the pick by president trump is getting leverage there. here's. biden's new numbers at record lows today. approval according to quinnipiac at 33%. that is not a good number according to gallup. he is leading support from a reliable voting block less than seven months to go to the mid-terms here. young voters definitely losing the luster with regard to the president. down 20 points in both of the millennial group and the gen z group. something to turn around. let's bring in marc thiessen, fox news contributor and mark penn, former clinton adviser and chairman and ceo. great to have you with us. i hear that election music and gets me pumped up. we'll get closer to looking at these closely. so let's look first at this number. i want to go to mark penn on this first, this is the quinnipiac. or this will be a tornado of a mid-terms if these numbers continue to hold up. frankly, they've had month after month here to do something to turn around on inflation, on immigration, on ukraine, on crime. they just haven't done it. they have done small little incremental changes. they need big changes to change some big numbers. >> martha: i want to get more specific about what you recommend, marc. you wrote an interesting piece on it. we're looking at this race. it's to replace senator burr. president trump has supported a candidate who is now moving ahead in that race. it's going to become a lot about this in these primaries as we look at who he is supporting and who he isn't supporting. what are we seeing here? >> we'll find out how much president trump's power still. in georgia in the governor's race, it's not working. but the problem is we shouldn't be focusing so much on donald trump. we should be focuses on joe biden. that will win republicans the election in the mid-terms and 2024. we have this situation with president biden. inflation was going to go down in 2022 instead it's gone up to 8.5%. that is the largest month over month increase between february and martha we've had in 17 years. that's an incredible statistic and his approval rating is down to 33%. what is remarkable, normally during a foreign policy crisis, americans rally around the commander-in-chief. the opposite is happening. they disapprove not only in the economy but the poll says 39% approval of his handling of ukraine. he's facing a perfect trifecta where people disapprove of his handling of inflation, of ukraine and they disapprove of his presidency. that is deadly for him. >> martha: marc, jen psaki said that we had to put in place all of these stimulus programs post covid or people wouldn't have had food on their table. do you think that the american people believe that? >> no. i think fundamentally the 1.9 trillion covid aid package wasn't targeted enough. because it wasn't targeted, i think ultimately that there's a good share of the responsibility for the inflation that consumers are facing. that's the way the voters see it. they see the spending has just having gotten out of control. triggering the inflation that is hurting them in their everyday lives today. that is the most powerful issue facing this administration right now. >> martha: staying with you, mark penn. you have a list. energy, foreign policy. you say send the jets to ukraine and do it without delay. to tell the white house a couple of things to do to turn it around, what would it be? >> they have to signal big changes on energy. all of the above. okay some pipelines and show they're serious. on immigration, they have to close the border and signal that they want comprehensive immigration reform. bring that back. be a leader in that. on crime, they need to show that look, if local da's continue do the job, the feds will step in. they should back another 100,000 cops like we did in the clinton administration. in the ukraine, be definitive. send the jets and fight the atrocities. they have to take big measures here. just doing a little thing on ghost guns is not going to stop -- >> martha: it's not something on people's minds every day. marc thiessen, a quick look here. what strikes me and what mark penn has to say there, most of those things are that joe biden has supported in the past except foreign policy where he haas been a waffler and indecisive. your thoughts real quick. >> yeah, mark is 100% right. jen psaki says that people wouldn't be able to afford food. they can't afford it now because of the inflation released by the 1.9 trillion in social relief. the polls are very clear. there's a referendum on every area that he's under water. if you double down and say we were right to give you that 1. 