the very same people that consider the bill of rights a racist relic questions miss that of hand. the same people quickly become emotional as they talk about roe v. wade. for many democrats, it's sacred. they will tell you and they mean it that this country cannot continue without roe. without roe, darkness will descend and american will revert to slavery an cannibalism and other grocery. between the hell of the handmade tails stand roe v. wade. they're telling you that right now. if you consider what roe v. wade is, no matter what you think of abortion, whether you're for legal abortion, the decision as a decision, roe v. wade is a widely acknowledged joke. moral questions aside, roe is the most embarrassing court decision handed down in the last century. every part of its from its justification to meaningless parameters mocks the idea of sober juris prudence. the point of the supreme court is to interpret the constitution. abortion is not mentioned or alieu -- alluded to in the contusion. try reading it. it will make you blush. the roe decision is a period piece from the early 70s like side burns nor the amc gremlin. so the fact that the roe decision was in fact shoddy and shameful is hardly a part season opinion. a lot of ardent pro choices have acknowledged it over the years because it's true. that would include joe biden. joe biden has always supported legal abortion. but nine years after the roe decision was handed down, he was willing to admit it was indefensible as a legal decision. pregnant women, biden explained in 1983 as a member of the nate judiciary committee should not have the sole right to say what should happen to their unborn children because nobody creates children alone. it takes two people. that is obvious. in fact, biden concluded that roe had gone "too far." of course, it had gone too far. that was obvious then and obvious now. then as now, many americans believe that abortion is murder. many other americans consider abortion a prerequisite to happiness. those are unreconcilable positions. in a democracy, we have a solution to quandaries like this and it's called voting. if we don't like something, we elect representatives to act on our behalf. if they do what we want, we re-elect them.if they don't, they're voted out. that's how the system works. for hundreds of years we've used that to solve complex and thorny moral issues. not just abortion. many others and worked well. that's why this has been a stable country because we get to rule ourselves. roe v. wade took that right away. in a single 1973 decision, the high court bans democracy from the debate over abortion. justices prohibited the states from enacting abortion restrictions that their own citizens strongly prefer. that meant going forward, alabama would be required to have the same abortion laws as massachusetts. some people love this. of course people in massachusetts loveded it. people in became became hated it. there was nothing that anybody could do about it because supreme court had cut voters out of the equation. as a result of that, the issue of abortion was never resolved. things are not resolved by fiat. only consent. it's the core of democracy and it's true. as a result of this short circuiting of democracy, demands from the left forced it. as a result of that, for nearly 50 years, this issue has festered. it's given americans another reason to dislike each other. it's divided the country. now finally after 49 years, voters might have the say over what to do about abortion as is their right. according to a piece last night in the blog politco, the majority of justices on the supreme court are ready to overturn row. justice alito said clearly in a draft opinion you can read yourself because it's circulates on the internet. we should be able to read it. it's not for the public. a final official decision is supposed to be months away. and yet an unnamed liberal objective short circuited this ancient process which has worked well for hundreds of years. this person leaked the opinion. not by accident. the point of leaking the opinion was to intimidate conservative justices in to reversing course. mob justice. if you're shocked by that, you shouldn't be. remember that it's not so different from what we saw this january when another unnamed liberal operative leaked the news that justice brier was planning on retirement and that forced him to retire which liberals wanted him to do because he was a white man. so that was in other words another op. one of many that we're seeing in our country. as if to prove that within moments of this story breaking last night, a mob formed a flash mob at the supreme court. watch. well, the upside is they're not telling you it's your body, your choice. even these people couldn't pull that off with a straight face after forcing manies to inject an experimental drug against their will or be fired. so they can't claim bodty autonomy anymore. so now they move to name calling. you're a fascist if you agree with them. they've been preparing for this moment for quite some time. the supreme court is debating the constitutionality of a mississippi law that bans abortion after 15 weeks. during oral arguments in this case in december, justice alito noted that "the fetus has an interest in having a life." that's true. but when he said that, plans for retaliation began. no one wanted sam alito to vote the wrong way. now those plans are underway. it's no exaggeration to say once the step gets going, you don't know where it winds up. people can get hurt because of this leak. you hate to think it could happen and you hate to think it could happen. people do. here they are. ada chavez works for the nation. she's some kind of reporter. she tweeted it's good that conservative justices and their families will have their lives threatened. she's in favor of that. over at vox.com, ian millheiser shouted f it, let's burn this place down. government by tantrum. and brian fallon, the executive director of the activist ground "demand justice" or else, said this quote, is a brave clerk taking the step of leaking a document warning the country in a last ditch hail mary to see the public response to make the court reconsider? like do what we want or we will hurt you? these are threats of violence. the ceo of planned parenthood is calling on activists to storm state capitol buildings. watch this. >> we know this decision will enrage people. we know, we've seen what has happened when people find out that when they found out what was happening in texas, they started filling state houses in florida, they started filling stale houses in other places because they know the fight right now is on the ground and in these states. so we're going to continue to capture that rage. >> tucker: we're going to capture that rage. people get angry and you wouldn't like us when we're angry. don't we have a system in democratic norms we're supposed to observe? if you don't like something, isn't there a process for resolving that? don't you elect people