commission after the 9/11 attack. we need a 9/11 commission to go back and look at what the public health officials did here. the cdc is a disgrace. we would be better off in this pandemic if the cdc didn't exist. they've gotten everything wrong. just in the very first weeks of the pandemic, they banned private testing and contaminating their own tests. they used a flu surveillance method that was looking for symptomatic infections in hospitals when it was spreading a symptomatically. they told us not to wear masks all the way up until may. they came up with a 6-foot distancing rule which we now know was based on no science whatsoever which cause the closing of our schools. that was a main driver in the closing of our schools which has been more disastrous for young people than the virus itself. they have just a week ago, they said that omicron was 73% prevalent when it was only 23% prevalent. they are literally getting nothing right. we really need to look back, because truly, we have gotten to the point where people just don't listen to them anymore. it is really dangerous when public health officials have so discredited themselves that the public just tuned them out. not everything they say is wrong. we need to good science and good guidance from our government. and the public health officials have literally done a worse job in handling this pandemic than the intelligence community did in missing the 9/11 -- >> dana: parents for employers, for restaurant owners, and workers trying to get to work. all of it is really bad. there is a confusing messaging from new york state. this is something they decided over the weekend. basically, nonwhite race or hispanic latino ethnicity should be considered a risk factor in social inequities have contributed to an increased risk of severe illness and death from covid-19. they put this in a memo. i got out and over the weekend, basically -- you are going to deprioritize people if they are quiet if they have the same symptoms. of this to me also adds into what you are saying in terms of people feeling confused and frustrated. >> first of all, it is unconstitutional. you can't factor race into who you give a theory applied to public health. francis x kennedy was one of the chief proponents of critical race theory. the only remedy to racist discrimination is antiracist discrimination. the only remedy to present discrimination is future discrimination. this is basically saying that since there is past discrimination against african-americans and other minorities, there should be present discrimination against white people for getting vaccines or getting treatments. it is ridiculous. there should be no discrimination. the goal of country should have zero discrimination against any race. it is our attention in a tweet. there is a new definition in merriam-webster's dictionary. this is not a joke, folks. a change of the definition of an anti-vaxxer to a person who opposes the use of vaccines or regulations mandating vaccinations. you are a wordsmith. i know that having worked with you in the past. this makes no sense. >> no, it doesn't. who appointed merriam-webster? i didn't realize they were public health experts to decide what is the definition of an anti-vaxxer. the second of all, i am at backs, i am boosted. i oppose mandates. it does that make me an anti-vaxxer? my colleague, source. you can see some of the bullets that impacted the truck. at that age and was arresting a migrant who crossed illegally on new year's day near texas about an hour away from where we are. gunfire erupted from the mexican side. several bullets ended up hitting that border patrol agents drug. thank only they agent nor the migrant were hit. this is being investigated by the fbi. also now involves beer to take a look at this video. human smuggling certainly didn't take a break over the holidays. this is a video of texas troopers pulling over a pickup truck in texas here in the rio grande valley on new year's eve. they pulled the truck over. or they get the driver out of the vehicle. he was a suspected human smuggler. take a look at what they find inside of that vehicle. seven illegal immigrants were being smuggled. some of the bed of the pickup truck. there is in the truck itself. that driver was a mexican national. it was arrested and charged with multiple counts of human smuggling and more smuggling to show you. take a look at these photos from the del rio area also on new year's eve. pulling over a truck. this one had a trailer attached to it. they arrest the driver. here is what they find inside. a large group of illegal immigrants once again being smuggled. here is what is interesting. you take a look under the vehicle, photos appear that driver had modified the suspension to his truck by placing blocks underneath it so it wouldn't look like the frame of his vehicle was riding low from the people being smuggled inside of the vehicle. at 21 illegal immigrants were recovered from that human smuggling incidents as well. both of those incidents on new year's eve. back your live. border patrol reporting that del rio sector alone just in the month of november inflation that all of these farmers are facing as regular americans that i mentioned, $8 for a pound of beef whatever. gaslighting what's really happening. the top 4 producers. 