his show. we do not know the answer to that, because we did not speak about it. on the show. but nevertheless, i think it is to remember another cnn anchor, just a few days ago, who use the video contact to help his brother. it did not turn out well for him. >> here is the core issue. did it cross the line from going from a typical journalistic hook that they give to source and even people that they know, to try to get them to reveal more information from news gathering purposes. or did it cross the line, between providing information to jussie smollett that was helpful to small at, and then trying to maybe, gives small more information. the only way to no comments were don lemon and for jussie smollett to release all of the tax and all of the emails. this could actually be just what journalists do. but if it went beyond that, if it went into the cuomo direction of controlling, influencing, directing, giving ideas. counseling. you've got another problem on your hands with cnn. it is kind of like this new covid variant, we should not jump the gun to conclude that lemon is guilty. he needs to help himself and release all the texts. >> yeah. interestingly, jussie smollett, on trial, this bombshell for cnn's don lemon. we talked to him back in 2019. let's play. >> we should not forget, innocent until proven guilty, of course. innocent until proven guilty. like i said, a lot of this just does not add up. if jesse's story is not true, he squandered the goodwill of a whole lot of people. he even lied to a lot of people, if it's not true. that is not cool. >> has a personal relationship with jussie smollett. the tax would certainly cleared up. >> reichard i was just looking at a "usa today" piece from 2019. don lemon was talking to jada pinkett smith and he indicated that he tested jussie smollett daily, that was the use where he used to characterize the relationship. again, that was from "usa today," and 2019. i think already hit the nail on the head. we have to ask ourselves, is a relationship beyond a reporter trying to get more information. when you were in your last job and when i was in mine, reporters email you all the time. you can even have very friendly relationships, because you are all working together at close contact. clearly, don lemon has talked about the camaraderie that he had with jussie smollett, both being, and persons of color in the media. and the struggle that they have had to go through. you can see how they would have a camaraderie over that. what we really need is the answers for, does this go beyond camaraderie? does this impede a police investigation? at the heart of this, is of, jussie smollett, the hate crime that happen, when it in fact had not. it was wall-to-wall coverage, not just at cnn but elsewhere. now he is charged with six counts of federal, felony disorderly conduct. >> recall back in february 2019, first there were charges that were ultimately talked out. then a special prosecutor was appointed. we sort of went through the prosecutor that time, saying he was committed to ethics and committed to transparency. there was a lot of back-and-forth that brought down the house at the same time concurrently as these charges are being filed for that special prosecutor was eventually instated, that resulted in this six count indictment. for six counts of public disorderly conduct here now, they are in illinois, that is what filing a false plate report falls under. the reason there are six counts is because it accounts for each of the alleged did six times that jussie smollett was alleged to have been dishonest with police officers. it involves three different police officers in all three are expected to testify. note that it is the lowest level of felony conduct in illinois. it is not really that serious from a judicial's perspective yet it brings with it the potential for three years of jail time. >> can they call back the cash from him? i know that that was in the talk early on. is that still something that can happen? >> at that point it was more of a talking point. the chief said he absolutely wants him to pay for all of the damage. it is not. this is the criminal side parents are not the civil note as well, that that same case, i disorderly conduct case for a false police report happened back in 2011 when a guy alleged he had opera tickets that he was beaten and robbed. it turned out he just did not want his wife to know he did not have tickets. he served no jail time, despite the conviction peers so that is the precedent we are looking at here with jussie smollett in terms of actually serving jail time. >> harris, really the cross-sectional legal pay, paternalism involves what happens yesterday. spew when i ari say this. not all journalists behave this way, don lemon. not everybody does that. not everybody is texting back and forth and giving you information from your sources, which is what we were talking about on the focus, last hour. that is in a different lane then, hey dude, i heard this. he has got sources on a story that is covering and he is giving that information potentially in a text message to someone who is a principle, he could have been the victim, could have been charged. he was in that nebulous zone of jussie smollett. he is the principal in