to see your will put into law? not anymore. you just storm capitols. but wait a second. isn't storming capitols an insurrection? oh, no. not when abortion is the topic. already they're vowing to use this draft decision to eliminate the filibuster and pack the supreme court. here's the best part. all this is happening in the name of democracy. so you won't have a chance to vote on something that matters to you, whether you're for it or against it. so that you won't have a chance to vote on something like that, they're going to thwart democracy. here's a former u.s. attorney that said that the justices are insurrectionists. >> it's not too great of a stretch to say there's an effort to overturn an election and overturn roe. it's this as i've been thinking about it. there's a segment of the idealogical spectrum now that think that has certain kinds of powers and wants to engage in radical efforts to overturn things that they don't like. there's no more compromise. you don't like the results of an election, you storm the capitol and talk about hanging the vice president of the united states and you get the presidency back. >> tucker: yeah. it's like overturning an election. you listen to something like that and they're like nine points you could make in response. you have to ask, either the person saying that is so stupid that he doesn't understand what he's saying or he's willing to say absolutely anything to stop the other side. that's of course what you're watching. these people are not stupid. they're dishonest. the thread, the consistent note in these clips is that none of the people yammerring against this draft opinion have actually read it. you know that because they don't attempt to respond to the legal arguments because they're immaterial. just as in 1973. they didn't consider what the constitution had to say about it. they didn't care. that's why it's an embarrassing decision. so instead of assessing what alito wrote, they accuse him of terrorism. overturning precedents and active insurrection. really? any supreme court decision must remain in place forever or else you're committing an act of insurrection. legal scholars out there, are there any supreme court decisions throughout the ages that were overturned and happy we're overturned? probably quite a few. messy versus ferguson anyone? the legal experts are screaming about facish. >> next they'll go about brown very board of education. they already eroded our voting rights a little bit. i say fascism down the line here. >> tucker: it almost detracts from us to play you something like that but that show has real ratings. people listen to that. really couldn't navigate a checkout scanner telling you what the supreme court draft opinion might mean despite the fact that she's capable of reading it or anything else longer than a tweet. she clearly didn't read what alito wrote. alito did anticipate this argument, that all kinds of terrible things would happen. here's what he wrote for the people that won't read it. what is distinctive about abortion is what roe turned to life. it's a unique issue. "to ensure that our decision is not misunderstood or mischaracterized, we emphasize that our decision concerns the constitutional right to abortioned and no other right." oh, so they're not trying to bring back slavery or legalize cannibalism or make it i'lless for you to vote. they're trying to allow you to vote on abortion. that's how dishonest these people are. if roe v. wade goes away, you get to vote on abortion. if you're a pro lifer, that's good news. if you're a pro choice activist, that's good news. why wouldn't you want your democracy to function. you don't want to vote on it? you want some elderly people to tell you what to do? no, this is a democracy. you vote. nobody on television is saying that they're demagoguing in their hysteria. they're nullifying the gender rules, which is concocted. they don't realize it but it's fun to see it. at cnn that spent last year that men can get pregnant. yes, they can. so they rediscovered the meaning of the word "woman." >> forgive me. i seem to be losing my voice. seems to be in line how women are losing their rights in this country. this opinion, if true, can be narrowed down and defined simply. women are not viewed as equal to men. >> tucker: women are losing their rights. really. what percentage of college students are women. what percentage of first hires of big company are women? yeah, they're losing their rights. how many women are in elections? liars, stupid people. let's get back to the constitution, the core question here. abortion does not appear there nor has there ever been a right to abortion in this country. if that bothers you, you can vote for it in the congress. you could pass a constitutional amendment. if you support a democracy, that's what you call to do. nobody has. we're moving the other direction. joe biden announced that democracy has been suspended. >> why i voted against a number of the members in the court. they refuse to acknowledge there's a ninth amendment. refused a right to privacy. so many fundamental rights that are affected by that. i'm not prepared to leave that to the wims and the -- of the public at the moment. >> tucker: he can't remember the word but we're going to piece together the sentence. the wims of the public no longer matter. sorry, pal, they do matter. it's a democracy. we get to vote on this stuff because that's our system. you're passing through. you'll be gone soon. the rest of us get to decide how we're governed because we're a self-governing country. we're a free people. sorry. there's a lot to unpanning here, so we thought we would start with an actual lawyer, someone that knows a lot about the supreme court, laura ingraham, the host of "the ingraham angle" on the fox news channel. she joins us tonight. laura, i have to ask you something. the fact that this was leaked, you know how the court works. how big a deal is that? >> the first thing that happened when i clerked on the courts, the first day that all of the clerks from that term were all together, like 40 or so of us, chief justice rehnquist said to us, if you are thinking at any point in time of divulging what happens within the walls of this court, especially anything about internal deliberations, your legal career is over. it's a great privilege to work at that court. considered by many the highest honor you could have as a young lawyer just leaving law school in my case. that's how you betray the trust of the justices, liberals, conservatives, doesn't matter and the institution of the court. it's never happened before. it will change the way the court operates. liberal justices, conservative justices, all should come together and together release a statement saying we condemn this, we will find out who did this and this will never happen again. explain to the american people why this matters. i know they announced an investigation today from the marshall's office. i look forward to seeing where that leads. but