in the white house or in the big house? >> greg: they want to send trump to the big house before you voters even get the chance to send him back to the white house. legal experts and republicans argue this indictment is an attack on the first amendment. >> political speech now has been criminalized. the first amendment is under assault. it's under attack by the biden administration. >> you see a lot of deceitful conduct but the problem, i think, jack smith has is that congress has not enacted statutes that directly criminalize the behavior that smith is talking about. >> when i take a red pen through material that's protected by the first amendment, it reduces much of this to a haiku. >> greg: republicans are blasting how trump's new legal troubles are once again perfect timing for the bidens. notice the difference on how the media covers joe's growing scandals. >> you can't equate these two things. i mean, you're talking about an encyclopedia of outrages and scandals against constitutional government vs. what's, you know, at best a comma or footnote in the annals of american political history because you're talking about the son of a president. >> they talked basically every day, sometimes joe biden would say hello to the people in the room if he popped in or on the phone or whatever. >> a lot of these relationships operate in the gray areas intentionally. especially when you have somebody who is either related to a famous person or powerful person or used to work for a powerful person. you want your clients to know that you can get them on the phone. >> greg: all right. so jesse, you listen to the journalists and they're relying on this hyperbole. i have a theory, they use that to cover up the betrayal of speech and thought. like they can't say it's about what trump said or what he thought so they have to compare him to a terrorist so that way, they can then just crap all over the first amendment. >> jesse: their job is predicated on the first amendment and they still don't want to defend the first amendment. more people know about the barbie movie than they know about january 6th. to democrats, january 6th is like july 4th. to everybody else, it's just another day on the calendar. and if you talk to survivors or families of 9/11 of pearl harbor, i don't think they're the same thing. some of these charges i love it, conspiracy to defraud the government. ok, what would you call russia collusion? what would you call hillary and the c.i.a. knew it was a lie? still pushed it anyway. not only that, concocted fake e-mails to make a judge spy on the trump campaign. they defrauded the court. also, the laptop cover-up with the f.b.i., that's a conspiracy to defraud. that denied people their voting rights or the c.i.a. ran on the laptop the month before the election coordinating with the biden campaign. another conspiracy. if you're going to charge garbage like this, everyone is going to be in prison. i love this part of the indictment. when jack smith says, well, fact checkers said that there is no fraud. i don't think fact checkers have a great track record so that's not even going to fly in court. think about the margin of this election. there is three states, margin is razor thin. 42,000. you're saying donald trump was out of his mind to think he might be able to claw back half? that's, what, 21? 21,000, that's all he needed to change out. and you're saying they're now going to put the 2020 election on trial. donald trump is chomping at the bit. he's going to call witnesses. he's got subpoena power. he's going to put detroit, philly, vegas, on the stand and make them defend the integrity of their voting process. the lawyer last night was on cnn cleaned their clocks. the guy said they're trying to speed this trial up. we need maybe nine months to a year. this isn't getting done before the election and any way, it's going to get appealed and it's going to go to scotus and scotus is going to knock it down. what the republicans need to do is time the impeachment because that's the main draw. and if you put up impeachment with the trump trials, i don't think the democrats want to stomach that. >> greg: jessica, on the point of timing i thought it was honest of you in the greenroom to say wow, having this stuff come out after the archer revelations shows you how this political beast operates. you know, they got greedy and arrogant and they went too far. how else can you explain why they would do it the day after? i couldn't believe you said that. >> jessica: you always betray yourself because you go one step too far. like maybe -- >> greg: like a democrat? >> jessica: not at all! i think that the timing of this feels that way to people who think that donald trump is innocent of all of these things. fact of the matter is there is such a litany of crimes that he has committed all over the country that it just adds up this way you'll have another indictment and then you're going to have another one. carry on republicans with your investigations of joe biden and hunter biden. and jack smith will continue his work in these grand juries which, by the way, are not -- he will work at the d.o.j. they're