9 trillion covid relief and we are not responsible for the inflation. we're not responsible for the record crime. we're not responsible for the record border crisis in history and double down on your policies and you don't change anybody, nobody's opinions of you will change. >> martha: it's clear that the folks in charge of policy are digging in their heels. they're not moving on anything. it looks at this point like it may not happen until after the mid-terms. we'll see who wins these battles in the white house and beyond. mark pen, good to see you, sir. marc thiessen, great to have you with us. immigration a hot issue in election season as president biden's decision to end title 42 gets pushed back from democrats and republicaning and folks that are on the president's door step. another bus came today. the blunt warning from ron desantis when sean duffy and geraldo rivera join us coming up. >> governor abbott is making good on his promise to send migrants to the president's door step. you previously called it a publicity stunt. is that still the view of the white house? >> i agree. you need consistency. how can you abolish a law that is a health-protecting law -- if they need to wear masks because of covid, they need to stay out because of title 42. you need consistency. >> martha: you think the white house will do that? you think they'll extend it? >> because of the ruckus and the push back they're getting, i would be absolutely shocked if biden suffering the low poll numbers was to abolish a law that everybody wants to be in place. because greater chaos -- you know, the thing that abbott is doing -- abbott is a hard-nosed showman. sending those buses to washington, he knew it would be a spectacle. you know, i get it. i get the spectacular nature of what he did. but under the radar, what he has done is to tell the governor of the state south of texas in mexico, tell them they better control the immigrants or they'll have blockades at the border. texas will take it very seriously. that is something that is effective. that's what trump did best. >> martha: exactly. >> he went to the mexicans and said these people are walking across your territory. you have an obligation -- >> martha: a trade partner. help us out and they did. that went away. it's interesting, sean, jen psaki got push back and good questions from jacqui heinrich the other day about this question of bringing these buses up to new york, right? and then today she said it was a publicity stunt. yesterday, i believe it was, in the news conference, she said they're free to traffic. they have always been processed already by cbp. so how nice of texas to provide buses for them. what do you think of that? >> i think -- listen, this is a messaging battle that they'll have with ron desantis and the white house. is this a gimmick from greg abbott? of course it is. he's trying to draw attention of all the migrants coming in. it highlights the destruction of illegal immigration. i know in new jersey and schools around the country, there's new students coming in and the teachers can't teach the kids that live in the community because they have an influx and speaking different languages. not just spanish. russians and different languages. kids are suffering. and then the fact that you have the cartels. geraldo cares about this. but you have cartels that are raping, murdering, making massive amounts of money at a time when the white house says we want to stabilize these countries. look at the root causes. the policy of illegal immigration is destabilizing the region and has an impact on families. >> martha: it's a political gimmick. i get it. but these buses and planes are going everywhere else. why shouldn't they go to d.c.? any community that is helps these people come in, it's in my town, i'm saying yeah. we're bringing people in here. why shouldn't washington take them? >> regardless of the language the immigrants are speaking, they would prefer miami over washington d.c. i know i would. >> maybe this summer. >> they are here now legally until their status is resolved by the immigration system. >> martha: is this going to happen nor the people that just got off of the bus? it's all going to be -- >> they have a need to report at a certain time. if they don't report by that time, that would forfeit their ability to do the asylum seeking, to have their status deemed as a refugee. if they don't toe the line now, then they will be rejected and particularly with title 42 in place. they'll be thrown out asap. >> that will not happen. democrats will move to make these migrants legal citizens with voting rights. that's the plan. they talked about it. that's the net purpose behind what they're doing, bring in new voters. >> you think america would be okay to vote republican? >> not at all. we have a legal process. if you want to say who has their way to asylum in this country, you might go venezuelan, cuban -- >> but venezuelans and cubans are in this group. >> i know they are. that's why joe biden keeps getting it wrong. >> martha: and you should seek asylum in the very first country you reach. >> mexico has to step up. >> martha: thank you, guys. and a man is charged with federal terrorism offense after shooting people in a new york city subway. we're learning more about 52-year-old frank james. he's has a stockpile of weapons and new details about his violent rants online where he called himself the prophet of doom. bryan llenas reporting live from the brooklyn courthouse where mr. james just appeared. hi, bryan. >> hi, martha. frank james was denied bail and will be detained the duration of his trial. he appeared in court without handcuffs or shackles. his defense attorney asked a judge that he undergo a medical psychiatric evaluation. afterwards, the same defense attorney, that attorney confirmed that james was caught by police only after he called them and told them that he was at a mcdonald's on the lower east side. >> yesterday mr. james saw his photograph on the news. he called crimestoppers to help. he told them where he was. initial press and police reports in cases like this one are often inaccurate. mr. james is entitled to a