someone knows who did this besides the leaker in that court. >> tucker: they just did this -- look, i don't agree with stephen brier but i think he's smart and interesting. you know, he's an american that got the job legitimately. he shouldn't be forced out because people don't like his skin color. that happened the same way this did. nobody did anything about it or noticed it. >> because the liberals that claim to be the defenders of democracy as you noted in the open -- today they're the anti-democrats. the language is we're pro choice. no, they're the wrecking ball to american democracy today. imagine if the case was reversed and we had heard through a leak that the court was coming down the other way. imagine if mobs of people descended at the court screaming what could be described action threatening language towards some of the justices or derogatory language. you'd have nancy pelosi and the whole crowd saying we need to wall off the city again. we need to put the fences back up. this is -- those are the insurrectionists. that's what they would be saying today and tonight. >> tucker: so abortion is one of the saddest things i imagine. i mean that. some people think it's a road to happiness. why should we have a vote on it? if you love abortion, why wouldn't you welcome a state by state vote to look at the parameters? >> tucker, we've been friends a long time. you actually think these people trust americans to vote? really vote? on these types of issues? if they were so confident this was a popular position, they'd be like bring it on. all 50 states, you bet. everybody have your say. that's democracy. that's how it works. they want to take a whole slate of issues off of the table from the american people. it's not going -- this is not settled here. they'll keep fighting and keep ramping up the temperatures. this is a great day for the pro life movement. those that toiled and prayed and did it the right way, peacefully and respectfully. that is the process and people should celebrate that tonight. >> tucker: that's right. we should not be intimidated by the mob. we've been through this before. got everybody back on their heels. shouldn't put up with this stuff. thanks, laura. thanks for doing this. >> you're welcome. >> tucker: so as laura just said, there's never been anything like this, a leaked draft of a supreme court opinion. that's unprecedented in the modern era. senator josh hawley joins us in just a moment. joe biden's publicist just said people of color will somehow suffer if roe v. wade is reversed. what does that mean exactly? candice owens thought a lot about it and she joins us next. >> tucker: so last night a draft of the supreme court opinion written by samuel alito and representing the views of a number of conservatives leaked suggesting the that the court may vote to overturn roe v. wade. you may be for that, you may be against it. there's nothing racial about that. the word "race" is not even in the decision. there's nothing racial about it. of course, the biden administration, which goes immediately to race hatred, the second they have any problem whatsoever, went to race hatred. biden's publicist, jen psaki, said people of color will suffer the most if roe v. wade is overturned. we're not sure what that means. candy owens has. we're grateful to have her assess and interpret. thanks for coming on, candice. so when roe v. wade is overturned, will colored people suffer most? >> we have to get a definition from jen psaki to suffer. more minority people will be born given the fact that 79% of planned parenthood clinics are in minority nakeds and the founder, margaret sanger notorious racist that didn't want black people to populate. she was successful. look at the statistics. black women represent 7% of the population and account for 40% of all of the abortions. if it wasn't for planned parenthood and the abortion industry, the black population would be double today. over 19 million black babies have been aborted since the 1973 decision. if i said to you that 19 million individuals against their will were killed, in a barbaric manner, poisoned and had each of their limbs ripped out of them limb for limb, that's what happened. nobody talks about the details of the abortion process. you said it's genocide. they don't want to admit that. so yes, black people will be affected but it's not amount any amount of suffering. you'll see more black babies being born. >> tucker: so i don't understand how this works. if you love somebody, you want them to reproduce. that's why you love your kids and grandkids. you want more of them. how do you turn to a group of people and say i love you, here's more abortion clinics. >> they want you to forget about history. they want you to forget about margaret sanger and the origins of abortion. they have done that via the education system. that's why irrespective of what happened with roe v. wade, nothing will get fixed until we fix the broken education system. it's predatory. when the federal department of education was established, they rewrote history. planned parent hood got into the classrooms. it's not normal for any woman to get on a platform and demand the right to kill children. it goes against the natural order of things. we're designed as women to want to protect children. i say this for someone that is 7 1/2 months pregnant right now. listening to them speak about my child that i should have the right to walk into an abortion clinic, this daughter that i feel kicking now, take her out of her right now. it's not respecting the live growing inside me. so disturbing especially as someone carrying a child right now. >> tucker: man, they're going to hate you for saying that because it's true. the true things that trigger them. i appreciate that. candice owens, thank you. >> thanks for having me. >> tucker: so what does it mean to leak a draft supreme court decision? of course, it's an attack on the judiciary and an attack on the rule of law. it's leveraging the mob to short circuit our democratic institutions. it's an attempt to intimidate the supreme court justices in to reversing course. are we for that? congress woman pramila paypal says women should have to make choices about our bodies and futures. he's an expert on the constitution. apparently. she called people to take to the streets. senator josh hawley understands what's going on here. he clerked for john roberts and we're happy to have him join us. you have a sitting member of congress threatening court justices with a mob if they don't do what she wants. that seems very dangerous to me. >> what it is, abortion is religion for the far left. they're willing to do anything to defend that religion and force it on everybody else. they're for the institution if i'd did it what they say it should do. what roe says, the people are too stupid to make these decisions themselves. the people can't be trusted to vote and deliberate and make tough moral choices. no, nine justices wearing remembers should be making the