regular people like in florida and in d.c. and in new york. yes. >> greg: d.c. and new york. that's how you win an election. >> jessica: the idea that you can only get a fair trial if people have the same political beliefs is patently absurd. ok, donald trump can only go before white billionaire republicans. >> greg: you don't need lawyers to look at juries, then. >> jessica: no, having biases and having inate -- anyway, i know what you're trying to do. this isn't about the first amendment. and jack smith was very careful to make sure the way this indictment was laid out made it so that speech continued to be protected. donald trump had every right to continue to say this is fake. there's fraud. what he didn't have a right to do was to act on it. and that's where the crimes were actually committed. so what is new in this indictment vs. the january 6th committee work is mike pence is a big part of this. so he took copious notes through the entire process which includes a conversation that he had with donald trump where donald trump after asking him to overturn the election, to not do his job in certifying it, he says to mike pence, you know, you're too honest. when somebody says you're too honest, that means that you want them to do the dirty thing. that you want them to do the bad thing. >> greg: again, you can disagree with that but you don't arrest somebody over it! >> jessica: you can't disagree with the fact that he knew that he had lost the election because everyone in -- >> greg: you're going to try to say that donald trump knew he lost. there's no way. going to try to prove that in court, jessica. there's no way he can be proven that he knew he lost. >> jessica: on page -- >> greg: he still thinks he's president! >> jessica: the insanity defense is available. on page 15 of the indictment, for instance, they talk about what happened in georgia and co-conspirator number two who we know is rudy giuliani tells donald trump the defendant this is a fraudulent accusation at this point and then he still went ahead and pushed it. as an example. >> greg: when schiff goes in there and comes out and says -- >> jessica: all i heard from you is hillary clinton, russia collusion. you cannot move on with your life. >> greg: this is a 2 1/2-year-old story! >> jessica: it's not. it's new information. we didn't have anything from mike pence. fake electors scheme is committing crimes. and also, some of his strongest defenders like andy mccarthy wrote this piece that got taken up. >> greg: i have two other people at the table. >> jessica: i know. i'm so rude. i cut off everyone constantly. i don't know how everyone can deal with me! >> greg: apology accepted. dana, is it normal to announce you know what is in somebody's heads. that's what we're arguing about it right now. >> dana: that's why this is so interesting. you can think that it's horrendous and terrible behavior and is there a crime committed? you can read this indictment. like i did last night, all the things they are listing, is that illegal? he was trying to persuade congress to change their position. like well, everyone has a right to try to persuade congress. you can disagree with how he did it. you can think it's abhorrent. is it illegal? and the other thing is i think about this -- the other piece which is i can't remember which charge it is. i guess fraud, the fraud piece, so george w. bush in 2000 and 2004 dealt with democrats who said he didn't win the election. did anybody try to arrest them? no. nobody did. >> jessica: accepted the court rulings like normal human beings. >> dana: right. ok. other thing is, so ruth marcus is a columnist for "the washington post" and writes from the left. she's a lawyer, legal eagle. and i thought her comment today was very interesting because basically, she didn't think this case was a slam dunk. she said i can see where he's coming from. and she does think that something needed to be done but was this the best way? she just thinks that letting it go without any sort of consequences or punishment was wrong but didn't seem to me there was consensus this was some slam dunk case. now, contrast that with the case about the documents. like whoa, this is actually pretty clear cut. a lot of republican lawyers who are like that didn't look good for president trump. this one, i feel like there's consensus saying how can you actually criminalize these things that are thoughts? like he passionately sincerely believes that he won the election. >> greg: yeah. >> dana: how are you going to prove that he knew that was wrong? maybe they'll be able to convince people when he tells mike pence you're too honest, maybe that persuades a jury. i think it's going to be a tough road to hoe they say. >> greg: watch your mouth, young lady! this is a family hour. last word to you, katie, if you're inside the story, you don't get the story like jessica is, if you step outside of your bubble and get out of the story, you see kind of a political machine that this is what they do. >> yes. and people watch elections when they come up and they see that democrats before have suggested, not just on capitol hill but in the states