fair trial. >> james face as terrorism charge for allegedly attacking a mass transit system. prosecutors say the evidence against james is strong. he left the gun and his cell phone on the trail. they're zeroing in on social media that james posted. they said that he has a history of recording violent videos on his social media accounts. he posted a video on youtube in which he instructed others how to make a molotov cocktail. he also stated a desire to kill and shoot people. northeaster criminal complaints or the detention memo mention the racist comments james recordedly made in the same videos. he ranted against white people, race issues and an upcoming race war. prosecutors say they found a stockpile of ammunition and dangerous items at a philadelphia storage unit and inside a philadelphia amendment. james has been arrested a dozen teams over 30 years. there were low-level offenses and we know that he was never on the fbi's radar, nor under their investigation. martha? >> ready to go? >> martha: the president was asked if they were going to send senior officials to ukraine. he said we're thinking about that now. so $800 million in weapons, am you mission, other military equipment set to arrive in a few days max according to officials as the united states becomes more involved in helps ukraine defeat vladimir putin at a critical juncture in this war. that's the assessment of a number of generals. the next couple weeks are very pivotal here. john kirby joins us. first to jeff paul in lviv, ukraine. hi, jeff. >> yeah, martha. it certainly is the talk of the town here in lviv. this development that a russian warship was badly damaged. regardless of how it happened, it's considered a major blow with this ship being considered the jewel of russia's black sea feet. ukraines say it was their forces, missiles from them that damaged this vessel. what is interesting, this vessel is named after the russian capitol city, that was about 60 miles south of odesa. there was a fire on board the ship, russian officials say but no mention hoff an attack. the ship is being towed to port. destruction in mariupol continues to mount. russia claims more than 1,000 ukrainian troops have surrendered the city. ukraine's interior minister countered the battle is still going on. regardless, the loss of life and the impact on innocent civilians is staggering where more than 10,000 have died and more than 100,000 are trapped. >> why are they killing us? why our houses? three ten story buildings were burnt completely. >> meanwhile, the u.s. officials are confirming today, martha, that they will be sending a top level official to the capitol city of kyiv. who that might be, it's unclear right now. president biden saying it's essentially in the works. martha? >> martha: jeff paul in lviv. thank you. joined by john kirby. thanks very much for being with us. good to have you. >> thank you. >> martha: so this ship, the moscow, it is a guided missile cruiser, the flag ship of the black sea fleet. so this is a huge just blow to their pride, to lose this ship. a fire burning on board and the reports are that it is limping its way for repairs. can the pentagon confirm whether this was a ukraine missile that hit this ship? >> we're in no position to refute the ukrainian claims right now. but we can't confirm it independently. we recognize the ship suffered a blow, an explosion, which led to a significant fire on board. it caused them to evacuate some of their sailors if not all of them from the ship. that much we know. we know that a couple hours ago, the ship was not making its own way through the water. so clearly something significant happened on this cruiser. it's a cruiser. they only have three in the russian fleet. so the loss of this ship will impact their naval operations. it's difficult to say at this point that it will cease all of their maritime activities or will prevent them from reinforcing their forces ashore from the sea like they've been doing the last few weeks. >> martha: you look at this. this is the lead of the black sea fleet. you say they have three of these guided missile ships. is this a mini midway? i read four or five russian ships left the black sea with it. they're gone from there right now that sounds like a very devastating blow to me. >> they didn't leave the black sea. in the wake of this incident, other ships, about a half a dozen or so russian surface combatants in the vicinity of this cruiser also moved themselves further away from the coast. that certainly seems to be an indication that they felt some sort of threat to them as well. they moved away from the coast. we don't assess that they left the black sea. the russians still have roughly between 15 and 22 or so ships in the black sea. it changes from day to day. they are black sea nations. they have ports in the black sea. they still have many ships at sea in the black sea and the sea of lasov. >> martha: these are ships that are firing missiles into odesa. >> yes, ma'am. >> martha: let's talk about this "new york times" report. president biden said the united states is already a major provider of defensive armorments to ukraine, would add 800 million in security aid. does the pentagon still see our commitment as defensive aid? >> no. what we're describing is weapons and systems that are helping ukraine defend itself because it is on the defense since they