decisions. that's not what the constitution says and that's why we need to get back to trusting the people and enforcing the constitution. >> tucker: exactly. i have strong feelings on this. i would happy and i hope that we can put this up for a vote in the united states congress, in the house and the senate and we can determine what the people want to do about abortion. why is that a scary option? >> you know, it's not scary. it's democracy. this is about whether or not democracy is going to have its day. supposedly joe biden believes in democracy yet today you heard him. he was saying that this is too important to be trust toed the wimss of the people. the voters? the people that elected you? the sovereigns of this nation? that's what we're talking about here. so what the court should do and what this opinion does do is that it puts democracy back in the driver's seat. and i hope the court will stick with it. they can't turn back now, tucker, in the face of this pressure. >> tucker: everyone i talked to today is afraid there's going to be violence from the left. is there a certain point that democrats say you're not allowed to intimidate the public to doing your will. we have a system. democratic norms. remember the phrase? that's my hometown, tucker. so far we have a big goose egg here. what is happening in franklin county. dolan is doing okay there. 3,300 raw votes to vance's 2,200. a lead there. we'll see how that runs as more votes come in. franklin county, something that we watch all the time, this is delaware county, by the way. why do i mention that? delaware county is where donald trump went to ohio to give the official endorsements. j.d. vance on stage there. not 1,000 votes for dolan either. something we'll watch through the night. this is cleveland, ohio. cuyahoga county. right now comfortable. 40%. this is a big city. there's a lot of votes to be counted still. dolan has about 3,000 raw votes there. come-out big-picture. one thing i would watch, tucker, in these rural counties a lot of them in the southwest, the southwest, j.d. vance is cleaning up. numbers like that hold it would be good news for vance tonight. your point at the beginning is what does the future for the republican? what is donald trump's role in this party? he endorsed vance. we'll see if that pays off. it's been called for tim ryan on the democratic side. so the congressman from northeastern ohio will be the democratic nominee whoever he faces on the republican side is still to be filled in tonight as we move forward through the hours. tucker, back to you. >> tucker: you never know where people are until an election. so interesting. thanks, bill. so the biden administration has decided to use a law enforcement agency to decide what you can say and think. they're going to use it to do what they've been doing for quite some time, which is to punish opponents of their rule. brandan strock found out the hard way. he's part of the walk-away movement. he went to washington, never committed any act of violence. he videotaped it. they arrested him anyway and threw him in jail. he just got out of home detention when he spoke to us today. listen to him describe the moment an fbi swat team came to his home. watch. >> imagine my surprise on monday, january 25 at the crack of down when an fbi swat came into my apartment, got me out of bed and presented me with a search warrant to take my property and put me in handcuffs and told me that they were taking me to jail and i was facing multiple felony charges for what i had done on january 6. >> tucker: no way. >> 100%. they took me to jail. they took my things, my coat, my money, my things like that. then they processed me and took a mug shot, put me -- printed the mug shot and put it on my wrist. had my mug shot on it and a number. at that point i was a number. the jail inmate system. from there they took me in to a concrete stall like a shower stall. i had to take my clothes off. i was standing there completely naked while a stranger came, took my clothes away. came back and gave me a pair of brown underwear, a brown shirt and an orange jump suit to put on. from there, they took me to medical. a nurse guard was standing there as i walked in. he says to me, i need your arm. i said why? he comes at me with a syringe. he said all new inmates in the jail system have to take a tb test. you need to give me your arm. the amount of trauma that is like boiling up in me because i'm thinking to myself, an hour ago was sleeping peacefully in my bed and now i'm here in a jail system wearing a jump suit and an inmate number and i have no say whether or not this stranger is going to inject whatever substance into my body. i have no idea. so he takes my arm, slides the needle in and injects something and forms a bubble and tells me if it turns blue or purple, let somebody know. from there, they took me in to a room called intake evaluation. there was a stoic military guy sitting there asking me questions like are you suicidal, have you ever been in a gang, do you have aids, have you ever had sex with a man. he said if a fight breaks out in the jail, are you able to defend yourself? i said no. i don't understand why i'm here. i was charged with a misdemeanor for disorderly conduct. now, i have no criminal record. this is a class b misdemeanor charge, which means it's a mid level, a petty offense, disorderly conduct, misdemeanor. i was sentenced to three months of house arrest, three years of probation, 60 hours of community service. mental health -- i had to take mental health services. what am i forgetting here? there were several other things. the government actually requested as a condition of my probation, three-year probation, that they have the right to survey my phone, my e-mail, my bank accounts, my social media accounts and my computers. they asked for the permission to survey all of those things for the three years that i was on probation to ensure that they could deter me from committing another crime. >> another misdemeanor. >> well, this is the thing. these january 6th cases, misdemeanors are being treated like felonies. the punishment that i just described -- >> tucker: you're not getting away with murder at scale. >> more than 90% of the blm anarchists had their charges dropped entirely. >> tucker: that guy's story is unbelievable. nobody is putting him on tv for some reason. he has a six-page single spaced handwritten letter and it was so shocking we checked the facts and they were true. you won't believe what happened to an american citizen in his on country. that is worth it. it's out right now fox nation. if the supreme court does overturn roe v. wade, abortion won't be banned but states make their own laws on abortion as in a democracy. what happens then? >> yeah, a massive meltdown happening right now from the pro abortion side because they can't force abortion for all nine months for children for any reason in all 50 states. that's what this is about. a tantrum being thrown but the pro abortion