a case of a crime that he says happen. either way about a come as it turns out, he has been accused of making it all up. it is just not a good look, for don lemon. it is worth getting to the bottom of whether or not that journalism was put by the wayside and something else was going on. it is not a good look for him and cnn. not everybody performs this way as journalists. first of all, we would not be able to keep our sources. >> he is in his own hot water. he is facing sexual harassment charges of his own. he is a defendant. that also ties in with what does cnn know, and as we draw similarities between that and the chris cuomo situation, in terms of cnn and their response and whatnot, is that plays out. as well as this intersect between don lemon and jussie smollett. >> harris: what does cnn know seems to be something that we see a lot. it's only to say. >> we think about those topics between chris cuomo don lemon, just the host of problems that he could listen under each of their names. yikes. coming up, parting shots as we prepared to leave office. the intense backlash at mayor bill de blasio's mandate that all private sector workers in new york city, get vaccinated. in three weeks, or else. ♪ ♪ >> harris: he could have just said this is how i put my political career first. they say that they were blindsided. one of new york city's biggest business groups, representing the likes of pfizer, pepsi, american express, he says he cares about vaccines, but visine is on the list. they are going against bill de blasio's announcement yesterday that all private sector employees in the city must be fully vaccinated, as of december 27. as they say they were no indication to move. this is a policy expected to affect nearly 200,000 businesses, just 20 days from now. that's like three days before he leaves office. on the big apple street, big action. >> i am not a fan of the mayor. but at this point in time i'm not care who makes these mandates, make them peer to do it. >> people have to have a choice. i can appreciate safety of the public. it is important. but he has his own agenda right now. to get the stuff and before hand and why? we know that there is a new mayor coming in. some people might object to the child been vaccinated. i think that it is better for the country to have everyone who is eligible to have that protection. >> harris: i don't know what she was talking about. because 11-year-olds don't have jobs. but anyway, the issue with this that i see, because he can see it now. our viewers can see it. there are a ton of people who are here. as the holiday season. we have a huge tree on fox plaza. those people are eating. those people and businesses can mandate all they want but you're getting exposure anyway. you have to make money for the city. are they going to send the torisel now? is the boss you're going to do that before he leaves office? >> this is a desperate political play before de blasio leaves office. businesses are already slammed. there is a worker shortage and now this. if you saw president biden's vaccine mandate was bad, this is were spared biden targeted bigger businesses, this targets all of them. biden said, you have four months. he says you've got until december 27th. i don't agree with the biden vaccine mandate, but this is beyond that. it is almost as if he is imagining himself on a political debate state for 2024 or beyond, thinking, biden is here. i want to be way far left over here, so i can hold the mantle of liberalism. that's what this is about. >> harris: i have news for him. that is not why he got the primary. that's not why he was not the nominee. emily. >> emily: the argument here, is that we know that the president's mandates are being tied up in court. that their request to stop these mandates for these injunctions have yes, being approved by the corporate so what is different here? why is this legal and enforcement and implementation, and the mayor has argued that it's about proof. so regarding the present, we know that those orders explode from the osha and cdc. the issues at that the legal authority, whether it flows from those entities. de blasio says that the mandate is coming from the health commissioner. who has legal authority, he argues. when there is a significant threat, credibly perceived or otherwise against public health, covid and its ongoing spread illustrate that clearly. there will be a different form of litigation, as i'm sure we can expect. it will be a different legal authority, and a lot of our conversation have touched on the fact that here, the authorities for these kinds of mandates come from state and local levels. it seems, on its face, little more likely that this is more legal than something flowing from the federal government. albeit, overbroad and not narrowly tailored. >> harris: i'm going to ask you to sit by for a second i want to stick on the legal. one, the new mayor comes in, can he undo this? >> sure. if the health commissioner donezo. >> harris: what is a health emergency? the wider usage of video footage that i've seen but what he did not see is that 89% of the city is already fully vaccinated. or has had at least one shot. i am not sure, what now makes it necessary for him to do this. >> according to de blasio in