85% of the market. where's the proof? they've been making these allegations against the industry since july. july 21 without giving out any proof. you've got the usda. you've got the fda. do an investigation peer to give the industry -- the insight they need to actually respond to these claims. this meeting today will be with smaller producers. i read that brief this morning. they want to throw a lot of money to get more processing facilities on smaller farms up and running. that is fine. these folks need support. they need loans, great. it is a tough job to be a farmer. we all know that. one of the hardest working industries out there in america and they are keeping us bad during a pandemic and have been for two years. the problem is they are still paying the high prices of inflationary prices. many economists say that inflation is being caused by bidens policies. they have thrown at the economy over the last year. >> trace: just so we have them, we are going to move onto the next question peered back end, business to business if you will. that is going to raise prices. understandably, these hardworking americans need raises. i understand that. i'm not immune to that. you are squeezing a small business owner. you want to have a small business that is in business, or do you want to lose more small businesses? don't get me started on the covid lockdowns that we are already talking about. and a lot of these democrat led cities that has also come a lot of their restaurants in new york are telling us that they can't even operate normal hours right now because they don't have staff because of >> the fundamental approach and the fundamental flaw in the president's approach is that he continues to tell the world and to tell vladimir putin what he will do after russia invades that we will respond decisively after they invade. that is like telling the ukrainians that in world war ii, and telling poland or france what we were going to do after germany invaded. now even, it is, like, telling taiwan and china what we will do that we will take decisive action after china invades over iran after they launch a nuke. we need to be taking steps now for deterrence now to prevent vladimir putin from taking that drastic step. that includes a dramatic increase in arms and equipment to the ukrainians and sanctions in place now including on the norge dream 2 pipeline which is exactly why he is doing this when he is doing it. >> dana: you were there last month. what i keep reading is that president biden says that russia will pay a heavy price. it to point, this is an after action and effect. listen to a adam schiff said. he's a democrat on intel in the house. watch. >> require an enormous sanctions on russia to deter what appears to be a very likely russian invasion of ukraine again. and i think our allies need to be on board with that beard russia needs to understand that we are united in this spirit >> dana: i get the sense that there's not a sense of urgency. when you're talking about getting allies together to focus on huge sanctions, that kind of thing takes a long time to put in place. we might not have that much time. >> again, the fundamental flaw here is that you have to have -- you have to have a consensus for sanctions to really work. they have to be in dollars and euros. with the norge dream 2 pipeline coming on which will create a dependency for germany, the main country that you need for sanctions to actually work, i don't think the europeans are going to be on board for this tough action like the united states is claiming they will be, because we allowed norge dream 2 to come into place. in the middle of winter, they will be dependent on cheap russian gas for their energy security. it is not going to work. >> dana: we had a chance on "fox & friends" this morning to speak to the family of lance corporal. he was killed by the suicide bomber outside the airport in afghanistan during that chaotic withdrawal. this and what they said this morning. >> we were able to keep our son alive. more importantly for the last 20 years, then he goes and joins the military to serve our country. and our country can't protect him. >> dana: what do you think is important for us to remember in terms of getting justice for those 13 that died but also to continue to help those who still want to get out? >> "needs improvement and needs to apply himself much more. because with any presidency, it always comes down to basic things. how's the economy doing in terms of safety and security, how is the country doing on that front? we saw the report from chicago earlier in the horrific numbers we are seeing out of there. it is so indicative of so many cities across the country. 16 cities all run by democratic mayors by the way. set homicide records in 2021. the other president or vice president for merck district general attorney. the beginning of 2021 is refund of the police in 2022. this will absolutely be important in the midterms. that's not good news for the president of the blue team. >> trace: you can only wonder what the numbers would be if the media was fully covering the crime crisis in the border crisis. those numbers one would assume might dip down even lower. >> one would think. numbers are tough to talk about in cable news because you throw out a number like i'm about to. at 2.2 million people will have crossed the border illegally this year into texas into arizona all those southern states. you say what is 2.2 million exactly? friend's idea. people as you point out, they are entitled to have friend's ideas. the problem is, if the federal courts are deemed to be a sort of a tool by which progressives further the progressive agenda, rather than to just have judges who apply the law and whatever crazy opinions they happen to have outside the white lines, at least when they are in court, they are applying the law, you wouldn't have to worry about that stuff so much. clearly this is an ideologue. if she gets on the bench, use the federal court and the federal law to try to further a political agenda. >> dana: do you think that approach of nominating an ideological person such as this leads to this is to stick? judicial nominees with greater than 25% opposition, president biden's m&a's are up there at 98%. you have to imagine some of that was were because they were against trump. this is a really high number. do you think that is part of the reason why? >> of course it is. this is historically unprecedented. to be 93% of your nominees get at least 25% opposition in the senate has never happened before in american history. it looked from biden's perspective, you know, 25% opposition -- what matters is 51% opposition. as long as he gets them, you know, minted and confirmed, that shows the progressive left daddy's on the team in delivering for them. from the beginning, there was a lot of pressure on him to deliver their legislative agenda that there margins and congress was not going to allow for peer to the way that they show they are on the team in moving the ball up the field is to use the administrative state and the federal judiciary to put people on who will do that. >> just