left. it doesn't reflect most of america. we have 22 states that have almost complete abortion bans in this country that want this to go into effect, that want to protect children in their state. children no matter the fact that they're unborn. so it's amazing to watch this moment unfold. and in the pro life movement, we're thrilled. this is a step forward and just getting started. >> tucker: this is one of those subjects that is often talked about but never in any detail. i never hear anybody address what it is, what is really happening. and they can do that because they don't have to discuss it because it's not up for a vote, right? one upside of this is we can have a real conversation about abortion. who is getting abortions? what does it mean? what does the science tell us? is that the upside of this? >> you're right, tucker. i spent the last 15 years of my life, my entire adult and teenage life working to educate people about abortion. i've seen people flip because of learning about human development in the wound and what abortion does, how it suctions a developing child into pieces, how it dismembers a tiny child, a lethal injection that pierces their heart. when people learn thinks truths about what abortion is, they change. when people learn, they change. we're going to see a wakening underway but it's only going to grow when people will be forced to grapple with the reality of what the abortion is. we're going to see, it's an empty husk. they don't have real life in them. they don't have real passion. they're just writhing out and screaming out, crying for the so-called right to abortion. it doesn't exist. the right to life does. so i'm very enthusiastic to see not just the red states enact pro life laws but change happening in blue states when people are educated about abortion. >> tucker: yeah. if they can look that in the face and say they support it, okay, they can vote for it. but if there's no vote on this stuff, how can you call this a democracy? the very same people that consider the bill of rights a racist relic questions miss that of hand. the same people quickly become emotional as they talk about roe v. wade. for many democrats, it's sacred. they will tell you and they mean it that this country cannot continue without roe. without roe, darkness will descend and american will revert to slavery an cannibalism and other grocery. between the hell of the handmade tails stand roe v. wade. they're telling you that right now. if you consider what roe v. wade is, no matter what you think of abortion, whether you're for legal abortion, the decision as a decision, roe v. wade is a widely acknowledged joke. moral questions aside, roe is the most embarrassing court decision handed down in the last century. every part of its from its justification to meaningless parameters mocks the idea of sober juris prudence. the point of the supreme court is to interpret the constitution. abortion is not mentioned or alieu -- alluded to in the contusion. try reading it. it will make you blush. the roe decision is a period piece from the early 70s like side burns nor the amc gremlin. so the fact that the roe decision was in fact shoddy and shameful is hardly a part season opinion. a lot of ardent pro choices have acknowledged it over the years because it's true. that would include joe biden. joe biden has always supported legal abortion. but nine years after the roe decision was handed down, he was willing to admit it was indefensible as a legal decision. pregnant women, biden explained in 1983 as a member of the nate judiciary committee should not have the sole right to say what should happen to their unborn children because nobody creates children alone. it takes two people. that is obvious. in fact, biden concluded that roe had gone "too far." of course, it had gone too far. that was obvious then and obvious now. then as now, many americans believe that abortion is murder. many other americans consider abortion a prerequisite to happiness. those are unreconcilable positions. in a democracy, we have a solution to quandaries like this and it's called voting. if we don't like something, we elect representatives to act on our behalf. if they do what we want, we re-elect them.if they don't, they're voted out. that's how the system works. for hundreds of years we've used that to solve complex and thorny moral issues. not just abortion. many others and worked well. that's why this has been a stable country because we get to rule ourselves. roe v. wade took that right away. in a single 1973 decision, the high court bans democracy from the debate over abortion. justices prohibited the states from enacting abortion restrictions that their own citizens strongly prefer. that meant going forward, alabama would be required to have the same abortion laws as massachusetts. some people love this. of course people in massachusetts loveded it. people in became became hated it. there was nothing that anybody could do about it because supreme court had cut voters out of the equation. as a result of that, the issue of abortion was never resolved. things are not resolved by fiat. only consent. it's the core of democracy and it's true. as a result of this short circuiting of democracy, demands from the left forced it. as a result of that, for nearly 50 years, this issue has festered. it's given americans another reason to dislike each other. it's divided the country. now finally after 49 years, voters might have the say over what to do about abortion as is their right. according to a piece last night in the blog politco, the majority of justices on the supreme court are ready to overturn row. justice alito said clearly in a draft opinion you can read yourself because it's circulates on the internet. we should be able to read it. it's not for the public. a final official decision is supposed to be months away. and yet an unnamed liberal objective short circuited this ancient process which has worked well for hundreds of years. this person leaked the opinion. not by accident. the point of leaking the opinion was to intimidate conservative justices in to reversing course. mob justice. if you're shocked by that, you shouldn't be. remember that it's not so different from what we saw this january when another unnamed liberal operative leaked the news that justice brier was planning on retirement and that forced him to retire which liberals wanted him to do because he was a white man. so that was in other words another op. one of many that we're seeing in our country. as if to prove that within moments of this story breaking last night, a mob formed a flash mob at the supreme court. watch. well, the upside is they're not telling you it's your body, your choice. even these people couldn't pull that off with a straight face after forcing manies to inject an experimental drug against their will or be fired. so they can't claim bodty autonomy anymore. so now they move to name calling. you're a fascist if you agree with them. they've been preparing for this