, i think, puts a different spin on this, regardless of whether or not he ever took a dime from his son's work. >> bret: meantime, you know, you have the lawsuits and the court trials on the republican side. you have these investigations, juan, on the democratic side. the rcp average for the g.o.p. primary, the nomination has former president trump at 53.1 and his nearest opponent at 17.6. >> this is the average of recent polls. i mean, it seems like it's going one way it. could obviously change but it seems like it's going one way. >> i think that's right. i don't think there is any other way to read it that even with these indictments and trouble what you see is former president trump gets a bump and kind of, you know, it's all about donald trump constantly now on the campaign trail. people have to react to the latest indictment and what trump says and doesn't say. the bigger issue here, i think, on the hunter biden side with the release of this devon archer transcript is where's the proof? so this moment even this week with the release of the transcript, when he was said, you know, when he was asked directly, did joe biden have any direct knowledge about burisma of any type he said no explicitly. what you see is that the republicans on the house side are engaged in what looks like to democrats like an attempt to distract and deflect from the big news of the week, which was the trump, you know, third trump indictment. >> bret: okay. i want to play this soundbite. this is from this ufo hearing. we had the common ground with the chair and the ranking member of that subeconomy who held that hearing. take a listen. >> right now the stigma on this topic is so bad commercial aviators do not feel comfortable reporting this as a safety issue come pound that with the department of defense is not releasing any information about this really little way they can create new procedures on reporting without that information sharing. >> bret: the information is out there, byron. we just have to find it. >> this is so amazing that we are hearing this stuff. if this is true, this is the biggest story in the world. we won't be talking about trump. this just absolutely incredible. so we have to actually have this stuff. it has to be released. we need some trainers here. >> bret: yeah. kimberley?
