"fox news @ night" starts right now. we began tonight with a deadly car attack at a christmas parade waukesha, wisconsin and the criminal record of the suspect in custody. tracking the latest developments from waukesha, wisconsin good evening, mapped. >> this is the parade route in downtown waukesha and throughout the day, rather calm and quiet compared to sunday when this area was bustling with shoppers and parade goers before the unimaginable happened. >> more eyewitness video was emerging revealing the horrifying moment this beating red suv plows through the joyful waukesha christmas parade sunday afternoon. one woman who shot ariel video says it appears to be intentional. >> the car didn't stop. he went completely -- >> 39-year-old darryl e brooks jr. was the alleged driver acting by himself. the authorities do not consider this a terrorist attack. before the car attack they were responding to a domestic disturbance call with brooks who left the scene and then drove through a barricade and onto the parade route. brooks has an extensive criminal history dating back to 1999 including multiple felonies. court documents said he posted $1,000 bail on charges he intentionally ran over the mother of his child with his vehicle. the police records read "officers observed swelling to her lip and dried blood on her face and dried blood on her left pants leg. they are conducting internal interview with no bail recommendation for brooks. the police now say five people are dead ranging in age from 52-81 years old. and all 18 children ages 3-16 taken to the hospital, six in critical condition. just days before thanksgiving, the milwaukee suburb welcoming the season of light with the parade is now in dark morning. >> last night the wonderful work he showed parade became a scene of a horrific incident. that became a nightmare. >> with the police announce they will seek five charges of first-degree murder against darrell brooks who we have one has an active warrant in nevada for failing to evade sex laws, shannon. >> shannon: matt finn, thanks, this weekend the upper midwest tunnel across twitter, the now 18-year-old rittenhouse responding to to defend himself against attackers." the family of one of the men killed by rittenhouse hope that the trial would bring them closer, but that did not happen. shannon. >> shannon: laura, thank you. raining in northern california with two mass including incidents in the san francisco bay area targeting high-end retailers there. course planner jonathan hunt in the west coast roots room. >> multiple reports coming in of these kind of robberies involving groups of people. nine people apparently broke into a men's warehouse in pleasanton on the side of san francisco. and fired several shots at a police vehicle in oakland after breaking into a cannabis business and shots were also fired during an attempted robbery at a dispensary and that was just today. but saturday's incident in walnut creek was the biggest and most brazen and what the police say are a highly organized thefts. dozens of people drove up to the nordstrom store running in and smashing display cases, grabbing goods and taking off in their vehicles. two nordstrom workers were assaulted and one pepper sprays there pepper sprayed by the attackers. only three of the estimated 18 have been arrested but the police promised more arrests as california governor gavin newsom called for action. >> we want real accountability. we want people prosecuted. we want people to feel safe this holiday season. speak three times in less than two years with recklessly endangering the safety of others and most recently november 5th as part of domestic abuse and charged with obstructing an officer in the most recent case, the woman told that brooks and her over while walking through a gas station parking lot after he had followed her there after a fight. according to a criminal complaint, out on the street in a very long rap sheet and recent charges against him, significant ones. >> look, shannon, what you are seeing is many years of efforts by the far left to decriminalize crime and they've used reducing bale in certain areas to basically eliminate it throughout the united states and certainly american cities that is what has happened and i sit here litigating this issue in california only eventually to have the leftist enter into a deal to resolve their case. so what we have is these liberal prosecutors are basically treating even violent criminals like this guy a repeat offender a child rapist for a father with 15-year-old no threat to the public. the purpose of bail is to ensure the defendant returns to court for his hearing. but what we have here is these people treating bail like get out of jail free permanently card. you know, that is what has happened here. these people's lives were lost due to the negligence of the milwaukee county prosecutor. not the one in waukesha but the neighboring county. >> shannon: again, the one told the police he punched her in the face and later ran her over with the carpet she try to get away from him. the prosecutor set the bail at $1,000 and he made that and got out november 11th. and the bail recommendation, not consistent with the approach of milwaukee county district attorney's office towards matters with violent crime nor consistent with the risk assessment to setting bail. jim, sounds like we got this one wrong. >> this is abject failure, shannon. the bottom line is bail is supposed to be decided on not just risk of flight bit dangerous to the community. this guy has a record longer than my arm a serious felony crimes. he's out in 2024 shooting towards his nephew. he's a felon in possession of a firearm at that point. he has this other incident just two weeks ago where he tries to run over a young woman and he has a felony bail jumping charge from that. he has hit every bell for beating pretile detained. so it is an absolute failure by the district attorney's office but also by the judge and no matter what the judge was doing no judge to exercise discretion to let this guy go out and conduct what he did on the streets the other day. this is exactly why you end up with mandatory sentencing i'm a three-time loser laws. as much as judges ask for discretion and say "trust me, i have." you have high profile where they failed the community. >> shannon: it is absolutely heartbreaking for the families and loved ones. i want to get you to commit what is going on in san francisco major looting in the bay area, multiple stores but meanwhile check voting i'm outraged by the union square and several crimes across the country but simple message don't bring that noise to our city, great work, stand by for charges. that is your neck of the wood so i will let you take a first crack at that. >> this is ridiculous and i have to restrain myself from using the language i really want to use. i've lived in san francisco 20 years and under the leadership this has been every single day. during the pandemic multiple incidents of this kind of gang looting and it's gone unpunished. burglaries have gone unpunished in my talons. car break-ins have gone unpunished in the police are downsizing. the police don't bother to respond to this type of offense. the fact that they happen to be there because, you know, a shopping area and it's christmas time. i'm glad for those stores, and i'm glad that this happens every single day in the city. in case of boudin he knows very well the crimes go on because he as one of these woke prosecutors refuses to do his job. with a single position of district attorney, he is effectively overruling the criminal laws in california because he refuses to enforce them. this is unacceptable and that's why he's facing a recall and suddenly woke on his job to do the prosecution of these types of crime. >> shannon: recall effort can make you change the way you see things in your community. , i want you to comment on the rittenhouse case because the last time we talked about this t yet but tonight, kyle rittenhouse telling tucker carlson he wished the president had watched the trial and known defects before he said something about calling him a white supremacist. it is malice, defaming his character. do you think there will be those -- not the president by others facing serious challenges from rittenhouse and he and his? >> yeah, i think that actually include biden because he wasn't present yet. look, this is nicholas sandmann part 2 a young man being plastered across the country by talking heads, by political figures. people who should know better than to rely on rank emotions and care more about the narrative than the evidence. when the evidence the folks who were actually naturally infected, previously infected are very robustly immune. in fact, the level of protection in the study seems to be 100% on the part of natural immunity. but now i want to be clear to you and your audience it does not mean to go out and get infected. it just means if you have been infected and particularly as you and i have talked about before, if you actually are positive with antibodies from a prior infection it is highly highly effective as robust as fully vaccinated person if not more. the study says you're more immune more robust. >> shannon: with that in mind, that dr. chief epidemiologist and the public health division says to the oregon public radio about prior infections, she said "think of coronavirus like a bag of skittles and i get infected