so everyone is aware, president biden, quiet about this excess, but they've had 40 judges confirmed in the first year of their presidency pure to look at that compared to all the others. not since ronald reagan has there been a record like that. they learn something from the republicans trying to get fda has authorized covid booster shots manufactured by pfizer for children as young as 12. at that still needs to be signed off on by the director of the cdc. that may come sometime later this week. the cdc is facing some criticism from medical experts for not requiring a negative covid test as part of its updated guidance for reducing the isolation period or people infected with the coronavirus. the new guidelines reduces the early ten-day isolation period to five days when an infected person can return to school, work, and social activities provided they have no fever or other covid symptoms and wear a mask for an additional five days. dr. anthony boucher says he expects as early as this week that cdc may add a testing option to those recommendations. >> there has been some concern about why we don't ask people at that 5-day period to get tested. that is something that is now under consideration. the cdc is very much aware that there has been some pushback about that. >> the highly infectious omicron variant is driving a near vertical surge in new covid infections averaging 400,000 cases per day in the u.s. hospitalizations and deaths remain disproportionately low. physicians worn as case members continue to rise, hospitals could still face a huge burden even if the percentage of people with severe disease remains low with omicron. most schools in massachusetts are reopening today despite calls from the teachers union to remain closed to allow more time for educators to take covid test that were delayed by supply chain issues. u.s. education secretary says testing is important, but not the only strategy for keeping students and teachers safe. >> it's really important that the testing protocols are put in place but not done in isolation. increasing vaccination helps. adherence to the mitigation strategies that we know where car part of the strategy. >> still a small but growing number of schools are closing this week were conducting online instruction. that is what they are doing with atlanta public schools nationwide. more than 2,000 schools have yet to open. concerns of surging covid cases. >> trace: jonathan, thank you part let's sound from him and get some response on the other side from him, watch. >> our expectation is for schools to be open full-time for students for in person learning. we remember the impact of school closures on students last year. our science is better. we have better tools. >> he says that science is better. the problem is that the teachers unions believe they are the arbiters of how to interpret the science and it is frustrating for a lot of people. >> great interview with him yesterday. i saw it. and i think that it is a platitude. it is a statement he is making but you made a great point. there's a lot of pressure and the other direction. when schools hit the pause button with 2,000 around the country or more, you kind of wonder when they are going to unpositive. hats off. he was on the week before saying that brown is going to be open. i think that schools and universities have to set a precedent here and go out front and say, we are going to be open, because we can do testing, rapid testing on the premises. we can make sure that most people they are vaccinated or have boosters and we can monitor this. here is the most important thing. we can monitor this much more closely in a school then we could ever do by letting them go into the community. what do you think happens if you send students, university students certainly are going to spread it in the community when they are at home trying to learn online or public schools are high schools are going to spread it anyway. you get a lot of public health damage by closing schools. get mental health issues. you don't get screenings, developmental delays are missed. you don't get immunizations. nutrition is all screwed up. on top of that, you spread virus. >> dana: here in the top five states reporting new cases but not surprising, the high population of states, florida, pennsylvania. there were reports all weekend especially here in new york. of course, we had a holiday. some doctors offices closed like pediatricians for example. you had moms and dads with sick children, not necessarily with covid having to stand in line outside for three hours in order to try to get their child seen. i think the level of frustration if you take the cdc mixed messaging on when to isolate admin to test if not et cetera coupled with the fact that there is concern about their schools possibly closing in their workplace might be closed as well. and you have people get sick, like regular illnesses in the winter and they can be seen. this is reaching a fever pitch in my opinion. >> that was a great juxtaposition between what the theory is. we are going to take care of you which is what the facts are which is not only our doctors offices closed, but staffing is down, way down because of covid. that is another reason they are closed. i want to point out one possible solution here. i was thinking a lot about this question. it is telemedicine. the mckinsey report last summer showed 40 times more telemedicine now than before the pandemic. i am a big believer in it. i used to load it by the way. telemedicine, i can't help anybody, i can't see what's going on inside their home. i've gotten used to it. if i have a concern that a patient has covid, i will use telemedicine. we need that state laws to reflect this. right now in new york just to give you one example, i can't bail across state lines. i can't. i can only do connecticut appeared we need to go back in the direction of more telemedicine. the other answer is don't tell people to wait online. in terms of testing, he made a great point. they are going to get sick. if you have kids waiting out in the cold they are going to get sick. and if they are not sick already, they are going to get sick now. >> they are frustrated. >> the whole thing about