and very aggressively in the media that george w. bush was not legitimately elected in 2000 and 2004. there are entire college courses about how he basically stole the election and alternate electors should have chosen which they're trying to criminalize as a result. in 2016, same thing. you have a number of people saying because russia hacked the election, alternative electors should be chosen on behalf of hillary clinton and should not be accepted when it was supposed to be certified on january 6 of 2017. and jamie raskin, for example, we heard from at the beginning of the block, democrat, stood on the house floor and said the election should not be certified and here he is saying all of these things about criminalizing this. democrats better be careful what they wish for. they always go way too far. they push this for a short political gain. think the ends justify the means and then all of a sudden, the rules are new. and the republicans want to play by the rules that they set, they have a problem with it. we have an election coming up. called democracy, democrats talk about it a lot. they could battle this out at the ballot box between probably president donald trump and joe biden and let it end there. instead, they're using the justice system to do it for them. there was a poll that came out in june of this year, and it was interesting. from harvard harris said 53% of americans would be ok with the pardon for the documents case because they want a truce including 30% of democrats. i think there are a lot of people who are very concerned about where this leads. and whether it actually will tear down our institutions as a result of criminalizing basic things like free speech and debate about elections. >> jesse: i don't want a truce, katie. i want revenge! >> that's what i think they're afraid of. >> jessica: like using the insurrection act. >> jesse: revenge. that includes you! >> greg: joe biden better watch out. it looks like kamala is trying to take his job! >> jesse: while joe biden lounges at the beach, kamala harris pretends to be president. i think that's the mongolian leader. tomorrow she heads to wisconsin and friday she'll try to spin the monthly jobs report. seems like she's getting comfortable. getting her big wish after her team has been complaining of her "being left out of the spotlight." this includes a softball interview with abc news but even that was too much for kamala to handle. watch. >> there are reports that say you have the lowest approval rating of any vice president. i'm curious how much of a role, if any, you feel race and gender play in that? >> there are polls that also say i have great approval ratings. i think the point that has to be made is that there are attempts to create distractions away from the accomplishments of our administration. >> jesse: we'd like to see those poll numbers. any day. because everyone we've seen shows voters that she's doing a historically bad job. there's good news for kamala, if you can call it that. voters are more enthusiastic for her to be the 2024 nominee than her boss, joe biden. dana, take it away. >> dana: this is kamala reboot 224, if you're keeping count. and i can understand why they're trying to give her a little bit more publicity. i think she has a brand new team again, right, if that makes sense. look, and the mongolians, those are good freedom fighters and need them on our side. thank you for coming to visit. >> greg: i love that barbecue. >> dana: indeed. look, one of the things she said is that she has this quote talking about bussing migrants is cinema and grand gestures and political games. one, a lot of politicians do that. you host events so you can do that. on bussing migrants, she was supposed to be in charge of immigration! >> jesse: she's greyhound. >> dana: very good one. i think this. that she's going to be elevated by both sides. ok? because the republicans want people to know that if you elect joe biden and he's 80 and not in good health, the likelihood of her becoming president during the next four years is higher than you would want if you're a republican. but the democrats also need to elevate her because she's dragging down joe biden's numbers. and they need her and especially because they're concerned about it not turning out. they need her to have a more visible presence on the campaign trail. you'll see more of her which will be great for "the five." >> jesse: that will be great. greg, when you see that poll where people are excited for a kamala nomination than a biden nomination, is that kind of like people excited if they see a car wreck? >> greg: maybe. >> jesse: the spectacle of it. >> greg: how dare you insult a car wreck? they have feelings, too. i feel like the biden family is trolling kamala. did you see that rumor in "the post"? it's great. joe biden's sister otherwise known as big al. she's pushing megan markle, you know that's upsetting kamala harris when the president's sister is like you know who would be a good president? meghan markle. that's just jamming it in! my feeling the only way that kamala sticks around is as gavin newsom's running mate and then you'll get two people