moment for quite some time. the supreme court is debating the constitutionality of a mississippi law that bans abortion after 15 weeks. during oral arguments in this case in december, justice alito noted that "the fetus has an interest in having a life." that's true. but when he said that, plans for retaliation began. no one wanted sam alito to vote the wrong way. now those plans are underway. it's no exaggeration to say once the step gets going, you don't know where it winds up. people can get hurt because of this leak. you hate to think it could happen and you hate to think it could happen. people do. here they are. ada chavez works for the nation. she's some kind of reporter. she tweeted it's good that conservative justices and their families will have their lives threatened. she's in favor of that. over at vox.com, ian millheiser shouted f it, let's burn this place down. government by tantrum. and brian fallon, the executive director of the activist ground "demand justice" or else, said this quote, is a brave clerk taking the step of leaking a document warning the country in a last ditch hail mary to see the public response to make the court reconsider? like do what we want or we will hurt you? these are threats of violence. the ceo of planned parenthood is calling on activists to storm state capitol buildings. watch this. >> we know this decision will enrage people. we know, we've seen what has happened when people find out that when they found out what was happening in texas, they started filling state houses in florida, they started filling stale houses in other places because they know the fight right now is on the ground and in these states. so we're going to continue to capture that rage. >> tucker: we're going to capture that rage. people get angry and you wouldn't like us when we're angry. don't we have a system in democratic norms we're supposed to observe? if you don't like something, isn't there a process for resolving that? don't you elect people to see your will put into law? not anymore. you just storm capitols. but wait a second. isn't storming capitols an insurrection? oh, no. not when abortion is the topic. already they're vowing to use this draft decision to eliminate the filibuster and pack the supreme court. here's the best part. all this is happening in the name of democracy. so you won't have a chance to vote on something that matters to you, whether you're for it or against it. so that you won't have a chance to vote on something like that, they're going to thwart democracy. here's a former u.s. attorney that said that the justices are insurrectionists. >> it's not too great of a stretch to say there's an effort to overturn an election and overturn roe. it's this as i've been thinking about it. there's a segment of the idealogical spectrum now that think that has certain kinds of powers and wants to engage in radical efforts to overturn things that they don't like. there's no more compromise. you don't like the results of an election, you storm the capitol and talk about hanging the vice president of the united states and you get the presidency back. >> tucker: yeah. it's like overturning an election. you listen to something like that and they're like nine points you could make in response. you have to ask, either the person saying that is so stupid that he doesn't understand what he's saying or he's willing to say absolutely anything to stop the other side. that's of course what you're watching. these people are not stupid. they're dishonest. the thread, the consistent note in these clips is that none of the people yammerring against this draft opinion have actually read it. you know that because they don't attempt to respond to the legal arguments because they're immaterial. just as in 1973. they didn't consider what the constitution had to say about it. they didn't care. that's why it's an embarrassing decision. so instead of assessing what alito wrote, they accuse him of terrorism. overturning precedents and active insurrection. really? any supreme court decision must remain in place forever or else you're committing an act of insurrection. legal scholars out there, are there any supreme court decisions throughout the ages that were overturned and happy we're overturned? probably quite a few. messy versus ferguson anyone? the legal experts are screaming about facish. >> next they'll go about brown very board of education. they already eroded our voting rights a little bit. i say fascism down the line here. >> tucker: it almost detracts from us to play you something like that but that show has real ratings. people listen to that. really couldn't navigate a checkout scanner telling you what the supreme court draft opinion might mean despite the fact that she's capable of reading it or anything else longer than a tweet. she clearly didn't read what alito wrote. alito did anticipate this argument, that all kinds of terrible things would happen. here's what he wrote for the people that won't read it. what is distinctive about abortion is what roe turned to life. it's a unique issue. "to ensure that our decision is not misunderstood or mischaracterized, we emphasize that our decision concerns the constitutional right to abortioned and no other right." oh, so they're not trying to bring back slavery or legalize cannibalism or make it i'lless for you to vote. they're trying to allow you to vote on abortion. that's how dishonest these people are. if roe v. wade goes away, you get to vote on abortion. if you're a pro lifer, that's good news. if you're a pro choice activist, that's good news. why wouldn't you want your democracy to function. you don't want to vote on it? you want some elderly people to tell you what to do? no, this is a democracy. you vote. nobody on television is saying that they're demagoguing in their hysteria. they're nullifying the gender rules, which is concocted. they don't realize it but it's fun to see it. at cnn that spent last year that men can get pregnant. yes, they can. so they rediscovered the meaning of the word "woman." >> forgive me. i seem to be losing my voice. seems to be in line how women are losing their rights in this country. this opinion, if true, can be narrowed down and defined simply. women are not viewed as equal to men. >> tucker: women are losing their rights. really. what percentage of college students are women. what percentage of first hires of big company are women? yeah, they're losing their rights. how many women are in elections? liars, stupid people. let's get back to the constitution, the core question here. abortion does not appear there nor has there ever been a right to abortion in this country. if that bothers you, you can vote for it in the congress. you could pass a constitutional amendment. if you support a democracy, that's what you call to do. nobody has. we're moving the other direction. joe biden announced that democracy has been suspended. >> why i voted against a number of the members in the court. they refuse to acknowledge