testing is there mixed messages coming into it we just heard dr. fauci saying the cdc might add a negative test before you can get out of quarantine. but you have the cdc director saying no, it's not going to happen because a pcr test might not work. you're getting different messages from different authorities. >> let me walk you through that. she's right about the pcr test. they can be the solution because he can stay positive for weeks. the rapid tests are being underutilized. rapid test if you are still symptomatic are pretty accurate. there are two new ones that just got approved. at the problem is, we don't have them. i have a hunch that the reason the cdc director didn't include testing to begin with is because she knows, we don't have them. but it is correct to criticize the decision that was made, because 20% of the time, it's not enough. you are going to end up spreading more and more omicron by letting people back to work too quickly. you have a problem. five days is not enough. people go back to work with covid. the workforce is getting depleted. my solution is rapid testing. at the end, i believe something. i believe that's correct. we need the rapid test. manufacturers and get the rapid tests. >> thank you. >> dana: thanks. at the latest covid surges putting a strain on new york city health care workers. emergency services are reportedly so understaffed, they are asking sick people who are stable not to go to the hospital. that is according to "the new york post" which reports about 800 emts or paramedics are out of work quarter-century with 797 homicides. other democrat run cities like houston or washington saw a crime spike. at d.c. suffering is deadliest year since 2003. head of research and public safety initiative at the manhattan institute. looking across the country at some of the other headlines. incredible that the "l.a. times" saying l.a. gun deaths more than a 15 years in philly. 14 shot as the new year begins. in portland, oregon, san jose, new orleans, so it's not just in new york or chicago. put this in context for rest. how bad is that situation? what should we know? >> is a very bad. there are more than 30 cities across the country that have either surpassed or flirting with surpassing their 1990s speaks in terms of homicides which is really an incredible statistic when you consider all the progress that american cities i made over the last 25 and 30 years. is also very sad to see all that in such a short period of time. and functions as a wake-up call. we understand just how fragile public safety can be. i think one other thing is that we are starting to see as the tide turn in the minds of voters who i think are going to be less likely to be willing to experiment with other kinds of, you know, bail reform and other types of policies that i think i contribute to some of the spirit >> dana: there was an op-ed in "the wall street journal" today. "well the crime wave soon crest?" people have got a taste of what these reforms look like. we see the results. we don't want them. especially in regards to homicide. what is it that was eroded as he mentioned that led to the end result? can you pinpoint it? >> i think it is a combination of factors for sure. there's never any one single explanation. one that we have seen is a broad trend toward the incarceration. the last decade or so between the prison population decline. leasing arrest declined by more than a quarter. we've seen tens of thousands of police officers leave the force and not be replaced. all of these trends i think is sort of combined along with the demonization of law enforcement and the pullback in proactive enforcement. all of that is combined to create those circumstances for their crime rise that we have been living through for the last two years. the fact that it's going on two years, mostly now to tell us this was not a short-lived blurb but rather something that we had to take seriously as a public policy problem. >> dana: let's look at new york city for a moment. eric adams was inaugurated on new year's eve or new year's day. on his way to the inauguration, he witnessed a brawl in the subway. he called 911 himself. i thought it was very interesting. who's calling this in? they said adam, the mayor adam. is this a new possible approach for crime here? he's not going to ignore it or sweep it under the rug. >> i am very encouraged by the fact that mayor adams ran on a platform of being the anticrime mayor and bringing back some of the proactive enforcement techniques that the nypd is known for. i think that is a really, really good thing. i also think it is important that we have a mayor who has lived in new york city, who spent some time in the police department and who understands and has seen firsthand what some of this crime looks like. obviously, we saw a taste of that with a 911 call. what is discouraging however is that mayor adams was elected alongside a new district attorney for manhattan. very many radical city council members were elected to the city council in new york. the infrastructure just may not be there. as much as he wants to try to make things better, he is going to need a team behind him peered one of the things i worry about is whether that team exists in albany, the city council, the district attorneys in the five boroughs per there are a lot of people have committed themselves to prod the incarceration who see policing as a net negative for communities. >> may be mayor adams will use his pulpit. everyone is paying attention. he could possibly put pressure on the other entities in that way. thank you and happy new year. >> thank you. >> trace: nearly a year after that january 6 the riot, capitol police are facing major staffing challenges. but the force is doing to shore up its ranks. and after being caught partying mass close in florida, congresswoman alexandria ocasio-cortez is lashing out at her republican critics. she says they are mad because they can't date her. sean duffy on that and more coming up. with directv stream i can get live tv and on demand anywhere. look, serena williams... matrix... serena... matrix... serena... matrix... ♪ ♪ ♪ get your tv together with the best of live and on demand. introducing directv stream.