his office, omicron is part of it but what you're arguing is part of what we will see in court. that scale of the emergency is not commensurate with this sweeping mandate, given the percentage of those who been vaccinated and given the mild, if any threat of omicron. those of the arguments we will see play out. as far as he authority perspective, technically yes, the health commissioner does have that power. if it is overbroad, if it is not rooted in science and data an actual fact. >> harris: one has it ever been with these mandates? anyway. i want to get into the politics of this. the spokesperson for you new york city's incoming mayor, the air elect, eric adams. issuing the statement through the mayor elect will evaluate this mandate and other covert strategies, when he is in office. make determinations based on science, efficacy, and the advice of health professionals. is that far enough? >> ari: i think when you are the incoming mayor like that, it is far enough. how much more can he go wash mark maybe he does not have the information. but let me just make this, let me make two points. this is the worst transition i've ever seen from mayor to mayor. from an outgoing mayor to leave a bomb like this on the doorstep of the incoming mayor is amazing to me. is every thing that is wrong with bill de blasio and his arrogance and bad government style. secondly, in terms of this, i try to be fair about these issues, as you know. look at what we mandate for schools. you have to have rubella, you have to have the vaccines to get into schools in new york city. and throughout the country. so philosophically, a mandate can make sense in a certain circumstance. but when there is this level of resistance, it just seems to me that it is wrong of government to try to shove something down people's throats. particularly, the consequence will be that new york city, five to 10% of people are just going to not take it. they're going to rebel. they don't work for shortage, when that happens, and especially with transportation industry and trucking industries, this will amount to another shutdown of the private sector. this goes back to the beginning of covid when we told people, do not come to work, we will shut you down. that will be the consequence if industries do not have enough employees. stop with the mandates, you have to let these things take time, and ultimately, maybe become successful as the childhood vaccines come to accept. you do not do it through mandates, yet. >> harris: do you know i love about what are you just said, he is looking down the road. where we are with society and policy and politics in all of that, we have to look down the road. where do we want to be with this virus? we want to be stuck where we are right now, another two years from now? what do we need to do? if the mandates are not working, can we nuance our plan and base and more on science? i don't know. i am just asking the questions. what are your thoughts? >> i think it will continue to be on a state-by-state basis, where you see some more draconian methods that the people will call this from, mayor de blasio. in blue states. and then more open measures in places like florida, texas, here in tennessee. the real test is to look at the blue state mandate, not only for vaccines, but for masks and other things. compared with the data from the red states, let's really see where a year and a half come almost two years into this, let's see which system works. by the way, if the mayor wants to declare some sort of emergency, he should declare emergency over the crime levels. there was less then, there averaged about ten covert death last month, and every death is tragic. that was in new york city. but guess how many violent crimes we had a new york city last month? 10,000. and 2,000 were assaulted. if you want to really get serious about fixing a city, which i hope and think that erica adams will, let's deal with the crime epidemic that you don't even want to walk around by yourself at night often come as a woman in certain neighborhoods anymore new york city. that is a tragedy. >> harris: yeah. whoever you are. crime does not know that boundary. it just does what it does. literally, on the loose. i don't live in new york city, but i am watching to see what happens now when this former republican and former police officer of 22 years gets into office. how different will it be? all right. just ahead, jen psaki says that the white house does not refusing to say who bought hunter biden's recently sold steak in a chinese firm. this, despite critics demanding transparency from the white house, saying that the president's son and his business dealings bring in huge ethics concerns per look at the change from yesterday's briefing. >> shortly after president biden's virtual meetings with the chinese president, his attorney said that he has taken from the chinese investment fund controlled by state owned entities. i was hoping that you could comment on the transparency about this transaction, including the name of the buyer, the dollar amount, and the timing. >> the president's son is not an employee of the federal government so i appointed to his representatives. >> if this was under a different administration, dare i suggest the answer