there's a ninth amendment. refused a right to privacy. so many fundamental rights that are affected by that. i'm not prepared to leave that to the wims and the -- of the public at the moment. >> tucker: he can't remember the word but we're going to piece together the sentence. the wims of the public no longer matter. sorry, pal, they do matter. it's a democracy. we get to vote on this stuff because that's our system. you're passing through. you'll be gone soon. the rest of us get to decide how we're governed because we're a self-governing country. we're a free people. sorry. there's a lot to unpanning here, so we thought we would start with an actual lawyer, someone that knows a lot about the supreme court, laura ingraham, the host of "the ingraham angle" on the fox news channel. she joins us tonight. laura, i have to ask you something. the fact that this was leaked, you know how the court works. how big a deal is that? >> the first thing that happened when i clerked on the courts, the first day that all of the clerks from that term were all together, like 40 or so of us, chief justice rehnquist said to us, if you are thinking at any point in time of divulging what happens within the walls of this court, especially anything about internal deliberations, your legal career is over. it's a great privilege to work at that court. considered by many the highest honor you could have as a young lawyer just leaving law school in my case. that's how you betray the trust of the justices, liberals, conservatives, doesn't matter and the institution of the court. it's never happened before. it will change the way the court operates. liberal justices, conservative justices, all should come together and together release a statement saying we condemn this, we will find out who did this and this will never happen again. explain to the american people why this matters. i know they announced an investigation today from the marshall's office. i look forward to seeing where that leads. but someone knows who did this besides the leaker in that court. >> tucker: they just did this -- look, i don't agree with stephen brier but i think he's smart and interesting. you know, he's an american that got the job legitimately. he shouldn't be forced out because people don't like his skin color. that happened the same way this did. nobody did anything about it or noticed it. >> because the liberals that claim to be the defenders of democracy as you noted in the open -- today they're the anti-democrats. the language is we're pro choice. no, they're the wrecking ball to american democracy today. imagine if the case was reversed and we had heard through a leak that the court was coming down the other way. imagine if mobs of people descended at the court screaming what could be described action threatening language towards some of the justices or derogatory language. you'd have nancy pelosi and the whole crowd saying we need to wall off the city again. we need to put the fences back up. this is -- those are the insurrectionists. that's what they would be saying today and tonight. >> tucker: so abortion is one of the saddest things i imagine. i mean that. some people think it's a road to happiness. why should we have a vote on it? if you love abortion, why wouldn't you welcome a state by state vote to look at the parameters? >> tucker, we've been friends a long time. you actually think these people trust americans to vote? really vote? on these types of issues? if they were so confident this was a popular position, they'd be like bring it on. all 50 states, you bet. everybody have your say. that's democracy. that's how it works. they want to take a whole slate of issues off of the table from the american people. it's not going -- this is not settled here. they'll keep fighting and keep ramping up the temperatures. this is a great day for the pro life movement. those that toiled and prayed and did it the right way, peacefully and respectfully. that is the process and people should celebrate that tonight. >> tucker: that's right. we should not be intimidated by the mob. we've been through this before. got everybody back on their heels. shouldn't put up with this stuff. thanks, laura. thanks for doing this. >> you're welcome. >> tucker: so as laura just said, there's never been anything like this, a leaked draft of a supreme court opinion. that's unprecedented in the modern era. senator josh hawley joins us in just a moment. joe biden's publicist just said people of color will somehow suffer if roe v. wade is reversed. what does that mean exactly? candice owens thought a lot about it and she joins us next. >> tucker: so last night a draft of the supreme court opinion written by samuel alito and representing the views of a number of conservatives leaked suggesting the that the court may vote to overturn roe v. wade. you may be for that, you may be against it. there's nothing racial about that. the word "race" is not even in the decision. there's nothing racial about it. of course, the biden administration, which goes immediately to race hatred, the second they have any problem whatsoever, went to race hatred. biden's publicist, jen psaki, said people of color will suffer the most if roe v. wade is overturned. we're not sure what that means. candy owens has. we're grateful to have her assess and interpret. thanks for coming on, candice. so when roe v. wade is overturned, will colored people suffer most? >> you know, it's not scary. it's democracy. this is about whether or not democracy is going to have its day. supposedly joe biden believes in democracy yet today you heard him. he was saying that this is too important to be trust toed the wimss of the people. the voters? that's my hometown, tucker. so far we have a big goose egg here. what is happening in franklin county. dolan is doing okay there. 3,300 raw votes to vance's 2,200. a lead there. we'll see how that runs as more votes come in. franklin county, something that we watch all the time, this is delaware county, by the way. why do i mention that? delaware county is where donald trump went to ohio to give the official endorsements. j.d. vance on stage there. not 1,000 votes for dolan either. something we'll watch through the night. this is cleveland, ohio. cuyahoga county. right now comfortable. 