were invaded by russia. we're not getting hung up on words like offensive and defensive. you can see the list. it's helping them defend themselves, their troops, cities, towns and people every day. if you look at that package that the president signed yesterday, it's really designed very much more specifically and tailored to the kind of fighting that we think the ukrainians will be experiencing in the donbas. artillery. counter artillery radar systems. more uavs. even unmanned surface vessels that can help them with coastal defense. we know mariupol is a coastal city a port city. that coastline is still important to the russians in terms of their goals in eastern ukraine. we tried to tailor this to the kind of fight that we think they'll be in. >> martha: not to -- we talked that this before. you want them to win. >> of course we do. >> martha: why the hesitancy to say we would offer them offensive weapons? >> whether you're using them on the offense or the defense depends how you employ them daily. they're designed in the aggregate from a strategic perspective. ukraine is the victim of an invasion here. designed to help them defend their country. >> this quote from elliot cohen today. he says what matters now is we judge the present moment correctly. the west faces potential failure. decisive action is urged between a costly success and a calamity. does the pentagon believe the next couple of weeks as russia regroups on the east side is decisive in this battle? >> we know that this coming few weeks are going to be very, very critical. we understand that. we know that time is not our friend. we're mindful of the clock. we understand what the russians are trying to do here going forward. we're going to try to give the ukrainians every advantage on the battlefield that we can so we can prevent the entire country the falling to october you because by the russians. what we're not clear is what the the russian's long-term goal is. take the donbas and call it a day or use it for more a tacks in the west. we want to make sure that we're looking long-term here. it's not inevitable that the russians will succeed here. they have not overcome, martha, all of their problems with command and control and logistics and unit cohesion and morale. they still have a lot of problems facing them even as they concentrate their forces on a smaller area. >> martha: what do you think about the mariupol report that 1,000 ukrainian marines turned themselves over? >> look, what we would tell you, we can't confirm or deny that report. we think that mariupol is contested. we still see ukraines fighting over it. anything that comes out of russian state media take with a grain of salt. >> we don't have a way to know that or intelligence to answer that question? >> i haven't seen any intelligence assessments that confirmed that report that 1,000 ukrainian marines surrendered. what we believe and what we see is that they're still -- the ukrainians are still fighting very hard for mariupol. >> martha: you make clear the problems with the morale on the russian side is quite evident and obviously an issue. the ship thing, i don't know why the four or five ships would leave if that ship wasn't attacked. if that was a fire on board, why would you send four or five other ships -- i want to move on. >> a fair question. >> martha: when you look at it short term and long-term, here's his fear. >> we're obviously very concerned. president biden is concerned about avoiding a nuclear threat. >> martha: while there's a lot of support ukraine in this country and wanting them to win and giving them what it takes to win, not everybody but a lot of people feel that way, you know, what about that concern, that putin is trapped and that he's losing and that he doesn't have a military that can win this on the ground but he does have a button on the largest nuclear weapons systems in the world? >> from the very beginning, we're talking about our concerns of escalation management. it would be irresponsible if we weren't thinking about that every day given the fact that mr. putin can be unpredictable, given the fact that he has available to him nuclear stockpiles of a significant nature. i think we've all said that nobody -- we want to see the war end today, of course but we don't want to see it escalate into a broader conflict that brings nuclear weapons or weapons of mass destruction in to play. that's not only not good for the european allies and partners and our national security, it's not good for the people of ukraine. so every decision we make, we have to think about escalation management. it would be irresponsible if we didn't. >> martha: we know he's been very unhappy about the growth of nato. does the pentagon support finland and sweden getting on the team in terms of a military response, article 5 response to russia? >> what we absolutely support is making sure that nato and the eastern flank of nato is strong and viable and we can present a strong deterrent to mr. putin so he understands that we will defend every inch of that nato territory. for sweden and finland, those countries leaders have to have that with the alliance. we expect that that process has to play out and those conversations have to be had. the will of the people there have to be met. obviously if it gets to that point, the united states would be supportive of making sure that if they