would have been, probably far different and so too, with the media reaction. >> ari: that is exactly what i was thinking. if this was the trump of children it would be a feeding friend to my friends in the press because they know it's connected to the president. in the case of the trump children, at least they were actual legitimate business people come on like biden. hunter biden has made a career of cashing in on his last name and having relationships with powerful people, often international, who want access to the vice president and now the present or the perception of access that he was selling. this is a problem throughout this administration. the biggest issue and what frustrates me to no income is how most of the white house press corps could care less. they just let it go, because it is joe biden. this is part of the whole original problem with the way that the press coverage of the biting campaign from the start in a way to cover him now as president, i don't think there could possibly be an ethical lapse, problem caused by joe biden's on. they rolled her eyes when they hear the word hunter. it is a legitimate inquiry in the white house ought to answer it. >> that is right. morgan, dare i say that it is deceptive, almost dishonest, to say that because hunter is not an employee of the federal government, that absolutely means that there is zero question that you cannot even, to ari's point, raise a legitimate inquiry and ask questions. field questions, because of that lack of employment, when ethics covers everyone. >> yeah. that is such a joke to say that. it is president biden's son. there have been many news reports that have a link president biden to some of hunter biden's business dealings. there is not conclusive proof, there is a lot of, there are people that have worked with hunter that have came forward and said, that president biden, the time he was the vice president, that he met with some of the business partners. there is legitimate questions about the direct connection to the president. also, a january 20th, when president biden was sworn in, he promised to be the most transparent administration in history. that is thrown out the window. there is a lot of legitimate questions. it is not all disinformation, as we were told in the campaign. legitimate questions into the chinese company that hunter biden reportedly is part owner of, that has a mine in the congo. there has been, reportedly massive human rights abuses and even deaths of the employees of this mine in the congo. if the president's son is a part owner of a chinese company that is committing human rights abuses in africa, i think that is important. just to start. not to mention the other issues we could go through in the next hour. we definitely agree, and not even entertaining those questions, not even allowing a question, i think also raises, it adds a level of opacity to your point. the utter lack of transparency that this in administration promised all of us from day one. kaylee, jen psaki was also asked about hunter's laptop. take a look. >> my colleague, the laptop from. i was hoping that you could confirm that the laptop is indeed authentic. i did not what was suggested on twitter last year. >> as it relates to the book, i neither have the time nor interest in exploring or reading the book. >> but she does have interest income on the laptop stolen. this info in the campaign. now we know that hunter says the laptop possibly could be his. will let me take a wild guess. the laptop has pictures of you and text with your dad, it is probably your laptop. just my guess. this is inexcusable to me that she will not answer a question about this. because what makes this comment to me, presidential white house territory, it is if you had a candidate, joe biden who said, i will not have my family and business dealings that gives a conflict of interest on appearance of a conflict of interest. well when you have a three and a half hour phone conversation with president xi of china and we do not know if your son has disentangled his involvement in the firm, before, during, after this call. there is on intersection here that treads on your promise. there are questions that need to be answered. referring to hunter's attorney, who then, not answers questions. >> the media is supposed to be the watchdog of their government. when you add in social media platforms that mute outlets like "the new york post," for daring to even raise these questions are publishing legitimate fact-finding results of their inquiries, then there is no way for the american public to even ever get their answers or be exposed to the facts. >> wow. i do not even know where to start with where we are with jen psaki. i want to believe that there is not complicity there. i want to know that she is just brush it off. they have all decided that, you know, the coverage of this is silly. it should be blocked on social. maybe they are in that lane. maybe there's something else going on here. like maybe there is a commanding patrol situation where they are being told that they cannot talk about this. and the person to do that, as the man with the title commander in chief. we do not know what he knows and does not know about his son's dealings. we do know