40%. this is a big city. there's a lot of votes to be counted still. dolan has about 3,000 raw votes there. come-out big-picture. one thing i would watch, tucker, in these rural counties a lot of them in the southwest, the southwest, j.d. vance is cleaning up. numbers like that hold it would be good news for vance tonight. your point at the beginning is what does the future for the republican? what is donald trump's role in this party? he endorsed vance. we'll see if that pays off. it's been called for tim ryan on the democratic side. so the congressman from northeastern ohio will be the democratic nominee whoever he faces on the republican side is still to be filled in tonight as we move forward through the hours. tucker, back to you. >> tucker: you never know where people are until an election. so interesting. thanks, bill. so the biden administration has decided to use a law enforcement agency to decide what you can say and think. they're going to use it to do what they've been doing for quite some time, which is to punish opponents of their rule. brandan strock found out the hard way. he's part of the walk-away movement. he went to washington, never committed any act of violence. he videotaped it. they arrested him anyway and threw him in jail. he just got out of home detention when he spoke to us today. listen to him describe the moment an fbi swat team came to his home. watch. >> imagine my surprise on monday, january 25 at the crack of down when an fbi swat came into my apartment, got me out of bed and presented me with a search warrant to take my property and put me in handcuffs and told me that they were taking me to jail and i was facing multiple felony charges for what i had done on january 6. >> tucker: no way. >> 100%. they took me to jail. they took my things, my coat, my money, my things like that. then they processed me and took a mug shot, put me -- printed the mug shot and put it on my wrist. had my mug shot on it and a number. at that point i was a number. the jail inmate system. from there they took me in to a concrete stall like a shower stall. i had to take my clothes off. i was standing there completely naked while a stranger came, took my clothes away. came back and gave me a pair of brown underwear, a brown shirt and an orange jump suit to put on. from there, they took me to medical. a nurse guard was standing there as i walked in. he says to me, i need your arm. i said why? he comes at me with a syringe. he said all new inmates in the jail system have to take a tb test. you need to give me your arm. the amount of trauma that is like boiling up in me because i'm thinking to myself, an hour ago was sleeping peacefully in my bed and now i'm here in a jail system wearing a jump suit and an inmate number and i have no say whether or not this stranger is going to inject whatever substance into my body. i have no idea. so he takes my arm, slides the needle in and injects something and forms a bubble and tells me if it turns blue or purple, let somebody know. from there, they took me in to a room called intake evaluation. there was a stoic military guy sitting there asking me questions like are you suicidal, have you ever been in a gang, do you have aids, have you ever had sex with a man. he said if a fight breaks out in the jail, are you able to defend yourself? i said no. i don't understand why i'm here. i was charged with a misdemeanor for disorderly conduct. now, i have no criminal record. this is a class b misdemeanor charge, which means it's a mid level, a petty offense, disorderly conduct, misdemeanor. i was sentenced to three months of house arrest, three years of probation, 60 hours of community service. mental health -- i had to take mental health services. what am i forgetting here? there were several other things. the government actually requested as a condition of my probation, three-year probation, that they have the right to survey my phone, my e-mail, my bank accounts, my social media accounts and my computers. they asked for the permission to survey all of those things for the three years that i was on probation to ensure that they could deter me from committing another crime. >> another misdemeanor. >> well, this is the thing. these january 6th cases, misdemeanors are being treated like felonies. the punishment that i just described -- >> tucker: you're not getting away with murder at scale. >> more than 90% of the blm anarchists had their charges dropped entirely. >> tucker: that guy's story is unbelievable. nobody is putting him on tv for some reason. he has a six-page single spaced handwritten letter and it was so shocking we checked the facts and they were true. you won't believe what happened to an american citizen in his on country. that is worth it. it's out right now fox nation. if the supreme court does overturn roe v. wade, abortion won't be banned but states make their own laws on abortion as in a democracy. what happens then? >> yeah, a massive meltdown happening right now from the pro abortion side because they can't force abortion for all nine months for children for any reason in all 50 states. that's what this is about. a tantrum being thrown but the pro abortion left. it doesn't reflect most of america. we have 22 states that have almost complete abortion bans in this country that want this to go into effect, that want to protect children in their state. children no matter the fact that they're unborn. so it's amazing to watch this moment unfold. and in the pro life movement, we're thrilled. this is a step forward and just getting started. >> tucker: this is one of those subjects that is often talked about but never in any detail. i never hear anybody address what it is, what is really happening. and they can do that because they don't have to discuss it because it's not up for a vote, right? one upside of this is we can have a real conversation about abortion. who is getting abortions? what does it mean? what does the science tell us? is that the upside of this? >> you're right, tucker. i spent the last 15 years of my life, my entire adult and teenage life working to educate people about abortion. i've seen people flip because of learning about human development in the wound and what abortion does, how it suctions a developing child into pieces, how it dismembers a tiny child, a lethal injection that pierces their heart. when people learn thinks truths about what abortion is, they change. when people learn, they change. we're going to see a wakening underway but it's only going to grow when people will be forced to grapple with the reality of what the abortion is. we're going to see, it's an empty husk. they don't have real life in them. they don't have real passion. they're just writhing out and screaming out, crying for the so-called right to abortion. it doesn't exist. the right to life does. so i'm very enthusiastic to see not just the red states enact pro life laws but change happening in blue states when people are educated about abortion. >> tucker: yeah. if they can look that in the face and say they support it, okay, they can vote for it. but if there's no vote on this stuff, how can you call this a democracy? >> but here's the thing. at the end of the day, even a democracy, tucker, shouldn't get to decide who lives and dies, innocent people. it's not up for a vote. it is up for a vote. the supreme court ruling, if this draft ruling that was leaked if that's what it's going to be, it would be a compromise to send abortion back to the states. that's not full justice. full justice is whether you're a child conceived in california or texas, you're protected by love and law and our legal system. that's what we're fighting for. >> tucker: i'm for it or against it. you know?