from california representing the democrats. i mean, that's the worst state in the union. that's like choosing two members of "the view" to represent america in the miss universe pageant. it's not a good choice. i'm going to blow your minds. this election right now isn't against the candidates you think. the democrats don't have any. it's not going to be joe biden. i'm going to say joe biden is not going to be there. so trump far and away is the candidate for the republican party. what do you have over there? what do you have over there? you have a machine, right, it's a political machine. it's trump vs. the machine and he's raging against this machine, right, it's a political beast. it's corrupt. and it punishes those who won't obey. that's the real race. him vs. this monolith that is trying to destroy the average american. how do you like that for a race? >> jesse: man vs. machine. do you like it? >> not if the machine is smarter. because that's terrifying. >> jesse: then throw water on it! >> that's true. like wicked witch of the west. pour water on it and it fries. they put her out there so many times and she tries so hard and it's like she just can't do it. and the question that she constantly gets from reporters is isn't this because america is racist and sexist? she actually do herself a big favor by saying no. actually, i'm in this position because i'm a qualified woman who has something to offer americans whether it's my experience in california or my desire to solve these problems that she's not solving which she could actually turn that question over and help herself with that. but this is the reason why niki haley says that they're running against kamala harris. they're not running against joe biden and i would watch gavin newsom. i wouldn't put it past him that he wouldn't start going after kamala harris. she thinks she's entitled to this position even though she couldn't get a single vote in the democratic primary when she ran for president. gavin newsom wants it and he's not going to let her take it especially since her approval ratings are so low and not good at her job. >> jesse: are we dreaming? there's got to be a solution to this that is compassionate. is it that hard to be compassionate without being [beep]. >> dana: one glaring example is here in new york city where migrants have been sleeping on the street because shelters have run out of room. after claiming to be a sanctuary city, the mayor is putting up a no vacancy sign. >> we have run out of room. we have to figure out how we're going to localize the inevitable that there's no more room indoors. eventually this was going to come to a neighborhood near you. >> dana: katie, i was musing earlier today i think eric adams if he were bold enough to be the first mayor to rescind sanctuary city status that the other cities would do the same under that cover. and then force the administration to finally address the issue. >> he should rescind the sanctuary city status. he should acknowledge that the vast majority of these people, you can see it in the videos are military aged men. so i don't really have a lot of compassion for them. what are they doing here? what are their goals? where are they going to work? how are they going to contribute to society? mayor adams should call ice and demand they come round them up and send them back to their countries because they're here illegal. they're filing false asylum claims and ruining the streets. many of them are a danger because they're committing crimes in these communities. and women and children tend to be the victims of those crimes. and so the administration throws their hands up and says well, the courts are shutting us down and we can't do much about it and by the way, the border is actually closed and this continues to be a crisis. not to mention the homeless americans on the streets who have been displaced by thousands of illegal immigrant who's are now taking up their shelters and resources. so this is something we see over and over again. and there are solutions to them and compassion is not one that helps. >> dana: this is a humanitarian crisis. our reporter has been there at that site for a couple of days. and it's not easy to watch all of this and she talked about some people who are so afraid to lose their place in line because they're looking for shelter that they're relieving themselves on the street because they don't want to move. and mayor adams, i think he's at his wit's end but yet to really push the administration to do something. >> yeah, it's completely heartbreaking. it's also entirely predictable. and i was looking at some of the costs of what this is going to -- the kind of toll it will take on the city. it's astronomical. frankly, the federal government needs to step up. if this is the result of border policies that you think are important to have in place, defend it with the money that goes to these people when they're getting to these cities across the country. i don't think that we're sending sanctuary city status is a good response to this and this is a recent problem. sanctuary cities have been around for a long time and they serve a very