that cobalt is important to their agreement. in that mind that morgan was talking about was for the production of cobol. if a son is mixed up in some sort of dealing, to acquire that substance that is so important to the biden administration, i think there are a lot of questions we need to be asking. is there something else going on here, rather than just jen psaki moving her mob back and forth say nothing to see here. if someone is trying to cover some enough, i think we need to get to that. if they are not, we will get to that too. we have to ask the questions. >> coming up, disney is refusing to edit steven spielberg's new "west side story" raising questions of why hollywood picks and chooses which censorship battles to fight. morgan, it's really interesting. this is not the only case where a movie has been altered to appease china. there was a case, tom cruise where he had symbolism on a jacket for taiwan. the jacket was changed. there was a marvel film. there are many other examples of this. it is an interesting double standard. before a lot of the started back in 1997. disney produced a movie called clayton tune. that movie was about the life of the dalai lama. that got them in major trouble in china pier they were banned for almost two years before they were allowed to reenter. disney, and many other corporations by the way, i am not just picking on them, you have seen other hospitality corporations, we will take taiwan off their website. many corporations, american gulf corporations that are supposed reps and our values, instead, when they go to china, they are beholden to the chinese communist party. whatever they want them to do pair this is a regime, by the way, that is overseen currently, right now as we were all speaking and watching. and so, what we really have to ask ourselves, is why is this american corporate convergence with the chinese communist party. are they so willing to make money that they will overlook a? it does not have to be that way. women have shown us how to stand up to the chinese communist party peer that is freedom to stand up. corporations need to have more got some more willingness to stand up. >> no doubt paired women's status. i canceled ten matches there. a cost of my belief, $40 million. they are sending an unmistakable signal that they are going to stand up to china. i know you have a view on this, it is a diplomatic boycott but interesting in comparison of the two. >> ari: let's start with a dippel medic bar card. it's a good idea. i'm glad the biden administration is doing it. but why is it unilateral? i thought joe biden was going to organize all of these international coalitions and he was going to be america first or america only? wise in france england, italy, why didn't joe biden work with them behind the scenes? that is a failure by the administration not to make this international effort. in terms of, where you really have leverage over china, it is america's business community. america's business community is just week, and it just makes me angry, and angers anybody who thinks that morality has to play a role in capitalism. if it was vladimir lenin, who allegedly said, that the west is going to sell us the rope with which we will hang. americans, businesses, seem to want to sell rope to china. if i read in american business, i would be looking for ways to wind it down and wanted out and get out of there. there is no good economic future for america business in china. the only way to be there, is to let them steal from your pocket, which of the price of doing business in china. to allow them to make knockoff products of what you have, to violate your intellectual tax. it is a price that people pay because they think they can make money peer they know they are doing wrong. it is time to wind it down and get out of china. >> we see so many examples of this caving to china. john seen apologizing to china for calling taiwan a country. >> harris: i cannot speak for john cena, i do not know what he knows and what he does not know. if he reads or any of that. those are all questions in our minds. but china lied to us. they helped kill millions of people around the world. they stated what they didn't know about a virus that has so changed the way that we live in america that we fight each other over things like mandates and masks and vaccines. china. that's who china is. why do you want to do business with china? supply chain prices? some of those things coming from china? you don't think they will try to benefit from them? of course they are. they are to benefit from, overlook their containers are trapped. let's hold things back even more and make it even more expensive for america. that's who china is. why do you want to do business with china? >> with a country committee and at the top of the hour for america reports. see you then. >> harris: it is december 7th, 80 years to the day since the horrific attack on pearl harbor. we lost 2400 u.s. service members and civilians. when japan launched that surprise assault on our naval base in hawaii. until september 11, it was the deadliest attack ever on american soil. president franklin roosevelt, famously called december 7th 1941, a date which will live in infamy. as it pushed the united states into world war ii. this year, dozens of pearl harbor survivors, just 150 them, will gather. 