join nato, that we were committing to their defense as well. we're just not there yet. >> martha: john kirby, thank you. good to see you, sir. >> thank you, martha. >> martha: john kirby at the pentagon. president putin's war on ukraine causing a perfect storm of crises that threatens food, energy, financial stability of billions of people around the world. this has such far-reaching ripples and impacts. and that statement was from the united nations. they're ramping up their efforts to provide much-needed help. trey yingst has that story for us from kyiv. trey? >> martha, good afternoon. it's day 50 of the war in ukraine. as russia continues to target civilian areas, the humanitarian situation on the ground is deteriorating. millions of people are risk for food insecurity. >> on the outskirts of kyiv, this woman waits for lunch. her husband is cooking onions on an open fire outside of their apartment. two days after the war started, we had no heating, no electricity, no gas. the occupiers came and eating our supplies. her neighbors recall life under russian control. and how everyone had too ration what they had left. i was coming to dena. sometimes we had to share one sausage for three people. standing next to her, natalia says after these days under russian occupation, when you see someone that stayed alive, you treat them like your relatives. these ukrainians are not alone. millions of people could face food insecurity. the united nations warns. david beasley from the u.n. world food program is on the ground in ukrainian. he's meeting with residents to get and idea of what they need. >> we reached over a million people inside ukraine. >> now the world food program is focusing on feeding people and also working around the clock to keep global aid supply lines working. they bought 800,000 tons of wheat from ukraine each year. the countries that need it are in need of alternative supplies. >> we have the bread basket of the world, ukraine, shut down now for production. >> beasley tells fox news in an exclusive interview that he communicated with russian leadership saying food supply ships must be allowed to safely leave their ports. he demanded access to life-saving aid in ukraine. >> i have asked written letters to demand that we, given the access to reach these innocent people. it's not complicated. it's very simple. give us the access to let us do what we do best. that's save lives in times of war and conflict. >> while there's aid flowing in to ukraine, beasley says it's not enough. every city across this country remains in the sights of the russian military. martha? with the newday100 loan, you can get up to $60,000 or more and lower your payments $615 a month. no bank, no lender, no one knows veterans like newdayusa. >> martha: now for something different. johnny depp and amber heard are facing off in court. multimillion dollar defamation trial is at work here. ugly allegations of drug use, mutual abuse from former assistants, marriage counselors weighing in on the stands today. mark geragos is here. first to david spunt outside the courthouse in virginia. hi, david. >> hi, martha. today is day four of this defamation trial. depp is suing heard for $50 million. a little rain outside of the fairfax county courthouse right now. but significant movement within the last 30 minutes. a judge actually dismissed one of the witnesses on the depp side. a friend of johnny depp. she admitted that she was watching coverage of the trial. she was dismissed. earlier today, a marriage counselor for johnny depp and amber heard took the stand to talk a little bit about both. today the estranged couple sitting on both sides of the courtroom. we have live pictures from inside the courtroom right now. depp is suing heard for the december 2018 op-ed in the post where she says that she was a survivor of domestic abuse even though she did not mention depp by name. depp says that her op-ed damaged the reputation, cost him future roles in films. he was never arrested or charged as a result. this is a civil trial involving defamation. the underlying accusations continue to be explosive with heard accusing depp of physical and sexual assault. a former therapist said that she observed heard with small bruises on her face. dr. anderson said that she became aware that the couple would physically hit each other. listen. >> when she said in terms of physical abuse that he hits her, no closed fist means an open hand slap to me. she says she hits back and now she starts it and sometimes hits him first because her history is having been violated by her father physically. >> court will pick up next month. the trial is expected to last six weeks with all the witnesses. martha? >> martha: thanks. let's bring in mark geragos, a no stranger to legal sagas. representing scott peterson, michael jackson and host of the reasonable doubt podcast. great to have you with us today, mark. we'll start by playing one more sound bite from this therapist that calls their abuse mutual and then we'll get your thoughts on the other side. here it is. >> they engaged in what i saw as mutual abuse. sometimes -- i know she led on more than one occasion and starteded to keep him with her because abandonment and having him lead was her worst nightmare. i think he initiated it on occasions, too. that i'm less sure of. >> martha: mark, what do you make of this so far?