good purpose. all of us know people in this country who are undocumented are incredible people who came here to work really hard. i would add as well republicans have been supportive of sanctuary cities that rudy giuliani who isn't having a great day but talked a lot about how important it is that people who are living in the shadows can talk to police about what's going on in their communities. and report crimes. >> dana: sure. circumstances on the ground have changed. and has bill maher changed? or listened to us? or will they listen to him? >> greg: i don't know. i'm deeply offended by all that bleeping, dana. we said this last year. now it's a story because it's breaking through. it went from one bubble to another bubble and that's because the bussing worked. only reason you're hearing that on his podcast is because when they move them into the sanctuary cities, stroke of genius, right? they had to deal with it. and now all of a sudden, liberals are sounding like conservatives. now, they're saying, you know, people -- letting people live on the streets, that's not compassion. we've been saying that's not compassion and you accuse us of being anti-compassionate when we say you're not helping these people. when people like me propose, you know, there would be a good campground or barracks, again, you're identified as a monster. this is an issue that's been politicized by the left so any attempt to solve it becomes right wing. so if you want to get them off the street, that is right wing. so that's why the left has nothing, they have nothing because the obvious solutions. they always dismiss. we need less carrots, more sticks. that's a metaphor. but that goes against their radical assumptions. i mean, it was the left that got the cities to agree that camping on the street was a right. >> dana: was a right. >> greg: now you have a distopian colony in every such town. w you're the reason people are dying on the street and you're the reason why women are being attacked on the street. you're the reason for every bad thing happening on the street because you refuse to listen to practical solutions. >> dana: right. that makes it so much harder to get actual legislation that would allow for some legal immigration and a lot of these businesses desperately need people who are legally here to work. >> jesse: you're just pouring it and then it just goes to the top and then it keeps overflowing and overflowing and overflowing. >> dana: is that how it goes? >> jesse: that's what's happening on this country right now. there's no more room in the shot glass! we're filled up. there's a slumber party three blocks down the street. i don't know if you've seen it. you have to stomp over sleeping bags to get to the coffee shop. i can be compassionate the way democrats are compassionate with jesse jr. he didn't need a bedtime. he could run around without a diaper, eat whatever the heck he wanted. do you think that's being a good father? no, you need a little discipline. you need a little structure and need rules in order to raise the proper community. there's too many workers in this country. you can be compassionate. and competent at the same time. and i just want to know something, greg, when you were on maher's show, did you take your shoes and socks like that and sit like that? there's going to have to be persuasion going on. pretty interesting. some of the best ways to annoy your parents is to be like jesse and his parents and being a conservative and drive his mom crazy and it goes the other way and back and forth it has been. there's a couple of things that are different this time, though. one is that for a long time, there has been concern about boys being left behind. and there was a much needed overcorrection, i think, for girls and to help them like you can do it and equality and now girls have for the most part, i believe, have caught up and they're doing great in colleges, medical school, law school. i think that we had the statistic this year that in marriage or in a lifelong partnership, women are making more money than men. and so there's a lot of things that have happened. happened to boys in the meantime. so they are starting to hear they're the problem. toxic masculinity is a problem and they've been preached this. what happens is they're on their phones and the algorithms are sending them content that will reinforce these feelings and make them feel like, you know what? why am i the bad guy? i didn't do anything. i didn't do any of this and it goes on and on like this. so i don't know how it ends but i absolutely believe that this is true. >> are you grateful you are not in the dating game and that you're married to someone with your same political ideology? >> jessica: anyway, i think that people do need to grow up about it and i know it's more of a liberal problem of dating people with opposing political views. it shouldn't be the most important as petting -- aspect of your life. if you're an 18 to 30-year-old boy, you're getting served joe rogan, barstool sports and stuff like that. it will inform how you think. >> masculine things, greg. you have anymore jokes about rhinoceroses?