40 of them are veterans of that very day. most of them now, nearly 100 years old. attending the ceremony. and it just moments from now, we will mark the exact time of the deadly bombing with a moment of silence. it is 12:55 p.m. on the east coast, when this happen. in 7:55 a.m., local time in hawaii. and so about six and half minutes, we will take that moment of silence. today's ceremony, valor, sacrifice and peace among honest sacrifices of those who died in that attack while paying tribute to the allies ultimate victory in world war ii. an amazing moment that is about to come up. ari fleischer, come to you. >> ari: i think of september 11th because i was press secretary would not attack snuck up on our country. it had that, the world has changed feel to it. i don't think it changed our world is much as the attacks on pearl harbor, because it launched us into a four year world war. a war that had already been raging for two years in europe, against the. america had chosen to stay out until pearl harbor. i want to pearl harbor, the one and only time i've been there, five years ago. i took my family. it is such a place of sorrow. a place of honor. anywhere you go, that is the american military is in charge of, is always a place of honor. >> harris: amen. >> ari: a place of tradition. a place of right and wrong. a sacred place of memory. that is the best thing about perl. it is a faithful memory to those who lost their lives, including a battleship that lies underneath the water, just a few feet, easy to see. from that little floating island. it is a sorrowful place but it is a place everybody has to go, at least once in their life. >> harris: we know that just shortly, they will open up a satellite picture, which we will show you live, at kilo peer for the main ceremony. we know that the secretary of the navy is going to be the keynote speaker. he is set to begin with some of the ceremony there, just shortly. what we are going to look at now, is videotaped. as soon as we can show you the live pictures from there, right before the moment of silence, we will. famously, the japanese sync multiple battleships, on that awful day. uss arizona, the uss oklahoma, the uss west virginia, and the uss california. directly prompted, as already with just saying, us to enter our commitment into world war ii. but imagine, the way that the whole landscape of the country, and what we talked about and what we held sacred, and the safety that we thought we had in america, shaken there. 2,403 americans dead. the attack on pearl harbor on december 7th, 1941, continued for two hours. and 20 minutes. morgan. >> morgan: it is just so hard looking at these images, to even imagine, what it was like for our sailors who were there that day and for their families. people who, like you said it was an ongoing attack. i look at it today, and how important it is and i think about what we do with the legacy of the greatest generation. we are losing about 245 of them a day, as you mentioned, they are getting elderly. i've got to tell you, harass, as we were coming up from commercial break, i was think about my friend, my neighbor, who we just lost this week, bob dole. most of you know him as a great senator, we all know his acts of heroism in world war ii. i know him as my neighbor, for the past 15 years. he famously once asked me, if i would name my daughter in edina after him. i said well, it is actually going to be a girl. he said that's fine, name her roberta. i was just a little emotional coming in from the break, thinking about him and think about elizabeth. that was the love of her life. the way that those two looked at each other, even over the past 12 years that i've seen them. the way that they still look each other, was one of the most beautiful things i've ever seen. i think about him and all of the veterans that we are losing. i sort of recommit myself, how can i be a better american? how can i exemplify what we saw these brave people, the greatest generation do? that is my thought today. >> harris: so many people to remember. emily, you have a family connection. >> i do. as we mourn the loss of those lives lost on december 7th, there were survivors among them, who you are looking out right now. my great, great cousin, anton lorenz. this is a photo of him in 1925, he was part of the yangtze river patrol. he served his entire career for our country and he was stationed at pearl harbor on december 7th, 1941. he was one of the survivors. he ultimately retired after a decade as chief commissary steward. he was a cook. i am so proud of him and his legacy. i honor his service today. although survivors on that day as well as those that lost their lives at pearl harbor, december seven, 1941. >> harris: while paired we are watching live. this is the japanese military left the skies over hawaii, our pacific fleet was decimated. forever changed, the performance, if you will, of all that we were doing worldwide. then it became war. that came with a great cost. we had more than 16 million u.s. service members who fought in world war ii. only over 3 understand -- 300 are still alive. they are in their 90s. 245 of them die every day. we are
